establish the Office of the Constitutional Advocate to provide advocacy in cases before courts established by the Foreign Intelligence Surveillance Act of 1978, and for other purposes.</official-title></form><legis-body id="HD2BF0C0D022B4284A767104C556AFF7D" style="OLC"><section id="H6CB139B6753B4E089BF41CA10E6BD0E5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>FISA Court Reform Act of 2013</short-title></quote>.</text></section><section id="HAF120C6FF6464E50BFB4BF2DC8C0AC29"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H7117AE188B7346D49D2AB143DF78AADB"><enum>(1)</enum><header>Constitutional Advocate</header><text>The term <term>Constitutional Advocate</term> means the Constitutional Advocate appointed under section 3(b).</text></paragraph><paragraph id="HFC6BDE41C4574A10A6375FCF2522C5CF"><enum>(2)</enum><header>Decision</header><text>The term <term>decision</term> means a decision, order, or opinion issued by the FISA Court or the FISA Court of Review.</text></paragraph><paragraph id="H92A82D32256A40EE9468413D26AFC9D5"><enum>(3)</enum><header>FISA</header><text>The term <term>FISA</term> means the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1801">50 U.S.C. 1801 et seq.</external-xref>).</text></paragraph><paragraph id="H01A14BE048CD44D5979758C7080D52DC"><enum>(4)</enum><header>FISA Court</header><text>The term <term>FISA Court</term> means the court established under section 103(a) of FISA (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(a)</external-xref>).</text></paragraph><paragraph id="H5CAE0E45F99F4BE99F0FB5C7A49D7356"><enum>(5)</enum><header>FISA Court of Review</header><text>The term <term>FISA Court of Review</term> means the court of review established under section 103(b) of FISA (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(b)</external-xref>).</text></paragraph><paragraph id="HF43DAD9CED2B4CADA1FE9075F82CB726"><enum>(6)</enum><header>Office</header><text>The term <term>Office</term> means the Office of the Constitutional Advocate established under section 3(a).</text></paragraph><paragraph id="H2587A8E556464C1D9D1E69DD32E373C5"><enum>(7)</enum><header>Petition review pool</header><text>The term <term>petition review pool</term> means the petition review pool established by section 103(e) of FISA (<external-xref legal-doc="usc" parsable-cite="usc/50/1803">50 U.S.C. 1803(e)</external-xref>) or any member of that pool.</text></paragraph><paragraph id="H874BAB36CB8B491392866D2948F451E5"><enum>(8)</enum><header>Significant construction or interpretation of law</header><text>The term <term>significant construction or interpretation of law</term> means a significant construction or interpretation of a provision, as that term is construed under section 601(c) of FISA (<external-xref legal-doc="usc" parsable-cite="usc/50/1871">50 U.S.C. 1871(c)</external-xref>).</text></paragraph></section><section id="HB74EC1FC69E64BFC9AF67C7EEA0C1A25"><enum>3.</enum><header>Office of the Constitutional Advocate</header><subsection id="H54247E55B07D45648A15B5E8489C7350"><enum>(a)</enum><header>Establishment</header><text>There is established within the judicial branch of the United States an Office of the Constitutional Advocate.</text></subsection><subsection id="H48CF58488B354CB2BA48E7D46C8EDD6F"><enum>(b)</enum><header>Constitutional Advocate</header><paragraph id="H72189FB778BA4AB8B6DBB910DEDE78E3"><enum>(1)</enum><header>In general</header><text>The head of the Office is the Constitutional Advocate.</text></paragraph><paragraph id="H10D675E9B0A546148C7E31600B2EEE08"><enum>(2)</enum><header>Appointment and term</header><subparagraph id="HE2FCDE026DD944A4A3BD90C45E3BB467"><enum>(A)</enum><header>Appointment</header><text>The Chief Justice of the United States shall appoint the Constitutional Advocate from the list of candidates submitted under subparagraph (B).</text></subparagraph><subparagraph id="HC346C4E03BF04F16B48D62A3760E2FCF"><enum>(B)</enum><header>Candidates</header><clause id="H731653B1E8434AF98280C32A3135361A"><enum>(i)</enum><header>List of candidates</header><text>The Privacy and Civil Liberties Oversight Board shall submit to the Chief Justice a list of not less than 5 qualified candidates to serve as a Constitutional Advocate.