which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and in addition to the Committees on <committee-name committee-id="HVR00">Veterans’ Affairs</committee-name>, <committee-name committee-id="HAS00">Armed Services</committee-name>, and <committee-name committee-id="HGO00">Oversight and Government Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for additional protections and disclosures to consumers when financial products or services are related to the consumers’ military or Federal pensions, and for other purposes.</official-title></form><legis-body id="H8BEF401295D74C689286F7CC72B96FF4" style="OLC"><section id="H9D52145B5B8F420B93367F82D9B3C0A7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Annuity Safety and Security Under Reasonable Enforcement Act of 2013</short-title></quote> or the <quote><short-title>ASSURE Act of 2013</short-title></quote>.</text></section><section id="HBE9BA1FC94764C42B441EE0FA7E27ED3"><enum>2.</enum><header>Consideration of Federal and military pensions in extensions of credit</header><text display-inline="no-display-inline">The Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1601">15 U.S.C. 1601 et seq.</external-xref>) is amended—</text><paragraph id="H3298A938BB1C49DB866A8CBB78A6EE6A"><enum>(1)</enum><text>in section 104(3), by inserting after <quote><short-title>other than</short-title></quote> the following: <quote><short-title>payments described under section 126(a) and</short-title></quote>;</text></paragraph><paragraph id="HBD27135973FE4901A90B80A0CB0B29AE"><enum>(2)</enum><text>by inserting after section 125 the following:</text><quoted-block display-inline="no-display-inline" id="H718B9DC57F2041FE9AB196A6389D6FC8" style="USC"><section id="H22853B181BA34AE1BEF048636FC65E1C"><enum>126.</enum><header>Payments in consideration of Federal and military pensions</header><subsection id="H4DDC71A68E3445B087CBE707F44B5465"><enum>(a)</enum><header>Disclosure</header><text display-inline="yes-display-inline">The Bureau shall issue regulations requiring any payment to a benefit recipient, whether or not such payment is an extension of credit, that diminishes the benefit recipient’s ability to control the payments from their Federal or military pension in any way, to be treated as an extension of credit for purposes of the disclosures required under this title.</text></subsection><subsection commented="no" id="H4C5D4C1239E848069CD753F481E78799"><enum>(b)</enum><header>Interest rate cap</header><text display-inline="yes-display-inline">With respect to a payment to a benefit recipient described under subsection (a)—</text><paragraph id="H875C8A4E6A114142AD0D1E502FE225A2"><enum>(1)</enum><text>if such payment is an extension of consumer credit, a creditor may not impose an annual percentage rate of interest greater than the Federal funds rate plus 6 percent; and</text></paragraph><paragraph id="HF087EC6932A44F7580D48F90FC91C9E5"><enum>(2)</enum><text>if such payment is not an extension of consumer credit, the Bureau shall issue regulations requiring that the aggregate amount of cash and property paid in exchange for such payment may not exceed an amount that is equivalent to the interest rate described under paragraph (1).</text></paragraph></subsection><subsection id="H57AFBB7EFD384E46847E09980D5BD876"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section:</text><paragraph id="HF8720E0A7B064DFB848D4B46B7E7EB07"><enum>(1)</enum><header>Benefit recipient</header><text>The term <term>benefit recipient</term> means a person who is entitled to payments under a Federal or military pension.</text></paragraph><paragraph id="H83D67AFC0B7B4384A2121999FB61F707"><enum>(2)</enum><header>Federal or military pension</header><text>The term <term>Federal or military pension</term> means—</text><subparagraph id="H85E0275DCADD47DA8E8ABDCE8B7A1299"><enum>(A)</enum><text>a benefit described under <external-xref legal-doc="usc" parsable-cite="usc/38/5301">section 5301(a)</external-xref> of title 38, United States Code;</text></subparagraph><subparagraph id="HF3E9D834C2C74DB89BB75A031BB4A7C7"><enum>(B)</enum><text display-inline="yes-display-inline">retired pay to an enlisted member of the Army, Navy, Air Force, or Marine Corps; and</text></subparagraph><subparagraph id="HD541B2EB2A974EC5A513A5A2C33BBC2C"><enum>(C)</enum><text>an annuity described under section <external-xref legal-doc="usc" parsable-cite="usc/5/8345">8345</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/5/8465">8465</external-xref> of title 5, United States Code.</text></subparagraph></paragraph><paragraph id="H5B999772695440078F9909D6061B7E76"><enum>(3)</enum><header>Federal funds rate</header><text>For purposes of this section, the term <term>Federal funds rate</term> means the Federal funds rate published in the Federal Reserve Statistical Release on selected interest rates (daily or weekly), and commonly referred to as the H.15 release (or any successor publication).