which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Director of the Office of Management and Budget to report on the disaster assistance obligations of the Federal Government, and for other purposes.</official-title></form><legis-body id="H571233F0CDA142E19F693DFCDD932A7F" style="OLC"><section id="HD0AE86157ACC499CA713F75BABF374EF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Assistance Transparency and Accountability Act of 2013</short-title></quote> or the <quote><short-title>DATA Act of 2013</short-title></quote>.</text></section><section id="HB15BF93AADDC4A049DB1EB381D1DB7B7"><enum>2.</enum><header>Disaster assistance reports</header><subsection id="H92EEEB0998B346D48665B1F7E627891D"><enum>(a)</enum><header>Disaster assistance spending report</header><paragraph id="H441DB5517F2348B4B4C8BBF3BF65B324"><enum>(1)</enum><header>Initial report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Director of the Office of Management and Budget shall submit to Congress a report that specifies—</text><subparagraph id="H6733BA60908140ABA628414142200B0D"><enum>(A)</enum><text display-inline="yes-display-inline">for each of the 10 fiscal years most recently concluded before submission of the report, the amount obligated by the Federal Government for disaster assistance, including the amount obligated for disaster assistance—</text><clause id="H02C65BF9BA8244D09F54BFD79D98B7C2"><enum>(i)</enum><text>by each Federal department or agency that made an obligation relating to disaster assistance; and</text></clause><clause id="HCF36EBF283964DBF94CBED747B9F7C8C"><enum>(ii)</enum><text>under each relevant program, project, or activity of such department or agency; and</text></clause></subparagraph><subparagraph id="HFC4F3BEE029546D8BF1B209D940B982D"><enum>(B)</enum><text display-inline="yes-display-inline">for the fiscal year in which the report is submitted, the amount projected to be obligated by the Federal Government for disaster assistance, including the amount projected to be obligated for disaster assistance—</text><clause id="H2E023934485C45AF8727C90F6DE19FFC"><enum>(i)</enum><text display-inline="yes-display-inline">by each Federal department or agency that has made or may make an obligation relating to disaster assistance; and</text></clause><clause id="HC480A3CA09CB403991324CAB2B440EEE"><enum>(ii)</enum><text display-inline="yes-display-inline">under each relevant program, project, or activity of such department or agency.</text></clause></subparagraph></paragraph><paragraph id="H90978B8274194100A50C37295D119783"><enum>(2)</enum><header>Annual report</header><text display-inline="yes-display-inline">Each year in conjunction with the President’s annual budget submission to Congress under <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105(a)</external-xref> of title 31, United States Code, the Director of the Office of Management and Budget shall submit to Congress a report that specifies—</text><subparagraph id="H46994480B27F4DBA8BE1062CBA19946E"><enum>(A)</enum><text display-inline="yes-display-inline">for the fiscal year for which the budget is submitted, the amount projected to be obligated for disaster assistance by—</text><clause id="H39B7E46DF13E4CB7AB456395FA7710B7"><enum>(i)</enum><text display-inline="yes-display-inline">each Federal department or agency that may make an obligation relating to disaster assistance; and</text></clause><clause id="H692B2CE29A2640718563C3FF36073FF4"><enum>(ii)</enum><text display-inline="yes-display-inline">each relevant program, project, or activity of such department or agency;</text></clause></subparagraph><subparagraph id="H8108709F95FA4D7EB368D7B705350A3B"><enum>(B)</enum><text display-inline="yes-display-inline">for the fiscal year in which the budget is submitted, the amount projected to be obligated for disaster assistance by—</text><clause id="H7C12F7A2C3AF4A16968D1E7B99E0F35D"><enum>(i)</enum><text display-inline="yes-display-inline">each Federal department or agency that has made or may make an obligation relating to disaster assistance; and</text></clause><clause id="HA54EB6B5348E4B8C9040CCA82C9F899C"><enum>(ii)</enum><text display-inline="yes-display-inline">each relevant program, project, or activity of such department or agency;</text></clause></subparagraph><subparagraph id="H5080A92865194DCE986A8CF32193D5DB"><enum>(C)</enum><text display-inline="yes-display-inline">for the most-recently concluded fiscal year, the amount obligated for disaster assistance by—</text><clause id="H10C44E8D40F4486FA41138BC3CD3D0E3"><enum>(i)</enum><text>each Federal department or agency that made an obligation relating to disaster assistance; and</text></clause><clause id="H725AB5F0E4CA452696579297F108671C"><enum>(ii)</enum><text display-inline="yes-display-inline">each relevant program, project, or activity of such department or agency; and</text></clause></subparagraph><subparagraph id="HCFF5C8BAA82F4FB8AE8B54D6E8508C3D"><enum>(D)</enum><text>any corrections to reports previously submitted under this subsection.</text></subparagraph></paragraph></subsection><subsection id="H4BDFF470AA6B42C7A255B0D2A53E6571"><enum>(b)</enum><header>Biennial report evaluating effectiveness of disaster assistance spending</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the report under subsection (a)(1) is submitted, and every 2 years thereafter, the Comptroller General of the United States shall submit to the Committee on Appropriations and the Committee on the Budget of the House of Representatives and the Committee on Appropriations and the Committee on the Budget of the Senate a report that provides—</text><paragraph id="H1588C65FA1684D53B9496994D4F41BD2"><enum>(1)</enum><text>an evaluation of Federal disaster assistance spending, including the identification of areas of potential duplication, waste, fraud, or abuse;</text></paragraph><paragraph id="H5ACD10DF52674664B2FEF4AD6F86CB22"><enum>(2)</enum><text>recommendations on how Federal departments and agencies can improve transparency in and better account for disaster assistance spending to ensure that funds are spent in an effective and efficient manner; and</text></paragraph><paragraph id="HB30EEDFC48AF4494BC9A97C3174ACD69"><enum>(3)</enum><text>an evaluation of the effectiveness and equity of the current system of cost-sharing with respect to disaster assistance spending, including the system’s effectiveness in reducing the Federal cost of disaster assistance and promoting non-Federal investment in disaster recovery, mitigation, and preparedness.</text></paragraph></subsection><subsection id="HFB933F332C7E40E59CCA97FD5FF3FFC4"><enum>(c)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text><paragraph id="H47A004DC71824DA39B0F7A02190D02F9"><enum>(1)</enum><header>Disaster</header><text display-inline="yes-display-inline">The term <term>disaster</term> means any natural, accidental, or manmade catastrophe in any part of the United States, including a territory or possession of the United States, which causes, or which may cause, substantial damage or injury, without regard to whether such catastrophe results in a declaration of a major disaster or emergency under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>).</text></paragraph><paragraph id="H51F8854709C844DD9173468B7AAD52BD"><enum>(2)</enum><header>Disaster assistance</header><text>The term <term>disaster assistance</term> means any Federal activity, including the provision of financial assistance, carried out to assist a public or private entity affected by the occurrence of a disaster.</text></paragraph></subsection></section></legis-body></bill>
