R. 3346</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131028">October 28, 2013</action-date><action-desc><sponsor name-id="L000563">Mr. Lipinski</sponsor> (for himself, <cosponsor name-id="A000055">Mr. Aderholt</cosponsor>, and <cosponsor name-id="S001170">Ms. Shea-Porter</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/83">chapter 83</external-xref> of title 41, United States Code, to increase the requirement for American-made content, to strengthen the waiver provisions, and for other purposes.</official-title></form><legis-body id="H94D945FA200747AD8898CE7F6CB20929" style="OLC"><section id="H43D314A92D2B42DDAB137279D601A721" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Buy American Improvement Act of 2013</short-title></quote>.</text></section><section id="HAA2F832643C94FE98068414F836B2392"><enum>2.</enum><header>Strengthening and simplifying Federal procurement policies</header><subsection id="H44AEB1D0653B48A996F8AE22CE9249C0"><enum>(a)</enum><header>In general</header><text>Not later than one year after the date of the enactment of this Act, the Administrator for Federal Procurement Policy, in consultation with the Federal Acquisition Regulatory Council, shall promulgate regulations to standardize and simplify how Federal agencies comply with, report on, and enforce <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/83">chapter 83</external-xref> of title 41, United States Code (commonly known as the <act-name>Buy American Act</act-name>). The regulations shall include, at a minimum, the following:</text><paragraph id="HA7FF4FFD96204464ABB8F05C26C32646"><enum>(1)</enum><text>Guidelines for determining, for the purposes of applying sections 8302(a) and 8303(b)(3) of such title, the circumstances under which the acquisition of articles, materials, or supplies mined, produced, or manufactured in the United States is inconsistent with the public interest.</text></paragraph><paragraph id="H48D0AC3F4FD941C1B4AF35AD0FBCE615"><enum>(2)</enum><text display-inline="yes-display-inline">Uniform procedures for collecting, reporting, and making publicly available information about waivers under chapter 83 of such title, including—</text><subparagraph id="HB3BDBF0CFBCA4332B1D0D66AF03C9AE5"><enum>(A)</enum><text>procedures for making a request for a waiver publicly available before granting the waiver; and</text></subparagraph><subparagraph id="H78D3A5A79E244261B5E5DE75E80B0EB7"><enum>(B)</enum><text>procedures for providing the rationale for why a waiver is granted.</text></subparagraph></paragraph><paragraph id="H98FE411D1919410288C94E7F473D48FC"><enum>(3)</enum><text>Rules to ensure that projects are not disaggregated for purposes of avoiding the applicability of the requirements under chapter 83 of such title to such larger project.</text></paragraph><paragraph id="HB38C96010E1041D19FCD756B1FF972A6"><enum>(4)</enum><text>Procedures for investigating waiver requests.</text></paragraph><paragraph id="H6CC47901C472471388E7BF0A562E2827"><enum>(5)</enum><text>Rules for evaluating the percentage of domestic content in a manufactured end product.</text></paragraph></subsection><subsection id="H72CC6F81AD8A4BB59F444C4B89F436BD"><enum>(b)</enum><header>Guidelines relating to inconsistency with public interest</header><text>In the guidelines developed under subsection (a)(1), the Administrator shall consider any significant decrease in employment in the United States resulting from the granting of waivers to be inconsistent with the public interest and seek to minimize—</text><paragraph id="H7FCE7B9E9ED941209C062FCB0299B1AA"><enum>(1)</enum><text display-inline="yes-display-inline">the granting of waivers that would result in a decrease in employment in the United States in both the short- and long-term; and</text></paragraph><paragraph id="HB0694153820944D7BB90AA4DF39B7068"><enum>(2)</enum><text>the granting of waivers for procurement of articles, materials, or supplies mined, produced, or manufactured in a foreign country with which the United States does not have a relevant trade agreement and which has a government that maintains, in regard to government procurement, a significant and persistent pattern or practice of discrimination against products produced in the United States.