<section id="H6B2A49D45DA2401A9AC09699CFF102D6"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Compounding Quality Act</short-title></quote>.</text></section> 
<section id="H82271CA026194A85A7D5DAF9307D3D55"><enum>102.</enum><header>Voluntary outsourcing facilities</header> 
<subsection id="H3D93DDCA7C8E458DA60BCD127370A888"><enum>(a)</enum><header>In general</header><text>Subchapter A of chapter V (<external-xref legal-doc="usc" parsable-cite="usc/21/351">21 U.S.C. 351 et seq.</external-xref>) is amended—</text> 
<paragraph id="HF0940BFC5CFC4E1EAC53F38989711E31"><enum>(1)</enum><text>by redesignating section 503B as section 503C; and</text></paragraph> 
<paragraph id="H3464FAA8E17C47399ED99B8FB83AFA70"><enum>(2)</enum><text>by inserting after section 503A the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="H8A20391866D84193BE63ADD53F818D0B" style="OLC"> 
<section id="H4287914C6A8A40AEA335FF3E2D5DC006"><enum>503B.</enum><header>Outsourcing facilities</header> 
<subsection id="HE4ECB553A12C496CAE5B75EF8A11A9A1"><enum>(a)</enum><header>In general</header><text>Sections 502(f)(1), 505, and 582 shall not apply to a drug compounded by or under the direct supervision of a licensed pharmacist in a facility that elects to register as an outsourcing facility if each of the following conditions is met:</text> 
<paragraph id="H22B70B407243477B98C9825A76D6357E"><enum>(1)</enum><header>Registration and reporting</header><text>The drug is compounded in an outsourcing facility that is in compliance with the requirements of subsection (b).</text></paragraph> 
<paragraph id="H3071507C6C404BB7BE63407E420D865F"><enum>(2)</enum><header>Bulk drug substances</header><text>The drug is compounded in an outsourcing facility that does not compound using bulk drug substances (as defined in <external-xref legal-doc="regulation" parsable-cite="cfr/21/207.3">section 207.3(a)(4)</external-xref> of title 21, Code of Federal Regulations (or any successor regulation)), unless—</text> 
<subparagraph id="H2CDCA4E0C97E41928493500F3C52A386"><enum>(A)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="HA8FC6E940AF14D7DA5C27DEEDCEE811B"><enum>(i)</enum><text>the bulk drug substance appears on a list established by the Secretary identifying bulk drug substances for which there is a clinical need, by—</text> 
<subclause id="HE99A4AE3A85949D2983DDE912BDE572C" indent="up1"><enum>(I)</enum><text>publishing a notice in the Federal Register proposing bulk drug substances to be included on the list, including the rationale for such proposal;</text></subclause> 
<subclause id="HE284A2B4C3884A029B28B468A0FCD2A6" indent="up1"><enum>(II)</enum><text>providing a period of not less than 60 calendar days for comment on the notice; and</text></subclause> 
<subclause id="H84766A6A715943D9B6DC97D800998411" indent="up1"><enum>(III)</enum><text>publishing a notice in the Federal Register designating bulk drug substances for inclusion on the list; or</text></subclause></clause> 
<clause id="H36FFED2FE6AB448CA2CA6245BED6F331" indent="up1"><enum>(ii)</enum><text>the drug compounded from such bulk drug substance appears on the drug shortage list in effect under section 506E at the time of compounding, distribution, and dispensing;</text></clause></subparagraph> 
<subparagraph id="H5BA1B0217CCC4793A4B4794AEC273208"><enum>(B)</enum><text>if an applicable monograph exists under the United States Pharmacopeia, the National Formulary, or another compendium or pharmacopeia recognized by the Secretary for purposes of this paragraph, the bulk drug substances each comply with the monograph;</text></subparagraph> 
<subparagraph id="H60A5FEDF64BA4E6E93CB52BCA3E8D894"><enum>(C)</enum><text>the bulk drug substances are each manufactured by an establishment that is registered under section 510 (including a foreign establishment that is registered under section 510(i)); and</text></subparagraph> 
<subparagraph id="HADA111BB1FD14459AEC416CB014D241C"><enum>(D)</enum><text>the bulk drug substances are each accompanied by a valid certificate of analysis.</text></subparagraph></paragraph> 
<paragraph id="H5AB33EAC5AAA45A69455A0EAB7E368EB"><enum>(3)</enum><header>Ingredients (other than bulk drug substances)</header><text>If any ingredients (other than bulk drug substances) are used in compounding the drug, such ingredients comply with the standards of the applicable United States Pharmacopeia or National Formulary monograph, if such monograph exists, or of another compendium or pharmacopeia recognized by the Secretary for purposes of this paragraph if any.</text></paragraph> 
<paragraph id="HECEC856D82B64395835D494F80ADEC05"><enum>(4)</enum><header>Drugs withdrawn or removed because unsafe or not effective</header><text>The drug does not appear on a list published by the Secretary of drugs that have been withdrawn or removed from the market because such drugs or components of such drugs have been found to be unsafe or not effective.</text></paragraph> 
<paragraph id="H8D61B2D3632A443AA1CCC07406DC303D"><enum>(5)</enum><header>Essentially a copy of an approved drug</header><text>The drug is not essentially a copy of one or more approved drugs.</text></paragraph> 
<paragraph id="HE4A85D2BA67F4D718AEBDA4EE241D8BF"><enum>(6)</enum><header>Drugs presenting demonstrable difficulties for compounding</header><text>The drug—</text> 
<subparagraph id="H21189D4D3A0A469B972D7E440B9BA9A9"><enum>(A)</enum><text>is not identified (directly or as part of a category of drugs) on a list published by the Secretary, through the process described in subsection (c), of drugs or categories of drugs that present demonstrable difficulties for compounding that are reasonably likely to lead to an adverse effect on the safety or effectiveness of the drug or category of drugs, taking into account the risks and benefits to patients; or</text></subparagraph> 
<subparagraph id="HB04C76D2F3524E1DA1F201CEAD63970A"><enum>(B)</enum><text>is compounded in accordance with all applicable conditions identified on the list described in subparagraph (A) as conditions that are necessary to prevent the drug or category of drugs from presenting the demonstrable difficulties described in subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="HF4598FD048D64A02BC432C0CB93EA8E8"><enum>(7)</enum><header>Elements to assure safe use</header><text>In the case of a drug that is compounded from a drug that is the subject of a risk evaluation and mitigation strategy approved with elements to assure safe use pursuant to section 505–1, or from a bulk drug substance that is a component of such drug, the outsourcing facility demonstrates to the Secretary prior to beginning compounding that such facility will utilize controls comparable to the controls applicable under the relevant risk evaluation and mitigation strategy.</text></paragraph> 
<paragraph id="H7589B56701184206AEEF4D49E11B80AD"><enum>(8)</enum><header>Prohibition on wholesaling</header><text>The drug will not be sold or transferred by an entity other than the outsourcing facility that compounded such drug. This paragraph does not prohibit administration of a drug in a health care setting or dispensing a drug pursuant to a prescription executed in accordance with section 503(b)(1).</text></paragraph> 
<paragraph id="H8CB7F99D731C4363A4E945A63E6BB520"><enum>(9)</enum><header>Fees</header><text>The drug is compounded in an outsourcing facility that has paid all fees owed by such facility pursuant to section 744K.</text></paragraph> 
<paragraph id="HF033529B171A46D081533C8E7B222C3C"><enum>(10)</enum><header>Labeling of drugs</header> 
<subparagraph id="H11E433060249482CAE8FBA26A3692514"><enum>(A)</enum><header>Label</header><text>The label of the drug includes—</text> 
<clause id="H956E96D6B39140259CE27CAB8430936E"><enum>(i)</enum><text>the statement <quote>This is a compounded drug.</quote> or a reasonable comparable alternative statement (as specified by the Secretary) that prominently identifies the drug as a compounded drug;</text></clause> 
<clause id="HCCFAA4661D32407A8541E0C283B42FE2"><enum>(ii)</enum><text>the name, address, and phone number of the applicable outsourcing facility; and</text></clause> 
<clause id="HB8DBD3C4E04A4872B004C11B9A585651"><enum>(iii)</enum><text>with respect to the drug—</text> 
<subclause id="H03824C2D2F6348DDA4CAC7FF11D870EE"><enum>(I)</enum><text>the lot or batch number;</text></subclause> 
<subclause id="H3306120EAF4C457696DD0FE02A8FC5CD"><enum>(II)</enum><text>the established name of the drug;</text></subclause> 
<subclause id="H7EBB491150494080AB182D69219FB081"><enum>(III)</enum><text>the dosage form and strength;</text></subclause> 
<subclause id="HEFCE9EA082484E86A379BCC18D5A18DC"><enum>(IV)</enum><text>the statement of quantity or volume, as appropriate;</text></subclause> 
<subclause id="H471829837CBA4722A4001BDFB05C5831"><enum>(V)</enum><text>the date that the drug was compounded;</text></subclause> 
<subclause id="H6B7CA1441AC345BA9872ED2F2D2F8A43"><enum>(VI)</enum><text>the expiration date;</text></subclause> 
<subclause id="HF82A592FE7F94AE0B63982A5E7556249"><enum>(VII)</enum><text>storage and handling instructions;</text></subclause> 
<subclause id="H9A0E8260866D4B45B961DC35936EC2E6"><enum>(VIII)</enum><text>the National Drug Code number, if available;</text></subclause> 
<subclause commented="no" id="H548F8EC3D4304ACFB2DFB6958CD22567"><enum>(IX)</enum><text>the statement <quote>Not for resale</quote>, and, if the drug is dispensed or distributed other than pursuant to a prescription for an individual identified patient, the statement <quote>Office Use Only</quote>; and</text></subclause> 
<subclause id="HFB9A4BB2707E46A49755BAF8462E9132"><enum>(X)</enum><text>subject to subparagraph (B)(i), a list of active and inactive ingredients, identified by established name and the quantity or proportion of each ingredient.</text></subclause></clause></subparagraph> 
<subparagraph id="HDC3A9C5B89B64EDC9594B6A0ED1FF275"><enum>(B)</enum><header>Container</header><text>The container from which the individual units of the drug are removed for dispensing or for administration (such as a plastic bag containing individual product syringes) shall include—</text> 
<clause id="HD46E42F735F74A008CB7FCD2A334F9BA"><enum>(i)</enum><text>the information described under subparagraph (A)(iii)(X), if there is not space on the label for such information;</text></clause> 
<clause id="H77115ACAA8A0421983D47B078FA23355"><enum>(ii)</enum><text>the following information to facilitate adverse event reporting: www.fda.gov/medwatch and 1–800–FDA–1088 (or any successor Internet Web site or phone number); and</text></clause> 
<clause id="HFFAACEF4D60F4B63B74C38E15F58AA7B"><enum>(iii)</enum><text>directions for use, including, as appropriate, dosage and administration.</text></clause></subparagraph> 
<subparagraph id="H846B227C7BD442228CEF42211FF9D24F"><enum>(C)</enum><header>Additional information</header><text>The label and labeling of the drug shall include any other information as determined necessary and specified in regulations promulgated by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="H3D273BDCB96442C7B76C7DE7DA9E985E"><enum>(11)</enum><header>Outsourcing facility requirement</header><text display-inline="yes-display-inline">The drug is compounded in an outsourcing facility in which the compounding of drugs occurs only in accordance with this section.</text></paragraph></subsection> 
<subsection id="H1DF65926E99F4CECA94D6E3E7BD216E5"><enum>(b)</enum><header>Registration of outsourcing facilities and reporting of drugs</header> 
<paragraph id="HAE32D2E352E147E89D1A68F64E66983D"><enum>(1)</enum><header>Registration of outsourcing facilities</header> 
<subparagraph id="HDE466C6D8F634966A538E5B4D1E22972"><enum>(A)</enum><header>Annual registration</header><text>Upon electing and in order to become an outsourcing facility, and during the period beginning on October 1 and ending on December 31 of each year thereafter, a facility—</text> 
<clause id="H08EE6B3B6C4D45418748F0F4A9A9218C"><enum>(i)</enum><text>shall register with the Secretary its name, place of business, and unique facility identifier (which shall conform to the requirements for the unique facility identifier established under section 510), and a point of contact email address; and</text></clause> 
<clause id="HDDE838AE4F524D82ACA03945E6A78FF3"><enum>(ii)</enum><text>shall indicate whether the outsourcing facility intends to compound a drug that appears on the list in effect under section 506E during the subsequent calendar year.</text></clause></subparagraph> 
<subparagraph id="H0F6066BD635043498CD0022065640C1F"><enum>(B)</enum><header>Availability of registration for inspection; list</header> 
<clause id="HA722F22A5F49400CA0013185D9829360"><enum>(i)</enum><header>Registrations</header><text>The Secretary shall make available for inspection, to any person so requesting, any registration filed pursuant to this paragraph.</text></clause> 
<clause id="H3353DBEBA4854FE8AC7BDED340CC58F4"><enum>(ii)</enum><header>List</header><text>The Secretary shall make available on the public Internet Web site of the Food and Drug Administration a list of the name of each facility registered under this subsection as an outsourcing facility, the State in which each such facility is located, whether the facility compounds from bulk drug substances, and whether any such compounding from bulk drug substances is for sterile or nonsterile drugs.</text></clause></subparagraph></paragraph> 
<paragraph id="HFB2D6825ACF44F0784D51F163D932356"><enum>(2)</enum><header>Drug reporting by outsourcing facilities</header> 
<subparagraph id="HC9F8F913660F4756B53470504A687BF8"><enum>(A)</enum><header>In general</header><text>Upon initially registering as an outsourcing facility, once during the month of June of each year, and once during the month of December of each year, each outsourcing facility that registers with the Secretary under paragraph (1) shall submit to the Secretary a report—</text> 
<clause id="H6450592A07644BE98026F4B4D91F9D1F"><enum>(i)</enum><text>identifying the drugs compounded by such outsourcing facility during the previous 6-month period; and</text></clause> 
<clause id="H7E51BE3AC6D14EF0B3AAE34627105723"><enum>(ii)</enum><text>with respect to each drug identified under clause (i), providing the active ingredient, the source of such active ingredient, the National Drug Code number of the source drug or bulk active ingredient, if available, the strength of the active ingredient per unit, the dosage form and route of administration, the package description, the number of individual units produced, and the National Drug Code number of the final product, if assigned.</text></clause></subparagraph> 
<subparagraph id="HD94AB11919A34C2E9FF7609173E1D966"><enum>(B)</enum><header>Form</header><text>Each report under subparagraph (A) shall be prepared in such form and manner as the Secretary may prescribe by regulation or guidance.</text></subparagraph> 
<subparagraph id="HAB08AE88E0054ABCA1E523FD4AA3843E"><enum>(C)</enum><header>Confidentiality</header><text>Reports submitted under this paragraph shall be exempt from inspection under paragraph (1)(B)(i), unless the Secretary finds that such an exemption would be inconsistent with the protection of the public health.</text></subparagraph></paragraph> 
<paragraph id="H6AC3A292CAE042148282EA7153F07169"><enum>(3)</enum><header>Electronic registration and reporting</header><text>Registrations and drug reporting under this subsection (including the submission of updated information) shall be submitted to the Secretary by electronic means unless the Secretary grants a request for waiver of such requirement because use of electronic means is not reasonable for the person requesting waiver.</text></paragraph> 
<paragraph id="H51F2AD936DE8421E9DBB4D08B6B25324"><enum>(4)</enum><header>Risk-based inspection frequency</header> 
<subparagraph id="H9B371DA85C594AF59290E5F555ED66D6"><enum>(A)</enum><header>In general</header><text>Outsourcing facilities—</text> 
<clause id="HE8AE00946CCF4699877184E9F7AF05BC"><enum>(i)</enum><text>shall be subject to inspection pursuant to section 704; and</text></clause> 
<clause id="H66EBA700F4C447488579AE78FFE3CE59"><enum>(ii)</enum><text>shall not be eligible for the exemption under section 704(a)(2)(A).</text></clause></subparagraph> 
<subparagraph id="H74229164021749D3A791D2C24D785B97"><enum>(B)</enum><header>Risk-based schedule</header><text>The Secretary, acting through one or more officers or employees duly designated by the Secretary, shall inspect outsourcing facilities in accordance with a risk-based schedule established by the Secretary.</text></subparagraph> 
<subparagraph id="H1ADA92282A614250A9C15710573D054E"><enum>(C)</enum><header>Risk factors</header><text>In establishing the risk-based schedule, the Secretary shall inspect outsourcing facilities according to the known safety risks of such outsourcing facilities, which shall be based on the following factors:</text> 
<clause id="H8D7631EC9CF24739B0DE8B46E8780174"><enum>(i)</enum><text>The compliance history of the outsourcing facility.</text></clause> 
<clause id="HF57916D277FF48E6BFF49C9785FD6633"><enum>(ii)</enum><text>The record, history, and nature of recalls linked to the outsourcing facility.</text></clause> 
<clause id="H2C8F97E6117647E08E4367A7F6E1EEA9"><enum>(iii)</enum><text>The inherent risk of the drugs compounded at the outsourcing facility.</text></clause> 
<clause id="H58FDF819CCF445A78EAC0FF8EA0AE026"><enum>(iv)</enum><text>The inspection frequency and history of the outsourcing facility, including whether the outsourcing facility has been inspected pursuant to section 704 within the last 4 years.</text></clause> 
<clause id="H5E573569F8E4404D91818FBB229BD597"><enum>(v)</enum><text>Whether the outsourcing facility has registered under this paragraph as an entity that intends to compound a drug that appears on the list in effect under section 506E.</text></clause> 
<clause id="HC3325055DFC740C69763EC1F4AD3AE7B"><enum>(vi)</enum><text>Any other criteria deemed necessary and appropriate by the Secretary for purposes of allocating inspection resources.</text></clause></subparagraph></paragraph> 
<paragraph id="HCAF49F44D3C44E74A42E0BBE90947688"><enum>(5)</enum><header>Adverse event reporting</header><text>Outsourcing facilities shall submit adverse event reports to the Secretary in accordance with the content and format requirements established through guidance or regulation under <external-xref legal-doc="regulation" parsable-cite="cfr/21/310.305">section 310.305</external-xref> of title 21, Code of Federal Regulations (or any successor regulations).</text></paragraph></subsection> 
<subsection id="HA9C707E389F6429DA0E50841A7A6F6B5"><enum>(c)</enum><header>Regulations</header> 
<paragraph id="H410D7A2C062B446F837F7C564039202C"><enum>(1)</enum><header>In general</header><text>The Secretary shall implement the list described in subsection (a)(6) through regulations.</text></paragraph> 
<paragraph id="H614822B60A4D4DD788FE71E5B2F714DA"><enum>(2)</enum><header>Advisory committee on compounding</header><text>Before issuing regulations to implement subsection (a)(6), the Secretary shall convene and consult an advisory committee on compounding. The advisory committee shall include representatives from the National Association of Boards of Pharmacy, the United States Pharmacopeia, pharmacists with current experience and expertise in compounding, physicians with background and knowledge in compounding, and patient and public health advocacy organizations.</text></paragraph> 
<paragraph id="H30E7E07735AA46B993706E7EE994EAC1"><enum>(3)</enum><header>Interim list</header> 
<subparagraph id="H9D8F608B9FFC4F3B988857A7898A3146"><enum>(A)</enum><header>In general</header><text>Before the effective date of the regulations finalized to implement subsection (a)(6), the Secretary may designate drugs, categories of drugs, or conditions as described such subsection by—</text> 
<clause id="HFA462EABE44F455BB971681F3C4E28C6"><enum>(i)</enum><text>publishing a notice of such substances, drugs, categories of drugs, or conditions proposed for designation, including the rationale for such designation, in the Federal Register;</text></clause> 
<clause id="HA678E23D4E9E4458A35671C886355782"><enum>(ii)</enum><text>providing a period of not less than 60 calendar days for comment on the notice; and</text></clause> 
<clause id="H4E4A55E2323F489489ACBAE8FD063F46"><enum>(iii)</enum><text>publishing a notice in the Federal Register designating such drugs, categories of drugs, or conditions.</text></clause></subparagraph> 
<subparagraph id="H51DE73807D1043C2897CCBD69152514E"><enum>(B)</enum><header>Sunset of Notice</header><text>Any notice provided under subparagraph (A) shall not be effective after the earlier of—</text> 
<clause id="H7F8482ED18454841B29F5BDFB0130E6C"><enum>(i)</enum><text>the date that is 5 years after the date of enactment of the <short-title>Compounding Quality Act</short-title>; or</text></clause> 
<clause id="H0BBD7F9D858542D9A39E5F92D5513C17"><enum>(ii)</enum><text>the effective date of the final regulations issued to implement subsection (a)(6).</text></clause></subparagraph></paragraph> 
<paragraph id="HB0C20B858B4B48EF9A6C55B43E018908"><enum>(4)</enum><header>Updates</header><text>The Secretary shall review, and update as necessary, the regulations containing the lists of drugs, categories of drugs, or conditions described in subsection (a)(6) regularly, but not less than once every 4 years. Nothing in the previous sentence prohibits submissions to the Secretary, before or during any 4-year period described in such sentence, requesting updates to such lists.</text></paragraph></subsection> 
<subsection id="H6F16C167292F4DA496C767273999D285"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H30E299453CB84593AC0A26E1081125A3"><enum>(1)</enum><text>The term <term>compounding</term> includes the combining, admixing, mixing, diluting, pooling, reconstituting, or otherwise altering of a drug or bulk drug substance to create a drug.</text></paragraph> 
<paragraph id="H52EB5A6BF8DD4B52AA3B2E5FED327531"><enum>(2)</enum><text>The term <term>essentially a copy of an approved drug</term> means—</text> 
<subparagraph id="H582DD8A3AC234500B7B8E95FF92BC9FC"><enum>(A)</enum><text>a drug that is identical or nearly identical to an approved drug, or a marketed drug not subject to section 503(b) and not subject to approval in an application submitted under section 505, unless, in the case of an approved drug, the drug appears on the drug shortage list in effect under section 506E at the time of compounding, distribution, and dispensing; or</text></subparagraph> 
<subparagraph id="H0F45A047015C42C9AD69783BCF623984"><enum>(B)</enum><text>a drug, a component of which is a bulk drug substance that is a component of an approved drug or a marketed drug that is not subject to section 503(b) and not subject to approval in an application submitted under section 505, unless there is a change that produces for an individual patient a clinical difference, as determined by the prescribing practitioner, between the compounded drug and the comparable approved drug.</text></subparagraph></paragraph> 
<paragraph id="H1DEEE8D7313F44C680344395576CD116"><enum>(3)</enum><text>The term <term>approved drug</term> means a drug that is approved under section 505 and does not appear on the list described in subsection (a)(4) of drugs that have been withdrawn or removed from the market because such drugs or components of such drugs have been found to be unsafe or not effective.</text></paragraph> 
<paragraph id="HD4C2A462ACF64000A5C9471C6826F4B0"><enum>(4)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H9A0F85FE819141BAA2DC38406E34154D"><enum>(A)</enum><text>The term <term>outsourcing facility</term> means a facility at one geographic location or address that—</text> 
<clause id="HD79617443B0A43FDA2EBA27AD2DFC0D8" indent="up1"><enum>(i)</enum><text>is engaged in the compounding of sterile drugs;</text></clause> 
<clause id="H1BBCAF783A1B4BDC8848C1CABF7BAAF2" indent="up1"><enum>(ii)</enum><text>has elected to register as an outsourcing facility; and</text></clause> 
<clause id="H56FC2EFEF1884FE780E08812CFACD734" indent="up1"><enum>(iii)</enum><text>complies with all of the requirements of this section.</text></clause></subparagraph> 
<subparagraph id="H563AF315DC3446BE8778ADA5210FFA9E" indent="up1"><enum>(B)</enum><text>An outsourcing facility is not required to be a licensed pharmacy.</text></subparagraph> 
<subparagraph id="H9191E983DB814B35A0251BA4A0938CDC" indent="up1"><enum>(C)</enum><text>An outsourcing facility may or may not obtain prescriptions for identified individual patients.</text></subparagraph></paragraph> 
<paragraph id="H6576BD54DD334C58B913FB3ACDD5B61F"><enum>(5)</enum><text>The term <term>sterile drug</term> means a drug that is intended for parenteral administration, an ophthalmic or oral inhalation drug in aqueous format, or a drug that is required to be sterile under Federal or State law.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> 
<quoted-block display-inline="no-display-inline" id="H36349007E15E49BAB440CA8A6F1D475F" style="OLC"> 
<subsection id="H49778A419B484F8D865E633D28F2C85B"><enum>(d)</enum><header>Obligation to pay fees</header><text>Payment of the fee under section 744K, as described in subsection (a)(9), shall not relieve an outsourcing facility that is licensed as a pharmacy in any State that requires pharmacy licensing fees of its obligation to pay such State fees.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H30093D8E5B1D4023B0E58F71953FB858"><enum>(b)</enum><header>Fees</header><text>Subchapter C of chapter VII (<external-xref legal-doc="usc" parsable-cite="usc/21/379f">21 U.S.C. 379f et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H9589C8C1099346F89D519D3F91E71DB7"><enum>744J.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text> 
<paragraph id="HCF29AF2F00B7411CB178BBB667C0A6D6"><enum>(1)</enum><text>The term <term>affiliate</term> has the meaning given such term in section 735(11).</text></paragraph> 
<paragraph id="H3B3770135AEF4E7BB65734510D7E8FD8"><enum>(2)</enum><text>The term <term>gross annual sales</term> means the total worldwide gross annual sales, in United States dollars, for an outsourcing facility, including the sales of all the affiliates of the outsourcing facility.</text></paragraph> 
<paragraph id="HCA08DA8FD9314D8EA57944A503538365"><enum>(3)</enum><text>The term <term>outsourcing facility</term> has the meaning given to such term in section 503B(d)(4).</text></paragraph> 
