<section id="HB8C4A332EA7447AB9EEB4AC18D32A556"><enum>2.</enum><header>Findings and purposes</header><text display-inline="no-display-inline">The Lake Tahoe Restoration Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/506">Public Law 106–506</external-xref>; 114 Stat. 2351) is amended by striking section 2 and inserting the following:</text>

<section id="HDBC4CE494E8A49D796AA7E76B76CB27D"><enum>2.</enum><header>Findings and purposes</header> 
<subsection id="H527BA6AF6AAA4119BA77EF77B494F070"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> 
<paragraph id="H6F36CDCD682A48E3A89AA54A4BD1F646"><enum>(1)</enum><text>Lake Tahoe—</text> 
<subparagraph id="H1AF4CC7A140248A290A534352DD62FF5"><enum>(A)</enum><text>is 1 of the largest, deepest, and clearest lakes in the world;</text></subparagraph> 
<subparagraph id="HE71AAAB5E6B948EA9987F7CD7A42EF9F"><enum>(B)</enum><text>has a cobalt blue color, a biologically diverse alpine setting, and remarkable water clarity; and</text></subparagraph> 
<subparagraph id="H4266D7A341AA4BCCB7CC8525F07D53CD"><enum>(C)</enum><text>is recognized nationally and worldwide as a natural resource of special significance;</text></subparagraph></paragraph> 
<paragraph id="H608DB4CD1B304157ABFE215EA4D97AE5"><enum>(2)</enum><text>in addition to being a scenic and ecological treasure, the Lake Tahoe Basin is 1 of the outstanding recreational resources of the United States, which—</text> 
<subparagraph id="HCE8569D2AF584546B4AC78D56152E544"><enum>(A)</enum><text>offers skiing, water sports, biking, camping, and hiking to millions of visitors each year; and</text></subparagraph> 
<subparagraph id="HD47BC96EE2C646A480489335AD4D7E58"><enum>(B)</enum><text>contributes significantly to the economies of California, Nevada, and the United States;</text></subparagraph></paragraph> 
<paragraph id="H86ED769E55E9498C994F81804601D5DD"><enum>(3)</enum><text>the economy in the Lake Tahoe Basin is dependent on the protection and restoration of the natural beauty and recreation opportunities in the area;</text></paragraph> 
<paragraph id="HA381D741BD434093B7FD298B621682E8"><enum>(4)</enum><text>the Lake Tahoe Basin continues to be threatened by the impacts of land use and transportation patterns developed in the last century that damage the fragile watershed of the Basin;</text></paragraph> 
<paragraph id="H539AB5F870234477AFEE02437DB045C7"><enum>(5)</enum><text>the water clarity of Lake Tahoe declined from a visibility level of 105 feet in 1967 to only 70 feet in 2008;</text></paragraph> 
<paragraph id="H19FDF21E7183404E817B6E43591AB5A2"><enum>(6)</enum><text>the rate of decline in water clarity of Lake Tahoe has decreased in recent years;</text></paragraph> 
<paragraph id="HF25938335D50467CA4BC88E643188011"><enum>(7)</enum><text>a stable water clarity level for Lake Tahoe could be achieved through feasible control measures for very fine sediment particles and nutrients;</text></paragraph> 
<paragraph id="H1D50F064C6AA4D3EB074872F8046655B"><enum>(8)</enum><text>fine sediments that cloud Lake Tahoe, and key nutrients such as phosphorus and nitrogen that support the growth of algae and invasive plants, continue to flow into the lake from stormwater runoff from developed areas, roads, turf, other disturbed land, and streams;</text></paragraph> 
<paragraph id="HCC29792AE6BF401FBB8A5956D175E1BF"><enum>(9)</enum><text>the destruction and alteration of wetland, wet meadows, and stream zone habitat have compromised the natural capacity of the watershed to filter sediment, nutrients, and pollutants before reaching Lake Tahoe;</text></paragraph> 
<paragraph id="H8C2B9094621F41ED93CEEA07E90C2434"><enum>(10)</enum><text>approximately 25 percent of the trees in the Lake Tahoe Basin are either dead or dying;</text></paragraph> 
<paragraph id="HD95A8CD0460B484C9E1DBB01E8AB48E1"><enum>(11)</enum><text>forests in the Tahoe Basin suffer from over a century of fire suppression and periodic drought, which have resulted in—</text> 
<subparagraph id="HD6C66AE84B644E12A09AAB913208B5AB"><enum>(A)</enum><text>high tree density and mortality;</text></subparagraph> 
<subparagraph id="HBA19A16DEC624DDABC0B38B17AA253E1"><enum>(B)</enum><text>the loss of biological diversity; and</text></subparagraph> 
<subparagraph id="H8F6216EB0DC54894B52C5F0F96C8713F"><enum>(C)</enum><text>a large quantity of combustible forest fuels, which significantly increases the threat of catastrophic fire and insect infestation;</text></subparagraph></paragraph> 
<paragraph id="HE7933E5D89054AF6BB9DD8F4A7A14614"><enum>(12)</enum><text>the establishment of several aquatic and terrestrial invasive species (including perennial pepperweed, milfoil, and Asian clam) threatens the ecosystem of the Lake Tahoe Basin;</text></paragraph> 
<paragraph id="HEC3E377B8BAB4D1B910CCD4D3B856768"><enum>(13)</enum><text>there is an ongoing threat to the Lake Tahoe Basin of the introduction and establishment of other invasive species (such as yellow starthistle, New Zealand mud snail, and quagga mussel);</text></paragraph> 
<paragraph id="HAB230474091646FEBFBB767925E0C1A6"><enum>(14)</enum><text>the report prepared by the University of California, Davis, entitled the <term>State of the Lake Report</term>, found that conditions in the Lake Tahoe Basin had changed, including—</text> 
<subparagraph id="HE0DE2FB658764162A8A9CC76C61A5B3F"><enum>(A)</enum><text>the average surface water temperature of Lake Tahoe has risen by more than 1.2 degrees Fahrenheit in the past 43 years;</text></subparagraph> 
<subparagraph id="HFF82D3EDC789410A849FE56367BAFCB7"><enum>(B)</enum><text>since 1910, the percent of precipitation that has fallen as snow in the Lake Tahoe Basin decreased from 51 percent to 35.5 percent; and</text></subparagraph> 
<subparagraph id="HA7B69054891949369872024EA6DBAD32"><enum>(C)</enum><text>daily air temperatures have increased by more than 4 degrees Fahrenheit and the trend in daily maximum temperature has risen by approximately 2 degrees Fahrenheit;</text></subparagraph></paragraph> 
<paragraph id="H707D45C5AD324891978DA38E8372A557"><enum>(15)</enum><text>75 percent of the land in the Lake Tahoe Basin is owned by the Federal Government, which makes it a Federal responsibility to restore environmental health to the Basin;</text></paragraph> 
<paragraph id="HAC066E750F7F4F4E9FC139DF713FC332"><enum>(16)</enum><text>the Federal Government has a long history of environmental preservation at Lake Tahoe, including—</text> 
<subparagraph id="H930CEC6A21C3471182320BDDC8329A5C"><enum>(A)</enum><text>congressional consent to the establishment of the Tahoe Regional Planning Agency with—</text> 
<clause id="H109B21EE73D143778075949909CA146E"><enum>(i)</enum><text>the enactment in 1969 of <external-xref legal-doc="public-law" parsable-cite="pl/91/148">Public Law 91–148</external-xref> (83 Stat. 360); and</text></clause> 
<clause id="HB9FC1010D39A4EB1855CADC3F4FEF3AC"><enum>(ii)</enum><text>the enactment in 1980 of <external-xref legal-doc="public-law" parsable-cite="pl/96/551">Public Law 96–551</external-xref> (94 Stat. 3233);</text></clause></subparagraph> 
<subparagraph id="H5B7BD074D5C642FFB67E4A0FF474CCDC"><enum>(B)</enum><text>the establishment of the Lake Tahoe Basin Management Unit in 1973;</text></subparagraph> 
<subparagraph id="H0E8AE6A3AC1E486E8C35BA73D0CDA980"><enum>(C)</enum><text>the enactment of <external-xref legal-doc="public-law" parsable-cite="pl/96/586">Public Law 96–586</external-xref> (94 Stat. 3381) in 1980 to provide for the acquisition of environmentally sensitive land and erosion control grants in the Lake Tahoe Basin;</text></subparagraph> 
<subparagraph id="HFD0EB1C8CF56451D8BDEB4FB8E340F50"><enum>(D)</enum><text>the enactment of sections 341 and 342 of the Department of the Interior and Related Agencies Appropriations Act, 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/108">Public Law 108–108</external-xref>; 117 Stat. 1317), which amended the Southern Nevada Public Land Management Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/263">Public Law 105–263</external-xref>; 112 Stat. 2346) to provide payments for the environmental restoration projects under this Act; and</text></subparagraph> 