</text></paragraph></subsection><subsection id="H2FC376BAB3D141E2A52B81793A626594"><enum>(c)</enum><header>Procedures relating to the publication of requests for waivers</header><text display-inline="yes-display-inline">In the procedures developed under subsection (a)(2)(A), the Administrator shall require the head of a Federal agency, after receiving a request for a waiver, to complete each of the following:</text><paragraph id="H14D5C4639A574E1DAF36CE964869B326"><enum>(1)</enum><text>Publish the request for a waiver on a publicly available website of the agency in an easily identifiable location within 15 days after receiving such request.</text></paragraph><paragraph commented="no" id="H603A7CEBA4254A8AA7A87835E4D734E4"><enum>(2)</enum><text>A waiver may not be issued before the expiration of the 15-day period beginning on the date on which the request for waiver is published pursuant to paragraph (1) to provide the public an opportunity for notice and comment.</text></paragraph></subsection><subsection id="HEAA362CFD8544ABAA54186A64CC9E29C"><enum>(d)</enum><header>Procedures relating to the publication of waivers granted</header><text display-inline="yes-display-inline">In the procedures developed under subsection (a)(2)(B), the Administrator shall require the head of a Federal agency to publish the determination for why a waiver was granted and the rationale for such determination in the Federal Register and on a publicly available website of the agency in an easily identifiable location not later than 30 days after the head of the agency determines to issue such waiver.</text></subsection><subsection id="H30D6C698A23A45329E054F95AC13666D"><enum>(e)</enum><header>Rules relating to domestic content</header><text>In the rules developed under subsection (a)(5), the Administrator shall not consider as domestic content components of foreign origin of the same class or kind as those that are not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.</text></subsection><subsection id="HF68B3094C1374B649F26560C84F20EB4"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HFA7A6A90A6544C50A12E3E13B4D63951"><enum>(1)</enum><header>Federal agency</header><text display-inline="yes-display-inline">The term <term>Federal agency</term> means any executive agency (as defined in <external-xref legal-doc="usc" parsable-cite="usc/41/133">section 133</external-xref> of title 41, United States Code) or any establishment in the legislative or judicial branch of the Federal Government.</text></paragraph><paragraph id="HE5610A3BAA634E0AAA550D530431395C"><enum>(2)</enum><header>Relevant trade agreement</header><text>The term <term>relevant trade agreement</term> means—</text><subparagraph id="H6BE97948F9914EC2A8DA344366A2A648"><enum>(A)</enum><text>a reciprocal defense procurement memorandum of understanding, as described in <external-xref legal-doc="usc" parsable-cite="usc/41/8304">section 8304</external-xref> of title 41, United States Code;</text></subparagraph><subparagraph id="HAA6B9D40695B410CADB649556E06DDA7"><enum>(B)</enum><text>any trade agreement for which the President, or his delegate, has issued a blanket waiver under section 301 of the Trade Agreements Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/19/2511">19 U.S.C. 2511</external-xref>); and</text></subparagraph><subparagraph id="H8E656D0589EA46F9840652AEB3F3FEB7"><enum>(C)</enum><text>any trade agreement described in subpart 25.4 of the Federal Acquisition Regulation.</text></subparagraph></paragraph><paragraph id="H7B6772CDA3CE479795FA9F26D30DE591"><enum>(3)</enum><header>Waiver</header><text display-inline="yes-display-inline">The term <term>waiver</term> means, with respect to the acquisition of an article, material, or supply for public use, the inapplicability of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/83">chapter 83</external-xref> of title 41, United States Code, to the acquisition by reason of any of the following determinations:</text><subparagraph id="H4C38F8C1FC064F4E84E0441904F811D6"><enum>(A)</enum><text>A determination by the head of the Federal agency concerned that the acquisition is inconsistent with the public interest.</text></subparagraph><subparagraph id="HACA126D7BB494AEDA9BEC8FD8A07D460"><enum>(B)</enum><text>A determination by the head of the Federal agency concerned that the cost of the acquisition is unreasonable.</text></subparagraph><subparagraph id="HB2A8E0F03AD24F46B427360867F3A23E"><enum>(C)</enum><text>A determination by the head of the Federal agency concerned that the article, material, or supply is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.