protections</header><paragraph commented="no" display-inline="no-display-inline" id="H7E9B81840CE8409FBED9AC765B32365C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 501(b) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(b)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="H0B30FFC3668248EFAFD6118CE360B581"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)(B), by striking <quote><short-title>and</short-title></quote> after the semicolon;</text></subparagraph><subparagraph display-inline="no-display-inline" id="HD7080D0E903B4E748BDFD95411185116"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking subparagraphs (A) and (B) and inserting the following new subparagraphs:</text><quoted-block act-name="" display-inline="no-display-inline" id="H7B28BE5DE3004EE58819CE68C7698980" style="OLC"><subparagraph id="H561ACA81947E4849AF69ED69016F5324"><enum>(A)</enum><text>a statement of facts showing that there are reasonable grounds to believe that the tangible things sought—</text><clause id="HB0A3CA68132B48AF91A82BA54DA6403A"><enum>(i)</enum><text>are relevant and material to an authorized investigation (other than a threat assessment) conducted in accordance with subsection (a)(2) to—</text><subclause id="id32A68FA80F7247CDA9BB1B336A603BD7"><enum>(I)</enum><text>obtain foreign intelligence information not concerning a United States person; or</text></subclause><subclause id="idCEB57F75F8774CFCBC6B1C8A14D32235"><enum>(II)</enum><text>protect against international terrorism or clandestine intelligence activities; and</text></subclause></clause><clause id="HBB3BB0B4476046C38366D695FDFDC537"><enum>(ii)</enum><text display-inline="yes-display-inline">pertain to—</text><subclause commented="no" display-inline="no-display-inline" id="H12E4358B9198451084648D0AF4524174"><enum>(I)</enum><text>a foreign power or an agent of a foreign power;</text></subclause><subclause display-inline="no-display-inline" id="HF8CDD66088014549A335F4051F4D5810"><enum>(II)</enum><text>the activities of a suspected agent of a foreign power who is the subject of such authorized investigation; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H7DBB5305BE5D49B2AC3EC427DF7F985A"><enum>(III)</enum><text>an individual in contact with, or known to, a suspected agent of a foreign power; and</text></subclause></clause></subparagraph><subparagraph id="H9CB02E67455B4813B1B52F0A827CEC34"><enum>(B)</enum><text>a statement of proposed minimization procedures; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H57A88546441C40ABAD7C3BA406965A44"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following paragraph:</text><quoted-block display-inline="no-display-inline" id="H4C4381503B2F4E23A9301224CF5F98B7" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="H5F88C085A8EF4333A5AC928BD2549493"><enum>(3)</enum><text display-inline="yes-display-inline">if the applicant is seeking a nondisclosure requirement described in subsection (d), shall include—</text><subparagraph commented="no" display-inline="no-display-inline" id="H5016518B06B440BF98FC8D3A995067BF"><enum>(A)</enum><text display-inline="yes-display-inline">the time period during which the Government believes the nondisclosure requirement should apply;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H07F0F0374DB64E57BB308028BCBF26B0"><enum>(B)</enum><text display-inline="yes-display-inline">a statement of facts showing that there are reasonable grounds to believe that disclosure of particular information about the existence or contents of the order requiring the production of tangible things under this section during such time period will result in—</text><clause commented="no" display-inline="no-display-inline" id="H69E79B214BD04E18B427353B5E0EE950"><enum>(i)</enum><text display-inline="yes-display-inline">endangering the life or physical safety of any person;</text></clause><clause commented="no" display-inline="no-display-inline" id="H08CB7202378D46F3BA8B06D43C2198F7"><enum>(ii)</enum><text display-inline="yes-display-inline">flight from investigation or prosecution;</text></clause><clause commented="no" display-inline="no-display-inline" id="HD86851C689A04D358D62A3A1981A8C75"><enum>(iii)</enum><text display-inline="yes-display-inline">destruction of or tampering with evidence;</text></clause><clause commented="no" display-inline="no-display-inline" id="HB34CE18FEEA243B6AC55DC0FD3A5CA48"><enum>(iv)</enum><text display-inline="yes-display-inline">intimidation of potential witnesses;</text></clause><clause commented="no" display-inline="no-display-inline" id="HF24C803E6867484B89904DAA87CCF0C8"><enum>(v)</enum><text display-inline="yes-display-inline">interference with diplomatic relations;</text></clause><clause commented="no" display-inline="no-display-inline" id="H6D69B1F8DF284116BCEFFA92297D1EDF"><enum>(vi)</enum><text display-inline="yes-display-inline">alerting a target, an associate of a target, or the foreign power of which the target is an agent, of the interest of the Government in the target; or</text></clause><clause id="H00BC2E64BDB241CCB0E02E0A1BE4983B"><enum>(vii)</enum><text>otherwise seriously endangering the national security of the United States; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF70580E05B414BA1B77E90267A1F2FC9"><enum>(C)</enum><text display-inline="yes-display-inline">an explanation of how the nondisclosure requirement is narrowly tailored to address the specific harm identified under subparagraph (B).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H371DB90C61C64D7B899F94D790A2C7CF"><enum>(2)</enum><header display-inline="yes-display-inline">Order</header><text display-inline="yes-display-inline">Section 501(c) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(c)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="H1E05811E6C1C450287F28653DB184551"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="H7512F06BA59E46FBA080D3FAC521F280"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>subsections (a) and (b)</quote> and inserting <quote>subsection (a) and paragraphs (1) and (2) of subsection (b) and that the proposed minimization procedures meet the definition of minimization procedures under subsection (g)</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H809A1A9299D448A7901F03C7F79B8C57"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking the last sentence and inserting the following: <quote>If the judge finds that the requirements of subsection (b)(3) have been met, such order shall include a nondisclosure requirement, which may apply for not longer than 1 year, unless the facts justify a longer period of nondisclosure, subject to the principles and procedures described in subsection (d).</quote>; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H96CDBC5E29D04AAB909C5B5BB4B45FFB"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><clause commented="no" display-inline="no-display-inline" id="H2438D43E18F84B2CB56C29C8C16FDF8D"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (C), by inserting before the semicolon <quote>, if applicable</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="HE4D8EF17AF6745AC9B12BBB1E1AE155B"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking <quote>and</quote> at the end;</text></clause><clause commented="no" display-inline="no-display-inline" id="HE7CA813800744EA5B10230CA966BCD0A"><enum>(iii)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H26E77263756F4757988CECCEC33947A2"><enum>(iv)</enum><text display-inline="yes-display-inline">by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H69E2D3C8545640FFA5D77441C5AB8DF2" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="HA0607BC5900E45BEBC91671B6F0DDC4D"><enum>(F)</enum><text display-inline="yes-display-inline">shall direct that the minimization procedures be followed.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC226711248A34EFEB3DC07147BC24704"><enum>(3)</enum><header display-inline="yes-display-inline">Nondisclosure</header><text display-inline="yes-display-inline">Section 501(d) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(d)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HC0BBBB79F36141D1ACDC2220320E7EB5" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H90F5F3B7BB8243739A2C27DF71FEE7E4"><enum>(d)</enum><header display-inline="yes-display-inline">Nondisclosure</header><paragraph commented="no" display-inline="no-display-inline" id="H2BEE10C487904FC787C95EA22584F78F"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">No person who receives an order entered under subsection (c) that contains a nondisclosure requirement shall disclose to any person the particular information specified in the nondisclosure requirement during the time period to which the requirement applies.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3231CF80D1E9475B8698936AEB9FDCC4"><enum>(2)</enum><header display-inline="yes-display-inline">Exception</header><subparagraph commented="no" display-inline="no-display-inline" id="HF38F06D85B454E5BB567D0BE41902A48"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A person who receives an order entered under subsection (c) that contains a nondisclosure requirement may disclose information otherwise subject to any applicable nondisclosure requirement to—</text><clause commented="no" display-inline="no-display-inline" id="H5CB46EEF9F47413D9F2FA2CAE3F50D12"><enum>(i)</enum><text display-inline="yes-display-inline">those persons to whom disclosure is necessary to comply with the order;</text></clause><clause commented="no" display-inline="no-display-inline" id="HF5A01A877DB3431EBAD320E501296957"><enum>(ii)</enum><text display-inline="yes-display-inline">an attorney to obtain legal advice or assistance regarding the order; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H34BB25F4016841BAAD27F880A92E4EE4"><enum>(iii)</enum><text display-inline="yes-display-inline">other persons as permitted by the Director of the Federal Bureau of Investigation or the designee of the Director.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H744AF5A06C434CBAA060A52B9CB9E533"><enum>(B)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">A person to whom disclosure is made under subparagraph (A) shall be subject to the nondisclosure requirements applicable to a person to whom an order is directed under this section in the same manner as the person to whom the order is directed.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H12BAE040F7D0434BA650CB81183AE03B"><enum>(C)</enum><header display-inline="yes-display-inline">Notice</header><text display-inline="yes-display-inline">Any person who discloses to a person described in subparagraph (A) information otherwise subject to a nondisclosure requirement shall notify the person of the applicable nondisclosure requirement.</text></subparagraph><subparagraph id="H52CDD04DF8F142F1829764C74B7E03BD"><enum>(D)</enum><header>Identification of disclosure recipients</header><text display-inline="yes-display-inline">At the request of the Director of the Federal Bureau of Investigation or the designee of the Director, any person making or intending to make a disclosure under clause (i) or (iii) of subparagraph (A) shall identify to the Director or such designee the person to whom such disclosure will be made or to whom such disclosure was made prior to the request.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H64FE69BF3CBF48E195FE47B0FAAB3056"><enum>(3)</enum><header display-inline="yes-display-inline">Extension</header><text display-inline="yes-display-inline">The Director of the Federal Bureau of Investigation, or a designee of the Director (whose rank shall be no lower than Assistant Special Agent in Charge), may apply for renewals of the prohibition on disclosure of particular information about the existence or contents of an order requiring the production of tangible things under this section for additional periods of not longer than 1 year, unless the facts justify a longer period of nondisclosure. A nondisclosure requirement shall be renewed if a court having jurisdiction under paragraph (4) determines that the application meets the requirements of subsection (b)(3).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEBEB54A3CABC47319DCC4E034F6103B0"><enum>(4)</enum><header display-inline="yes-display-inline">Jurisdiction</header><text display-inline="yes-display-inline">An application for a renewal under this subsection shall be made to—</text><subparagraph commented="no" display-inline="no-display-inline" id="H9FCC6492C63F46DD95337A08C5D48C46"><enum>(A)</enum><text display-inline="yes-display-inline">a judge of the court established under section 103(a); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H16AFF89410D548A7B3D0BB07D697C108"><enum>(B)</enum><text display-inline="yes-display-inline">a United States Magistrate Judge under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/43">chapter 43</external-xref> of title 28, United States Code, who is publicly designated by the Chief Justice of the United States to have the power to hear applications and grant orders for the production of tangible things under this section on behalf of a judge of the court established under section 103(a).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H51B1B91633C2409487661D670632A3F7"><enum>(4)</enum><header display-inline="yes-display-inline">Minimization</header><text display-inline="yes-display-inline">Section 501(g) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(g)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="HAB36E9B4573240AC924F1E8093935E22"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>Not later than</quote> and all that follows and inserting <quote>At or before the end of the period of time for the production of tangible things under an order entered under this section or at any time after the production of tangible things under an order entered under this section, a judge may assess compliance with the minimization procedures required by such order by reviewing the circumstances under which information concerning United States persons was acquired, retained, or disseminated.</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0CDA7161E6FA445E97B30FC16C1B79E2"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)(A), by inserting <quote>acquisition and</quote> after <quote>to minimize the</quote>.</text></subparagraph></paragraph><paragraph id="H3503F1A21D0645648C7ED9849197D5F6"><enum>(5)</enum><header>Conforming amendment</header><text>Section 501(f)(1)(B) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(f)(1)(B)</external-xref>) is amended by striking <quote>an order imposed under subsection (d)</quote> and inserting <quote>a nondisclosure requirement imposed in connection with a production order</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H214E7786B5EA40ACB42A153AA6B7CB63"><enum>(b)</enum><header display-inline="yes-display-inline">Judicial review</header><text display-inline="yes-display-inline">Section 501(f)(2) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861(f)(2)</external-xref>) is amended—</text><paragraph id="H4AAD6A2168E14A97AB36DDF30BFC058F"><enum>(1)</enum><text>in subparagraph (A)(i)—</text><subparagraph id="HA010F7267BBA423E9ED64A430AEDF3E7"><enum>(A)</enum><text>by striking <quote>that order</quote> and inserting <quote>such production order or any nondisclosure order imposed in connection with such production order</quote>; and</text></subparagraph><subparagraph id="H0ECDF133DED0412B942F87BAA69EDF8E"><enum>(B)</enum><text>by striking the second sentence;</text></subparagraph></paragraph><paragraph id="H8F55EAB4699849B88A30E732452A3A58"><enum>(2)</enum><text>by striking subparagraph (C) and inserting the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="HBF984B28619043738B7C58523FF89A20" style="traditional"><subparagraph id="H64CD669B36CD492CAC51F062CB3D7329" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">A judge considering a petition to modify or set aside a nondisclosure order shall grant such petition unless the court determines that—</text><clause id="H602F97D7E027456180F6228898ACFCB2"><enum>(i)</enum><text>there is reason to believe that disclosure of the information subject to the nondisclosure requirement during the time period in which such requirement is in effect will result in—</text><subclause id="H3A854A7A3F0B407A91CD7FF3B63EFD6F"><enum>(I)</enum><text>endangering the life or physical safety of any person;</text></subclause><subclause id="H07EC99A6A5024EBDBED4090999F4CC83"><enum>(II)</enum><text>flight from investigation or prosecution;</text></subclause><subclause id="H0D0CCADCCA174A8481764D2006733172"><enum>(III)</enum><text>destruction of or tampering with evidence;</text></subclause><subclause id="H63987B2B94924EBA9051855D98993A39"><enum>(IV)</enum><text>intimidation of potential witnesses;</text></subclause><subclause id="HF657D5A63EEC43BFA5D5202DFD3CFDBB"><enum>(V)</enum><text>interference with diplomatic relations;</text></subclause><subclause id="HDB972A1509FF40D8BB9B3336B73921D3"><enum>(VI)</enum><text>alerting a target, an associate of a target, or the foreign power of which the target is an agent, of the interest of the Government in the target; or</text></subclause><subclause id="HE1F1A047A8FA4C0E982AF65AC5EB5994"><enum>(VII)</enum><text display-inline="yes-display-inline">otherwise seriously endangering the national security of the United States; and</text></subclause></clause><clause id="H6395DBAC64654DB6B5DCD59A71C0A532"><enum>(ii)</enum><text>the nondisclosure requirement is narrowly tailored to address the specific harm identified under clause (i).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HA2F3A1DB1096455693990625BF08FFDD"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H90DA3C3D36B84E4FB3AE20EAAB5ED5DB" style="traditional"><subparagraph id="HCCA053115F6849FD934D226B29F7D34B" indent="up2"><enum>(E)</enum><text>If a judge denies a petition to modify or set aside a nondisclosure order under this paragraph, no person may file another petition to modify or set aside such nondisclosure order until the date that is one year after the date on which such judge issues the denial of such petition.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HD73A50887F8A4852BB902C194DD4815B"><enum>(c)</enum><header>Emergency authority for access to call detail records</header><paragraph id="HA07B743AD1A341FE8A265532895A4740"><enum>(1)</enum><header>In general</header><text>Title V of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861 et seq.