</text></clause><clause id="H8A440B63F90246C197E7DC440A320DB0"><enum>(ii)</enum><header>Selection of candidates</header><text>In preparing a list described in clause (i), the Privacy and Civil Liberties Oversight Board shall select candidates the Board believes will be zealous and effective advocates in defense of civil liberties and consider each potential candidate's—</text><subclause id="H99DA69553FA049A89BFA1EB6D0BF7FD1"><enum>(I)</enum><text>litigation and other professional experience;</text></subclause><subclause id="H74E6EAAFE1A546CE87C4A133DEA581C8"><enum>(II)</enum><text>experience with the areas of law the Constitutional Advocate is likely to encounter in the course of the Advocate's duties; and</text></subclause><subclause id="H3071509C149C4D61A2FF63A28A43278C"><enum>(III)</enum><text>demonstrated commitment to civil liberties.</text></subclause></clause></subparagraph><subparagraph id="H141ADE0CE8B44FFA8745B94523452677"><enum>(C)</enum><header>Security Clearance</header><text>An individual may be appointed Constitutional Advocate without regard to whether the individual possesses a security clearance on the date of the appointment.</text></subparagraph><subparagraph id="H58D8CE755EAF42DABCC2ED0BA7B41065"><enum>(D)</enum><header>Term and dismissal</header><text>A Constitutional Advocate shall be appointed for a term of 3 years and may be fired only for good cause shown, including the demonstrated inability to qualify for an adequate security clearance.</text></subparagraph><subparagraph id="H3D256F08583D4F608731E0256B8B0BC3"><enum>(E)</enum><header>Reappointment</header><text>There shall be no limit to the number of consecutive terms served by a Constitutional Advocate. The reappointment of a Constitutional Advocate shall be made in the same manner as appointment of a Constitutional Advocate.</text></subparagraph><subparagraph id="HA77A7678CCF148CD89F2F4362DEDD5BE"><enum>(F)</enum><header>Acting Constitutional Advocate</header><text>If the position of Constitutional Advocate is vacant, the Chief Justice may appoint an Acting Constitutional Advocate from among the qualified employees of the Office. If there are no such qualified employees, the Chief Justice may appoint an Acting Constitutional Advocate from the most recent list of candidates provided by the Privacy and Civil Liberties Oversight Board pursuant to subparagraph (B). The Acting Constitutional Advocate shall have all of the powers of a Constitutional Advocate and shall serve until a Constitutional Advocate is appointed.</text></subparagraph></paragraph><paragraph id="HFE677D80529A4A45A4AFFC2FC6CC5F25"><enum>(3)</enum><header>Employees</header><text>The Constitutional Advocate is authorized, without regard to the civil service laws and regulations, to appoint and terminate employees of the Office.</text></paragraph></subsection><subsection id="H38A9FE80A98C420B83F98DAA7B9215DB"><enum>(c)</enum><header>Security clearances</header><text>The appropriate departments, agencies, and elements of the executive branch shall cooperate with the Office, to the extent possible under existing procedures and requirements, to expeditiously provide the Constitutional Advocate and appropriate employees of the Office with the security clearances necessary to carry out the duties of the Constitutional Advocate.</text></subsection><subsection id="HF040A7EDCEF343DABD48F54B4ECE8A77"><enum>(d)</enum><header>Duties and authorities of the Constitutional Advocate</header><paragraph id="H05615A218046403DA4FF6F2674B8BC49"><enum>(1)</enum><header>In general</header><text>The Constitutional Advocate—</text><subparagraph id="H4CC559584AEE493A97D336A864C882C5"><enum>(A)</enum><text>shall review each application to the FISA Court by the Attorney General;</text></subparagraph><subparagraph id="HF2672F5C7AF64994994C912F5680CBCD"><enum>(B)</enum><text>shall review each decision of the FISA Court, the petition review pool, or the FISA Court of Review issued after the date of the enactment of this Act and all documents and other material relevant to such decision in a complete, unredacted form;</text></subparagraph><subparagraph id="H75A5477C855146FCBDCF88B42E02A15D"><enum>(C)</enum><text>may participate in a proceeding before the petition review pool if such participation is requested by a party in such a proceeding or by the petition review pool;</text></subparagraph><subparagraph id="H44083648483F44CA9F4FB1FDFA16B343"><enum>(D)</enum><text display-inline="yes-display-inline">shall consider