<paragraph id="H5D286F5F15664D6882FAC05A2EB382CF"><enum>(4)</enum><text>The term <term>reinspection</term> means, with respect to an outsourcing facility, 1 or more inspections conducted under section 704 subsequent to an inspection conducted under such provision which identified noncompliance materially related to an applicable requirement of this Act, specifically to determine whether compliance has been achieved to the Secretary’s satisfaction.</text></paragraph></section> 
<section id="HC2584910C03A47BE9723C530AFBAAE45"><enum>744K.</enum><header>Authority to assess and use outsourcing facility fees</header> 
<subsection id="H66CD391D660941E694C3E1E449A722D7"><enum>(a)</enum><header>Establishment and reinspection fees</header> 
<paragraph id="HA184FACF6636497EA4C36E589ABC6067"><enum>(1)</enum><header>In general</header><text>For fiscal year 2015 and each subsequent fiscal year, the Secretary shall, in accordance with this subsection, assess and collect—</text> 
<subparagraph id="H924F0ACF4966445ABD10B907A4D8FBC2"><enum>(A)</enum><text>an annual establishment fee from each outsourcing facility; and</text></subparagraph> 
<subparagraph id="H9288265ACCF949958BB27AE78A47A6AA"><enum>(B)</enum><text>a reinspection fee from each outsourcing facility subject to a reinspection in such fiscal year.</text></subparagraph></paragraph> 
<paragraph id="H47CC598D0C584443B6728EBC4BA60640"><enum>(2)</enum><header>Multiple reinspections</header><text>An outsourcing facility subject to multiple reinspections in a fiscal year shall be subject to a reinspection fee for each reinspection.</text></paragraph></subsection> 
<subsection id="HA3DBBD4DFD2A461CACA654D601D9EE35"><enum>(b)</enum><header>Establishment and reinspection fee setting</header><text>The Secretary shall—</text> 
<paragraph id="HA03F232F0D9E447987A1B0F19BBE12A5"><enum>(1)</enum><text>establish the amount of the establishment fee and reinspection fee to be collected under this section for each fiscal year based on the methodology described in subsection (c); and</text></paragraph> 
<paragraph id="HC698726292064B928347101ED3613A6C"><enum>(2)</enum><text>publish such fee amounts in a Federal Register notice not later than 60 calendar days before the start of each such year.</text></paragraph></subsection> 
<subsection id="HB82AB9756D86404EB927176461D9E80B"><enum>(c)</enum><header>Amount of establishment fee and reinspection fee</header> 
<paragraph id="H75D3337FEAFB47BD91370B4F60BE3F82"><enum>(1)</enum><header>In general</header><text>For each outsourcing facility in a fiscal year—</text> 
<subparagraph id="HCD8B01D069E443DD81AECB4EC5814479"><enum>(A)</enum><text>except as provided in paragraph (4), the amount of the annual establishment fee under subsection (b) shall be equal to the sum of—</text> 
<clause id="H9502C31614674EF18AC71FC0E2A7AE73"><enum>(i)</enum><text>$15,000, multiplied by the inflation adjustment factor described in paragraph (2); plus</text></clause> 
<clause id="H7ED6773EE7B64B0E879CDFB4CD0C3E79"><enum>(ii)</enum><text>the small business adjustment factor described in paragraph (3); and</text></clause></subparagraph> 
<subparagraph id="H399A850E14CE460BABB43656E6EEA301"><enum>(B)</enum><text>the amount of any reinspection fee (if applicable) under subsection (b) shall be equal to $15,000, multiplied by the inflation adjustment factor described in paragraph (2).</text></subparagraph></paragraph> 
<paragraph id="H4E5D18746D654F5D995E9C70CDAFB720"><enum>(2)</enum><header>Inflation adjustment factor</header> 
<subparagraph id="H79800F6D3D1742499BD5A7EDBAE2572F"><enum>(A)</enum><header>In general</header><text>For fiscal year 2015 and subsequent fiscal years, the fee amounts established in paragraph (1) shall be adjusted by the Secretary by notice, published in the Federal Register, for a fiscal year by the amount equal to the sum of—</text> 
<clause id="HEEF4C0655E824F73982F35F8EA833E62"><enum>(i)</enum><text>1;</text></clause> 
<clause id="HD7C8D4C5F4A84AED8C7A20DB0F68BD78"><enum>(ii)</enum><text>the average annual percent change in the cost, per full-time equivalent position of the Food and Drug Administration, of all personnel compensation and benefits paid with respect to such positions for the first 3 years of the preceding 4 fiscal years, multiplied by the proportion of personnel compensation and benefits costs to total costs of an average full-time equivalent position of the Food and Drug Administration for the first 3 years of the preceding 4 fiscal years; plus</text></clause> 
<clause id="H3FC8880F119B48C3B2ABB26BB686CB1F"><enum>(iii)</enum><text>the average annual percent change that occurred in the Consumer Price Index for urban consumers (U.S. City Average; Not Seasonally Adjusted; All items; Annual Index) for the first 3 years of the preceding 4 years of available data multiplied by the proportion of all costs other than personnel compensation and benefits costs to total costs of an average full-time equivalent position of the Food and Drug Administration for the first 3 years of the preceding 4 fiscal years.</text></clause></subparagraph> 
<subparagraph id="H3C8604D3B6CA49AFBA5C3E2E7958E978"><enum>(B)</enum><header>Compounded basis</header><text>The adjustment made each fiscal year under subparagraph (A) shall be added on a compounded basis to the sum of all adjustments made each fiscal year after fiscal year 2014 under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H0A17893504CB4B11A4ECB800872B81BB"><enum>(3)</enum><header>Small business adjustment factor</header><text>The small business adjustment factor described in this paragraph shall be an amount established by the Secretary for each fiscal year based on the Secretary’s estimate of—</text> 
<subparagraph id="H93C91F6918184F458E63410198127649"><enum>(A)</enum><text>the number of small businesses that will pay a reduced establishment fee for such fiscal year; and</text></subparagraph> 
<subparagraph id="H412AAE5F1FD742F581EB13B3D1938AC6"><enum>(B)</enum><text>the adjustment to the establishment fee necessary to achieve total fees equaling the total fees that the Secretary would have collected if no entity qualified for the small business exception in paragraph (4).</text></subparagraph></paragraph> 
<paragraph id="H71635210F33B4C79B24A833E71D057B1"><enum>(4)</enum><header>Exception for small businesses</header> 
<subparagraph id="H54F79AD5E7124F6A8BDCFF366CD10F94"><enum>(A)</enum><header>In general</header><text>In the case of an outsourcing facility with gross annual sales of $1,000,000 or less in the 12 months ending April 1 of the fiscal year immediately preceding the fiscal year in which the fees under this section are assessed, the amount of the establishment fee under subsection (b) for a fiscal year shall be equal to \1/3\ of the amount calculated under paragraph (1)(A)(i) for such fiscal year.</text></subparagraph> 
<subparagraph id="H490E8D52730E479CA6C278CF367DC324"><enum>(B)</enum><header>Application</header><text>To qualify for the exception under this paragraph, a small business shall submit to the Secretary a written request for such exception, in a format specified by the Secretary in guidance, certifying its gross annual sales for the 12 months ending April 1 of the fiscal year immediately preceding the fiscal year in which fees under this subsection are assessed. Any such application shall be submitted to the Secretary not later than April 30 of such immediately preceding fiscal year.</text></subparagraph></paragraph> 
<paragraph id="H137DD86E79334439AA902AC75E37B4FA"><enum>(5)</enum><header>Crediting of fees</header><text>In establishing the small business adjustment factor under paragraph (3) for a fiscal year, the Secretary shall—</text> 
<subparagraph id="HA3067EECE34A4D24B04384B9D8E2204E"><enum>(A)</enum><text>provide for the crediting of fees from the previous year to the next year if the Secretary overestimated the amount of the small business adjustment factor for such previous fiscal year; and</text></subparagraph> 
<subparagraph id="H10B97B266D1141D1928DFB1CC2E63EFF"><enum>(B)</enum><text>consider the need to account for any adjustment of fees and such other factors as the Secretary determines appropriate.</text></subparagraph></paragraph></subsection> 
<subsection id="H39358F2A3BC54985904DBB480506A7F5"><enum>(d)</enum><header>Use of fees</header><text>The Secretary shall make all of the fees collected pursuant to subparagraphs (A) and (B) of subsection (a)(1) available solely to pay for the costs of oversight of outsourcing facilities.</text></subsection> 
<subsection id="H8EE0C50695834A11A7A5A7FC4B3FD766"><enum>(e)</enum><header>Supplement not supplant</header><text>Funds received by the Secretary pursuant to this section shall be used to supplement and not supplant any other Federal funds available to carry out the activities described in this section.</text></subsection> 
<subsection id="H5C2DDB6C1C614A66AFF2C9C61501F934"><enum>(f)</enum><header>Crediting and availability of fees</header><text>Fees authorized under this section shall be collected and available for obligation only to the extent and in the amount provided in advance in appropriations Acts. Such fees are authorized to remain available until expended. Such sums as may be necessary may be transferred from the Food and Drug Administration salaries and expenses appropriation account without fiscal year limitation to such appropriation account for salaries and expenses with such fiscal year limitation. The sums transferred shall be available solely for the purpose of paying the costs of oversight of outsourcing facilities.</text></subsection> 
<subsection id="HE7AD87A49DD44208BEB89BC63F76CEA1"><enum>(g)</enum><header>Collection of fees</header> 
<paragraph id="HA075CAEFFAEE4202BD71089C8C94662B"><enum>(1)</enum><header>Establishment fee</header><text>An outsourcing facility shall remit the establishment fee due under this section in a fiscal year when submitting a registration pursuant to section 503B(b) for such fiscal year.</text></paragraph> 
<paragraph id="HD19D34ACDB954C1BAA044301AE6906AD"><enum>(2)</enum><header>Reinspection fee</header><text>The Secretary shall specify in the Federal Register notice described in subsection (b)(2) the manner in which reinspection fees assessed under this section shall be collected and the timeline for payment of such fees. Such a fee shall be collected after the Secretary has conducted a reinspection of the outsourcing facility involved.</text></paragraph> 
<paragraph id="HEAE4508163764927BFF741EF020EAA21"><enum>(3)</enum><header>Effect of failure to pay fees</header> 
<subparagraph id="H12B099A95326491F9D76574BB2868683"><enum>(A)</enum><header>Registration</header><text>An outsourcing facility shall not be considered registered under section 503B(b) in a fiscal year until the date that the outsourcing facility remits the establishment fee under this subsection for such fiscal year.</text></subparagraph> 
<subparagraph id="H613BD00899644B349437D137997DC002"><enum>(B)</enum><header>Misbranding</header><text>All drugs manufactured, prepared, propagated, compounded, or processed by an outsourcing facility for which any establishment fee or reinspection fee has not been paid, as required by this section, shall be deemed misbranded under section 502 until the fees owed for such outsourcing facility under this section have been paid.</text></subparagraph></paragraph> 
<paragraph id="H6D9F5951770E462FB3C78A6C25FF8583"><enum>(4)</enum><header>Collection of unpaid fees</header><text>In any case where the Secretary does not receive payment of a fee assessed under this section within 30 calendar days after it is due, such fee shall be treated as a claim of the United States Government subject to provisions of subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/37">chapter 37</external-xref> of title 31, United States Code.</text></paragraph></subsection> 
<subsection id="H30A28D83B9BC4D6581B68664C24BCDDD"><enum>(h)</enum><header>Annual report to congress</header><text>Not later than 120 calendar days after each fiscal year in which fees are assessed and collected under this section, the Secretary shall submit a report to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives, to include a description of fees assessed and collected for such year, a summary description of entities paying the fees, a description of the hiring and placement of new staff, a description of the use of fee resources to support inspecting outsourcing facilities, and the number of inspections and reinspections of such facilities performed each year.</text></subsection> 
<subsection id="HDA058F6DD2F74C8E9D96A1AB5F12CDF8"><enum>(i)</enum><header>Authorization of appropriations</header><text>For fiscal year 2014 and each subsequent fiscal year, there is authorized to be appropriated for fees under this section an amount equivalent to the total amount of fees assessed for such fiscal year under this section.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HC9FA7AB0ECBE411EA3BBBECC74A4300A"><enum>103.</enum><header>Penalties</header> 
<subsection id="H8EF0C9025BFA408BB7F37AED5EBD775A"><enum>(a)</enum><header>Prohibited acts</header><text>Section 301 (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H5ADB886B083A467690AA0A587B6D2439" style="OLC"> 
<subsection id="H3FA006AF49E545199B51BD5C81C0FBB0"><enum>(ccc)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H01C95F2C530542B38F68E659B2C850CB"><enum>(1)</enum><text>The resale of a compounded drug that is labeled <quote>not for resale</quote> in accordance with section 503B.</text></paragraph> 
<paragraph id="H86C6AAC4489B4536BFC445F1DDF8FA7B" indent="up1"><enum>(2)</enum><text>With respect to a drug to be compounded pursuant to section 503A or 503B, the intentional falsification of a prescription, as applicable.</text></paragraph> 
<paragraph id="H42D99A71123B4A43A93A5CBF0EB68049" indent="up1"><enum>(3)</enum><text>The failure to report drugs or adverse events by an entity that is registered in accordance with subsection (b) of section 503B.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA2B6C9663BD74BD893F068AC98766625"><enum>(b)</enum><header>Misbranded drugs</header><text>Section 502 (<external-xref legal-doc="usc" parsable-cite="usc/21/352">21 U.S.C. 352</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H39944BC8445048E7A543A0F0643C4359"><enum>(bb)</enum><text>If the advertising or promotion of a compounded drug is false or misleading in any particular.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HEE168D92AAD843298AAE0DEF5946A997"><enum>104.</enum><header>Regulations</header> 
<subsection id="H3A8A0589F99A478CB8E775F1DBADD5FB"><enum></enum><text>In promulgating any regulations to implement this title (and the amendments made by this title), the Secretary of Health and Human Services shall—</text> 
<paragraph id="H6C3C1DB6FE424CFEB09D845FDC94D689"><enum>(1)</enum><text>issue a notice of proposed rulemaking that includes the proposed regulation;</text></paragraph> 
<paragraph id="H43FCA670A8E54001926647D5A21A3C58"><enum>(2)</enum><text>provide a period of not less than 60 calendar days for comments on the proposed regulation; and</text></paragraph> 
<paragraph id="HBAF983BE990247BBBE017E60C25F8294"><enum>(3)</enum><text>publish the final regulation not more than 18 months following publication of the proposed rule and not less than 30 calendar days before the effective date of such final regulation.</text></paragraph></subsection></section> 
<section id="H0BC9856F7F2342F5919CA241C2D9D745"><enum>105.</enum><header>Enhanced communication</header> 
<subsection id="H305E330A9DCF42159AE48BF70B17AE3C"><enum>(a)</enum><header>Submissions from State boards of pharmacy</header><text>In a manner specified by the Secretary of Health and Human Services (referred to in this section as the <quote>Secretary</quote>), the Secretary shall receive submissions from State boards of pharmacy—</text> 
<paragraph id="H5857537C9AB7458CA710FF343F74C85C"><enum>(1)</enum><text>describing actions taken against compounding pharmacies, as described in subsection (b); or</text></paragraph> 
<paragraph id="H6CD51D1669C94D3DA2902A4CCFDE95FF"><enum>(2)</enum><text>expressing concerns that a compounding pharmacy may be acting contrary to section 503A of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/353a">21 U.S.C. 353a</external-xref>).</text></paragraph></subsection> 
<subsection id="H84E79A8CBF634F5993233A5CBD423B9B"><enum>(b)</enum><header>Content of submissions from state boards of pharmacy</header><text>An action referred to in subsection (a)(1) is, with respect to a pharmacy that compounds drugs, any of the following:</text> 
<paragraph id="H7925CD86554C45A69FA088EDFD4123E7"><enum>(1)</enum><text>The issuance of a warning letter, or the imposition of sanctions or penalties, by a State for violations of a State’s pharmacy regulations pertaining to compounding.</text></paragraph> 
<paragraph id="H5C5DA9EB0A5342E4923E3507E24AE6E1"><enum>(2)</enum><text>The suspension or revocation of a State-issued pharmacy license or registration for violations of a State’s pharmacy regulations pertaining to compounding.</text></paragraph> 
<paragraph id="H661045E6520047878C7F349033791AA6"><enum>(3)</enum><text>The recall of a compounded drug due to concerns relating to the quality or purity of such drug.</text></paragraph></subsection> 
<subsection id="H6BACDC410F8C4E63AC7FA156DE8620C8"><enum>(c)</enum><header>Consultation</header><text>The Secretary shall implement subsection (a) in consultation with the National Association of Boards of Pharmacy.</text></subsection> 
<subsection id="HBBC9F4CCD05349BE98B9E2390353CC47"><enum>(d)</enum><header>Notifying state boards of pharmacy</header><text>The Secretary shall immediately notify State boards of pharmacy when—</text> 
<paragraph id="H8E200914682D49CC994C273E18DFE51A"><enum>(1)</enum><text>the Secretary receives a submission under subsection (a)(1); or</text></paragraph> 
<paragraph id="HDCE2F3D1CDDA4B3B9B5D76482BCFC256"><enum>(2)</enum><text>the Secretary makes a determination that a pharmacy is acting contrary to section 503A of the Federal Food, Drug, and Cosmetic Act.</text></paragraph></subsection></section> 
<section id="H7DC9A190021845C9A3F68693FAB398A7"><enum>106.</enum><header>Severability</header> 
<subsection id="HF539B8FC37D74BA089ADA6E4E22FDC97"><enum>(a)</enum><header>In general</header><text>Section 503A (<external-xref legal-doc="usc" parsable-cite="usc/21/353a">21 U.S.C. 353a</external-xref>) is amended —</text> 
<paragraph id="H8357B768348C4C78BBE9070FEEFCEA3D"><enum>(1)</enum><text>in subsection (a), in the matter preceding paragraph (1), by striking <quote>unsolicited</quote>;</text></paragraph> 
<paragraph id="H37010F4F5EDE4C95B20A206229DCF4BF"><enum>(2)</enum><text>by striking subsection (c);</text></paragraph> 
<paragraph id="H273BBAF4477F486482296251700E59F4"><enum>(3)</enum><text>by redesignating subsections (d) through (f) as subsections (c) through (e), respectively; and</text></paragraph> 
<paragraph id="HADDE5BDC570B419AA3E8D637A779DEA3"><enum>(4)</enum><text>in subsection (b)(1)(A)(i)(III), by striking <quote>subsection (d)</quote> and inserting <quote>subsection (c)</quote>.</text></paragraph></subsection> 
<subsection id="HEC358E8177FE404683CA85BE65AD701A"><enum>(b)</enum><header>Severability</header><text>If any provision of this Act (including the amendments made by this Act) is declared unconstitutional, or the applicability of this Act (including the amendments made by this Act) to any person or circumstance is held invalid, the constitutionality of the remainder of this Act (including the amendments made by this Act) and the applicability thereof to other persons and circumstances shall not be affected.</text></subsection></section> 
<section id="H36AA36FBDBC64822BE9696EC89FBA050"><enum>107.</enum><header>GAO study</header> 
<subsection id="H671B65D3496C4D7CB72AE897ABB6E61F"><enum>(a)</enum><header>Study</header><text>Not later than 36 months after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on pharmacy compounding and the adequacy of State and Federal efforts to assure the safety of compounded drugs.</text></subsection> 
<subsection id="HED0C29C588A84B24BC4DA653E8F3180D"><enum>(b)</enum><header>Contents</header><text>The report required under this section shall include—</text> 
<paragraph id="H5C7E30272AF14A5FB71CDA1F2F15F014"><enum>(1)</enum><text>a review of pharmacy compounding in each State, and the settings in which such compounding occurs;</text></paragraph> 
<paragraph id="HAC33E9EA126449D1B565E231BADDEE9C"><enum>(2)</enum><text>a review of the State laws and policies governing pharmacy compounding, including enforcement of State laws and policies;</text></paragraph> 
<paragraph id="H65E2793C8F3E4FEDBF70403F3DB3A625"><enum>(3)</enum><text>an assessment of the available tools to permit purchasers of compounded drugs to determine the safety and quality of such drugs;</text></paragraph> 
<paragraph id="H00E683F20C484A26A350AB0714203F07"><enum>(4)</enum><text>an evaluation of the effectiveness of the communication among States and between States and the Food and Drug Administration regarding compounding; and</text></paragraph> 
<paragraph id="H2A813C596D5B44D79E49875C8D1B556A"><enum>(5)</enum><text>an evaluation of the Food and Drug Administration's implementation of sections 503A and 503B of the Federal Food, Drug, and Cosmetic Act.</text></paragraph></subsection></section></title> 
<title id="HC1C77FA4874B4AC3BA22C26562F837A2"><enum>II</enum><header>Drug Supply Chain Security</header> 
<section id="H96BA2CB644DA4A40AE9595A38836B2B2"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Drug Supply Chain Security Act</short-title></quote>.</text></section> 
<section id="HCF2F9929051F472F901AF87A4D1AF1D9"><enum>202.</enum><header>Pharmaceutical distribution supply chain</header><text display-inline="no-display-inline">Chapter V (<external-xref legal-doc="usc" parsable-cite="usc/21/351">21 U.S.C. 351 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H4E2D857DD1074D10A0703847C2C3680C"><enum>581.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text> 
<paragraph id="H53BE93104F384E6EAD49FD42BCA85053"><enum>(1)</enum><header>Affiliate</header><text>The term <term>affiliate</term> means a business entity that has a relationship with a second business entity if, directly or indirectly—</text> 
<subparagraph id="H73B09D2E57634D7496010F8BE170090C"><enum>(A)</enum><text>one business entity controls, or has the power to control, the other business entity; or</text></subparagraph> 
<subparagraph id="HCFF3BFE25E4A47E3BA980631638F312D"><enum>(B)</enum><text>a third party controls, or has the power to control, both of the business entities.</text></subparagraph></paragraph> 
<paragraph id="HB215D8F7BE2E4157B1CCC6DFA0DD1CED"><enum>(2)</enum><header>Authorized</header><text>The term <term>authorized</term> means—</text> 
<subparagraph id="HCCAEB581882A4487BCAE6CE3EFE5FF0C"><enum>(A)</enum><text>in the case of a manufacturer or repackager, having a valid registration in accordance with section 510;</text></subparagraph> 
<subparagraph id="H480021156FC24CC6BBD7368214CBBC39"><enum>(B)</enum><text>in the case of a wholesale distributor, having a valid license under State law or section 583, in accordance with section 582(a)(6), and complying with the licensure reporting requirements under section 503(e), as amended by the <short-title>Drug Supply Chain Security Act</short-title>;</text></subparagraph> 
<subparagraph id="HBBA5DF8F32964834B90A734C1DAA3371"><enum>(C)</enum><text>in the case of a third-party logistics provider, having a valid license under State law or section 584(a)(1), in accordance with section 582(a)(7), and complying with the licensure reporting requirements under section 584(b); and</text></subparagraph> 
<subparagraph id="HF87625B04EE049C187F11ECD1D3632A6"><enum>(D)</enum><text>in the case of a dispenser, having a valid license under State law.</text></subparagraph></paragraph> 
<paragraph id="HB9644D931F1E422B8E6EEE5E449BE82C"><enum>(3)</enum><header>Dispenser</header><text>The term <term>dispenser</term>—</text> 
<subparagraph id="HB7380238BDBB4B538B4C7B3CAF2599D5"><enum>(A)</enum><text>means a retail pharmacy, hospital pharmacy, a group of chain pharmacies under common ownership and control that do not act as a wholesale distributor, or any other person authorized by law to dispense or administer prescription drugs, and the affiliated warehouses or distribution centers of such entities under common ownership and control that do not act as a wholesale distributor; and</text></subparagraph> 
<subparagraph id="HBB801A2532E34D24A024BB81003DDA12"><enum>(B)</enum><text>does not include a person who dispenses only products to be used in animals in accordance with section 512(a)(5).</text></subparagraph></paragraph> 
<paragraph id="H4FC00FCC71FE4C54B0C83FDB5049DC3C"><enum>(4)</enum><header>Disposition</header><text>The term <term>disposition</term>, with respect to a product within the possession or control of an entity, means the removal of such product from the pharmaceutical distribution supply chain, which may include disposal or return of the product for disposal or other appropriate handling and other actions, such as retaining a sample of the product for further additional physical examination or laboratory analysis of the product by a manufacturer or regulatory or law enforcement agency.</text></paragraph> 
<paragraph id="HC8CF2A792CF3427890475A8B718D9408"><enum>(5)</enum><header>Distribute or distribution</header><text>The term <term>distribute</term> or <term>distribution</term> means the sale, purchase, trade, delivery, handling, storage, or receipt of a product, and does not include the dispensing of a product pursuant to a prescription executed in accordance with section 503(b)(1) or the dispensing of a product approved under section 512(b).</text></paragraph> 
<paragraph id="HB91EC2BC914A436280AF9949AE315049"><enum>(6)</enum><header>Exclusive distributor</header><text>The term <term>exclusive distributor</term> means the wholesale distributor that directly purchased the product from the manufacturer and is the sole distributor of that manufacturer's product to a subsequent repackager, wholesale distributor, or dispenser.</text></paragraph> 
<paragraph id="H67B1CC2227894A3DA6D68B7003C28058"><enum>(7)</enum><header>Homogeneous case</header><text>The term <term>homogeneous case</term> means a sealed case containing only product that has a single National Drug Code number belonging to a single lot.</text></paragraph> 
<paragraph id="H7EAABB9A93FD427AACFCD916553804A2"><enum>(8)</enum><header>Illegitimate product</header><text>The term <term>illegitimate product</term> means a product for which credible evidence shows that the product—</text> 
