		<section id="H88B547FAE5974D479420E3B8A5FFF9DE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Excess Federal Building and Property
			 Disposal Act of 2013</short-title></quote>.</text>
		</section><section id="HFE6B69C76DE04D2C97E9DB2EFD5DB190"><enum>2.</enum><header>Federal real
			 property disposal pilot program</header>
			<subsection id="HD7AD477F78AD46E0A60EEA52861E918C"><enum>(a)</enum><header>In
			 general</header><text>Chapter 5 of subtitle I of title 40, United States Code,
			 is amended by adding at the end the following new subchapter:</text>
				<quoted-block display-inline="no-display-inline" id="HAE6F5A55E7614D54BE063D27404D2FAE" style="USC">
					<subchapter id="HFDE40670220041BAA3F570AD589CCAEF"><enum>VII</enum><header>Expedited
				disposal of real property</header>
						<section id="HB881CA0B46554F0590D56006344D014F"><enum>621.</enum><header>Federal real
				property disposal pilot program</header>
							<subsection id="HA9220D3BC8AA43B5B39BB0A0814D5A0D"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Administrator of
				General Services (in this subchapter referred to as the
				<term>Administrator</term>), in consultation with the Director of the Office of
				Management and Budget (in this subchapter referred to as the
				<term>Director</term>), shall conduct a pilot program to be known as the
				<term>Federal Real Property Disposal Pilot Program</term>, under which the
				Administrator, in consultation with the Director, shall determine which 15
				Federal Government real properties that are excess or surplus and have the
				highest fair market value and the greatest potential to sell and shall dispose
				of such properties in accordance with this subchapter and through an expedited
				disposal of real property.</text>
							</subsection><subsection id="H31877B879425489BAAE1F077DEB367F1"><enum>(b)</enum><header>Disposal</header><text>During
				the five-year period beginning on the date of the enactment of the
				<short-title>Excess Federal Building and Property Disposal
				Act of 2013</short-title>, the Administrator, in consultation with the
				Director, shall dispose of real property under the Federal Real Property
				Disposal Pilot Program through a public auction.</text>
							</subsection><subsection id="H8B77E45268714301A39A9D044CDA5CE7"><enum>(c)</enum><header>Adding
				properties to the pilot program</header><text>Not later than 15 days after a
				property is disposed of under subsection (b), the Administrator, in
				consultation with the Director, shall designate an additional property, in
				accordance with subsection (a), to be disposed of under the Federal Real
				Property Disposal Pilot Program.</text>
							</subsection><subsection id="H5C8C025B7D6D453A842038D12390737A"><enum>(d)</enum><header>Exceptions</header><text>The
				Administrator shall not include for purposes of the Federal Real Property Pilot
				Program any of the following types of property:</text>
								<paragraph id="H1D684634D7B24762AD8EC94F50E0A1AD"><enum>(1)</enum><text>A parcel of real
				property, building, or other structure located on such real property that is to
				be closed or realigned under the Defense Base Closure and Realignment Act of
				1990 (<external-xref legal-doc="usc" parsable-cite="usc/10/2687">10 U.S.C. 2687</external-xref> note).</text>
								</paragraph><paragraph id="H1C37647E3FDF4EFC948ACAE4336DE109"><enum>(2)</enum><text>Properties that
				are excluded for reasons of national security by the Director of the Office of
				Management and Budget.</text>
								</paragraph><paragraph id="H88C7F9BA38B34D4AAA4AB622224CD24C"><enum>(3)</enum><text display-inline="yes-display-inline">Indian and Native Eskimo properties
				including—</text>
									<subparagraph id="HD8B447DB8BE34459B5C951306E1B6F0F"><enum>(A)</enum><text>any property
				within the limits of any Indian reservation to which the United States owns
				title; and</text>
									</subparagraph><subparagraph id="HDB50F1D7C4994868AAF1569AF978222E"><enum>(B)</enum><text>any property title
				which is held in trust by the United States for the benefit of any Indian tribe
				or individual or held by an Indian tribe or individual subject to restriction
				by the United States against alienation.</text>
									</subparagraph></paragraph><paragraph id="H721BEE6383CE4C6A8BD04C71FDEA8CE8"><enum>(4)</enum><text>Properties
				operated and maintained by the Tennessee Valley Authority pursuant to the
				Tennessee Valley Authority Act of 1933 (<external-xref legal-doc="usc" parsable-cite="usc/16/831">16 U.S.C. 831 et seq.</external-xref>).</text>
								</paragraph><paragraph id="HBE7D2E9543144F9180AA0D12EAD8DAD9"><enum>(5)</enum><text>Postal properties
				owned by the United States Postal Service.</text>
								</paragraph><paragraph id="HE0D3E310F80F4CC29C99F085F86D60FB"><enum>(6)</enum><text>Properties used in
				connection with river, harbor, flood control, reclamation, or power
				projects.</text>
								</paragraph><paragraph id="H71A3A70F82064878962DC2D5EFF9795F"><enum>(7)</enum><text display-inline="yes-display-inline">Properties that the Administrator has