</text></subparagraph></paragraph></subsection></section><section id="HF58F42CC343848B9858B8C4D844A20CD"><enum>3.</enum><header>Increasing transparency and accountability in Federal procurement</header><text display-inline="no-display-inline">Subsection (b) of <external-xref legal-doc="usc" parsable-cite="usc/41/8302">section 8302</external-xref> of title 41, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H26F733B7BBB24DE4B816876E68586A66" style="USC"><subsection id="H7B20EC92A4D04ECDAD1564A3B42970E9"><enum>(b)</enum><header>Reports</header><paragraph id="HB339BBB941394727A140C8A02693F56E"><enum>(1)</enum><header>In general</header><subparagraph id="HA01CAE4BD6494452BB3EBC7FEC0041AA"><enum>(A)</enum><header>Agency report</header><text display-inline="yes-display-inline">Not later than 120 days after the end of each of fiscal years 2013 through 2018, the head of each Federal agency shall submit to the Administrator for Federal Procurement Policy a report on the amount of the acquisitions made by the agency in that fiscal year of articles, materials, or supplies purchased from entities that manufacture the articles, materials, or supplies outside of the United States. A separate report is not required by a Federal agency under this subparagraph if such agency has already submitted the information required in such report for a fiscal year through the Federal Procurement Data System (as referred to in section 1122(a)(4)(A)) or another uniform comprehensive system prescribed by the Federal Acquisition Regulation.</text></subparagraph><subparagraph commented="no" id="H7FC73F6ECB8A45218E1D08B933655783"><enum>(B)</enum><header>Consolidated report</header><text display-inline="yes-display-inline">Not later than 180 days after the end of each of fiscal years 2011 through 2016, the Administrator for Federal Procurement Policy, in consultation with the Administrator of General Services, shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives a consolidated report that includes each report and any information submitted pursuant to subparagraph (A) and the total amount of acquisitions made by Federal agencies in the relevant fiscal year of articles, materials, or supplies purchased from entities that manufacture or produce the articles, materials, or supplies outside of the United States.</text></subparagraph></paragraph><paragraph id="H0A913DDDF31B4BE2BB44A69148EC9BC4"><enum>(2)</enum><header>Contents of report</header><text display-inline="yes-display-inline">The report required by paragraph (1)(A) shall separately include, for the fiscal year covered by the report—</text><subparagraph id="H9E712760F1D3444F9A7D841CBEB08B52"><enum>(A)</enum><text display-inline="yes-display-inline">the dollar value of any articles, materials, or supplies that were manufactured or produced outside the United States, in the aggregate and by country;</text></subparagraph><subparagraph id="HC829F373E1FE4C599A81F37CD9EDF587"><enum>(B)</enum><text>an itemized list of all waivers granted with respect to such articles, materials, or supplies under this chapter, and the country where such articles, materials, or supplies were manufactured or produced;</text></subparagraph><subparagraph id="H85455AA5ED7B49C4BB0CD940640D6AD9"><enum>(C)</enum><text display-inline="yes-display-inline">if any articles, materials, or supplies were acquired from entities that manufacture or produce articles, materials, or supplies outside the United States due to an exception (that is not the micro-purchase threshold exception described under subsection (a)(2)(C)), the specific exception that was used to purchase such articles, materials, or supplies;</text></subparagraph><subparagraph id="HFFD621879A8648C3981A6FE23611012A"><enum>(D)</enum><text display-inline="yes-display-inline">if any articles, materials, or supplies were acquired from entities that manufacture or produce articles, materials, or supplies outside the United States pursuant to a relevant trade agreement, a citation to such agreement; and</text></subparagraph><subparagraph id="H37613E9EAB334DD7A0C594BDF2AEBFB5"><enum>(E)</enum><text>a summary of—</text><clause id="H388A2477D3594816AFB1DBFCB3143EAD"><enum>(i)</enum><text>the total procurement funds expended on articles, materials, and supplies manufactured or produced inside the United States;</text></clause><clause id="HE60A105C51FD4691B7E2EE6AA91C4CD6"><enum>(ii)</enum><text>the total procurement funds expended on articles, materials, and supplies manufactured or produced outside the United States; and</text></clause><clause id="H370853D5038B4766B8F42867C61A9051"><enum>(iii)</enum><text display-inline="yes-display-inline">the total procurement funds expended on articles, materials, and supplies manufactured or produced outside the United States for each country that manufactured or produced such articles, materials, and supplies.