<subparagraph id="H946D8DFB000B4D3BAC8C355EF7E28CCC"><enum>(A)</enum><text>is counterfeit, diverted, or stolen;</text></subparagraph> 
<subparagraph id="HBCEC6DF3E8734507BF6A9785D6CE2D2C"><enum>(B)</enum><text>is intentionally adulterated such that the product would result in serious adverse health consequences or death to humans;</text></subparagraph> 
<subparagraph id="H9AD761DD8A124B799870739049532ECB"><enum>(C)</enum><text>is the subject of a fraudulent transaction; or</text></subparagraph> 
<subparagraph id="H252B52013D7F4C5997F882D05CF96434"><enum>(D)</enum><text>appears otherwise unfit for distribution such that the product would be reasonably likely to result in serious adverse health consequences or death to humans.</text></subparagraph></paragraph> 
<paragraph id="H18FA9E9DFF5A4473A0298377F56844A8"><enum>(9)</enum><header>Licensed</header><text>The term <term>licensed</term> means—</text> 
<subparagraph id="H84FE501785964BAD8EEA6B967021C1EE"><enum>(A)</enum><text>in the case of a wholesale distributor, having a valid license in accordance with section 503(e) or section 582(a)(6), as applicable;</text></subparagraph> 
<subparagraph id="HCB3BBD82CF584A419B672F2929073BDB"><enum>(B)</enum><text>in the case of a third-party logistics provider, having a valid license in accordance with section 584(a) or section 582(a)(7), as applicable; and</text></subparagraph> 
<subparagraph id="H574FEC733D7549D9A1DCB062211C67A0"><enum>(C)</enum><text>in the case of a dispenser, having a valid license under State law.</text></subparagraph></paragraph> 
<paragraph id="H2E44D8D824544DB5BEA47AA095BFF0DB"><enum>(10)</enum><header>Manufacturer</header><text>The term <term>manufacturer</term> means, with respect to a product—</text> 
<subparagraph id="HCA912582DD7E48D8AE34BA4F19F80E86"><enum>(A)</enum><text>a person that holds an application approved under section 505 or a license issued under section 351 of the Public Health Service Act for such product, or if such product is not the subject of an approved application or license, the person who manufactured the product;</text></subparagraph> 
<subparagraph id="HCAA666792F6A42A288C0A6AEF233EF74"><enum>(B)</enum><text>a co-licensed partner of the person described in subparagraph (A) that obtains the product directly from a person described in this subparagraph or subparagraph (A) or (C); or</text></subparagraph> 
<subparagraph id="H3D597FA35F2B42C49F2B9F8D27775E8F"><enum>(C)</enum><text>an affiliate of a person described in subparagraph (A) or (B) that receives the product directly from a person described in this subparagraph or subparagraph (A) or (B).</text></subparagraph></paragraph> 
<paragraph id="HCB6E4113CAB948C0AE37B6357CC7D3D3"><enum>(11)</enum><header>Package</header> 
<subparagraph id="H51430EFD34C54CCE90E36AF70548932F"><enum>(A)</enum><header>In general</header><text>The term <term>package</term> means the smallest individual saleable unit of product for distribution by a manufacturer or repackager that is intended by the manufacturer for ultimate sale to the dispenser of such product.</text></subparagraph> 
<subparagraph id="HBADEEB4CA57F4FF390C4B742E64D0FC7"><enum>(B)</enum><header>Individual saleable unit</header><text>For purposes of this paragraph, an <term>individual saleable unit</term> is the smallest container of product introduced into commerce by the manufacturer or repackager that is intended by the manufacturer or repackager for individual sale to a dispenser.</text></subparagraph></paragraph> 
<paragraph id="H1DE1A1B042E245AFADB42B4A7A3DE750"><enum>(12)</enum><header>Prescription drug</header><text>The term <term>prescription drug</term> means a drug for human use subject to section 503(b)(1).</text></paragraph> 
<paragraph id="H845217F48559470E814F8C47F01F9821"><enum>(13)</enum><header>Product</header><text>The term <term>product</term> means a prescription drug in a finished dosage form for administration to a patient without substantial further manufacturing (such as capsules, tablets, and lyophilized products before reconstitution), but for purposes of section 582, does not include blood or blood components intended for transfusion, radioactive drugs or radioactive biological products (as defined in <external-xref legal-doc="regulation" parsable-cite="cfr/21/600.3">section 600.3(ee)</external-xref> of title 21, Code of Federal Regulations) that are regulated by the Nuclear Regulatory Commission or by a State pursuant to an agreement with such Commission under section 274 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2021">42 U.S.C. 2021</external-xref>), imaging drugs, an intravenous product described in clause (xiv), (xv), or (xvi) of paragraph (24)(B), any medical gas (as defined in section 575), homeopathic drugs marketed in accordance with applicable guidance under this Act, or a drug compounded in compliance with section 503A or 503B.</text></paragraph> 
<paragraph id="H9757DBDCCCD04366A24A9A027E606642"><enum>(14)</enum><header>Product identifier</header><text>The term <term>product identifier</term> means a standardized graphic that includes, in both human-readable form and on a machine-readable data carrier that conforms to the standards developed by a widely recognized international standards development organization, the standardized numerical identifier, lot number, and expiration date of the product.</text></paragraph> 
<paragraph id="H5DF2D20BEA844BDDB44216965A40B67A"><enum>(15)</enum><header>Quarantine</header><text>The term <term>quarantine</term> means the storage or identification of a product, to prevent distribution or transfer of the product, in a physically separate area clearly identified for such use or through other procedures.</text></paragraph> 
<paragraph id="H498ECEBB88B243C6A6221EDF0C185276"><enum>(16)</enum><header>Repackager</header><text>The term <term>repackager</term> means a person who owns or operates an establishment that repacks and relabels a product or package for—</text> 
<subparagraph id="H4C1DC8164C164103BCB569EDFED8105B"><enum>(A)</enum><text>further sale; or</text></subparagraph> 
<subparagraph id="H03AF49AC24C24531B9539653911FFD25"><enum>(B)</enum><text>distribution without a further transaction.</text></subparagraph></paragraph> 
<paragraph id="HF2EE82F9B33C4709AB520CF74ED7603C"><enum>(17)</enum><header>Return</header><text>The term <term>return</term> means providing product to the authorized immediate trading partner from which such product was purchased or received, or to a returns processor or reverse logistics provider for handling of such product.</text></paragraph> 
<paragraph id="H3967D9BCBDAA42DDA7879377AC31BAD8"><enum>(18)</enum><header>Returns processor or reverse logistics provider</header><text>The term <term>returns processor</term> or <term>reverse logistics provider</term> means a person who owns or operates an establishment that dispositions or otherwise processes saleable or nonsaleable product received from an authorized trading partner such that the product may be processed for credit to the purchaser, manufacturer, or seller or disposed of for no further distribution.</text></paragraph> 
<paragraph id="HB734FF8216BB4FE289D38A8AA4AEEA3B"><enum>(19)</enum><header>Specific patient need</header><text>The term <term>specific patient need</term> refers to the transfer of a product from one pharmacy to another to fill a prescription for an identified patient. Such term does not include the transfer of a product from one pharmacy to another for the purpose of increasing or replenishing stock in anticipation of a potential need.</text></paragraph> 
<paragraph id="HCF9E315A399F4A96B883922F8D4AE831"><enum>(20)</enum><header>Standardized numerical identifier</header><text>The term <term>standardized numerical identifier</term> means a set of numbers or characters used to uniquely identify each package or homogenous case that is composed of the National Drug Code that corresponds to the specific product (including the particular package configuration) combined with a unique alphanumeric serial number of up to 20 characters.</text></paragraph> 
<paragraph id="H7A37ABDE174E4FE983F566AE02A9F8C0"><enum>(21)</enum><header>Suspect product</header><text>The term <term>suspect product</term> means a product for which there is reason to believe that such product—</text> 
<subparagraph id="H7528D811DCAE4807BA36E7B5096126BE"><enum>(A)</enum><text>is potentially counterfeit, diverted, or stolen;</text></subparagraph> 
<subparagraph id="HEE1C9B105B0B473ABB7AECC8CD95B228"><enum>(B)</enum><text>is potentially intentionally adulterated such that the product would result in serious adverse health consequences or death to humans;</text></subparagraph> 
<subparagraph id="H366C2E79BDB443AA9D53957C426C8766"><enum>(C)</enum><text>is potentially the subject of a fraudulent transaction; or</text></subparagraph> 
<subparagraph id="HA24C2364A99346A89F0CF96B911D5D03"><enum>(D)</enum><text>appears otherwise unfit for distribution such that the product would result in serious adverse health consequences or death to humans.</text></subparagraph></paragraph> 
<paragraph id="HB26E85B5DA01470EA79181B4F4684E36"><enum>(22)</enum><header>Third-party logistics provider</header><text>The term <term>third-party logistics provider</term> means an entity that provides or coordinates warehousing, or other logistics services of a product in interstate commerce on behalf of a manufacturer, wholesale distributor, or dispenser of a product, but does not take ownership of the product, nor have responsibility to direct the sale or disposition of the product.</text></paragraph> 
<paragraph id="H415FB703D3664C3988EB3E466041163A"><enum>(23)</enum><header>Trading partner</header><text>The term <term>trading partner</term> means—</text> 
<subparagraph id="H582BA27DECB343E2AD74B3BC2D65FDFC"><enum>(A)</enum><text>a manufacturer, repackager, wholesale distributor, or dispenser from whom a manufacturer, repackager, wholesale distributor, or dispenser accepts direct ownership of a product or to whom a manufacturer, repackager, wholesale distributor, or dispenser transfers direct ownership of a product; or</text></subparagraph> 
<subparagraph id="H3126DA3C65974AF6901C05ECBBFB5AB2"><enum>(B)</enum><text>a third-party logistics provider from whom a manufacturer, repackager, wholesale distributor, or dispenser accepts direct possession of a product or to whom a manufacturer, repackager, wholesale distributor, or dispenser transfers direct possession of a product.</text></subparagraph></paragraph> 
<paragraph id="HB19DB6DB03904AE1AD79AF9DFB203C9C"><enum>(24)</enum><header>Transaction</header> 
<subparagraph id="H8071069CF11140778777EA3FCA9164EB"><enum>(A)</enum><header>In general</header><text>The term <term>transaction</term> means the transfer of product between persons in which a change of ownership occurs.</text></subparagraph> 
<subparagraph id="HEEDC0AE92FC346578398B817384C012E"><enum>(B)</enum><header>Exemptions</header><text>The term <term>transaction</term> does not include—</text> 
<clause id="H0F06046868C644859DF45DDC85BA2926"><enum>(i)</enum><text>intracompany distribution of any product between members of an affiliate or within a manufacturer;</text></clause> 
<clause id="H3BFA98070DDE4330B184A340374C0C53"><enum>(ii)</enum><text>the distribution of a product among hospitals or other health care entities that are under common control;</text></clause> 
<clause id="HAB3932764E1F45E48D5E277F3E2FBC6F"><enum>(iii)</enum><text>the distribution of a product for emergency medical reasons including a public health emergency declaration pursuant to section 319 of the Public Health Service Act, except that a drug shortage not caused by a public health emergency shall not constitute an emergency medical reason;</text></clause> 
<clause id="HDD7B4592913F4892B4D6A64B9DE24DA1"><enum>(iv)</enum><text>the dispensing of a product pursuant to a prescription executed in accordance with section 503(b)(1);</text></clause> 
<clause id="HA56D6ECC8BEC46BFAD76E268DBD296AD"><enum>(v)</enum><text>the distribution of product samples by a manufacturer or a licensed wholesale distributor in accordance with section 503(d);</text></clause> 
<clause id="H1891D40E984545489B7707B63026D26E"><enum>(vi)</enum><text>the distribution of blood or blood components intended for transfusion;</text></clause> 
<clause id="H71FBBEF1D78A4445992653720A670DA2"><enum>(vii)</enum><text>the distribution of minimal quantities of product by a licensed retail pharmacy to a licensed practitioner for office use;</text></clause> 
<clause id="H6E3E272812A446D4BEB60793017020FC"><enum>(viii)</enum><text>the sale, purchase, or trade of a drug or an offer to sell, purchase, or trade a drug by a charitable organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 to a nonprofit affiliate of the organization to the extent otherwise permitted by law;</text></clause> 
<clause id="HA764D5A541AA44F190B45E7B3A1D530B"><enum>(ix)</enum><text>the distribution of a product pursuant to the sale or merger of a pharmacy or pharmacies or a wholesale distributor or wholesale distributors, except that any records required to be maintained for the product shall be transferred to the new owner of the pharmacy or pharmacies or wholesale distributor or wholesale distributors;</text></clause> 
<clause id="HC5BB6B1D633F4B1ABE9C3EC9B8F15801"><enum>(x)</enum><text>the dispensing of a product approved under section 512(c);</text></clause> 
<clause id="H5313FFDFAA02420F9A5426E79A66DA66"><enum>(xi)</enum><text>products transferred to or from any facility that is licensed by the Nuclear Regulatory Commission or by a State pursuant to an agreement with such Commission under section 274 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2021">42 U.S.C. 2021</external-xref>);</text></clause> 
<clause id="H448D8AB8D3B1438EAE2FCB735708C68E"><enum>(xii)</enum><text>a combination product that is not subject to approval under section 505 or licensure under section 351 of the Public Health Service Act, and that is—</text> 
<subclause id="HF0D17C03641043ACBE115780FD3C22A1"><enum>(I)</enum><text>a product comprised of a device and 1 or more other regulated components (such as a drug/device, biologic/device, or drug/device/biologic) that are physically, chemically, or otherwise combined or mixed and produced as a single entity;</text></subclause> 
<subclause id="H295ADBC1E67447728C9A2D618DBCDAE2"><enum>(II)</enum><text>2 or more separate products packaged together in a single package or as a unit and comprised of a drug and device or device and biological product; or</text></subclause> 
<subclause id="H13EE3FFFBC9840BFA3CBE5A565E9FD78"><enum>(III)</enum><text>2 or more finished medical devices plus one or more drug or biological products that are packaged together in what is referred to as a <quote>medical convenience kit</quote> as described in clause (xiii);</text></subclause></clause> 
<clause id="H083AE0EF8B814E21BFB8B95A95A47442"><enum>(xiii)</enum><text>the distribution of a collection of finished medical devices, which may include a product or biological product, assembled in kit form strictly for the convenience of the purchaser or user (referred to in this clause as a <quote>medical convenience kit</quote>) if—</text> 
<subclause id="H7C1F537381844EEBAB1753CFF1145D0F"><enum>(I)</enum><text>the medical convenience kit is assembled in an establishment that is registered with the Food and Drug Administration as a device manufacturer in accordance with section 510(b)(2);</text></subclause> 
<subclause id="HDE36C4D82A73415098FD54A520A29126"><enum>(II)</enum><text>the medical convenience kit does not contain a controlled substance that appears in a schedule contained in the Comprehensive Drug Abuse Prevention and Control Act of 1970;</text></subclause> 
<subclause id="H736DF5B1B3BD474792A917FF9D75D037"><enum>(III)</enum><text>in the case of a medical convenience kit that includes a product, the person that manufacturers the kit—</text> 
<item id="H127EB323AC8E46839E286BCCD73DBBC8"><enum>(aa)</enum><text>purchased such product directly from the pharmaceutical manufacturer or from a wholesale distributor that purchased the product directly from the pharmaceutical manufacturer; and</text></item> 
<item id="H72EAB1F7FEA949558058AE218DE2C6B9"><enum>(bb)</enum><text>does not alter the primary container or label of the product as purchased from the manufacturer or wholesale distributor; and</text></item></subclause> 
<subclause commented="no" id="H38F17D48F8A344DC9954F3E3F003431F"><enum>(IV)</enum><text>in the case of a medical convenience kit that includes a product, the product is—</text> 
<item commented="no" id="H703393CB85EA465EA1AD21A824DAA75C"><enum>(aa)</enum><text>an intravenous solution intended for the replenishment of fluids and electrolytes;</text></item> 
<item commented="no" id="H164CEA7BE2D1486197DFC381FB862891"><enum>(bb)</enum><text>a product intended to maintain the equilibrium of water and minerals in the body;</text></item> 
<item commented="no" id="HCE8FA73207634CC589D39A67BD87C846"><enum>(cc)</enum><text>a product intended for irrigation or reconstitution;</text></item> 
<item commented="no" id="H38DFC561A11E41B28C44B645E281DF48"><enum>(dd)</enum><text>an anesthetic;</text></item> 
<item commented="no" id="H43600384CBC544A6B69D2D1C1F8C79B6"><enum>(ee)</enum><text>an anticoagulant;</text></item> 
<item commented="no" id="HE20E31DE28374FD4B18F5F4E7B267B09"><enum>(ff)</enum><text>a vasopressor; or</text></item> 
<item id="H9F3489EC2A87472BB1CE3CB2CC671DAD"><enum>(gg)</enum><text display-inline="yes-display-inline">a sympathomimetic;</text></item></subclause></clause> 
<clause id="H68A7B0954A5A4340803698174119271C"><enum>(xiv)</enum><text>the distribution of an intravenous product that, by its formulation, is intended for the replenishment of fluids and electrolytes (such as sodium, chloride, and potassium) or calories (such as dextrose and amino acids);</text></clause> 
<clause id="H8A7C2A372E6749D9A7BD83102CAC55A4"><enum>(xv)</enum><text>the distribution of an intravenous product used to maintain the equilibrium of water and minerals in the body, such as dialysis solutions;</text></clause> 
<clause id="H3940FB6EB4BB4B1DB58C561FA2C23BB0"><enum>(xvi)</enum><text>the distribution of a product that is intended for irrigation, or sterile water, whether intended for such purposes or for injection;</text></clause> 
<clause id="H52581B771DA0490DB604BB25C77F3256"><enum>(xvii)</enum><text>the distribution of a medical gas (as defined in section 575); or</text></clause> 
<clause id="H4AC51B3BE3F147E4ABA1B9908D425BFD"><enum>(xviii)</enum><text>the distribution or sale of any licensed product under section 351 of the Public Health Service Act that meets the definition of a device under section 201(h).</text></clause></subparagraph></paragraph> 
<paragraph id="HDE5BD86F37E24959A9756A9451429BC3"><enum>(25)</enum><header>Transaction history</header><text>The term <term>transaction history</term> means a statement in paper or electronic form, including the transaction information for each prior transaction going back to the manufacturer of the product.</text></paragraph> 
<paragraph id="H2D2A886079B6450196B423907017CB1E"><enum>(26)</enum><header>Transaction information</header><text>The term <term>transaction information</term> means—</text> 
<subparagraph id="H443EC740FBD84EA68CCC89C400DF5B50"><enum>(A)</enum><text>the proprietary or established name or names of the product;</text></subparagraph> 
<subparagraph id="H1BEB7D93455A4C8795FF9BDBC4E6A50E"><enum>(B)</enum><text>the strength and dosage form of the product;</text></subparagraph> 
<subparagraph id="H76F6D1C51ABD4724A7A04F8A35669142"><enum>(C)</enum><text>the National Drug Code number of the product;</text></subparagraph> 
<subparagraph id="H22D87F1DD0FD4253B3A2748A51FDBFAA"><enum>(D)</enum><text>the container size;</text></subparagraph> 
<subparagraph id="HAC243888C3534818BA0B25367DD251FA"><enum>(E)</enum><text>the number of containers;</text></subparagraph> 
<subparagraph id="HD5C6A053C65043A0AC64AFE69C6487BD"><enum>(F)</enum><text>the lot number of the product;</text></subparagraph> 
<subparagraph id="H95C414140442468497F70348EA5C0632"><enum>(G)</enum><text>the date of the transaction;</text></subparagraph> 
<subparagraph id="H036A3E4B0EC840D89431F92BF72F8D07"><enum>(H)</enum><text>the date of the shipment, if more than 24 hours after the date of the transaction;</text></subparagraph> 
<subparagraph id="H35AE9362BFB7483296EB60EF7DFB6C83"><enum>(I)</enum><text>the business name and address of the person from whom ownership is being transferred; and</text></subparagraph> 
<subparagraph id="H6A6DB8FF394241738C45870A074AC9C3"><enum>(J)</enum><text>the business name and address of the person to whom ownership is being transferred.</text></subparagraph></paragraph> 
<paragraph id="H7B52486FF8AA431D83D9DFBAF942C97D"><enum>(27)</enum><header>Transaction statement</header><text>The <term>transaction statement</term> is a statement, in paper or electronic form, that the entity transferring ownership in a transaction—</text> 
<subparagraph id="H2D66B2F689B34A4FB241DF1D1A066882"><enum>(A)</enum><text>is authorized as required under the <short-title>Drug Supply Chain Security Act</short-title>;</text></subparagraph> 
<subparagraph id="H92F66789171842C0A8B33467B98950C3"><enum>(B)</enum><text>received the product from a person that is authorized as required under the <short-title>Drug Supply Chain Security Act</short-title>;</text></subparagraph> 
<subparagraph id="H81B5BF10D9E847B1AC22A456A5EBE33C"><enum>(C)</enum><text>received transaction information and a transaction statement from the prior owner of the product, as required under section 582;</text></subparagraph> 
<subparagraph id="H4F92DDEFDB114FB781BDEF0ED9C507CA"><enum>(D)</enum><text>did not knowingly ship a suspect or illegitimate product;</text></subparagraph> 
<subparagraph id="H2F530CB6441B40E587FFB61D9AF2F1DF"><enum>(E)</enum><text>had systems and processes in place to comply with verification requirements under section 582;</text></subparagraph> 
<subparagraph id="H9229CEEDBCB7471699D49985071BE703"><enum>(F)</enum><text>did not knowingly provide false transaction information; and</text></subparagraph> 
<subparagraph id="H2E37E84CB2534C109022DE2F092D6D01"><enum>(G)</enum><text>did not knowingly alter the transaction history.</text></subparagraph></paragraph> 
<paragraph id="H27607C20FF99434D9C94AFB2E73CACCF"><enum>(28)</enum><header>Verification or verify</header><text>The term <term>verification</term> or <term>verify</term> means determining whether the product identifier affixed to, or imprinted upon, a package or homogeneous case corresponds to the standardized numerical identifier or lot number and expiration date assigned to the product by the manufacturer or the repackager, as applicable in accordance with section 582.</text></paragraph> 
<paragraph commented="no" id="HFC3E4D4301144DE3BCD661671A8F4B39"><enum>(29)</enum><header>Wholesale distributor</header><text>The term <term>wholesale distributor</term> means a person (other than a manufacturer, a manufacturer's co-licensed partner, a third-party logistics provider, or repackager) engaged in wholesale distribution (as defined in section 503(e)(4), as amended by the <short-title>Drug Supply Chain Security Act</short-title>).</text></paragraph></section> 
<section id="H2D31566D5FD8475AA2002D1570061E86"><enum>582.</enum><header>Requirements</header> 
<subsection id="HD6573B0B4BA043A3923D0065FE210000"><enum>(a)</enum><header>In general</header> 
<paragraph id="H5B03CB230DE04765BC55F6E3A00A6A41"><enum>(1)</enum><header>Other activities</header><text>Each manufacturer, repackager, wholesale distributor, and dispenser shall comply with the requirements set forth in this section with respect to the role of such manufacturer, repackager, wholesale distributor, or dispenser in a transaction involving product. If an entity meets the definition of more than one of the entities listed in the preceding sentence, such entity shall comply with all applicable requirements in this section, but shall not be required to duplicate requirements.</text></paragraph> 
<paragraph id="H9E5B150D915C48A28443AAC2150FD677"><enum>(2)</enum><header>Initial standards</header> 
<subparagraph id="H96BC93C54CDD4A1590650A971969836C"><enum>(A)</enum><header>In general</header><text>The Secretary shall, in consultation with other appropriate Federal officials, manufacturers, repackagers, wholesale distributors, dispensers, and other pharmaceutical distribution supply chain stakeholders, issue a draft guidance document that establishes standards for the interoperable exchange of transaction information, transaction history, and transaction statements, in paper or electronic format, for compliance with this subsection and subsections (b), (c), (d), and (e). In establishing such standards, the Secretary shall consider the feasibility of establishing standardized documentation to be used by members of the pharmaceutical distribution supply chain to convey the transaction information, transaction history, and transaction statement to the subsequent purchaser of a product and to facilitate the exchange of lot level data. The standards established under this paragraph shall take into consideration the standards established under section 505D and shall comply with a form and format developed by a widely recognized international standards development organization.</text></subparagraph> 
<subparagraph id="H763AB1DA6DAA4698A888D2150A56AB03"><enum>(B)</enum><header>Public input</header><text>Prior to issuing the draft guidance under subparagraph (A), the Secretary shall gather comments and information from stakeholders and maintain such comments and information in a public docket for at least 60 days prior to issuing such guidance.</text></subparagraph> 
<subparagraph id="HA02647BA553E4ABEAF4E8FFA69636D10"><enum>(C)</enum><header>Publication</header><text>The Secretary shall publish the standards established under subparagraph (A) not later than 1 year after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>.</text></subparagraph></paragraph> 
<paragraph id="H00B0E743FDFB46F4B7EAA15395E8D0E0"><enum>(3)</enum><header>Waivers, exceptions, and exemptions</header> 
<subparagraph id="HBC33F874C6E0490EA0CF72C0648C443A"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, the Secretary shall, by guidance—</text> 
<clause id="H63E9662C0FE74E379B09C971F32C61DA"><enum>(i)</enum><text>establish a process by which an authorized manufacturer, repackager, wholesale distributor, or dispenser may request a waiver from any of the requirements set forth in this section, which the Secretary may grant if the Secretary determines that such requirements would result in an undue economic hardship or for emergency medical reasons, including a public health emergency declaration pursuant to section 319 of the Public Health Service Act;</text></clause> 