</external-xref>) is amended—</text><subparagraph id="H8012B52E1F0145ED9C6338881F50F2CC"><enum>(A)</enum><text>by redesignating section 502 as section 503; and</text></subparagraph><subparagraph id="H8B035E4DD4FF4DF0A950B56FC67C23E4"><enum>(B)</enum><text>by inserting after section 501 the following new section:</text><quoted-block display-inline="no-display-inline" id="H180B246F3EC64342936B43D39FDB9B0F" style="OLC"><section id="H90F7FE5B8B3441EDAC0124B95708FB74"><enum>502.</enum><header>Emergency authority for access to call detail records</header><subsection id="H76B2ECAE94E34FDC9D188079A78A33BC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, the Attorney General may require the production of call detail records by the provider of a wire or electronic communication service on an emergency basis if—</text><paragraph id="H9C22283E70AC448B8692442CD0B10453"><enum>(1)</enum><text display-inline="yes-display-inline">such records—</text><subparagraph id="H2C88E45C2CA6465AB3C1D8FB8ADFE740"><enum>(A)</enum><text>are relevant and material to an authorized investigation (other than a threat assessment) conducted in accordance with section 501(a)(2) to—</text><clause id="id4FCA63E9CE0548F882457D44E39FAEA9"><enum>(i)</enum><text>obtain foreign intelligence information not concerning a United States person; or</text></clause><clause id="idB41802AE437C41E399815DAAC28B9CC7"><enum>(ii)</enum><text>protect against international terrorism or clandestine intelligence activities; and</text></clause></subparagraph><subparagraph id="HFEFC186011F04DF58CC276708146A701"><enum>(B)</enum><text display-inline="yes-display-inline">pertain to—</text><clause commented="no" display-inline="no-display-inline" id="H02CAB528346A43DFA24933A505B74D0A"><enum>(i)</enum><text>a foreign power or an agent of a foreign power;</text></clause><clause display-inline="no-display-inline" id="H200FB7A56D834E60828DAFCC045F632D"><enum>(ii)</enum><text>the activities of a suspected agent of a foreign power who is the subject of such authorized investigation; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H308E5EB1743F467E8C5BF62D66127CD1"><enum>(iii)</enum><text>an individual in contact with, or known to, a suspected agent of a foreign power;</text></clause></subparagraph></paragraph><paragraph id="H65C1B09941C2430291A237C31699D782"><enum>(2)</enum><text>the Attorney General reasonably determines that—</text><subparagraph display-inline="no-display-inline" id="HC2DC9C543DAD4E219BBCF9DD798A4E1C"><enum>(A)</enum><text>an emergency requires the production of such records before an order requiring such production can with due diligence be obtained under section 501; and</text></subparagraph><subparagraph id="H0A63945C03B14DA8AB88B353B88F173A"><enum>(B)</enum><text>the factual basis for issuance of an order under section 501 to require the production of such records exists;</text></subparagraph></paragraph><paragraph id="H1EE2B322EED240B69E99AFB7CB92DCD2"><enum>(3)</enum><text>a judge referred to in section 501(b)(1) is informed by the Attorney General or a designee of the Attorney General at the time of the required production of such records that the decision has been made to require such production on an emergency basis; and</text></paragraph><paragraph id="HB5DBC3A2B45E4D429655BC4B1C743CB4"><enum>(4)</enum><text>an application in accordance with section 501 is made to such judge as soon as practicable, but not more than 7 days after the date on which the Attorney General requires the production of such records under this section.</text></paragraph></subsection><subsection id="HB8E32BDD5611467C85A475782EEA4F02"><enum>(b)</enum><header>Termination of authority</header><paragraph id="H1D92601F998B4E82B52E97BE6702549C"><enum>(1)</enum><header>Termination</header><text>In the absence of an order under section 501 approving the production of call detail records under subsection (a), the authority to require the production of such records shall terminate at the earlier of—</text><subparagraph id="HBF03EE23EBFD4F35B743DB1482976410"><enum>(A)</enum><text>when the information sought is obtained;</text></subparagraph><subparagraph id="H9063EDFE88DC4403BB14F8164231A3D1"><enum>(B)</enum><text>when the application for the order is denied under section 501; or</text></subparagraph><subparagraph id="H2D872D4777A74C9F9AA41C9FF98D3FED"><enum>(C)</enum><text>7 days after the time of the authorization by the Attorney General.</text></subparagraph></paragraph><paragraph id="H8AB5B29AE7EE413FB39F3DF266943110"><enum>(2)</enum><header>Use of information</header><text>If an application for an order under section 501 for the production of call detail records required to be produced pursuant to subsection (a) is denied, or in any other case in which the emergency production of call detail records under this section is terminated and no order under section 501 is issued approving the required production of such records, no information obtained or evidence derived from such records shall be received in evidence or otherwise disclosed in any trial, hearing, or other proceeding in or before any court, grand jury, department, office, agency, regulatory body, legislative committee, or other authority of the United States, a State, or political subdivision thereof, and no information concerning any United States person acquired from such records shall subsequently be used or disclosed in any other manner by Federal officers or employees without the consent of such person, except with the approval of the Attorney General if the information indicates a threat of death or serious bodily harm to any person.</text></paragraph></subsection><subsection commented="no" id="H225754616B704E26BE40131BC432DC0D"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">The Attorney General shall annually submit to the Permanent Select Committee on Intelligence and the Committee on the Judiciary of the House of Representatives and the Select Committee on Intelligence and the Committee on the Judiciary of the Senate a report containing the number of times the authority under this section was exercised during the calendar year covered by such report.</text></subsection><subsection id="HDAE400ED99574FF1874EBA5993940C8A"><enum>(d)</enum><header>Call detail records defined</header><text display-inline="yes-display-inline">In this section, the term <quote>call detail records</quote>—</text><paragraph id="HCC5AFC72EA0D47EB978348584B1425E6"><enum>(1)</enum><text>means session identifying information (including originating or terminating telephone number, International Mobile Subscriber Identity number, or International Mobile Station Equipment Identity number), telephone calling card numbers, or the time or duration of a call; and</text></paragraph><paragraph id="H8F0C8A9CB59E425BA286A1BCD20D0DF2"><enum>(2)</enum><text>does not include—</text><subparagraph id="H45BCEF00422B41CE8471EB04A77788F8"><enum>(A)</enum><text>the contents of any communication (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/2510">section 2510(8)</external-xref> of title 18, United States Code);</text></subparagraph><subparagraph id="H941D93211BE64486A275DD061839A6CB"><enum>(B)</enum><text>the name, address, or financial information of a subscriber or customer; and</text></subparagraph><subparagraph id="H19506CFA47264D12AD4F62ECEFE0227A"><enum>(E)</enum><text>examine any minimization procedures proposed by an element of the intelligence community under such title that were modified or denied by the court established under section 103(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(a)</external-xref>).</text></subparagraph></paragraph><paragraph id="H12AB716FDC2341C6BE4461717FDB952D"><enum>(2)</enum><header>Submission date for assessment</header><text>Not later than December 31, 2014, the Inspector General of the Intelligence Community shall submit to the Committee on the Judiciary and the Select Committee on Intelligence of the Senate and the Committee on the Judiciary and the Permanent Select Committee on Intelligence of the House of Representatives a report containing the results of the assessment for calendar years 2010 through 2013.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HFEE46C5B5A8A4B3D86920DC99E31A172"><enum>(5)</enum><text>in subsection (e), as redesignated by paragraph (3)—</text><subparagraph id="HBD436CF524214F79919584BF3EE52C49"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="HA3143C15A26D4B64923E7146F96DFD7D"><enum>(i)</enum><text>by striking <quote>a report under subsection (c)(1) or (c)(2)</quote> and inserting <quote>any report under subsection (c) or (d)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAEB88F4CE48940438B85D1A20D607484"><enum>(B)</enum><text display-inline="yes-display-inline">pertain to—</text><clause commented="no" display-inline="no-display-inline" id="H0C94630C88AC4C2E81CF61E2FA632250"><enum>(i)</enum><text display-inline="yes-display-inline">a foreign power or an agent of a foreign power;</text></clause><clause commented="no" display-inline="no-display-inline" id="HD1591E3122804982AE85DF62791B0B31"><enum>(ii)</enum><text display-inline="yes-display-inline">the activities of a suspected agent of a foreign power who is the subject of such authorized investigation; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H7E986B349F2C4C1CBB2E3729E2072B5A"><enum>(iii)</enum><text display-inline="yes-display-inline">an individual in contact with, or known to, a suspected agent of a foreign power; and</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9295784A8D10410A83603E9AA96210C7"><enum>(3)</enum><text display-inline="yes-display-inline">a statement of proposed minimization procedures.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA1DE53966A1940C2BC9A46187170ABED"><enum>(b)</enum><header display-inline="yes-display-inline">Minimization</header><paragraph commented="no" display-inline="no-display-inline" id="H7814FCD1C05344AE80DEA75B7AF7ED57"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">Section 401 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1841">50 U.S.C. 1841</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HB1B6761EC3154A93BBBAFA9EA237C4CE" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="H455BA2F3974E4EBB8212BEDA37B0B659"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>minimization procedures</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="H8A566739DB78472298507C5324F445BB"><enum>(A)</enum><text display-inline="yes-display-inline">specific procedures that are reasonably designed in light of the purpose and technique of an order for the installation and use of a pen register or trap and trace device, to minimize the acquisition and retention, and prohibit the dissemination, of nonpublicly available information concerning unconsenting United States persons consistent with the need of the United States to obtain, produce, and disseminate foreign intelligence information;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3EFDC0D8BA7E45CAA365FA61D8CBB251"><enum>(B)</enum><text display-inline="yes-display-inline">procedures that require that nonpublicly available information, which is not foreign intelligence information, as defined in section 101(e)(1), shall not be disseminated in a manner that identifies any United States person, without such person’s consent, unless such person’s identity is necessary to understand foreign intelligence information or assess its importance; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0BF02A73F8EC403C842B6E6070B9E909"><enum>(C)</enum><text display-inline="yes-display-inline">notwithstanding subparagraphs (A) and (B), procedures that allow for the retention and dissemination of information that is evidence of a crime which has been, is being, or is about to be committed and that is to be retained or disseminated for law enforcement purposes.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9A5909037C3B466CA140CC268FA44199"><enum>(2)</enum><header display-inline="yes-display-inline">Procedures required</header><text display-inline="yes-display-inline">Section 402 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1842">50 U.S.C. 1842</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="HF606A7F0C02C4C2D9F09AEC273FFE59C"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (d)—</text><clause commented="no" display-inline="no-display-inline" id="HE3A2F772B27949EFB33085594760BB82"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>and that the proposed minimization procedures meet the definition of minimization procedures under this title</quote> before the period at the end; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H1A440E6911074BE6A454F7E406CBE183"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (2)(B)—</text><subclause commented="no" display-inline="no-display-inline" id="HF592D873D73444DB8C21FF3DA9202543"><enum>(I)</enum><text display-inline="yes-display-inline">in clause (ii)(II), by striking <quote>and</quote> after the semicolon; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HA6EFBF2B0DF14B608B8F567792847976"><enum>(II)</enum><text display-inline="yes-display-inline">by adding at the end the following new clause:</text><quoted-block display-inline="no-display-inline" id="H31969410004C4E128A5C878F0E02152D" style="OLC"><clause commented="no" display-inline="no-display-inline" id="H8E295489185949C29034706F774553D6"><enum>(iv)</enum><text display-inline="yes-display-inline">the minimization procedures be followed; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA732B10E447746919ADDEC7D36301973"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H84AD14F77CD742C698F44D68847BCA26" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H7E8776D0DEB0439FB7388F0BC4A8BDE1"><enum>(h)</enum><text display-inline="yes-display-inline">At or before the end of the period of time for which the installation and use of a pen register or trap and trace device is approved under an order or an extension under this section, the judge may assess compliance with the minimization procedures by reviewing the circumstances under which information concerning United States persons was acquired, retained, or disseminated.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HACD3F9841A9345C69A4FA060664D136E"><enum>(3)</enum><header display-inline="yes-display-inline">Emergencies</header><text display-inline="yes-display-inline">Section 403 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1843">50 U.S.C. 1843</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="H74DB3EFFAB7845F789D77ADB2B42087D"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subsection (c) as subsection (d); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H208805368A7545639DD9E41645034979"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after subsection (b) the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H33CE2634A6D947C398A13064C252C067" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H9170D9ECFC164F0C9DCD14FA666935AE"><enum>(c)</enum><text display-inline="yes-display-inline">If the Attorney General authorizes the emergency installation and use of a pen register or trap and trace device under this section, the Attorney General shall require that minimization procedures required by this title for the issuance of a judicial order be followed.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H119DB73888B24DCC856836F0EABD10F2"><enum>(4)</enum><header display-inline="yes-display-inline">Use of information</header><text display-inline="yes-display-inline">Section 405(a)(1) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1845">50 U.S.C. 1845(a)(1)</external-xref>) is amended by inserting <quote>and the minimization procedures required under the order approving such pen register or trap and trace device</quote> after <quote>of this section</quote>.</text></paragraph></subsection><subsection id="H9835F3EF22EA43289BFC6B035DB62954"><enum>(c)</enum><header>Transition procedures</header><paragraph id="HCCC02F9FC8DF47A6B782CBDCC8105D4D"><enum>(1)</enum><header>Orders in effect</header><text display-inline="yes-display-inline">Notwithstanding the amendments made by this section, an order entered under section 402(d)(1) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1842">50 U.S.C. 1842(d)(1)</external-xref>) that is in effect on the effective date of the amendments made by this section shall remain in effect until the expiration of the order.</text></paragraph><paragraph id="H818B571AD7264E80BD7CCB2E4A46521F"><enum>(2)</enum><header>Extensions</header><text display-inline="yes-display-inline">A request for an extension of an order referred to in paragraph (1) shall be subject to the requirements of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>), as amended by this Act.</text></paragraph></subsection></section><section id="H4CAEB75361EF43AD93B0BFF5860E65B5"><enum>202.</enum><header>Inspector general reports on pen registers and trap and trace devices</header><subsection id="H0143EA422845490AA1B98C39DE325C06"><enum>(a)</enum><header>Audits</header><text>The Inspector General of the Department of Justice shall perform comprehensive audits of the effectiveness and use, including any improper or illegal use, of pen registers and trap and trace devices under title IV of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1841">50 U.S.C. 1841 et seq.</external-xref>) during the period beginning on January 1, 2010, and ending on December 31, 2013.