<subparagraph id="H34853E88D76C442ABDF5FB753E95A5D8"><enum>(E)</enum><text>the enactment of section 382 of the Tax Relief and Health Care Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/432">Public Law 109–432</external-xref>; 120 Stat. 3045), which amended the Southern Nevada Public Land Management Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/263">Public Law 105–263</external-xref>; 112 Stat. 2346) to authorize development and implementation of a comprehensive 10-year hazardous fuels and fire prevention plan for the Lake Tahoe Basin;</text></subparagraph></paragraph> 
<paragraph id="H999E53D6C4474E6480E29E3483E30B47"><enum>(17)</enum><text>the Assistant Secretary of the Army for Civil Works was an original signatory in 1997 to the Agreement of Federal Departments on Protection of the Environment and Economic Health of the Lake Tahoe Basin;</text></paragraph> 
<paragraph id="H3EC1F0E89BBE488393F76013C1EAE84D"><enum>(18)</enum><text>the Chief of Engineers, under direction from the Assistant Secretary of the Army for Civil Works, has continued to be a significant contributor to Lake Tahoe Basin restoration, including—</text> 
<subparagraph id="H7D7FE3A5DA904533912AE0ED80648B16"><enum>(A)</enum><text>stream and wetland restoration;</text></subparagraph> 
<subparagraph id="HF4751B302B4F4DCCA3978EA07F542834"><enum>(B)</enum><text>urban stormwater conveyance and treatment; and</text></subparagraph> 
<subparagraph id="H88F4FAEF694341E0AE1A6EA7C5873412"><enum>(C)</enum><text>programmatic technical assistance;</text></subparagraph></paragraph> 
<paragraph id="H5B805DD520F0447EAFAA26D6236BD898"><enum>(19)</enum><text>at the Lake Tahoe Presidential Forum in 1997, the President renewed the commitment of the Federal Government to Lake Tahoe by—</text> 
<subparagraph id="H2F415846C16E455C876F9C7F868AD743"><enum>(A)</enum><text>committing to increased Federal resources for environmental restoration at Lake Tahoe; and</text></subparagraph> 
<subparagraph id="H93C47F5D05F944B99B6B47BD072B1233"><enum>(B)</enum><text>establishing the Federal Interagency Partnership and Federal Advisory Committee to consult on natural resources issues concerning the Lake Tahoe Basin;</text></subparagraph></paragraph> 
<paragraph id="H2DF5E22D1B784D6595804BCDC33F24DD"><enum>(20)</enum><text>at the 2011 and 2012 Lake Tahoe Forums, Senator Reid, Senator Feinstein, Senator Heller, Senator Ensign, Governor Gibbons, Governor Sandoval, and Governor Brown—</text> 
<subparagraph id="H656633625E2446D9B5F2F28D028BDEE2"><enum>(A)</enum><text>renewed their commitment to Lake Tahoe; and</text></subparagraph> 
<subparagraph id="HD9D6A049610649C99C3E4D68737C102C"><enum>(B)</enum><text>expressed their desire to fund the Federal and State shares of the Environmental Improvement Program through 2022;</text></subparagraph></paragraph> 
<paragraph id="HDBBCEE1257A748DC9162E4CBEF9275F4"><enum>(21)</enum><text>since 1997, the Federal Government, the States of California and Nevada, units of local government, and the private sector have contributed more than $1,620,000,000 to the Lake Tahoe Basin, including—</text> 
<subparagraph id="H38ED8F9CD85642899F87D3346527811A"><enum>(A)</enum><text>$521,100,000 from the Federal Government;</text></subparagraph> 
<subparagraph id="H442FBB2CAC72446DBA01308228924361"><enum>(B)</enum><text>$636,200,000 from the State of California;</text></subparagraph> 
<subparagraph id="HC15011112E0F4800B7FF4B05051E4C2E"><enum>(C)</enum><text>$101,400,000 from the State of Nevada;</text></subparagraph> 
<subparagraph id="H55B2B0986106452BAE06900DE9956082"><enum>(D)</enum><text>$68,200,000 from units of local government; and</text></subparagraph> 
<subparagraph id="HEFFF64188134481996E730F991FD4EE3"><enum>(E)</enum><text>$299,600,000 from private interests;</text></subparagraph></paragraph> 
<paragraph id="H671B1A68CC3746A8AFDE4682954723DC"><enum>(22)</enum><text>significant additional investment from Federal, State, local, and private sources is necessary—</text> 
<subparagraph id="H1AFC4918AD5249A398300CA0140E69B2"><enum>(A)</enum><text>to restore and sustain the environmental health of the Lake Tahoe Basin;</text></subparagraph> 
<subparagraph id="H259B7233DD8740D1947AB28089B0B575"><enum>(B)</enum><text>to adapt to the impacts of changing water temperature and precipitation; and</text></subparagraph> 
<subparagraph id="H415B21D34B53473C8FAB182A2A6584EB"><enum>(C)</enum><text>to protect the Lake Tahoe Basin from the introduction and establishment of invasive species; and</text></subparagraph></paragraph> 
<paragraph id="H4FAC2ED381354A57AB0B81CCA3D33F6E"><enum>(23)</enum><text>the Secretary has indicated that the Lake Tahoe Basin Management Unit has the capacity for at least $10,000,000 for the Fire Risk Reduction and Forest Management Program.</text></paragraph></subsection> 
<subsection id="HB9B9687647DA4E808E30F41808BDDA90"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are—</text> 
<paragraph id="HF8FC02DFFAD0450D969167E3EEDD87AC"><enum>(1)</enum><text>to enable the Chief of the Forest Service, the Director of the United States Fish and Wildlife Service, and the Administrator of the Environmental Protection Agency, in cooperation with the Planning Agency and the States of California and Nevada, to fund, plan, and implement significant new environmental restoration activities and forest management activities to address in the Lake Tahoe Basin the issues described in paragraphs (4) through (14) of subsection (a);</text></paragraph> 
<paragraph id="HC7A5A55E123E4E67BDEB81728A5D0094"><enum>(2)</enum><text>to ensure that Federal, State, local, regional, tribal, and private entities continue to work together to manage land in the Lake Tahoe Basin and to coordinate on other activities in a manner that supports achievement and maintenance of—</text> 
<subparagraph id="H481B276A0D4E4A698463FF7555935D1A"><enum>(A)</enum><text>the environmental threshold carrying capacities for the region; and</text></subparagraph> 
<subparagraph id="H9FAF93E2F2FB4AAF8FB79FDC0006FCFC"><enum>(B)</enum><text>other applicable environmental standards and objectives;</text></subparagraph></paragraph> 
<paragraph id="H0E850EB72BDC46CB8FC11E64B2D3415A"><enum>(3)</enum><text>to support local governments in efforts related to environmental restoration, stormwater pollution control, fire risk reduction, and forest management activities; and</text></paragraph> 
<paragraph id="H3E97239B42184AED9C3F1058F0DE308A"><enum>(4)</enum><text>to ensure that agency and science community representatives in the Lake Tahoe Basin work together—</text> 
<subparagraph id="H3F535447A36F4FDFB3D18E8C577876AD"><enum>(A)</enum><text>to develop and implement a plan for integrated monitoring, assessment, and applied research to evaluate the effectiveness of the Environmental Improvement Program; and</text></subparagraph> 
<subparagraph id="H7DADD0617D6440F7AAF215B7EB8BA30C"><enum>(B)</enum><text>to provide objective information as a basis for ongoing decisionmaking, with an emphasis on decisionmaking relating to public and private land use and resource management in the Basin.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H0815DCF6C86B4991AA7E1EB4AF4C1BF1"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">The Lake Tahoe Restoration Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/506">Public Law 106–506</external-xref>; 114 Stat. 2351) is amended by striking section 3 and inserting the following:</text>

<section id="HD3509417090A4301B5E482CD3FC5AD59"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HF206BB0A088D4FF38DD628AD16989CB6"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph> 
<paragraph id="HEE6075F4B64D42EF8FD6A3D5411796ED"><enum>(2)</enum><header>Assistant secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of the Army for Civil Works.</text></paragraph> 
<paragraph id="H10AFD1680DB8417AA9E9F85755530A5D"><enum>(3)</enum><header>Chair</header><text>The term <term>Chair</term> means the Chair of the Federal Partnership.</text></paragraph> 