				determined are suitable for assignment to the Secretary of the Interior for
				transfer to a State, a political subdivision or instrumentality of a State, or
				a municipality for use as a public park or recreation area under section 550(e)
				of this title. In making such determination, the Administrator may consider the
				appraised value of the property and the highest and best use.</text>
								</paragraph><paragraph id="H23EBE8BE18A8472CA19DDC773DA369D7"><enum>(8)</enum><text display-inline="yes-display-inline">Properties used, as of the date of the
				enactment of this subchapter, in connection with Federal programs for
				recreational and conservation purposes, including research for such
				programs.</text>
								</paragraph></subsection><subsection id="H5080E50813DD4B43887F6538BFCD8E7C"><enum>(e)</enum><header>GAO
				report</header><text display-inline="yes-display-inline">Not later than 24
				months after the date of the enactment of this subchapter, the Comptroller
				General of the United States shall submit to Congress and make publicly
				available a study of the effectiveness of the Federal Real Property Pilot
				Program.</text>
							</subsection><subsection id="HABAB6F71C2D043469185868DC1D2DD43"><enum>(f)</enum><header>Termination</header><text>The
				Federal Real Property Disposal Pilot Program shall terminate on the date that
				is five years after the date of the enactment of the
				<short-title>Excess Federal Building and Property Disposal
				Act of 2013</short-title>.</text>
							</subsection></section><section commented="no" id="H7C6FA797EB144C859F58500F5294682D"><enum>622.</enum><header>Selection of
				real properties</header><text display-inline="no-display-inline">The head of
				each executive agency shall recommend properties to the Director for disposal
				under the Federal Real Property Pilot Program. The Director, in consultation
				with the Administrator, shall then select properties for disposal under the
				pilot program and notify the recommending executive agency accordingly.</text>
						</section><section id="HA484139529944C42942C1D7A038E8AC6"><enum>623.</enum><header>Expedited
				disposal requirements</header>
							<subsection id="HFEB2499D8384403E87E91E305D91687D"><enum>(a)</enum><header>Expedited
				disposal of real property defined</header><text>For purposes of this
				subchapter, an <term>expedited disposal of real property</term> is the sale of
				real property for cash that is conducted pursuant to the requirements of
				section 545(a) of this title.</text>
							</subsection><subsection id="H54AA264A14CB4D2092784D039103BAC6"><enum>(b)</enum><header>Fair market
				value requirement</header><text display-inline="yes-display-inline">Real
				property sold under the Federal Real Property Pilot Program may not be sold at
				less than the fair market value as determined by the Administrator, in
				consultation with the Director. Costs associated with disposal may not exceed
				the fair market value of the property unless the Director approves incurring
				such costs.</text>
							</subsection><subsection id="HDC567142E9084225868B2DE41308D153"><enum>(c)</enum><header>Monetary
				proceeds requirement</header><text display-inline="yes-display-inline">Real
				property shall be sold under the Federal Real Property Pilot Program only if
				the property will generate monetary proceeds to the Federal Government, as
				provided in subsection (b). A disposal of real property under the Federal Real
				Property Pilot Program may not include any exchange, trade, transfer,
				acquisition of like-kind property, or other non-cash transaction as part of the
				disposal.</text>
							</subsection><subsection id="HA6E30E72AC504D9195C442A636AAB9BD"><enum>(d)</enum><header>Rule of
				construction</header><text>Nothing in this subchapter shall be construed as
				terminating or in any way limiting authorities that are otherwise available to
				agencies under other provisions of law to dispose of Federal real property,
				except as provided in subsection (e).</text>
							</subsection><subsection id="HD4719A00B48C49E0ABC63055B596948A"><enum>(e)</enum><header>Exemption from
				certain requirements</header><text>Any expedited disposal of a real property
				conducted under this subchapter shall not be subject to—</text>
								<paragraph id="H5C545619EBFE4054857C2ACCB34CB1D6"><enum>(1)</enum><text>subchapter IV of
				this chapter;</text>
								</paragraph><paragraph id="HF6FB4476B46E406B9A02A00CB3903454"><enum>(2)</enum><text>sections 550 and
				553 of this title;</text>
								</paragraph><paragraph id="H80DC90D8BCE94DDDBCD5FF8BA126CDC2"><enum>(3)</enum><text>section 501 of the
				McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11411">42 U.S.C. 11411</external-xref>);</text>
								</paragraph><paragraph id="HB2D8985B6BB349AAA29AF70EE6B9EF45"><enum>(4)</enum><text>any other
				provision of law authorizing the no-cost conveyance of real property owned by
				the Federal Government; or</text>