any request from a provider who has been served with an order, certification, or directive compelling the provider to provide assistance to the Government or to release customer information to assist that provider in a proceeding before the FISA Court or the petition review pool, including a request—</text><clause id="H29360DBF0B8941669AAA4C8C86553A54"><enum>(i)</enum><text display-inline="yes-display-inline">to oppose the Government on behalf of the private party in such a proceeding; or</text></clause><clause id="HA65A61A33F274B36B5BA045404676C24"><enum>(ii)</enum><text display-inline="yes-display-inline">to provide guidance to the private party if the private party is considering compliance with an order of the FISA Court;</text></clause></subparagraph><subparagraph id="HB1347A372DC54A629BF020126B52B2A5"><enum>(E)</enum><text>shall participate in a proceeding before the FISA Court if appointed to participate by the FISA Court under section 4(a) and may participate in a proceeding before the petition review pool if authorized under section 5(a);</text></subparagraph><subparagraph id="HDAAA4EF748974EF298A6364D722C4B18"><enum>(F)</enum><text>may request to participate in a proceeding before the FISA Court or the petition review pool;</text></subparagraph><subparagraph id="H7FEA53CBD78048BBA4EECE44A44553C9"><enum>(G)</enum><text>shall participate in such a proceeding if such request is granted;</text></subparagraph><subparagraph id="HE7E2BD5E217044368D200027D7180170"><enum>(H)</enum><text>may request reconsideration of a decision of the FISA Court under section 4(b);</text></subparagraph><subparagraph id="HFB69C1A15CC34EDDAE9295FCA32F7848"><enum>(I)</enum><text>may appeal or seek review of a decision of the FISA Court, the petition review pool, or the FISA Court of Review, as permitted by this title; and</text></subparagraph><subparagraph id="HBE25601D157442D095B73BCA294A95ED"><enum>(J)</enum><text>shall participate in such appeal or review.</text></subparagraph></paragraph><paragraph id="HFC69D12539CD439580EF47573691999E"><enum>(2)</enum><header>Advocacy</header><text>The Constitutional Advocate shall protect individual rights by vigorously advocating before the FISA Court, the petition review pool, or the FISA Court of Review, as appropriate, in support of legal interpretations that minimize the scope of surveillance and the extent of data collection and retention.</text></paragraph><paragraph id="H7628208C70D6469B86F3D6D40FFB7434"><enum>(3)</enum><header>Utilization of outside counsel</header><text>The Constitutional Advocate—</text><subparagraph id="HC4CB3F7EF62D4D23921B8E4B74723297"><enum>(A)</enum><text>may delegate to a competent outside counsel any duty or responsibility of the Constitutional Advocate with respect to participation in a matter before the FISA Court, the FISA Court of Review, or the Supreme Court of the United States; and</text></subparagraph><subparagraph id="H3812A5C4D5C4417EADDD05E341D029B5"><enum>(B)</enum><text>may not delegate to outside counsel any duty or authority set out in subparagraph (A), (B), (D), (F), (H), or (I) of paragraph (1).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3CDE27F367F94D27B5F7C63EE4A0C5F3"><enum>(4)</enum><header>Availability of documents and material</header><text>The FISA Court, the petition review pool, or the FISA Court of Review, as appropriate, shall order any agency, department, or entity to make available to the Constitutional Advocate, or appropriate outside counsel if utilized by the Constitutional Advocate under paragraph (3), any documents or other material necessary to carry out the duties described in paragraph (1).</text></paragraph></subsection></section><section id="H737D989A9EDC4DC8B2067669317BEE0A"><enum>4.</enum><header>Advocacy before the FISA Court</header><subsection id="H430B80DADDEE4332938AA1BB4BA53B33"><enum>(a)</enum><header>Appointment To participate</header><paragraph id="H00EB5C832DF84CC3AFE7AB5AA70BE238"><enum>(1)</enum><header>In general</header><text>The FISA Court may appoint the Constitutional Advocate to participate in a FISA Court proceeding.</text></paragraph><paragraph id="H06097CD2766343C097E8AF80D1B1E245"><enum>(2)</enum><header>Standing</header><text>If the Constitutional Advocate is appointed to participate in a FISA Court proceeding pursuant to paragraph (1), the Constitutional Advocate shall have standing as a party before the FISA Court in that proceeding.