which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure appropriate coverage of ventricular assist devices under the Medicare program under title XVIII of the Social Security Act, and for other purposes.</official-title></form><legis-body id="H189DDF4DA29640CB947FC0C1A04B7197" style="OLC"><section id="HDF0DBA82B4F940E6A10A2C32CAA3835F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Ventricular Assist Device Access Act of 2013</short-title></quote>.</text></section><section id="H2F13026785884D2094F3ADA2B1AF2215"><enum>2.</enum><header>Findings; purpose</header><subsection id="HE2326BE9D1604EF698820CDC76ACDECA"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text><paragraph id="HD4DF9760540541EE9AA6B416F6A1EFE8"><enum>(1)</enum><text display-inline="yes-display-inline">Ventricular assistance devices are mechanical blood pumps that surgeons attach to a damaged or weakened native heart to assist in pumping blood.</text></paragraph><paragraph id="H26958E2FD88144568A917A51FEA120ED"><enum>(2)</enum><text>Under its coverage policy as of the date of the enactment of this Act, the Medicare program covers ventricular assist devices for Medicare beneficiaries that meet certain criteria after open-heart surgery, that are approved and listed as candidates for heart transplant by a Medicare-approved heart transplant center, and for those who are not eligible for a heart transplant.</text></paragraph><paragraph id="H07170BBE5AD64E12B5CADA6C593D9018"><enum>(3)</enum><text display-inline="yes-display-inline">The Medicare program does not currently cover Medicare beneficiaries for ventricular assist devices who are—</text><subparagraph id="HD8A1789CD48E4C29AB1A569999B0441A"><enum>(A)</enum><text>undergoing an evaluation to determine their candidacy for heart transplantation; or</text></subparagraph><subparagraph id="H6150F824A3FA41C0A76E2544F366E2FF"><enum>(B)</enum><text>potential heart transplant candidates, but who are currently not eligible for heart transplantation because of a contraindication that may be favorably modified by the use of a ventricular assist device.</text></subparagraph></paragraph><paragraph id="HCBD6015D5DD04B2E988396238BBA8782"><enum>(4)</enum><text>Approximately 40 percent of patients who receive a ventricular assist device are not eligible for a heart transplant initially, but may become eligible as the ventricular support improves their overall health.</text></paragraph></subsection><subsection id="H34D1DE4E369F4C06A1C4C148A909E2CF"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to ensure Medicare beneficiaries with heart failure have appropriate access to ventricular assist devices.</text></subsection></section><section id="H577DEB922AF448D6AB075499B4FDA187"><enum>3.</enum><header>Revision of Medicare ventricular assist device national coverage policy</header><subsection id="H36763E9602F8441792A95636A1A2FF0F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding section 1862(a)(1)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(a)(1)(A)</external-xref>) or any other provision of law, the Secretary of Health and Human Services (in this section referred to as the <term>Secretary</term>) shall revise the Medicare national coverage determination (as defined in section 1869(f)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ff">42 U.S.C. 1395ff(f)(1)(B)</external-xref>)) relating to coverage of ventricular assist devices to extend the coverage of such devices under title XVIII of the Social Security Act applied as of the date of the enactment of this Act with respect to individuals approved for heart transplantation to also apply to—</text><paragraph id="HC27BB19B84224493952B215CB6882BAE"><enum>(1)</enum><text display-inline="yes-display-inline">individuals who are undergoing an evaluation to determine candidacy for heart transplantation; and</text></paragraph><paragraph id="H867D4606EA2A495288BBB941363F9B2C"><enum>(2)</enum><text display-inline="yes-display-inline">individuals who would be potential heart transplant candidates, but are not so eligible because of a contraindication that may be favorably modified by the use of a ventricular assist device.</text></paragraph></subsection><subsection id="H861BB6B53B7E4232809662A648A0AD05"><enum>(b)</enum><header>Construction</header><text>Nothing in this section shall be construed—</text><paragraph id="H8E4940BAAF7F4A41A3E89E19DA2B049A"><enum>(1)</enum><text>to limit coverage of ventricular assist devices for Medicare beneficiaries who meet the Medicare criteria for coverage of ventricular assist devices as of the date of enactment of this Act; or</text></paragraph><paragraph id="H97721635589C4BEE81B116B3FA2BBA30"><enum>(2)</enum><text>as preventing the Secretary from expanding its coverage decision beyond the coverage required under this section.</text></paragraph></subsection><subsection id="H3CBB1CE9D6554497BF6883F9903E73D3"><enum>(c)</enum><header>Revision of national coverage decision; effective date</header><paragraph id="HBBF63B5786444070A413CA12ADC9192C"><enum>(1)</enum><header>Revision of national coverage decision</header><text display-inline="yes-display-inline">The Secretary shall use the processes described in section 1862(l) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(l)</external-xref>) to revise its national coverage determination relating to ventricular assist devices to incorporate the requirements of this section.</text></paragraph><paragraph id="HAF577378FC23401689307183BB1781F2"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The revised coverage decision described in paragraph (1) shall apply to ventricular assist devices furnished on or after the date that is 30 days after the date of the enactment of this Act, regardless of the date on which the Secretary completes the process required under such paragraph.</text></paragraph></subsection></section></legis-body></bill>