								</paragraph><paragraph id="HDEE7549FD86641BF81B44221214E66C4"><enum>(5)</enum><text>any congressional
				notification requirement other than that in section 545 of this title.</text>
								</paragraph></subsection></section><section id="H67C26EC6386245E5AD20B5ADB3C6226A"><enum>624.</enum><header>Special rules
				for deposit and use of proceeds from expedited disposals</header><text display-inline="no-display-inline">The proceeds from an expedited disposal of
				real property under this subchapter shall be deposited into the General Fund of
				the Treasury. Two percent of such proceeds is authorized to be appropriated
				until expended to fund the grant program under section 625.</text>
						</section><section commented="no" id="H20B65A5EE6054BC086B56641DF8C72CF"><enum>625.</enum><header>Homeless
				assistance grants</header>
							<subsection commented="no" id="H2740868703024FC18F06A79ED644346F"><enum>(a)</enum><header>Grant
				authority</header><text display-inline="yes-display-inline">To the extent
				amounts are made available pursuant to section 624 for use under this section,
				the Secretary of Housing and Urban Development shall make grants to eligible
				private nonprofit organizations under subsection (b) to purchase property
				suitable for use to assist the homeless as provided in subsection (c).</text>
							</subsection><subsection commented="no" id="HF33F0E55199E499BAC44F5CAC66182CE"><enum>(b)</enum><header>Eligible
				grantees</header><text>To be eligible to receive a grant under subsection (a),
				a private nonprofit organization shall be a representative of the homeless, as
				such term is defined in section 501(i)(4) of the McKinney-Vento Homeless
				Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11411">42 U.S.C. 11411(i)(4)</external-xref>).</text>
							</subsection><subsection commented="no" id="HD0DA6D9122474F6B8084C94DC760703B"><enum>(c)</enum><header>Use of
				properties for housing or shelter for the homeless</header>
								<paragraph commented="no" id="H9CE788EEBB81402F8573C4D6428CC8B6"><enum>(1)</enum><header>Eligible
				uses</header><text display-inline="yes-display-inline">A nonprofit organization
				that receives a grant under subsection (a) shall use the amounts received under
				such grant only to acquire or rehabilitate real property for use to provide
				permanent housing (as such term is defined in section 401 of the McKinney-Vento
				Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360</external-xref>)), transitional housing (as such term
				is defined in such section 401), or temporary shelter, for persons who are
				homeless.</text>
								</paragraph><paragraph commented="no" id="H1D4A52BFAEDA4DF096BBA620D8FF4339"><enum>(2)</enum><header>Term of
				use</header><text display-inline="yes-display-inline">The Secretary of Housing
				and Urban Development may not make a grant under subsection (a) to a private
				nonprofit organization unless the organization provides the Secretary with such
				assurances as the Secretary determines necessary to ensure that any property
				acquired or rehabilitated using the amounts received under such grant is used
				only as provided in paragraph (1) of this subsection for a period of not fewer
				than 15 years.</text>
								</paragraph></subsection><subsection commented="no" id="HB2A67CEF244948CB88419BCC3197B89F"><enum>(d)</enum><header>Preference</header><text display-inline="yes-display-inline">In awarding grants under subsection (a),
				the Secretary of Housing and Urban Development shall give preference for such
				grants to private nonprofit organizations that operate within areas in which
				Federal real property is being sold under the Federal Real Property Disposal
				Pilot Program under this subchapter.</text>
							</subsection><subsection commented="no" id="H3E32D9D98CDE44FDB37851101AFE1B4D"><enum>(e)</enum><header>Nonprofit
				organization</header><text>For purposes of this section, the following
				definitions shall apply:</text>
								<paragraph commented="no" id="HA85259C970934CE9AC6C81E7F3A388E5"><enum>(1)</enum><header>Homeless</header><text display-inline="yes-display-inline">The term <term>homeless</term> has the
				meaning given such term in section 103 of the McKinney-Vento Homeless
				Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11302">42 U.S.C. 11302(a)</external-xref>), except that subsection (c) of such section
				shall not apply for purposes of this section.</text>
								</paragraph><paragraph commented="no" id="H3280FBEC8FAE4F9096ED3910CEC0B875"><enum>(2)</enum><header>Private
				nonprofit organization</header><text>The term <term>private nonprofit
				organization</term> has the meaning given such term in section 401 of the
				McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360</external-xref>).</text>
								</paragraph></subsection><subsection commented="no" id="H31CACFF3E3D740BEBE5DDFAB97C85E3B"><enum>(f)</enum><header>Regulations</header><text>The
				Secretary of Housing and Urban Development may issue any regulations necessary
				to carry out this
