R. 3217</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20130928">September 28, 2013</action-date><action-desc><sponsor name-id="L000564">Mr. Lamborn</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committees on <committee-name committee-id="HAS00">Armed Services</committee-name> and <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure the pay and allowances of members of the Armed Forces in the event that the debt limit is reached or during a funding gap, and for other purposes.</official-title></form><legis-body id="H5819389EE82A40BF9F1B0E316C0F2568" style="OLC"><section id="H5A08C70AFBB5475FA718DCC75B807AEF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Pay Act</short-title></quote>.</text></section><section id="HD11AAB10ED504980806BAA051F0725C6"><enum>2.</enum><header>Pay and allowances for national security personnel if the debt ceiling is reached</header><text display-inline="no-display-inline">In the event that the debt of the United States Government, as defined in <external-xref legal-doc="usc" parsable-cite="usc/31/3101">section 3101</external-xref> of title 31, United States Code, reaches the statutory limit, the Secretary of the Treasury shall make available the following amounts:</text><paragraph id="H89B5912CAF9A43ECA78EF1FA3866F9B9"><enum>(1)</enum><text>Such amounts as the Secretary of Defense (and the Secretary of Homeland Security in the case of the Coast Guard) determines to be necessary to continue to provide pay and allowances (without interruption) to members of the Army, Navy, Air Force, Marine Corps, and Coast Guard, including reserve components thereof, as well as civilian employees of the Department of Defense (and the Department of Homeland Security in the case of the Coast Guard) and designated contractors.</text></paragraph><paragraph id="H6DB5D5ADCABF4521A714B15682D7D2F0"><enum>(2)</enum><text>Such amounts as the President certifies to Congress as are necessary to carry out vital national security priorities of the United States.</text></paragraph></section><section id="H68F2B1D62F01490ABC8BD5B787CA630B"><enum>3.</enum><header>Emergency appropriation of funds for defense and national security during a funding gap</header><subsection id="H2DB8919B7926486091F97CC16F58D697"><enum>(a)</enum><header>In general</header><text>During any funding gap, the Secretary of the Treasury shall make available, out of any amounts in the general fund of the Treasury not otherwise appropriated—</text><paragraph id="H78010C7BA6A0447089912CFF46AE898C"><enum>(1)</enum><text display-inline="yes-display-inline">such amounts as the Secretary of Defense (and the Secretary of Homeland Security in the case of the Coast Guard) determines to be necessary to continue to provide pay and allowances (without interruption) to members of the Army, Navy, Air Force, Marine Corps, and Coast Guard, including reserve components thereof, as well as civilian employees of the Department of Defense (and the Department of Homeland Security in the case of the Coast Guard) and designated contractors; and</text></paragraph><paragraph id="H52240869CC2746BAB7E34DA0CDEBB49D"><enum>(2)</enum><text>such amounts as the President certifies to the Congress are necessary to carry out vital national security priorities.</text></paragraph></subsection><subsection id="HD7B804544A7946199D2F927098BD0675"><enum>(b)</enum><header>Funding gap defined</header><text>For purposes of this section and with respect to an obligation incurred by the Government of the United States, the term <term>funding gap</term> means any period of time after the beginning of a fiscal year for which interim or full-year appropriations for such obligation have not been enacted.</text></subsection></section></legis-body></bill>