<paragraph id="H8E37C271408440CBB561B543A323D975"><enum>(4)</enum><header>Compact</header><text>The term <term>Compact</term> means the Tahoe Regional Planning Compact included in the first section of <external-xref legal-doc="public-law" parsable-cite="pl/96/551">Public Law 96–551</external-xref> (94 Stat. 3233).</text></paragraph> 
<paragraph id="H39931EE58B124B5CA28A00D55C5EC009"><enum>(5)</enum><header>Directors</header><text>The term <term>Directors</term> means—</text> 
<subparagraph id="H55987FB81738436EA1CB9EE53F67D49D"><enum>(A)</enum><text>the Director of the United States Fish and Wildlife Service; and</text></subparagraph> 
<subparagraph id="H51D28BEFCD4D4312929A53EE6E559253"><enum>(B)</enum><text>the Director of the United States Geological Survey.</text></subparagraph></paragraph> 
<paragraph id="H69058434FD26439A9347227E892B82B1"><enum>(6)</enum><header>Environmental improvement program</header><text>The term <term>Environmental Improvement Program</term> means—</text> 
<subparagraph id="HB5D8286D51B345FBBD8FC5FF2260C740"><enum>(A)</enum><text>the Environmental Improvement Program adopted by the Planning Agency; and</text></subparagraph> 
<subparagraph id="HBFAD752F15C44895B8E440B9F7B003FE"><enum>(B)</enum><text>any amendments to the Program.</text></subparagraph></paragraph>

<subparagraph id="HA69EB8919A584948A9811CBF638C9C1B"><enum>(C)</enum><text>road decommissioning or reconstruction;</text></subparagraph> 
<subparagraph id="HD70A4AA9512842679B33B36BCCE0EEC6"><enum>(D)</enum><text>stream environment zone restoration and other watershed and wildlife habitat enhancements;</text></subparagraph> 
<subparagraph id="HD1022E46DFF2430FAA5EEF095CB2CB15"><enum>(E)</enum><text>nonnative invasive species management; and</text></subparagraph> 
<subparagraph id="H9E5A48D5EDE34A8190EBC7442802380F"><enum>(F)</enum><text>other activities consistent with Forest Service practices, as the Secretary determines to be appropriate.</text></subparagraph></paragraph>

<paragraph id="H0C1182BDF5194B5CA76A418D8356AA74"><enum>(17)</enum><header>Watercraft</header><text>The term <term>watercraft</term> means motorized and non-motorized watercraft, including boats, seaplanes, personal watercraft, kayaks, and canoes.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HDB5CD69B92FF4C429192DFAB38CC0DE6"><enum>4.</enum><header>Administration of the Lake Tahoe Basin Management Unit</header><text display-inline="no-display-inline">Section 4 of the Lake Tahoe Restoration Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/506">Public Law 106–506</external-xref>; 114 Stat. 2353) is amended—</text> 
<paragraph id="HE189C05CA51248E68A2FA244D6DE8850"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(3), by striking <quote>basin</quote> and inserting <quote>Basin</quote>; and</text></paragraph> 
<paragraph id="HF6656BAA92D148BAA9B529E2E3A7A3C4"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

<paragraph id="H52313F119DD348A4A673FA91B4242F70"><enum>(1)</enum><header>In general</header><text>The Lake Tahoe Basin Management Unit shall, consistent with the regional transportation plan adopted by the Planning Agency, manage vehicular parking and traffic in the Lake Tahoe Basin Management Unit, with priority given—</text> 
<subparagraph id="HF4A21B74BDE6413AAB1000AEC634E83D"><enum>(A)</enum><text>to improving public access to the Lake Tahoe Basin, including the prioritization of alternatives to the private automobile, consistent with the requirements of the Compact;</text></subparagraph> 
<subparagraph id="HBDDBC4367412435B90FDC876E12A1D60"><enum>(B)</enum><text>to coordinating with the Nevada Department of Transportation, Caltrans, State parks, and other entities along Nevada Highway 28 and California Highway 89; and</text></subparagraph> 
<subparagraph id="H5D0FFFD236C84E97BF6BEEC9092B3DD1"><enum>(C)</enum><text>to providing support and assistance to local public transit systems in the management and operations of activities under this subsection.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H986CA1AE601E4929B47769116D976EB6"><enum>(2)</enum><header>National forest transit program</header><text>Consistent with the support and assistance provided under paragraph (1)(C), the Secretary, in consultation with the Secretary of Transportation, may enter into a contract, cooperative agreement, interagency agreement, or other agreement with the Department of Transportation to secure operating and capital funds from the National Forest Transit Program.</text></paragraph></subsection> 
<subsection id="H5E50607B9F1F4A6BA3A048E7A186E51F"><enum>(d)</enum><header>Forest management activities</header> 
<paragraph id="H93A443DD3D4C46318E85357E122BC10C"><enum>(1)</enum><header>Coordination</header> 
<subparagraph id="HC900C6E6C651436E8570642DCC828900"><enum>(A)</enum><header>In general</header><text>In conducting forest management activities in the Lake Tahoe Basin Management Unit, the Secretary shall, as appropriate, coordinate with the Administrator and State and local agencies and organizations, including local fire departments and volunteer groups.</text></subparagraph> 
<subparagraph id="H99C9463C3B594BDCB9E875CB2ABDE892"><enum>(B)</enum><header>Goals</header><text>The coordination of activities under subparagraph (A) should aim to increase efficiencies and maximize the compatibility of management practices across public property boundaries.</text></subparagraph></paragraph> 
<paragraph id="HBFF11B46A0054D9B8AB9DD068304DE37"><enum>(2)</enum><header>Multiple benefits</header> 
<subparagraph id="H3234C12ACAB74344B4C907DB512C158F"><enum>(A)</enum><header>In general</header><text>In conducting forest management activities in the Lake Tahoe Basin Management Unit, the Secretary shall conduct the activities in a manner that—</text> 
<clause id="HA4C2971C1B8A4A2D8AC8BA6AE658613F"><enum>(i)</enum><text>except as provided in subparagraph (B), attains multiple ecosystem benefits, including—</text> 
<subclause id="HD868F0F1F9774BF18AFAEB55C3E4E3C1"><enum>(I)</enum><text>reducing forest fuels;</text></subclause> 
<subclause id="H66DECCA0D83F42D6BE56702CA2C0DCF6"><enum>(II)</enum><text>maintaining or restoring biological diversity;</text></subclause> 
<subclause id="HDE1A37FDC081456EAC73047691AE27E6"><enum>(III)</enum><text>improving wetland and water quality, including in Stream Environment Zones; and</text></subclause> 
<subclause id="H3CE7966CE85D4FAC99118ECDEE3EE534"><enum>(IV)</enum><text>increasing resilience to changing water temperature and precipitation; and</text></subclause></clause> 
<clause id="HBA0E16DD8E1A4953906C4349837E3CF6"><enum>(ii)</enum><text>helps achieve and maintain the environmental threshold carrying capacities established by the Planning Agency.</text></clause></subparagraph> 
<subparagraph id="HAA05CA8AFB9846FDB2952347102CCEBB"><enum>(B)</enum><header>Exception</header><text>Notwithstanding clause (A)(i), the attainment of multiple ecosystem benefits shall not be required if the Secretary determines that management for multiple ecosystem benefits would excessively increase the cost of a project in relation to the additional ecosystem benefits gained from the management activity.</text></subparagraph></paragraph> 
<paragraph id="H6B338F4717B54828A5949EA3D28BF66E"><enum>(3)</enum><header>Ground disturbance</header><text>Consistent with applicable Federal law and Lake Tahoe Basin Management Unit land and resource management plan direction, the Secretary shall—</text> 
<subparagraph id="HC06AD86C13F941BC9DBE63E8F11DD990"><enum>(A)</enum><text>establish post-project ground condition criteria for ground disturbance caused by forest management activities; and</text></subparagraph> 
<subparagraph id="H59C33C18F5444B18A456BB4C52A8C37A"><enum>(B)</enum><text>provide for monitoring to ascertain the attainment of the post-project conditions.</text></subparagraph></paragraph></subsection> 
<subsection id="HF8E73F5B83FE4B919CCC8957B2C34A89"><enum>(e)</enum><header>Withdrawal of Federal land</header> 
<paragraph id="H6C202BE57FD8442DBE1A674C5CF49EAC"><enum>(1)</enum><header>In general</header><text>Subject to valid existing rights and paragraph (2), the Federal land located in the Lake Tahoe Basin Management Unit is withdrawn from—</text> 