</text></paragraph></subsection><subsection id="HFCA671285E664F508FD500E1A5071E35"><enum>(b)</enum><header>Reconsideration of a FISA Court decision</header><paragraph id="H9F423E8D10994F3EBD939A89D4E602D8"><enum>(1)</enum><header>Authority to move for reconsideration</header><text>The Constitutional Advocate may move the FISA Court to reconsider any decision of the FISA Court made after the date of the enactment of this Act by petitioning the FISA Court not later than 30 days after the date on which all documents and materials relevant to the decision are made available to the Constitutional Advocate.</text></paragraph><paragraph id="HA71EC8960AB34C838871A1B83B234858"><enum>(2)</enum><header>Discretion of the FISA Court</header><text>The FISA Court shall have discretion to grant or deny a motion for reconsideration made pursuant to paragraph (1).</text></paragraph></subsection><subsection id="H1A7F2DBC00264D1388CAD003B7C7F508"><enum>(c)</enum><header>Amicus curiae participation</header><paragraph id="HA7308BF346C74AB0AFAF92AE93D59D28"><enum>(1)</enum><header>Motion by the Constitutional Advocate</header><text>The Constitutional Advocate may file a motion with the FISA Court to permit and facilitate participation of amicus curiae, including participation in oral argument if appropriate, in any proceeding. The FISA Court shall have the discretion to grant or deny such a motion.</text></paragraph><paragraph id="H4D9460CCE1FC4C19AD9D1DD7EF832C49"><enum>(2)</enum><header>Facilitation by the FISA Court</header><text>The FISA Court may, sua sponte, permit and facilitate participation by amicus curiae, including participation in oral argument if appropriate, in proceedings before the FISA Court.</text></paragraph><paragraph commented="no" id="HE5E98A3C9D6748B2BCADC4A3D6C1E629"><enum>(3)</enum><header>Regulations</header><text>Not later than 180 days after the date of the enactment of this Act, the FISA Court shall promulgate rules to provide the public with information sufficient to allow interested parties to participate as amicus curiae.</text></paragraph></subsection></section><section id="HE1429D82318843B8BE8177A095B9C7FD"><enum>5.</enum><header>Advocacy before the petition review pool</header><subsection id="H701592BEEFC84935898478526CA5EB51"><enum>(a)</enum><header>Authority To participate</header><text>The petition review pool or any party to a proceeding before the petition review pool may authorize the Constitutional Advocate to participate in a petition review pool proceeding.</text></subsection><subsection id="HF40CC4597D1B45D8B5D29199A4405BAF"><enum>(b)</enum><header>Reconsideration of a petition review pool decision</header><paragraph id="H37052C20E410497598D113D5E805A980"><enum>(1)</enum><header>Authority to move for reconsideration</header><text>The Constitutional Advocate may move the petition review pool to reconsider any decision of the petition review pool made after the date of the enactment of this Act by petitioning the petition review pool not later than 30 days after the date on which all documents and materials relevant to the decision are made available to the Constitutional Advocate.</text></paragraph><paragraph id="H8F5671CB4FC74D46A3FADBE4FC51BBEE"><enum>(2)</enum><header>Discretion of the petition review pool</header><text>The petition review pool shall have discretion to grant or deny a motion for reconsideration made pursuant to paragraph (1).</text></paragraph></subsection><subsection id="H7A05A7D433DC40B28C18B0D39F9D5FD9"><enum>(c)</enum><header>Amicus curiae participation</header><paragraph id="HF3707D6FD0204CE1890D9324FBF38C4E"><enum>(1)</enum><header>Motion by the Constitutional Advocate</header><text>The Constitutional Advocate may file a motion with the petition review pool to permit and facilitate participation of amicus curiae, including participation in oral argument if appropriate, in any proceeding. The petition review pool shall have the discretion to grant or deny such a motion.</text></paragraph><paragraph id="H187E5C02FFB843859CC3861213324A81"><enum>(2)</enum><header>Facilitation by the FISA Court</header><text>The petition review pool may, sua sponte, permit and facilitate participation by amicus curiae, including participation in oral argument if appropriate, in proceedings before the petition review pool.