R. 3184</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20130926">September 26, 2013</action-date><action-desc><sponsor name-id="C001077">Mr. Coffman</sponsor> (for himself and <cosponsor name-id="C000754">Mr. Cooper</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for auditable financial statements for the Department of Defense, and for other purposes.</official-title></form><legis-body id="HC05C73A8EB894068A32E0526A1EBF083" style="OLC"><section id="H9063221C15BC4C078BB5E8F222B9F2A7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Audit the Pentagon Act of 2013</short-title></quote>.</text></section><section id="H2933CE371EBC480EA00149CD47D9F27B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="H0F20FED74F8444B99486E77361103E22"><enum>(1)</enum><text>Section 9 of Article I of the Constitution of the United States requires all agencies of the Federal Government, including the Department of Defense, to publish <quote><short-title>a regular statement and account of the receipts and expenditures of all public money</short-title></quote>.</text></paragraph><paragraph id="HC391E2172F8E4BBFA9DC21A3643C1D46"><enum>(2)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/31/3515">Section 3515</external-xref> of title 31, United States Code, requires the agencies of the Federal Government, including the Department of Defense, to present auditable financial statements beginning not later than March 1, 1997. The Department has not complied with this law.</text></paragraph><paragraph id="H421E69BACE294B6B9BC7CE732511F3C8"><enum>(3)</enum><text>The Federal Financial Management Improvement Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/31/3512">31 U.S.C. 3512</external-xref> note) requires financial systems acquired by the Federal Government, including the Department of Defense, to be able to provide information to leaders to manage and control the cost of Government. The Department has not complied with this law.</text></paragraph><paragraph id="H0CF036FCE3FE456E98C219D9192D096E"><enum>(4)</enum><text>The financial management of the Department of Defense has been on the <term>High-Risk</term> list of the Government Accountability Office, which means that the Department is not consistently able to <quote><short-title>control costs; ensure basic accountability; anticipate future costs and claims on the budget; measure performance; maintain funds control; [and] prevent and detect fraud, waste, and abuse</short-title></quote>.</text></paragraph><paragraph id="H0524A37AF357499C804FB7F2FBC94DE3"><enum>(5)</enum><text>The National Defense Authorization Act for Fiscal Year 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/107">Public Law 107–107</external-xref>) requires the Secretary of Defense to report to Congress annually on the reliability of the financial statements of the Department of Defense, to minimize resources spent on producing unreliable financial statements, and to use resources saved to improve financial management policies, procedures, and internal controls.</text></paragraph><paragraph id="HD62DDAF0E9974BAAA74F2552D0417A84"><enum>(6)</enum><text>In 2005, the Department of Defense created a Financial Improvement and Audit Readiness (FIAR) Plan, overseen by a directorate within the office of the Under Secretary of Defense (Comptroller), to improve Department business processes with the goal of producing timely, reliable, and accurate financial information that could generate an audit-ready annual financial statement. In December 2005, that directorate, known as the FIAR Directorate, issued the first of a series of semiannual reports on the status of the Financial Improvement and Audit Readiness Plan.</text></paragraph><paragraph id="HCCBF863630E4401C9E63D6C675B21D2C"><enum>(7)</enum><text>The National Defense Authorization Act for Fiscal Year 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/84">Public Law 111–84</external-xref>) requires regular status reports on the Financial Improvement and Audit Readiness Plan described in paragraph (6), and codified as a statutory requirement the goal of the Plan in ensuring that Department of Defense financial statements are validated as ready for audit not later than September 30, 2017. In addition, the National Defense Authorization Act for Fiscal Year 2013 (<external-xref legal-doc="public-law" parsable-cite="pl/112/239">Public Law 112–239</external-xref>) requires that the statement of budgetary resources of the Department of Defense be validated as ready for audit by not later than September 30, 2014.</text></paragraph><paragraph id="H56CD614409B14072A12B4E31970C843A"><enum>(8)</enum><text>At a September 2010 hearing of the Senate, the Government Accountability Office stated that past expenditures by the Department of Defense of $5,800,000,000 to improve financial information, and billions of dollars more of anticipated expenditures on new information technology systems for that purpose, may not suffice to achieve full audit readiness of the financial statements of the Department. At that hearing, the Government Accountability Office could not predict when the Department would achieve full audit readiness of such statements.