</text></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H9F0035FB4E20425D926882E99CFA37C7"><enum>(3)</enum><text>in the table of contents for chapter 2 of such Act, by inserting after the item relating to section 125 the following:</text><quoted-block display-inline="no-display-inline" id="HA46F89710D2F40DF8CC6AA87D7151980" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">126. Consideration of Federal pensions in extensions of credit</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H29D526B4FA2E41688B9770F51DA5CFF6"><enum>3.</enum><header>Clarification of assignments; private rights of actions</header><subsection id="HA8FD18F2414842D5B0D1FFAB14060728"><enum>(a)</enum><header>Veterans benefits</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/5301">Section 5301</external-xref> of title 38, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H58A1798503DF4428BBB131ABF169AB7E" style="OLC"><subsection id="HF858301A05BF4BEAB1109A9A25B1C979"><enum>(f)</enum><header>Private right of action</header><paragraph id="H64E0DD7F0DC8452B8E6BE4B7CCB50697"><enum>(1)</enum><header>In general</header><text>A benefit recipient may bring an action against a pension assignee in the appropriate Federal or State court and recover—</text><subparagraph id="H5D5AA82F3292468FA2E2C2D04047ED2A"><enum>(A)</enum><text>three times the damages suffered due to the assignment made in violation of this section;</text></subparagraph><subparagraph id="H6B619A318FD249FF8D9C43C78EAF4D18"><enum>(B)</enum><text>court costs; and</text></subparagraph><subparagraph id="H157F7EC88F9D4A8CAD819C3225B8F5DD"><enum>(C)</enum><text>reasonable attorneys’ fees and expenses.</text></subparagraph></paragraph><paragraph id="H7EADC557C44A471D96677396B3B871C1"><enum>(2)</enum><header>Definitions</header><text>For purposes of this subsection:</text><subparagraph id="H20DDF0BBD3E84136A0E8B4716A094948"><enum>(A)</enum><header>Benefit recipient</header><text display-inline="yes-display-inline">The term <term>benefit recipient</term> means a person with respect to which payments of benefits described under this section are due or are to become due.</text></subparagraph><subparagraph id="H99260A19D78D43F3980506AACF229D00"><enum>(B)</enum><header>Pension assignee</header><text>With respect to a benefit recipient, the term <term>pension assignee</term> means a person who has been assigned the benefits of the benefit recipient in violation of this section.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H29218D9522C24468A1CA64FCA0526AFD"><enum>(b)</enum><header>Military retired pay</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/37/701">Section 701</external-xref> of title 37, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H0E280535F19A487388F394C9638D6443" style="OLC"><subsection id="H57B9FE89C22F474AABD40019E25412ED"><enum>(f)</enum><header>Clarification on non-Assignment of retired pay for enlisted members</header><paragraph id="H7F60D34FB8E14EAB9A382D1ED48D20FF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this subsection (c), in any case where an enlisted member is entitled to retired pay and enters into an agreement with another person under which agreement such other person acquires for consideration the right to receive payment of such retired pay, whether by payment from the member to such other person, deposit into an account from which such other person may make withdrawals, or otherwise, such agreement shall be deemed to be an assignment and is prohibited. Any agreement or arrangement for collateral for security for an agreement that is prohibited under the previous sentence is also prohibited.</text></paragraph><paragraph id="HF5C974D779B94728A5B5BFCABDAC52F6"><enum>(2)</enum><header>Private right of action</header><subparagraph id="H28D8D0E3F54B4ED387AB9B612F95FEAF"><enum>(A)</enum><header>In general</header><text>A retired pay recipient may bring an action against a retired pay assignee in the appropriate Federal or State court and recover—</text><clause id="H9212C8D0204344F686A64E1DE4041CD8"><enum>(i)</enum><text>three times the damages suffered due to the assignment of retired pay made in violation of this section;</text></clause><clause id="HC04994162E6A4F258F2263CE36242BAF"><enum>(ii)</enum><text>court costs; and</text></clause><clause id="H5FE9157EFB394C86A7166076A84C9404"><enum>(iii)</enum><text>reasonable attorneys’ fees and expenses.</text></clause></subparagraph><subparagraph id="H03D7927A316948BE8E1E9C3AD6AF2030"><enum>(B)</enum><header>Definitions</header><text>For purposes of this subsection:</text><clause commented="no" id="HC9A3E1114CBB4DFD9FAB0D78E85A9708"><enum>(i)</enum><header>Retired pay recipient</header><text display-inline="yes-display-inline">The term <term>retired pay recipient</term> means a person with respect to which retired pay described under this section is due or is to become due.