<clause id="H865847AC5A6A420A8A2D7D6969C7DAFE"><enum>(ii)</enum><text>establish a process by which the Secretary determines exceptions, and a process through which a manufacturer or repackager may request such an exception, to the requirements relating to product identifiers if a product is packaged in a container too small or otherwise unable to accommodate a label with sufficient space to bear the information required for compliance with this section; and</text></clause> 
<clause id="H44E91768C3F34E289E568EC479290F01"><enum>(iii)</enum><text>establish a process by which the Secretary may determine other products or transactions that shall be exempt from the requirements of this section.</text></clause></subparagraph> 
<subparagraph id="HFB64C9652AB9466CB07E98F8644FF8E1"><enum>(B)</enum><header>Content</header><text>The guidance issued under subparagraph (A) shall include a process for the biennial review and renewal of such waivers, exceptions, and exemptions, as applicable.</text></subparagraph> 
<subparagraph commented="no" id="H9D2929DF548A4E62A8F0A16EBDFA0006"><enum>(C)</enum><header>Process</header><text>In issuing the guidance under this paragraph, the Secretary shall provide an effective date that is not later than 180 days prior to the date on which manufacturers are required to affix or imprint a product identifier to each package and homogenous case of product intended to be introduced in a transaction into commerce consistent with this section.</text></subparagraph></paragraph> 
<paragraph commented="no" id="H5F41ACAE8F274780B75A6E813203CF25"><enum>(4)</enum><header>Self-executing requirements</header><text>Except where otherwise specified, the requirements of this section may be enforced without further regulations or guidance from the Secretary.</text></paragraph> 
<paragraph id="HF22BA573E0E042A18C3F7C34BDDAFC5E"><enum>(5)</enum><header>Grandfathering product</header> 
<subparagraph id="H4E084BA99D1F4DB59F2595BAA767DF99"><enum>(A)</enum><header>Product identifier</header><text>Not later than 2 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, the Secretary shall finalize guidance specifying whether and under what circumstances product that is not labeled with a product identifier and that is in the pharmaceutical distribution supply chain at the time of the effective date of the requirements of this section shall be exempted from the requirements of this section.</text></subparagraph> 
<subparagraph id="H4A112AFB1DE544DB922D6C2AFAC3994D"><enum>(B)</enum><header>Tracing</header><text>For a product that entered the pharmaceutical distribution supply chain prior to January 1, 2015—</text> 
<clause id="HE7F6465E22924233BC379D1610E3905C"><enum>(i)</enum><text>authorized trading partners shall be exempt from providing transaction information as required under subsections (b)(1)(A)(i), (c)(1)(A)(ii), (d)(1)(A)(ii), and (e)(1)(A)(ii);</text></clause> 
<clause id="H051C401B6FB944EDAD8587131ABD79E7"><enum>(ii)</enum><text>transaction history required under this section shall begin with the owner of such product on such date; and</text></clause> 
<clause id="HFA9286DAF2BA40DE84435DEABA597DF4"><enum>(iii)</enum><text>the owners of such product on such date shall be exempt from asserting receipt of transaction information and transaction statement from the prior owner as required under this section.</text></clause></subparagraph></paragraph> 
<paragraph id="H56A5C4C55A404D97BADE89F37C2F1AB4"><enum>(6)</enum><header>Wholesale distributor licenses</header><text>Notwithstanding section 581(9)(A), until the effective date of the wholesale distributor licensing regulations under section 583, the term <term>licensed</term> or <term>authorized</term>, as it relates to a wholesale distributor with respect to prescription drugs, shall mean a wholesale distributor with a valid license under State law.</text></paragraph> 
<paragraph id="H7C62A169867747ABB5645295CBC9CE0E"><enum>(7)</enum><header>Third-party logistics provider licenses</header><text>Until the effective date of the third-party logistics provider licensing regulations under section 584, a third-party logistics provider shall be considered <term>licensed</term> under section 581(9)(B) unless the Secretary has made a finding that the third-party logistics provider does not utilize good handling and distribution practices and publishes notice thereof.</text></paragraph> 
<paragraph id="H5C1E1785B4884C19AA729D5EED7160C1"><enum>(8)</enum><header>Label changes</header><text>Changes made to package labels solely to incorporate the product identifier may be submitted to the Secretary in the annual report of an establishment, in accordance with section 314.70(d) of chapter 21, Code of Federal Regulations (or any successor regulation).</text></paragraph> 
<paragraph id="H778063658862425688E4B29998BD76D6"><enum>(9)</enum><header>Product identifiers</header><text>With respect to any requirement relating to product identifiers under this subchapter—</text> 
<subparagraph id="H8BAF7F5A7C7E4861A9945F00EB74D11E"><enum>(A)</enum><text>unless the Secretary allows, through guidance, the use of other technologies for data instead of or in addition to the technologies described in clauses (i) and (ii), the applicable data—</text> 
<clause id="H9E6CEB030BE2402FB592EC73278F427A"><enum>(i)</enum><text>shall be included in a 2-dimensional data matrix barcode when affixed to, or imprinted upon, a package; and</text></clause> 
<clause id="H3B7B248ECB4145449346D31A27EE9944"><enum>(ii)</enum><text>shall be included in a linear or 2-dimensional data matrix barcode when affixed to, or imprinted upon, a homogeneous case; and</text></clause></subparagraph> 
<subparagraph id="HA2510A149F984EFDB8132793BF16A4BE"><enum>(B)</enum><text>verification of the product identifier may occur by using human-readable or machine-readable methods.</text></subparagraph></paragraph></subsection> 
<subsection id="H77A64E2386674D17BA79E6E6B9686632"><enum>(b)</enum><header>Manufacturer requirements</header> 
<paragraph id="H73AA0794D08B469187797F553F66D8D0"><enum>(1)</enum><header>Product tracing</header> 
<subparagraph id="H28912792FF824FD090EAB4335234BEB6"><enum>(A)</enum><header>In general</header><text>Beginning not later than January 1, 2015, a manufacturer shall—</text> 
<clause id="H3571D9B1BD7D484DA3216062C32EB6FB"><enum>(i)</enum><text>prior to, or at the time of, each transaction in which such manufacturer transfers ownership of a product, provide the subsequent owner with transaction history, transaction information, and a transaction statement, in a single document in an paper or electronic format; and</text></clause> 
<clause id="H634B01B0FCA4437F8BDA0BC052AE8B4F"><enum>(ii)</enum><text>capture the transaction information (including lot level information), transaction history, and transaction statement for each transaction and maintain such information, history, and statement for not less than 6 years after the date of the transaction.</text></clause></subparagraph> 
<subparagraph id="H3D4CCD38EBE54464B29078BE1C6668C1"><enum>(B)</enum><header>Requests for information</header><text>Upon a request by the Secretary or other appropriate Federal or State official, in the event of a recall or for the purpose of investigating a suspect product or an illegitimate product, a manufacturer shall, not later than 1 business day, and not to exceed 48 hours, after receiving the request, or in other such reasonable time as determined by the Secretary, based on the circumstances of the request, provide the applicable transaction information, transaction history, and transaction statement for the product.</text></subparagraph> 
<subparagraph id="HBA518B446B3C437AB1D277ADC429D9EB"><enum>(C)</enum><header>Electronic format</header> 
<clause id="H5C0FE46927D342E6AB41E1F201765B39"><enum>(i)</enum><header>In general</header><text>Beginning not later than 4 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, except as provided under clause (ii), a manufacturer shall provide the transaction information, transaction history, and transaction statement required under subparagraph (A)(i) in electronic format.</text></clause> 
<clause id="H662C09777BEE4FFD8A7F7BA1D6CA3D65"><enum>(ii)</enum><header>Exception</header><text>A manufacturer may continue to provide the transaction information, transaction history, and transaction statement required under subparagraph (A)(i) in a paper format to a licensed health care practitioner authorized to prescribe medication under State law or other licensed individual under the supervision or direction of such a practitioner who dispenses product in the usual course of professional practice.</text></clause></subparagraph></paragraph> 
<paragraph id="H10B4CB00A02C42EF8A4B7602DEA02AC8"><enum>(2)</enum><header>Product identifier</header> 
<subparagraph id="H690EA63F387D42F7853F0FD6DE289A86"><enum>(A)</enum><header>In general</header><text>Beginning not later than 4 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, a manufacturer shall affix or imprint a product identifier to each package and homogenous case of a product intended to be introduced in a transaction into commerce. Such manufacturer shall maintain the product identifier information for such product for not less than 6 years after the date of the transaction.</text></subparagraph> 
<subparagraph id="H23D0BAD15B75430C80827D1F8A78DBF7"><enum>(B)</enum><header>Exception</header><text>A package that is required to have a standardized numerical identifier is not required to have a unique device identifier.</text></subparagraph></paragraph> 
<paragraph id="H5812978E04F849089E84AF6B1E74A8E6"><enum>(3)</enum><header>Authorized trading partners</header><text>Beginning not later than January 1, 2015, the trading partners of a manufacturer may be only authorized trading partners.</text></paragraph> 
<paragraph id="HC310893B2B0749EFA0A8F9E8A26775DE"><enum>(4)</enum><header>Verification</header><text>Beginning not later than January 1, 2015, a manufacturer shall have systems in place to enable the manufacturer to comply with the following requirements:</text> 
<subparagraph id="H3CB83938514147829BAE37B15DE67D53"><enum>(A)</enum><header>Suspect product</header> 
<clause id="H3BC209105FAA46DAA76A2BEC28F3CB31"><enum>(i)</enum><header>In general</header><text>Upon making a determination that a product in the possession or control of the manufacturer is a suspect product, or upon receiving a request for verification from the Secretary that has made a determination that a product within the possession or control of a manufacturer is a suspect product, a manufacturer shall—</text> 
<subclause id="HA2A50B11E60E4BD2845DEE2AB7834BCA"><enum>(I)</enum><text>quarantine such product within the possession or control of the manufacturer from product intended for distribution until such product is cleared or dispositioned; and</text></subclause> 
<subclause id="H96309FC2EA8541509AFDF1EF1B20F903"><enum>(II)</enum><text>promptly conduct an investigation in coordination with trading partners, as applicable, to determine whether the product is an illegitimate product, which shall include validating any applicable transaction history and transaction information in the possession of the manufacturer and otherwise investigating to determine whether the product is an illegitimate product, and, beginning 4 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, verifying the product at the package level, including the standardized numerical identifier.</text></subclause></clause> 
<clause id="H2482332D984542069FC71FB87C969083"><enum>(ii)</enum><header>Cleared product</header><text>If the manufacturer makes the determination that a suspect product is not an illegitimate product, the manufacturer shall promptly notify the Secretary, if applicable, of such determination and such product may be further distributed.</text></clause> 
<clause id="H46A84FBFF0564E75B403D9D8EEB1D9DD"><enum>(iii)</enum><header>Records</header><text>A manufacturer shall keep records of the investigation of a suspect product for not less than 6 years after the conclusion of the investigation.</text></clause></subparagraph> 
<subparagraph id="H31819905344642F3A957A914A6BCBC8D"><enum>(B)</enum><header>Illegitimate product</header> 
<clause id="HDFB55FB78CAD4CB79244419BFC5322CA"><enum>(i)</enum><header>In general</header><text>Upon determining that a product in the possession or control of a manufacturer is an illegitimate product, the manufacturer shall, in a manner consistent with the systems and processes of such manufacturer—</text> 
<subclause id="H8378948EECC14A25AEAEAEB42BD4EDB7"><enum>(I)</enum><text>quarantine such product within the possession or control of the manufacturer from product intended for distribution until such product is dispositioned;</text></subclause> 
<subclause id="H388AB318337C4854A63FF7628C3BCE11"><enum>(II)</enum><text>disposition the illegitimate product within the possession or control of the manufacturer;</text></subclause> 
<subclause id="HF7CCE8418DD349E68CA93503A05BEC98"><enum>(III)</enum><text>take reasonable and appropriate steps to assist a trading partner to disposition an illegitimate product not in the possession or control of the manufacturer; and</text></subclause> 
<subclause id="HD6F944E8B1C6474EA863C84B70941D9E"><enum>(IV)</enum><text>retain a sample of the product for further physical examination or laboratory analysis of the product by the manufacturer or Secretary (or other appropriate Federal or State official) upon request by the Secretary (or other appropriate Federal or State official), as necessary and appropriate.</text></subclause></clause> 
<clause id="H9C5D50DFB72C4034A0F26329F939E781"><enum>(ii)</enum><header>Making a notification</header> 
<subclause id="HBD57B5CF586148EDA205D49B436464DB"><enum>(I)</enum><header>Illegitimate product</header><text>Upon determining that a product in the possession or control of the manufacturer is an illegitimate product, the manufacturer shall notify the Secretary and all immediate trading partners that the manufacturer has reason to believe may have received such illegitimate product of such determination not later than 24 hours after making such determination.</text></subclause> 
<subclause id="H8A8A37024553484DBD01A391351BA2EB"><enum>(II)</enum><header>High risk of illegitimacy</header><text>A manufacturer shall notify the Secretary and immediate trading partners that the manufacturer has reason to believe may have in the trading partner’s possession a product manufactured by, or purported to be a product manufactured by, the manufacturer not later than 24 hours after determining or being notified by the Secretary or a trading partner that there is a high risk that such product is an illegitimate product. For purposes of this subclause, a <quote>high risk</quote> may include a specific high risk that could increase the likelihood that illegitimate product will enter the pharmaceutical distribution supply chain and other high risks as determined by the Secretary in guidance pursuant to subsection (h).</text></subclause></clause> 
<clause id="HA060947D00AA4838AB97D8A7B7AF6A92"><enum>(iii)</enum><header>Responding to a notification</header><text>Upon the receipt of a notification from the Secretary or a trading partner that a determination has been made that a product is an illegitimate product, a manufacturer shall identify all illegitimate product subject to such notification that is in the possession or control of the manufacturer, including any product that is subsequently received, and shall perform the activities described in subparagraph (A).</text></clause> 
<clause id="H565BA37243D3467DA8843F0EF78B5F87"><enum>(iv)</enum><header>Terminating a notification</header><text>Upon making a determination, in consultation with the Secretary, that a notification is no longer necessary, a manufacturer shall promptly notify immediate trading partners that the manufacturer notified pursuant to clause (ii) that such notification has been terminated.</text></clause> 
<clause id="H7E704728999B4AFE81F7BF1489278011"><enum>(v)</enum><header>Records</header><text>A manufacturer shall keep records of the disposition of an illegitimate product for not less than 6 years after the conclusion of the disposition.</text></clause></subparagraph> 
<subparagraph id="HBE35692D07194A41B9F859FD6F99A17C"><enum>(C)</enum><header>Requests for verification</header><text>Beginning 4 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, upon receiving a request for verification from an authorized repackager, wholesale distributor, or dispenser that is in possession or control of a product such person believes to be manufactured by such manufacturer, a manufacturer shall, not later than 24 hours after receiving the request for verification or in other such reasonable time as determined by the Secretary, based on the circumstances of the request, notify the person making the request whether the product identifier, including the standardized numerical identifier, that is the subject of the request corresponds to the product identifier affixed or imprinted by the manufacturer. If a manufacturer responding to a request for verification identifies a product identifier that does not correspond to that affixed or imprinted by the manufacturer, the manufacturer shall treat such product as suspect product and conduct an investigation as described in subparagraph (A). If the manufacturer has reason to believe the product is an illegitimate product, the manufacturer shall advise the person making the request of such belief at the time such manufacturer responds to the request for verification.</text></subparagraph> 
<subparagraph id="H95DEA158E4BA45BAA2AD15FF721A5C9E"><enum>(D)</enum><header>Electronic database</header><text>A manufacturer may satisfy the requirements of this paragraph by developing a secure electronic database or utilizing a secure electronic database developed or operated by another entity. The owner of such database shall establish the requirements and processes to respond to requests and may provide for data access to other members of the pharmaceutical distribution supply chain, as appropriate. The development and operation of such a database shall not relieve a manufacturer of the requirement under this paragraph to respond to a request for verification submitted by means other than a secure electronic database.</text></subparagraph> 
<subparagraph id="H17175916CED94148AC1553DB1B5912F3"><enum>(E)</enum><header>Saleable returned product</header><text>Beginning 4 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title> (except as provided pursuant to subsection (a)(5)), upon receipt of a returned product that the manufacturer intends to further distribute, before further distributing such product, the manufacturer shall verify the product identifier, including the standardized numerical identifier, for each sealed homogeneous case of such product or, if such product is not in a sealed homogeneous case, verify the product identifier, including the standardized numerical identifier, on each package.</text></subparagraph> 
<subparagraph id="H12C9A4E57B18424EB723CC367F285387"><enum>(F)</enum><header>Nonsaleable returned product</header><text>A manufacturer may return a nonsaleable product to the manufacturer or repackager, to the wholesale distributor from whom such product was purchased, or to a person acting on behalf of such a person, including a returns processor, without providing the information described in paragraph (1)(A)(i).</text></subparagraph></paragraph></subsection> 
<subsection id="H0CC076BD2A8749A79E2C09DDB7EE7939"><enum>(c)</enum><header>Wholesale distributor requirements</header> 
<paragraph id="H1D222504EFC74599BD8AE8ACC27DE25E"><enum>(1)</enum><header>Product tracing</header> 
<subparagraph id="HA0F50052F87E44429FC149E2BE9B899B"><enum>(A)</enum><header>In general</header><text>Beginning not later than January 1, 2015, the following requirements shall apply to wholesale distributors:</text> 
<clause id="H91497731DCDC40BD944D81A005200841"><enum>(i)</enum><text>A wholesale distributor shall not accept ownership of a product unless the previous owner prior to, or at the time of, the transaction provides the transaction history, transaction information, and a transaction statement for the product, as applicable under this subparagraph.</text></clause> 
<clause id="H32F909796759478CBA0EA7DA54269297"><enum>(ii)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="H9B0B1B1F1C3045D99A288348925F1720"><enum>(I)</enum> 
<item commented="no" display-inline="yes-display-inline" id="H77013152D69C4E1E89C47A1EBD073032"><enum>(aa)</enum><text>If the wholesale distributor purchased a product directly from the manufacturer, the exclusive distributor of the manufacturer, or a repackager that purchased directly from the manufacturer, then prior to, or at the time of, each transaction in which the wholesale distributor transfers ownership of a product, the wholesale distributor shall provide to the subsequent purchaser—</text> 
<subitem id="H453930D4345D466ABE42E004D00EE5E0" indent="up2"><enum>(AA)</enum><text>a transaction statement, which shall state that such wholesale distributor, or a member of the affiliate of such wholesale distributor, purchased the product directly from the manufacturer, exclusive distributor of the manufacturer, or repackager that purchased the product directly from the manufacturer; and</text></subitem> 
<subitem id="H0E5E50ACCCD84B48974FADE2C914D7EF" indent="up2"><enum>(BB)</enum><text>subject to subclause (II), the transaction history and transaction information.</text></subitem></item> 
<item id="H67A151DF847E41F8882E49A26D6DFC1A" indent="up2"><enum>(bb)</enum><text>The wholesale distributor shall provide the transaction history, transaction information, and transaction statement under item (aa)—</text> 
<subitem id="H106D8FD22A5E4F388E3BD47298D347F0" indent="down1"><enum>(AA)</enum><text>if provided to a dispenser, on a single document in a paper or electronic format; and</text></subitem> 
<subitem id="HD43488FD4AAA4E0D9160F01BB9EFE623" indent="down1"><enum>(BB)</enum><text>if provided to a wholesale distributor, through any combination of self-generated paper, electronic data, or manufacturer-provided information on the product package.</text></subitem></item></subclause> 
<subclause id="HEFBFF83E24E747E79E571C52F2C2BB5C" indent="up1"><enum>(II)</enum><text>For purposes of transactions described in subclause (I), transaction history and transaction information shall not be required to include the lot number of the product, the initial transaction date, or the initial shipment date from the manufacturer (as defined in subparagraphs (F), (G), and (H) of section 581(26)).</text></subclause></clause> 
<clause id="HC2640763F07947CD87576FA03DF79B17"><enum>(iii)</enum><text>If the wholesale distributor did not purchase a product directly from the manufacturer, the exclusive distributor of the manufacturer, or a repackager that purchased directly from the manufacturer, as described in clause (ii), then prior to, or at the time of, each transaction or subsequent transaction, the wholesale distributor shall provide to the subsequent purchaser a transaction statement, transaction history, and transaction information, in a paper or electronic format that complies with the guidance document issued under subsection (a)(2).</text></clause> 
<clause id="H00B3E1B6FC6947798EE8382F0910E245"><enum>(iv)</enum><text>For the purposes of clause (iii), the transaction history supplied shall begin only with the wholesale distributor described in clause (ii)(I), but the wholesale distributor described in clause (iii) shall inform the subsequent purchaser that such wholesale distributor received a direct purchase statement from a wholesale distributor described in clause (ii)(I).</text></clause> 
<clause id="H5B002F3AAA3A42DFA656803EB488C24A"><enum>(v)</enum><text>A wholesale distributor shall—</text> 
<subclause id="H4CEA933DBBE349CC91F3DA1D18C5EC76"><enum>(I)</enum><text>capture the transaction information (including lot level information) consistent with the requirements of this section, transaction history, and transaction statement for each transaction described in clauses (i), (ii), and (iii) and maintain such information, history, and statement for not less than 6 years after the date of the transaction; and</text></subclause> 
<subclause id="HB8FB73AD99A8486A8623BD9779087CC0"><enum>(II)</enum><text>maintain the confidentiality of the transaction information (including any lot level information consistent with the requirements of this section), transaction history, and transaction statement for a product in a manner that prohibits disclosure to any person other than the Secretary or other appropriate Federal or State official, except to comply with clauses (ii) and (iii), and, as applicable, pursuant to an agreement under subparagraph (D).</text></subclause></clause></subparagraph> 
<subparagraph id="H7AC100F97AA343B5AA92C76E94ABC5A7"><enum>(B)</enum><header>Returns</header> 
<clause id="H0148E4D0CEBA471DAA095A9B2141EB27"><enum>(i)</enum><header>Saleable returns</header><text>Notwithstanding subparagraph (A)(i), the following shall apply:</text> 
<subclause id="H9075FA8440104FBDA30BCCFD0B4D338B"><enum>(I)</enum><header>Requirements</header><text>Until the date that is 6 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title> (except as provided pursuant to subsection (a)(5)), a wholesale distributor may accept returned product from a dispenser or repackager pursuant to the terms and conditions of any agreement between the parties, and, notwithstanding subparagraph (A)(ii), may distribute such returned product without providing the transaction history. For transactions subsequent to the return, the transaction history of such product shall begin with the wholesale distributor that accepted the returned product, consistent with the requirements of this subsection.</text></subclause> 
<subclause id="H1B89A80F357E470896FC1039578794C9"><enum>(II)</enum><header>Enhanced requirements</header><text>Beginning 6 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title> (except as provided pursuant to subsection (a)(5)), a wholesale distributor may accept returned product from a dispenser or repackager only if the wholesale distributor can associate returned product with the transaction information and transaction statement associated with that product. For all transactions after such date, the transaction history, as applicable, of such product shall begin with the wholesale distributor that accepted and verified the returned product. For purposes of this subparagraph, the transaction information and transaction history, as applicable, need not include transaction dates if it is not reasonably practicable to obtain such dates.</text></subclause></clause> 
