which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, to update certain procedures applicable to commerce in firearms and remove certain Federal restrictions on interstate firearms transactions.</official-title></form><legis-body id="HA318B15E7869493283C918506BFF7ACC" style="OLC"><section display-inline="no-display-inline" id="HE58492A22A7D488D9FD531238E1972C3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <short-title><quote><short-title>Firearms Interstate Commerce Reform Act</short-title></quote></short-title>.</text></section><section id="HD4BD8BB040FE4716907B12550CCBD99B"><enum>2.</enum><header>Authority to conduct interstate firearms transactions</header><subsection id="H3C0E03631EDE48199DF3F50E3240D664"><enum>(a)</enum><header>Firearms dispositions</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/922">Section 922(b)(3)(A)</external-xref> of title 18, United States Code, is amended—</text><paragraph display-inline="no-display-inline" id="H568A43327CE84FCF844528380C3A7658"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote><short-title>rifle or shotgun</short-title></quote> and inserting <quote><short-title>firearm</short-title></quote>;</text></paragraph><paragraph id="HBB67CCFB2B564EAAB7A36E7CE651B475"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote><short-title>located</short-title></quote> and inserting <quote><short-title>located or temporarily located</short-title></quote>; and</text></paragraph><paragraph id="H38486844DDC1467592330D6369C7E428"><enum>(3)</enum><text>by striking <quote><short-title>both such States</short-title></quote> and inserting <quote><short-title>the State in which the transfer is conducted and the State of residence of the transferee</short-title></quote>.</text></paragraph></subsection><subsection id="H42D9F995E385433DBF9D8411808FB9A8"><enum>(b)</enum><header>Dealer location</header><text>Section 923 of such title is amended—</text><paragraph id="H96D30BD4AD204079867B479556056422"><enum>(1)</enum><text>in subsection (j)—</text><subparagraph id="HB1598FF108484498AF12C04F53FC4DE8"><enum>(A)</enum><text>in the first sentence, by striking <quote><short-title>, and such location is in the State which is specified on the license</short-title></quote>; and</text></subparagraph><subparagraph id="H9BFD768B644C4E78A70D5E9588374AD2"><enum>(B)</enum><text>in the last sentence—</text><clause id="H2E1140BC70FB49D7A0708DA7949FFD90"><enum>(i)</enum><text>by inserting <quote><short-title>transfer,</short-title></quote> after <quote><short-title>sell,</short-title></quote>; and</text></clause><clause id="H878D2A9CC83349F7A93C74821B4D33B8"><enum>(ii)</enum><text>by striking all that follows <quote><short-title>Act</short-title></quote> and inserting a period; and</text></clause></subparagraph></paragraph><paragraph id="HFF2BC647967F437B802461AAC61080EE"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HE14BFB7F0E9D47BF90A130F7C377BFB2" style="OLC"><subsection id="H5BB27185E8FA438583D4B07064A0B38F"><enum>(m)</enum><text display-inline="yes-display-inline">Nothing in this chapter shall be construed to prohibit the sale, transfer, delivery, or other disposition of a firearm or ammunition—</text><paragraph id="H6AE860C5EA914BC5AC47878E96922A9E"><enum>(1)</enum><text display-inline="yes-display-inline">by a person licensed under this chapter to another person so licensed, at any location in any State; or</text></paragraph><paragraph id="HC60007875C4C45B08C35309E76C8B811"><enum>(2)</enum><text display-inline="yes-display-inline">by a licensed importer, licensed manufacturer, or licensed dealer to a person not licensed under this chapter, at a temporary location described in subsection (j) in any State.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HD03157423C5F433EA77F5498A0F04CAD"><enum>(c)</enum><header>Residence of united states officers</header><text display-inline="yes-display-inline">Section 921 of such title is amended by striking subsection (b) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H032351E40F26479D8F507B3F69206646" style="OLC"><subsection id="H2A29F184F8FB461E8A080E374FBF9B35"><enum>(b)</enum><text display-inline="yes-display-inline">For purposes of this chapter:</text><paragraph display-inline="no-display-inline" id="HACE4CF6E54B4403D8E0F1DCD6F7FD614"><enum>(1)</enum><text display-inline="yes-display-inline">A member of the Armed Forces on active duty, or a spouse of the member, is a resident of—</text><subparagraph id="HEEA16234B0904997B625B7366651E026"><enum>(A)</enum><text>the State in which the person maintains legal residence;</text></subparagraph><subparagraph id="H169BD290BDEA4AAD920191CAF477328E"><enum>(B)</enum><text>the State in which the permanent duty station of the member is located; and</text></subparagraph><subparagraph id="H79FA95F6ECE84AC19BEBEBCE280D0373"><enum>(C)</enum><text>the State in which the member maintains a place of abode from which the member commutes each day to the permanent duty station.</text></subparagraph></paragraph><paragraph id="H4C7D2EA3FCA940EABA1FD29E77F3BCE6"><enum>(2)</enum><text display-inline="yes-display-inline">An officer or employee of the United States (other than a member of the Armed Forces) stationed outside the United States for a period exceeding one year, or a spouse residing with such an officer or employee, is a resident of the State in which the person maintains legal residence.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