				section.</text>
							</subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H712E0BA6209543518BFA88BC2EF122F1"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections at the beginning of chapter 5 of subtitle I of title 40, United States
			 Code, is amended by inserting after the item relating to section 611 the
			 following:</text>

			 General Services Administration and executive agencies</header>
			<subsection id="HBC039CA7108F4F58B757861E74CD15DE"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/40/524">Section 524</external-xref> of title 40, United States Code, is amended
			 to read as follows:</text>

					<section id="H1A2F13BB2DF948FA9DA4D565BB834044"><enum>524.</enum><header>Duties of the
				General Services Administration and executive agencies</header>
						<subsection id="H836F2F53DB8E42AAB89C697CEF8332BD"><enum>(a)</enum><header>Duties of the
				General Services Administration</header>
							<paragraph id="H12FF589C2D6540E392FE0AAD4E659AC2"><enum>(1)</enum><header>Guidance</header><text>Not
				later than 6 months after the date of the enactment of this section, and when
				necessary thereafter, the Administrator of General Services shall issue
				guidance for the development and implementation of executive agency real
				property plans. Such guidance shall include recommendations on—</text>
								<subparagraph id="H8EF0A6F572664DFA86788D75F2837F02"><enum>(A)</enum><text>how to identify
				excess properties;</text>
								</subparagraph><subparagraph id="H247604625C61469BBFC7D48D95785A77"><enum>(B)</enum><text>how to evaluate
				the costs and benefits associated with disposing of real property;</text>
								</subparagraph><subparagraph id="HAC801FBD5EA248148AB0B570D7DE22E9"><enum>(C)</enum><text>how to prioritize
				disposal decisions based on agency missions and anticipated future need for
				holdings; and</text>
								</subparagraph><subparagraph id="H1389EE2E713F442192B38741273978F4"><enum>(D)</enum><text>how best to
				dispose of those properties identified as excess to meet the needs of the
				agency.</text>
								</subparagraph></paragraph><paragraph id="H8BDE23FB7B5845EDB1F41D67A0448BBF"><enum>(2)</enum><header>Assistance</header><text>The
				Administrator shall assist executive agencies in the identification and
				disposal of excess real property.</text>
							</paragraph></subsection><subsection id="H20D31FD55D5849EFA06308BDA8327936"><enum>(b)</enum><header>Duties of
				executive agencies</header>
							<paragraph id="HC46313A7B2E44512BEAD25438D848658"><enum>(1)</enum><header>In
				general</header><text>Each executive agency shall—</text>
								<subparagraph id="HAFD0F34E711644D2A9D12598B4749A9E"><enum>(A)</enum><text>maintain adequate
				inventory controls and accountability systems for property under its
				control;</text>
								</subparagraph><subparagraph id="H9FDFA670D3E141ED85EE9A16CBFBE962"><enum>(B)</enum><text>continuously
				survey property under its control to identify excess property;</text>
								</subparagraph><subparagraph id="H132D227BDA2E4C57AAF8F2E6AD3D7EB2"><enum>(C)</enum><text>promptly report
				excess property to the Administrator;</text>
								</subparagraph><subparagraph id="H07D79DDA940C4599AA80878F9061AEC9"><enum>(D)</enum><text>perform the care
				and handling of excess property; and</text>
								</subparagraph><subparagraph id="H0AFD3693BAF54A8595FD6F9FCDF6A702"><enum>(E)</enum><text>transfer or
				dispose of excess property as promptly as possible in accordance with authority
				delegated and regulations prescribed by the Administrator.</text>
								</subparagraph></paragraph><paragraph id="HC93230B79B9942468FC54AC052DFFF86"><enum>(2)</enum><header>Specific
				requirements with respect to real property</header><text>With respect to real
				property, each executive agency shall—</text>
								<subparagraph id="H4BF3F640D9084A2DB299170B353C3069"><enum>(A)</enum><text>develop and
				implement a real property plan in order to identify properties to declare as
				excess using the guidance issued under subsection (a)(1);</text>
								</subparagraph><subparagraph id="H070B6EE3021448D4A21A229F77375061"><enum>(B)</enum><text>identify and
				categorize all real property owned, leased, or otherwise managed by the
				agency;</text>
								</subparagraph><subparagraph id="HDFC5092721354A7090270D451515FBC5"><enum>(C)</enum><text>establish adequate
				goals and incentives to reduce excess real property in such agency’s inventory;
				and</text>
								</subparagraph><subparagraph id="HC21D3AC922964750AB8BBAF82F95FC1B"><enum>(D)</enum><text>when appropriate,
				use the authorities in section 572(a)(2)(B) of this title in order to identify
				and prepare real property to be reported as excess.</text>
								</subparagraph></paragraph><paragraph id="H136A825269C2405A8524D4F3AE2CD2D3"><enum>(3)</enum><header>Additional
				requirements</header><text>Each executive agency, as far as practicable,
				shall—</text>
								<subparagraph id="HA2D441F7C1134A159F33E145F4B9DDAB"><enum>(A)</enum><text>reassign property