</text></paragraph><paragraph id="HEF4868ACB1D74CEE96F4752B42415EF8"><enum>(3)</enum><header>Regulations</header><text>Not later than 180 days after the date of the enactment of this Act, the petition review pool shall promulgate rules to provide the public with information sufficient to allow interested parties to participate as amicus curiae.</text></paragraph></subsection></section><section id="H3943613BB56F45DDADD2C8C7D78DA84A"><enum>6.</enum><header>Appellate review</header><subsection id="H6E519CFBB6974966A550C923ACDD965B"><enum>(a)</enum><header>Appeal of FISA Court decisions</header><paragraph id="HCA40CAE6643B4382A2B3D5689ACF7072"><enum>(1)</enum><header>Authority to appeal</header><text>The Constitutional Advocate may appeal any decision of the FISA Court or the petition review pool issued after the date of the enactment of this Act not later than 90 days after the date the decision is issued, unless it would be apparent to all reasonable jurists that such decision is dictated by statute or by precedent handed down after such date of enactment.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0EA57E6CBE56408B8AC21481BA1EBE8D"><enum>(2)</enum><header>Standing as appellant</header><text>If the Constitutional Advocate appeals a decision of the FISA Court or the petition review pool pursuant to paragraph (1), the Constitutional Advocate shall have standing as a party before the FISA Court of Review in such appeal.</text></paragraph><paragraph id="H284AFF33A3D74D618E12621EB0A448F4"><enum>(3)</enum><header>Mandatory review</header><text>The FISA Court of Review shall review any FISA Court or petition review pool decision appealed by the Constitutional Advocate and issue a decision in such appeal.</text></paragraph><paragraph id="H2B91A505B7104EEBA1DB0E664E3A5109"><enum>(4)</enum><header>Standard of review</header><text>The standards for a mandatory review of a FISA Court or petition review pool decision pursuant to paragraph (3) shall be—</text><subparagraph id="H65F9458C598046A7B3D01758F7384D4B"><enum>(A)</enum><text>de novo with respect to issues of law; and</text></subparagraph><subparagraph id="HACC5392F6AE14051A013A6E2E9D0F69A"><enum>(B)</enum><text>clearly erroneous with respect to determination of facts.</text></subparagraph></paragraph><paragraph id="H7E713F5CD19F4F6CBB126B3B3BAA5731"><enum>(5)</enum><header>Amicus curiae participation</header><subparagraph id="HEB287ED2D61341D1B2FF57A21D9E1AAE"><enum>(A)</enum><header>In general</header><text>The FISA Court of Review shall accept amicus curiae briefs from interested parties in all mandatory reviews pursuant to paragraph (3) and shall provide for amicus curiae participation in oral argument if appropriate.</text></subparagraph><subparagraph id="HE6EDB6767D164A28A693E6CB4667379D"><enum>(B)</enum><header>Regulations</header><text>Not later than 180 days after the date of the enactment of this Act, the FISA Court of Review shall promulgate rules to provide the public with information sufficient to allow interested parties to participate as amicus curiae.</text></subparagraph></paragraph></subsection><subsection id="H432E4A9FB5D0442EB14BF90C98321ED6"><enum>(b)</enum><header>Review of FISA Court of Review decisions</header><paragraph id="H65CD5BAC84EC4B8EB3F13F0DB73F6B02"><enum>(1)</enum><header>Authority</header><text>The Constitutional Advocate may seek a writ of certiorari from the Supreme Court of the United States for review of any decision of the FISA Court of Review.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0A7FA1F4C3764D02BBD233FEDAAB7308"><enum>(2)</enum><header>Standing</header><text>In any proceedings before the Supreme Court of the United States relating to a petition of certiorari filed under paragraph (1) and any proceedings in a matter for which certiorari is granted, the Constitutional Advocate shall have standing as a party.</text></paragraph></subsection></section><section id="HB034BADCB191422F99EE1B6D6A203044"><enum>7.