<clause id="H8303E92AEA124C87A4659E8045D7C1A1"><enum>(ii)</enum><header>Nonsaleable returns</header><text>A wholesale distributor may return a nonsaleable product to the manufacturer or repackager, to the wholesale distributor from whom such product was purchased, or to a person acting on behalf of such a person, including a returns processor, without providing the information required under subparagraph (A)(i).</text></clause></subparagraph> 
<subparagraph id="H037C2A8BFC11420B9F4CC2D57AB9D453"><enum>(C)</enum><header>Requests for information</header><text>Upon a request by the Secretary or other appropriate Federal or State official, in the event of a recall or for the purpose of investigating a suspect product or an illegitimate product, a wholesale distributor shall, not later than 1 business day, and not to exceed 48 hours, after receiving the request or in other such reasonable time as determined by the Secretary, based on the circumstances of the request, provide the applicable transaction information, transaction history, and transaction statement for the product.</text></subparagraph> 
<subparagraph id="HD75740754C804A6292DBD720AF6B7F8D"><enum>(D)</enum><header>Trading partner agreements</header><text>Beginning 6 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, a wholesale distributor may disclose the transaction information, including lot level information, transaction history, or transaction statement of a product to the subsequent purchaser of the product, pursuant to a written agreement between such wholesale distributor and such subsequent purchaser. Nothing in this subparagraph shall be construed to limit the applicability of subparagraphs (A) through (C).</text></subparagraph></paragraph> 
<paragraph id="HC4DEB9503740480DB4441AFA9FFDB6D6"><enum>(2)</enum><header>Product identifier</header><text>Beginning 6 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, a wholesale distributor may engage in transactions involving a product only if such product is encoded with a product identifier (except as provided pursuant to subsection (a)(5)).</text></paragraph> 
<paragraph id="H4ED41CC8CF22424A95D7087DC5797751"><enum>(3)</enum><header>Authorized trading partners</header><text>Beginning not later than January 1, 2015, the trading partners of a wholesale distributor may be only authorized trading partners.</text></paragraph> 
<paragraph id="H5C7DB5507C6C4A0A81874BB419A21E4E"><enum>(4)</enum><header>Verification</header><text>Beginning not later than January 1, 2015, a wholesale distributor shall have systems in place to enable the wholesale distributor to comply with the following requirements:</text> 
<subparagraph id="H99238E89B14E4DDF9D8EB074E8AE669F"><enum>(A)</enum><header>Suspect product</header> 
<clause id="HF7F4A8630B88428484F30B3140E80405"><enum>(i)</enum><header>In general</header><text>Upon making a determination that a product in the possession or control of a wholesale distributor is a suspect product, or upon receiving a request for verification from the Secretary that has made a determination that a product within the possession or control of a wholesale distributor is a suspect product, a wholesale distributor shall—</text> 
<subclause id="H63DD6CEC13DB4A42B694A471C66B11D7"><enum>(I)</enum><text>quarantine such product within the possession or control of the wholesale distributor from product intended for distribution until such product is cleared or dispositioned; and</text></subclause> 
<subclause id="H2354A687B7AC4B42B562FAC8E4D4C28B"><enum>(II)</enum><text>promptly conduct an investigation in coordination with trading partners, as applicable, to determine whether the product is an illegitimate product, which shall include validating any applicable transaction history and transaction information in the possession of the wholesale distributor and otherwise investigating to determine whether the product is an illegitimate product, and, beginning 6 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title> (except as provided pursuant to subsection (a)(5)), verifying the product at the package level, including the standardized numerical identifier.</text></subclause></clause> 
<clause id="H19557AC2367849C3BDC4EB2823C1A802"><enum>(ii)</enum><header>Cleared product</header><text>If the wholesale distributor determines that a suspect product is not an illegitimate product, the wholesale distributor shall promptly notify the Secretary, if applicable, of such determination and such product may be further distributed.</text></clause> 
<clause id="HE0A78650AC04425AB4B1172300B0D6A2"><enum>(iii)</enum><header>Records</header><text>A wholesale distributor shall keep records of the investigation of a suspect product for not less than 6 years after the conclusion of the investigation.</text></clause></subparagraph> 
<subparagraph id="H8B6422AEA98A43CA895EF80B73F26EBB"><enum>(B)</enum><header>Illegitimate product</header> 
<clause id="H4B6790BFB5BD4CC1A9EB36ECC62F465D"><enum>(i)</enum><header>In general</header><text>Upon determining, in coordination with the manufacturer, that a product in the possession or control of a wholesale distributor is an illegitimate product, the wholesale distributor shall, in a manner that is consistent with the systems and processes of such wholesale distributor—</text> 
<subclause id="H7F2BEAF526FC4C73883FB573E999F1C0"><enum>(I)</enum><text>quarantine such product within the possession or control of the wholesale distributor from product intended for distribution until such product is dispositioned;</text></subclause> 
<subclause id="H938233FDA35741B0A7F3FC262AF500C2"><enum>(II)</enum><text>disposition the illegitimate product within the possession or control of the wholesale distributor;</text></subclause> 
<subclause id="H23FEF75615AA4D51A89EF4CE56B3186B"><enum>(III)</enum><text>take reasonable and appropriate steps to assist a trading partner to disposition an illegitimate product not in the possession or control of the wholesale distributor; and</text></subclause> 
<subclause id="H70E87D741689452FACF692420DA0448A"><enum>(IV)</enum><text>retain a sample of the product for further physical examination or laboratory analysis of the product by the manufacturer or Secretary (or other appropriate Federal or State official) upon request by the manufacturer or Secretary (or other appropriate Federal or State official), as necessary and appropriate.</text></subclause></clause> 
<clause id="H1646448B98F4418A943062665DEE0D90"><enum>(ii)</enum><header>Making a notification</header><text>Upon determining that a product in the possession or control of the wholesale distributor is an illegitimate product, the wholesale distributor shall notify the Secretary and all immediate trading partners that the wholesale distributor has reason to believe may have received such illegitimate product of such determination not later than 24 hours after making such determination.</text></clause> 
<clause id="H1AC4AB49E3D9454E88220AE34E557831"><enum>(iii)</enum><header>Responding to a notification</header><text>Upon the receipt of a notification from the Secretary or a trading partner that a determination has been made that a product is an illegitimate product, a wholesale distributor shall identify all illegitimate product subject to such notification that is in the possession or control of the wholesale distributor, including any product that is subsequently received, and shall perform the activities described in subparagraph (A).</text></clause> 
<clause id="H9C7CC495AEBF48D690C34684A4E01773"><enum>(iv)</enum><header>Terminating a notification</header><text>Upon making a determination, in consultation with the Secretary, that a notification is no longer necessary, a wholesale distributor shall promptly notify immediate trading partners that the wholesale distributor notified pursuant to clause (ii) that such notification has been terminated.</text></clause> 
<clause id="H2458C7A0F2664DB08F81ED68BCC48CF3"><enum>(v)</enum><header>Records</header><text>A wholesale distributor shall keep records of the disposition of an illegitimate product for not less than 6 years after the conclusion of the disposition.</text></clause></subparagraph> 
<subparagraph id="HB81490232D3740ADAD1B7FDF50D58E0D"><enum>(C)</enum><header>Electronic database</header><text>A wholesale distributor may satisfy the requirements of this paragraph by developing a secure electronic database or utilizing a secure electronic database developed or operated by another entity. The owner of such database shall establish the requirements and processes to respond to requests and may provide for data access to other members of the pharmaceutical distribution supply chain, as appropriate. The development and operation of such a database shall not relieve a wholesale distributor of the requirement under this paragraph to respond to a verification request submitted by means other than a secure electronic database.</text></subparagraph> 
<subparagraph id="H6EE4264EEAD341EF8C37020CDBCBD2FE"><enum>(D)</enum><header>Verification of saleable returned product</header><text>Beginning 6 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, upon receipt of a returned product that the wholesale distributor intends to further distribute, before further distributing such product, the wholesale distributor shall verify the product identifier, including the standardized numerical identifier, for each sealed homogeneous case of such product or, if such product is not in a sealed homogeneous case, verify the product identifier, including the standardized numerical identifier, on each package.</text></subparagraph></paragraph></subsection> 
<subsection id="HEFBBB85C08E44B1C8B504223021FC168"><enum>(d)</enum><header>Dispenser requirements</header> 
<paragraph id="H9020EA4A3AE1414C98B408A0D7C7DFD1"><enum>(1)</enum><header>Product tracing</header> 
<subparagraph id="HC089EA12DCAF4157968A562369BADBAE"><enum>(A)</enum><header>In general</header><text>Beginning July 1, 2015, a dispenser—</text> 
<clause id="HA8BA6EB1A259412485A82E7733B3578F"><enum>(i)</enum><text>shall not accept ownership of a product, unless the previous owner prior to, or at the time of, the transaction, provides transaction history, transaction information, and a transaction statement;</text></clause> 
<clause id="HFFB7E66F44954FDE83CC90024D92E2FF"><enum>(ii)</enum><text>prior to, or at the time of, each transaction in which the dispenser transfers ownership of a product (but not including dispensing to a patient or returns) shall provide the subsequent owner with transaction history, transaction information, and a transaction statement for the product, except that the requirements of this clause shall not apply to sales by a dispenser to another dispenser to fulfill a specific patient need; and</text></clause> 
<clause id="H89D5C446D8BC43F49D02EF3D98F6E2CC"><enum>(iii)</enum><text>shall capture transaction information (including lot level information, if provided), transaction history, and transaction statements, as necessary to investigate a suspect product, and maintain such information, history, and statements for not less than 6 years after the transaction.</text></clause></subparagraph> 
<subparagraph id="HC984C003765D44C0B05512D0698617E9"><enum>(B)</enum><header>Agreements with third parties</header><text>A dispenser may enter into a written agreement with a third party, including an authorized wholesale distributor, under which the third party confidentially maintains the transaction information, transaction history, and transaction statements required to be maintained under this subsection on behalf of the dispenser. If a dispenser enters into such an agreement, the dispenser shall maintain a copy of the written agreement and shall not be relieved of the obligations of the dispenser under this subsection.</text></subparagraph> 
<subparagraph id="H1B6F56D6E2B347F2BC6F73F3D1C5EC98"><enum>(C)</enum><header>Returns</header> 
<clause id="HF8EF48B60FF148AD84DC7F144F61652A"><enum>(i)</enum><header>Saleable returns</header><text>A dispenser may return product to the trading partner from which the dispenser obtained the product without providing the information required under subparagraph (A).</text></clause> 
<clause id="H8C13FC0C82604179B16816746D5EF97A"><enum>(ii)</enum><header>Nonsaleable returns</header><text>A dispenser may return a nonsaleable product to the manufacturer or repackager, to the wholesale distributor from whom such product was purchased, to a returns processor, or to a person acting on behalf of such a person without providing the information required under subparagraph (A).</text></clause></subparagraph> 
<subparagraph id="H77F47A79BF184B68AA59BD4B06A4A3CA"><enum>(D)</enum><header>Requests for information</header><text>Upon a request by the Secretary or other appropriate Federal or State official, in the event of a recall or for the purpose of investigating a suspect or an illegitimate product, a dispenser shall, not later than 2 business days after receiving the request or in another such reasonable time as determined by the Secretary, based on the circumstances of the request, provide the applicable transaction information, transaction statement, and transaction history which the dispenser received from the previous owner, which shall not include the lot number of the product, the initial transaction date, or the initial shipment date from the manufacturer unless such information was included in the transaction information, transaction statement, and transaction history provided by the manufacturer or wholesale distributor to the dispenser. The dispenser may respond to the request by providing the applicable information in either paper or electronic format. Until the date that is 4 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, the Secretary or other appropriate Federal or State official shall grant a dispenser additional time, as necessary, only with respect to a request to provide lot level information described in subparagraph (F) of section 581(26) that was provided to the dispenser in paper format, limit the request time period to the 6 months preceding the request or other relevant date, and, in the event of a recall, the Secretary, or other appropriate Federal or State official may request information only if such recall involves a serious adverse health consequence or death to humans.</text></subparagraph></paragraph> 
<paragraph id="H4810EE7DECC84E6B9D9E49460333CD05"><enum>(2)</enum><header>Product identifier</header><text>Beginning not later than 7 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, a dispenser may engage in transactions involving a product only if such product is encoded with a product identifier (except as provided pursuant to subsection (a)(5)).</text></paragraph> 
<paragraph id="H574E27C69CFD4AA996986D5DF3413C4A"><enum>(3)</enum><header>Authorized trading partners</header><text>Beginning not later than January 1, 2015, the trading partners of a dispenser may be only authorized trading partners.</text></paragraph> 
<paragraph id="H83E7277DEC6C465882248DBCF6C2ADC6"><enum>(4)</enum><header>Verification</header><text>Beginning not later than January 1, 2015, a dispenser shall have systems in place to enable the dispenser to comply with the following requirements:</text> 
<subparagraph id="H1119653B06B14AD3A1130B3D8E893EC3"><enum>(A)</enum><header>Suspect product</header> 
<clause id="H3DBE3E4A21DA4973AC19C767B93A8109"><enum>(i)</enum><header>In general</header><text>Upon making a determination that a product in the possession or control of the dispenser is a suspect product, or upon receiving a request for verification from the Secretary that has made a determination that a product within the possession or control of a dispenser is a suspect product, a dispenser shall—</text> 
<subclause id="H9A191C1670D145DBAB8F59398DF9AE9A"><enum>(I)</enum><text>quarantine such product within the possession or control of the dispenser from product intended for distribution until such product is cleared or dispositioned; and</text></subclause> 
<subclause id="HFEB7CF162507415C8C320F8956B5A2EB"><enum>(II)</enum><text>promptly conduct an investigation in coordination with trading partners, as applicable, to determine whether the product is an illegitimate product.</text></subclause></clause> 
<clause id="HE1ADAD9F70CC4135A19EA1807F0666F9"><enum>(ii)</enum><header>Investigation</header><text>An investigation conducted under clause (i)(II) shall include—</text> 
<subclause id="HCC521FEBBD884E228FD993380EF37C42"><enum>(I)</enum><text>beginning 7 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, verifying whether the lot number of a suspect product corresponds with the lot number for such product;</text></subclause> 
<subclause id="H59A1391AE63F4E688FCA0F810812DCF3"><enum>(II)</enum><text>beginning 7 years after the date of enactment of such Act, verifying that the product identifier, including the standardized numerical identifier, of at least 3 packages or 10 percent of such suspect product, whichever is greater, or all packages, if there are fewer than 3, corresponds with the product identifier for such product;</text></subclause> 
<subclause id="HCBA804CBBC2E44ECA2098A58FE9BD6F6"><enum>(III)</enum><text>validating any applicable transaction history and transaction information in the possession of the dispenser; and</text></subclause> 
<subclause id="HBFF2DD5AEBFC4A70B862BEBFF52F72CC"><enum>(IV)</enum><text>otherwise investigating to determine whether the product is an illegitimate product.</text></subclause></clause> 
<clause id="HBA129183DB304C6F855DB10C08604530"><enum>(iii)</enum><header>Cleared product</header><text>If the dispenser makes the determination that a suspect product is not an illegitimate product, the dispenser shall promptly notify the Secretary, if applicable, of such determination and such product may be further distributed or dispensed.</text></clause> 
<clause id="H377C26ADD64F4DB3A553C34EFE0E0180"><enum>(iv)</enum><header>Records</header><text>A dispenser shall keep records of the investigation of a suspect product for not less than 6 years after the conclusion of the investigation.</text></clause></subparagraph> 
<subparagraph id="HABE6E424EA3847E6AEF3B5BB8EEA4FB6"><enum>(B)</enum><header>Illegitimate product</header> 
<clause id="HF1FB5A0722A14BF09046E628D7BD21C8"><enum>(i)</enum><header>In general</header><text>Upon determining, in coordination with the manufacturer, that a product in the possession or control of a dispenser is an illegitimate product, the dispenser shall—</text> 
<subclause id="H6ABC1AD0C6BC426AB20223776D6B0C43"><enum>(I)</enum><text>disposition the illegitimate product within the possession or control of the dispenser;</text></subclause> 
<subclause id="H0E49D22E9688414A98B9C82CABEE6E4B"><enum>(II)</enum><text>take reasonable and appropriate steps to assist a trading partner to disposition an illegitimate product not in the possession or control of the dispenser; and</text></subclause> 
<subclause id="H552C0850D32F4399AE39CF030794F89E"><enum>(III)</enum><text>retain a sample of the product for further physical examination or laboratory analysis of the product by the manufacturer or Secretary (or other appropriate Federal or State official) upon request by the manufacturer or Secretary (or other appropriate Federal or State official), as necessary and appropriate.</text></subclause></clause> 
<clause id="H95B6053416C14C6993085682E5251DDD"><enum>(ii)</enum><header>Making a notification</header><text>Upon determining that a product in the possession or control of the dispenser is an illegitimate product, the dispenser shall notify the Secretary and all immediate trading partners that the dispenser has reason to believe may have received such illegitimate product of such determination not later than 24 hours after making such determination.</text></clause> 
<clause id="H9283F96152AD478EB8507917B8F9F012"><enum>(iii)</enum><header>Responding to a notification</header><text>Upon the receipt of a notification from the Secretary or a trading partner that a determination has been made that a product is an illegitimate product, a dispenser shall identify all illegitimate product subject to such notification that is in the possession or control of the dispenser, including any product that is subsequently received, and shall perform the activities described in subparagraph (A).</text></clause> 
<clause id="H67AD4F2FE5394F4A88E076DB10012DA4"><enum>(iv)</enum><header>Terminating a notification</header><text>Upon making a determination, in consultation with the Secretary, that a notification is no longer necessary, a dispenser shall promptly notify immediate trading partners that the dispenser notified pursuant to clause (ii) that such notification has been terminated.</text></clause> 
<clause id="H34F4906862614B109384EF497B8229DC"><enum>(v)</enum><header>Records</header><text>A dispenser shall keep records of the disposition of an illegitimate product for not less than 6 years after the conclusion of the disposition.</text></clause></subparagraph> 
<subparagraph id="HD88CAFF405B74DE2ABBFD97BDA0C5064"><enum>(C)</enum><header>Electronic database</header><text>A dispenser may satisfy the requirements of this paragraph by developing a secure electronic database or utilizing a secure electronic database developed or operated by another entity.</text></subparagraph></paragraph> 
<paragraph id="H4618BE4D23B34165B16FF3EEDC2FDA1E"><enum>(5)</enum><header>Exception</header><text>Notwithstanding any other provision of law, the requirements under paragraphs (1) and (4) shall not apply to licensed health care practitioners authorized to prescribe or administer medication under State law or other licensed individuals under the supervision or direction of such practitioners who dispense or administer product in the usual course of professional practice.</text></paragraph></subsection> 
<subsection id="HDBD89640ED7243AF90D6A69166DD95CA"><enum>(e)</enum><header>Repackager requirements</header> 
<paragraph id="H93FCFBD535944977BC1348395E31D649"><enum>(1)</enum><header>Product tracing</header> 
<subparagraph id="H2C3DAE699DFC4867BF059A6E044A7360"><enum>(A)</enum><header>In general</header><text>Beginning not later than January 1, 2015, a repackager described in section 581(16)(A) shall—</text> 
<clause id="H1F7428A42D8B4B99A9876DE5DFF86496"><enum>(i)</enum><text>not accept ownership of a product unless the previous owner, prior to, or at the time of, the transaction, provides transaction history, transaction information, and a transaction statement for the product;</text></clause> 
<clause id="H65667CB46AA746519AE07B24F5187ABA"><enum>(ii)</enum><text>prior to, or at the time of, each transaction in which the repackager transfers ownership of a product, provide the subsequent owner with transaction history, transaction information, and a transaction statement for the product; and</text></clause> 
<clause id="HAC9C2DDF178340B68CA2CB17D67DC26A"><enum>(iii)</enum><text>capture the transaction information (including lot level information), transaction history, and transaction statement for each transaction described in clauses (i) and (ii) and maintain such information, history, and statement for not less than 6 years after the transaction.</text></clause></subparagraph> 
<subparagraph id="H31E5911733A44808BFF2FBF1F9636FDE"><enum>(B)</enum><header>Returns</header> 
<clause id="HD595B2629A6249D0A6F210646F4D25E0"><enum>(i)</enum><header>Nonsaleable product</header><text>A repackager described in section 581(16)(A) may return a nonsaleable product to the manufacturer or repackager, or to the wholesale distributor from whom such product was purchased, or to a person acting on behalf of such a person, including a returns processor, without providing the information required under subparagraph (A)(ii).</text></clause> 
<clause id="HC9AE90ECDA1641C0980394B453D933DB"><enum>(ii)</enum><header>Saleable or nonsaleable product</header><text>A repackager described in section 581(16)(B) may return a saleable or nonsaleable product to the manufacturer, repackager, or to the wholesale distributor from whom such product was received without providing the information required under subparagraph (A)(ii) on behalf of the hospital or other health care entity that took ownership of such product pursuant to the terms and conditions of any agreement between such repackager and the entity that owns the product.</text></clause></subparagraph> 
<subparagraph id="HEDD038C4221649F1BC6399FD0E6E9A96"><enum>(C)</enum><header>Requests for information</header><text>Upon a request by the Secretary or other appropriate Federal or State official, in the event of a recall or for the purpose of investigating a suspect product or an illegitimate product, a repackager described in section 581(16)(A) shall, not later than 1 business day, and not to exceed 48 hours, after receiving the request or in other such reasonable time as determined by the Secretary, provide the applicable transaction information, transaction history, and transaction statement for the product.</text></subparagraph></paragraph> 
<paragraph id="H3052DD69BB4B4C558AE6E76610FE1FCD"><enum>(2)</enum><header>Product identifier</header> 
<subparagraph id="H8DA1657BC1774DEE93170271C25631C5"><enum>(A)</enum><header>In general</header><text>Beginning not later than 5 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, a repackager described in section 581(16)(A)—</text> 
<clause id="H5D0D444EC7C94819931190420A7319ED"><enum>(i)</enum><text>shall affix or imprint a product identifier to each package and homogenous case of product intended to be introduced in a transaction in commerce;</text></clause> 
<clause id="HEB76381F04C34B16B43A88F16A93C4A8"><enum>(ii)</enum><text>shall maintain the product identifier information for such product for not less than 6 years after the date of the transaction;</text></clause> 
<clause id="H7E0AFB0857F548D8B078A0D7BB6F34D8"><enum>(iii)</enum><text>may engage in transactions involving a product only if such product is encoded with a product identifier (except as provided pursuant to subsection (a)(5)); and</text></clause> 
<clause id="H2D57C2FDA50146E9A19A154371469D3E"><enum>(iv)</enum><text>shall maintain records for not less than 6 years to allow the repackager to associate the product identifier the repackager affixes or imprints with the product identifier assigned by the original manufacturer of the product.</text></clause></subparagraph> 
