		<section commented="no" display-inline="no-display-inline" id="HB28A98002DB84174A0013BDAEF4915E6" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Muscogee Nation of Florida Federal
			 Recognition Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H6CFF51CD4CFB48CDBE27C931A1AF2764" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H6A2A7D5ACBFD4EE9B6B68C02DCD21979"><enum>(1)</enum><text display-inline="yes-display-inline">the Muscogee Nation of Florida is comprised
			 of lineal descendants of persons who were historically part of the Creek
			 Confederacy, which relocated from Daleville, Alabama, and other areas of
			 southern Alabama to the State of Florida between 1812 and 1887;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2B7E851529F045A18E9F153CD509B869"><enum>(2)</enum><text display-inline="yes-display-inline">those Creek persons settled in the north
			 Florida panhandle in autonomous communities (referred to in the constitution of
			 the Muscogee Nation as <quote>Townships</quote>), continuing the lifestyle and
			 traditions practiced by the historic Creek Nation of Alabama and
			 Georgia;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H286533EF864C4E7BA558952C02317843"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H462DA83258784A8181A58D6BED7EEFEF"><enum>(A)</enum><text display-inline="yes-display-inline">on dissolution of the Creek Confederacy,
			 the ancestors of current members of the Muscogee Nation of Florida relocated
			 and reestablished home sites, traditions, ceremonial centers, tribal government
			 (including through the traditional appointment of tribal leaders), and tribal
			 economy in rural areas of the State of Florida;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE3662DFFDF6F4E6A924D5B54412C2666" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the relocation described in subparagraph
			 (A) did not prevent the Nation from—</text>
					<clause commented="no" display-inline="no-display-inline" id="H4D3EFF9354534C71994346D6020FADE4"><enum>(i)</enum><text display-inline="yes-display-inline">continuing to exercise the governing powers
			 of the Nation;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H382A8FE53C04436CB43DC5473C5FB029"><enum>(ii)</enum><text display-inline="yes-display-inline">providing services to members of the
			 Nation; or</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H1BC13F6B83834F89BAEBAA6A369AC4C2"><enum>(iii)</enum><text display-inline="yes-display-inline">enjoying the communal lifestyle of the
			 Nation; and</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE091E2A88E324866B7F7D73882E07507" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">some members of the Nation remain on
			 original home sites of their Creek ancestors;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC8017E6F646943C886991C07728DA329"><enum>(4)</enum><text display-inline="yes-display-inline">members of the Nation—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HB393879EE86F4AFB908934002DDF78ED"><enum>(A)</enum><text display-inline="yes-display-inline">participated in the 1814 Treaty of Ft.
			 Jackson and the Apalachicola Treaty of October 11, 1832; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5722CEBB9FE34A0E850E4D876EE628B4"><enum>(B)</enum><text display-inline="yes-display-inline">were included in the Abbott-Parsons Creek
			 Census, dated 1832 and 1833;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFD22E9B78B974AA7A08095B314789EC5"><enum>(5)</enum><text display-inline="yes-display-inline">members of the Nation have established an
			 ancestral claim to land taken from the Nation by General Andrew Jackson in the
			 aftermath of the War of 1812 pursuant to the 1814 Treaty of Ft. Jackson;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H895F51E81E98480DA3A0BB30E4408828"><enum>(6)</enum><text display-inline="yes-display-inline">beginning in 1971, the Secretary of the
			 Interior distributed to members of the Nation in 3 actions per capita payments
			 for land claim settlements;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD6D3327796224B929D1002F6D6E99F42"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HF4BCFC9366E7456C930A7A9ED1E745D3"><enum>(A)</enum><text display-inline="yes-display-inline">in 1974, the State of Florida established
			 the Northwest Florida Creek Indian Council to manage issues relating to Creek
			 Indians in northwest Florida; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4EA93143AA694E5E9033A1A2CBEF6997" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">in 1978, the Council held an election for
			 representatives to the tribal government known as the <quote>Florida Tribe of
			 Eastern Creek Indians</quote>, which is now the Muscogee Nation of
			 Florida;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H77DFB72B08044C06B31D264A23AB7FEA"><enum>(8)</enum><text display-inline="yes-display-inline">the community of Bruce in Walton County,
			 Florida, has been a governing center for the Nation for more than 150
			 years;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H07EBCDC7702E40AD808186EBACB710CF"><enum>(9)</enum><text display-inline="yes-display-inline">in the community of Bruce, the