				to another activity within the agency when the property is no longer required
				for the purposes of the appropriation used to make the purchase;</text>
								</subparagraph><subparagraph id="HC2FB8BC51B834EFBB579532F9C3DD031"><enum>(B)</enum><text>transfer excess
				property under its control to other Federal agencies and to organizations
				specified in section 321(c)(2) of this title; and</text>
								</subparagraph><subparagraph id="H0BA8BC7AFFCE4923B16EC9AA1E75C300"><enum>(C)</enum><text>obtain excess
				properties from other Federal agencies to meet mission needs before acquiring
				non-Federal
				property.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HDD7ACC917DB84E9CA7D2154F14D47B67"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The item relating to section 524 in the table of
			 sections at the beginning of chapter 5 of such title is amended to read as
			 follows:</text>

			 report</header>
				<paragraph id="H2D6C6AD71BEC4BEA9857D8349C5ED2F4"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than three
			 years after the date of the enactment of this Act, the Administrator of General
			 Services shall submit a report to the Committee on Oversight and Government
			 Reform of the House of Representatives and the Committee on Homeland Security
			 and Governmental Affairs of the Senate on the implementation of section 524, as
			 amended by subsection (a), and each of the following:</text>
					<subparagraph id="H56C1FAF133B54491A28F6E9DD545DB77"><enum>(A)</enum><text>The efforts of
			 each executive agency to reduce such agency’s real property assets, based on
			 data submitted from such agency.</text>
					</subparagraph><subparagraph id="HD111325FF7E846BE90D1C877AA31B148"><enum>(B)</enum><text display-inline="yes-display-inline">For each excess and surplus real property
			 facility/installation disposed of, an indication of—</text>
						<clause id="H67CD0674B0F04874885091F4D412E3B5"><enum>(i)</enum><text>the
			 date and method of disposal;</text>
						</clause><clause id="H9F14394470B34D49B1DB533AFA6B6EB0"><enum>(ii)</enum><text>the
			 proceeds obtained from the disposition of such property;</text>
						</clause><clause id="H773A2211729A4361BD57E318CE3CB511"><enum>(iii)</enum><text>the amount of
			 time required to fully dispose of excess and surplus real property under the
			 custody and control of all executive agencies; and</text>
						</clause><clause id="HB60CF5990A734F799BAC61C4869306E8"><enum>(iv)</enum><text>the
			 cost to dispose of surplus and excess real property under the custody and
			 control of all executive agencies.</text>
						</clause></subparagraph></paragraph><paragraph id="H9DAA76E07E574CBCBCC6BA1474760258"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">The terms <term>excess property</term>,
			 <term>executive agency</term>, and <term>surplus property</term> have the
			 meanings given those terms in <external-xref legal-doc="usc" parsable-cite="usc/40/102">section 102</external-xref> of title 40, United States Code.</text>
				</paragraph></subsection></section><section id="H2BB0C3DAA89B47C2864BE35199E4D902"><enum>4.</enum><header>Enhanced
			 authorities with regard to preparing properties to be reported as
			 excess</header><text display-inline="no-display-inline">Section 572(a)(2) of
			 title 40, United States Code, is amended—</text>
			<paragraph id="H9782BE5ED72E4553BB28A8CF95BD8665"><enum>(1)</enum><text>by redesignating
			 subparagraphs (B) and (C) as subparagraphs (C) and (D), respectively;
			 and</text>
			</paragraph><paragraph id="H03F808CF3B6D4961A3F83540E8732895"><enum>(2)</enum><text>by inserting after
			 subparagraph (A) the following new subparagraph:</text>
				<quoted-block id="H4CCEC0CE753640768D7F7A1BC094A867" style="USC">
					<subparagraph id="HE3AABF8BA4FC4CCAB778C790970B13C4"><enum>(B)</enum><header>Additional
				authority</header><clause commented="no" display-inline="yes-display-inline" id="HE1BF841F04C249EBB3ECCA935BC5DF06"><enum>(i)</enum><text>From the fund described
				in paragraph (1), subject to clause (iv) of this subparagraph, the
				Administrator may obligate an amount to pay the direct and indirect costs
				related to identifying and preparing properties to be reported excess by
				another agency.</text>
						</clause><clause id="HD08577500E154C3EB81E3ED42D3A5976" indent="up1"><enum>(ii)</enum><text>The General Services
				Administration shall be reimbursed from the proceeds of the sale of such
				properties for such costs.</text>
						</clause><clause id="H99643057EC2142519B7668DA51E27AFF" indent="up1"><enum>(iii)</enum><text>Net proceeds shall be dispersed
				pursuant to section 571 of this title.</text>
						</clause><clause id="H10587AEDCC78499B9CD1C4C106159CB2" indent="up1"><enum>(iv)</enum><text>The authority under clause (i) to
				obligate funds to prepare properties to be reported excess does not include the
				authority to convey such properties by use, sale, lease, exchange, or
				otherwise, including through leaseback arrangements or service
				agreements.</text>