</enum><header>Disclosure</header><subsection id="H25D8373832E048BD9F1C03B26947BE9D"><enum>(a)</enum><header>Requirement To disclose</header><text>The Attorney General shall publicly disclose—</text><paragraph id="H400F640698E54EA59A29834E3722AFB7"><enum>(1)</enum><text>all decisions issued by the FISA Court, the petition review pool, or the FISA Court of Review after July 10, 2003, that include a significant construction or interpretation of law;</text></paragraph><paragraph id="H92E7A474A06A458C94452B3EC9ED604E"><enum>(2)</enum><text>any decision of the FISA Court or the petition review pool appealed by the Constitutional Advocate pursuant to this title; and</text></paragraph><paragraph id="HA50965F2B095419A96A940E20B163CA0"><enum>(3)</enum><text>any FISA Court of Review decision that is issued after an appeal by the Constitutional Advocate.</text></paragraph></subsection><subsection id="H3882AA4560A14C90B9811A609DB764F2"><enum>(b)</enum><header>Disclosure described</header><text>For each disclosure required by subsection (a) with respect to a decision, the Attorney General shall make available to the public documents sufficient—</text><paragraph id="H6A0C17D4BD894454983C074F69EE738A"><enum>(1)</enum><text>to identify with particularity each legal question addressed by the decision and how such question was resolved;</text></paragraph><paragraph id="HAD54D278C72E42DC95C3C96B6C2E2054"><enum>(2)</enum><text>to describe in general terms the context in which the matter arises;</text></paragraph><paragraph id="HE88FEB391B0341A39582D614E677CB3F"><enum>(3)</enum><text>to describe the construction or interpretation of any statute, constitutional provision, or other legal authority relied on by the decision; and</text></paragraph><paragraph id="H7F48D0EFE1404823892BB9BEB36362F6"><enum>(4)</enum><text>to indicate whether the decision departed from any prior decision of the FISA Court, the petition review pool, or the FISA Court of Review.</text></paragraph></subsection><subsection id="H78D2C3C904A84026A1EC8E43FB93677C"><enum>(c)</enum><header>Documents described</header><text>The Attorney General shall satisfy the disclosure requirements in subsection (b) by—</text><paragraph id="HB702257F183A466EB1427E65785342FC"><enum>(1)</enum><text>releasing a FISA Court, petition review pool, or FISA Court of Review decision in its entirety or as redacted;</text></paragraph><paragraph id="H2A4EAABF4AA344D08531D49D1CBEA5CE"><enum>(2)</enum><text>releasing a summary of a FISA Court, petition review pool, or FISA Court of Review decision; or</text></paragraph><paragraph id="HDBAB36D5A0224875A072FA2730FF7237"><enum>(3)</enum><text>releasing an application made to the FISA Court, a petition made to the petition review pool, briefs filed before the FISA Court, the petition review pool, or the FISA Court of Review, or other materials, in full or as redacted.</text></paragraph></subsection><subsection id="H7B1C205769DF424EAF3094116E79967A"><enum>(d)</enum><header>Extensive disclosure</header><text>The Attorney General shall release as much information regarding the facts and analysis contained in a decision described in subsection (a) or documents described in subsection (c) as is consistent with legitimate national security concerns.</text></subsection><subsection id="H9F2B106DAEDA498686C2CC41D0F6AA4C"><enum>(e)</enum><header>Timing of disclosure</header><paragraph id="H8183274FA56C4F739635599D208610C8"><enum>(1)</enum><header>Decisions issued prior to enactment</header><text>A decision issued prior to the date of the enactment of this Act that is required to be disclosed under subsection (a)(1) shall be disclosed not later than 180 days after the date of the enactment of this Act.</text></paragraph><paragraph id="H99B0FB437FCD44018B57C7C2F7CD8C8E"><enum>(2)</enum><header>FISA Court and petition review pool decisions</header><text>The Attorney General shall release FISA Court or petition review pool decisions appealed by the Constitutional Advocate not later than 30 days after the date the appeal is filed.</text></paragraph><paragraph id="H775DABB391EC472CAB1F91E8B945E835"><enum>(3)</enum><header>FISA Court of Review decisions</header><text>The Attorney General shall release FISA Court of Review decisions appealed by the Constitutional Advocate not later than 90 days after the date the appeal is filed.