			 Nation—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HAB89A0F2CCAF44EBBE02507C4FBE05E0"><enum>(A)</enum><text display-inline="yes-display-inline">beginning in the early 1860s, used and
			 maintained the Antioch Cemetery, which remains in use by members of the Nation
			 as of the date of enactment of this Act;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC98588A582F345A281A475E00F5FE0D3"><enum>(B)</enum><text display-inline="yes-display-inline">between 1895 and 1947, maintained a school
			 that was attended by members of the Nation;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC67A5EA0DE824D29A80D57713FA51634"><enum>(C)</enum><text display-inline="yes-display-inline">in 1912, established a church that is
			 recognized by the Methodist Conference as a Native American church; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6955B1E8256B446C8EF63315A01E270F"><enum>(D)</enum><text display-inline="yes-display-inline">maintained a ceremonial area on Bruce Creek
			 that was attended until the late 1920s;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H551604D4E7B04A7FAF149828777AC58E"><enum>(10)</enum><text display-inline="yes-display-inline">the ceremonial area of the Nation, as in
			 existence on the date of enactment of this Act—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HB3075D7AE4AC4A74B305CEF229AC8DD2"><enum>(A)</enum><text display-inline="yes-display-inline">is located in the community of Blountstown,
			 Florida, one of the reservations referred to in the Apalachicola Treaty of
			 October 11, 1832; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD85D9A59072B4A4F97594F0CED7297CB"><enum>(B)</enum><text display-inline="yes-display-inline">is the site of continuing ceremonies, such
			 as Green Corn, and traditional events;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEEE909D2519F494AB76C95701AAF9B44"><enum>(11)</enum><text display-inline="yes-display-inline">local governments have recognized the
			 community of Bruce as the center of tribal government of the Nation; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB0D95EDEF3A14B479CBC410DDC7AABF2"><enum>(12)</enum><text display-inline="yes-display-inline">during the 30-year period preceding the
			 date of enactment of this Act, the Nation has received Federal, State, and
			 local grants, and entered into contracts, to provide services and benefits to
			 members of the Nation.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="HAFC822B489AD41209722B00B42006127" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H0FBB0B74DE894E07B8CAA3CC16854C38"><enum>(1)</enum><header display-inline="yes-display-inline">Member</header><text display-inline="yes-display-inline">The term <term>member</term> means—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H42DB1331A6414D998F843E4B90D454FE"><enum>(A)</enum><text display-inline="yes-display-inline">an individual who is an enrolled member of
			 the Nation as of the date of enactment of this Act; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFE04E58BA2B74840B8834E33B97FC831"><enum>(B)</enum><text display-inline="yes-display-inline">an individual who has been placed on the
			 membership rolls of the Nation in accordance with this Act.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H28D6A0A95A89481FBD497C515428B385"><enum>(2)</enum><header display-inline="yes-display-inline">Nation</header><text display-inline="yes-display-inline">The term <term>Nation</term> means the
			 Muscogee Nation of Florida (formerly known as the <quote>Florida Tribe of
			 Eastern Creek Indians</quote>).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2B1BA4A4D1B3412D80D1B9E363FA93B2"><enum>(3)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of the Interior.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAD70FD8951BB4887802635E2790E1D2D"><enum>(4)</enum><header display-inline="yes-display-inline">Tribal
			 Council</header><text display-inline="yes-display-inline">The term <term>Tribal
			 Council</term> means the governing body of the Nation.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H09A65770898F4D96B302A638CBCD893C" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Federal recognition</header>
			<subsection commented="no" display-inline="no-display-inline" id="H48CB08EEF3AF42329151ABF0467D9CF2"><enum>(a)</enum><header display-inline="yes-display-inline">Recognition</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HAA35B48483904529B978134FB7244E58"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Federal recognition is extended to the
			 Nation.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC97D734BC40C48BF97D8BAD478B4A82D"><enum>(2)</enum><header display-inline="yes-display-inline">Applicability of laws</header><text display-inline="yes-display-inline">All laws (including regulations) of the
			 United States of general applicability to Indians or nations, Indian tribes, or
			 bands of Indians (including the Act of June 18, 1934 (<external-xref legal-doc="usc" parsable-cite="usc/25/461">25 U.S.C. 461 et seq.</external-xref>))
			 that are not inconsistent with this Act shall be applicable to the Nation and