						</clause><clause id="HC0841199981D4DE1802A7E9EEB5697ED" indent="up1"><enum>(v)</enum><text>Nothing in this subparagraph is
				intended to affect subparagraph
				(D).</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" id="H26AF6469EC9142C481B7ADE4EC99528E"><enum>5.</enum><header>Enhanced
			 authorities with regard to reverted real property</header>
			<subsection commented="no" id="HACFF1F9141E94E909720896CE19AA4A5"><enum>(a)</enum><header>Authority To pay
			 expenses related to reverted real property</header><text>Section 572(a)(2)(A)
			 of title 40, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block id="HCBC8E02B057344829E1875F902D7B0EA" style="USC">
					<clause commented="no" id="H1ECD1224E1B5424AB48EBCA8109F8190"><enum>(iv)</enum><text>The direct and
				indirect costs associated with the reversion, custody, and disposal of reverted
				real
				property.</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H494417AA076045A19495946D13F6AD58"><enum>(b)</enum><header>Requirements
			 related to sales of reverted property under section 550</header><text>Section
			 550(b)(1) of title 40, United States Code, is amended—</text>
				<paragraph commented="no" id="HC272893068F34B64AA9A218B35AF496A"><enum>(1)</enum><text>by inserting
			 <quote>(A)</quote> after <quote>(1)
			 <header-in-text level="paragraph" style="OLC">In
			 general.—</header-in-text></quote>; and</text>
				</paragraph><paragraph commented="no" id="HFC63D274C30F44759D54BE9318747CE4"><enum>(2)</enum><text>by adding at the
			 end the following: “If the official, in consultation with the Administrator,
			 recommends reversion of the property, the Administrator shall take control of
			 such property, and, subject to subparagraph (B), sell it at or above appraised
			 fair market value for cash and not by lease, exchange, leaseback arrangements,
			 or service agreements.</text>
					<quoted-block id="HB375B828175C489FA35B6D957717AC6C" style="USC">
						<subparagraph commented="no" id="H127F19614C2A4CED9C587094421AE220" indent="up1"><enum>(B)</enum><text>Prior to sale, the Administrator shall
				make such property available to State and local governments and certain
				non-profit institutions or organizations pursuant to this section and sections
				553 and 554 of this
				title.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H31E28CF2C43F4F199F795BEE56D56BEE"><enum>(c)</enum><header>Requirements
			 related to sales of reverted property under section 553</header><text>Section
			 553(e) of title 40, United States Code, is amended—</text>
				<paragraph commented="no" id="H1FB7E7D5F6B74185842616249DECB472"><enum>(1)</enum><text>by inserting
			 <quote>(1)</quote> after <quote><header-in-text level="subsection" style="OLC">This Section.—</header-in-text></quote>; and</text>
				</paragraph><paragraph commented="no" id="H89E143204D18497BA08BE7EF7AECAA96"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="yes-display-inline" id="HA5B155C5CB10459AA6CEC13E49AF9275" style="OLC">
						<text>If the Administrator
			 determines that reversion of the property is necessary to enforce compliance
			 with the terms of the conveyance, the Administrator shall take control of such
			 property and, subject to paragraph (2), sell it at or above appraised fair
			 market value for cash and not by lease, exchange, leaseback arrangements, or
			 service agreements.</text><paragraph commented="no" id="H4101E7817F674964BDCA792234A3E837" indent="up1"><enum>(2)</enum><text>Prior to sale, the Administrator
				shall make such property available to State and local governments and certain
				non-profit institutions or organizations pursuant to this section and sections
				550 and 554 of this
				title.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H70FC6580C30641619ADEA1476B54340E"><enum>6.</enum><header>Agency retention
			 of proceeds</header><text display-inline="no-display-inline">The text of
			 <external-xref legal-doc="usc" parsable-cite="usc/40/571">section 571</external-xref> of title 40, United States Code, is amended to read as
			 follows:</text>
			<quoted-block id="H498B59AF16D64102B7CB54548400C5F3" style="USC">
				<subsection id="HBCFB43307333416E9BEEA1BEE9B9A3AC"><enum>(a)</enum><header>Proceeds from
				transfer or sale of real property</header>
					<paragraph id="H270DB37783D24B5E8F7171813F4D743A"><enum>(1)</enum><header>Deposit of net
				proceeds</header><text>Net proceeds described in subsection (d) shall be
				deposited into the appropriate real property account of the agency that had
				custody and accountability for the real property at the time the real property
				is determined to be excess.</text>
					</paragraph><paragraph id="H7E9F48C38FD041069846371B8810F19D"><enum>(2)</enum><header>Expenditure of
				net proceeds</header><text>The net proceeds deposited pursuant to paragraph (1)
				may only be expended as authorized in annual appropriations Acts, for
				activities described in sections 543 and 545 of this title, including paying
				costs incurred by the General Services Administration for any disposal-related
				activity authorized by this title.</text>