</text></paragraph></subsection><subsection id="H004CFBCFB33344C5AFB235F69BDEF33D"><enum>(f)</enum><header>Petition by the Constitutional Advocate</header><paragraph id="HA3F78B1F6CC84F8E917955905A0A1F5B"><enum>(1)</enum><header>Authority to petition</header><text>The Constitutional Advocate may petition the FISA Court, the petition review pool, or the FISA Court of Review to order—</text><subparagraph id="H3B7F964F00B640A59D28C11CD18A5221"><enum>(A)</enum><text>the public disclosure of a decision of such a Court or review pool, and documents or other material relevant to such a decision, previously designated as classified information; or</text></subparagraph><subparagraph id="HA5EA71685C404C388DDE5582F1C79546"><enum>(B)</enum><text>the release of an unclassified summary of such decisions and documents.</text></subparagraph></paragraph><paragraph id="H2F4902085AE0410AB4799D935CE30958"><enum>(2)</enum><header>Contents of petition</header><text>Each petition filed under paragraph (1) shall contain a detailed declassification proposal or a summary of the decision and documents that the Constitutional Advocate proposes to have released publicly.</text></paragraph><paragraph id="H3AC0E92A8BDF4D97BBFC833DE270F10E"><enum>(3)</enum><header>Role of the Attorney General</header><subparagraph id="H4995327554964EB5A6D1B9574722FA38"><enum>(A)</enum><header>Copy of petition</header><text>The Constitutional Advocate shall provide to the Attorney General a copy of each petition filed under paragraph (1).</text></subparagraph><subparagraph id="HA50278FA4CCE48349CBB7A9277C02EE7"><enum>(B)</enum><header>Opposition</header><text>The Attorney General may oppose a petition filed under paragraph (1) by submitting any objections in writing to the FISA Court, the petition review pool, or the FISA Court of Review, as appropriate, not later than 90 days after the date such petition was submitted.</text></subparagraph></paragraph><paragraph id="HEFCC21127D2648A9ABEDEED017FEEFF9"><enum>(4)</enum><header>Public availability</header><text>Not less than 91 days after receiving a petition under paragraph (1), and taking into account any objections from the Attorney General made under paragraph (3)(B), the FISA Court, the petition review pool, or the FISA Court of Review, as appropriate, shall declassify and make readily available to the public any decision, document, or other material requested in such petition, to the greatest extent possible, consistent with legitimate national security considerations.</text></paragraph><paragraph id="HED5C72326E1C445EA0A97AEA999BD5A9"><enum>(5)</enum><header>Effective date</header><text>The Constitutional Advocate may not file a petition under paragraph (1) until 181 days after the date of the enactment of this Act, except with respect to a decision appealed by the Constitutional Advocate.</text></paragraph></subsection></section><section id="H65AA4BC548894D87BC94BC2BBE8063CC"><enum>8.</enum><header>Annual report to Congress</header><subsection id="H4D0B7D626998477787A03F2E0DBBFC0D"><enum>(a)</enum><header>Requirement for annual report</header><text>The Constitutional Advocate shall submit to Congress an annual report on the implementation of this title.</text></subsection><subsection id="H724F511C454D49EE9C547197F092E69D"><enum>(b)</enum><header>Contents</header><text>Each annual report submitted under subsection (a) shall—</text><paragraph id="HC85665DCE48F4FCE8894CE7C3EF54F99"><enum>(1)</enum><text>detail the activities of the Office;</text></paragraph><paragraph id="HFA7BF47BA69345EAAE2E844DBF620575"><enum>(2)</enum><text>provide an assessment of the effectiveness of this title; and</text></paragraph><paragraph id="H2584E2453A4F4F1CA2339D8B4834CFF1"><enum>(3)</enum><text>propose any new legislation to improve the functioning of the Office or the operation of the FISA Court, the petition review pool, or the FISA Court of Review.</text></paragraph></subsection></section><section id="HF6BE145A19D2442BAB416FED5134BBED"><enum>9.</enum><header>Preservation of rights</header><text display-inline="no-display-inline">Nothing in this title shall be construed—</text><paragraph id="H535F4D6C52A5464C8BFC0A7BA6933F22"><enum>(1)</enum><text>to provide the Attorney General with authority to prevent the FISA Court, the petition review pool, or the FISA Court of Review from declassifying decisions or releasing information pursuant to this title; and</text></paragraph><paragraph id="H00B168FC957C4B9A91C1975EDCE187D7"><enum>(2)</enum><text>to eliminate the public’s ability to secure information under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code (commonly known as the <term>Freedom of Information Act</term>) or any other provision of law.</text></paragraph></section></legis-body></bill>