<subparagraph id="H848A060BB68B406DB0E3B2082118CA5A"><enum>(B)</enum><header>Exception</header><text>A package that is required to have a standardized numerical identifier is not required to have a unique device identifier.</text></subparagraph></paragraph> 
<paragraph id="H02399076B9D243A28259F00CC4852511"><enum>(3)</enum><header>Authorized trading partners</header><text>Beginning January 1, 2015, the trading partners of a repackager described in section 581(16) may be only authorized trading partners.</text></paragraph> 
<paragraph id="H00EE274ABDBF4491AC30700A4CD3F686"><enum>(4)</enum><header>Verification</header><text>Beginning not later than January 1, 2015, a repackager described in section 581(16)(A) shall have systems in place to enable the repackager to comply with the following requirements:</text> 
<subparagraph id="HA795ABDCD2EB4C2C8DD6FAB6B65D21D5"><enum>(A)</enum><header>Suspect product</header> 
<clause id="H740F4B42AF1346E4804233FF8D1B00ED"><enum>(i)</enum><header>In general</header><text>Upon making a determination that a product in the possession or control of the repackager is a suspect product, or upon receiving a request for verification from the Secretary that has made a determination that a product within the possession or control of a repackager is a suspect product, a repackager shall—</text> 
<subclause id="H62C9BE5D74FA41AD884287787E74C21A"><enum>(I)</enum><text>quarantine such product within the possession or control of the repackager from product intended for distribution until such product is cleared or dispositioned; and</text></subclause> 
<subclause id="H4C3AC8515DEC483C9B606611488B0369"><enum>(II)</enum><text>promptly conduct an investigation in coordination with trading partners, as applicable, to determine whether the product is an illegitimate product, which shall include validating any applicable transaction history and transaction information in the possession of the repackager and otherwise investigating to determine whether the product is an illegitimate product, and, beginning 5 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title> (except as provided pursuant to subsection (a)(5)), verifying the product at the package level, including the standardized numerical identifier.</text></subclause></clause> 
<clause id="H83AF3CA84AE14A6CB50B3B984C73FB11"><enum>(ii)</enum><header>Cleared product</header><text>If the repackager makes the determination that a suspect product is not an illegitimate product, the repackager shall promptly notify the Secretary, if applicable, of such determination and such product may be further distributed.</text></clause> 
<clause id="HD15335DE2C36447D82ADD77D968E3414"><enum>(iii)</enum><header>Records</header><text>A repackager shall keep records of the investigation of a suspect product for not less than 6 years after the conclusion of the investigation.</text></clause></subparagraph> 
<subparagraph id="H3F31062ADDE74FC28D77B4A8F382A828"><enum>(B)</enum><header>Illegitimate product</header> 
<clause id="HE1C44C653C454015BFAC000307F2C8E3"><enum>(i)</enum><header>In general</header><text>Upon determining, in coordination with the manufacturer, that a product in the possession or control of a repackager is an illegitimate product, the repackager shall, in a manner that is consistent with the systems and processes of such repackager—</text> 
<subclause id="HDD51BED711B945D486371B6D4B6B895E"><enum>(I)</enum><text>quarantine such product within the possession or control of the repackager from product intended for distribution until such product is dispositioned;</text></subclause> 
<subclause id="H27943D5C44A1490299715C8D5EBEE71C"><enum>(II)</enum><text>disposition the illegitimate product within the possession or control of the repackager;</text></subclause> 
<subclause id="H6CD5ABCB20654C2BB4C07D628DE4EC75"><enum>(III)</enum><text>take reasonable and appropriate steps to assist a trading partner to disposition an illegitimate product not in the possession or control of the repackager; and</text></subclause> 
<subclause id="HBB64C1B6BB8A4B5892E2760E78B91B21"><enum>(IV)</enum><text>retain a sample of the product for further physical examination or laboratory analysis of the product by the manufacturer or Secretary (or other appropriate Federal or State official) upon request by the manufacturer or Secretary (or other appropriate Federal or State official), as necessary and appropriate.</text></subclause></clause> 
<clause id="H0E9E75C2BDAA4B2DB4C333C5F5DB8311"><enum>(ii)</enum><header>Making a notification</header><text>Upon determining that a product in the possession or control of the repackager is an illegitimate product, the repackager shall notify the Secretary and all immediate trading partners that the repackager has reason to believe may have received the illegitimate product of such determination not later than 24 hours after making such determination.</text></clause> 
<clause id="H494D5BA49EE1448E87D97AD424494BFF"><enum>(iii)</enum><header>Responding to a notification</header><text>Upon the receipt of a notification from the Secretary or a trading partner, a repackager shall identify all illegitimate product subject to such notification that is in the possession or control of the repackager, including any product that is subsequently received, and shall perform the activities described in subparagraph (A).</text></clause> 
<clause id="H75F794FC645948FC8FC058A8629B5294"><enum>(iv)</enum><header>Terminating a notification</header><text>Upon making a determination, in consultation with the Secretary, that a notification is no longer necessary, a repackager shall promptly notify immediate trading partners that the repackager notified pursuant to clause (ii) that such notification has been terminated.</text></clause> 
<clause id="H10C38F39EFF84191BBD30B2B45A33034"><enum>(v)</enum><header>Records</header><text>A repackager shall keep records of the disposition of an illegitimate product for not less than 6 years after the conclusion of the disposition.</text></clause></subparagraph> 
<subparagraph id="HB9E0FCCD153D4A61AFAE6F57EC3D0DE6"><enum>(C)</enum><header>Requests for verification</header><text>Beginning 5 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, upon receiving a request for verification from an authorized manufacturer, wholesale distributor, or dispenser that is in possession or control of a product they believe to be repackaged by such repackager, a repackager shall, not later than 24 hours after receiving the verification request or in other such reasonable time as determined by the Secretary, based on the circumstances of the request, notify the person making the request whether the product identifier, including the standardized numerical identifier, that is the subject of the request corresponds to the product identifier affixed or imprinted by the repackager. If a repackager responding to a verification request identifies a product identifier that does not correspond to that affixed or imprinted by the repackager, the repackager shall treat such product as suspect product and conduct an investigation as described in subparagraph (A). If the repackager has reason to believe the product is an illegitimate product, the repackager shall advise the person making the request of such belief at the time such repackager responds to the verification request.</text></subparagraph> 
<subparagraph id="HE2E6098854F4498797776200D0DC1556"><enum>(D)</enum><header>Electronic database</header><text>A repackager may satisfy the requirements of paragraph (4) by developing a secure electronic database or utilizing a secure electronic database developed or operated by another entity. The owner of such database shall establish the requirements and processes to respond to requests and may provide for data access to other members of the pharmaceutical distribution supply chain, as appropriate. The development and operation of such a database shall not relieve a repackager of the requirement under subparagraph (C) to respond to a verification request submitted by means other than a secure electronic database.</text></subparagraph> 
<subparagraph id="H6F00D3F6C5A3439FBB1CCB1A231CBF8B"><enum>(E)</enum><header>Verification of saleable returned product</header><text>Beginning 5 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, upon receipt of a returned product that the repackager intends to further distribute, before further distributing such product, the repackager shall verify the product identifier for each sealed homogeneous case of such product or, if such product is not in a sealed homogeneous case, verify the product identifier on each package.</text></subparagraph></paragraph></subsection> 
<subsection id="H49CDDC3F956E47759074365AFD627727"><enum>(f)</enum><header>Drop shipments</header> 
<paragraph id="HD06839CD4BDD45CA97EC78D53CB91A76"><enum>(1)</enum><header>In general</header><text>A wholesale distributor that does not physically handle or store product shall be exempt from the provisions of this section, except the notification requirements under clauses (ii), (iii), and (iv) of subsection (c)(4)(B), provided that the manufacturer, repackager, or other wholesale distributor that distributes the product to the dispenser by means of a drop shipment for such wholesale distributor includes on the transaction information and transaction history to the dispenser the contact information of such wholesale distributor and provides the transaction information, transaction history, and transaction statement directly to the dispenser.</text></paragraph> 
<paragraph id="H00541D61BD53448D85E7E344609EF5AB"><enum>(2)</enum><header>Clarification</header><text>For purposes of this subsection, providing administrative services, including processing of orders and payments, shall not by itself, be construed as being involved in the handling, distribution, or storage of a product.</text></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H276C48F1DBF644A38D0D54BAA54A4D5D"><enum>203.</enum><header>Enhanced drug distribution security</header><text display-inline="no-display-inline">Section 582, as added by section 202, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HE652C1D5122F4D4F9460180C79F1CBAC" style="OLC"> 
<subsection id="H3A57341D8F42408BAC649CC175717826"><enum>(g)</enum><header>Enhanced drug distribution security</header> 
<paragraph id="H5ABB4B4C0E9142078CC6A605F4C15574"><enum>(1)</enum><header>In general</header><text>On the date that is 10 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, the following interoperable, electronic tracing of product at the package level requirements shall go into effect:</text> 
<subparagraph id="H88FD0DB75F8D423AB95BBFD6783B260F"><enum>(A)</enum><text>The transaction information and the transaction statements as required under this section shall be exchanged in a secure, interoperable, electronic manner in accordance with the standards established under the guidance issued pursuant to paragraphs (3) and (4) of subsection (h), including any revision of such guidance issued in accordance with paragraph (5) of such subsection.</text></subparagraph> 
<subparagraph id="H8AE7C5B365604F249AB5903C155B72A6"><enum>(B)</enum><text>The transaction information required under this section shall include the product identifier at the package level for each package included in the transaction.</text></subparagraph> 
<subparagraph id="H1C3C847D95974D2CAF767CF27B901E48"><enum>(C)</enum><text>Systems and processes for verification of product at the package level, including the standardized numerical identifier, shall be required in accordance with the standards established under the guidance issued pursuant to subsection (a)(2) and the guidances issued pursuant to paragraphs (2), (3), and (4) of subsection (h), including any revision of such guidances issued in accordance with paragraph (5) of such subsection, which may include the use of aggregation and inference as necessary.</text></subparagraph> 
<subparagraph id="H7C29429E25254AD2A3C9337C302870F5"><enum>(D)</enum><text>The systems and processes necessary to promptly respond with the transaction information and transaction statement for a product upon a request by the Secretary (or other appropriate Federal or State official) in the event of a recall or for the purposes of investigating a suspect product or an illegitimate product shall be required.</text></subparagraph> 
<subparagraph id="H46F847BE4E0F482183D285050596E50C"><enum>(E)</enum><text>The systems and processes necessary to promptly facilitate gathering the information necessary to produce the transaction information for each transaction going back to the manufacturer, as applicable, shall be required—</text> 
<clause id="H66BDC090E39C4D739E438612562AC494"><enum>(i)</enum><text>in the event of a request by the Secretary (or other appropriate Federal or State official), on account of a recall or for the purposes of investigating a suspect product or an illegitimate product; or</text></clause> 
<clause id="HFFAF25DA20AB4DF0BC60F5BBFD138176"><enum>(ii)</enum><text>in the event of a request by an authorized trading partner, in a secure manner that ensures the protection of confidential commercial information and trade secrets, for purposes of investigating a suspect product or assisting the Secretary (or other appropriate Federal or State official) with a request described in clause (i).</text></clause></subparagraph> 
<subparagraph id="HCF48DAE0D3C144C8BD85DD7987D149A0"><enum>(F)</enum><text>Each person accepting a saleable return shall have systems and processes in place to allow acceptance of such product and may accept saleable returns only if such person can associate the saleable return product with the transaction information and transaction statement associated with that product.</text></subparagraph></paragraph> 
<paragraph id="HA673A22B0EEC4BE1BCFA3F8281398A7B"><enum>(2)</enum><header>Compliance</header> 
<subparagraph id="H7357DA52C98C4EE99E8D45F6D176A509"><enum>(A)</enum><header>Information maintenance agreement</header><text>A dispenser may enter into a written agreement with a third party, including an authorized wholesale distributor, under which the third party shall confidentially maintain any information and statements required to be maintained under this section. If a dispenser enters into such an agreement, the dispenser shall maintain a copy of the written agreement and shall not be relieved of the obligations of the dispenser under this subsection.</text></subparagraph> 
<subparagraph id="H87C9CA03EE28407CBCABA8E041D4C0E4"><enum>(B)</enum><header>Alternative methods</header><text>The Secretary, taking into consideration the assessment conducted under paragraph (3), shall provide for alternative methods of compliance with any of the requirements set forth in paragraph (1), including—</text> 
<clause id="H1FB2C06FB8FA49E7BA98F1DE18FB51D1"><enum>(i)</enum><text>establishing timelines for compliance by small businesses (including small business dispensers with 25 or fewer full-time employees) with such requirements, in order to ensure that such requirements do not impose undue economic hardship for small businesses, including small business dispensers for whom the criteria set forth in the assessment under paragraph (3) is not met, if the Secretary determines that such requirements under paragraph (1) would result in undue economic hardship; and</text></clause> 
<clause id="HFC91775371BA4E4F9A8C07292D6E29B6"><enum>(ii)</enum><text>establishing a process by which a dispenser may request a waiver from any of the requirements set forth in paragraph (1) if the Secretary determines that such requirements would result in an undue economic hardship, which shall include a process for the biennial review and renewal of any such waiver.</text></clause></subparagraph></paragraph> 
<paragraph id="H0228E049E16B4FB787C73431132E83F4"><enum>(3)</enum><header>Assessment</header> 
<subparagraph id="HF42577F5700A43A1962E40B2B63C5666"><enum>(A)</enum><header>In general</header><text>Not later than the date that is 18 months after the Secretary issues the final guidance required under subsection (h), the Secretary shall enter into a contract with a private, independent consulting firm with expertise to conduct a technology and software assessment that looks at the feasibility of dispensers with 25 or fewer full-time employees conducting interoperable, electronic tracing of products at the package level. Such assessment shall be completed not later than 8½ years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>.</text></subparagraph> 
<subparagraph id="H4E5A408C8C0143D4A13E21A67E2F1DEC"><enum>(B)</enum><header>Condition</header><text>As a condition of the award of the contract under subparagraph (A), the private, independent consulting firm shall agree to consult with dispensers with 25 or fewer full-time employees when conducting the assessment under such subparagraph.</text></subparagraph> 
<subparagraph id="H20B86B44587247E6990D82842C139B1A"><enum>(C)</enum><header>Content</header><text>The assessment under subparagraph (A) shall assess whether—</text> 
<clause id="HB85B0F764548402A96F63A9DCE5BDA34"><enum>(i)</enum><text>the necessary software and hardware is readily accessible to such dispensers;</text></clause> 
<clause id="H7C0CAAB48A6F462F9BAF2119FB3E5375"><enum>(ii)</enum><text>the necessary software and hardware is prohibitively expensive to obtain, install, and maintain for such dispensers; and</text></clause> 
<clause id="HF331AF2942334502965E99B25FE7686D"><enum>(iii)</enum><text>the necessary hardware and software can be integrated into business practices, such as interoperability with wholesale distributors, for such dispensers.</text></clause></subparagraph> 
<subparagraph id="HFF52E1A6024F4CE6A9501D5058CC3B52"><enum>(D)</enum><header>Publication</header><text>The Secretary shall—</text> 
<clause id="HE45156A4C25B4D6480CA50CB368ED626"><enum>(i)</enum><text>publish the statement of work for the assessment under subparagraph (A) for public comment prior to beginning the assessment;</text></clause> 
<clause id="H82D853A51D184E9C95D2473E55625AAA"><enum>(ii)</enum><text>publish the final assessment for public comment not later than 30 calendar days after receiving such assessment; and</text></clause> 
<clause id="H76E36FDB9DD04B899C1A7D09722F72D4"><enum>(iii)</enum><text>hold a public meeting not later than 180 calendar days after receiving the final assessment at which public stakeholders may present their views on the assessment.</text></clause></subparagraph></paragraph> 
<paragraph id="HBE3CCA322FAF43328BDD23F7BED9CBA4"><enum>(4)</enum><header>Procedure</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code, the Secretary, in promulgating any regulation pursuant to this section, shall—</text> 
<subparagraph id="HFAB69C7A4DFE46A1B89B3585B94A06BB"><enum>(A)</enum><text>provide appropriate flexibility by—</text> 
<clause id="H37D72F5FD9C24F51A8DB71BAECB704D8"><enum>(i)</enum><text>not requiring the adoption of specific business systems for the maintenance and transmission of data;</text></clause> 
<clause id="HF2F9815FC74C43549B3D147E02319517"><enum>(ii)</enum><text>prescribing alternative methods of compliance for any of the requirements set forth in paragraph (1) or set forth in regulations implementing such requirements, including—</text> 
<subclause id="H3DCAB14ACE524F479AF14A7B3D7DD8EA"><enum>(I)</enum><text>timelines for small businesses to comply with the requirements set forth in the regulations in order to ensure that such requirements do not impose undue economic hardship for small businesses (including small business dispensers for whom the criteria set forth in the assessment under paragraph (3) is not met), if the Secretary determines that such requirements would result in undue economic hardship; and</text></subclause> 
<subclause id="HE4C8BEAB71234802A65872B014CC8679"><enum>(II)</enum><text>the establishment of a process by which a dispenser may request a waiver from any of the requirements set forth in such regulations if the Secretary determines that such requirements would result in an undue economic hardship; and</text></subclause></clause> 
<clause id="HF80206F86948423A95F236D2CA185094"><enum>(iii)</enum><text>taking into consideration—</text> 
<subclause id="H01447CCDA1F248B385E24477D0820D0D"><enum>(I)</enum><text>the results of pilot projects, including pilot projects pursuant to this section and private sector pilot projects, including those involving the use of aggregation and inference;</text></subclause> 
<subclause id="H57074FC39D484D1AAF603D1752137108"><enum>(II)</enum><text>the public meetings held and related guidance documents issued under this section;</text></subclause> 
<subclause id="H41CF3330049B4CA8A550BFC7DA23BD48"><enum>(III)</enum><text>the public health benefits of any additional regulations in comparison to the cost of compliance with such requirements, including on entities of varying sizes and capabilities;</text></subclause> 
<subclause id="HA5250379D5D34952833154522939F652"><enum>(IV)</enum><text>the diversity of the pharmaceutical distribution supply chain by providing appropriate flexibility for each sector, including both large and small businesses; and</text></subclause> 
<subclause id="HD993DC8871594E678337A7547287ABF9"><enum>(V)</enum><text>the assessment pursuant to paragraph (3) with respect to small business dispensers, including related public comment and the public meeting, and requirements under this section;</text></subclause></clause></subparagraph> 
<subparagraph id="H5A61609A547248659F64A8464726E5DB"><enum>(B)</enum><text>issue a notice of proposed rulemaking that includes a copy of the proposed regulation;</text></subparagraph> 
<subparagraph id="H466D096D798A4F7FA7E11BDF017C7A94"><enum>(C)</enum><text>provide a period of not less than 60 days for comments on the proposed regulation; and</text></subparagraph> 
<subparagraph id="H6F5418BB7BEC416DACB52B60E9B993A1"><enum>(D)</enum><text>publish in the Federal Register the final regulation not less than 2 years prior to the effective date of the regulation.</text></subparagraph></paragraph></subsection> 
<subsection id="HA697EBC5EF8440CDB86DE87597BE21BA"><enum>(h)</enum><header>Guidance documents</header> 
<paragraph id="H390031262A8044E9AAF8DB2CC83C818A"><enum>(1)</enum><header>In general</header><text>For the purposes of facilitating the successful and efficient adoption of secure, interoperable product tracing at the package level in order to enhance drug distribution security and further protect the public health, the Secretary shall issue the guidance documents as provided for in this subsection.</text></paragraph> 
<paragraph id="HF3F75E13124E42AF8676FE4853A539DC"><enum>(2)</enum><header>Suspect and illegitimate product</header> 
<subparagraph id="H03C16EBDC83143879C3BF86ED4C64230"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, the Secretary shall issue a guidance document to aid trading partners in the identification of a suspect product and notification termination. Such guidance document shall—</text> 
<clause id="HCEC65D3873B54836ACDB0A250E32F890"><enum>(i)</enum><text>identify specific scenarios that could significantly increase the risk of a suspect product entering the pharmaceutical distribution supply chain;</text></clause> 
<clause id="HDAF0C09D92FE44138013EE99EAAC0A19"><enum>(ii)</enum><text>provide recommendation on how trading partners may identify such product and make a determination on whether the product is a suspect product as soon as practicable; and</text></clause> 
<clause id="H9F7573C3DCFD4F7C8F8FFAD626D06E25"><enum>(iii)</enum><text>set forth the process by which manufacturers, repackagers, wholesale distributors, and dispensers shall terminate notifications in consultation with the Secretary regarding illegitimate product pursuant to subsections (b)(4)(B), (c)(4)(B), (d)(4)(B), and (e)(4)(B).</text></clause></subparagraph> 
<subparagraph id="H0973E926D6C345F0AB40A6D8F9680545"><enum>(B)</enum><header>Revised guidance</header><text>If the Secretary revises the guidance issued under subparagraph (A), the Secretary shall follow the procedure set forth in paragraph (5).</text></subparagraph></paragraph> 
<paragraph id="H12641ED9ADD741AA8E3316756E5E3179"><enum>(3)</enum><header>Unit level tracing</header> 
<subparagraph id="H5B1FC625A24240969403EFE88E749B42"><enum>(A)</enum><header>In general</header><text>In order to enhance drug distribution security at the package level, not later than 18 months after conducting a public meeting on the system attributes necessary to enable secure tracing of product at the package level, including allowing for the use of verification, inference, and aggregation, as necessary, the Secretary shall issue a final guidance document that outlines and makes recommendations with respect to the system attributes necessary to enable secure tracing at the package level as required under the requirements established under subsection (g). Such guidance document shall—</text> 
<clause id="H8DCBFCD76E6C46BB8E5CBB35778CCD63"><enum>(i)</enum><text>define the circumstances under which the sectors within the pharmaceutical distribution supply chain may, in the most efficient manner practicable, infer the contents of a case, pallet, tote, or other aggregate of individual packages or containers of product, from a product identifier associated with the case, pallet, tote, or other aggregate, without opening each case, pallet, tote, or other aggregate or otherwise individually scanning each package;</text></clause> 
<clause id="H847A5FDD89FE46218C644B1910F539A8"><enum>(ii)</enum><text>identify methods and processes to enhance secure tracing of product at the package level, such as secure processes to facilitate the use of inference, enhanced verification activities, the use of aggregation and inference, processes that utilize the product identifiers to enhance tracing of product at the package level, including the standardized numerical identifier, or package security features; and</text></clause> 
<clause id="HE7A7B9EB4FE3420C8C994A506E49E8F3"><enum>(iii)</enum><text>ensure the protection of confidential commercial information and trade secrets.</text></clause></subparagraph> 
<subparagraph id="H91BE9A64D8C949D787FF1DD6FDE9237E"><enum>(B)</enum><header>Procedure</header><text>In issuing the guidance under subparagraph (A), and in revising such guidance, if applicable, the Secretary shall follow the procedure set forth in paragraph (5).</text></subparagraph></paragraph> 
<paragraph id="H2675242738F743268A12BB778F0FD1E8"><enum>(4)</enum><header>Standards for interoperable data exchange</header> 