					</paragraph><paragraph id="H721BE5AAD90C419D993DFCE6814B196B"><enum>(3)</enum><header>Deficit
				reduction</header><text>Any net proceeds described in subsection (d) from the
				sale, lease, or other disposition of surplus real property that are not
				expended under paragraph (2) shall be used for deficit reduction.</text>
					</paragraph></subsection><subsection id="HA2BD3374DDF54E5EA8958B56FD42B66C"><enum>(b)</enum><header>Effect on other
				sections</header><text>Nothing in this section is intended to affect section
				572(b), 573, or 574 of this title.</text>
				</subsection><subsection id="H8DE00E9CB88B45ADA56F10610C574918"><enum>(c)</enum><header>Disposal agency
				for reverted property</header><text>For the purposes of this section, for any
				real property that reverts to the United States under sections 550 and 553 of
				this title, the General Services Administration, as the disposal agency, shall
				be treated as the agency with custody and accountability for the real property
				at the time the real property is determined to be excess.</text>
				</subsection><subsection id="HFE22AE69086E4CE08031932FC3AFE69C"><enum>(d)</enum><header>Net
				proceeds</header><text>The net proceeds described in this subsection are
				proceeds under this chapter, less expenses of the transfer or disposition as
				provided in section 572(a) of this title, from a—</text>
					<paragraph id="HDAD6D245A37F43A598A01C4CF5CE0DDC"><enum>(1)</enum><text>transfer of excess
				real property to a Federal agency for agency use; or</text>
					</paragraph><paragraph id="HA4A49C07A7CD46A4A0EBF4DC0D5E4995"><enum>(2)</enum><text>sale, lease, or
				other disposition of surplus real property.</text>
					</paragraph></subsection><subsection id="HB7976EE9C61C4F7084A7B2E667CA7CD1"><enum>(e)</enum><header>Proceeds from
				transfer or sale of personal property</header>
					<paragraph id="H75820F9BB10040408E03D3AA6AA89C19"><enum>(1)</enum><header>In
				general</header><text>Except as otherwise provided in this subchapter, proceeds
				described in paragraph (2) shall be deposited in the Treasury as miscellaneous
				receipts.</text>
					</paragraph><paragraph id="H0C51B7E2452844E6BE8FA8925FFE818D"><enum>(2)</enum><header>Proceeds</header><text>The
				proceeds described in this paragraph are proceeds under this chapter
				from—</text>
						<subparagraph id="HD431745773404CA4930D1ECFE2F5D11B"><enum>(A)</enum><text>a transfer of
				excess personal property to a Federal agency for agency use; or</text>
						</subparagraph><subparagraph id="H9603966D849C4223998F12C3FA050B21"><enum>(B)</enum><text>a sale, lease, or
				other disposition of surplus personal property.</text>
						</subparagraph></paragraph><paragraph id="H12BAAE5E4FD548BFB4DCCFBF9F773051"><enum>(3)</enum><header>Payment of
				expenses of sale before deposit</header><text>Subject to regulations under this
				subtitle, the expenses of the sale of personal property may be paid from the
				proceeds of sale so that only the net proceeds are deposited in the Treasury.
				This paragraph applies whether proceeds are deposited as miscellaneous receipts
				or to the credit of an appropriation as authorized by
				law.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HF6E0CE63A5184DF09A6AC8EE1970E893"><enum>7.</enum><header>Federal real
			 property database</header>
			<subsection id="HBF3665661A224E0589AD0ACC810EAB70"><enum>(a)</enum><header>In
			 general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/5">chapter 5</external-xref> of title 40, United States
			 Code, is amended by adding at the end the following new section:</text>
				<quoted-block id="HA0114FB6A0384C24918FFD516AD46723" style="USC">
					<section id="H4EDD0737000E455DA270F6654C31F787"><enum>530.</enum><header>Federal real
				property database</header>
						<subsection id="H3DEFBE9184ED457C9DDAC12438B7924F"><enum>(a)</enum><header>Database
				required</header><text>Not later than one year after the date of the enactment
				of this section, the Administrator of General Services shall publish a single,
				comprehensive, and descriptive database of all Federal real property under the
				custody and control of all executive agencies, other than Federal real property
				excluded for reasons of national security, in accordance with subsection
				(b).</text>
						</subsection><subsection id="H8DC8577FCE664A81942DF94487B4DB7F"><enum>(b)</enum><header>Required
				information for database</header><text>The Administrator shall collect from the
				head of each executive agency descriptive information, except for classified
				information, of the nature, use, and extent of the Federal real property of
				each such agency, including the following:</text>
							<paragraph id="H2D72F1D69A0444C8A780D224801845E0"><enum>(1)</enum><text>The geographic
				location of each Federal real property of each such agency, including the
				address and description for each such property.</text>
							</paragraph><paragraph id="H5AE7B9390E6C424C8E706AF88DCD7B27"><enum>(2)</enum><text>The total size of