</text></subsection><subsection id="HBC20728A7CC146A5900D7DF6FC996F2A"><enum>(b)</enum><header>Requirements</header><text>The audits required under subsection (a) shall include—</text><paragraph id="H72F9C697A9C44BD582C1D7752AAB204C"><enum>(1)</enum><text>an examination of the use of pen registers and trap and trace devices under such title for calendar years 2010 through 2013;</text></paragraph><paragraph id="H4393729D048B4CE3BCACF3369CE54E7C"><enum>(2)</enum><text>an examination of the installation and use of a pen register or trap and trace device on emergency bases under section 403 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1843">50 U.S.C. 1843</external-xref>);</text></paragraph><paragraph id="H3E7009EBE5554B6481E12E0DF4DD1869"><enum>(3)</enum><text>an examination of any noteworthy facts or circumstances relating to the use of a pen register or trap and trace device under such title, including any improper or illegal use of the authority provided under such title; and</text></paragraph><paragraph id="HC9D24827C6DB40B79474F8A2C3DD2C48"><enum>(4)</enum><text>an examination of the effectiveness of the authority under such title as an investigative tool, including—</text><subparagraph id="HA634B02B3C2544C1AD66A28D3D7C6C62"><enum>(A)</enum><text>the importance of the information acquired to the intelligence activities of the Federal Bureau of Investigation;</text></subparagraph><subparagraph id="H4B660B5B7B5B48FEA345A2F4A35AB265"><enum>(B)</enum><text>the manner in which the information is collected, retained, analyzed, and disseminated by the Federal Bureau of Investigation, including any direct access to the information provided to any other department, agency, or instrumentality of Federal, State, local, or tribal governments or any private sector entity;</text></subparagraph><subparagraph id="H52EAB80E059543EBB73B09FEE807F826"><enum>(C)</enum><text>whether, and how often, the Federal Bureau of Investigation used information acquired under a pen register or trap and trace device under such title to produce an analytical intelligence product for distribution within the Federal Bureau of Investigation, to the intelligence community, or to another department, agency, or instrumentality of Federal, State, local, or tribal governments; and</text></subparagraph><subparagraph id="HFB34D9C6E19E46A4AF50E68EB63E6B8A"><enum>(D)</enum><text>whether, and how often, the Federal Bureau of Investigation provided information acquired under a pen register or trap and trace device under such title to law enforcement authorities for use in criminal proceedings.</text></subparagraph></paragraph></subsection><subsection id="H44958D9E7A61470FB7D3078B05F9A5A2"><enum>(c)</enum><header>Report</header><text>Not later than December 31, 2014, the Inspector General of the Department of Justice shall submit to the Committee on the Judiciary and the Select Committee on Intelligence of the Senate and the Committee on the Judiciary and the Permanent Select Committee on Intelligence of the House of Representatives a report containing the results of the audits conducted under subsection (a) for calendar years 2010 through 2013.</text></subsection><subsection id="H4360F2E01C3C40DFB317AA510CA20EE9"><enum>(d)</enum><header>Intelligence assessment</header><paragraph id="HEAE6521510AF44F8908848BBE329BF05"><enum>(1)</enum><header>In general</header><text>For the period beginning January 1, 2010, and ending on December 31, 2013, the Inspector General of the Intelligence Community shall—</text><subparagraph id="HB71447F3916645AF993DF83353877A95"><enum>(A)</enum><text>assess the importance of the information to the activities of the intelligence community;</text></subparagraph><subparagraph id="HF6DDCE99F1134E6381CD0B64CBFB0D75"><enum>(B)</enum><text>examine the manner in which the information was collected, retained, analyzed, and disseminated;</text></subparagraph><subparagraph id="HF3C15E7530E44C71B9674228DBB805E4"><enum>(C)</enum><text>describe any noteworthy facts or circumstances relating to orders under title IV of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1841">50 U.S.C. 1841 et seq.</external-xref>); and</text></subparagraph><subparagraph id="H316B87CAC5BE43168AF20B946121C9E8"><enum>(D)</enum><text>examine any minimization procedures used by elements of the intelligence community in relation to pen registers and trap and trace devices under title IV of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1841">50 U.S.C. 1841 et seq.</external-xref>) and whether the minimization procedures adequately protect the constitutional rights of United States persons.</text></subparagraph></paragraph><paragraph id="H22420ACE4DDC449397AABB012648D2B9"><enum>(2)</enum><header>Submission dates for assessment</header><text>Not later than December 31, 2014, the Inspector General of the Intelligence Community shall submit to the Committee on the Judiciary and the Select Committee on Intelligence of the Senate and the Committee on the Judiciary and the Permanent Select Committee on Intelligence of the House of Representatives a report containing the results of the assessment for calendar years 2010 through 2013.</text></paragraph></subsection><subsection id="HF613588AB2BB4123BE5CF92A8FB3CC6C"><enum>(e)</enum><header>Prior notice to attorney general and director of national intelligence; comments</header><paragraph id="H24AF7EB49760459EA0FF242DB227F2F1"><enum>(1)</enum><header>Notice</header><text>Not later than 30 days before the submission of any report under subsection (c) or (d), the Inspector General of the Department of Justice and the Inspector General of the Intelligence Community shall provide the report to the Attorney General and the Director of National Intelligence.</text></paragraph><paragraph id="H0FEE30F4B6564C658954D50D4554F340"><enum>(2)</enum><header>Comments</header><text>The Attorney General or the Director of National Intelligence may provide such comments to be included in any report submitted under subsection (c) or (d) as the Attorney General or the Director of National Intelligence may consider necessary.</text></paragraph></subsection><subsection id="H7D99764A9E9446D9879ADA65A48AEC05"><enum>(f)</enum><header>Unclassified form</header><text>Each report submitted under subsection (c) and any comments included in that report under subsection (e)(2) shall be in unclassified form, but may include a classified annex.</text></subsection><subsection id="HA2B7C54180A64404A056BE6EE0C47BEB"><enum>(g)</enum><header>Definitions</header><text>In this section—</text><paragraph id="HB8CD0E10DCD3418A9A340FBC564B06A8"><enum>(1)</enum><text>the terms <quote>Attorney General</quote>, <quote>foreign intelligence information</quote>, and <quote>United States person</quote> have the meanings given those terms in section 101 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801</external-xref>);</text></paragraph><paragraph id="H086554C4D82F447DA26FF38B0DCA0850"><enum>(2)</enum><text>the term <quote>intelligence community</quote> has the meaning given that term in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>);</text></paragraph><paragraph id="HE6D04BF88BC3414F9CCB70D8B44BFA00"><enum>(3)</enum><text>the term <quote>minimization procedures</quote> has the meaning given that term in section 401 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1841">50 U.S.C. 1841</external-xref>), as amended by this Act; and</text></paragraph><paragraph id="H2DBBE1EF4CEB4E43887136688DF679D3"><enum>(4)</enum><text>the terms <quote>pen register</quote> and <quote>trap and trace device</quote> have the meanings given those terms in <external-xref legal-doc="usc" parsable-cite="usc/18/3127">section 3127</external-xref> of title 18, United States Code.</text></paragraph></subsection></section></title><title id="H369B75695C044662860FBC76D2FD2E3A"><enum>III</enum><header>FISA acquisitions targeting persons outside the United States reforms</header><section id="HB0E6C5E559A1478DA7F844CAA0337173"><enum>301.</enum><header>Clarification on prohibition on searching of collections of communications to conduct warrantless searches for the communications of United States persons</header><text display-inline="no-display-inline">Section 702(b) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(b)</external-xref>) is amended—</text><paragraph id="HA0017103EA584E4AB6012AB1472E272B"><enum>(1)</enum><text>by redesignating paragraphs (1) through (5) as subparagraphs (A) through (E), respectively, and indenting such subparagraphs, as so redesignated, an additional two ems from the left margin;</text></paragraph><paragraph id="HA15CF1AE7B8C474EB13D174B0CD21CE8"><enum>(2)</enum><text>by striking <quote>An acquisition</quote> and inserting the following:</text><quoted-block id="H078A08D23AC44B05A7A8A7772867C2A5" style="OLC"><paragraph id="H3E3688BB75924C4F8EF9AC6D87C37C69"><enum>(1)</enum><header>In general</header><text>An acquisition</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HBFF0C096E55941408F057456605190D6"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="H8235123EA59A480AA20C13204C8B65EC" style="OLC"><paragraph id="HB5BD9024B6EF4BA0AEEC8F5A0399DDDD"><enum>(2)</enum><header>Clarification on prohibition on searching of collections of communications of United States persons</header><subparagraph id="H642127AEB20849C080FDE3B6F6D0C261"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), no officer or employee of the United States may conduct a search of a collection of communications acquired under this section in an effort to find communications of a particular United States person (other than a corporation).</text></subparagraph><subparagraph id="HED8E84BA3CBD47D88FEC33D837E4AEC2"><enum>(B)</enum><header>Concurrent authorization and exception for emergency situations</header><text>Subparagraph (A) shall not apply to a search for communications related to a particular United States person if—</text><clause id="HF545DDAC7A4D4C06B672DC97855C5123"><enum>(i)</enum><text>such United States person is the subject of an order or emergency authorization authorizing electronic surveillance or physical search under section 105, 304, 703, 704, or 705, or title 18, United States Code, for the effective period of that order;</text></clause><clause id="HD15DCB8FECF64B0EB105AA74480017A0"><enum>(ii)</enum><text>the entity carrying out the search has a reasonable belief that the life or safety of such United States person is threatened and the information is sought for the purpose of assisting that person; or</text></clause><clause id="H3D04229A7B0D46C8A0C872D6FFE6A94C"><enum>(iii)</enum><text>such United States person has consented to the search.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="H21E56C755A484969BF185984557AC916" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Protection against collection of wholly domestic communications</header><subsection id="H9495503A289F403D99C20968B6463146"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 702 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a</external-xref>) is amended—</text><paragraph id="H3FE8F823F72E4DFB85B77E1CFA308E2E"><enum>(1)</enum><text>in subsection (d)(1)—</text><subparagraph id="H26F2C9F68C7047EFA4AB01A69C2F0F9B"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id0B10A918E43044879D4F752EB06D6ABE"><enum>(B)</enum><text>in subparagraph (B), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H44F0E10BDB124D558735E8F24135FE0C"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H0F78FB6D36AA40A98114B7E1142B1FCC" style="OLC"><subparagraph id="HF4AAC41E5D3F44DA9DCDDEBE2FBD21D8"><enum>(C)</enum><text display-inline="yes-display-inline">limit the acquisition of the contents of any communication to those communications—</text><clause id="H9294140C6AE0415EA6F23A037584426F"><enum>(i)</enum><text>to which any party is a target of the acquisition; or</text></clause><clause commented="no" id="HAA9BE555C9FA48238C723FA1CA021385"><enum>(ii)</enum><text>that contain an account identifier of a target of an acquisition, only if such communications are acquired to protect against international terrorism or the international proliferation of weapons of mass destruction.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H1A2870F0AF9547B5841B979097F1A862"><enum>(2)</enum><text>in subsection (i)(2)(B)—</text><subparagraph id="HBB2CDB7CE9874BC1911B42B464538C18"><enum>(A)</enum><text>in clause (i), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="H457F837143824C4E862FB3540E15F4DE"><enum>(B)</enum><text>in clause (ii), by striking the period and inserting <quote>; and</quote>; or</text></subclause><subclause id="HBE8A028C3EC74D17A2E9E83458B3B948"><enum>(II)</enum><text>that contain an account identifier of the target of an acquisition, only if such communications are acquired to protect against international terrorism or the international proliferation of weapons of mass destruction.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HAE1029B86DDE437EBE5E2D9615603A96"><enum>(b)</enum><header>Conforming amendment</header><text>Section 701 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881">50 U.S.C. 1881</external-xref>) is amended—</text><paragraph id="HE518D2E7CE70422ABE58C7486BC126FF"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HA7450D0C7B264077A4DB0C07F8577125"><enum>(A)</enum><text>by inserting <quote><quote>international terrorism</quote>,</quote> after <quote><quote>foreign power</quote>,</quote>; and</text></subparagraph><subparagraph id="HF5EEC9FEC1F14C43B967FE2605FA39DA"><enum>(B)</enum><text>by striking <quote>and <quote>United States person</quote></quote> and inserting <quote><quote>United States person</quote>, and <quote>weapon of mass destruction</quote></quote>; and</text></subparagraph></paragraph><paragraph id="H52F623D237E84503A14756049D6676AE"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H248557B682564DA2BE6DF5CC73460B84"><enum>(A)</enum><text>by redesignating paragraphs (1) through (5) as paragraphs (2) through (6), respectively; and</text></subparagraph><subparagraph id="HC6B83F44898B4FF8BB61BAECA3A878F2"><enum>(B)</enum><text>by inserting before paragraph (2), as so redesignated, the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H7B9DE2F15205483E8F204F057D983620" style="OLC"><paragraph id="HB7C90BA7A77C4B38A0098BCA5CB67022"><enum>(1)</enum><header>Account identifier</header><text display-inline="yes-display-inline">The term <quote>account identifier</quote> means a telephone or instrument number, other subscriber number, email address, or username used to uniquely identify an account.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HBDBF040C487A42FEBEDF5B7ED73CDB23"><enum>(c)</enum><header>Effective date</header><text>The amendments made by subsections (a) and (b) shall take effect on the date that is 180 days after the date of the enactment of this Act.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H692E9D7F27584AD1AF7D853FDD0F6392" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">Prohibition on reverse targeting</header><text display-inline="no-display-inline">Section 702(b)(1)(B) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a</external-xref>), as redesignated by section 301(1) of this Act, is amended by striking <quote>the purpose</quote> and inserting <quote>a significant purpose</quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H23A7BAF199FD45C9AAB3D5B97B261A77" section-type="subsequent-section"><enum>304.</enum><header display-inline="yes-display-inline">Limits on use of unlawfully obtained information</header><text display-inline="no-display-inline">Section 702(i)(3) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(i)(3)</external-xref>) is amended by striking subparagraph (B) and inserting the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="HEB9DF8A4DBD842149892F1AE30CE7934" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="H03624961728C45EFB2D38FBD5F0172D0"><enum>(B)</enum><header display-inline="yes-display-inline">Correction of deficiencies</header><clause commented="no" display-inline="no-display-inline" id="H847B54D04294417FB864B2745D3EE358"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If the Court finds that a certification required by subsection (g) does not contain all of the required elements, or that the procedures required by subsections (d) and (e) are not consistent with the requirements of those subsections or the Fourth Amendment to the Constitution of the United States, the Court shall issue an order directing the Government to, at the Government’s election and to the extent required by the order of the Court—</text><subclause commented="no" display-inline="no-display-inline" id="HAC0DDDFB2C754B91A2AE824BE7B11C56"><enum>(I)</enum><text display-inline="yes-display-inline">correct any deficiency identified by the order of the Court not later than 30 days after the date on which the Court issues the order; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H924ADBEA6B7F44B3A332B1235A604F91"><enum>(II)</enum><text display-inline="yes-display-inline">cease, or not begin, the implementation of the authorization for which such certification was submitted.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HF77A4DEF72E64C999C74CEF35C79D18E"><enum>(ii)</enum><header display-inline="yes-display-inline">Limitation on use of information</header><subclause commented="no" display-inline="no-display-inline" id="H1E428EAD695544D39446C73A4AE18FD7"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subclause (II), no information obtained or evidence derived from an acquisition pursuant to a certification or targeting or minimization procedures subject to an order under clause (i) concerning any United States person shall be received in evidence or otherwise disclosed in any trial, hearing, or other proceeding in or before any court, grand jury, department, office, agency, regulatory body, legislative committee, or other authority of the United States, a State, or political subdivision thereof, and no information concerning any United States person acquired from the acquisition shall subsequently be used or disclosed in any other manner by Federal officers or employees without the consent of the United States person, except with the approval of the Attorney General if the information indicates a threat of death or serious bodily harm to any person.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H73A38949CC4043349E62322993E718DF"><enum>(II)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">If the Government corrects any deficiency identified by the order of the Court under clause (i), the Court may permit the use or disclosure of information acquired before the date of the correction under such minimization procedures as the Court shall establish for purposes of this clause.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HB1F22F761E1A4AE4BC9A7F2087D8B108"><enum>305.