R. 3312</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20131023">October 23, 2013</action-date><action-desc><sponsor name-id="B001257">Mr. Bilirakis</sponsor> (for himself, <cosponsor name-id="R000583">Mr. Rooney</cosponsor>, and <cosponsor name-id="R000435">Ms. Ros-Lehtinen</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Administrator of the Federal Emergency Management Agency to allow for monthly installment payments for flood insurance under the National Flood Insurance Act of 1968, to cap the annual cost of flood insurance under that Act, to provide for a ten-year phase-in of premium increases resulting from the enactment of the Biggert-Waters Flood Insurance Reform Act of 2012, and for other purposes.</official-title></form><legis-body id="H088FC8D6E3344BB9BB360E09E43EFB51" style="OLC"><section id="H3C713012A2CB441389B7EFD8A2B53B98" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Homeowners Flood Insurance Relief Act of 2013</short-title></quote>.</text></section><section id="H917AC9A453024B95BA71930A5EB4A15C"><enum>2.</enum><header>Monthly installment payments for premiums</header><text display-inline="no-display-inline">Section 1308(g) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015(g)</external-xref>) is amended by striking <quote><short-title>either annually or in more frequent installments</short-title></quote> and inserting <quote><short-title>annually, monthly, or in other installments that are more frequent than annually</short-title></quote>.</text></section><section id="HF966022B67F3440E9E746D29390628BD"><enum>3.</enum><header>Cap on annual cost of flood insurance</header><text display-inline="no-display-inline">Section 1308 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4015">42 U.S.C. 4015</external-xref>) is amended—</text><paragraph id="HA72059EEC8224268B98D524A5DC3054D"><enum>(1)</enum><text>by redesignating subsection (i) as subsection (j); and</text></paragraph><paragraph id="H37AAA9830C4B4F2FBD027C24A0C38874"><enum>(2)</enum><text>by inserting after subsection (h) the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H15D9C699DE6E4EF7B8710ADB343F8461" style="OLC"><subsection id="H19CE36EDA4334701A12645562BD3DB9D"><enum>(i)</enum><header>Maximum annual premium</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, the maximum annual chargeable premium rate for a property shall be the total appraised value of all structures located on the property at the time of the purchase of the property by the current owner of the property divided by 30.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H1626AF13E0EA4DFC95D6608ADEB102E7"><enum>4.</enum><header>Ten-year phase-in of premium increases resulting from Biggert-Waters Flood Insurance Reform Act of <enum-in-header>2012</enum-in-header></header><subsection id="H67624B01E3374EC39EDDE216745CF40F"><enum>(a)</enum><header>Phase-In</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any increase in the risk premium rate charged for flood insurance under the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4001">42 U.S.C. 4001 et seq.</external-xref>) on any property that is covered by a flood insurance policy on the effective date of the Biggert-Waters Flood Insurance Reform Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>; 126 Stat. 916 et seq.) that is a result of the enactment of such Act or the amendments made by such Act shall be phased in over a 10-year period, at the rate of 10 percent for each year following such effective date.</text></subsection><subsection id="H222BDD63410C421E8448388E8B4521C4"><enum>(b)</enum><header>Applicability; refund or credit</header><text display-inline="yes-display-inline">Subsection (a) shall apply as if enacted as part of the Biggert-Waters Flood Insurance Reform Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>; 126 Stat. 916 et seq.). The Administrator of the Federal Emergency Management Agency shall refund to insureds, or provide credit to insureds for, any premiums for flood insurance coverage under the National Flood Insurance Program collected in excess of the rates required pursuant to subsection (a).</text></subsection></section></legis-body></bill>