<subparagraph id="HB8AAD97176C845428FA582D207042A5F"><enum>(A)</enum><text>all forms of entry, appropriation, or disposal under the public land laws;</text></subparagraph> 
<subparagraph id="H73A888067CEE45FB866B32F4CE174990"><enum>(B)</enum><text>location, entry, and patent under the mining laws; and</text></subparagraph> 
<subparagraph id="HE5DF0E3671C04181B4199A76E59FDB3A"><enum>(C)</enum><text>disposition under all laws relating to mineral and geothermal leasing.</text></subparagraph></paragraph> 
<paragraph id="HFD914EF22E8F47C3A74EAA2E028EBAA5"><enum>(2)</enum><header>Exceptions</header><text>A conveyance of land shall be exempt from withdrawal under this subsection if carried out under—</text> 
<subparagraph id="H00D2B744368C4465883185794EA94688"><enum>(A)</enum><text>this Act; or</text></subparagraph> 
<subparagraph id="HDD928CE3B27147D89B2ADE82012B6EBA"><enum>(B)</enum><text display-inline="yes-display-inline">Public Law 96–586 (94 Stat. 3381) (commonly known as the <quote>Santini-Burton Act</quote>).</text></subparagraph></paragraph></subsection> 
<subsection id="HE6AC7AA866A74C2D982D84CD69307B38"><enum>(f)</enum><header>Environmental threshold carrying capacity</header><text display-inline="yes-display-inline">The Lake Tahoe Basin Management Unit shall support the attainment of the environmental threshold carrying capacities.</text></subsection> 
<subsection id="H9EF6FC9763574841A0FCE5E5DF3B82A4"><enum>(g)</enum><header>Cooperative authorities</header><text>During the 4 fiscal years following the date of enactment of the <short-title>Lake Tahoe Restoration Act of 2013</short-title>, the Secretary, in conjunction with land adjustment projects or programs, may enter into contracts and cooperative agreements with States, units of local government, and other public and private entities to provide for fuel reduction, erosion control, reforestation, Stream Environment Zone restoration, and similar management activities on Federal land and non-Federal land within the projects or programs.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H3BC8414A8F5040C1A09D2925F6A9E30C"><enum>5.</enum><header>Consultation</header><text display-inline="no-display-inline">The Lake Tahoe Restoration Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/506">Public Law 106–506</external-xref>; 114 Stat. 2351) is amended by striking section 5 and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H934A3CFC55FB412EB7C02420F947480D" style="OLC"> 
<section id="HE55DD6059BFF43528F30FE2436D4B9BB"><enum>5.</enum><header>Consultation</header><text display-inline="no-display-inline">In carrying out this Act, the Secretary, the Administrator, and the Directors shall, as appropriate and in a timely manner, consult with the heads of the Washoe Tribe, applicable Federal, State, regional, and local governmental agencies, and the Lake Tahoe Federal Advisory Committee.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H35C6155C159B48A8B51915D4BAC34BF0"><enum>6.</enum><header>Authorized projects</header><text display-inline="no-display-inline">The Lake Tahoe Restoration Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/506">Public Law 106–506</external-xref>; 114 Stat. 2351) is amended by striking section 6 and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="HF24B0FB46DCC4BF3B5963BA27C08BEB0" style="OLC"> 
<section id="H47741E486E7F4D33877783197B0FB191"><enum>6.</enum><header>Authorized projects</header> 
<subsection id="H2B8CBB95AA4041CAAD36CE688B4B6AAF"><enum>(a)</enum><header>In general</header><text>The Secretary, the Assistant Secretary, the Directors, and the Administrator, in coordination with the Planning Agency and the States of California and Nevada, may carry out or provide financial assistance to any project or program that—</text> 
<paragraph id="H9BD3F90760924788B7061A0357F6ED72"><enum>(1)</enum><text>is described in subsection (d);</text></paragraph> 
<paragraph id="HAA4644BB3F534C998194B75E1C7261C5"><enum>(2)</enum><text>is included in the Priority List under section 8; and</text></paragraph> 
<paragraph id="H42B8C68E268E44E59A2134CB63AE392E"><enum>(3)</enum><text>furthers the purposes of the Environmental Improvement Program if the project has been subject to environmental review and approval, respectively, as required under Federal law, article 7 of the Compact, and State law, as applicable.</text></paragraph></subsection> 
<subsection id="H110C37CEEEA8464D8861AB533733652C"><enum>(b)</enum><header>Restriction</header><text>The Administrator shall use not more than 3 percent of the funds provided under subsection (a) for administering the projects or programs described in paragraphs (1) and (2) of subsection (d).</text></subsection> 
<subsection id="HC183804AFC904F5FBA6E8B69EAF90529"><enum>(c)</enum><header>Monitoring and assessment</header><text>All projects authorized under subsection (d) shall—</text> 
<paragraph id="H0F47E6366A1243549D8267EC8F3A8731"><enum>(1)</enum><text>include funds for monitoring and assessment of the results and effectiveness at the project and program level consistent with the program developed under section 11; and</text></paragraph> 
<paragraph id="H7BA96CFD7F24486D99B81A218E2B4893"><enum>(2)</enum><text>use the integrated multiagency performance measures established under section 13.</text></paragraph></subsection> 
<subsection id="H85B9A51296DF4B54ABB83B0F810DE210"><enum>(d)</enum><header>Description of activities</header> 
<paragraph id="H5B681FC8EA7A4B4285D8F08F0BC7EC8B"><enum>(1)</enum><header>Stormwater management, erosion control, and total maximum daily load implementation</header><text>Of the amounts made available under section 17(a), $75,000,000 shall be made available—</text> 
<subparagraph id="HF4D4EDDBA1F74293A95EDAC5DB43A03B"><enum>(A)</enum><text>to the Secretary or the Administrator for the Federal share of stormwater management and related projects and programs consistent with the established total maximum daily load and near-shore water quality goals; and</text></subparagraph> 
<subparagraph id="H5CF63D0469FC42FA890F3FB08F8BF077"><enum>(B)</enum><text>for grants by the Secretary and the Administrator to carry out the projects and programs described in subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="HC082F272AFC341F3881B3B82DDF79515"><enum>(2)</enum><header>Stream environment zone and watershed restoration</header><text>Of the amounts made available under section 17(a), $38,000,000 shall be made available—</text> 
<subparagraph id="HF40E1BCBA19F4681A416C8562E3D42E6"><enum>(A)</enum><text>to the Secretary or the Assistant Secretary for the Federal share of the Upper Truckee River restoration projects and other watershed restoration projects identified in the priority list established under section 8; and</text></subparagraph> 
<subparagraph id="H4C7766AC14F3411197E28DCEA198DD24"><enum>(B)</enum><text>for grants by the Administrator to carry out the projects described in subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="HB5DE8A6332EA4C77B6D2A504562AD8BA"><enum>(3)</enum><header>Fire risk reduction and forest management</header> 
<subparagraph id="H23B7F143CE7A46A3AABE59D363343F8A"><enum>(A)</enum><header>In general</header><text>Of the amounts made available under section 17(a), $135,000,000 shall be made available to the Secretary to carry out, including by making grants, the following projects:</text> 
<clause id="HBA02845E2DC44819BD41EBC950A3BD4F"><enum>(i)</enum><text>Projects identified as part of the Lake Tahoe Basin Multi-Jurisdictional Fuel Reduction and Wildfire Prevention Strategy 10-Year Plan.</text></clause> 
<clause id="H4CE02F372F694D00BE847B94A2A75E68"><enum>(ii)</enum><text>Competitive grants for fuels work to be awarded by the Secretary to communities that have adopted national wildland fire codes to implement the applicable portion of the 10-year plan described in clause (i).</text></clause> 
<clause id="HF4862C7E3AA24CB8805853BAA85A0B50"><enum>(iii)</enum><text>Biomass projects, including feasibility assessments and transportation of materials.</text></clause> 