</text></clause><clause commented="no" id="H0802DECF00F5428F97B095DEAFCB7511"><enum>(ii)</enum><header>Retired pay assignee</header><text>With respect to a retired pay recipient, the term <term>retired pay assignee</term> means a person who has been assigned or allotted the retired pay of the retired pay recipient in violation of this section.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5C32756841E7488690D363318E4264A7"><enum>(c)</enum><header>CSRS annuities</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8345">Section 8345(h)</external-xref> of title 5, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H105F7BC3297346A6B5955F50A00BE49E" style="USC"><subsection id="HF9BFB086B4DB404FBBBD13D2C77AB175"><enum>(h)</enum><header>Non-Assignment of annuities</header><paragraph id="H8112667CBBC847C180CCB22148A12C60"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An individual entitled to an annuity from the Fund may not make allotments or assignments of amounts from such annuity.</text></paragraph><paragraph id="H98291140061C4A538931A1EC8D91A3D7"><enum>(2)</enum><header>Construction</header><text display-inline="yes-display-inline">For purposes of this subsection—</text><subparagraph id="HE049FC14BB244E51A7740980B1672E1E"><enum>(A)</enum><text>in any case where an individual entitled to an annuity from the Fund enters into an agreement with another person under which agreement such other person acquires for consideration the right to receive payment of such annuity, whether by payment from the individual to such other person, deposit into an account from which such other person may make withdrawals, or otherwise, such agreement shall be deemed to be an assignment and is prohibited; and</text></subparagraph><subparagraph id="H5E15E1AEFA0B4D0F813EF5F037CF71B4"><enum>(B)</enum><text display-inline="yes-display-inline">any agreement or arrangement for collateral for security for an agreement that is prohibited under subparagraph (A) is also prohibited.</text></subparagraph></paragraph><paragraph id="H4D4541BDA7AF491AB603654B72E7AB04"><enum>(3)</enum><header>Exception</header><text display-inline="yes-display-inline">Paragraphs (1) and (2) shall not apply to amounts used to pay dues to unions or other employee organizations.</text></paragraph><paragraph id="H5B31E3B3F85F42D5AA9923A37CDD43FD"><enum>(4)</enum><header>Private right of action</header><subparagraph id="H951C46BE5C904F819D04858CC1648AB8"><enum>(A)</enum><header>In general</header><text>An annuity recipient may bring an action against an annuity assignee in the appropriate Federal or State court and recover—</text><clause id="H43AACBC2648A4BC5A5F8BA2282C56270"><enum>(i)</enum><text display-inline="yes-display-inline">three times the damages suffered due to the assignment made in violation of this subsection or the regulations issued pursuant to this subsection;</text></clause><clause id="H1C03574EEB7A460A9B6C42A04869B101"><enum>(ii)</enum><text>court costs; and</text></clause><clause id="HBEEA9AAE26B049B6ADD65A211AC0D7F2"><enum>(iii)</enum><text>reasonable attorneys’ fees and expenses.</text></clause></subparagraph><subparagraph id="HD65CE7E98CD64D0A9375824D0EEFC7E7"><enum>(B)</enum><header>Definitions</header><text>For purposes of this paragraph:</text><clause id="HD540D61D05EC461399F07955DE9CA09B"><enum>(i)</enum><header>Annuity assignee</header><text display-inline="yes-display-inline">With respect to an annuity recipient, the term <quote><short-title>annuity assignee</short-title></quote> means a person who has been assigned or allotted all or part of an annuity from the Fund in violation of this subsection or the regulations issued pursuant to this subsection.</text></clause><clause id="HB8CF221439774F3E8029B742DF355CA4"><enum>(ii)</enum><header>Annuity recipient</header><text display-inline="yes-display-inline">The term <quote><short-title>annuity recipient</short-title></quote> means an individual entitled to an annuity from the Fund.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H81E812AA363B498FB6A367F10340A6F4"><enum>(d)</enum><header>FERS annuities</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8465">Section 8465(b)</external-xref> of title 5, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H58EC0697DE3F4D71AE5BF535B258E789" style="USC"><subsection id="H28936BC97C76414181904A7E80653A7B"><enum>(b)</enum><header>Non-Assignment of annuities</header><paragraph id="HFD636F2F948D4D68A5278C262271CDD5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An individual entitled to an annuity from the Fund may not make allotments or assignments of amounts from such annuity.