		<section id="H79EF06B3738B4324B339CA5CC6AF48E8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Accountability of Taxpayer Funding for
			 Afghanistan Fuels Act of 2013</short-title></quote>.</text>
		</section><section id="HBCCF0DD5EE774B63942B5B5B8C57F28B"><enum>2.</enum><header>Requirements
			 relating to provision of covered products to the Government of
			 Afghanistan</header>
			<subsection id="H2C005268CA804984BA667DC53C0BD40B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">No covered product
			 may be provided directly or indirectly to the Government of Afghanistan unless
			 and until the Secretary of Defense submits to Congress a report that
			 contains—</text>
				<paragraph id="HA3ABE2087FF04865A556FE3A3CDA43EF"><enum>(1)</enum><text>a
			 determination of the Secretary that the requirements described in subsection
			 (b) have been met; and</text>
				</paragraph><paragraph id="H96875F452E2C4C739AB3A90CFADE2812"><enum>(2)</enum><text>a
			 detailed justification for such determination.</text>
				</paragraph></subsection><subsection id="H5C52219C175941128915304579B9888A"><enum>(b)</enum><header>Requirements</header><text>The
			 requirements described in this subsection are the following:</text>
				<paragraph id="HB9DACE01BDDA41DFA33851F3701F0B39"><enum>(1)</enum><text>The provision of
			 the covered product meets an existing or future need of the Government of
			 Afghanistan.</text>
				</paragraph><paragraph id="H2205BC4C80BE480594AC206F357F4CE0"><enum>(2)</enum><text>The financial
			 documents relating to the provision of the covered product are fully accounted
			 for and will be maintained by the Department of Defense for a period of not
			 less than 10 years.</text>
				</paragraph><paragraph id="H6D1003F04FB64C6A831A1077FF69886F"><enum>(3)</enum><text>The Department of
			 Defense has established controls to monitor the use of the covered
			 product.</text>
				</paragraph></subsection><subsection id="H882F55B2A122441980522BF983E01D28"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">This section takes
			 effect 60 days after the date of the enactment of this Act and applies with
			 respect to the provision of a covered product on or after 60 days after such
			 date of enactment.</text>
			</subsection></section><section id="HE1563CE8BA3B41149C4B89615E0DE309"><enum>3.</enum><header>Prohibition on
			 financing assistance for purposes of procuring any covered product for use by
			 the Government of Afghanistan</header>
			<subsection id="H9A92AE2918D84FD1BE3834F2E2C1D99B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">No funds available to
			 the Department of Defense may be provided directly or indirectly to the
			 Government of Afghanistan for purposes of procuring any covered product unless
			 and until the Secretary of Defense submits to Congress a report that
			 contains—</text>
				<paragraph id="H7FE70DB27AA844799606EB8C4B6D5F77"><enum>(1)</enum><text>a
			 determination of the Secretary that the requirements described in subsection
			 (b) have been met; and</text>
				</paragraph><paragraph id="H06A55A81414143F6A3A7B3B864E94F70"><enum>(2)</enum><text>a
			 detailed justification for such determination.</text>
				</paragraph></subsection><subsection id="HE5406E66339143819FDD13D93DFE77A9"><enum>(b)</enum><header>Requirements</header><text>The
			 requirements described in this subsection are the following:</text>
				<paragraph id="H841624606C8544FBAD4D4727AC78E08A"><enum>(1)</enum><text display-inline="yes-display-inline">The Government of Afghanistan is capable of
			 providing reliable accounting and reporting to the Department of Defense with
			 respect to the purchase, delivery, and consumption of a covered product.</text>
				</paragraph><paragraph id="H37686D557D0345AB93AEA57BACEE6C47"><enum>(2)</enum><text display-inline="yes-display-inline">The Special Inspector General for
			 Afghanistan Reconstruction or beginning on the date described in subsection (c)
			 the Inspector General of the Department of Defense has certified to the
			 Secretary of Defense that the requirements described in paragraph (1) have been
			 met.</text>
				</paragraph></subsection><subsection id="H8AAD628951084B34817E599E31AC2C56"><enum>(c)</enum><header>Date
			 described</header><text>The date described in this subsection is the date of
			 termination of the Office of the Special Inspector General for Afghanistan
			 Reconstruction as required under section 1229 of the National Defense
			 Authorization Act for Fiscal Year 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/181">Public Law 110–181</external-xref>; 122 Stat.
			 378).</text>
			</subsection><subsection commented="no" id="H716054A1EA9A4794A29FBBFE823759FF"><enum>(d)</enum><header>Effective
			 date</header><text>This section takes effect on the date of the enactment of
			 this Act and applies with respect to funds available to the Department of
			 Defense that are unobligated or unexpended as of such date of enactment.</text>
			</subsection></section><section id="H588C8C7F41D945059E6A0076B2A74A21"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" id="H391AAD5A1E2C4F718EA135D1BA941BCE"><enum>(1)</enum><header>Covered
			 product</header><text display-inline="yes-display-inline">The term
			 <term>covered product</term> means petroleum, oil, or a lubricant (including
			 diesel fuel, gasoline, jet or aviation fuel, kerosene, or other fuels) or
			 firewood that is to be used for purposes of equipping, training, or sustaining
			 the Afghan National Security Forces.</text>
			</paragraph><paragraph id="H41E7D32492894E919DBAAF12834BC7A0"><enum>(2)</enum><header>Government of
			 Afghanistan</header><text>The term <term>Government of Afghanistan</term>
			 includes any agency of instrumentality of Afghanistan.</text>