</text></paragraph></section><section id="HBD58CB89835C49C9ACA52AB89A12541C"><enum>3.</enum><header>Cessation of applicability of reporting requirements regarding the financial statements of the Department of Defense</header><subsection id="HD05B241800084E0B992F0721E6D800CC"><enum>(a)</enum><header>Cessation of applicability</header><paragraph id="H0430BFC4419C46A89A939242CF1ED432"><enum>(1)</enum><header>Military departments</header><text>The financial statements of a military department shall cease to be covered by the reporting requirements specified in subsection (b) upon the issuance of an unqualified audit opinion on such financial statements.</text></paragraph><paragraph id="H80A3DC53DC764C209E2B029A9BE5EB53"><enum>(2)</enum><header>Department of Defense</header><text>The reporting requirements specified in subsection (b) shall cease to be effective when an unqualified audit opinion is issued on the financial statements of the Department of Defense, including each of the military departments and the other reporting entities defined by the Office of Management and Budget.</text></paragraph></subsection><subsection id="HD9B2C14BA51D481697FFCB454BBAF1CF"><enum>(b)</enum><header>Reporting requirements</header><text>The reporting requirements specified in this subsection are the following:</text><paragraph id="H76BEA748BE4F429C8563DEC794AFF7D2"><enum>(1)</enum><text>The requirement for annual reports in section 892(b) of the Ike Skelton National Defense Authorization Act for Fiscal Year 2011 (<external-xref legal-doc="public-law" parsable-cite="pl/111/383">Public Law 111–383</external-xref>; 124 Stat. 4311; <external-xref legal-doc="usc" parsable-cite="usc/10/2306a">10 U.S.C. 2306a</external-xref> note).</text></paragraph><paragraph id="H31AA6C5168954CCCBF9BDA25A396BAE9"><enum>(2)</enum><text>The requirement for semi-annual reports in section 1003(b) of the National Defense Authorization Act for Fiscal Year 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/84">Public Law 111–84</external-xref>; 123 Stat. 2440; <external-xref legal-doc="usc" parsable-cite="usc/10/2222">10 U.S.C. 2222</external-xref> note).</text></paragraph><paragraph id="H07D0B103F1074BC4B33CF65603B34438"><enum>(3)</enum><text>The requirement for annual reports in section 817(d) of the Bob Stump National Defense Authorization Act for Fiscal Year 2003 (<external-xref legal-doc="usc" parsable-cite="usc/10/2306a">10 U.S.C. 2306a</external-xref> note).</text></paragraph><paragraph id="H9E0236413CD848AB825478D3079C5030"><enum>(4)</enum><text>The requirement for annual reports in section 1008(a) of the National Defense Authorization Act for Fiscal Year 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/107">Public Law 107–107</external-xref>; 115 Stat. 1204; <external-xref legal-doc="usc" parsable-cite="usc/10/113">10 U.S.C. 113</external-xref> note).</text></paragraph><paragraph id="H7850EEF0473D4FAA9ED411EB66B8F08C"><enum>(5)</enum><text>The requirement for periodic reports in section 908(b) of the Defense Acquisition Improvement Act of 1986 (<external-xref legal-doc="public-law" parsable-cite="pl/99/500">Public Law 99–500</external-xref>; 100 Stat. 1783–140; <external-xref legal-doc="usc" parsable-cite="usc/10/2326">10 U.S.C. 2326</external-xref> note) and duplicate requirements as provided for in section 6 of the Defense Technical Corrections Act of 1987 (<external-xref legal-doc="public-law" parsable-cite="pl/100/26">Public Law 100–26</external-xref>; 101 Stat. 274; <external-xref legal-doc="usc" parsable-cite="usc/10/2302">10 U.S.C. 2302</external-xref> note).</text></paragraph></subsection></section><section id="H09922A572A3246A59CA86109389B091A"><enum>4.</enum><header>Enhanced reprogramming authority following achievement by Department of Defense and military departments of audit with unqualified opinion of statement of budgetary resources for fiscal years after fiscal year 2014</header><subsection id="H553728C340644A319169CC49336DFA94"><enum>(a)</enum><header>Department of Defense generally</header><text>Subject to section 6(1), if the Department of Defense obtains an audit with an unqualified opinion on its statement of budgetary resources for any fiscal year after fiscal year 2014, the limitation on the total amount of authorizations that the Secretary of Defense may transfer pursuant to general transfer authority available to the Secretary in the national interest in the succeeding fiscal year shall be $8,000,000,000.