</enum><header>Modification of FISA Amendments Act of <enum-in-header>2008</enum-in-header> sunset</header><subsection id="H587C383B3DCC4EFBBA4A8A3B9AF15E1E"><enum>(a)</enum><header>Modification</header><text>Section 403(b)(1) of the FISA Amendments Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/261">Public Law 110–261</external-xref>; and</text></subparagraph><subparagraph id="H5064FDFB846C431D82A6A33D574F75C4"><enum>(B)</enum><text>by inserting after paragraph (2) the following new paragraph:</text><quoted-block id="HF386E2CA0F294DDD829A51BAB574FF1C" style="OLC"><paragraph id="H38F83705187C4BFAAE82D66914D9269C"><enum>(3)</enum><header>Inspector general of the Intelligence Community review</header><subparagraph id="H05990585332244118BBE27957290627B"><enum>(A)</enum><header>In general</header><text>The Inspector General of the Intelligence Community is authorized to review the acquisition, use, and dissemination of information acquired under subsection (a) to review compliance with the targeting and minimization procedures adopted in accordance with subsections (d) and (e) and the guidelines adopted in accordance with subsection (f), and in order to conduct the review required under subparagraph (B).</text></subparagraph><subparagraph id="H0B823F2D48CF456CA34A4D88B7DBF609"><enum>(B)</enum><header>Mandatory review</header><text>The Inspector General of the Intelligence Community shall review the procedures and guidelines developed by the elements of the intelligence community to implement this section, with respect to the protection of the privacy rights of United States persons, including—</text><clause id="H43FECF66DAE34FBFA0D5C92AC5363234"><enum>(i)</enum><text>an evaluation of the limitations outlined in subsection (b), the procedures approved in accordance with subsections (d) and (e), and the guidelines adopted in accordance with subsection (f), with respect to the protection of the privacy rights of United States persons; and</text></clause><clause id="H099FE2A2645246C7AA4CFDA70CA709B0"><enum>(ii)</enum><text>an evaluation of the circumstances under which the contents of communications acquired under subsection (a) may be searched in order to review the communications of particular United States persons.</text></clause></subparagraph><subparagraph id="HFEC08427CF9E451CAB4D7A9CC35F6EEC"><enum>(C)</enum><header>Consideration of other reviews and assessments</header><text>In conducting a review under subparagraph (B), the Inspector General of the Intelligence Community shall take into consideration, to the extent relevant and appropriate, any reviews or assessments that have been completed or are being undertaken under this section.</text></subparagraph><subparagraph id="H0BDF5D41B338424DB1D58970F47A342D"><enum>(D)</enum><header>Public reporting of findings and conclusions</header><text>In a manner consistent with the protection of the national security of the United States, and in unclassified form, the Inspector General of the Intelligence Community shall make publicly available a summary of the findings and conclusions of the review conducted under subparagraph (B).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HF4447BBAFB434F58B92838F378874917"><enum>(2)</enum><header>Report</header><text>Not later than December 31, 2014, the Inspector General of the Intelligence Community shall submit a report regarding the reviews conducted under paragraph (3) of section 702(l) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(l)</external-xref>), as amended by paragraph (1) of this subsection, to—</text><subparagraph id="HF01F261C95E7490DAA099EA0A98D4398"><enum>(A)</enum><text>the Attorney General;</text></subparagraph><subparagraph id="HCA86BD4D5DB2490C9FA7CAF5E20973CB"><enum>(B)</enum><text>the Director of National Intelligence; and</text></subparagraph><subparagraph id="H83E5950493144967A85E55343BFF12CE"><enum>(C)</enum><text>consistent with the Rules of the House of Representatives, the Standing Rules of the Senate, and Senate Resolution 400 of the 94th Congress or any successor Senate resolution—</text><clause id="H970CCCB8F8FB4068ACB3C9C9E769FB1D"><enum>(i)</enum><text>the congressional intelligence committees; and</text></clause><clause id="H34F1980D00714685B81C27A87E7A918C"><enum>(ii)</enum><text>the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives.</text></clause></subparagraph></paragraph></subsection><subsection id="H80A0210B918B40C6BECC7029026D5FEC"><enum>(c)</enum><header>Annual reviews</header><text>Section 702(l)(4)(A) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881a">50 U.S.C. 1881a(l)(4)(A)</external-xref>), as redesignated by subsection (b)(1), is amended—</text><paragraph id="H58BF0C8BAAE3472AA6570D8BBD3585ED"><enum>(1)</enum><text>in the matter preceding clause (i)—</text><subparagraph id="HD47A1B922E2548A383342A75558B4666"><enum>(A)</enum><text>in the first sentence—</text><clause id="HF7B45345964E4A4B8E36F42E35DAC55F"><enum>(i)</enum><text>by striking <quote>conducting an acquisition authorized under subsection (a)</quote> and inserting <quote>subject to targeting or minimization procedures approved under this section</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8237EE70FEF74948B83D4ACD0B527173"><enum>(2)</enum><text>in clause (iii), by inserting <quote>United States persons or</quote> after <quote>later determined to be</quote>.</text></paragraph></subsection></section></title><title id="H823BB3AFF2504AC8BF57398AE92AD702"><enum>IV</enum><header>Foreign Intelligence Surveillance Court reforms</header><section id="H892B25A5319343C294766A030FF127A9"><enum>401.</enum><header>Office of the Special Advocate</header><subsection id="HDE20F6121981471CAC9D7E045FCA8595"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>) is amended by adding at the end the following new title:</text><quoted-block display-inline="no-display-inline" id="H3EFB09490BFF4CADB51C21F8E35574F7" style="OLC"><title id="H86C57FC9229F4B76B06015FA69A26BF4"><enum>IX</enum><header>Office of the Special Advocate</header><section id="H41BB7850C8C943DCBB4B9B0BBF31009F"><enum>901.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H456D326C446C4D0E891E0CE3B99E00B5"><enum>(1)</enum><header>Decision</header><text>The term <term>decision</term> means a decision, order, or opinion issued by the Foreign Intelligence Surveillance Court or the Foreign Intelligence Surveillance Court of Review.</text></paragraph><paragraph id="H1BAE7C1C014248ED82DA13BB7CF72CFF"><enum>(2)</enum><header>Foreign Intelligence Surveillance Court; Court</header><text>The terms <term>Foreign Intelligence Surveillance Court</term> and <quote>Court</quote> mean the court established under section 103(a) and the petition review pool established under section 103(e).</text></paragraph><paragraph id="H637A57B6C2BC420381F33BF573B6E31B"><enum>(3)</enum><header>Foreign Intelligence Surveillance Court of Review; Court of Review</header><text>The terms <term>Foreign Intelligence Surveillance Court of Review</term> and <quote>Court of Review</quote> mean the court of review established under section 103(b).</text></paragraph><paragraph id="H774D28A0320F4C68A57A206B64AD2660"><enum>(4)</enum><header>Office</header><text>The term <term>Office</term> means the Office of the Special Advocate established under section 902(a).</text></paragraph><paragraph id="HCE26CC7969934EF0B5BB6E81E229AD3A"><enum>(5)</enum><header>Significant construction or interpretation of law</header><text>The term <term>significant construction or interpretation of law</term> means a significant construction or interpretation of a provision, as that term is construed under section 601(c).</text></paragraph><paragraph id="H1A0D0864024C42F497593F4B1E791660"><enum>(6)</enum><header>Special Advocate</header><text>The term <quote>Special Advocate</quote> means the Special Advocate appointed under section 902(b).</text></paragraph></section><section id="H577E70C5920841CE99064F93C13E100A"><enum>902.</enum><header>Office of the Special Advocate</header><subsection id="HB34A9B939C74444AADD202D268354B54"><enum>(a)</enum><header>Establishment</header><text>There is established within the judicial branch of the United States an Office of the Special Advocate.</text></subsection><subsection id="H74181A6541EF44E3B8E628A3DF5CEBE3"><enum>(b)</enum><header>Special Advocate</header><paragraph id="H17930EEA40D244C3807869DEF951BFCD"><enum>(1)</enum><header>In general</header><text>The head of the Office is the Special Advocate.</text></paragraph><paragraph id="H686175A6C8BB46269FF084E8EF92DF69"><enum>(2)</enum><header>Appointment and term</header><subparagraph id="HAD801C67AF4B4D87B21DADF71AA227B5"><enum>(A)</enum><header>Appointment</header><text>The Chief Justice of the United States shall appoint the Special Advocate from the list of candidates submitted under subparagraph (B).</text></subparagraph><subparagraph id="HE24EE0A7171542B38F03172F74823948"><enum>(B)</enum><header>List of candidates</header><text>The Privacy and Civil Liberties Oversight Board shall submit to the Chief Justice a list of not less than 5 qualified candidates to serve as Special Advocate. The Board shall select candidates for such list whom the Board believes will be zealous and effective advocates in defense of civil liberties and consider with respect to each potential candidate—</text><clause id="HE99669FCB2E34B9BB2A0BD38AD45A34C"><enum>(i)</enum><text>the litigation and other professional experience of such candidate;</text></clause><clause id="HB14162977EAE48C780298AB92ED3AF07"><enum>(ii)</enum><text>the experience of such candidate in areas of law that the Special Advocate is likely to encounter in the course of the duties of the Special Advocate; and</text></clause><clause id="HA0C5E75B2FE74A0CA087222AF7E1941F"><enum>(iii)</enum><text>the demonstrated commitment of such candidate to civil liberties.</text></clause></subparagraph><subparagraph id="H0A53FE0941E141ADBEDA506076F6C6AB"><enum>(C)</enum><header>Security Clearance</header><text>An individual may be appointed Special Advocate without regard to whether the individual possesses a security clearance on the date of the appointment.</text></subparagraph><subparagraph id="H331796EB421948DBA1B05A9C785C30C3"><enum>(D)</enum><header>Term and dismissal</header><text>A Special Advocate shall be appointed for a term of 3 years and may be removed only for good cause shown, including the demonstrated inability to qualify for an adequate security clearance.</text></subparagraph><subparagraph id="HC9DD4EC820184AC4B904BCC0320717C7"><enum>(E)</enum><header>Reappointment</header><text>There shall be no limit to the number of consecutive terms served by a Special Advocate. The reappointment of a Special Advocate shall be made in the same manner as appointment of a Special Advocate.</text></subparagraph><subparagraph id="HCCDE65B6AB9B47AB86CF5E2F1DE6BE93"><enum>(F)</enum><header>Acting Special Advocate</header><text>If the position of Special Advocate is vacant, the Chief Justice of the United States may appoint an Acting Special Advocate from among the qualified employees of the Office. If there are no such qualified employees, the Chief Justice may appoint an Acting Special Advocate from the most recent list of candidates provided by the Privacy and Civil Liberties Oversight Board pursuant to subparagraph (B). The Acting Special Advocate shall have all of the powers of a Special Advocate and shall serve until a Special Advocate is appointed.</text></subparagraph></paragraph><paragraph id="H7B1270CA5E484F21A861C2E05FA3BF78"><enum>(3)</enum><header>Employees</header><text>The Special Advocate may appoint and terminate and fix the compensation of employees of the Office without regard to the provisions of title 5, United States Code, governing appointments in the competitive service.</text></paragraph></subsection><subsection id="HF0F024836D3A46C0BF4AAFD5667B9079"><enum>(c)</enum><header>Duties and authorities of the Special Advocate</header><paragraph id="H69195FD5AA2A42DC88AC7B97C88DEC28"><enum>(1)</enum><header>In general</header><text>The Special Advocate—</text><subparagraph id="HCC8D3CCDACD94791A1412134AECCCA53"><enum>(A)</enum><text>may consider any request for consultation by a party who has been served with an order or directive issued under this Act requiring the party to provide information, facilities, or assistance to the Federal Government;</text></subparagraph><subparagraph id="HECBA7CA7ED364B3587C289E63CCE4367"><enum>(B)</enum><text>may request to participate in a proceeding before the Foreign Intelligence Surveillance Court;</text></subparagraph><subparagraph id="HEBB5CE2C1E7844C8A258C975978A6C15"><enum>(C)</enum><text>shall participate in such proceeding if such request is granted;</text></subparagraph><subparagraph id="H931B314793C342D1977E14D985239CF5"><enum>(D)</enum><text>shall participate in a proceeding before the Court if appointed to participate by the Court under section 903(a);</text></subparagraph><subparagraph id="H7AAE75FB08884E85A29B3D15CD086ED3"><enum>(E)</enum><text>may request reconsideration of a decision of the Court under section 903(b);</text></subparagraph><subparagraph id="HE24C45C8F16A4298B9A4134775A42B12"><enum>(F)</enum><text>may appeal or seek review of a decision of the Court or the Foreign Intelligence Surveillance Court of Review under section 904; and</text></subparagraph><subparagraph id="H39A03B3F91A04518ADAB94C66E2995DD"><enum>(G)</enum><text>shall participate in such appeal or review.</text></subparagraph></paragraph><paragraph commented="no" id="H3F014804B40B413089923006BCC8E6F6"><enum>(2)</enum><header>Access to applications and decisions</header><subparagraph commented="no" id="HF5B5C30F1423486D86580669AD31AD81"><enum>(A)</enum><header>Applications</header><text display-inline="yes-display-inline">The Attorney General shall provide to the Special Advocate each application submitted to a judge of the Foreign Intelligence Surveillance Court under this Act at the same time as the Attorney General submits such applications.</text></subparagraph><subparagraph commented="no" id="H13D7315C8BB842BC9BA54A9620BF4008"><enum>(B)</enum><header>Decisions</header><text>The Foreign Intelligence Surveillance Court and the Foreign Intelligence Surveillance Court of Review shall provide to the Special Advocate access to each decision of the Court and the Court of Review, respectively, issued after the date of the enactment of the USA FREEDOM Act and all documents and other material relevant to such decision in complete, unredacted form.</text></subparagraph></paragraph><paragraph id="H4A73024DE0874DB3B0F405CA5F579F7C"><enum>(3)</enum><header>Advocacy</header><text>The Special Advocate shall vigorously advocate before the Foreign Intelligence Surveillance Court or the Foreign Intelligence Surveillance Court of Review, as appropriate, in support of legal interpretations that protect individual privacy and civil liberties.</text></paragraph><paragraph id="HDF6C58EC5D05499483B8A1C6E52BC238"><enum>(4)</enum><header>Outside counsel</header><text>The Special Advocate may delegate to a competent outside counsel who has or is able to obtain an appropriate security clearance any duty or responsibility of the Special Advocate set out in subparagraph (E) or (F) of paragraph (1) with respect to participation in a matter before the Court, the Court of Review, or the Supreme Court of the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6E49297A7D2F4550B1A47043DD56623E"><enum>(5)</enum><header>Availability of documents and material</header><text>The Court or the Court of Review, as appropriate, shall order any agency, department, or entity to make available to the Special Advocate, or appropriate outside counsel if the Special Advocate has delegated duties or responsibilities to the outside counsel under paragraph (4), any documents or other material necessary to carry out the duties described in paragraph (1).</text></paragraph></subsection><subsection id="H51812200F42E4CD7B7D3EA2073676152"><enum>(d)</enum><header>Security clearances</header><text>The appropriate departments, agencies, and elements of the Executive branch shall cooperate with the Office, to the extent possible under existing procedures and requirements, to expeditiously provide the Special Advocate, appropriate employees of the Office, and outside counsel to whom the Special Advocate delegates a duty or responsibility under subsection (c)(4) with the security clearances necessary to carry out the duties of the Special Advocate.</text></subsection></section><section id="H6B7B0D6DBBF34EE79593B469D4F49D13"><enum>903.</enum><header>Advocacy before the Foreign Intelligence Surveillance Court</header><subsection id="H6E09DF4C4B7644FCAE178A8A5AD04BB4"><enum>(a)</enum><header>Appointment To participate</header><paragraph id="HE50F55E3AD4345A88326766627D5D36B"><enum>(1)</enum><header>In general</header><text>The Foreign Intelligence Surveillance Court may appoint the Special Advocate to participate in a proceeding before the Court.</text></paragraph><paragraph id="HD19B4D80C7E94B71AF4541F0173EFB20"><enum>(2)</enum><header>Standing</header><text>If the Special Advocate is appointed to participate in a Court proceeding pursuant to paragraph (1), the Special Advocate shall have standing as a party before the Court in that proceeding.</text></paragraph></subsection><subsection id="HE06C179C60FD454B9175780A941AD427"><enum>(b)</enum><header>Reconsideration of a Foreign Intelligence Surveillance Court decision</header><paragraph id="H5F1B76573126444088FAF5F25981A2C9"><enum>(1)</enum><header>Authority to move for reconsideration</header><text>The Special Advocate may move the Court to reconsider any decision of the Court made after the date of the enactment of the USA FREEDOM Act by petitioning the Court not later than 30 days after the date on which all documents and materials relevant to the decision are made available to the Special Advocate.</text></paragraph><paragraph id="HF64A4A9788894204A047B0163F2A7B4D"><enum>(2)</enum><header>Discretion of the Court</header><text>The Court shall have discretion to grant or deny a motion for reconsideration made pursuant to paragraph (1).</text></paragraph></subsection><subsection id="H906E196FAE2846BEBAB4F411A136B498"><enum>(c)</enum><header>Amici curiae participation</header><paragraph id="H176B8811B36D4277880591D9A490D37D"><enum>(1)</enum><header>Motion by the Special Advocate</header><text>The Special Advocate may file a motion with the Court to permit and facilitate participation of amici curiae, including participation in oral argument if appropriate, in any proceeding. The Court shall have the discretion to grant or deny such a motion.