R. 3349</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131028">October 28, 2013</action-date><action-desc><sponsor name-id="C000714">Mr. Conyers</sponsor> (for himself, <cosponsor name-id="W000207">Mr. Watt</cosponsor>, and <cosponsor name-id="C001093">Mr. Collins of Georgia</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the permanent funding of the United States Patent and Trademark Office, and for other purposes.</official-title></form><legis-body id="HA25AF6D41860463DBE10C1C1DEB7CB04" style="OLC"><section id="H1CC1DF2EC1164CC8ABE9060F5A22DBEC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Innovation Protection Act</short-title></quote>.</text></section><section id="H1A6C053431A64849ADAFFC474D151260"><enum>2.</enum><header>Patent and Trademark Office funding</header><subsection id="H57A6BEB85DBE49E0B778DA5CEBAAC441"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H919E7EEFF6974D018B148507FDAF9BD0"><enum>(1)</enum><header>Director</header><text>The term <term>Director</term> means the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office.</text></paragraph><paragraph id="HDA82D7654F46467A87FF53C552E1EB94"><enum>(2)</enum><header>Fund</header><text display-inline="yes-display-inline">The term <term>Fund</term> means the United States Patent and Trademark Office Public Enterprise Revolving fund established under subsection (c).</text></paragraph><paragraph id="H5257B6F2F6E54491BD727F951700C699"><enum>(3)</enum><header>Office</header><text>The term <term>Office</term> means the United States Patent and Trademark Office.</text></paragraph><paragraph id="HAFA3B0BEE0C84CD6B76476154B39758C"><enum>(4)</enum><header>Trademark Act of 1946</header><text>The term <term>Trademark Act of 1946</term> means the Act entitled <quote><short-title>An Act to provide for the registration and protection of trademarks used in commerce, to carry out the provisions of certain international conventions, and for other purposes</short-title></quote>, approved July 5, 1946 (<external-xref legal-doc="usc" parsable-cite="usc/15/1051">15 U.S.C. 1051 et seq.</external-xref>) (commonly referred to as the <term>Trademark Act of 1946</term> or the <term>Lanham Act</term>).</text></paragraph></subsection><subsection id="H4269C727A02641DEA4050878CB7253E9"><enum>(b)</enum><header>Funding</header><paragraph id="H407B324B4AC34791818AE82A310BCF9A"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/35/42">Section 42</external-xref> of title 35, United States Code, is amended—</text><subparagraph id="HE0DCA9027CC54641B5E37063E9BB5FAC"><enum>(A)</enum><text>in subsection (b), by striking <quote>Patent and Trademark Office Appropriation Account</quote> and inserting <quote>United States Patent and Trademark Office Public Enterprise Fund</quote>; and</text></subparagraph><subparagraph id="H017DE9500E57454695A549C0F54C82EE"><enum>(B)</enum><text>in subsection (c)—</text><clause id="H814BB41C48784BCBA49381FC03318647"><enum>(i)</enum><text>in paragraph (1)—</text><subclause id="H5A8E90E9A9B748DFA0741AC1EC856503"><enum>(I)</enum><text>in the first sentence, by striking <quote>To the extent</quote> and all that follows through <quote>fees</quote> and inserting <quote>Fees</quote>; and</text></subclause><subclause id="H93ABBEF6437041EDB5231CFA0F15645E"><enum>(II)</enum><text>by striking <quote>shall be collected by and shall, subject to paragraph (3), be available to the Director</quote> and inserting <quote>shall be collected by, and shall be available to, the Director until expended</quote>; and</text></subclause></clause><clause id="H045DB484AAAB48469A066EDEE4F0F51B"><enum>(ii)</enum><text>by striking paragraph (2) and redesignating paragraph (3) as paragraph (2).</text></clause></subparagraph></paragraph><paragraph id="H04E95A23DBC245B4BF24C2D05CBA4279"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall take effect on the first day of the first fiscal year that begins on or after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="H5BA9FAC6A66F4F178F6BCB2590800495"><enum>(c)</enum><header>USPTO revolving fund</header><paragraph id="H3123713819F341F4BC6DBDDA1122976F"><enum>(1)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a revolving fund to be known as the <quote>United States Patent and Trademark Office Public Enterprise Fund</quote>. Any amounts in the Fund shall be available for use by the Director without fiscal year limitation.</text></paragraph><paragraph id="H22703A3BCAA34887923782B9D128A19B"><enum>(2)</enum><header>Derivation of resources</header><subparagraph id="HB5064FB235584205B9B20B570A652768"><enum>(A)</enum><header>In general</header><text>There shall be deposited into the Fund on and after the effective date set forth in subsection (b)(2)—</text><clause id="HDDE92CEDED4A4F0BBB4BAB77EF175156"><enum>(i)</enum><text>any fees collected under title 35, United States Code; and</text></clause><clause id="H7141CD8430FB45878E76169AAD28E080"><enum>(ii)</enum><text>any fees collected under the Trademark Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/15/1051">15 U.S.C. 1051 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="H21CBBD23CF5B40DD97C3EAE0E401AF12"><enum>(B)</enum><header>Remaining balances</header><text display-inline="yes-display-inline">There shall be deposited in the Fund, on the effective date set forth in subsection (b)(2), any unobligated balances remaining in the Patent and Trademark Office Appropriation Account, and in the Patent and Trademark Fee Reserve Fund established under <external-xref legal-doc="usc" parsable-cite="usc/31/42">section 42(b)(2)</external-xref> of title 31, United States Code, as in effect on the day before such effective date. Upon the payment of all obligated amounts in the Patent and Trademark Fee Reserve Fund, the Patent and Trademark Fee Reserve Fund shall be terminated.