</text></subsection><subsection id="H13ED4FE24A9842C782131ADDF03D525D"><enum>(b)</enum><header>Military departments, Defense Agencies, and defense field activities</header><text>Subject to section 7(a), if a military department, Defense Agency, or defense field activity obtains an audit with an unqualified opinion on its statement of budgetary resources for any fiscal year after fiscal year 2014, the thresholds for reprogramming of funds of such military department, Defense Agency, or defense field activity, as the case may be, without prior notice to Congress for the succeeding fiscal year shall be deemed to be the thresholds as follows:</text><paragraph id="H2DA28129DA274D0CBD060B9454F33285"><enum>(1)</enum><text>In the case of an increase or decrease to the program base amount for a procurement program, $60,000,000.</text></paragraph><paragraph id="H0D7E219464784A9BADF76BB7438CCBDE"><enum>(2)</enum><text>In the case of an increase or decrease to the program base amount for a research program, $30,000,000.</text></paragraph><paragraph id="H9F2FBA2F2A0349ADA3D09CB135BBCA80"><enum>(3)</enum><text>In the case of an increase or decrease to the amount for a budget activity for operation and maintenance, $45,000,000.</text></paragraph><paragraph id="H84E54E634FC2457B98234C09537675CE"><enum>(4)</enum><text>In the case of an increase or decrease to the amount for a budget activity for military personnel, $30,000,000.</text></paragraph></subsection><subsection id="H5487305C273D474AAC5D88DCF25E3414"><enum>(c)</enum><header>Construction</header><text>Nothing in this section shall be construed to alter or revise any requirement (other than a threshold amount) for notice to Congress on transfers covered by subsection (a) or reprogrammings covered by subsection (b) under any other provision of law.</text></subsection><subsection id="HFD0C1956C85A4F82B880FDC8BF93D1E9"><enum>(d)</enum><header>Definitions</header><text>In this section, the terms <term>program base amount</term>, <term>procurement program</term>, <term>research program</term>, and <term>budget activity</term> have the meanings given such terms in chapter 6 of volume 3 of the Financial Management Regulation of the Department of Defense (DoD 7000.14R), dated March 2011, or any successor document.</text></subsection></section><section id="H4B3429F24C6C484F9AA1096C0A98D337"><enum>5.</enum><header>Failure to obtain audits with unqualified opinion of fiscal year 2015 general fund statement of budgetary resources of the Department of Defense</header><subsection id="H4EDED016AE024BD782CF24D015086ED0"><enum>(a)</enum><header>In general</header><text>If the Department of Defense fails to obtain an audit with an unqualified opinion on its general fund statement of budgetary resources for fiscal year 2015 by December 31, 2015, the following shall take effect on January 1, 2016:</text><paragraph id="H9ADF462341794B29B65381CDD2F8E343"><enum>(1)</enum><header>Additional qualifications and duties of USD (Comptroller)</header><subparagraph id="HF2A540C860A24AE3BAF9C56456990468"><enum>(A)</enum><header>Qualifications</header><text>Any individual nominated for appointment to the position of Under Secretary of Defense (Comptroller) under <external-xref legal-doc="usc" parsable-cite="usc/10/135">section 135</external-xref> of title 10, United States Code, shall be an individual who has served—</text><clause id="H6D83560BC5D54B9AB519E31CC21125B7"><enum>(i)</enum><text>as the chief financial officer of a Federal or State agency that has received an audit with an unqualified opinion on such agency's financial statements during the time of such individual's service; or</text></clause><clause id="HF6AA74FF80CA45AEB8B002744FC5DF6E"><enum>(ii)</enum><text>as the chief financial officer of a public company that has received an audit with an unqualified opinion on such company's financial statements during the time of such individual's service.</text></clause></subparagraph><subparagraph id="H824F964004B7430BB113AA8D89319124"><enum>(B)</enum><header>Duties and powers</header><text>The duties and powers of the individual serving as Under Secretary of Defense (Comptroller) shall include, in addition to the duties and powers specified in <external-xref legal-doc="usc" parsable-cite="usc/10/135">section 135(c)</external-xref> of title 10, United States Code, such duties and powers with respect to the financial management of the Department of Defense as the Deputy Secretary of Defense (acting in the capacity of Chief Management Officer of the Department of Defense) or a successor official in the Department of Defense (acting in such capacity) may prescribe.