				each Federal real property of each such agency, including square footage and
				acreage of each such property.</text>
							</paragraph><paragraph id="H0F302F3D59724305AE77BA175416BF13"><enum>(3)</enum><text>The relevance of
				each Federal real property to the agency’s mission.</text>
							</paragraph><paragraph id="H5FBD9F449FDF4E51829265ED9397245A"><enum>(4)</enum><text>The level of use
				of each Federal real property for each such agency, including whether such
				property is excess, surplus, underutilized, or unutilized.</text>
							</paragraph><paragraph id="H2B82E3968B3241218338B379E2ED19E3"><enum>(5)</enum><text>The number of days
				each Federal real property is designated as excess, surplus, underutilized, or
				unutilized.</text>
							</paragraph><paragraph id="H01C791488A994EC7BEE450D29DD5C867"><enum>(6)</enum><text>The annual
				operating costs of each Federal real property.</text>
							</paragraph><paragraph id="H8C95F94B8F4C47F0B7995691891E3FA6"><enum>(7)</enum><text>The replacement
				value of each Federal real property.</text>
							</paragraph></subsection><subsection id="H58B54A2C191F4FC09D2C0F42FCFEC510"><enum>(c)</enum><header>Access to
				database</header>
							<paragraph id="HEE1EEF4009FE43B5A02014E04967886B"><enum>(1)</enum><header>Federal
				agencies</header><text>The Administrator shall, in consultation with the
				Director of the Office of Management and Budget, make the database established
				and maintained under this section available to other Federal agencies.</text>
							</paragraph><paragraph id="H02A31B3C31A34B1782C336A0974CFC6C"><enum>(2)</enum><header>Public
				access</header><text>To the extent consistent with national security, the
				database shall be accessible by the public at no cost through the Web site of
				the General Services Administration.</text>
							</paragraph></subsection><subsection id="H9F5BEF939EB34B8786DFF8A60E394771"><enum>(d)</enum><header>Transparency of
				database</header><text>To the extent practicable, the Administrator shall
				ensure that the database—</text>
							<paragraph id="H52DFA61C317445B89D08EC388129294C"><enum>(1)</enum><text display-inline="yes-display-inline">uses an open, machine-readable format;</text>
							</paragraph><paragraph id="HBB48A7D069884589B6C78DE199E1A896"><enum>(2)</enum><text>permits users to
				search and sort Federal real property data; and</text>
							</paragraph><paragraph id="H91ADA6E28CBC4F6D9E7697EE215ECFBF"><enum>(3)</enum><text>includes a means
				to download a large amount of Federal real property data and a selection of
				such data retrieved using a search.</text>
							</paragraph></subsection><subsection id="HFDF66F863A6B42A29DBA581CE128B572"><enum>(e)</enum><header>Applicability</header><text>Nothing
				in this section may be construed to require an agency to make available to the
				public information that is exempt from disclosure pursuant to section 552(b) of
				title
				5.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HCCF1B4639E5545BDBD56E4D6B437005C"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 5 of
			 title 40, United States Code, is amended by inserting after the item relating

			 Code, is amended by adding at the end the following new section:</text>

					<section id="H718910A8E7F8418AA05C6E855017CB61"><enum>560.</enum><header>Sustainable
				disposal of property</header><text display-inline="no-display-inline">The head
				of each Federal agency shall divert at least 50 percent of construction and
				demolition materials and debris by the end of fiscal year
				2015.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H81EADD7C890A49C9A9DAC1F3D9420526"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 5 of

			 Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11411">42 U.S.C. 11411</external-xref>) is amended—</text>
			<paragraph commented="no" id="H4CDC016C0EA342A58D01D9E4D67D0233"><enum>(1)</enum><text>in subsection (a),
			 by adding at the end the following new sentence: <quote>Agencies shall not be
			 required to submit information to the Secretary regarding properties located in
			 an area for which the general public is denied access in the interest of
			 national security.</quote>;</text>
			</paragraph><paragraph commented="no" id="H3D9542A58BCB44D3AE3A11DEDAEC22A4"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)(1)(A), by striking
			 <quote>in the Federal Register</quote> and inserting the following: <quote>on
			 the Web site of the Department of Housing and Urban Development or the General
			 Services Administration</quote>; and</text>
			</paragraph><paragraph commented="no" id="HF8BCB3DC49E248F98BCDE6AFE59A468D"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (d)(3), by adding at the end
			 the following new sentence: <quote>If no such review of the determination is
			 requested within the 20-day period, such property will not be included in
			 subsequent publications unless the landholding agency reclassifies the property
			 as available and the Secretary subsequently determines the property is
			 suitable.</quote>.</text>