<subparagraph id="H7D73DC2D4DBE48799E8E64DA7E368C84"><enum>(A)</enum><header>In general</header><text>In order to enhance secure tracing of a product at the package level, the Secretary, not later than 18 months after conducting a public meeting on the interoperable standards necessary to enhance the security of the pharmaceutical distribution supply chain, shall update the guidance issued pursuant to subsection (a)(2), as necessary and appropriate, and finalize such guidance document so that the guidance document—</text> 
<clause id="HD23F122C288D4269930013236D14EE1C"><enum>(i)</enum><text>identifies and makes recommendations with respect to the standards necessary for adoption in order to support the secure, interoperable electronic data exchange among the pharmaceutical distribution supply chain that comply with a form and format developed by a widely recognized international standards development organization;</text></clause> 
<clause id="H7FA8C1D5E53647BA84DB5E473CC689CD"><enum>(ii)</enum><text>takes into consideration standards established pursuant to subsection (a)(2) and section 505D;</text></clause> 
<clause id="H0BFE40EC3B39469CA1F679D46569645D"><enum>(iii)</enum><text>facilitates the creation of a uniform process or methodology for product tracing; and</text></clause> 
<clause id="H70CDBFD24EBF4ACE82761F578E09B7F6"><enum>(iv)</enum><text>ensures the protection of confidential commercial information and trade secrets.</text></clause></subparagraph> 
<subparagraph id="HE6E6E3D6E7784F4BB6E41BABCA6DD93F"><enum>(B)</enum><header>Procedure</header><text>In issuing the guidance under subparagraph (A), and in revising such guidance, if applicable, the Secretary shall follow the procedure set forth in paragraph (5).</text></subparagraph></paragraph> 
<paragraph id="H8AC9E7E48A3D4B7E8A663717E9E38229"><enum>(5)</enum><header>Procedure</header><text>In issuing or revising any guidance issued pursuant to this subsection or subsection (g), except the initial guidance issued under paragraph (2)(A), the Secretary shall—</text> 
<subparagraph id="H3F4461D183CC4F8BB224BA469507959B"><enum>(A)</enum><text>publish a notice in the Federal Register for a period not less than 30 days announcing that the draft or revised draft guidance is available;</text></subparagraph> 
<subparagraph id="H88498BA81BC34EA4A4DE58DFBE5433B7"><enum>(B)</enum><text>post the draft guidance document on the Internet Web site of the Food and Drug Administration and make such draft guidance document available in hard copy;</text></subparagraph> 
<subparagraph id="H64C14310973F4AF688A70BA0633F4A79"><enum>(C)</enum><text>provide an opportunity for comment and review and take into consideration any comments received;</text></subparagraph> 
<subparagraph id="H44C7D2DEC22E42A6A8B0683441BBA6AD"><enum>(D)</enum><text>revise the draft guidance, as appropriate;</text></subparagraph> 
<subparagraph id="HFE4AFF9153FC49159C98E4BF328AB1AF"><enum>(E)</enum><text>publish a notice in the Federal Register for a period not less than 30 days announcing that the final guidance or final revised guidance is available;</text></subparagraph> 
<subparagraph id="H5FA582A3D96448D797DCFFC61384BDE5"><enum>(F)</enum><text>post the final guidance document on the Internet Web site of the Food and Drug Administration and make such final guidance document available in hard copy; and</text></subparagraph> 
<subparagraph id="H708841D4089C4BE492ABFFA6E7A74B80"><enum>(G)</enum><text>provide for an effective date of not earlier than 1 year after such guidance becomes final.</text></subparagraph></paragraph></subsection> 
<subsection id="HFEADF20EEBF84407A33812E90D02B681"><enum>(i)</enum><header>Public meetings</header> 
<paragraph id="HDC16465C83F6416CAE444C038FE58202"><enum>(1)</enum><header>In general</header><text>The Secretary shall hold not less than 5 public meetings to enhance the safety and security of the pharmaceutical distribution supply chain and provide for comment. The Secretary may hold the first such public meeting not earlier than 1 year after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>. In carrying out the public meetings described in this paragraph, the Secretary shall—</text> 
<subparagraph id="H386BAB0163944B10B0026D3B81E3377C"><enum>(A)</enum><text>prioritize topics necessary to inform the issuance of the guidance described in paragraphs (3) and (4) of subsection (h); and</text></subparagraph> 
<subparagraph id="H26BBB36931B44D9C84D89B7BC95DB663"><enum>(B)</enum><text>take all measures reasonable and practicable to ensure the protection of confidential commercial information and trade secrets.</text></subparagraph></paragraph> 
<paragraph id="HD405F314CCB24685BD46C1487288B830"><enum>(2)</enum><header>Content</header><text>Each of the following topics shall be addressed in at least one of the public meetings described in paragraph (1):</text> 
<subparagraph id="H2930F70EC69E4828A00581A44108676F"><enum>(A)</enum><text>An assessment of the steps taken under subsections (b) through (e) to build capacity for a unit-level system, including the impact of the requirements of such subsections on—</text> 
<clause id="H63B7B6CD8C114DAC88F95E4400A26428"><enum>(i)</enum><text>the ability of the health care system collectively to maintain patient access to medicines;</text></clause> 
<clause id="HF1D597E9E1EE48CF9983DE053BF7855C"><enum>(ii)</enum><text>the scalability of such requirements, including as it relates to product lines; and</text></clause> 
<clause id="HC553A8DD90A44966BBC8381DD973AFC6"><enum>(iii)</enum><text>the capability of different sectors and subsectors, including both large and small businesses, to affix and utilize the product identifier.</text></clause></subparagraph> 
<subparagraph id="H5CC8D3B8147E43CA9740227B53A4617F"><enum>(B)</enum><text>The system attributes necessary to support the requirements set forth under subsection (g), including the standards necessary for adoption in order to support the secure, interoperable electronic data exchange among sectors within the pharmaceutical distribution supply chain.</text></subparagraph> 
<subparagraph id="H84089B31CBF44C579D7219863E0E0455"><enum>(C)</enum><text>Best practices in each of the different sectors within the pharmaceutical distribution supply chain to implement the requirements of this section.</text></subparagraph> 
<subparagraph id="H86981D01E2E14E92B2412B25ACFBD503"><enum>(D)</enum><text>The costs and benefits of the implementation of this section, including the impact on each pharmaceutical distribution supply chain sector and on public health.</text></subparagraph> 
<subparagraph id="H93717A173CB34389B8090F0EA95AC4E4"><enum>(E)</enum><text>Whether electronic tracing requirements, including tracing of product at the package level, are feasible, cost effective, and needed to protect the public health.</text></subparagraph> 
<subparagraph id="H6F8A35BCB561489486C4C49538857C76"><enum>(F)</enum><text>The systems and processes needed to utilize the product identifiers to enhance tracing of product at the package level, including allowing for verification, aggregation, and inference, as necessary.</text></subparagraph> 
<subparagraph id="H5F67B0AC90A54A9B870A232F4CFFDCC9"><enum>(G)</enum><text>The technical capabilities and legal authorities, if any, needed to establish an interoperable, electronic system that provides for tracing of product at the package level.</text></subparagraph> 
<subparagraph id="HECA277FF423748DFB960B66786A64FA8"><enum>(H)</enum><text>The impact that such additional requirements would have on patient safety, the drug supply, cost and regulatory burden, and timely patient access to prescription drugs.</text></subparagraph> 
<subparagraph id="HA6AC68BF4D9D427782DF466203FA5556"><enum>(I)</enum><text>Other topics, as determined appropriate by the Secretary.</text></subparagraph></paragraph></subsection> 
<subsection id="HF4AF2FFFBB5F4FDC9735519CFEC280CB"><enum>(j)</enum><header>Pilot projects</header> 
<paragraph id="H6C63A14719FF4782A0EE4916AFAEB0C1"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish 1 or more pilot projects, in coordination with authorized manufacturers, repackagers, wholesale distributors, and dispensers, to explore and evaluate methods to enhance the safety and security of the pharmaceutical distribution supply chain. Such projects shall build upon efforts, in existence as of the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, to enhance the safety and security of the pharmaceutical distribution supply chain, take into consideration any pilot projects conducted prior to such date of enactment, including any pilot projects that use aggregation and inference, and inform the draft and final guidance under paragraphs (3) and (4) of subsection (h).</text></paragraph> 
<paragraph id="H4B12A9FA8ACE4EF0B9706FFBC59D2A90"><enum>(2)</enum><header>Content</header> 
<subparagraph id="HC0D1C9112990479385553A9736D78C11"><enum>(A)</enum><header>In general</header><text>The Secretary shall ensure that the pilot projects under paragraph (1) reflect the diversity of the pharmaceutical distribution supply chain and that the pilot projects, when taken as a whole, include participants representative of every sector, including both large and small businesses.</text></subparagraph> 
<subparagraph id="H8A0F9D5E5A1A44F7B1253D40D43F4CB3"><enum>(B)</enum><header>Project design</header><text>The pilot projects under paragraph (1) shall be designed to—</text> 
<clause id="H94A354F950A74D81AFFCC410C146F3A5"><enum>(i)</enum><text>utilize the product identifier for tracing of a product, which may include verification of the product identifier of a product, including the use of aggregation and inference;</text></clause> 
<clause id="H327BAC8E64CA41C794B560D9355B3281"><enum>(ii)</enum><text>improve the technical capabilities of each sector and subsector to comply with systems and processes needed to utilize the product identifiers to enhance tracing of a product;</text></clause> 
<clause id="HB3ED05AF0B6440CA8F583A09276515F9"><enum>(iii)</enum><text>identify system attributes that are necessary to implement the requirements established under this section; and</text></clause> 
<clause id="HC89113A443804BDDA5A74EA2E583F5C6"><enum>(iv)</enum><text>complete other activities as determined by the Secretary.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HDA0F23A4B5084F2CBE1BA7AE44E29E90"><enum>(k)</enum><header>Sunset</header><text>The following requirements shall have no force or effect beginning on the date that is 10 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>:</text> 
<paragraph id="H27625C7EABFB4E8E9387CCACFFC64251"><enum>(1)</enum><text>The provision and receipt of transaction history under this section.</text></paragraph> 
<paragraph id="H9379471A7395460F982ADFB5A72BF08A"><enum>(2)</enum><text>The requirements set forth for returns under subsections (b)(4)(E), (c)(1)(B)(i), (d)(1)(C)(i), and (e)(4)(E).</text></paragraph> 
<paragraph id="HD723FDD2592646D4836637AD0C8B0425"><enum>(3)</enum><text>The requirements set forth under subparagraphs (A)(v)(II) and (D) of subsection (c)(1), as applied to lot level information only.</text></paragraph></subsection> 
<subsection id="H38DA99067FF7476CBD7CE77C4BCECCFC"><enum>(l)</enum><header>Rule of construction</header><text>The requirements set forth in subsections (g)(4), (i), and (j) shall not be construed as a condition, prohibition, or precedent for precluding or delaying the provisions becoming effective pursuant to subsection (g).</text></subsection> 
<subsection id="H5554F990536144948082422A364E6697"><enum>(m)</enum><header>Requests for information</header><text>On the date that is 10 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, the timeline for responses to requests for information from the Secretary, or other appropriate Federal or State official, as applicable, under subsections (b)(1)(B), (c)(1)(C), and (e)(1)(C) shall be not later than 24 hours after receiving the request from the Secretary or other appropriate Federal or State official, as applicable, or in such other reasonable time as determined by the Secretary based on the circumstances of the request.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC205854682F944E888BB438DDB24926D"><enum>204.</enum><header>National standards for prescription drug wholesale distributors</header> 
<subsection id="HF3903E069297405A98576E9C054F4EE9"><enum>(a)</enum><header>Amendments</header> 
<paragraph id="HE170F2CDC5994E67BE7302B38F1A2F88"><enum>(1)</enum><header>Requirement</header><text>Section 503(e) (<external-xref legal-doc="usc" parsable-cite="usc/21/353">21 U.S.C. 353(e)</external-xref>) is amended by striking paragraphs (1), (2), and (3) and inserting the following:</text>

<paragraph id="HDE33465EE44F41C6AC4CC62A4B6E7759"><enum>(1)</enum><header>Requirement</header><text>Subject to section 583:</text> 
<subparagraph id="H66A5A0357FE84B48B02602CC6C513DF4"><enum>(A)</enum><header>In general</header><text>No person may engage in wholesale distribution of a drug subject to subsection (b)(1) in any State unless such person—</text> 
<clause id="HFF8D36B008124EC388ECE3445EA6633B"><enum>(i)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="HD5C90ABC2D494D99AC7CC585FBBD3F65"><enum>(I)</enum><text>is licensed by the State from which the drug is distributed; or</text></subclause> 
<subclause id="H5FB92D98C643466397827140901F6D8D" indent="up1"><enum>(II)</enum><text>if the State from which the drug is distributed has not established a licensure requirement, is licensed by the Secretary; and</text></subclause></clause> 
<clause id="H4C27C263F2F84E7E9941AAA58084BCD4"><enum>(ii)</enum><text>if the drug is distributed interstate, is licensed by the State into which the drug is distributed if the State into which the drug is distributed requires the licensure of a person that distributes drugs into the State.</text></clause></subparagraph> 
<subparagraph id="HFB5C096B77434CB99D570C4A3716C434"><enum>(B)</enum><header>Standards</header><text>Each Federal and State license described in subparagraph (A) shall meet the standards, terms, and conditions established by the Secretary under section 583.</text></subparagraph></paragraph> 
<paragraph id="H197AFB36A1D74F8ABC4AC2E1D8F4DC29"><enum>(2)</enum><header>Reporting and database</header> 
<subparagraph id="H58B2DABFD3984EE19DAA294FE3908A35"><enum>(A)</enum><header>Reporting</header><text>Beginning January 1, 2015, any person who owns or operates an establishment that engages in wholesale distribution shall—</text> 
<clause id="HE972C39547DA465897FCC4DA67999A19"><enum>(i)</enum><text>report to the Secretary, on an annual basis pursuant to a schedule determined by the Secretary—</text> 
<subclause id="HEA8F2239CA584EFD8978CA55496AF9F1"><enum>(I)</enum><text>each State by which the person is licensed and the appropriate identification number of each such license; and</text></subclause> 
<subclause id="HD3F7D0D1371A4E5C8EADA639A72900E6"><enum>(II)</enum><text>the name, address, and contact information of each facility at which, and all trade names under which, the person conducts business; and</text></subclause></clause> 
<clause id="H5643BA60696345D1A75D9666E58B2E30"><enum>(ii)</enum><text>report to the Secretary within a reasonable period of time and in a reasonable manner, as determined by the Secretary, any significant disciplinary actions, such as the revocation or suspension of a wholesale distributor license, taken by a State or the Federal Government during the reporting period against the wholesale distributor.</text></clause></subparagraph> 
<subparagraph id="H5034A1BA052D4FF8875343FAEB3E417D"><enum>(B)</enum><header>Database</header><text>Not later than January 1, 2015, the Secretary shall establish a database of authorized wholesale distributors. Such database shall—</text> 
<clause id="H8DEABC775A5F4321AC0E4E7B3724F118"><enum>(i)</enum><text>identify each authorized wholesale distributor by name, contact information, and each State where such wholesale distributor is appropriately licensed to engage in wholesale distribution;</text></clause> 
<clause id="HA828778343B3424C976A52C4C9C69506"><enum>(ii)</enum><text>be available to the public on the Internet Web site of the Food and Drug Administration; and</text></clause> 
<clause id="HE233A0FA41004D51B677D6B90930F7E1"><enum>(iii)</enum><text>be regularly updated on a schedule determined by the Secretary.</text></clause></subparagraph> 
<subparagraph id="HB4191CE818E8490DB86FC79AD046F314"><enum>(C)</enum><header>Coordination</header><text>The Secretary shall establish a format and procedure for appropriate State officials to access the information provided pursuant to subparagraph (A) in a prompt and secure manner.</text></subparagraph> 
<subparagraph id="HBFBB43E010AD4185AEFD6913277D0BC0"><enum>(D)</enum><header>Confidentiality</header><text>Nothing in this paragraph shall be construed as authorizing the Secretary to disclose any information that is a trade secret or confidential information subject to <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552(b)(4)</external-xref> of title 5, United States Code, or <external-xref legal-doc="usc" parsable-cite="usc/18/1905">section 1905</external-xref> of title 18, United States Code.</text></subparagraph></paragraph> 
<paragraph id="H7919664FE0D7456187372602555F788B"><enum>(3)</enum><header>Costs</header> 
<subparagraph id="H4360C13200AB4F96BA568974CD57ECE2"><enum>(A)</enum><header>Authorized fees of secretary</header><text>If a State does not establish a licensing program for persons engaged in the wholesale distribution of a drug subject to subsection (b), the Secretary shall license a person engaged in wholesale distribution located in such State and may collect a reasonable fee in such amount necessary to reimburse the Secretary for costs associated with establishing and administering the licensure program and conducting periodic inspections under this section. The Secretary shall adjust fee rates as needed on an annual basis to generate only the amount of revenue needed to perform this service. Fees authorized under this paragraph shall be collected and available for obligation only to the extent and in the amount provided in advance in appropriations Acts. Such fees are authorized to remain available until expended. Such sums as may be necessary may be transferred from the Food and Drug Administration salaries and expenses appropriation account without fiscal year limitation to such appropriation account for salaries and expenses with such fiscal year limitation.</text></subparagraph> 
<subparagraph id="HFBB6F74F2B1B45B6B6F7C5628C46F709"><enum>(B)</enum><header>State licensing fees</header><text>Nothing in this Act shall prohibit States from collecting fees from wholesale distributors in connection with State licensing of such distributors.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC0A16686196E4AD4AE786F2F8AF5180C"><enum>(2)</enum><header>Wholesale distribution</header><text>Section 503(e) (<external-xref legal-doc="usc" parsable-cite="usc/21/353">21 U.S.C. 353(e)</external-xref>), as amended by paragraph (1), is further amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HC963CC737C4F4EB49AC1FFCA91EC451D" style="OLC"> 
<paragraph id="HB7A984FC9C84483EBB8100A8F17D38A6"><enum>(4)</enum><text>For the purposes of this subsection and subsection (d), the term <term>wholesale distribution</term> means the distribution of a drug subject to subsection (b) to a person other than a consumer or patient, or receipt of a drug subject to subsection (b) by a person other than the consumer or patient, but does not include—</text> 
<subparagraph id="HD59476288FB64D3F8203D9D16262CDD7"><enum>(A)</enum><text>intracompany distribution of any drug between members of an affiliate or within a manufacturer;</text></subparagraph> 
<subparagraph id="HFC768AEAD8C84765AB0241F700051C97"><enum>(B)</enum><text>the distribution of a drug, or an offer to distribute a drug among hospitals or other health care entities which are under common control;</text></subparagraph> 
<subparagraph id="HDEAA37C2413C4C2DAC70DB95472C2122"><enum>(C)</enum><text>the distribution of a drug or an offer to distribute a drug for emergency medical reasons, including a public health emergency declaration pursuant to section 319 of the Public Health Service Act, except that, for purposes of this paragraph, a drug shortage not caused by a public health emergency shall not constitute an emergency medical reason;</text></subparagraph> 
<subparagraph id="H6631D24715914DE08710E0BB0A543CE7"><enum>(D)</enum><text>the dispensing of a drug pursuant to a prescription executed in accordance with subsection (b)(1);</text></subparagraph> 
<subparagraph id="H56D79F9D490844CA967B6579F3D95AEC"><enum>(E)</enum><text>the distribution of minimal quantities of drug by a licensed retail pharmacy to a licensed practitioner for office use;</text></subparagraph> 
<subparagraph id="H07935317D38C464AA770DCD8E5908B80"><enum>(F)</enum><text>the distribution of a drug or an offer to distribute a drug by a charitable organization to a nonprofit affiliate of the organization to the extent otherwise permitted by law;</text></subparagraph> 
<subparagraph id="H8804604F7C3A4FDABB49286DF4F63599"><enum>(G)</enum><text>the purchase or other acquisition by a dispenser, hospital, or other health care entity of a drug for use by such dispenser, hospital, or other health care entity;</text></subparagraph> 
<subparagraph id="H4A2AD473295748E7BDB56F5304D8FD7E"><enum>(H)</enum><text>the distribution of a drug by the manufacturer of such drug;</text></subparagraph> 
<subparagraph id="H80764056190649A0BC834AFE19BF87FD"><enum>(I)</enum><text>the receipt or transfer of a drug by an authorized third-party logistics provider provided that such third-party logistics provider does not take ownership of the drug;</text></subparagraph> 
<subparagraph id="H8B792BA797004910AFBEDBF18FD45AA3"><enum>(J)</enum><text>a common carrier that transports a drug, provided that the common carrier does not take ownership of the drug;</text></subparagraph> 
<subparagraph id="H80CF205B4DC84A218B5DAA7DE49FAC19"><enum>(K)</enum><text>the distribution of a drug, or an offer to distribute a drug by an authorized repackager that has taken ownership or possession of the drug and repacks it in accordance with section 582(e);</text></subparagraph> 
<subparagraph id="H7A17A74466084027B7B7AF2DC0F80F7B"><enum>(L)</enum><text>salable drug returns when conducted by a dispenser;</text></subparagraph> 
<subparagraph id="HD7BFF67435B74A19A4C8C25E58723FEC"><enum>(M)</enum><text>the distribution of a collection of finished medical devices, which may include a product or biological product, assembled in kit form strictly for the convenience of the purchaser or user (referred to in this subparagraph as a <quote>medical convenience kit</quote>) if—</text> 
<clause id="H7CE5460E01554DABAC9F6595B92F3AF9"><enum>(i)</enum><text>the medical convenience kit is assembled in an establishment that is registered with the Food and Drug Administration as a device manufacturer in accordance with section 510(b)(2);</text></clause> 
<clause id="HB277E85E97DA41618AFC935224018271"><enum>(ii)</enum><text>the medical convenience kit does not contain a controlled substance that appears in a schedule contained in the Comprehensive Drug Abuse Prevention and Control Act of 1970;</text></clause> 
<clause id="HB7608CC834A84D4EA33FBB7EF076DCEE"><enum>(iii)</enum><text>in the case of a medical convenience kit that includes a product, the person that manufacturers the kit—</text> 
<subclause id="HAF45F34689E84CA6A25B9462C242375B"><enum>(I)</enum><text>purchased such product directly from the pharmaceutical manufacturer or from a wholesale distributor that purchased the product directly from the pharmaceutical manufacturer; and</text></subclause> 
<subclause id="H0A4AD42CFA56415797E0CC629675A4E7"><enum>(II)</enum><text>does not alter the primary container or label of the product as purchased from the manufacturer or wholesale distributor; and</text></subclause></clause> 
<clause commented="no" id="HAADB6CE3C10D4D9A96E59657A8C09AE9"><enum>(iv)</enum><text>in the case of a medical convenience kit that includes a product, the product is—</text> 
<subclause commented="no" id="HBF6C351F65C54D2D8D9CCB70F74652B6"><enum>(I)</enum><text>an intravenous solution intended for the replenishment of fluids and electrolytes;</text></subclause> 
<subclause commented="no" id="H51CF54C110B14E4F91BA0B32182539B2"><enum>(II)</enum><text>a product intended to maintain the equilibrium of water and minerals in the body;</text></subclause> 
<subclause commented="no" id="H4D9764DAED9548EAB9D95A6F1ABB862E"><enum>(III)</enum><text>a product intended for irrigation or reconstitution;</text></subclause> 
<subclause commented="no" id="HDD29AEF4B48147B194D042C2FD2A74EE"><enum>(IV)</enum><text>an anesthetic;</text></subclause> 
<subclause commented="no" id="H4CD1A5751DB5447CA022722AA024F60D"><enum>(V)</enum><text>an anticoagulant;</text></subclause> 
<subclause commented="no" id="H7B36746381154FC69296AEF5DD212819"><enum>(VI)</enum><text>a vasopressor; or</text></subclause> 
<subclause id="H62EFD5FDF8EC48D9B3361AFC93C41B39"><enum>(VII)</enum><text display-inline="yes-display-inline">a sympathomimetic;</text></subclause></clause></subparagraph> 
<subparagraph id="H8504E2CB8D814270BCC1B1EC26A9A323"><enum>(N)</enum><text>the distribution of an intravenous drug that, by its formulation, is intended for the replenishment of fluids and electrolytes (such as sodium, chloride, and potassium) or calories (such as dextrose and amino acids);</text></subparagraph> 
<subparagraph id="H67F9A2199DA54846BE6D3B5DECAB1B6E"><enum>(O)</enum><text>the distribution of an intravenous drug used to maintain the equilibrium of water and minerals in the body, such as dialysis solutions;</text></subparagraph> 
<subparagraph id="H9016165F8DD84D669423FDF41C389B89"><enum>(P)</enum><text>the distribution of a drug that is intended for irrigation, or sterile water, whether intended for such purposes or for injection;</text></subparagraph> 
<subparagraph id="H59C2769CA3F940C1B7722307E6068957"><enum>(Q)</enum><text>the distribution of medical gas, as defined in section 575;</text></subparagraph> 
<subparagraph id="H3CA4D6DE4167494995A4CC6B032AB962"><enum>(R)</enum><text>facilitating the distribution of a product by providing solely administrative services, including processing of orders and payments; or</text></subparagraph> 