</text></clause></subparagraph></paragraph><paragraph id="HD14AC1572E424D659DCF0368D936FD21"><enum>(3)</enum><header>Public availability</header><text display-inline="yes-display-inline">Not later than 180 days after the end of the relevant fiscal year, the Administrator for Federal Procurement Policy shall make the consolidated report described under paragraph (1)(B) publicly available on a website.</text></paragraph><paragraph id="H057E559D4FD84D05AE9E6294CE93DCEC"><enum>(4)</enum><header>Exception for intelligence community</header><text display-inline="yes-display-inline">This subsection shall not apply to acquisitions made by an agency, or component of an agency, that is an element of the intelligence community as specified in, or designated under, section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HB370000E6890408DB7CCCCABC49597A4"><enum>4.</enum><header>Strengthening the Buy American Act</header><subsection id="H0963EF6BCB204793AFB31D8420C4DAE5"><enum>(a)</enum><header>Requirements for waivers</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/41/8302">Section 8302</external-xref> of title 41, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H86097E88EDF2437989C685F585DB6F4C" style="USC"><subsection id="H8E0B31417C6840F09681C6171C1B9C50"><enum>(c)</enum><header>Special rules</header><text display-inline="yes-display-inline">The following rules apply in carrying out the provisions of subsection (a):</text><paragraph id="H7BD2D199716D4B249BA0BFA1E64D5F12"><enum>(1)</enum><header>Calculation of domestic and non-domestic bids</header><subparagraph id="HFC9F07E813EE445C82534D72836085CE"><enum>(A)</enum><header>Exclusion of start-up costs in calculating cost of bid</header><text>When comparing bids between domestic entities and non-domestic entities, costs related to the start-up of a project shall be excluded from a domestic bid.</text></subparagraph><subparagraph id="HC36DFFCE77284A85B9D5034BBB9CDF8F"><enum>(B)</enum><header>Unreasonable cost determination</header><clause id="H49F298268D2E4E1B8F92A275908BB91B"><enum>(i)</enum><header>In general</header><text>The head of a Federal agency shall not determine the cost of acquiring articles, materials, or supplies produced or manufactured in the United States to be unreasonable under subsection (a) unless the acquisition of such articles, materials, or supplies would increase the cost of the overall project by more than 25 percent.</text></clause><clause id="H4C79EE9660544368BAC02B8F2ACE2E95"><enum>(ii)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subparagraph shall be construed as reducing the percentage increase required as of the date of the enactment of the <short-title>Buy American Improvement Act of 2013</short-title> for a determination of unreasonable cost applicable to projects under Department of Defense contracts.</text></clause></subparagraph></paragraph><paragraph id="H43B631DBBA5C4794BCB247CD41B7EA09"><enum>(2)</enum><header>Use outside the united states</header><subparagraph id="HBF75AC307EE845FC98F8D376267C2365"><enum>(A)</enum><header>In general</header><text>Subsection (a) shall apply without regard to whether the articles, materials, or supplies to be acquired are for use outside the United States if the articles, materials, or supplies are not needed on an urgent basis or if they are acquired on a regular basis.</text></subparagraph><subparagraph commented="no" id="HA886DDC2F5E442BFA00F2D9E5CA91786"><enum>(B)</enum><header>Cost analysis</header><text>In any case in which the articles, materials, or supplies are to be acquired for use outside the United States and are not needed on an urgent basis, before entering into a contract an analysis shall be made of the difference in the cost of acquiring the articles, materials, or supplies from a company manufacturing the articles, materials, or supplies in the United States (including the cost of shipping) and the cost of acquiring the articles, materials, or supplies from a company manufacturing the articles, materials, or supplies outside the United States (including the cost of shipping).