</text></subparagraph></paragraph><paragraph id="HD53709D363D846CFAAB7B8B365912051"><enum>(2)</enum><header>Additional qualifications and responsibilities of ASA for Financial Management</header><subparagraph id="H152D70CA7E6742069356D55D6F9FE73C"><enum>(A)</enum><header>Qualifications</header><text>Any individual nominated for appointment to the position of Assistant Secretary of the Army for Financial Management under <external-xref legal-doc="usc" parsable-cite="usc/10/3016">section 3016</external-xref> of title 10, United States Code, shall be an individual who has served—</text><clause id="HF896C610127541B0AA6A44DFE53F5A76"><enum>(i)</enum><text>as the chief financial officer of a Federal or State agency that has received an audit with an unqualified opinion on such agency's financial statements during the time of such individual's service; or</text></clause><clause id="H91B06DC6E679421EA77F231F4DF39DE7"><enum>(ii)</enum><text>as the chief financial officer of a public company that has received an audit with an unqualified opinion on such company's financial statements during the time of such individual's service.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFD793F6792D6445A95B5BDCE0469968A"><enum>(B)</enum><header>Responsibilities</header><text>The responsibilities of the individual serving as Assistant Secretary of the Army for Financial Management shall include, in addition to the responsibilities specified in <external-xref legal-doc="usc" parsable-cite="usc/10/3016">section 3016(b)(4)</external-xref> of title 10, United States Code, such responsibilities as the Deputy Secretary of Defense (acting in the capacity of Chief Management Officer of the Department of Defense) or a successor official in the Department of Defense (acting in such capacity) may prescribe.</text></subparagraph></paragraph><paragraph id="H71AC51C1969E4E06ADC1C4CAD29DC9B7"><enum>(3)</enum><header>Additional qualifications and responsibilities of ASN for Financial Management</header><subparagraph id="H4FE09417A5A04A57A0CCBBBCECC6940D"><enum>(A)</enum><header>Qualifications</header><text>Any individual nominated for appointment to the position of Assistant Secretary of the Navy for Financial Management under <external-xref legal-doc="usc" parsable-cite="usc/10/5016">section 5016</external-xref> of title 10, United States Code, shall be an individual who has served—</text><clause id="HCDE6A79C56A4416383714B0809D67E7B"><enum>(i)</enum><text>as the chief financial officer of a Federal or State agency that has received an audit with an unqualified opinion on such agency's financial statements during the time of such individual's service; or</text></clause><clause id="H944358354E9E4F9B854B030D1764704E"><enum>(ii)</enum><text>as the chief financial officer of a public company that has received an audit with an unqualified opinion on such company's financial statements during the time of such individual's service.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3ED91530570D4F4E855438243F285C63"><enum>(B)</enum><header>Responsibilities</header><text>The responsibilities of the individual serving as Assistant Secretary of the Navy for Financial Management shall include, in addition to the responsibilities specified in <external-xref legal-doc="usc" parsable-cite="usc/10/5016">section 5016(b)(3)</external-xref> of title 10, United States Code, such responsibilities as the Deputy Secretary of Defense (acting in the capacity of Chief Management Officer of the Department of Defense) or a successor official in the Department of Defense (acting in such capacity) may prescribe.</text></subparagraph></paragraph><paragraph id="HA5BE71111C3F4C2DB00B3F39CD412665"><enum>(4)</enum><header>Additional qualifications and responsibilities of ASAF for Financial Management</header><subparagraph id="HA464B21624AC43C48C5D9E557BC897FD"><enum>(A)</enum><header>Qualifications</header><text>Any individual nominated for appointment to the position of Assistant Secretary of the Air Force for Financial Management under <external-xref legal-doc="usc" parsable-cite="usc/10/8016">section 8016</external-xref> of title 10, United States Code, shall be an individual who has served—</text><clause id="HCFA6B70F10F14D55AB00B42346EA72A9"><enum>(i)</enum><text>as the chief financial officer of a Federal or State agency that has received an audit with an unqualified opinion on such agency's financial statements during the time of such individual's service; or</text></clause><clause id="HA30CF77CC9E748569E323253AEC290EB"><enum>(ii)</enum><text>as the chief financial officer of a public company that has received an audit with an unqualified opinion on such company's financial statements during the time of such individual's service.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC3EB3BCCA85748739AF1F2F631DDA1F6"><enum>(B)</enum><header>Responsibilities</header><text>The responsibilities of the individual serving as Assistant Secretary of the Air Force for Financial Management shall include, in addition to the responsibilities specified in <external-xref legal-doc="usc" parsable-cite="usc/10/8016">section 8016(b)(3)</external-xref> of title 10, United States Code, such responsibilities as the Deputy Secretary of Defense (acting in the capacity of Chief Management Officer of the Department of Defense) or a successor official in the Department of Defense (acting in such capacity) may prescribe.