</text></paragraph><paragraph id="H30B6B272D6B343A99690368FB0802E18"><enum>(2)</enum><header>Facilitation by the Foreign Intelligence Surveillance Court</header><text>The Court may, sua sponte, permit and facilitate participation by amici curiae, including participation in oral argument if appropriate, in proceedings before the Court.</text></paragraph><paragraph commented="no" id="H2D3F1042B8E34E73AB3DCAA10B81EA24"><enum>(3)</enum><header>Regulations</header><text>Not later than 180 days after the date of the enactment of USA FREEDOM Act, the Court shall promulgate regulations to provide the public with information sufficient to allow interested parties to participate as amici curiae.</text></paragraph></subsection></section><section id="H7E68385F29C14DF9956F1FDF90D7FCB0"><enum>904.</enum><header>Appellate review</header><subsection id="H6558ACAB43254DB3ABAFBD2B02A6B770"><enum>(a)</enum><header>Appeal of Foreign Intelligence Surveillance Court decisions</header><paragraph id="HF79BA7036E1244CE9E24B44A7795C263"><enum>(1)</enum><header>Authority to appeal</header><text>The Special Advocate may appeal any decision of the Foreign Intelligence Surveillance Court issued after the date of the enactment of the USA FREEDOM Act not later than 90 days after the date on which the decision is issued.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB8D33D3F71944C2F8325FA17133DFCA8"><enum>(2)</enum><header>Standing as appellant</header><text>If the Special Advocate appeals a decision of the Court pursuant to paragraph (1), the Special Advocate shall have standing as a party before the Foreign Intelligence Surveillance Court of Review in such appeal.</text></paragraph><paragraph id="HEC2347393ABB44FC94968598C026FC2C"><enum>(3)</enum><header>Mandatory review</header><text display-inline="yes-display-inline">The Court of Review shall review any Foreign Intelligence Surveillance Court decision appealed by the Special Advocate and issue a decision in such appeal, unless it would be apparent to all reasonable jurists that such decision is dictated by statute or by precedent.</text></paragraph><paragraph id="H7FA737B29A0843EFA0C237716A3C122A"><enum>(4)</enum><header>Standard of review</header><text>The standard for a mandatory review of a Foreign Intelligence Surveillance Court decision pursuant to paragraph (3) shall be—</text><subparagraph id="H53E84F00A064488FB5C0440CAEDDDB4F"><enum>(A)</enum><text>de novo with respect to issues of law; and</text></subparagraph><subparagraph id="H4146AC23015C4664A30B0B0A9D6FE6B4"><enum>(B)</enum><text>clearly erroneous with respect to determination of facts.</text></subparagraph></paragraph><paragraph id="H912483D41EA445B6B8D457FB5514DCED"><enum>(5)</enum><header>Amici curiae participation</header><subparagraph id="HE91AEB9C040245F29734F04A8B3397D4"><enum>(A)</enum><header>In general</header><text>The Court of Review shall accept amici curiae briefs from interested parties in all mandatory reviews pursuant to paragraph (3) and shall provide for amici curiae participation in oral argument if appropriate.</text></subparagraph><subparagraph id="H0FC35B13C216489AA45BD7D099A8C4F1"><enum>(B)</enum><header>Regulations</header><text>Not later than 180 days after the date of the enactment of the USA FREEDOM Act, the Court of Review shall promulgate regulations to provide the public with information sufficient to allow interested parties to participate as amici curiae.</text></subparagraph></paragraph></subsection><subsection id="H0B020C82A0D6445EB24A91FD02787745"><enum>(b)</enum><header>Review of Foreign Intelligence Surveillance Court of Review decisions</header><paragraph id="H639721C227CB437592557609261F8774"><enum>(1)</enum><header>Authority</header><text>The Special Advocate may seek a writ of certiorari from the Supreme Court of the United States for review of any decision of the Foreign Intelligence Surveillance Court of Review.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEF6E6A39184044FA9B1AE8E1EECAE684"><enum>(2)</enum><header>Standing</header><text>In any proceedings before the Supreme Court of the United States relating to a petition of certiorari filed under paragraph (1) and any proceedings in a matter for which certiorari is granted, the Special Advocate shall have standing as a party.</text></paragraph></subsection></section><section id="H1F1C14BEC4DE42308A667AAA4468AD84"><enum>905.</enum><header>Disclosure</header><subsection id="H954AFD21A54C4C35842E49A61D00DF6B"><enum>(a)</enum><header>Requirement To disclose</header><text>The Attorney General shall publicly disclose—</text><paragraph id="H1C3410EC72334948A7AC89A94A221FC6"><enum>(1)</enum><text display-inline="yes-display-inline">all decisions issued by the Foreign Intelligence Surveillance Court or the Foreign Intelligence Surveillance Court of Review after July 10, 2003, that include a significant construction or interpretation of law;</text></paragraph><paragraph id="H6394ECABC6BA4E1F8983F4359F6F3625"><enum>(2)</enum><text>any decision of the Court appealed by the Special Advocate pursuant to this title; and</text></paragraph><paragraph id="HCC410E0A041649E4AB336F10C27F0DA5"><enum>(3)</enum><text>any Court of Review decision that is issued after an appeal by the Special Advocate.</text></paragraph></subsection><subsection id="H26EDF7A1F4A14AC59A8B7EC2A297E3D8"><enum>(b)</enum><header>Disclosure described</header><text>For each disclosure required by subsection (a) with respect to a decision, the Attorney General shall make available to the public documents sufficient—</text><paragraph id="HF200213C628D48D8B481E74C581D586B"><enum>(1)</enum><text>to identify with particularity each legal question addressed by the decision and how such question was resolved;</text></paragraph><paragraph id="HD8ED2103409C4CBA8E6C3840DD03B211"><enum>(2)</enum><text>to describe in general terms the context in which the matter arises;</text></paragraph><paragraph id="H4BD3DF75A2CA4BA896AF8AAE745C25B2"><enum>(3)</enum><text>to describe the construction or interpretation of any statute, constitutional provision, or other legal authority relied on by the decision; and</text></paragraph><paragraph id="HDC56A797E33C4C86ACBC4F8D6F292268"><enum>(4)</enum><text>to indicate whether the decision departed from any prior decision of the Court or Court of Review.</text></paragraph></subsection><subsection id="HC7A08664D95F41FFA50396094C67AF3A"><enum>(c)</enum><header>Documents described</header><text>The Attorney General shall satisfy the disclosure requirements in subsection (b) by—</text><paragraph id="H2E9A189C3D324133A246D5DB7810D29C"><enum>(1)</enum><text>releasing a Court or Court of Review decision in its entirety or as redacted;</text></paragraph><paragraph id="H4124A6D655994E72AC398B4243CF0CB2"><enum>(2)</enum><text>releasing a summary of a Court or Court of Review decision; or</text></paragraph><paragraph id="H1DDF9F8977494979BEE9ACA62ADFFDA7"><enum>(3)</enum><text>releasing an application made to the Court, briefs filed before the Court or the Court of Review, or other materials, in full or as redacted.</text></paragraph></subsection><subsection id="HA7E194C701324E48B5F9D44D0F2D37D3"><enum>(d)</enum><header>Extensive disclosure</header><text>The Attorney General shall release as much information regarding the facts and analysis contained in a decision described in subsection (a) or documents described in subsection (c) as is consistent with legitimate national security concerns.</text></subsection><subsection id="HDE21BE327DB5464E8814393D43628925"><enum>(e)</enum><header>Timing of disclosure</header><paragraph id="H11BA0F81910145B589DEC4C75906A9CF"><enum>(1)</enum><header>Decisions issued prior to enactment</header><text>The Attorney General shall disclose a decision issued prior to the date of the enactment of the USA FREEDOM Act that is required to be disclosed under subsection (a)(1) not later than 180 days after the date of the enactment of such Act.</text></paragraph><paragraph id="HF00080D753D94A8492FACC778B3E1B9B"><enum>(2)</enum><header>FISA Court decisions</header><text>The Attorney General shall release Court decisions appealed by the Special Advocate not later than 30 days after the date on which the appeal is filed.</text></paragraph><paragraph id="H4519053703D24D5C8D0983DA80E87583"><enum>(3)</enum><header>FISA Court of Review decisions</header><text>The Attorney General shall release Court of Review decisions for which the Special Advocate seeks a writ of certiorari not later than 90 days after the date on which the petition is filed.</text></paragraph></subsection><subsection id="H5025A5491EE342A3B3DBA18A155D1C47"><enum>(f)</enum><header>Petition by the Special Advocate</header><paragraph id="H037CD1CD18DB48CAAE8F48F570340333"><enum>(1)</enum><header>Authority to petition</header><text>The Special Advocate may petition the Court or the Court of Review to order—</text><subparagraph id="H7C62F83A0E3147E882021A17019535B3"><enum>(A)</enum><text>the public disclosure of a decision of the Court or Court of Review, and documents or other material relevant to such a decision, previously designated as classified information; or</text></subparagraph><subparagraph id="H1EA5C10468CE4AFC9D91E002DA748582"><enum>(B)</enum><text>the release of an unclassified summary of such decisions and documents.</text></subparagraph></paragraph><paragraph id="HA6052EB2FD0B421E8558E84421D3A665"><enum>(2)</enum><header>Contents of petition</header><text>Each petition filed under paragraph (1) shall contain a detailed declassification proposal or a summary of the decision and documents that the Special Advocate proposes to have released publicly.</text></paragraph><paragraph id="H98B1E70D51594C849AC7C64E18049AB3"><enum>(3)</enum><header>Role of the Attorney General</header><subparagraph id="H961FFDA82C2443E6B7B8FA5C7181792C"><enum>(A)</enum><header>Copy of petition</header><text>The Special Advocate shall provide to the Attorney General a copy of each petition filed under paragraph (1).</text></subparagraph><subparagraph id="H400CA285ACFE4E3593CEA6D11A933584"><enum>(B)</enum><header>Opposition</header><text>The Attorney General may oppose a petition filed under paragraph (1) by submitting any objections in writing to the Court or the Court of Review, as appropriate, not later than 90 days after the date such petition was submitted.</text></subparagraph></paragraph><paragraph id="HBD697C588C074B6C9F39D5BAD7B74B3C"><enum>(4)</enum><header>Public availability</header><text>Not less than 91 days after receiving a petition under paragraph (1), and taking into account any objections from the Attorney General made under paragraph (3)(B), the Court or the Court of Review, as appropriate, shall declassify and make readily available to the public any decision, document, or other material requested in such petition, to the greatest extent possible, consistent with legitimate national security considerations.</text></paragraph><paragraph id="H7E5F76BC544D4D0D80A9ED0097A6063F"><enum>(5)</enum><header>Effective date</header><text>The Special Advocate may not file a petition under paragraph (1) until 181 days after the date of the enactment of the USA FREEDOM Act, except with respect to a decision appealed by the Special Advocate.</text></paragraph></subsection></section><section id="H9B41BC8F8B6C41EA855B25712F972925"><enum>906.</enum><header>Annual report to Congress</header><subsection id="H85AB5A54A2244593B44BB749F22C7137"><enum>(a)</enum><header>Requirement for annual report</header><text>The Special Advocate shall submit to Congress an annual report on the implementation of this title.</text></subsection><subsection id="HF8AB147734E94BBFA2D47D7C5F5E4A39"><enum>(b)</enum><header>Contents</header><text>Each annual report submitted under subsection (a) shall—</text><paragraph id="HB9C3EB39BBC74081BC06748B1BBD1B17"><enum>(1)</enum><text>detail the activities of the Office of the Special Advocate;</text></paragraph><paragraph id="H0C079D7765E446BDAB6AD85438FB5762"><enum>(2)</enum><text>provide an assessment of the effectiveness of this title; Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803</external-xref>) is amended—</text><paragraph id="HA3FCC002089D42F087EA13FEEDC6CBA2"><enum>(1)</enum><text>by redesignating subsections (g) and (h) as subsections (h) and (i), respectively; and</text></paragraph><paragraph id="H9393C021008F4336B9978A3A9F00D086"><enum>(2)</enum><text>by inserting after subsection (f) the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HEB1E578DD994462C85600AEABF7BF1DA" style="traditional"><subsection id="H4AEBD18797964CD1BA946531F5A1E55F"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HE30CB07F59334FC5B448BC95980E782C"><enum>(1)</enum><text>A judge of the court established under subsection (a) who authored an order, opinion, or other decision may sua sponte or on motion by a party request that such order, opinion, or other decision be made publicly available.</text></paragraph><paragraph id="HE0442B9382194417B1276C153CEAA74A" indent="up1"><enum>(2)</enum><text>Upon a request under paragraph (1), the presiding judge of the court established under subsection (a), in consultation with the other judges of such court, may direct that such order, opinion, or other decision be made publicly available.</text></paragraph><paragraph id="H35C41369D5DD4A3D9EA8CF729EBCD665" indent="up1"><enum>(3)</enum><text>Prior to making an order, opinion, or other decision of the court established under subsection (a) publicly available in accordance with this subsection, the presiding judge of such court may direct the Executive branch to review such order, opinion, or other decision and redact such order, opinion, or other decision as necessary to ensure that properly classified information is appropriately protected.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HFEEFD3AF404E49628300C4E31FDCE7F8"><enum>403.</enum><header>Preservation of rights</header><text display-inline="no-display-inline">Nothing in this title or an amendment made by this title shall declassifying decisions or releasing information pursuant to this title or an amendment made by this title; and</text></paragraph><paragraph id="H004E16307490455F9E766FC471FB2D13"><enum>(2)</enum><text>to eliminate the public’s ability to secure information under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>) or any other provision of law.</text></paragraph></section></title><title id="H102EFB9C6B5641088B76F4EDD825A414"><enum>V</enum><header>National security letter reforms</header><section commented="no" display-inline="no-display-inline" id="H1BED04015AEE45AA825DE098015EFD63" section-type="subsequent-section"><enum>501.</enum><header display-inline="yes-display-inline">National security letter authority</header><subsection commented="no" display-inline="no-display-inline" id="H1D7690ABA1EE4AB08602E51B889CF6E3"><enum>(a)</enum><header display-inline="yes-display-inline">Counterintelligence access to telephone toll and transactional records</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2709">Section 2709</external-xref> of title 18, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id81DF30E27B644F608C84C7E8A4FAADFE"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph commented="no" id="H0AE6B0F741984A6481F8E12320AFDC01"><enum>(A)</enum><text>by striking <quote>may—</quote> and all that follows through the period at the end and inserting the following: <quote>may request the name, address, length of service, and local and long distance toll billing records of a person or entity if the Director (or his designee) certifies in writing to the wire or electronic communication service provider to which the request is made that—</quote>; and</text></subparagraph><subparagraph commented="no" id="HFCA97567F3A24BCEAA653720A17E58EC"><enum>(B)</enum><text>by adding at the end the following new paragraphs:</text><quoted-block display-inline="no-display-inline" id="H7DAC40F6C5A5447E8D4A5E07A7DFC632" style="OLC"><paragraph commented="no" id="HFC83E93225A54CD194C2BC392169FCD8"><enum>(1)</enum><text display-inline="yes-display-inline">the name, address, length of service, and toll billing records sought are relevant and material to an authorized investigation to protect against international terrorism or clandestine intelligence activities, provided that such an investigation of a United States person is not conducted solely on the basis of activities protected by the First Amendment to the Constitution of the United States; and</text></paragraph><paragraph commented="no" id="HF2D854B5A4CF476DAD03B7479D97483A"><enum>(2)</enum><text>there are reasonable grounds to believe that the name, address, length of service, and toll billing records sought pertain to—</text><subparagraph commented="no" id="HBEA11016A9204ADE945E17B8CF3606DC"><enum>(A)</enum><text>a foreign power or agent of a foreign power;</text></subparagraph><subparagraph commented="no" id="H367967257EAF44ADBC0C036114F6F4D0"><enum>(B)</enum><text>the activities of a suspected agent of a foreign power who is the subject of such authorized investigation; or</text></subparagraph><subparagraph commented="no" id="HCE85A11A59C64CC9843F797DCAA2D9F9"><enum>(C)</enum><text>an individual in contact with, or known to, a suspected agent of a foreign power.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="id0F0083E582674B8A8999A6D9CA058121"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" 1801</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB9266F14D39E445D8E9AF45CADBFBF7C"><enum>(b)</enum><header display-inline="yes-display-inline">Access to financial records for certain intelligence and protective purposes</header><text display-inline="yes-display-inline">Section 1114 of the Right to Financial Privacy Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/3414">12 U.S.C. 3414</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H01B2E3467F3A41148E82F457B5F4B4E4" style="OLC"><section commented="no" display-inline="no-display-inline" id="HBE2DCF18167E48A6B7A3B679C32D8EA7" section-type="subsequent-section"><enum>1114.