<clause id="H1322B49F634C45BE945661B788140958"><enum>(iv)</enum><text>Angora Fire Restoration projects under the jurisdiction of the Secretary.</text></clause> 
<clause id="HC8B0FD03BE2F41E0A263ACBFCE1E3E90"><enum>(v)</enum><text>Washoe Tribe projects on tribal lands within the Lake Tahoe Basin.</text></clause> 
<clause id="H302BF4475A884599965BE352E9D7F6B3"><enum>(vi)</enum><text>Development of an updated Lake Tahoe Basin multijurisdictional fuel reduction and wildfire prevention strategy, consistent with section 4(d).</text></clause> 
<clause id="H782790628406461C843D584AF7B21CDA"><enum>(vii)</enum><text>Development of updated community wildfire protection plans by local fire districts.</text></clause> 
<clause id="H4924BCED380F4EA4AC709036D4F2F37F"><enum>(viii)</enum><text>Municipal water infrastructure that significantly improves the firefighting capability of local government within the Lake Tahoe Basin.</text></clause></subparagraph> 
<subparagraph id="H2969DFA650D74FE19276955DFD55A7AE"><enum>(B)</enum><header>Minimum allocation</header><text>Of the amounts made available to the Secretary to carry out subparagraph (A), at least $80,000,000 shall be used by the Secretary for projects under subparagraph (A)(i).</text></subparagraph> 
<subparagraph id="H35FCACDEB4C24181B193360423DD824E"><enum>(C)</enum><header>Priority</header><text>Units of local government that have dedicated funding for inspections and enforcement of defensible space regulations shall be given priority for amounts provided under this paragraph.</text></subparagraph> 
<subparagraph id="H79CAAC6AD98344FA88B7B5439D0C20F8"><enum>(D)</enum><header>Cost-sharing requirements</header> 
<clause id="HAD715B6A3973479CB6DD1D907C03D3E5"><enum>(i)</enum><header>In general</header><text>As a condition on the receipt of funds, communities or local fire districts that receive funds under this paragraph shall provide a 25 percent match.</text></clause> 
<clause id="H1D95A7033FE240D9900C11E014FCD3BD"><enum>(ii)</enum><header>Form of non-Federal share</header> 
<subclause id="H942E0C17345940CA921429F3225968BC"><enum>(I)</enum><header>In general</header><text>The non-Federal share required under clause (i) may be in the form of cash contributions or in-kind contributions, including providing labor, equipment, supplies, space, and other operational needs.</text></subclause> 
<subclause id="HD85EC7F0C6BC407A8B53AD8AC4A8E36C"><enum>(II)</enum><header>Credit for certain dedicated funding</header><text>There shall be credited toward the non-Federal share required under clause (i) any dedicated funding of the communities or local fire districts for a fuels reduction management program, defensible space inspections, or dooryard chipping.</text></subclause> 
<subclause id="HD55B01D97344469D938FEE8594158751"><enum>(III)</enum><header>Documentation</header><text>Communities and local fire districts shall—</text> 
<item id="HFF3FA605609946DD86B2C50E883E254A"><enum>(aa)</enum><text>maintain a record of in-kind contributions that describes—</text> 
<subitem id="HB6A2C1DE888846E9905D369AB2EA2966"><enum>(AA)</enum><text>the monetary value of the in-kind contributions; and</text></subitem> 
<subitem id="H2D1C880A50F44EE191A6A4059168D8B5"><enum>(BB)</enum><text>the manner in which the in-kind contributions assist in accomplishing project goals and objectives; and</text></subitem></item>

<subsection id="H62A96880621A4691B44CAE346B97D8BD"><enum>(a)</enum><header>Deadline</header><text>Not later than February 15 of the year after the date of enactment of the <short-title>Lake Tahoe Restoration Act of 2013</short-title>, the Chair, in consultation with the Secretary, the Administrator, the Directors, the Planning Agency, the States of California and Nevada, the Federal Partnership, the Washoe Tribe, the Lake Tahoe Federal Advisory Committee, and the Tahoe Science Consortium shall submit to Congress a prioritized list of all Environmental Improvement Program projects for the Lake Tahoe Basin for each program category described in section 6(d).</text></subsection> 
<subsection id="HC47186F2298F4D6FB6B24EDA74093D88"><enum>(b)</enum><header>Criteria</header> 
<paragraph id="H744D648F97B049329063E2095BEB1313"><enum>(1)</enum><header>In general</header><text>The priority of projects included in the Priority List shall be based on the best available science and the following criteria:</text> 
<subparagraph id="HBDFAB23134B0447F982CA61A80453C49"><enum>(A)</enum><text>The 5-year threshold carrying capacity evaluation.</text></subparagraph> 
<subparagraph id="H8887C8147D3C4E6FA78A2EB4B439DE2C"><enum>(B)</enum><text>The ability to measure progress or success of the project.</text></subparagraph> 
<subparagraph id="H20310915055E4136B14E68AB1E77F7E8"><enum>(C)</enum><text>The potential to significantly contribute to the achievement and maintenance of the environmental threshold carrying capacities identified in the Compact for—</text> 
<clause id="H8AAD3D067BF448A2887B169DFC5AE108"><enum>(i)</enum><text>air quality;</text></clause> 
<clause id="H5A9052CC6EED435A8F79B9E360641593"><enum>(ii)</enum><text>fisheries;</text></clause>

<subsection id="H2D14A35984394783A2699258CA0E4042"><enum>(c)</enum><header>Revisions</header> 
<paragraph id="H971C567B54AA46B489CAC8E2EB9B4DAE"><enum>(1)</enum><header>In general</header><text>The Priority List submitted under subsection (b) shall be revised—</text> 
<subparagraph id="H6DF8A48225354D53925B01A04C652428"><enum>(A)</enum><text>every 2 years; or</text></subparagraph> 
<subparagraph id="H0E69661DF53944F3BD3E47006C02E6A2"><enum>(B)</enum><text>on a finding of compelling need under paragraph (2).</text></subparagraph></paragraph> 
<paragraph id="H8EA028946AFD4293BD4E9485785DBB8F"><enum>(2)</enum><header>Finding of compelling need</header> 
<subparagraph id="H3D4B5292768C4C40848001CED43AFAE8"><enum>(A)</enum><header>In general</header><text>If the Secretary, the Administrator, or the Director of the United States Fish and Wildlife Service makes a finding of compelling need justifying a priority shift and the finding is approved by the Secretary, the Executive Director of the Planning Agency, the California Natural Resources Secretary, and the Director of the Nevada Department of Conservation, the Priority List shall be revised in accordance with this subsection.</text></subparagraph> 
<subparagraph id="H01ABFDD4C57B4003813419BB8D0570E9"><enum>(B)</enum><header>Inclusions</header><text>A finding of compelling need includes—</text> 
<clause id="HB51D0A38FADB4B49BF25D1C4C7447B66"><enum>(i)</enum><text>major scientific findings;</text></clause> 
<clause id="HACFA473FEDC241CEAB8B04AA2D52A5FC"><enum>(ii)</enum><text>results from the threshold evaluation of the Planning Agency;</text></clause> 
<clause id="HD317207C43F944FD8C776936D30535E0"><enum>(iii)</enum><text>emerging environmental threats; and</text></clause> 
<clause id="H128BC676196743FBAA035A23AC343E85"><enum>(iv)</enum><text>rare opportunities for land acquisition.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HAA6811C994344F869EA7E9793D0C6343"><enum>(d)</enum><header>Funding</header><text>Of the amount made available under section 17(a), $80,000,000 shall be made available to the Secretary to carry out this section.</text></subsection></section> 
<section id="H27DB80B5CDD24B14B19A525E8C3E0F3F"><enum>9.</enum><header>Aquatic invasive species prevention</header> 
<subsection id="HEC1C7C8C2A7C4F799BEC85F03B5A3788"><enum>(a)</enum><header>In general</header><text>The Director of the United States Fish and Wildlife Service, in coordination with the Planning Agency, the California Department of Fish and Game, and the Nevada Department of Wildlife, shall deploy strategies consistent with the Lake Tahoe Aquatic Invasive Species Management Plan to prevent the introduction of aquatic invasive species into the Lake Tahoe Basin.</text></subsection> 
<subsection id="H03138E67C94D4D329CD731839E69714E"><enum>(b)</enum><header>Criteria</header><text>The strategies referred to in subsection (a) shall provide that—</text> 