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9064EE040109402FA10927A225A2FF33"><enum>(b)</enum><header>Public company defined</header><text>In this section, the term <term>public company</term> has the meaning given the term <term>issuer</term> in section 2(a)(7) of the Sarbanes-Oxley Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/7201">15 U.S.C. 7201(7)</external-xref>).</text></subsection></section><section commented="no" display-inline="no-display-inline" id="HF7ADFFCDF4A94CDEB3A988FD38306BFC"><enum>6.</enum><header>Failure of the Department of Defense to obtain audits with unqualified opinion of fiscal year 2018 financial statements</header><text display-inline="no-display-inline">If the Department of Defense fails to obtain an audit with an unqualified opinion on its general fund statement of budgetary resources for fiscal year 2018 by December 31, 2018:</text><paragraph commented="no" display-inline="no-display-inline" id="H503ACD84C29342DCA2724CBA609A4626"><enum>(1)</enum><header>Permanent cessation of enhanced general transfer authority</header><text>Effective as of January 1, 2019, the authority in section 4(a) shall cease to be available to the Department of Defense for fiscal year 2018 and any fiscal year thereafter.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7430531A5D4C4B0BB061301C770DE9EB"><enum>(2)</enum><header>Reorganization of responsibilities of chief management officer</header><text>Effective as of April 1, 2019:</text><subparagraph commented="no" display-inline="no-display-inline" id="H166BBE3E6CE545DB93B0C9FEA7D8F72E"><enum>(A)</enum><header>Position of Chief Management Officer</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/132a">Section 132a</external-xref> of title 10, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H7E453D4FA0604995965366F4BF71C526" style="USC"><section commented="no" display-inline="no-display-inline" id="H005C47D243EF46DF9E47B9B0CC25C51F"><enum>132a.</enum><header>Chief Management Officer </header><subsection commented="no" display-inline="no-display-inline" id="H9394B67D52F64DC3AD5CDE9B31DE6C5E"><enum>(a)</enum><header>In general</header><paragraph commented="no" display-inline="yes-display-inline" id="HEA2135B88AE245AB8093F7B9EB3BCD48"><enum>(1)</enum><text>There is a Chief Management Officer of the Department of Defense, appointed from civilian life by the President, by and with the advice and consent of the Senate.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE59CBA6EC50A4778BCFE11B78C01AD52" indent="up1"><enum>(2)</enum><text>Any individual nominated for appointment as Chief Management Officer shall be an individual who has—</text><subparagraph commented="no" display-inline="no-display-inline" id="H2224B6CD93EC4EB58D4D3FC58F752E82"><enum>(A)</enum><text>extensive executive level leadership and management experience in the public or private sector;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7094E135519A4591807FA9E73800FC0D"><enum>(B)</enum><text>strong leadership skills;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC660D759E70F4E37AFE994A071F476E6"><enum>(C)</enum><text>a demonstrated ability to manage large and complex organizations; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF69CF7690B42468B863D8D2F111CB777"><enum>(D)</enum><text>a proven record in achieving positive operational results.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H725C01E3EBEF4A2E9A22F0C425334037"><enum>(b)</enum><header>Powers and duties</header><text>The Chief Management Officer shall perform such duties and exercise such powers as the Secretary of Defense may prescribe.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H7A8D3117FAF74AA78F880EB299A593EB"><enum>(c)</enum><header>Service as Chief Management Officer</header><paragraph commented="no" display-inline="yes-display-inline" id="H2C89A93A34604722B9753E4DADCF3964"><enum>(1)</enum><text>The Chief Management Officer is the Chief Management Officer of the Department of Defense.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9D164A92D71B43EFA20F84E436DAA0EE" indent="up1"><enum>(2)</enum><text>In serving as the Chief Management Officer of the Department of Defense, the Chief Management Officer shall be responsible for the management and administration of the Department of Defense with respect to the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="H2048C09A6B9F4D85A3DCF7F1064A0D3C"><enum>(A)</enum><text>The expenditure of funds, accounting, and finance.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H71768F0A6CB84092875A45453D8FA4D9"><enum>(B)</enum><text>Procurement, including procurement of any enterprise resource planning (ERP) system and any information technology (IT) system that is a financial feeder system, human resources system, or logistics system.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H652C262858684262A669EEF08F851F9B"><enum>(C)</enum><text>Facilities, property, nonmilitary equipment, and other resources.