</enum><header display-inline="yes-display-inline">Access to financial records for certain intelligence and protective purposes</header><subsection commented="no" display-inline="no-display-inline" id="H9DA7A8D38EA1446DA382999A52D4092E"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization</header><paragraph commented="no" display-inline="no-display-inline" id="H274095254D1843E2924D099717045119"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director of the Federal Bureau of Investigation, or a designee of the Director whose rank shall be no lower than Deputy Assistant Director at Bureau headquarters or Special Agent in Charge in a Bureau field office, may issue in writing and cause to be served on a financial institution, a request requiring the production of—</text><subparagraph commented="no" display-inline="no-display-inline" id="H415092D8AE104524BB8ECEB26C0D3CB7"><enum>(A)</enum><text display-inline="yes-display-inline">the name of a customer of the financial institution;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEAE9BAC743A2488F8E3FC178B3B147D7"><enum>(B)</enum><text display-inline="yes-display-inline">the address of a customer of the financial institution;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H81BD6D6E9A72406EAAB1FEA1EFEC382E"><enum>(C)</enum><text display-inline="yes-display-inline">the length of time during which a person has been, or was, a customer of the financial institution (including the start date) and the type of service provided by the financial institution to the customer; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H96859C118DF14FAF803EE5469B70A55D"><enum>(D)</enum><text display-inline="yes-display-inline">any account number or other unique identifier associated with a customer of the financial institution.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6727272023F74B37815B28A69A4849F3"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">A request issued under this subsection may not require the production of records or information not listed in paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H85EE53FE74D04925B5CE85303CA26C73"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><paragraph commented="no" display-inline="no-display-inline" id="HB864B208E03C4BC59E4B58923D0667B5"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A request issued under subsection (a) shall—</text><subparagraph id="HCA5512C36A934A35A79F4C2E50BF9CAE"><enum>(A)</enum><text>be subject to the requirements of subsections (d) through (g) of <external-xref legal-doc="usc" parsable-cite="usc/18/2709">section 2709</external-xref> of title 18, United States Code, in the same manner and to the same extent as those provisions apply with respect to a request under <external-xref legal-doc="usc" parsable-cite="usc/18/2709">section 2709(b)</external-xref> of title 18, United States Code, to a wire or electronic communication service provider; and</text></subparagraph><subparagraph id="HC45869BEC9F040988E597A19C3B9D7E4"><enum>(B)</enum><text>include a statement of facts showing that there are reasonable grounds to believe that the records or other things sought—</text><clause id="HF1623532C4C44C9BAD9017B0C12AF96E"><enum>(i)</enum><text display-inline="yes-display-inline">are relevant and material to an authorized investigation (other than a threat assessment and provided that such an investigation of a United States person is not conducted solely on the basis of activities protected by the First Amendment to the Constitution of the United States) to—</text><subclause id="id91854A57938D42E6B299851349BD3F74"><enum>(I)</enum><text display-inline="yes-display-inline">obtain foreign intelligence information not concerning a United States person; or</text></subclause><subclause id="id15A7B927DCC74FF890BD38E5A16C2566"><enum>(II)</enum><text display-inline="yes-display-inline">protect against international terrorism or clandestine intelligence activities; and</text></subclause></clause><clause id="H566E02431A6B4E1AB60F26A8CAE5BCB4"><enum>(ii)</enum><text display-inline="yes-display-inline">pertain to—</text><subclause commented="no" display-inline="no-display-inline" id="H50044389844044718323C1CD9C377D68"><enum>(I)</enum><text>a foreign power or an agent of a foreign power;</text></subclause><subclause display-inline="no-display-inline" id="H8B879E6FC88C4556A0B7ACEBCB96B68A"><enum>(II)</enum><text>the activities of a suspected agent of a foreign power who is the subject of such authorized investigation; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H3C178E200BBF4D6ABCFDB46056C0782A"><enum>(III)</enum><text>an individual in contact with, or known to, a suspected agent of a foreign power.</text></subclause></clause></subparagraph></paragraph><paragraph id="HD3E1B717BA83495092A639DDA4E9D78C"><enum>(2)</enum><header>Definitions</header><text>For purposes of this subsection, the terms <quote>agent of a foreign power</quote>, <quote>foreign intelligence information</quote>, <quote>foreign power</quote>, <quote>international terrorism</quote>, and <quote>United States person</quote> have the same meanings as in section 101 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801</external-xref>).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA0DB09A81D5F4656A1AB9F06FF14FC89"><enum>(c)</enum><header display-inline="yes-display-inline">Definition of financial institution</header><text display-inline="yes-display-inline">For purposes of this section (and sections 1115 and 1117, insofar as the sections relate to the operation of this section), the term <quote>financial institution</quote> has the same meaning as in subsections (a)(2) and (c)(1) of <external-xref legal-doc="usc" parsable-cite="usc/31/5312">section 5312</external-xref> of title 31, United States Code, except that the term shall include only a financial institution any part of which is located inside any State or territory of the United States, the District of Columbia, Puerto Rico, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, or the United States Virgin Islands.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H7893A0DF17784E10B829C5918AE417B1"><enum>(c)</enum><header display-inline="yes-display-inline">National security letter authority for certain consumer report records</header><paragraph commented="no" display-inline="no-display-inline" id="H0B20EED3ADE2418398758823F3D40F5F"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 626 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681u">15 U.S.C. 1681u</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="HBB29E00D0AF549BBACD59A4054D79CC0"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subsections (a) through (c) and inserting the following new subsections:</text><quoted-block display-inline="no-display-inline" id="H86B162C619CC406FB85F2330EECD7E25" style="OLC"><subsection commented="no" current and former places of employment of a consumer; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBC437193FB9C45A3B04E318CF986D51A"><enum>(D)</enum><text display-inline="yes-display-inline">the name and address of any financial institution (as that term is defined in section 1101 of the Right to Financial Privacy Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/3401">12 U.S.C. 3401</external-xref>)) at which a consumer maintains or has maintained an account, to the extent that the information is in the files of the consumer reporting agency.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H701B6131FD744C0F9D3CA6743499BCAB"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">A request issued under this subsection may not require the production of a consumer report.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC1627E939B5B4A8E99D99B7A24058739"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><paragraph commented="no" display-inline="no-display-inline" id="HFAAAAD0C52B94CC9A149B230F5F57E0E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A request issued under subsection (a) shall—</text><subparagraph id="HB74A529BCD3A42B9AF47B1D7F407EDE8"><enum>(A)</enum><text display-inline="yes-display-inline">be subject to the requirements of subsections (d) through (g) of <external-xref legal-doc="usc" parsable-cite="usc/18/2709">section 2709</external-xref> of title 18, United States Code, in the same manner and to the same extent as those provisions apply with respect to a request under <external-xref legal-doc="usc" parsable-cite="usc/18/2709">section 2709(b)</external-xref> of title 18, United States Code, to a wire or electronic communication service provider; and</text></subparagraph><subparagraph id="H7E52ED1FA96C4A2FA47363F1D319F0A0"><enum>(B)</enum><text>include a statement of facts showing that there are reasonable grounds to believe that the records or other things sought—</text><clause id="HF2C884B40AAC40F4A817D94337983311"><enum>(i)</enum><text display-inline="yes-display-inline">are relevant and material to an authorized investigation (other than a threat assessment and provided that such an investigation of a United States person is not conducted solely on the basis of activities protected by the First Amendment to the Constitution of the United States) to—</text><subclause id="idADF66E8EBDD545028F7674FA4BCE7359"><enum>(I)</enum><text display-inline="yes-display-inline">obtain foreign intelligence information not concerning a United States person; or</text></subclause><subclause id="idC9C64247CBE44CECA5092AB3EFDD1C60"><enum>(II)</enum><text display-inline="yes-display-inline">protect against international terrorism or clandestine intelligence activities; and</text></subclause></clause><clause id="HBAAB0F21BFC341E59F4D4390115D7464"><enum>(ii)</enum><text display-inline="yes-display-inline">pertain to—</text><subclause commented="no" display-inline="no-display-inline" id="H652C1B98CE7144889C69A8EB3BE15C4F"><enum>(I)</enum><text>a foreign power or an agent of a foreign power;</text></subclause><subclause display-inline="no-display-inline" id="H7588B5E34B374055AB8F0DF08DFCC4BE"><enum>(II)</enum><text>the activities of a suspected agent of a foreign power who is the subject of such authorized investigation; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H463D08D89AC3422586DA95D4220D8C4C"><enum>(III)</enum><text>an individual in contact with, or known to, a suspected agent of a foreign power.</text></subclause></clause></subparagraph></paragraph><paragraph id="H39B5574789614CD9BC91A941DAEA6949"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection, the terms <quote>agent of a foreign power</quote>, <quote>foreign intelligence information</quote>, <quote>foreign power</quote>, <quote>international terrorism</quote>, and <quote>United States person</quote> have the meaning given such terms in section 101 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801</external-xref>).</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3C149BFA51F64D89AE29ED3FACA7C8AF"><enum>(B)</enum><text display-inline="yes-display-inline">by striking subsections (f) through (h); and</text></subparagraph><subparagraph commented="no" id="HE1F5F395C2ED4084875F8CA6FC29C529"><enum>(a)</enum><header>Counterintelligence access to telephone toll and transactional records</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2709">Section 2709</external-xref> of title 18, United States Code, is amended by striking subsection (c) and inserting the following new subsection:</text><quoted-block id="HCD051505E63F4444BD6B2C3F01E68430" style="OLC"><subsection id="H034C426F7FAB4FFB8A62778CC3BAB9A6"><enum>(c)</enum><header>Prohibition of certain disclosure</header><paragraph id="HD81C6AA62ACF4C74AA898F2C5CDF7320"><enum>(1)</enum><header>Prohibition</header><subparagraph id="HE528E3572A1E4FEAAD762485694F8E1F"><enum>(A)</enum><header>In general</header><text>If a certification is issued under subparagraph (B) and notice of the right to judicial review under subsection (d) is provided, no wire or electronic communication service provider, or officer, employee, or agent thereof, that receives a request under subsection (b), shall disclose to any person that the Director of the Federal Bureau of Investigation has sought or obtained access to information or records under this section.</text></subparagraph><subparagraph id="H9E46B2B6662B41CCB4DA2BC65BAFFD88"><enum>(B)</enum><header>Certification</header><text>The requirements of subparagraph (A) shall apply if the Director of the Federal Bureau of Investigation, or a designee of the Director whose rank shall be no lower than Deputy Assistant Director at Bureau headquarters or a Special Agent in Charge of a Bureau field office, certifies that the absence of a prohibition of disclosure under this subsection may result in—</text><clause id="HD34D4DCC5D524001B4835B022E240706"><enum>(i)</enum><text>endangering the life or physical safety of any person;</text></clause><clause id="H2EF28378510F43448B5AC9AF7ACFFC47"><enum>(ii)</enum><text>flight from investigation or prosecution;</text></clause><clause id="H5CC1FD8AE45746E294D3638314531956"><enum>(iii)</enum><text>destruction of or tampering with evidence;</text></clause><clause id="HD625ABEE9139403D9F502F11956750BE"><enum>(iv)</enum><text>intimidation of potential witnesses;</text></clause><clause id="HA8FCCB4F302C4321A67E72E3BEF40CDA"><enum>(v)</enum><text>interference with diplomatic relations;</text></clause><clause id="H3A9F7DFCCD6D489288148215C3FF1ED6"><enum>(vi)</enum><text>alerting a target, an associate of a target, or the foreign power of which the target is an agent, of the interest of the Government in the target; or</text></clause><clause id="H0E56EC0FF9DA4049AD2D41E4565E656C"><enum>(vii)</enum><text display-inline="yes-display-inline">otherwise seriously endangering the national security of the United States.</text></clause></subparagraph></paragraph><paragraph id="HDC4297F4CC76408DBFB6704DB26AA9C2"><enum>(2)</enum><header>Exception</header><subparagraph id="H4A96CF82D06745669015F3B019FAD06C"><enum>(A)</enum><header>In general</header><text>A wire or electronic communication service provider, or officer, employee, or agent thereof, that receives a request under subsection (b) may disclose information otherwise subject to any applicable nondisclosure requirement to—</text><clause id="HE67EEADC85694283A400F3A21F396F41"><enum>(i)</enum><text>those persons to whom disclosure is necessary in order to comply with the request;</text></clause><clause id="H5E09E3EB355A416B9B3046131890A0B6"><enum>(ii)</enum><text>an attorney in order to obtain legal advice or assistance regarding the request; or</text></clause><clause id="H4C9F6E7C624D44569DB9C9BB31852C22"><enum>(iii)</enum><text>other persons as permitted by the Director of the Federal Bureau of Investigation or the designee of the Director.</text></clause></subparagraph><subparagraph id="HC4E2937AD78144A2B778B8A8C4F51B46"><enum>(B)</enum><header>Application</header><text>A person to whom disclosure is made under subparagraph (A) shall be subject to the nondisclosure requirements applicable to a person to whom a request is issued under subsection (b) in the same manner as the person to whom the request is issued.</text></subparagraph><subparagraph id="HFC810242F48741F3B0EEC85225AEDDE8"><enum>(C)</enum><header>Notice</header><text>Any recipient that discloses to a person described in subparagraph (A) information otherwise subject to a nondisclosure requirement shall notify the person of the applicable nondisclosure requirement.</text></subparagraph><subparagraph display-inline="no-display-inline" id="H3410859FC7814409B12BAB0C089EB699"><enum>(D)</enum><header>Identification of disclosure recipients</header><text display-inline="yes-display-inline">At the request of the Director of the Federal Bureau of Investigation or the designee of the Director, any person making or intending to make a disclosure under clause (i) or (iii) of subparagraph (A) shall identify to the Director or such designee the person to whom such disclosure will be made or to whom such disclosure was made prior to the request.</text></subparagraph></paragraph><paragraph id="H8419E9D2145C44C9BE91288AE365C715"><enum>(3)</enum><header>Termination</header><text>In the case of any request for which a recipient has submitted a notification or filed a petition for judicial review under paragraph (3)(B), if the facts supporting a nondisclosure requirement cease to exist, an appropriate official of the Federal Bureau of Investigation shall promptly notify the wire or electronic service provider, or officer, employee, or agent thereof, subject to the nondisclosure requirement that the nondisclosure requirement is no longer in effect.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="HA1E7CBA131444440BDA7DCC9321617CE"><enum>(b)</enum><header>Access to financial records for certain intelligence and protective purposes</header><text>Section 1114 of the Right to Financial Privacy Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/3414">12 U.S.C. 3414</external-xref>), as amended by section 501(b) of this Act, is further amended—</text><paragraph commented="no" id="H510431CE925C4A48BF61B9729AF8A447"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph><paragraph commented="no" id="H9B689BE00A37429EBCB01EB2302325BA"><enum>(2)</enum><text>by inserting after subsection (b) the following new subsection:</text><quoted-block display-inline="no-display-inline" institution, or officer, employee, or agent thereof, that receives a request under subsection (a) shall disclose to any person that the Federal Bureau of Investigation has sought or obtained access to information or records under subsection (a).</text></subparagraph><subparagraph commented="no" id="H98BC760AEA784D9CA37D4300B9A0B974"><enum>(B)</enum><header>Certification</header><text>The id="H835DE85EB0A5410E96D847A406059F8D"><enum>(iv)</enum><text>intimidation of potential witnesses;</text></clause><clause commented="no" id="HCD51615A694D41BB8CA6B094FC222DCA"><enum>(v)</enum><text>interference with diplomatic relations;</text></clause><clause commented="no" id="HAFA2C7179D9B495190AA8584E27E0BFF"><enum>(vi)</enum><text>alerting a target, an associate of a target, or the foreign power of which the target is an agent, of the interest of the Government in the target; or</text></clause><clause commented="no" id="H95A60CC3C9FC47F68CC3DFFE59EFD6B8"><enum>(vii)</enum><text display-inline="yes-display-inline">otherwise seriously endangering the national security of the United States.