<paragraph id="H5BAA442AD26D40C095D76783BD9854E7"><enum>(1)</enum><text>combined inspection and decontamination stations be established and operated at not less than 2 locations in the Lake Tahoe Basin; and</text></paragraph> 
<paragraph id="HB75684F18E6946908ABA2B908243C8D4"><enum>(2)</enum><text>watercraft not be allowed to launch in waters of the Lake Tahoe Basin if the watercraft has not been inspected in accordance with the Lake Tahoe Aquatic Invasive Species Management Plan.</text></paragraph></subsection> 
<subsection id="HAFFE86DD66A4457ABA53B750CA98EAA1"><enum>(c)</enum><header>Certification</header><text>The Planning Agency may certify State and local agencies to perform the decontamination activities described in subsection (b)(3) at locations outside the Lake Tahoe Basin if standards at the sites meet or exceed standards for similar sites in the Lake Tahoe Basin established under this section.</text></subsection> 
<subsection id="H500E9324A7C8480E81146CCB4517E9FA"><enum>(d)</enum><header>Applicability</header><text>The strategies and criteria developed under this section shall apply to all watercraft to be launched on water within the Lake Tahoe Basin.</text></subsection> 
<subsection id="HA2231A6ABD994866AE389AA76B1CD4C8"><enum>(e)</enum><header>Fees</header><text display-inline="yes-display-inline">The Director of the United States Fish and Wildlife Service may collect and spend fees for decontamination only at a level sufficient to cover the costs of operation of inspection and decontamination stations under this section.</text></subsection> 
<subsection id="HC5761A7B0FC84481BBC6ED7D86334406"><enum>(f)</enum><header>Civil penalties</header> 
<paragraph id="H8F9DBC1869764742826F59BFECA9A611"><enum>(1)</enum><header>In general</header><text>Any person that launches, attempts to launch, or facilitates launching of watercraft not in compliance with strategies deployed under this section shall be liable for a civil penalty in an amount not to exceed $1,000 per violation.</text></paragraph> 
<paragraph id="HC79EAF9DF2BD42558C0134749946F7DD"><enum>(2)</enum><header>Other authorities</header><text>Any penalties assessed under this subsection shall be separate from penalties assessed under any other authority.</text></paragraph></subsection> 
<subsection id="HC5EF1E2F5502495DB8E42268A45A811E"><enum>(g)</enum><header>Limitation</header><text display-inline="yes-display-inline">The strategies and criteria under subsections (a) and (b), respectively, may be modified if the Secretary of the Interior, in a nondelegable capacity and in consultation with the Planning Agency and State governments, issues a determination that alternative measures will be no less effective at preventing introduction of aquatic invasive species into Lake Tahoe than the strategies and criteria.</text></subsection> 
<subsection id="H681C139879B649DF9B001C84301A1A04"><enum>(h)</enum><header>Supplemental authority</header><text>The authority under this section is supplemental to all actions taken by non-Federal regulatory authorities.</text></subsection> 
<subsection id="H9CC973471A3D4C4DA501978E3E94082F"><enum>(i)</enum><header>Savings clause</header><text>Nothing in this title shall be construed as restricting, affecting, or amending any other law or the authority of any department, instrumentality, or agency of the United States, or any State or political subdivision thereof, respecting the control of invasive species.</text></subsection></section> 
<section id="HE3D147E23FF94770BF4D84A9FA1DA1E3"><enum>10.</enum><header>Corps of Engineers; interagency agreements</header> 
<subsection id="H06296FCF72264F2FABBE753FD1C45738"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Assistant Secretary may enter into interagency agreements with non-Federal interests in the Lake Tahoe Basin to use Lake Tahoe Partnership-Miscellaneous General Investigations funds to provide programmatic technical assistance for the Environmental Improvement Program.</text></subsection> 
<subsection id="H85AD4654BA05470DAF1637A296CEF9A2"><enum>(b)</enum><header>Local cooperation agreements</header> 
<paragraph id="HD3876EEA6E104E99B8E979D6AA6BE2DD"><enum>(1)</enum><header>In general</header><text>Before providing technical assistance under this section, the Assistant Secretary shall enter into a local cooperation agreement with a non-Federal interest to provide for the technical assistance.</text></paragraph> 
<paragraph id="H4363A716A0D94BA0A04D8E70601CD607"><enum>(2)</enum><header>Components</header><text>The agreement entered into under paragraph (1) shall—</text> 
<subparagraph id="HB726C166B5034A999DE037C7B3384555"><enum>(A)</enum><text>describe the nature of the technical assistance;</text></subparagraph> 
<subparagraph id="HCD71162860E944FD84BE3059D59B8B96"><enum>(B)</enum><text>describe any legal and institutional structures necessary to ensure the effective long-term viability of the end products by the non-Federal interest; and</text></subparagraph> 
<subparagraph id="HC620798B0F8F4D048B2DB9A98923206A"><enum>(C)</enum><text>include cost-sharing provisions in accordance with paragraph (3).</text></subparagraph></paragraph> 
<paragraph id="HEE7AD7EBD7C644BEA57D6A0D291079EA"><enum>(3)</enum><header>Federal share</header> 
<subparagraph id="HB766313B1133400C8268F1B9BEEC18BD"><enum>(A)</enum><header>In general</header><text>The Federal share of project costs under each local cooperation agreement under this subsection shall be 65 percent.</text></subparagraph> 
<subparagraph id="H188AA12BE58C4D75AF3F1FB63EA303B7"><enum>(B)</enum><header>Form</header><text>The Federal share may be in the form of reimbursements of project costs.</text></subparagraph> 
<subparagraph id="H61C569CC4FA143DE8AFC98017112CE40"><enum>(C)</enum><header>Credit</header><text>The non-Federal interest may receive credit toward the non-Federal share for the reasonable costs of related technical activities completed by the non-Federal interest before entering into a local cooperation agreement with the Assistant Secretary under this subsection.</text></subparagraph></paragraph></subsection></section> 
<section id="H67A78ECB359140CEA8C213EE62E56635"><enum>11.</enum><header>Lake Tahoe Basin Science Program</header><text display-inline="no-display-inline">The Secretary (acting through the Station Director of the Forest Service, Pacific Southwest Research Station), the Administrator, the Planning Agency, the States of California and Nevada, and the Tahoe Science Consortium, shall develop and implement the Lake Tahoe Basin Science Program that—</text> 
<paragraph id="HBF6325C51FF14F3592CFE927C1D6AB0B"><enum>(1)</enum><text>develops and regularly updates an integrated multiagency programmatic assessment and monitoring plan—</text> 
<subparagraph id="HAE091869F73A472D935265A20C3140E0"><enum>(A)</enum><text>to evaluate the effectiveness of the Environmental Improvement Program;</text></subparagraph> 
<subparagraph id="H3F473196638144FCAB2B37668397BC09"><enum>(B)</enum><text>to evaluate the status and trends of indicators related to environmental threshold carrying capacities; and</text></subparagraph> 
<subparagraph id="H585FC9CDA10C41CE84D531A326FC002F"><enum>(C)</enum><text>to assess the impacts and risks of changing water temperature, precipitation, and invasive species;</text></subparagraph></paragraph> 
<paragraph id="HE50EC590AB9F49CF9AB56A642358248F"><enum>(2)</enum><text>produces and synthesizes scientific information necessary for—</text> 
<subparagraph id="H0403B3B05773485DBFE585989A9D0000"><enum>(A)</enum><text>the identification and refinement of environmental indicators for the Lake Tahoe Basin; and</text></subparagraph> 
<subparagraph id="H276705D717B74744BFF212C5B2BD6F40"><enum>(B)</enum><text>the evaluation of standards and benchmarks;</text></subparagraph></paragraph> 
<paragraph id="H751ECA08B07C4DFBBA6E61DDD15AD6E0"><enum>(3)</enum><text>conducts applied research, programmatic technical assessments, scientific data management, analysis, and reporting related to key management questions;</text></paragraph> 
<paragraph id="H6C9847165CE44FB89BBC39A19CA74F5E"><enum>(4)</enum><text>develops new tools and information to support objective assessments of land use and resource conditions;</text></paragraph> 