</text></subparagraph></paragraph><paragraph id="H67217A53E32B479EBA70FFDEF40A66C4"><enum>(3)</enum><header>Expenses</header><text>Amounts deposited into the Fund under paragraph (2) shall be available, without fiscal year limitation, to cover—</text><subparagraph id="HE6F425B15F544B8C81859A223F89469F"><enum>(A)</enum><text>all expenses, to the extent consistent with the limitation on the use of fees set forth in <external-xref legal-doc="usc" parsable-cite="usc/35/42">section 42(c)</external-xref> of title 35, United States Code, including all administrative and operating expenses, determined in the discretion of the Director to be ordinary and reasonable, incurred by the Director for the continued operation of all services, programs, activities, and duties of the Office relating to patents and trademarks, as such services, programs, activities, and duties are described under—</text><clause id="H6CBC76CC95F14A20B4AD593F192731C9"><enum>(i)</enum><text>title 35, United States Code; and</text></clause><clause id="H0537E30AA666450886969439196D6878"><enum>(ii)</enum><text>the Trademark Act of 1946; and</text></clause></subparagraph><subparagraph id="H2BFA94EF73414C1880E30764987D4A36"><enum>(B)</enum><text>all expenses incurred pursuant to any obligation, representation, or other commitment of the Office.</text></subparagraph></paragraph></subsection><subsection id="HC69AE8C2B7094419B6B6CA5084302288"><enum>(d)</enum><header>Annual report and operation plan</header><text display-inline="yes-display-inline">Not later than 60 days after the end of each fiscal year, the Director shall submit to Congress a report that—</text><paragraph id="HF566E50E83484B18BDD5E4C5B4771584"><enum>(1)</enum><text>summarizes the operations of the Office for the preceding fiscal year, including financial details and staff levels broken down by each major activity of the Office;</text></paragraph><paragraph id="H485D23F65C3F425F94D484F75C387CA1"><enum>(2)</enum><text>describes the long term modernization plans of the Office;</text></paragraph><paragraph id="H3D0A60135F494C77918C1A7CB12E6EA4"><enum>(3)</enum><text>sets forth details of any progress towards such modernization plans made in the preceding fiscal year; and</text></paragraph><paragraph id="H3092E414453E47A8A6DDFCE166FAB944"><enum>(4)</enum><text>includes the results of the most recent audit carried out under subsection (f).</text></paragraph></subsection><subsection id="H22FA5CABE10B4402B5563EBAB82603B7"><enum>(e)</enum><header>Annual spending plan</header><paragraph id="H8046F2C124C0468BAC4A9435D2C39395"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the beginning of each fiscal year, the Director shall notify the Committee on Appropriations of the House of Representatives and the Committee on Appropriations of the Senate of the plan for the obligation and expenditure by the Office of the total amount of the funds for that fiscal year in accordance with section 605 of the Science, State, Justice, Commerce, and Related Agencies Appropriations Act, 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/108">Public Law 109–108</external-xref>; 119 Stat. 2334).</text></paragraph><paragraph id="H59232D3090BC4EFB9B5A47057D321CEE"><enum>(2)</enum><header>Contents</header><text>Each plan under paragraph (1) shall—</text><subparagraph id="H37E03BE154E344508EEDE73D1B1074F8"><enum>(A)</enum><text>summarize the operations of the Office for the current fiscal year, including financial details and staff levels with respect to major activities; and</text></subparagraph><subparagraph id="H41620D1FAA5A44BBA1F08F735EC4E370"><enum>(B)</enum><text>detail the operating plan of the Office, including specific expense and staff needs, for the current fiscal year.</text></subparagraph></paragraph></subsection><subsection id="H371FD9A92F444A9092B8A714ED7D9ED7"><enum>(f)</enum><header>Audit</header><text>The Director shall, on an annual basis, provide for an independent audit of the financial statements of the Office. Such audit shall be conducted in accordance with generally accepted accounting principles.</text></subsection><subsection id="HD7EC81EEEB464239A6E57B7DA6B3CAE5"><enum>(g)</enum><header>Budget</header><text>The Fund shall prepare and submit each year to the President a business-type budget in such manner, and before such date, as the President prescribes by regulation.</text></subsection></section></legis-body></bill>