<subparagraph id="H16F9612AE4584215B32171D89BFE106B"><enum>(S)</enum><text>the transfer of a product by a hospital or other health care entity, or by a wholesale distributor or manufacturer operating at the direction of the hospital or other health care entity, to a repackager described in section 581(16)(B) and registered under section 510 for the purpose of repackaging the drug for use by that hospital, or other health care entity and other health care entities that are under common control, if ownership of the drug remains with the hospital or other health care entity at all times.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H91310D54CA5D4AACBAB6AD354B038FD5"><enum>(3)</enum><header>Third-party logistics providers</header><text>Section 503(e) (<external-xref legal-doc="usc" parsable-cite="usc/21/353">21 U.S.C. 353(e)</external-xref>), as amended by paragraph (2), is further amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H1E3894206C9E43F885B738BD27B6A937" style="OLC"> 
<paragraph id="HA28B148D0B684CFD97BBDFFFB10AB2C0"><enum>(5)</enum><header>Third-party logistics providers</header><text>Notwithstanding paragraphs (1) through (4), each entity that meets the definition of a third-party logistics provider under section 581(22) shall obtain a license as a third-party logistics provider as described in section 584(a) and is not required to obtain a license as a wholesale distributor if the entity never assumes an ownership interest in the product it handles.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HDC8E6EECC0624214AA297E4B40A61CD1"><enum>(4)</enum><header>Affiliate</header><text>Section 503(e) (<external-xref legal-doc="usc" parsable-cite="usc/21/353">21 U.S.C. 353(e)</external-xref>), as amended by paragraph (3), is further amended by adding at the end the following:</text>

<paragraph id="HDEF0546F7B3D449F9EB61D9060FABBAA"><enum>(6)</enum><header>Affiliate</header><text>For purposes of this subsection, the term <term>affiliate</term> means a business entity that has a relationship with a second business entity if, directly or indirectly—</text> 
<subparagraph id="H146001DBA87C48D4AB53F4ED6EE3BBC0"><enum>(A)</enum><text>one business entity controls, or has the power to control, the other business entity; or</text></subparagraph> 
<subparagraph id="HCBC02DD4235544BCA73044E586DD9BEE"><enum>(B)</enum><text>a third party controls, or has the power to control, both of the business entities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H29040C4A40C4434F9D9D69DE95309AB5"><enum>(5)</enum><header>Standards</header><text>Subchapter H of chapter V, as added by section 202, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H498DE12F358E4653940323F094FE1398" style="OLC"> 
<section id="H2E473F58F30E4E7D8D17B7F15AA9F9CB"><enum>583.</enum><header>National standards for prescription drug wholesale distributors</header> 
<subsection commented="no" id="HD22750BE5D4F46269BDE8C26A7362BB2"><enum>(a)</enum><header>In general</header><text>The Secretary shall, not later than 2 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, establish by regulation standards for the licensing of persons under section 503(e)(1) (as amended by the <short-title>Drug Supply Chain Security Act</short-title>), including the revocation, reissuance, and renewal of such license.</text></subsection> 
<subsection id="H071A90D48EFC4EBBB25D69453FAE1FD6"><enum>(b)</enum><header>Content</header><text>For the purpose of ensuring uniformity with respect to standards set forth in this section, the standards established under subsection (a) shall apply to all State and Federal licenses described under section 503(e)(1) (as amended by the <short-title>Drug Supply Chain Security Act</short-title>) and shall include standards for the following:</text> 
<paragraph id="HA94556BAD9EE4AF2939DBBB840D3B0FF"><enum>(1)</enum><text>The storage and handling of prescription drugs, including facility requirements.</text></paragraph> 
<paragraph id="H0254426AC58D42128A63A9039C3F72B6"><enum>(2)</enum><text>The establishment and maintenance of records of the distributions of such drugs.</text></paragraph> 
<paragraph id="H4370BCC982B84D35955F19E6A8665FA5"><enum>(3)</enum><text>The furnishing of a bond or other equivalent means of security, as follows:</text> 
<subparagraph id="H5B9A0FB5B6434620BA1BA36037A30392"><enum>(A)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="HB529DBEA2B4F4229B47A3D70A1D1E9CA"><enum>(i)</enum><text>For the issuance or renewal of a wholesale distributor license, an applicant that is not a government owned and operated wholesale distributor shall submit a surety bond of $100,000 or other equivalent means of security acceptable to the State.</text></clause> 
<clause id="H2F723B4F76654C3BA6E7943C4B926888" indent="up1"><enum>(ii)</enum><text>For purposes of clause (i), the State or other applicable authority may accept a surety bond in the amount of $25,000 if the annual gross receipts of the previous tax year for the wholesaler is $10,000,000 or less.</text></clause></subparagraph> 
<subparagraph id="H7CB70748A74548C6A4CC188E54AE8476"><enum>(B)</enum><text>If a wholesale distributor can provide evidence that it possesses the required bond in a State, the requirement for a bond in another State shall be waived.</text></subparagraph></paragraph> 
<paragraph id="H879711CD950B41D189296EC91916DCBC"><enum>(4)</enum><text>Mandatory background checks and fingerprinting of facility managers or designated representatives.</text></paragraph> 
<paragraph id="H908E9F6C2894434BBEAD3712367D13B5"><enum>(5)</enum><text>The establishment and implementation of qualifications for key personnel.</text></paragraph> 
<paragraph id="H8ECE0BD9AB504560A183350E7E7C665A"><enum>(6)</enum><text>The mandatory physical inspection of any facility to be used in wholesale distribution within a reasonable time frame from the initial application of the facility and to be conducted by the licensing authority or by the State, consistent with subsection (c).</text></paragraph> 
<paragraph id="H1BE9568FAEA4482396DD0BF8FE262822"><enum>(7)</enum><text>In accordance with subsection (d), the prohibition of certain persons from receiving or maintaining licensure for wholesale distribution.</text></paragraph></subsection> 
<subsection id="H51D8B11E542F44558C1FD310C8F69B03"><enum>(c)</enum><header>Inspections</header><text>To satisfy the inspection requirement under subsection (b)(6), the Federal or State licensing authority may conduct the inspection or may accept an inspection by the State in which the facility is located, or by a third-party accreditation or inspection service approved by the Secretary or the State licensing such wholesale distributor.</text></subsection> 
<subsection id="H971FBFB9579A467FB85B21F2DB301AE6"><enum>(d)</enum><header>Prohibited persons</header><text>The standards established under subsection (a) shall include requirements to prohibit a person from receiving or maintaining licensure for wholesale distribution if the person—</text> 
<paragraph id="HAA99D6CA761D44C9868F7AD1501A0926"><enum>(1)</enum><text>has been convicted of any felony for conduct relating to wholesale distribution, any felony violation of subsection (i) or (k) of section 301, or any felony violation of <external-xref legal-doc="usc" parsable-cite="usc/18/1365">section 1365</external-xref> of title 18, United States Code, relating to product tampering; or</text></paragraph> 
<paragraph id="H6DB52040CE544036BD7729504EB38199"><enum>(2)</enum><text>has engaged in a pattern of violating the requirements of this section, or State requirements for licensure, that presents a threat of serious adverse health consequences or death to humans.</text></paragraph></subsection> 
<subsection id="H9EB0E00391C5404A83E52B434C6C5985"><enum>(e)</enum><header>Requirements</header><text>The Secretary, in promulgating any regulation pursuant to this section, shall, notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code—</text> 
<paragraph id="HCCFE72757C22467091A676E3E1F81056"><enum>(1)</enum><text>issue a notice of proposed rulemaking that includes a copy of the proposed regulation;</text></paragraph> 
<paragraph id="H0B0C840051EA4927BD89417F5260A137"><enum>(2)</enum><text>provide a period of not less than 60 days for comments on the proposed regulation; and</text></paragraph> 
<paragraph id="HB6331C12BA7F430D90A759F816F8633F"><enum>(3)</enum><text>provide that the final regulation take effect on the date that is 2 years after the date such final regulation is published.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H088FE53B60584B2298A27EB83D7867A9"><enum>(b)</enum><header>Authorized distributors of record</header><text>Section 503(d) (<external-xref legal-doc="usc" parsable-cite="usc/21/353">21 U.S.C. 353(d)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H32DC2420BC2B4073A9E2771B325C5239" style="OLC"> 
<paragraph id="HE65DA625386245F6AB9BE8F422502881"><enum>(4)</enum><text>In this subsection, the term <term>authorized distributors of record</term> means those distributors with whom a manufacturer has established an ongoing relationship to distribute such manufacturer's products.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4D2D767E838145E4B7E0ED96857081B8"><enum>(c)</enum><header>Effective date</header><text>The amendments made by subsections (a) and (b) shall take effect on January 1, 2015.</text></subsection></section> 
<section id="HC2B62CA0FD1B42E3916F56F38785713F"><enum>205.</enum><header>National standards for third-party logistics providers; uniform national policy</header><text display-inline="no-display-inline">Subchapter H of chapter V, as amended by section 204, is further amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H776A6E672F06425091B0BB6B105616C9" style="OLC"> 
<section id="H745A0CEAAF3B4952B906CA0E52C2FC6E"><enum>584.</enum><header>National standards for third-party logistics providers</header> 
<subsection id="HC1DB359FAEEA44D1A4328323E723A64C"><enum>(a)</enum><header>Requirements</header><text>No third-party logistics provider in any State may conduct activities in any State unless each facility of such third-party logistics provider—</text> 
<paragraph id="HDD6A4F91B5F6463FA305FEB7F553E47A"><enum>(1)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HDAFBE2F9BFEF48008D4A97733E8D1EF1"><enum>(A)</enum><text>is licensed by the State from which the drug is distributed by the third-party logistics provider, in accordance with the regulations promulgated under subsection (d); or</text></subparagraph> 
<subparagraph id="HD3CA553C18DA44AA8411575537A40D74" indent="up1"><enum>(B)</enum><text>if the State from which the drug distributed by the third-party logistics provider has not established a licensure requirement, is licensed by the Secretary, in accordance with the regulations promulgated under subsection (d); and</text></subparagraph></paragraph> 
<paragraph id="H6C632B5FF96944C499549677079B9F2A"><enum>(2)</enum><text>if the drug is distributed interstate, is licensed by the State into which the drug is distributed by the third-party logistics provider if such State licenses third-party logistics providers that distribute drugs into the State and the third-party logistics provider is not licensed by the Secretary as described in paragraph (1)(B).</text></paragraph></subsection> 
<subsection id="H028C169179784C2DBD737336EF29367D"><enum>(b)</enum><header>Reporting</header><text>Beginning 1 year after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, a facility of a third-party logistics provider shall report to the Secretary, on an annual basis pursuant to a schedule determined by the Secretary—</text> 
<paragraph id="H44B3D5C02DE24A19ADE588921275FBB0"><enum>(1)</enum><text>the State by which the facility is licensed and the appropriate identification number of such license; and</text></paragraph> 
<paragraph id="H691750A209E74C5C9DBBCD84273ECBB3"><enum>(2)</enum><text>the name and address of the facility and all trade names under which such facility conducts business.</text></paragraph></subsection> 
<subsection id="H9B700010CE0F4096B58FECBA12CF2D1F"><enum>(c)</enum><header>Costs</header>

<paragraph id="H342842168E604863B5DEB44C622B40D1"><enum>(2)</enum><header>State licensing fees</header> 
<subparagraph id="HE6C24B89DD804AF285DDD6708C7B05AC"><enum>(A)</enum><header>State established program</header><text>Nothing in this Act shall prohibit a State that has established a program to license a third-party logistics provider from collecting fees from a third-party logistics provider for such a license.</text></subparagraph> 
<subparagraph id="HB072524DCBEB4D498868F6DE5EB136D6"><enum>(B)</enum><header>No State established program</header><text>A State that does not establish a program to license a third-party logistics provider in accordance with this section shall be prohibited from collecting a State licensing fee from a third-party logistics provider.</text></subparagraph></paragraph></subsection> 
<subsection id="HD747263A49E844AA8DDD207DFB851B5B"><enum>(d)</enum><header>Regulations</header> 
<paragraph id="H3F0F78BFE28C463782975BE1F6EDC0D4"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, the Secretary shall issue regulations regarding the standards for licensing under subsection (a), including the revocation and reissuance of such license, to third-party logistics providers under this section.</text></paragraph> 
<paragraph id="H90EA92CBD9F442858A3735B6B3A1BE18"><enum>(2)</enum><header>Content</header><text>Such regulations shall—</text> 
<subparagraph id="H395C2E11DE504D52A2DD1705E64ADC02"><enum>(A)</enum><text>establish a process by which a third-party accreditation program approved by the Secretary shall, upon request by a third-party logistics provider, issue a license to each third-party logistics provider that meets the requirements set forth in this section;</text></subparagraph> 
<subparagraph id="H1E2B1DC76AF946AB9A2481B80A31E97D"><enum>(B)</enum><text>establish a process by which the Secretary shall issue a license to each third-party logistics provider that meets the requirements set forth in this section if the Secretary is not able to approve a third-party accreditation program because no such program meets the Secretary’s requirements necessary for approval of such a third-party accreditation program;</text></subparagraph> 
<subparagraph id="HDF46A423C89740EDACB5AA6963966E17"><enum>(C)</enum><text>require that the entity complies with storage practices, as determined by the Secretary for such facility, including—</text> 
<clause id="H2F43A255760E496C919970C6BFEFD9A6"><enum>(i)</enum><text>maintaining access to warehouse space of suitable size to facilitate safe operations, including a suitable area to quarantine suspect product;</text></clause> 
<clause id="HF93D9DD984AA4B80AF3BE78A859545D9"><enum>(ii)</enum><text>maintaining adequate security; and</text></clause> 
<clause id="H4C0D0A8CCDDF4290AD0C762349EE2435"><enum>(iii)</enum><text>having written policies and procedures to—</text> 
<subclause id="H2CD85F6D4E324D16B49CE7C1F2642CAB"><enum>(I)</enum><text>address receipt, security, storage, inventory, shipment, and distribution of a product;</text></subclause> 
<subclause id="HE50CEBA0EDAF42DC9A9D4833CF087521"><enum>(II)</enum><text>identify, record, and report confirmed losses or thefts in the United States;</text></subclause> 
<subclause id="HE4220BDA38BF4ACE90E01F8C742BD5B0"><enum>(III)</enum><text>correct errors and inaccuracies in inventories;</text></subclause> 
<subclause id="HE161C057ACD24BB18832CDC362B2FFAD"><enum>(IV)</enum><text>provide support for manufacturer recalls;</text></subclause> 
<subclause id="H67C6FC45547D4F9B87F3DDEBB7D4C278"><enum>(V)</enum><text>prepare for, protect against, and address any reasonably foreseeable crisis that affects security or operation at the facility, such as a strike, fire, or flood;</text></subclause> 
<subclause id="HF65B6A26C2B64EDB8644667AFCB37A1C"><enum>(VI)</enum><text>ensure that any expired product is segregated from other products and returned to the manufacturer or repackager or destroyed;</text></subclause> 
<subclause id="HAB57B60AD3A24414ACBFED7B90EE45FD"><enum>(VII)</enum><text>maintain the capability to trace the receipt and outbound distribution of a product, and supplies and records of inventory; and</text></subclause> 
<subclause id="H7F6873CB771A46A989BF82BD41D8507C"><enum>(VIII)</enum><text>quarantine or destroy a suspect product if directed to do so by the respective manufacturer, wholesale distributor, dispenser, or an authorized government agency;</text></subclause></clause></subparagraph> 
<subparagraph id="HE9C8FE6C135941449EE918FF45CBFB89"><enum>(D)</enum><text>provide for periodic inspection by the licensing authority, as determined by the Secretary, of such facility warehouse space to ensure compliance with this section;</text></subparagraph> 
<subparagraph id="H3B81D99065BC484DB67B5FB3CBEBB322"><enum>(E)</enum><text>prohibit a facility from having as a manager or designated representative anyone convicted of any felony violation of subsection (i) or (k) of section 301 or any violation of <external-xref legal-doc="usc" parsable-cite="usc/18/1365">section 1365</external-xref> of title 18, United States Code relating to product tampering;</text></subparagraph> 
<subparagraph id="H7ED18A3F62DD46CA864578A916DBB633"><enum>(F)</enum><text>provide for mandatory background checks of a facility manager or a designated representative of such manager;</text></subparagraph> 
<subparagraph id="H9FFC8181E35C467FBFC64019510BD1F8"><enum>(G)</enum><text>require a third-party logistics provider to provide the applicable licensing authority, upon a request by such authority, a list of all product manufacturers, wholesale distributors, and dispensers for whom the third-party logistics provider provides services at such facility; and</text></subparagraph> 
<subparagraph id="H97E39D8F37CE44C59CC0FE3C5CB6B374"><enum>(H)</enum><text>include procedures under which any third-party logistics provider license—</text> 
<clause id="H5879AB2F83284C6AAB7C01058804A2D2"><enum>(i)</enum><text>expires on the date that is 3 years after issuance of the license; and</text></clause> 
<clause id="H5290857DA1084AC58719B89C404C4C15"><enum>(ii)</enum><text>may be renewed for additional 3-year periods.</text></clause></subparagraph></paragraph> 
<paragraph id="H02E84DD0EA0649FE814F7EF98DD48A19"><enum>(3)</enum><header>Procedure</header><text>In promulgating the regulations under this subsection, the Secretary shall, notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code—</text> 
<subparagraph id="HCDC598D8DCF742358B89E4C6E38B3918"><enum>(A)</enum><text>issue a notice of proposed rulemaking that includes a copy of the proposed regulation;</text></subparagraph> 
<subparagraph id="H25538D28E50B4D959ED535356D97D1A6"><enum>(B)</enum><text>provide a period of not less than 60 days for comments on the proposed regulation; and</text></subparagraph> 
<subparagraph id="HD3DA8C8AF0434DCA8E5D97B85F7AEEE6"><enum>(C)</enum><text>provide that the final regulation takes effect upon the expiration of 1 year after the date that such final regulation is issued.</text></subparagraph></paragraph></subsection> 
<subsection id="H4B5B7296C6FB4A7BAB65DA277B4BDC2C"><enum>(e)</enum><header>Validity</header><text>A license issued under this section shall remain valid as long as such third-party logistics provider remains licensed consistent with this section. If the Secretary finds that the third-party accreditation program demonstrates that all applicable requirements for licensure under this section are met, the Secretary shall issue a license under this section to a third-party logistics provider receiving accreditation, pursuant to subsection (d)(2)(A).</text></subsection></section> 
<section id="HA3B9383773E34B12BE6D4D896599069F"><enum>585.</enum><header>Uniform national policy</header> 
<subsection id="H1F042E8E63BC4535A2D4C57D30993AD4"><enum>(a)</enum><header>Product tracing and other requirements</header><text>Beginning on the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, no State or political subdivision of a State may establish or continue in effect any requirements for tracing products through the distribution system (including any requirements with respect to statements of distribution history, transaction history, transaction information, or transaction statement of a product as such product changes ownership in the supply chain, or verification, investigation, disposition, notification, or recordkeeping relating to such systems, including paper or electronic pedigree systems or for tracking and tracing drugs throughout the distribution system) which are inconsistent with, more stringent than, or in addition to, any requirements applicable under section 503(e) (as amended by such Act) or this subchapter (or regulations issued thereunder), or which are inconsistent with—</text> 
<paragraph id="HF32958740E124743884B2B448A34EE49"><enum>(1)</enum><text>any waiver, exception, or exemption pursuant to section 581 or 582; or</text></paragraph> 
<paragraph id="HC36C175EBE954D2D8A0C30439D6A29E5"><enum>(2)</enum><text>any restrictions specified in section 582.</text></paragraph></subsection> 
<subsection id="H81C4047174D945AC896EEB9BFFB741AE"><enum>(b)</enum><header>Wholesale Distributor and Third-Party Logistics Provider standards</header> 
<paragraph commented="no" id="HE2347A4ABE364881A968D9FA76C726B4"><enum>(1)</enum><header>In general</header><text>Beginning on the date of enactment of the <short-title>Drug Supply Chain Security Act</short-title>, no State or political subdivision of a State may establish or continue any standards, requirements, or regulations with respect to wholesale prescription drug distributor or third-party logistics provider licensure that are inconsistent with, less stringent than, directly related to, or covered by the standards and requirements applicable under section 503(e) (as amended by such Act), in the case of a wholesale distributor, or section 584, in the case of a third-party logistics provider.</text></paragraph> 
<paragraph commented="no" id="H2C077C0C08354CA5A284FB7E4AF94C19"><enum>(2)</enum><header>State regulation of third-party logistics providers</header><text>No State shall regulate third-party logistics providers as wholesale distributors.</text></paragraph> 
<paragraph id="H0B662B7334D9472B888BA9E8F22A15A2"><enum>(3)</enum><header>Administration fees</header><text>Notwithstanding paragraph (1), a State may administer fee collections for effectuating the wholesale drug distributor and third-party logistics provider licensure requirements under sections 503(e) (as amended by the <short-title>Drug Supply Chain Security Act</short-title>), 583, and 584.</text></paragraph> 
<paragraph id="HB0727B1A7AEE4D41B4116BBD9F9D039A"><enum>(4)</enum><header>Enforcement, suspension, and revocation</header><text>Notwithstanding paragraph (1), a State—</text> 
<subparagraph id="H846B2F5326A44B8EA98AE2DBFE0E8D58"><enum>(A)</enum><text>may take administrative action, including fines, to enforce a requirement promulgated by the State in accordance with section 503(e) (as amended by the <short-title>Drug Supply Chain Security Act</short-title>) or this subchapter;</text></subparagraph> 
<subparagraph id="H3B8D54E36B2A4463BBC25ECB2390C64E"><enum>(B)</enum><text>may provide for the suspension or revocation of licenses issued by the State for violations of the laws of such State;</text></subparagraph> 
<subparagraph id="H7C09B00942BE445981CDBDEB936761D2"><enum>(C)</enum><text>upon conviction of violations of Federal, State, or local drug laws or regulations, may provide for fines, imprisonment, or civil penalties; and</text></subparagraph> 
<subparagraph commented="no" id="HE2942317A1D347299EF565A9C181E3D4"><enum>(D)</enum><text>may regulate activities of licensed entities in a manner that is consistent with product tracing requirements under section 582.</text></subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H6BD9FC5E6CAF4EF7BDD0B8E2E81FA4B0"><enum>(c)</enum><header>Exception</header><text>Nothing in this section shall be construed to preempt State requirements related to the distribution of prescription drugs if such requirements are not related to product tracing as described in subsection (a) or wholesale distributor and third-party logistics provider licensure as described in subsection (b) applicable under section 503(e) (as amended by the <short-title>Drug Supply Chain Security Act</short-title>) or this subchapter (or regulations issued thereunder).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H3246153B182E440F8F98CCB4C2375B9A"><enum>206.</enum><header>Penalties</header> 
<subsection id="HC58E19E3A4164D8EA2C8536DD97F435C"><enum>(a)</enum><header>Prohibited act</header><text>Section 301(t) (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331(t)</external-xref>), is amended—</text> 
<paragraph id="H20CCE4DF460B4837BAD9EBCFDF2AD8A6"><enum>(1)</enum><text>by striking <quote>or</quote> after <quote>the requirements of section 503(d),</quote>; and</text></paragraph> 
<paragraph id="H29464C3329E340FE8B49E48BD9241167"><enum>(2)</enum><text>by inserting <quote>, failure to comply with the requirements under section 582, the failure to comply with the requirements under section 584, as applicable,</quote> after <quote>in violation of section 503(e)</quote>.</text></paragraph></subsection> 
<subsection id="H74B2AF22596F40C0BCB5680F41AE4840"><enum>(b)</enum><header>Misbranding</header><text>Section 502 (<external-xref legal-doc="usc" parsable-cite="usc/21/352">21 U.S.C. 352</external-xref>), as amended by section 103, is further amended by adding at the end the following:</text>

<section id="HE0140C9DDBE04F23A4A8361C85788E6F"><enum>207.</enum><header>Conforming amendment</header> 
<subsection id="H990C8C8CB40941C68C95FC260AF50879"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 303(b)(1)(D) (<external-xref legal-doc="usc" parsable-cite="usc/21/333">21 U.S.C. 333(b)(1)(D)</external-xref>) is amended by striking <quote>503(e)(2)(A)</quote> and inserting <quote>503(e)(1)</quote>.</text></subsection> 
<subsection id="H686C53F0F70E43BFACE0D93FBD179F70"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on January 1, 2015.</text></subsection></section> 
<section id="HC717A1C345EB4AF9984110611CA3B195"><enum>208.</enum><header>Savings clause</header><text display-inline="no-display-inline">Except as provided in the amendments made by paragraphs (1), (2), and (3) of section 204(a) and by section 206(a), nothing in this title (including the amendments made by this title) shall be construed as altering any authority of the Secretary of Health and Human Services with respect to a drug subject to section 503(b)(1) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/353">21 U.S.C. 353(b)(1)</external-xref>) under any other provision of such Act or the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/201">42 U.S.C. 201 et seq.</external-xref>).</text></section></title>