</text></paragraph><paragraph id="HCF2910A69EAD44E7B4DE337930BB90A3"><enum>(2)</enum><header>Construction</header><text display-inline="yes-display-inline">For purposes of this subsection—</text><subparagraph id="H5AEE9A16BA2C4093AEBDD2F81B46A36B"><enum>(A)</enum><text>in any case where an individual entitled to an annuity from the Fund enters into an agreement with another person under which agreement such other person acquires for consideration the right to receive payment of such annuity, whether by payment from the individual to such other person, deposit into an account from which such other person may make withdrawals, or otherwise, such agreement shall be deemed to be an assignment and is prohibited; and</text></clause><clause id="H2C1190EDF514413E8F3A4C5914178948"><enum>(iii)</enum><text>reasonable attorneys’ fees and expenses.</text></clause></subparagraph><subparagraph id="HDD09E0D0AD36400BABA5D97F2E01942A"><enum>(B)</enum><header>Definitions</header><text>For purposes of this paragraph:</text><clause id="HCFD401FCE94E48ECA268DBBB700A24A9"><enum>(i)</enum><header>Annuity assignee</header><text display-inline="yes-display-inline">With respect to an annuity recipient, the term <term>annuity assignee</term> means a person who has been assigned or allotted all or part of an annuity from the Fund in violation of this subsection or the regulations issued pursuant to this subsection.</text></clause><clause id="H8E8FA62C7A7F4D1A86543A49E85DD28F"><enum>(ii)</enum><header>Annuity recipient</header><text display-inline="yes-display-inline">The term <term>annuity recipient</term> means an individual entitled to an annuity from the Fund.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H96FC4071506A4E37BD3A85A72CAF35A4"><enum>4.</enum><header>Bureau of Consumer Financial Protection provisions</header><subsection id="H100AE46764544747BDFC0E2A58BCE63E"><enum>(a)</enum><header>Regulation of Federal or military pension-Related products</header><text display-inline="yes-display-inline">Section 1032(f) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5532">12 U.S.C. 5532(f)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H7B1CF100449E45D2ADF4E9041CB4DB63" style="OLC"><subsection id="H41B89B3EE8E64E01BB37525305C40C93"><enum>(g)</enum><header>Regulation of Federal or military pension-Related products</header><paragraph id="HA7E5DE406EF54DFBB11F3787ACDFBD7D"><enum>(1)</enum><header>In general</header><text>The Bureau shall issue regulations to require a person offering a Federal or military pension-related product to provide additional disclosures when advertising or selling such product, sufficient to allow consumers to understand how their pension relates to the product.</text></paragraph><paragraph id="HE9C15E8F37924192B6CC2D1FD2AA19D7"><enum>(2)</enum><header>Definitions defined</header><text display-inline="yes-display-inline">For purposes of this subsection:</text><subparagraph id="HE6E8DBC5E25643C3A641E0B396646D84"><enum>(A)</enum><header>Federal or military pension</header><text>The term <term>Federal or military pension</term> means—</text><clause id="H061EB29CD0C34E0585A5035A530C94F3"><enum>(i)</enum><text>a benefit described under <external-xref legal-doc="usc" parsable-cite="usc/38/5301">section 5301(a)</external-xref> of title 38, United States Code;</text></clause><clause id="H9E7043E55CB84D22919018133FC734A8"><enum>(ii)</enum><text display-inline="yes-display-inline">retired pay to an enlisted member of the Army, Navy, Air Force, or Marine Corps; and</text></clause><clause id="HA1ABC16D6D064F50BB02816FE2EB3663"><enum>(iii)</enum><text>an annuity described under section <external-xref legal-doc="usc" parsable-cite="usc/5/8345">8345</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/5/8465">8465</external-xref> of title 5, United States Code.</text></clause></subparagraph><subparagraph id="HDC20EC1B38164BB88E698D7E2FF96998"><enum>(B)</enum><header>Federal or military pension-related product</header><text>The term <term>Federal or military pension-related product</term> means a financial product or service related to a Federal or military pension, including any extension of credit if the creditor, when determining a consumer’s ability to repay the extension of credit, takes the pension into consideration.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H198A9CB1C78E46BEAD5FA7C75141E1A8"><enum>(b)</enum><header>Study by the Bureau</header><paragraph id="H823F224692E64FF7AA66F780478F34B9"><enum>(1)</enum><header>In general</header><text>The Bureau of Consumer Financial Protection shall carry out a study of financial products and services that target military retirees and Federal employee retirees.</text></paragraph><paragraph id="HF60EABC0CE5646B2B15EA75C0101EAFE"><enum>(2)</enum><header>Report</header><text>Not later than the end of the 3-month period beginning on the date of the enactment of this Act, the Bureau shall issue a report to the Congress containing all findings and determinations made in carrying out the study required under this subsection.</text></paragraph></subsection></section></legis-body></bill>
