<section id="H830317EFFF2C4745A0713DE10D453D43" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Day Off Act</short-title></quote>.</text></section> 
<section display-inline="no-display-inline" id="HADD49D40426C4E3BAA0EC69FA08F3C16" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<subsection id="H7B34C8BCC41F49FD8112731A24217BFA"><enum>(a)</enum><header>Eligible Employee</header> 
<paragraph id="H40B886995CE0472B9982164DDA1A2F17"><enum>(1)</enum><header>In General</header><text>The term <term>eligible employee</term> means an employee who—</text> 
<subparagraph id="H4E6D8E8480804D50BE12364E4B858BCD"><enum>(A)</enum><text>is a veteran, as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/38/101">section 101</external-xref> of title 38, United States Code; and</text></subparagraph> 
<subparagraph id="H7ABA989BFCE747D1AA51B84C5921C1DE"><enum>(B)</enum><text>has been employed for at least 12 months by the employer with respect to whom leave is requested under section 3.</text></subparagraph></paragraph> 
<paragraph display-inline="no-display-inline" id="HB0EB85BB139F4C4492C367542FE0B27F"><enum>(2)</enum><header>Exclusions</header><text>The term <term>eligible employee</term> does not include an individual employed by a public agency, as that term is defined in section 3(e)(2) of the Fair Labor Standards Act of 1938 (29 U.S.C. 203(3)(e)(2)).</text></paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H0C10033D9B1A4FC58116C1A9718214DB"><enum>(b)</enum><header>Employ; employee</header><text>The terms <term>employ</term> and <term>employee</term> have the same meanings given such terms in subsections (e) and (g) of section 3 of the Fair Labor Standards Act of 1938 (29 U.S.C. 203 (e) and (g)).</text></subsection> 
<subsection id="HA0DCD69942C948F9BABCAB79AD76C5E3"><enum>(c)</enum><header>Employer</header><text display-inline="yes-display-inline">The term <term>employer</term> means any person engaged in commerce or in any industry or activity affecting commerce who employs 50 or more employees during a calendar year, and includes any person who acts, directly or indirectly, in the interest of any employer to any of the employees of such employer and any successor in interest of an employer. In the previous sentence, the terms <term>commerce</term> and <term>industry or activity affective commerce</term> have the meaning given such terms in section 101(1) of the Family and Medical Leave Act of 1993.</text></subsection> 
<subsection id="H10C7563A6B1A45E0A52D37BD7000E77F"><enum>(d)</enum><header>Person</header><text>The term <term>person</term> has the same meaning given such term in section 3(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(a)</external-xref>).</text></subsection> 
<subsection id="H1C3764DB5065427BACCBE4AA2877E3FF"><enum>(e)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></subsection></section> 
<section id="H66414551B11C4DFCBDD4C0ECD5567D89"><enum>3.</enum><header>Leave requirement</header> 
<subsection id="HD58BAD15027949D6B877602AB24AF902"><enum>(a)</enum><header>Entitlement to leave</header> 
<paragraph id="H29656B5B13F445DF8C08A59F011B8942"><enum>(1)</enum><header>In General</header><text>Except as provided in paragraph (2), an eligible employee shall be entitled to leave on Veterans Day upon request if such employee would otherwise be required to work on Veterans Day.</text></paragraph> 
<paragraph id="H28C5879C2564425098F078A797D96A67"><enum>(2)</enum><header>Exceptions</header><text>An employer may deny leave to an eligible employee if providing leave to the employee would—</text> 
<subparagraph id="HBC82EBA2E7224211840233126A5F1000"><enum>(A)</enum><text display-inline="yes-display-inline">negatively impact public health or safety; or</text></subparagraph> 
<subparagraph id="H0465E8ED82A048EB8D011A9E85D798C5"><enum>(B)</enum><text>cause the employer significant economic or operational disruption.</text></subparagraph></paragraph></subsection> 
<subsection id="HA2070BA042A744EBA36FE97F160C080B"><enum>(b)</enum><header>Type of leave</header> 
<paragraph id="H0FB8CBEAAB5947D2B95211540F9EC64E"><enum>(1)</enum><header>Unpaid leave permitted</header><text display-inline="yes-display-inline">Leave granted under subsection (a) may consist of unpaid leave.</text></paragraph> 
<paragraph id="H1007CE6D14964F79A0D6E450A0E0AB45"><enum>(2)</enum><header>Substitution of paid leave</header><text>An eligible employee may elect, or an employer may require the employee, to substitute any of the accrued paid vacation leave or personal leave of the employee for leave provided under subsection (a).</text></paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H3B43BED23B7B4BE4AE7387A9D0BA829F"><enum>(c)</enum><header>Duties of Employee</header><text display-inline="yes-display-inline">Not less than 30 days before the Veterans Day on which leave is requested to be taken, an employee requesting leave under subsection (a) shall provide the employer with the following:</text> 