</text></subparagraph></paragraph><paragraph id="H3568B959636445B8A934275746ED4528"><enum>(3)</enum><header>Domestic availability</header><text>The head of a Federal agency may not make a determination under subsection (a) that an article, material, or supply is not mined, produced, or manufactured, as the case may be, in the United States in sufficient and reasonably available commercial quantities and of satisfactory quality, unless the head of the agency has determined that—</text><subparagraph id="H6346EFEA8DD445C4A23D0B37D419B2FD"><enum>(A)</enum><text>domestic production cannot be initiated without significantly delaying the project for which the article, material, or supply is to be procured; and</text></subparagraph><subparagraph id="HFFC7AD99F8B7490FB1E99AA0E14FD9F3"><enum>(B)</enum><text>a substitutable article, material, or supply is not available in reasonable quantities and of satisfactory quality from a company in the United States.</text></subparagraph></paragraph><paragraph id="H292279B70A6645379A7F448F5C773436"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H0F8D98A8A07A42D5ADC642056FA74F2F"><enum>(A)</enum><header>Exception</header><text>The term <term>exception</term> means, with respect to the acquisition of an article, material, or supply for public use, the inapplicability of chapter 83 to the acquisition by reason of any of the following:</text><clause commented="no" id="HBA15EA3EE1A0446786FA6784EA828DA5"><enum>(i)</enum><text>Use outside the United States (described in section 8302(a)(2)(A)).</text></clause><clause commented="no" id="HC6862257F576431CBBF32A9DC3223027"><enum>(ii)</enum><text>Procured under a contract with an award value that is not more than the micro-purchase threshold (described in section 8302(a)(2)(C)).</text></clause><clause commented="no" id="H395DA712E8334C65AC505F19B6B3D791"><enum>(iii)</enum><text>Specifically excepted for information technology (as defined in <external-xref legal-doc="usc" parsable-cite="usc/40/11101">section 11101</external-xref> of title 40) that is a commercial item (as defined in section 103).</text></clause><clause commented="no" id="H8E1A588AB42747A893A0E899DA098196"><enum>(iv)</enum><text>A relevant trade agreement.</text></clause></subparagraph><subparagraph commented="no" id="H0748BBC354584BCAB485DBA0C79C639D"><enum>(B)</enum><header>Waiver</header><text display-inline="yes-display-inline">The term <term>waiver</term> means, with respect to the acquisition of an article, material, or supply for public use, the inapplicability of this chapter to the acquisition by reason of any of the following determinations:</text><clause commented="no" id="H0A0DD733BBBD494698FB5BB10F981303"><enum>(i)</enum><text>A determination by the head of the Federal agency concerned that the acquisition is inconsistent with the public interest.</text></clause><clause commented="no" id="H4714C685DD584E4B97B529798FB94E56"><enum>(ii)</enum><text>A determination by the head of the Federal agency concerned that the cost of the acquisition is unreasonable.</text></clause><clause commented="no" id="HA8767EF2589B46A1871CA8A33130FB19"><enum>(iii)</enum><text>A determination by the head of the Federal agency concerned that the article, material, or supply is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0FF5FC1BA0DB4872939AF5B60D420704"><enum>(b)</enum><header>Definitions; increasing domestic content requirement</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/41/8301">Section 8301</external-xref> of title 41, United States Code, is amended—</text><paragraph id="HEA0E6E6C97874A54BF7D4F3C4952A704"><enum>(1)</enum><text>by adding at the end the following new paragraphs:</text><quoted-block display-inline="no-display-inline" id="H629097A021AD4CBCA1677A7EF7D240C0" style="USC"><paragraph id="HF98094E940B14837B9168687FBBA8C14"><enum>(3)</enum><header>Federal agency</header><text display-inline="yes-display-inline">The term <term>Federal agency</term> means any executive agency (as defined in section 133) or any establishment in the legislative or judicial branch of the Federal Government.