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF4011EFDCAA4410FB5AF35FCF5AFBCD6"><enum>(D)</enum><text>Strategic planning, annual performance planning, and identification and tracking of performance measures.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5C6D75DE1B864B429076D532D31C4DCF"><enum>(E)</enum><text>Internal audits and management analyses of the programs and activities of the Department, including the Defense Contract Audit Agency.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7E635331BEB44477B14BB00ED87795C1"><enum>(F)</enum><text>Such other areas or matters as the Secretary of Defense may designate.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF2076F4D6E4B4BB9AF4E32B7DF954A78" indent="up1"><enum>(3)</enum><text>The head of the Defense Contract Audit Agency shall be under the supervision of, and shall report directly to, the Chief Management Officer.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H44091BF653DC498BB1EAFAA09A16FEAA"><enum>(d)</enum><header>Precedence</header><text>The Chief Management Officer takes precedence in the Department of Defense after the Secretary of Defense and the Deputy Secretary of Defense.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H60175836755846759F793FA152817954"><enum>(B)</enum><header>Conforming amendments</header><clause commented="no" display-inline="no-display-inline" id="HE7BAEC95972F47438098288C26D3EB93"><enum>(i)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/10/131">Section 131(b)</external-xref> of title 10, United States Code, is amended—</text><subclause commented="no" display-inline="no-display-inline" id="HFF012EFACB674D59A922A1E0BE7C5BA1"><enum>(I)</enum><text>by striking paragraph (3);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H994445A082A34C3A9501D71F163CFAB6"><enum>(II)</enum><text>by redesignating paragraph (2) as paragraph (3); Chief Management Officer.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H52E87198D3F94D9EB6776C2069836F6B"><enum>(D)</enum><header>Executive schedule</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/5313">Section 5313</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HE5F31AD469864CC789E32137ECB23CD7" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="H27852BEBD3AB43A197C8A4D3A8537DDF"><enum></enum><text>Chief Management Officer of the Department of Defense.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0028AF04B2FD4676BBE2C383361E374A"><enum>(E)</enum><header>Reference in law</header><text>Any reference in any provision of law to the Chief Management Officer of the Department of Defense shall be deemed to refer to the Chief Management Officer of the Department of Defense under <external-xref legal-doc="usc" parsable-cite="usc/10/132a">section 132a</external-xref> of title 10, United States Code (as amended by this paragraph).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H47FFAE0A38614C6D942D7A5D67280D17"><enum>(3)</enum><header>Jurisdiction of DFAS</header><text>Effective as of April 1, 2019:</text><subparagraph commented="no" display-inline="no-display-inline" id="H83EFB6015CC44C7ABCE371900DC646C5"><enum>(A)</enum><header>Transfer to Department of the Treasury</header><text>Jurisdiction of the Defense Finance and Accounting Service (DFAS) is transferred from the Department of Defense to the Department of the Treasury.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H14A6EA355E8B4D5896930B2A6C2C354D"><enum>(B)</enum><header>Administration</header><text>The Secretary of the Treasury shall administer the Defense Finance and Accounting Service following transfer under this paragraph through the Financial Management Service of the Department of the Treasury.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H10F1176014F848DBB15DCDCE9722DE7A"><enum>(C)</enum><header>Memorandum of understanding</header><text>The Secretary of Defense and the Secretary of the Treasury shall jointly enter into a memorandum of understanding regarding the transfer of jurisdiction of the Defense Finance and Accounting Service under this paragraph. The memorandum of understanding shall provide for the transfer of the personnel and other resources of the Service to the Department of the Treasury and for the assumption of responsibility for such personnel and resources by the Department of the Treasury.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H36595EB79535460DB1F5198D1E185DFB"><enum>(D)</enum><header>Construction</header><text>Nothing in this paragraph shall be construed as terminating, altering, or revising any responsibilities or authorities of the Defense Finance and Accounting Service (other than responsibilities and authorities in connection with the exercise of jurisdiction of the Service following transfer under this paragraph).</text></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="H50A33962C61C4A828A8CB2C57F1FF38D"><enum>7.