which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the National Flood Insurance Act of 1968 to allow the repair, expansion, and construction, without elevation, of agricultural structures located in special flood hazard zones, and for other purposes.</official-title></form><legis-body id="HF581D323E40D4783971002A250FCFE03" style="OLC"><section id="H0B8AE1A3A73C4E61B75A0E4BCFD805F7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Agricultural Structures Building Act of 2013</short-title></quote>.</text></section><section id="HE8A7134EC4E44F869ECE472C2D78D073"><enum>2.</enum><header>Requirements for State and local land use controls</header><text display-inline="no-display-inline">Subsection (a) of section 1315 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4022">42 U.S.C. 4022(a)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H46FFFFB2F5C642468E1EEA3A3CBDDDC1" style="OLC"><paragraph id="HF23524716867459B916D473A0F1CF7C5"><enum>(3)</enum><header>Allowable local variances for certain agricultural structures</header><subparagraph id="H8E669ABBD58748DD853A82DA17EF9DE0"><enum>(A)</enum><header>Requirement</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, the land use and control measures adopted pursuant to paragraph (1) may not, for purposes of such paragraph, be considered to be inadequate or inconsistent with the comprehensive criteria for land management and use under section 1361 because such measures provide that, in the case of any agricultural structure that is located in an area having special flood hazards, a variance in accordance with subparagraph (B) may be granted, and the Administrator may not suspend a community from participation in the national flood insurance program, or place such a community on probation under such program, because such land use and control measures provide for such a variance.</text></subparagraph><subparagraph id="H5D6044314FD4429E941CC2E12F20842F"><enum>(B)</enum><header>Variance; considerations</header><text display-inline="yes-display-inline">A variance in accordance with this subparagraph is a variance, granted by an appropriate official of the community, from compliance with such land use and control measures that allows for the repair, expansion, or construction of such agricultural structure without elevation of the structure, but only after a determination by such appropriate official that—</text><clause id="H44CEE9E601F84D61BAC8077BBBAA1422"><enum>(i)</enum><text>in the case of new construction, the agricultural structure is subject to base flood elevations of at least three feet;</text></clause><clause id="H2DEEBC09F5F743C58A259E6B162914F5"><enum>(ii)</enum><text>in the case of existing structures, it is not practicable to elevate the repaired or expanded structure to the base flood elevation;</text></clause><clause id="HE413A4072DBA4B7D820E1E3B47BA8F4C"><enum>(iii)</enum><text>the structure is located within 5 miles of active agricultural operations; and</text></clause><clause id="H88DB0FDEC0C246E79DF1AB8C59F26BD9"><enum>(iv)</enum><text>not more than one claim payment exceeding $1,000 has been made for the structure under flood insurance coverage under this title within any period of 10 consecutive years.</text></clause></subparagraph><subparagraph id="H1B0D75B0A6984B49A347B24F63D4FCAC"><enum>(C)</enum><header>Definition of agricultural structure</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term <term>agricultural structure</term> means any agricultural product processing facility, agricultural product storage facility, shed, farmhouse, barn, or other structure which has as its primary purpose supporting the agricultural industry.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H9F1A7C541B6246B18FAC2AA83D2636F3"><enum>3.</enum><header>Premium rates</header><text display-inline="no-display-inline">Section 1308 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H4D31C70AD98649A089013493726364B2" style="OLC"><subsection id="HF2DB828EA728498D85C2EF63ADE03A7D"><enum>(j)</enum><header>Premium rates for certain agricultural structures with variances</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, the chargeable premium rate for coverage under this title for any structure provided a variance pursuant to section 1315(a)(3) shall be the rate that otherwise would apply to such structure if the structure had been repaired, expanded, or constructed before the establishment of the special flood hazard area.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