<paragraph id="H31C8755CBE4749978222311793604E58"><enum>(1)</enum><text display-inline="yes-display-inline">Written notice of the employee's intention to take leave under subsection (a).</text></paragraph> 
<paragraph id="H03EE597203804E2E9F0ADC72B1E04FF1"><enum>(2)</enum><text>Documentation verifying that the employee is a veteran.</text></paragraph></subsection> 
<subsection id="H17895BE378E6412B9E08FC7C6BDCEC2E"><enum>(d)</enum><header>Duties of Employer</header> 
<paragraph id="H883ACB8C27AB4F40894D11E72CE54370"><enum>(1)</enum><header>Notice of decision</header><text>Not less than 10 days before the Veterans Day on which leave is requested to be taken, the employer shall notify an employee requesting leave under subsection (a)—</text> 
<subparagraph id="H353C9998D7944CF0AFDDAFD3F8E2AC96"><enum>(A)</enum><text>whether the employee shall be provided leave; and</text></subparagraph> 
<subparagraph id="H5DD9FDA80205438590D69DE1BEE40C27"><enum>(B)</enum><text>if so, whether the leave shall be paid or unpaid.</text></subparagraph></paragraph> 
<paragraph id="H840199803A7D44A9A0660A3E10D7F5EC"><enum>(2)</enum><header>Denial of leave request</header><text>If an employer receives multiple requests for leave under subsection (a)(1) and denies leave to more than one eligible employee in accordance with subsection (a)(2), the employer should deny leave to the minimum number of eligible employees practicable.</text></paragraph></subsection></section> 
<section id="H84493804E8C24E0E8EFD913638B11333"><enum>4.</enum><header>Prohibited Acts</header> 
<subsection id="H2DD310227F7249B68F7BDF4F4AFAE473"><enum>(a)</enum><header>Interference with rights</header> 
<paragraph id="H38BDA18E5339468BBA799B0C51CE81C4"><enum>(1)</enum><header>Exercise of rights</header><text display-inline="yes-display-inline">It shall be unlawful for any employer to interfere with, restrain, or deny the taking of or the attempt to take, any leave provided under this Act.</text></paragraph> 
<paragraph id="H7AD3C9D4281C4535B6026C251C4A38DB"><enum>(2)</enum><header>Discrimination</header><text>It shall be unlawful for any employer to discharge or in any other manner discriminate against any individual for opposing any practice made unlawful by this Act.</text></paragraph></subsection> 
<subsection id="HEFCCA934864C483FA9BD8A7404116D3C"><enum>(b)</enum><header>Interference with proceedings or inquiries</header><text>It shall be unlawful for any person to discharge or in any other manner discriminate against any individual because such individual—</text> 
<paragraph id="HB7E8666A3B5C4764981396F0E9996648"><enum>(1)</enum><text>has filed any charge, or has instituted or caused to be instituted any proceeding, under or related to this Act;</text></paragraph> 
<paragraph id="HD482F95701CB4827827D774D666F1644"><enum>(2)</enum><text>has given, or is about to give, any information in connection with any inquiry or proceeding relating to any leave provided under this Act; or</text></paragraph> 
<paragraph id="HB27A03A07DC44955A3F1FF4C77DBFDAF"><enum>(3)</enum><text>has testified, or is about to testify, in any inquiry or proceeding relating to any leave provided under this Act.</text></paragraph></subsection></section> 
<section id="H15B4C96128A54D39A1152F4A94F1A263"><enum>5.</enum><header>Investigative Authority</header><text display-inline="no-display-inline">The Secretary shall have investigative authority with respect to the provisions of this Act in the same manner and under the same terms and conditions as the investigative authority provided under section 106 of the Family and Medical Leave Act of 1993, and the requirements of section 106 of such Act shall apply to employers under this Act in the same manner as such requirements apply to employers under section 106 of such Act.</text></section> 
<section id="H733DAE3D89964203B7B803DB47E31C4E"><enum>6.</enum><header>Enforcement</header><text display-inline="no-display-inline">The provisions of section 107 of the Family and Medical Leave Act of 1993 shall apply with respect to the enforcement of the requirements of this Act in the same manner and under the same terms and conditions as such provisions apply with respect to the enforcement of the requirements of title I of such Act.</text></section> 
<section id="H9AB047303CB941B3A70A22D1784E8F62"><enum>7.</enum><header>Notice</header> 
<subsection id="H297462E9CE464731BF2B8D850BCE92FB"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Each employer shall post and keep posted, in conspicuous places on the premises of the employer where notices to employees and applicants for employment are customarily posted, a notice, to be prepared or approved by the Secretary, setting forth excerpts from, or summaries of, the pertinent provisions of this title Act information pertaining to the filing of a charge.</text></subsection> 
<subsection id="H8262B4914B144F10A5B3786A98C90993"><enum>(b)</enum><header>Penalty</header><text>Any employer that willfully violates this section may be assessed a civil money penalty not to exceed $100 for each separate offense.</text></subsection></section>