</enum><header>Failure of the military departments to obtain audits with unqualified opinion of financial statements for fiscal years after fiscal year 2017</header><subsection commented="no" display-inline="no-display-inline" id="HF872A92C4ED44E1090541D1ADC7B8533"><enum>(a)</enum><header>Permanent cessation of authorities on reprogramming of funds</header><text>If a military department fails to obtain an audit with an unqualified opinion on its financial statements for fiscal year 2018 by December 31, 2018, effective as of January 1, 2019, the authorities in section 4(b) shall cease to be available to the military department for fiscal year 2018 and any fiscal year thereafter.</text></subsection><subsection id="HC35E24E5BB3A4DC8B68D0B45959E1169"><enum>(b)</enum><header>Annual prohibition on expenditure of funds for certain MDAPs past Milestone B in connection with failure</header><paragraph id="H663E910118C24825AE5C24D43860C785"><enum>(1)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Effective for fiscal years after fiscal year 2017, if a military department fails to obtain an audit with an unqualified opinion on its financial statements for any fiscal year, effective as of the date of the issuance of the opinion on such audit, amounts available to the military department for the following fiscal year may not be obligated by the military department for a weapon or weapon system or platform being acquired as a major defense acquisition program for any activity beyond Milestone B approval unless such program has already achieved Milestone B approval as of the date of the issuance of the opinion on such audit.</text></paragraph><paragraph id="H21FBD67CBEA444ECBDDC5EC4810AFC8F"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HB419C1DB120544D4B3289F15E2EC8D49"><enum>(A)</enum><text>The term <term>major defense acquisition program</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/10/2430">section 2430</external-xref> of title 10, United States Code.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H375C08766B06434D975019F0252B9F67"><enum>(B)</enum><text>The term <term>Milestone B approval</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/10/2366">section 2366(e)(7)</external-xref> of title 10, United States Code.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H866F9D4F7B814708B107889609E306A5"><enum>8.</enum><header>Enterprise resource planning</header><text display-inline="no-display-inline">The Secretary of Defense shall amend the acquisition guidance of the Department of Defense to provide for the following:</text><paragraph id="H2A5F2834461C43DF9D76ECEFE45DA662"><enum>(1)</enum><text>The Defense Business System Management Committee may not approve procurement of any Enterprise Resource Planning (ERP) business system that is independently estimated to take longer than three years to procure from initial obligation of funds to full deployment and sustainment.</text></paragraph><paragraph id="H7D4381BFC6884C21AF5085F16ABECB2F"><enum>(2)</enum><text>Any contract for the acquisition of an Enterprise Resource Planning business system shall include a provision authorizing termination of the contract at no cost to the Government if procurement of the system takes longer than three years from initial obligation of funds to full deployment and sustainment.</text></paragraph><paragraph id="HA14473AC0FB141FFADE3133692D02605"><enum>(3)</enum><text>Any implementation of an Enterprise Resource Planning system shall comply with each of the following:</text><subparagraph id="HE903445445AB4F82888C760163447BA4"><enum>(A)</enum><text>The current Business Enterprise Architecture established by the Chief Management Officer of the Department of Defense.</text></subparagraph><subparagraph id="HBE7FD5ED60FB40C18F8DBDCAE9949E82"><enum>(B)</enum><text>The provisions of <external-xref legal-doc="usc" parsable-cite="usc/10/2222">section 2222</external-xref> of title 10, United States Code.</text></subparagraph></paragraph><paragraph id="H93B6C970702749E29A36CBB46375B150"><enum>(4)</enum><text>The Deputy Secretary of Defense (acting in the capacity of Chief Management Officer of the Department of Defense) or a successor official in the Department of Defense (acting in such capacity) shall have the authority to replace any program manager (whether in a military department or a Defense Agency) for the procurement of an Enterprise Resource Planning business system if procurement of the system takes longer than three years from initial obligation of funds to full deployment and sustainment.</text></paragraph><paragraph id="HBB6AAAC6A2AC4FCFBC33D8966ABDBD69"><enum>(5)</enum><text>Any integrator contract for the implementation of an Enterprise Resource Planning business system shall only be awarded to companies that have a history of successful implementation of other Enterprise Resource Planning business systems for the Federal Government (whether with the Department of Defense or another department or agency of the Federal Government), including meeting cost and schedule goals.</text></paragraph></section></legis-body></bill>