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H8D123CE58CB04C16B450A0826C07E645"><enum>(2)</enum><header>Exception</header><subparagraph commented="no" id="HB1158AC933D84829B9AD9E10C35A1FB8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A financial institution, or officer, employee, or agent thereof, that receives a request under subsection (a) may disclose information otherwise subject to any applicable nondisclosure requirement to—</text><clause commented="no" id="HE16DF940F06741F682AD8B77739E9610"><enum>(i)</enum><text>those persons to whom disclosure is necessary in order to comply with the request;</text></clause><clause commented="no" id="H35D2AAFED3544B14B7960F1D06134041"><enum>(ii)</enum><text>an attorney in order to obtain legal advice or assistance regarding the request; or</text></clause><clause commented="no" id="H2DA05B6E698F4D1C87FE99D5212B472F"><enum>(iii)</enum><text>other persons as permitted by the Director of the Federal Bureau of Investigation or the designee of the Director.</text></clause></subparagraph><subparagraph commented="no" id="H573FE47F352B44B190C4B00D5CDEECF7"><enum>(B)</enum><header>Application</header><text>A person to whom disclosure is made under subparagraph (A) shall be subject to the nondisclosure requirements applicable to a person to whom a request is issued under subsection (a) in the same manner as the person to whom the request is issued.</text></subparagraph><subparagraph commented="no" id="H03624616584B4620B205B453014A8342"><enum>(C)</enum><header>Notice</header><text>Any recipient that discloses to a person described in subparagraph (A) information otherwise subject to a nondisclosure requirement shall inform the person of the applicable nondisclosure requirement.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE1166B0819A6421FB60C9803187D347D"><enum>(D)</enum><header>Identification of disclosure recipients</header><text display-inline="yes-display-inline">At the request of the Director of the Federal Bureau of Investigation or the designee of the Director, any person making or intending to make a disclosure under clause (i) or (iii) of subparagraph (A) shall identify to the Director or such designee the person to whom such disclosure will be made or to whom such disclosure was made prior to the request.</text></subparagraph></paragraph><paragraph commented="no" id="H5A247A0E94374B37A43BA8593B2DA07E"><enum>(3)</enum><header>Termination</header><text>In the case of any request for which a financial institution has submitted a notification or filed a petition for judicial review under paragraph (3)(B), if the facts supporting a nondisclosure requirement cease to exist, an appropriate official of the Federal Bureau of Investigation shall promptly notify the financial institution, or officer, employee, or agent thereof, subject to the nondisclosure requirement that the nondisclosure requirement is no longer in effect.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H72B10376210F41E5BC9E427E3C8E8322"><enum>(c)</enum><header>Identity of financial institutions and credit reports</header><text>Section 626 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681u">15 U.S.C. 1681u</external-xref>), as amended by section 501(c) of this Act, is further amended by striking subsection (c) (as redesignated by section 501(c)(1)(D) of this Act) and inserting the following new subsection:</text><quoted-block id="H8E093E5CF8D14006A1210B8E40DD3B49" style="OLC"><subsection commented="no" id="HD693022781444BF6BEF0C66B079100BB"><enum>(c)</enum><header>Prohibition of certain disclosure</header><paragraph commented="no" id="H42A7252E91AF44818475099F34E09022"><enum>(1)</enum><header>Prohibition</header><subparagraph commented="no" id="H0732D78935BD494FA99792AC881E36F1"><enum>(A)</enum><header>In general</header><text>If a certification is issued under subparagraph (B) and notice of the right to judicial review under subsection (d) is provided, no consumer reporting agency, or officer, employee, or agent thereof, that receives a request under subsection (a) shall disclose or specify in any consumer report, that the Federal Bureau of Investigation has sought or obtained access to information or records under subsection (a) or (b).</text></subparagraph><subparagraph commented="no" id="HA1907C384AF94D6B8B81EF7F22385ECE"><enum>(B)</enum><header>Certification</header><text>The requirements of subparagraph (A) shall apply if the Director of the Federal Bureau of Investigation, or a designee of the Director whose rank shall be no lower than Deputy Assistant Director at Bureau headquarters or a Special Agent in Charge of a Bureau field office, certifies that the absence of a prohibition of disclosure under this subsection may result in—</text><clause commented="no" id="HCFB21348803047B08D74477048C3340B"><enum>(iii)</enum><text>destruction of or tampering with evidence;</text></clause><clause commented="no" id="H2E669F194AC54C7C826618FCFEC399CA"><enum>(iv)</enum><text>intimidation of potential witnesses;</text></clause><clause commented="no" id="H7CC4A91452144BCEB85A0536D361DBEE"><enum>(v)</enum><text>interference with diplomatic relations;</text></clause><clause commented="no" id="HCAAD0CC436A84C33BCC217A29F38824C"><enum>(vi)</enum><text>alerting a target, an associate of a target, or the foreign power of which the target is an agent, of the interest of the Government in the target; or</text></clause><clause commented="no" id="H086F724C5CA54FD39CDC7E97E937282B"><enum>(vii)</enum><text display-inline="yes-display-inline">otherwise seriously endangering the national security of the United States.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H76F5B7ECFCBA4FBCB4B3EE567E4852C5"><enum>(2)</enum><header>Exception</header><subparagraph commented="no" id="H70936D52133F4D82A18A5A8A369769CE"><enum>(A)</enum><header>In general</header><text>A consumer reporting agency, or officer, employee, or agent thereof, that receives a request under subsection (a) may disclose information otherwise subject to any applicable nondisclosure requirement to—</text><clause commented="no" id="HEB7A1627CA2C415091A818EBB481AEA5"><enum>(i)</enum><text>those persons to whom disclosure is necessary in order to comply with the request;</text></clause><clause commented="no" id="HCC576BA46B564730B67BEB36A96C5D33"><enum>(ii)</enum><text>an attorney in order to obtain legal advice or assistance regarding the request; or</text></clause><clause commented="no" id="HD728091C952D4F77A00B395479E3C57A"><enum>(iii)</enum><text>other persons as permitted by the Director of the Federal Bureau of Investigation or the designee of the Director.</text></clause></subparagraph><subparagraph commented="no" id="H089A7E5C15294A149968E079CA43E6F5"><enum>(B)</enum><header>Application</header><text>A person to whom disclosure is made under subparagraph (A) shall be subject to the nondisclosure requirements applicable to a person to whom a request is issued under subsection (a) or (b) in the same manner as the person to whom the request is issued.</text></subparagraph><subparagraph commented="no" id="H8BF1D6A0F3554C54B50046B038A39E8A"><enum>(C)</enum><header>Notice</header><text>Any recipient that discloses to a person described in subparagraph (A) information otherwise subject to a nondisclosure requirement shall inform the person of the applicable nondisclosure requirement.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFB89440487F643778A9A7E0746FE4A7C"><enum>(D)</enum><header>Identification of disclosure recipients</header><text display-inline="yes-display-inline">At the request of the Director of the Federal Bureau of Investigation or the designee of the Director, any person making or intending to make a disclosure under clause (i) or (iii) of subparagraph (A) shall identify to the Director or such designee the person to whom such disclosure will be made or to whom such disclosure was made prior to the request.</text></subparagraph></paragraph><paragraph commented="no" id="H48FE0B17941249CBA1E874224A56F24F"><enum>(3)</enum><header>Termination</header><text>In the case of any request for which a consumer reporting agency has submitted a notification or filed a petition for judicial review under paragraph (3)(B), if the facts supporting a nondisclosure requirement cease to exist, an appropriate official of the Federal Bureau of Investigation shall promptly notify the consumer reporting agency, or officer, employee, or agent thereof, subject to the nondisclosure requirement that the nondisclosure requirement is no longer in effect.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE3BD64B4FCEF4388B129F6C0D9BF0777"><enum>(d)</enum><header>Investigations of persons with access to classified information</header><text>Section 802 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3162">50 U.S.C. 3162</external-xref>) is amended by striking subsection (b) and inserting the following new subsection:</text><quoted-block id="H7A1AF7EFFE4E4B65A46127ED63F58EB0" style="OLC"><subsection id="H4477FEB27ABD463C8F4E528C261F1E60"><enum>(b)</enum><header>Prohibition of certain disclosure</header><paragraph id="HE51B602FACC449D08FFFEF03B579E549"><enum>(1)</enum><header>Prohibition</header><subparagraph id="H7FE30EE09DD64B01A34D000BFACE57AA"><enum>(A)</enum><header>In general</header><text>If a certification is issued under subparagraph (B) and notice of the right to judicial review under subsection (c) is provided, no governmental or private entity, or officer, employee, or agent thereof, that receives a request under subsection (a), shall disclose to any person that an authorized investigative agency described in subsection (a) has sought or obtained access to information under subsection (a).</text></subparagraph><subparagraph id="H0C14FBDDBAFA460399DC84E2D0EF41A7"><enum>(B)</enum><header>Certification</header><text>The requirements of subparagraph (A) shall apply if the head of an authorized investigative agency described in subsection (a), or a designee, certifies that the absence of a prohibition of disclosure under this subsection may result in—</text><clause id="H98228D815EF84B61A963439D4D1F7EE9"><enum>(i)</enum><text>endangering the life or physical safety of any person;</text></clause><clause id="H6C2BE31DF12C498B93B826C16EE1F7FB"><enum>(ii)</enum><text>flight from investigation or prosecution;</text></clause><clause id="H75137B4BB6CF48668B2B75C92E8F7AB1"><enum>(iii)</enum><text>destruction of or tampering with evidence;</text></clause><clause id="HA2F3B22E5C7F4BE6B0CCA2504E1AEFAE"><enum>(iv)</enum><text>intimidation of potential witnesses;</text></clause><clause id="H0F91649C62D442BA83D8FEAF3A968128"><enum>(v)</enum><text>interference with diplomatic relations;</text></clause><clause id="HD21F8387D1424EEDBDAF3E284CC7627E"><enum>(vi)</enum><text>alerting a target, an associate of a target, or the foreign power of which the target is an agent, of the interest of the Government in the target; or</text></clause><clause id="HB7B9A4F7E13F4B8681498E9F5C222DDF"><enum>(vii)</enum><text display-inline="yes-display-inline">otherwise seriously endangering the national security of the United States.</text></clause></subparagraph></paragraph><paragraph id="H32F03A4A21694396A0719E6F2D9077E1"><enum>(2)</enum><header>Exception</header><subparagraph id="H85BBB8CC0E214CBE988921A142641673"><enum>(A)</enum><header>In general</header><text>A governmental or private entity, or officer, employee, or agent thereof, that receives a request under subsection (a) may disclose information otherwise subject to any applicable nondisclosure requirement to—</text><clause id="H7AB7DDA2D7D3484C94437A22537478C3"><enum>(i)</enum><text>those persons to whom disclosure is necessary in order to comply with the request;</text></clause><clause id="H123BBA3599BE42C18B386E9B818885BE"><enum>(ii)</enum><text>an attorney in order to obtain legal advice or assistance regarding the request; or</text></clause><clause id="HD14C77E66F6B43E5845BDCF78447979B"><enum>(iii)</enum><text>other persons as permitted by the head of the authorized investigative agency described in subsection (a).</text></clause></subparagraph><subparagraph id="H5BCA102AE3764E96BC22C1C2AD7FCC11"><enum>(B)</enum><header>Application</header><text>A person to whom disclosure is made under subparagraph (A) shall be subject to the nondisclosure requirements applicable to a person to whom a request is issued under subsection (a) in the same manner as the person to whom the request is issued.</text></subparagraph><subparagraph id="HF6BE5A67C84849E28D2D4D572A5A6064"><enum>(C)</enum><header>Notice</header><text>Any recipient that discloses to a person described in subparagraph (A) information otherwise subject to a nondisclosure requirement shall inform the person of the applicable nondisclosure requirement.</text></subparagraph><subparagraph display-inline="no-display-inline" id="H95AD47AF27ED4D5FBE997DDE1EB5F0FF"><enum>(D)</enum><header>Identification of disclosure recipients</header><text display-inline="yes-display-inline">At the request of the head of an authorized investigative agency described in subsection (a), or a designee, any person making or intending to make a disclosure under clause (i) or (iii) of subparagraph (A) shall identify to the head of the authorized investigative agency or such designee the person to whom such disclosure will be made or to whom such disclosure was made prior to the request.</text></subparagraph></paragraph><paragraph id="H4FE17F0DCF2D43CCB68DED95ABDCF042"><enum>(3)</enum><header>Termination</header><text>In the case of any request for which a governmental or private entity has submitted a notification or filed a petition for judicial review under paragraph (3)(B), if the facts supporting a nondisclosure requirement cease to exist, an appropriate official of the authorized investigative agency described in subsection (a) shall promptly notify the governmental or private entity, or officer, employee, or agent thereof, subject to the nondisclosure requirement that the nondisclosure requirement is no longer in effect.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2FF4D94179794E73B8C6781393DDB6FB"><enum>(e)</enum><header>Judicial Review</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3511">Section 3511</external-xref> of title 18, United parsable-cite="usc/50/3162">50 U.S.C. 3162</external-xref>), wishes to have a court review a nondisclosure requirement imposed in connection with the request, the recipient may notify the Government or file a petition for judicial review in any court described in subsection (a).</text></subparagraph><subparagraph id="H4F7348159D5343899CF2B2157CA8C3D3"><enum>(B)</enum><header>Application</header><text>Not later than 30 days after the date of receipt of a notification under subparagraph (A), the Government shall apply for an order prohibiting the disclosure of the existence or contents of the relevant request. An application under this subparagraph may be filed in the district court of the United States for the judicial district in which the recipient of the order is doing business or in the district court of the United States for any judicial district within which the authorized investigation that is the basis for the request is being conducted. The applicable nondisclosure requirement shall remain in effect during the pendency of proceedings relating to the requirement.</text></subparagraph><subparagraph id="H0BBCE3C9382D4844BFDB49703AA51880"><enum>(C)</enum><header>Consideration</header><text>A district court of the United States that receives a petition under subparagraph (A) or an application under subparagraph (B) should rule expeditiously, and shall, subject to paragraph (3), issue a nondisclosure order that includes conditions appropriate to the circumstances.</text></subparagraph></paragraph><paragraph id="HB4638DF8624F4EC1880DF096E230676D"><enum>(2)</enum><header>Application contents</header><text>An application for a nondisclosure order or extension thereof or a response to a petition filed under paragraph (1) shall include a certification from the Attorney General, Deputy Attorney General, an Assistant Attorney General, or the Director of the Federal Bureau of Investigation, or in the case of a request by a department, agency, or instrumentality of the Federal Government other than the Department of Justice, the head or deputy head of the department, agency, or instrumentality, containing a statement of specific facts indicating that the absence of a prohibition of disclosure under this subsection may result in—</text><subparagraph id="H7B4067301A114C05A3B64AC04DDFE1DC"><enum>(A)</enum><text>endangering the life or physical safety of any person;</text></subparagraph><subparagraph id="H4D1C84E9EB0248ECBBD45F1EF66727C5"><enum>(B)</enum><text>flight from investigation or prosecution;</text></subparagraph><subparagraph id="HD8B15E2F2B1644689A7F29CBD5E24B71"><enum>(C)</enum><text>destruction of or tampering with evidence;</text></subparagraph><subparagraph id="H943F7C0B06CE4FD29F17F37B21F12ED8"><enum>(D)</enum><text>intimidation of potential witnesses;</text></subparagraph><subparagraph id="H894FCB7357144FDDAC8B2E9779DA8F4A"><enum>(E)</enum><text>interference with diplomatic relations;</text></subparagraph><subparagraph id="H2B60E76909F440A19F101CCEB1F2C362"><enum>(F)</enum><text>alerting a target, an associate of a target, or the foreign power of which the target is an agent, of the interest of the Government in the target; or</text></subparagraph><subparagraph id="H589D0184889D40F99A26D2A4818D6D3A"><enum>(G)</enum><text display-inline="yes-display-inline">otherwise seriously endangering the national security of the United States.</text></subparagraph></paragraph><paragraph id="HF064BD9109404BFA9C2506A83A5EC6B1"><enum>(3)</enum><header>Standard</header><text>A district court of the United States shall issue a nondisclosure requirement order or extension thereof under this subsection if the court determines that there is reason to believe that disclosure of the information subject to the nondisclosure requirement during the applicable time period will result in—</text><subparagraph id="HBBF6C9635EE64AA38C66075E17B027DA"><enum>(A)</enum><text>endangering the life or physical safety of any person;</text></subparagraph><subparagraph id="HEA219075C25D4A9A804DF2F88D0318DB"><enum>(B)</enum><text>flight from investigation or prosecution;</text></subparagraph><subparagraph id="HAC4CCBA3447742FF91C52726EA5AB11F"><enum>(C)</enum><text>destruction of or tampering with evidence;</text></subparagraph><subparagraph id="H05A882B33AEA47AC96565B5A403FC99D"><enum>(D)</enum><text>intimidation of potential witnesses;</text></subparagraph><subparagraph id="H0CAD240A8B7B46899483D48C48B1107F"><enum>(E)</enum><text>interference with diplomatic relations;</text></subparagraph><subparagraph id="H3359E828F46941B6B1EE7E4D601586E8"><enum>(F)</enum><text>alerting a target, an associate of a target, or the foreign power of which the target is an agent, of the interest of the Government in the target; or</text></subparagraph><subparagraph id="H206966EACB2B42A190BE559FEB891D8A"><enum>(G)</enum><text display-inline="yes-display-inline">otherwise seriously endangering the national security of the United States.