<paragraph id="H1B2E3CACBCAB4449867A70274528B6D3"><enum>(5)</enum><text>provides scientific and technical support to the Federal Government and State and local governments in—</text> 
<subparagraph id="H12A3496A210F4B469A99CD77E82987A2"><enum>(A)</enum><text>reducing stormwater runoff, air deposition, and other pollutants that contribute to the loss of lake clarity; and</text></subparagraph> 
<subparagraph id="HFD52A11F5C764CBDBBB1C69DBA46B247"><enum>(B)</enum><text>the development and implementation of an integrated stormwater monitoring and assessment program;</text></subparagraph></paragraph> 
<paragraph id="H1BDDE349B84E4C348A72426EE8C5022D"><enum>(6)</enum><text>establishes and maintains independent peer review processes—</text> 
<subparagraph id="H8BE77EEE4571425D86392C77E0A8AC41"><enum>(A)</enum><text>to evaluate the Environmental Improvement Program; and</text></subparagraph> 
<subparagraph id="H907C6BDC42F4418FA977C54100F2576A"><enum>(B)</enum><text>to assess the technical adequacy and scientific consistency of central environmental documents, such as the 5-year threshold review; and</text></subparagraph></paragraph> 
<paragraph id="H6155CE47BAEF48068957540E589145F0"><enum>(7)</enum><text>provides scientific and technical support for the development of appropriate management strategies to accommodate changing water temperature and precipitation in the Lake Tahoe Basin.</text></paragraph></section> 
<section id="HE5E8AE3FF5C94125BB65E874767E7206"><enum>12.</enum><header>Public outreach and education</header> 
<subsection id="H127361E35B5548968E1FFDE615B23DAF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, the Administrator, and the Directors will coordinate with the Planning Agency to conduct public education and outreach programs, including encouraging—</text> 
<paragraph id="H7A5AE17576B24170BA74F4F60F219034"><enum>(1)</enum><text display-inline="yes-display-inline">owners of land and residences in the Lake Tahoe Basin—</text> 
<subparagraph id="HA50B57C6E9714355A4C10E30F6576009"><enum>(A)</enum><text display-inline="yes-display-inline">to implement defensible space; and</text></subparagraph> 
<subparagraph id="H064E25E64C374970B03ABC2AB8E2BEFB"><enum>(B)</enum><text display-inline="yes-display-inline">to conduct best management practices for water quality; and</text></subparagraph></paragraph> 
<paragraph id="HCAEBAF598DA8426085B72857FE94A781"><enum>(2)</enum><text display-inline="yes-display-inline">owners of land and residences in the Lake Tahoe Basin and visitors to the Lake Tahoe Basin, to help prevent the introduction and proliferation of invasive species as part of the private share investment in the Environmental Improvement Program.</text></paragraph></subsection> 
<subsection id="HE93544BFC5584CDFABAC11114CE81996"><enum>(b)</enum><header>Scientific and technical guidance</header><text display-inline="yes-display-inline">The Director of the United States Geological Survey shall provide scientific and technical guidance to public outreach and education programs conducted under this section.</text></subsection> 
<subsection id="H78D504AD52EB4992AF0E42FE55A745AF"><enum>(c)</enum><header>Required coordination</header><text display-inline="yes-display-inline">Public outreach and education programs for aquatic invasive species under this section shall—</text> 
<paragraph id="H3BAD7B14050A417E91210281D4CB5F7C"><enum>(1)</enum><text display-inline="yes-display-inline">be coordinated with Lake Tahoe Basin tourism and business organizations; and</text></paragraph> 
<paragraph id="HAAB69AC4ADCF46E4B1C90B3BADE6F68E"><enum>(2)</enum><text display-inline="yes-display-inline">include provisions for the programs to extend outside of the Lake Tahoe Basin.</text></paragraph></subsection></section> 
<section id="H6300587DC6E448ADA67D972009EE67FC"><enum>13.</enum><header>Reporting requirements</header><text display-inline="no-display-inline">Not later than February 15 of each year, the Secretary, in cooperation with the Chair, the Administrator, the Directors, the Planning Agency, and the States of California and Nevada, consistent with section 6(d)(6), shall submit to Congress a report that describes—</text> 
<paragraph id="H70E8A6373384425F989C6D563FC5EFCA"><enum>(1)</enum><text>the status of all Federal, State, local, and private projects authorized under this Act, including to the maximum extent practicable, for projects that will receive Federal funds under this Act during the current or subsequent fiscal year—</text> 
<subparagraph id="H294A8AF6BFAB4308AA6A31FFEC53449E"><enum>(A)</enum><text>the project scope;</text></subparagraph> 
<subparagraph id="H8A734B1CAA894B0CB7C3DA9F3A55E7B3"><enum>(B)</enum><text>the budget for the project; and</text></subparagraph> 
<subparagraph id="H9EFF7C0E231C4B26ACDBBCC82E2DCDBB"><enum>(C)</enum><text>the justification for the project, consistent with the criteria established in section 8(b)(1);</text></subparagraph></paragraph> 
<paragraph id="H797F08A8300A4666A78FD137D133E860"><enum>(2)</enum><text>Federal, State, local, and private expenditures in the preceding fiscal year to implement the Environmental Improvement Program and projects otherwise authorized under this Act;</text></paragraph> 
<paragraph id="H00213EA75A8F45A5AA99F25C10327823"><enum>(3)</enum><text>accomplishments in the preceding fiscal year in implementing this Act in accordance with the performance measures and other monitoring and assessment activities; and</text></paragraph> 
<paragraph id="H7667B13384E14D939BA299913A0BEE95"><enum>(4)</enum><text>public education and outreach efforts undertaken to implement programs and projects authorized under this Act.</text></paragraph></section> 
<section id="HEFCD6872A4A748058AD05624A9E965C1"><enum>14.</enum><header>Annual budget plan</header><text display-inline="no-display-inline">As part of the annual budget of the President, the President shall submit information regarding each Federal agency involved in the Environmental Improvement Program (including the Forest Service, the Environmental Protection Agency, the United States Fish and Wildlife Service), the United States Geological Survey, and the Corps of Engineers), including—</text> 
<paragraph id="H4B2A409E07C94E01B4BE8E34D1DF47EC"><enum>(1)</enum><text>an interagency crosscut budget that displays the proposed budget for use by each Federal agency in carrying out restoration activities relating to the Environmental Improvement Program for the following fiscal year;</text></paragraph> 
<paragraph id="HABBB46B1F8164E608B3DDE86E5532202"><enum>(2)</enum><text>a detailed accounting of all amounts received and obligated by Federal agencies to achieve the goals of the Environmental Improvement Program during the preceding fiscal year; and</text></paragraph> 
<paragraph id="H58E0D35A639940D9B5140D85A39A3A87"><enum>(3)</enum><text>a description of the Federal role in the Environmental Improvement Program, including the specific role of each agency involved in the restoration of the Lake Tahoe Basin.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H0BB40B7C57174E60B288B54A8D2B72E8"><enum>8.</enum><header>Relationship to other laws</header><text display-inline="no-display-inline">Section 16 of the Lake Tahoe Restoration Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/506">Public Law 106–506</external-xref>; 114 Stat. 2358) (as redesignated by section 7(2)) is amended by inserting <quote>, Director, or Administrator</quote> after <quote>Secretary</quote>.</text></section> 
<section id="H0823B84A97934DA88A03B2560E8D1753"><enum>9.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">The Lake Tahoe Restoration Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/506">Public Law 106–506</external-xref>; 114 Stat. 2351) is amended by striking section 17 (as redesignated by section 7(2)) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="HBAEA4595123B403BAE9614810531E0CC" style="OLC"> 
<section id="HCB4A9364539740C1B0CAD1BF546521EB"><enum>17.</enum><header>Authorization of appropriations</header> 