</text></paragraph><paragraph id="H4572DDF5B8FB4F099D4C3388183A36E1"><enum>(4)</enum><header>Relevant trade agreement</header><text>The term <term>relevant trade agreement</term> means—</text><subparagraph id="H092F8DF8E62B40758777497ACEDFFFCF"><enum>(A)</enum><text>a reciprocal defense procurement memorandum of understanding, as described in <external-xref legal-doc="usc" parsable-cite="usc/41/8304">section 8304</external-xref> of title 41, United States Code;</text></subparagraph><subparagraph id="HE59604809DC8405C996206D861AF7A9D"><enum>(B)</enum><text>any trade agreement for which the President, or his delegate, has issued a blanket waiver under section 301 of the Trade Agreements Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/19/2511">19 U.S.C. 2511</external-xref>); and</text></subparagraph><subparagraph id="HCF65EC6C8F8B4F338D48BF31BD9FCB1C"><enum>(C)</enum><text>any trade agreement described in subpart 25.4 of the Federal Acquisition Regulation.</text></subparagraph></paragraph><paragraph id="H86553A34E3704905AC0098C5E791A26A"><enum>(5)</enum><header>Substantially all</header><text>Articles, materials, or supplies shall be treated as made substantially all from articles, materials, or supplies mined, produced, or manufactured in the United States, if the cost of the domestic components of such articles, materials, or supplies exceeds 75 percent of the total cost of all components of such articles, materials, or supplies.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H2EF24EAEF5714D2CACBF67B1BC32C258"><enum>(2)</enum><text display-inline="yes-display-inline">by reordering paragraphs (1) and (2) and the paragraphs added by paragraph (1) of this subsection in alphabetical order based on the headings of such paragraphs and renumbering such paragraphs as so reordered.</text></paragraph></subsection><subsection id="H9517F9EA2C944D2CA719762CE873548B"><enum>(c)</enum><header>Conforming amendments</header><text>Title 41, United States Code, is 1908(b)(2)(A)</external-xref> of title 41, United States Code, is amended by striking <quote>chapter 67</quote> and inserting <quote>chapters 67 and 83</quote>.</text></subsection></section><section commented="no" id="HA4F68F6B4F1848A298FC8B2E7C02ADEE"><enum>5.</enum><header>GAO report and recommendation</header><text display-inline="no-display-inline">Not later than one year after the date of the enactment of this Act, the Comptroller General shall report to Congress on the extent to which, in each of fiscal years 2009, 2010, 2011, 2012, and 2013, articles, materials, or supplies acquired by the Federal Government were manufactured, mined, or produced outside of the United States. Such report shall include for each Federal agency the following:</text><paragraph commented="no" id="HF108B8AF3F254AA2B6C16A7C7B5A07B6"><enum>(1)</enum><text display-inline="yes-display-inline">A summary of total procurement funds expended on articles, materials, and supplies manufactured—</text><subparagraph id="HC6AECFFFFA874CE1913C1A07300A12CF"><enum>(A)</enum><text>inside the United States;</text></subparagraph><subparagraph commented="no" id="H895F6432166C4ACD8C7CC6834A08B01F"><enum>(B)</enum><text>outside the United States; and</text></subparagraph><subparagraph commented="no" id="H9BB5659008AE4036AAC51E7321096A2B"><enum>(C)</enum><text>outside the United States—</text><clause id="H151149729F8A498DA57F737A0A6EA6DF"><enum>(i)</enum><text>under each type of waiver (as defined in section 2(f) of this Act);</text></clause><clause id="HB78FFECEBD07496BB5F0BA297FCF0365"><enum>(ii)</enum><text>under each category of exception (as defined in <external-xref legal-doc="usc" parsable-cite="usc/41/8301">section 8301</external-xref> of title 41, United States Code, as added by section 4(b)(1) of this Act); and</text></clause><clause id="H1A3D03CEF7944B82B383ACAB997F5DD7"><enum>(iii)</enum><text>for each country that manufactured or produced such articles, materials, and supplies.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H31368E59E5A9421EAB6126E0AD37C5B7"><enum>(2)</enum><text display-inline="yes-display-inline">An analysis of the impact of eliminating the exception for acquisitions for information technology (as defined in <external-xref legal-doc="usc" parsable-cite="usc/40/11101">section 11101</external-xref> of title 40, United States Code) that is a commercial item (as defined in <external-xref legal-doc="usc" parsable-cite="usc/41/103">section 103</external-xref> of title 41, United States Code).</text></paragraph></section><section id="HD3B66CF6336A419A9D5572062B6AE305"><enum>6.</enum><header>United States Obligations under international agreements</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall be applied in a manner consistent with United States obligations under international agreements.</text></section></legis-body></bill>