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H6E30AD151E2E437FA196B1AE5AD45ECC"><enum>503.</enum><header>Judicial review</header><subsection id="H45DEEFB532EB40CD89EED29271235C19"><enum>(a)</enum><header>Counterintelligence access to telephone toll and transactional records</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2709">Section 2709</external-xref> of title 18, United States Code, as amended by section 501(a) of this Act, is further amended—</text><paragraph id="H8AC25688A73341B5BD38378640A02E98"><enum>(1)</enum><text>by redesignating subsections (d), (e), (f), and (g) as subsections (e), (f), (g), and (h), respectively; 120 Stat. 219) is amended—</text><paragraph id="H01E43DCF09344E68B99FF6DBD6B740ED"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H91732AE1B70A4BEAA5984A2D5C2D226C"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>and calendar years 2010 through 2013</quote> after <quote>2006</quote>; and</text></subparagraph><subparagraph id="HD4416E8249214AF181F8BE46B5BA586A"><enum>(D)</enum><text>examine the manner in which information received under the national security letters was collected, retained, analyzed, and disseminated.</text></subparagraph></paragraph><paragraph id="H7E0254875B9843E9A9E32DE1F41E5D91"><enum>(2)</enum><header>Submission date for assessment</header><text>Not later than December 31, 2014, the Inspector General of the Intelligence Community shall submit to the Committee on the Judiciary and the Select Committee on Intelligence of the Senate and the Committee on the Judiciary and the Permanent Select Committee on Intelligence of the House of Representatives a report containing the results of the assessment for calendar years 2010 through 2013.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H5362AC5C34F749EBA9A0ACA002C15AC3"><enum>(6)</enum><text>in subsection (e), as redesignated by paragraph (4)—</text><subparagraph id="HBC9763B7662D44F8AA9625F7322A9D2F"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H73579003A319439986178A479F745981"><enum>(i)</enum><text>by striking <quote>a report under subsection (c)(1) or (c)(2)</quote> and inserting <quote>any report under subsection (c) or (d)</quote>; and</text></clause><clause id="H52E8C5C505BB4062A181DD93C7B49B9A"><enum>(ii)</enum><text>by striking <quote>Inspector General of the Department of Justice</quote> and inserting <quote>Inspector General of the Department of Justice, the Inspector General of the Intelligence Community, and any Inspector General of an element of the intelligence community that prepares a report to assist the Inspector General of the Department of Justice or the Inspector General of the Intelligence Community in complying with the requirements of this section</quote>; 109 Stat. 974), read on October 25, 2001; and</text></paragraph><paragraph id="H82632F7F389846C189FDACB0DE585A7F"><enum>(4)</enum><text>section 802 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3162">50 U.S.C. 3162</external-xref>) is amended to read as such provision read on October 25, 2001.</text></paragraph></subsection><subsection id="H79EC30D323654B379568CA0299FB3263"><enum>(b)</enum><header>Transition provision</header><text>Notwithstanding subsection (a), the provisions of law referred to in subsection (a), as in effect on May 31, 2015, shall continue to apply on and after June 1, 2015, with respect to any particular foreign intelligence investigation or with respect to any particular offense or potential offense that began or occurred before June 1, 2015.</text></subsection></section><section id="H80E68C5C0A3F48AAB7012F68A0D646CB"><enum>506.</enum><header>Technical and conforming amendments</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/3511">Section 3511</external-xref> of title 18, United States Code, is amended in subsections (a), (c), and (d), by striking <quote>or 627(a)</quote> each place it appears.</text></section></title><title id="H840E1C41C8AC47D9BC119A6AFFD5EDE8"><enum>VI</enum><header>FISA and national security letter transparency reforms</header><section id="HA0A4106387B64A928B500B7E461A1B46" section-type="subsequent-section"><enum>601.</enum><header>Third-party reporting on FISA orders and national security letters</header><subsection id="HF40181C478CF4A5D8FC16101250015EE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each electronic service provider may report information to the public in accordance with this section about demands and requests for information made by any Government entity under a surveillance law, and is exempt in accordance with subsection (d) from liability with respect to that report, even if such provider would otherwise be prohibited by a surveillance law from reporting that information.</text></subsection><subsection id="H957167AF6AED46D7B1CE0C1867859183"><enum>(b)</enum><header>Periodic aggregate reports</header><text display-inline="yes-display-inline">An electronic service provider may report such information not more often than quarterly and only to the following extent:</text><paragraph id="H10DD4031D8BF4E1799DAD1802DCD45EE"><enum>(1)</enum><header>Estimate of numbers of demands and requests made</header><text display-inline="yes-display-inline">The report may reveal an estimate of the number of the demands and requests described in subsection (a) made during the period to which the report pertains.</text></paragraph><paragraph id="HD704DBD39F634D2185E361750431EF0A"><enum>(2)</enum><header>Estimate of numbers of demands and requests complied with</header><text display-inline="yes-display-inline">The report may reveal an estimate of the numbers of the demands and requests described in subsection (a) the electronic service provider complied with during the period to which the report pertains, regardless of when the demands or requests were made.</text></paragraph><paragraph id="H65904695BCF24F7C9583776239C898CB"><enum>(3)</enum><header>Estimate of number of users or accounts</header><text display-inline="yes-display-inline">The report may reveal an estimate of the numbers of users or accounts, or both, of the electronic service provider, for which information was demanded, requested, or provided during the period to which the report pertains.</text></paragraph></subsection><subsection id="H79075A5DE7A243DEBC105C393E840221"><enum>(c)</enum><header>Special rules for reports</header><paragraph id="H83C02FCDD72E43CE8C0A94B14D5F40C0"><enum>(1)</enum><header> Level of detail by authorizing surveillance law</header><text display-inline="yes-display-inline">Any estimate disclosed under this section may be an overall estimate or broken down by categories of authorizing surveillance laws or by provisions of authorizing surveillance laws.</text></paragraph><paragraph id="H68A57A98127142F49841C63ADDFFC094"><enum>(2)</enum><header>Level of detail by numerical range</header><text>Each estimate disclosed under this section shall be rounded to the nearest 100. and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HD7BD22A7F3E94C55BE9349A9CC20C34F"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H5869958D2BF944549B204A846D1B0FCF" style="traditional"><paragraph id="H7C7393BB12DF43F09BB74265A5F52427" indent="up1"><enum>(3)</enum><text>Not later than 7 days after the date on which a report is submitted under paragraph (1), the Attorney General shall make such report publicly available.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H9875237D7DAB4BB99E133559CD80841A"><enum>(e)</enum><header>Additional procedures regarding certain persons outside the United States</header><text>Section 707 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1881f">50 U.S.C. 1881f</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H099F82AB41354D7E9CFA6BEA37480223" style="OLC"><subsection id="H933CD73B943F4AC0929BD092111D1012"><enum>(c)</enum><header>Additional annual report</header><paragraph id="H1189FED3052D4520B77F64BA900BFA07"><enum>(1)</enum><header>Report required</header><text display-inline="yes-display-inline">In April of each year, the Attorney General shall submit to the Permanent Select Committee on Intelligence and the Committee on the Judiciary of the House of Representatives and the Select Committee on Intelligence and the Committee on the Judiciary of the Senate a report setting forth with respect to the preceding year—</text><subparagraph id="HCFEFE3CDB9BB43B1B586E621935FFA2B"><enum>(A)</enum><text>the total number of—</text><clause id="H41572925A7C84965898B765B116D4239"><enum>(i)</enum><text>directives issued under section 702;</text></clause><clause id="HA181D1D063744A4387B8473BD3B33B60"><enum>(ii)</enum><text>orders granted under section 703; and</text></clause><clause id="H2ACEAD8307F641758D63EA96B45EC2C4"><enum>(iii)</enum><text>orders granted under section 704;</text></clause></subparagraph><subparagraph id="H9AEC6731BBB9400CB2C305C8AC6AE6DB"><enum>(B)</enum><text>good faith estimates of the total number of individuals, rounded to the nearest 100, whose electronic or wire communications or communications records were collected pursuant to—</text><clause id="HE370256A43824635B23991FA87499DDB"><enum>(i)</enum><text>a directive issued under section 702;</text></clause><clause id="HB2705C9B406545C5A7DD91B538F08CEC"><enum>(ii)</enum><text>an order granted under section 703; and</text></clause><clause id="H909F7C684A7D4B8EB46AC929935B9ECB"><enum>(iii)</enum><text>an order granted under section 704;</text></clause></subparagraph><subparagraph id="HBE8A4E86261544FF9B0B65658874A0EB"><enum>(C)</enum><text>good faith estimates of the total number, rounded to the nearest 100, of United States persons whose electronic or wire communications or communications records were collected pursuant to—</text><clause id="H09B9CE64D3E540ECB4BFD25A5EF70F03"><enum>(i)</enum><text>a directive issued under section 702;</text></clause><clause id="H48529F71B9CD48E79A877B99F990CF56"><enum>(ii)</enum><text>an order granted under section 703; and</text></clause><clause id="HCFA0D149DDCD4EE787333CE82BDD3FAF"><enum>(iii)</enum><text>an order granted under section 704; and</text></clause></subparagraph><subparagraph id="HBD7C0B13DE404F1F9EA16B1B46485EBD"><enum>(D)</enum><text>a good faith estimate of the total number of United States persons whose electronic or wire communications or communications records were collected pursuant to a directive issued under section 702 and subsequently reviewed or accessed by a Federal officer, employee, or agent, rounded to the nearest 100.</text></subparagraph></paragraph><paragraph id="H44D80F1212FC4DC2B4D0CF0406A695F2"><enum>(2)</enum><header>Form</header><text>Each report required under paragraph (1) shall be submitted in unclassified form.</text></paragraph><paragraph id="H00C4A66E2E294C5BB20FABE5D984DFE9"><enum>(3)</enum><header>Public availability</header><text>Not later than 7 days after the date on which a report is submitted under paragraph (1), the Attorney General shall make such report publicly available.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="H3E623F43791D4ACA8CFD7D954E346DD1" section-type="subsequent-section"><enum>603.</enum><header display-inline="yes-display-inline">Government reporting on national security letters</header><text display-inline="no-display-inline">Section 118(c) of the USA PATRIOT Improvement and Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/18/3511">18 U.S.C. 3511</external-xref> note) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H629340A73F3248D1B99C97FE1E3B3836" style="OLC"><subsection commented="no" id="H181A197B7EB546B3B4FB21ED7FA9A77E"><enum>(c)</enum><header>Report on requests for national security letters</header><paragraph commented="no" id="H78D84C19228F408DAD4FC15FFBB1054F"><enum>(1)</enum><header>Classified form</header><subparagraph commented="no" id="HBFA289AA5A644A5F8ED10738A77A9ADE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than March 1, 2015, and every 180 days thereafter, the Attorney General shall submit to the Select Committee on Intelligence, the Committee on the Judiciary, and the Committee on Banking, Housing, and Urban Affairs of the Senate and the Permanent Select Committee on Intelligence, the Committee on the Judiciary, and the Committee on Financial Services of the House of Representatives a report fully informing the committees concerning the requests made under <external-xref legal-doc="usc" parsable-cite="usc/18/2709">section 2709(a)</external-xref> of title 18, United States Code, section 1114 of the Right to Financial Privacy Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/3414">12 U.S.C. 3414(a)(5)(A)</external-xref>), section 626 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681u">15 U.S.C. 1681u</external-xref>), or section 802 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3162">50 U.S.C. 3162</external-xref>) during the applicable period.</text></subparagraph><subparagraph commented="no" id="H778C8350E6374079AA12A1CB45620425"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">Each report under subparagraph (A) shall include, for each provision of law described in subparagraph (A)—</text><clause commented="no" id="H570A063AC67B4662A2A98EE0F72A5254"><enum>(i)</enum><text>authorized requests under the provision, including requests for subscriber information; and</text></clause><clause commented="no" id="H70A3BDD5446A4848A79F6C158BC4C31C"><enum>(ii)</enum><text>the number of authorized requests under the provision—</text><subclause commented="no" id="H517914E89EDF4CAFAA704D1C92156946"><enum>(I)</enum><text>that relate to a United States person;</text></subclause><subclause commented="no" id="HD3E6AC800CE840B9A57BA42079C68278"><enum>(II)</enum><text>that relate to a person that is not a United States person;</text></subclause><subclause commented="no" id="H182F4E2CD20841349B55F6B2F7088CB9"><enum>(III)</enum><text>that relate to a person that is—</text><item commented="no" id="H39364C99F144443787BF9D43F4FAC7D7"><enum>(aa)</enum><text>the subject of an authorized national security investigation; Each report under this paragraph shall be in unclassified form.</text></subparagraph><subparagraph commented="no" id="HF74CBDF7503D466693A470726B864EB1"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">Each report under subparagraph (A) shall include the aggregate total of requests—</text><clause commented="no" id="H13876E3B53B842D0BDC2A909DACC3C02"><enum>(i)</enum><text>that relate to a United States person;</text></clause><clause commented="no" id="HBFCBEB51B4804D18833834278F044F82"><enum>(ii)</enum><text>that relate to a person that is not a United States person;</text></clause><clause commented="no" id="H4104DA7CD1BF428596132CEC778FDA6D"><enum>(iii)</enum><text>that relate to a person that is—</text><subclause commented="no" id="HF88112F3F07549F5BAEB9CD0B3A13A26"><enum>(I)</enum><text>the subject of an authorized national security investigation; or</text></subclause><subclause commented="no" id="HAA33226493F9460582BAED9A0A316FEC"><enum>(II)</enum><text>an individual who has been in contact with or otherwise directly linked to the subject of an authorized national security investigation; and</text></subclause></clause><clause commented="no" id="H1C29265CFB5F4A84B761792CDD8FB22D"><enum>(iv)</enum><text>that relate to a person that is not known to be the subject of an authorized national security investigation.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H9E9DF7DF210845629809CE2DA7C7C895"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph commented="no" id="H152FD1BFE9744D05929B7BA0586C0440"><enum>(A)</enum><header>Applicable period</header><text>The term <quote>applicable period</quote> means—</text><clause commented="no" id="H7EBD0AE63BA04D4B96A98F585268489A"><enum>(i)</enum><text>with respect to the first report submitted under paragraph (1) or (2), the period beginning 180 days after the date of enactment of the USA FREEDOM Act and ending on December 31, 2014; and</text></clause><clause commented="no" id="HD2E25E8F962B488C82F8F88EE2C92731"><enum>(ii)</enum><text>with respect to the second report submitted under paragraph (1) or (2), and each report thereafter, the 6-month period ending on the last day of the second month before the date for submission of the report.</text></clause></subparagraph><subparagraph commented="no" id="HAFC0E82853E9470DAF61F8DF017222B6"><enum>(B)</enum><header>United States person</header><text>The term <quote>United States person</quote> has the meaning given that term in section 101 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801</external-xref>).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="H6F2D6BB8CC194D1580BE070F0712BD65"><enum>VII</enum><header>Privacy and Civil Liberties Oversight Board subpoena authority</header><section id="H1A6EB1D81EB14ED18B3651A081611969"><enum>701.</enum><header>Privacy and Civil Liberties Oversight Board subpoena authority</header><text display-inline="no-display-inline">Section 1061(g) of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000ee">42 U.S.C. 2000ee(g)</external-xref>) is amended—</text><paragraph id="HA39E1E77401F4198B12DB50888244246"><enum>(1)</enum><text>in paragraph (1)(D), by striking <quote>submit a written request to the Attorney General of the United States that the Attorney General</quote>;</text></paragraph><paragraph id="H69FFDED31FC34D85B4BEF806E7DAC2CB"><enum>(2)</enum><text>by striking paragraph (2); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H26B74FE247184FEF9C3C4781C317B01D"><enum>(3)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (2) and (3).</text></paragraph></section></title></legis-body></bill>