<subsection id="H60AF718BF72542C2BAAF9B3511CD7D66"><enum>(a)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this Act $415,000,000 for a period of 10 fiscal years beginning the first fiscal year after the date of enactment of the <short-title>Lake Tahoe Restoration Act of 2013</short-title>.</text></subsection> 
<subsection id="H2139674475C3478095448FF92C75C3E7"><enum>(b)</enum><header>Effect on other funds</header><text>Amounts authorized under this section and any amendments made by this Act—</text> 
<paragraph id="H41C35BAAF2584EA3871B3C45409FAA44"><enum>(1)</enum><text>shall be in addition to any other amounts made available to the Secretary, the Administrator, or the Directors for expenditure in the Lake Tahoe Basin; and</text></paragraph> 
<paragraph id="H363CF102BA0442E2B869BF0791E398B9"><enum>(2)</enum><text>shall not reduce allocations for other Regions of the Forest Service, Environmental Protection Agency, or the United States Fish and Wildlife Service.</text></paragraph></subsection> 
<subsection id="H2329DB26F21247849DE089408C1BB200"><enum>(c)</enum><header>Cost-Sharing requirement</header><text>Except as provided in subsection (d) and section 6(d)(3)(D), the States of California and Nevada shall pay 50 percent of the aggregate costs of restoration activities in the Lake Tahoe Basin funded under section 6.</text></subsection> 
<subsection id="H80F5F984B0DF46F19427625145297248"><enum>(d)</enum><header>Relocation costs</header><text>Notwithstanding subsection (c), the Secretary shall provide to local utility districts two-thirds of the costs of relocating facilities in connection with—</text> 
<paragraph id="HDB06ADB0540F40A88662A69BCB1C16E0"><enum>(1)</enum><text>environmental restoration projects under sections 6 and 8; and</text></paragraph> 
<paragraph id="H0072DE24D1C641E9AF4969E680F7F645"><enum>(2)</enum><text>erosion control projects under section 2 of <external-xref legal-doc="public-law" parsable-cite="pl/96/586">Public Law 96–586</external-xref> (94 Stat. 3381).</text></paragraph></subsection> 
<subsection id="HBE053F7E80E4477290A1D8EF17D8FB44"><enum>(e)</enum><header>Signage</header><text>To the maximum extent practicable, a project provided assistance under this Act shall include appropriate signage at the project site that—</text> 
<paragraph id="H7E92FD3F7B574202987CE05A897092A9"><enum>(1)</enum><text>provides information to the public on—</text> 
<subparagraph id="HC1ADCDB1FC3B48FF8A01E09ED7E76B1C"><enum>(A)</enum><text>the amount of Federal funds being provided to the project; and</text></subparagraph> 
<subparagraph id="H6E6C01E7B7C1434C80F57B62198E5463"><enum>(B)</enum><text>this Act; and</text></subparagraph></paragraph> 
<paragraph id="H3588AC6364FC44CBA8A312591950D037"><enum>(2)</enum><text>displays the visual identity mark of the Environmental Improvement Program.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HD2600099A2D041E198A6756C8E76AF89"><enum>10.</enum><header>Administration of acquired land</header> 
<subsection id="H83A44306B5FD49769BA0FBABAA4397AE"><enum>(a)</enum><header>In general</header><text>Section 3(b) of <external-xref legal-doc="public-law" parsable-cite="pl/96/586">Public Law 96–586</external-xref> (94 Stat. 3384) (commonly known as the <quote>Santini-Burton Act</quote>) is amended—</text> 
<paragraph id="H4D6DC82402354777912862FF06AF67F5"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(b) Lands</quote> and inserting the following:</text>

<subparagraph id="H2BFDB739B63F44729313908E4BB48E89"><enum>(A)</enum><header>In general</header><text>If the State of California (acting through the California Tahoe Conservancy and the California Department of Parks and Recreation) offers to donate to the United States acceptable title to the non-Federal land described in subparagraph (B)(i), the Secretary—</text> 
<clause id="HC7CEE183C7DB454CAABB4331770426C6"><enum>(i)</enum><text>may accept the offer; and</text></clause> 
<clause commented="no" id="HD1E91D17263D444A8EEC47426C3F7B93"><enum>(ii)</enum><text>not later than 180 days after the date on which the Secretary receives acceptable title to the non-Federal land described in subparagraph (B)(i), convey to the State of California, subject to valid existing rights and for no consideration, all right, title, and interest of the United States in and to the Federal land that is acceptable to the State of California.</text></clause></subparagraph> 
<subparagraph id="H439BF4A91AFD486B94BB604F9A62B7E8"><enum>(B)</enum><header>Description of land</header> 
<clause id="H72544E6E35824970A94FD653E6712B2D"><enum>(i)</enum><header>Non-federal land</header><text>The non-Federal land referred to in subparagraph (A) includes—</text> 
<subclause id="H1B42915C27FF4066BD8E11F1B2789267"><enum>(I)</enum><text>the approximately 1,981 acres of land administered by the Conservancy and identified on the Maps as <quote>Conservancy to the United States Forest Service</quote>; and</text></subclause> 
<subclause id="HB15F522F87C6470EBBA22F736102DC0F"><enum>(II)</enum><text>the approximately 187 acres of land administered by California State Parks and identified on the Maps as <quote>State Parks to the U.S. Forest Service</quote>.</text></subclause></clause> 
<clause id="HF1435239C4FE44E385B51C61D67D94A5"><enum>(ii)</enum><header>Federal land</header><text>The Federal land referred to in subparagraph (A) includes the approximately 1,995 acres of Forest Service land identified on the Maps as <quote>U.S. Forest Service to Conservancy and State Parks</quote>.</text></clause></subparagraph> 
<subparagraph id="H4F4FF3C4862041198C898531934699D4"><enum>(C)</enum><header>Conditions</header><text>Any land conveyed under this paragraph shall—</text> 
<clause id="H1095655EDC354C0F83B50585BDDAE34F"><enum>(i)</enum><text>be for the purpose of consolidating Federal and State ownerships and improving management efficiencies;</text></clause> 
<clause id="H2D64CA2419E54A0B8ED17B847CF9E602"><enum>(ii)</enum><text>not result in any significant changes in the uses of the land; and</text></clause> 
<clause id="HA7288DF5B4564F73AC996819A30E3D2B"><enum>(iii)</enum><text>be subject to the condition that the applicable deed include such terms , restrictions, covenants, conditions, and reservations as the Secretary determines necessary to—</text> 
<subclause id="HB79B81FDE1D3465E91C7DC9AE57656E1"><enum>(I)</enum><text>ensure compliance with this Act; and</text></subclause> 
<subclause id="H5A38CCD79A534EA39FDEF8A2CEB7399D"><enum>(II)</enum><text>ensure that the development rights associated with the conveyed parcels shall not be recognized or available for transfer under section 90.2 of the Code of Ordinances for the Tahoe Regional Planning Agency.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H5C7145E4BA8F41DA8BFF9EAA451C13CB"><enum>11.</enum><header>Miscellaneous provisions</header> 
<subsection id="H2B0068B8D3B84D23B1A04C5D8EF6C57A"><enum>(a)</enum><header>Importation or shipment of quagga mussels</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/42">Section 42</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="HD5263375B82F497E82AD73D18D14895B"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1), by adding <quote>of the quagga mussel of the species Dreissena rostriformis;</quote> after <quote>Hypophthalmichthys nobilis;</quote>; and</text></paragraph> 
<paragraph id="HF12AE399D9D34C84A9B4744201ECC437"><enum>(2)</enum><text>by adding at the end the following:</text>

<paragraph id="H251F894753CD4A3A94F8FB3C7A85816A"><enum>(1)</enum><text>the importation or transportation of prohibited species through the operation of a public water system or a related water conveyance, storage, or distribution facility; or</text></paragraph> 
<paragraph id="HAD230A79CCF744CBBBDA626383D84630"><enum>(2)</enum><text>the possession or conveyance of water supplies containing prohibited species by a public water system operator.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEE6A77EF09204C91BC760D6F59AB9C93"><enum>(b)</enum><header>Control of illegally taken fish and wildlife</header><text>Section 8 of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3377">16 U.S.C. 3377</external-xref>) is amended by adding at the end the following:</text>