			 members.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H45C7C00AD99B45AFAC3C3B7FD071750C"><enum>(b)</enum><header display-inline="yes-display-inline">Federal services and benefits</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H6EF04C7D13FF49BA9CAF98508DA4A9DF"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">On and after the date of enactment of this
			 Act, the Nation and members shall be eligible for all services and benefits
			 provided by the Federal Government to federally recognized Indian tribes
			 without regard to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HD7B487AE071940B0BD87125A50B404E3"><enum>(A)</enum><text display-inline="yes-display-inline">the existence of a reservation for the
			 Nation; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H073AE421CBA842BEA9AB0CB38BC33814"><enum>(B)</enum><text display-inline="yes-display-inline">the location of the residence of any member
			 on or near any Indian reservation.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H750C01F1D7634F31825C1CFC0EF0CC64"><enum>(2)</enum><header display-inline="yes-display-inline">Service area</header><text display-inline="yes-display-inline">For the purpose of the delivery of Federal
			 services to members, the service area of the Nation shall be considered to
			 be—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H998E748EC6BA47D5AB2D62723672A5D8"><enum>(A)</enum><text display-inline="yes-display-inline">the community of Bruce in Walton County,
			 Florida; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0925CA9243B3408F9B3F96EBBD65CA19"><enum>(B)</enum><text display-inline="yes-display-inline">an area in the State of Florida in which
			 members reside that is bordered—</text>
						<clause commented="no" display-inline="no-display-inline" id="H35D01A2B4993442C98B69A42DFA017B4"><enum>(i)</enum><text display-inline="yes-display-inline">on the west by the Escambia River;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H60F71893D02A499E8A3DA54319ECA6E1"><enum>(ii)</enum><text display-inline="yes-display-inline">on the east by the St. Marks River.</text>
						</clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H9F50DE5269714C53BFB000885C6D129B" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Constitution and bylaws</header>
			<subsection commented="no" display-inline="no-display-inline" id="HB46104C364C64068AE5A8496AEC58F00"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The constitution and bylaws of the Nation
			 shall be the constitution and bylaws of the Tribal Council dated January 21,
			 2001 (including amendments), as submitted to the Secretary for approval on
			 recognition.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HB4016A5E503E4C189625A245363D2E7F"><enum>(b)</enum><header display-inline="yes-display-inline">New constitution and bylaws</header><text display-inline="yes-display-inline">On receipt of a written request of the
			 Tribal Council, the Secretary shall hold a referendum for members for the
			 purpose of adopting a new constitution and bylaws, in accordance with section
			 16 of the Act of June 18, 1934 (<external-xref legal-doc="usc" parsable-cite="usc/25/476">25 U.S.C. 476</external-xref>).</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H063283342D884C2484E4DD5A514B4200" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Tribal
			 Council</header><text display-inline="no-display-inline">The Tribal
			 Council—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HE452063EB3104A8491ED419D92CBFB2F"><enum>(1)</enum><text display-inline="yes-display-inline">shall represent the Nation and members;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF00AA40D44134C05BAFEF14936842462"><enum>(2)</enum><text display-inline="yes-display-inline">may—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H82F04431CF7545F78D0823716D67A410"><enum>(A)</enum><text display-inline="yes-display-inline">enter into any contract, grant agreement,
			 or other agreement with any Federal department or agency;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3C884F1497B64CA1AC066481611F8E2B"><enum>(B)</enum><text display-inline="yes-display-inline">carry out or administer such programs as
			 the Tribal Council determines to be appropriate to carry out the contracts and
			 agreements; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H20A05D94446A4127A8E6FC68BFEA5D6E"><enum>(C)</enum><text display-inline="yes-display-inline">designate a successor in interest pursuant
			 to a new constitution or bylaw of the Nation adopted under section 5(b).</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="HDA677E93DD5B41B2B217464331AA97D8" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Membership roll</header><text display-inline="no-display-inline">The membership roll of the Nation shall be
			 determined in accordance with the membership criteria established by the
			 ordinance of the Nation numbered 04–01–100 and dated February 7, 2004.</text>
		</section><section id="HF12A3C44186E42B8AF8E302CD178DCE6"><enum>8.</enum><header>Land in
			 trust</header><text display-inline="no-display-inline">The Secretary is
			 authorized to take land in trust on behalf of the Muscogee Nation of Florida
			 pursuant to part 151 of title 25, Code of Federal Regulations.</text>
