which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for an exemption from the individual mandate under the Patient Protection and Affordable Care Act for individuals residing in States in which the Exchange Websites are not fully functional, and for other purposes.</official-title></form><legis-body id="H109290159B0D45AB892640B7271DAC32" style="OLC"><section id="H96B9F4ED90204795B118245703606C1C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness for Individuals Using Exchange Websites Act of 2013</short-title></quote>.</text></section><section id="H28226F29D2C743C0AE34D0CCB8F392BB"><enum>2.</enum><header>Exemption from ACA individual mandate for individuals residing in States with an Exchange for which the Website has not received a certification of functionality</header><subsection id="H62317BF00EE14B23BB2A1E3960A74F99"><enum>(a)</enum><header>HHS certification</header><text>The Inspector General of the Department of Health and Human Services shall certify the Website of an Exchange established under title I of the Patient Protection and Affordable Care Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>) once such Website is determined, based on the criteria specified under subsection (b), to be fully functional for the purpose of enrolling through such Exchange in qualified health plans (as defined in section 1301(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18021">42 U.S.C. 18021(a)</external-xref>)).</text></subsection><subsection id="H7F3575E8845D4F76ABE753BB425CA9B2"><enum>(b)</enum><header>Criteria</header><text>Not later than 30 days after the date of the enactment of this Act, the Comptroller General of the United States shall specify criteria for determining whether the Website of an Exchange described in subsection (a) is fully functional for the purpose described in such subsection.</text></subsection><subsection id="HCD694C27AC81429F8A57BBA8F1EFE817"><enum>(c)</enum><header>Special enrollment period following date of certification</header><text>Section 1311(c)(6) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18031">42 U.S.C. 18031(c)(6)</external-xref>) is amended—</text><paragraph id="HBAA05746426441C488881F9CC897999A"><enum>(1)</enum><text>in subparagraph (C), by striking at the end <quote><short-title>and</short-title></quote>;</text></paragraph><paragraph id="HABF93ACABE1D49FA86BE45E7C3B64DFF"><enum>(2)</enum><text>in subparagraph (D), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H6D006DCFFCBA48A4B58D87F9BFED860D"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="HF29968702E75463889639588F9F7A197" style="OLC"><subparagraph id="H32F8D6EFC0784824B489003F8F3C6FE6"><enum>(E)</enum><text display-inline="yes-display-inline">in the case of an Exchange for which the Website is certified under section 2(a) of the Fairness for Individuals Using Exchange Websites Act of 2013 after December 31, 2013, a special enrollment period of at least 3 months beginning after the date of such certification.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7DE5A6ECC45F4F37AE51EC3275366881"><enum>(d)</enum><header>Exemption from ACA individual mandate</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5000A">Section 5000A(e)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text><quoted-block id="H5C7A45ADCC1644998332D167D6D86940" style="OLC"><paragraph id="H8E8943E037264F0A857F1BD28D5AA2AD"><enum>(6)</enum><header>Individuals unable to enroll in a health plan online</header><subparagraph id="HD98BB6682F7C4B33BCD5207E993F630A"><enum>(A)</enum><header>Individuals residing in States with uncertified Exchange Websites</header><text display-inline="yes-display-inline">Any applicable individual for any month during which the individual resides in a State for which the Exchange Website is not certified under section 2(a) of the Fairness for Individuals Using Exchange Websites Act of 2013.</text></subparagraph><subparagraph id="HC479E744A16A40F4B0B777BF1C37055F"><enum>(B)</enum><header>Individuals residing in States with Exchange Websites certified after December 31, 2013</header><text display-inline="yes-display-inline">In the case of an Exchange for a State with respect to which the Website is certified under section 2(a) of the Fairness for Individuals Using Exchange Websites Act of 2013 after December 31, 2013, any applicable individual for any month—</text><clause id="HFF6A956F157442FDA390C4FC5E4F11A0"><enum>(i)</enum><text>beginning before the last day of the special enrollment period provided by such Exchange pursuant to section 1311(c)(6)(E) of the Patient Protection and Affordable Care Act; and</text></clause><clause id="HEEA081A0D7EB49949E5326A1A263282B"><enum>(ii)</enum><text>during which the individual resides in such State.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3C7BC9A782EE45F982A6CC4E0881AB8C"><enum>(e)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by—</text><paragraph id="H086053039708486B8F2D818A8894D8B5"><enum>(1)</enum><text display-inline="yes-display-inline">subsection (c) shall take effect as if included in the enactment of section 1311 of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18031">42 U.S.C. 18031</external-xref>); and</text></paragraph><paragraph id="HDC417CF6C85A432499E21569B5276393"><enum>(2)</enum><text>subsection (d) shall take effect as if included in the amendments made by section 1501 of such Act.</text></paragraph></subsection></section></legis-body></bill>
