R. 3329</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131023">October 23, 2013</action-date><action-desc><sponsor name-id="L000569">Mr. Luetkemeyer</sponsor> (for himself, <cosponsor name-id="C001095">Mr. Cotton</cosponsor>, <cosponsor name-id="M001191">Mr. Murphy of Florida</cosponsor>, <cosponsor name-id="Q000023">Mr. Quigley</cosponsor>, and <cosponsor name-id="K000382">Ms. Kuster</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To enhance the ability of community financial institutions to foster economic growth and serve their communities, boost small businesses, increase individual savings, and for other purposes.</official-title></form><legis-body id="H3A41DE3B06D146D4A19640A1D5A4ECBA" style="OLC"><section id="H78488999372C440FBC461F2C185E6D7B" section-type="section-one"><enum>1.</enum><header>Changes required to small bank holding company policy statement on assessment of financial and managerial factors</header><subsection id="H4E90B7B118534CEBAB723D28AB84D23E"><enum>(a)</enum><header>In general</header><text>Before the end of the 6-month period beginning on the date of the enactment of this Act, the Board of Governors of the Federal Reserve System shall publish in the Federal Register proposed revisions to the Small Bank Holding Company Policy Statement on Assessment of Financial and Managerial Factors (12 C.F.R. part 225–appendix C) that provide that the policy shall apply to bank holding companies and savings and loan holding companies which have pro forma consolidated assets of less than $1,000,000,000 and that—</text><paragraph id="HF3CA9DC594F54B0A82D99812C22896FB"><enum>(1)</enum><text>are not engaged in any nonbanking activities involving significant leverage; and</text></paragraph><paragraph id="H6B10A83A65C44B248B50D904C2533DBB"><enum>(2)</enum><text>do not have a significant amount of outstanding debt that is held by the general public.</text></paragraph></subsection><subsection id="HA50C072A9F3B4422B6392ACBB1646B2E"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 171(b)(5)(C) of the Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5371">12 U.S.C. 5371(b)(5)(C)</external-xref>) is amended by inserting <quote>or small savings and loan holding company</quote> after <quote>any small bank holding company</quote>.</text></subsection><subsection id="HF43578FD90A744079E5C7F5639E6BA21"><enum>(c)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act or the amendments made by this Act may be construed as limiting the authority of the Board of Governors of the Federal Reserve System to exclude a bank holding company or a savings and loan holding company from the policy statement described under subsection (a), if such action is warranted for supervisory purposes.</text></subsection><subsection id="H137AF9068F154EAA956C2A7AE910B9C2"><enum>(d)</enum><header>Definitions</header><text>For purposes of this section:</text><paragraph id="HA959BA6E8EE541AE89123C6B38D5C65B"><enum>(1)</enum><header>Bank holding company</header><text display-inline="yes-display-inline">The term <term>bank holding company</term> has the meaning given that term under section 2 of the Bank Holding Company Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/12/1841">12 U.S.C. 1841</external-xref>).</text></paragraph><paragraph id="HDF81EE41BDB6468F843201015AA6E6DD"><enum>(2)</enum><header>Savings and loan holding company</header><text display-inline="yes-display-inline">The term <term>savings and loan holding company</term> has the meaning given that term under section 10(a) of the Home Owners' Loan Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1467a">12 U.S.C. 1467a(a)</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
