R. 3365</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131029">October 29, 2013</action-date><action-desc><sponsor name-id="W000798">Mr. Walberg</sponsor> (for himself, <cosponsor name-id="G000546">Mr. Graves of Missouri</cosponsor>, <cosponsor name-id="T000462">Mr. Tiberi</cosponsor>, and <cosponsor name-id="M001189">Mr. Messer</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To exempt certain long-term care hospitals operating in a single-hospital MSA from the Medicare threshold payment adjustment policy for long-term care hospitals, and for other purposes.</official-title></form><legis-body id="H327FDD092F1F48EAB6FC6055D2109E48" style="OLC"><section id="H8BB0D134D9464068B6FCD242ADB9E5EF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defending Rural Access to Long Term Acute Care Act of 2013</short-title></quote>.</text></section><section id="H488E32026DEC4E2F956F8EC55BF5F48E"><enum>2.</enum><header>Exemption from threshold payment adjustment policy for certain long-term care hospitals operating in a single-hospital MSA</header><subsection id="HFEFC7A4F0C5B4055A985E8FEAEFF1672"><enum>(a)</enum><header>In general</header><text>The Secretary of Health and Human Services shall not apply sections 412.534 or 412.536 of title 42, Code of Federal Regulations, to any long-term care hospital operating in a single-hospital MSA (as defined in subsection (b)).</text></subsection><subsection id="HB806B95AE92744F689F7FD7751AEBF25"><enum>(b)</enum><header>Long-Term care hospital operating in a single-Hospital MSA defined</header><text>In this section, the term <term>long-term care hospital operating in a single-hospital MSA</term> means an entity that meets the following criteria on the date of the enactment of this Act:</text><paragraph id="H15FDBD650644494581A997D04BD65836"><enum>(1)</enum><text>The entity is a long-term care hospital as defined in section 1861(ccc) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ccc)</external-xref>), but is not a long-term care hospital described in section 1886(d)(1)(B)(iv)(II) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(1)(B)(iv)(II)</external-xref>).</text></paragraph><paragraph id="H8B18CD3F7F9A408F89DFF3B0223D187B"><enum>(2)</enum><text>The entity is located in a Metropolitan Statistical Area (as defined by the Office of Management and Budget in OMB Bulletin 13–01 published February 28, 2013) that has only one subsection (d) hospital (as defined in section 1886(d)(2)(D) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(2)(D)</external-xref>).</text></paragraph></subsection><subsection id="H0DEA58B7AFB54A1AB59F46E89D3E9B56"><enum>(c)</enum><header>Effective date</header><text>Subsection (a) applies to long-term care hospitals for cost reporting periods beginning on or after October 1, 2013.</text></subsection></section></legis-body></bill>
