R. 3183</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20130925">September 25, 2013</action-date><action-desc><sponsor name-id="W000796">Mr. Westmoreland</sponsor> (for himself, <cosponsor name-id="R000586">Mr. Renacci</cosponsor>, <cosponsor name-id="G000569">Mr. Grimm</cosponsor>, <cosponsor name-id="J000255">Mr. Jones</cosponsor>, <cosponsor name-id="L000575">Mr. Lankford</cosponsor>, <cosponsor name-id="C001064">Mr. Campbell</cosponsor>, <cosponsor name-id="L000569">Mr. Luetkemeyer</cosponsor>, <cosponsor name-id="D000614">Mr. Duffy</cosponsor>, <cosponsor name-id="B000013">Mr. Bachus</cosponsor>, <cosponsor name-id="B001282">Mr. Barr</cosponsor>, <cosponsor name-id="R000598">Mr. Rothfus</cosponsor>, <cosponsor name-id="W000812">Mrs. Wagner</cosponsor>, <cosponsor name-id="P000599">Mr. Posey</cosponsor>, <cosponsor name-id="P000588">Mr. Pearce</cosponsor>, <cosponsor name-id="F000458">Mr. Fincher</cosponsor>, and <cosponsor name-id="M001156">Mr. McHenry</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Consumer Financial Protection Act of 2010 to provide consumers with a free annual disclosure of information the Bureau of Consumer Financial Protection maintains on them, and for other purposes.</official-title></form><legis-body id="H4707296BCA834E8C8B1A73AD7AD8CBA1" style="OLC"><section id="HF63ABF9A067A47BCAE6D056ED4841AD9" section-type="section-one"><enum>1.</enum><header>Annual disclosure to consumers</header><subsection id="HF6833E921CDA4F3A8CDD172E84FD5E77"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1022(c)(9) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5512">12 U.S.C. 5512(c)(9)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HCF0E3190FBBD432AADFEADF2D53F6C94" style="OLC"><subparagraph id="H1BE78D6077E544AF87AD0D991C7D7D02"><enum>(C)</enum><header>Annual disclosure to consumers</header><clause id="H5C111F25B8BC46B69A99B774894DDEB3"><enum>(i)</enum><header>In general</header><text>Once during any 12-month period, upon request of a consumer and without charge to the consumer, the Bureau shall clearly and accurately disclose to the consumer, before the end of the 15-day period beginning on the day the request is made, the following:</text><subclause id="HA2F523AEDA41489DAD40127C3B1DC8DD"><enum>(I)</enum><text display-inline="yes-display-inline">All information with respect to the consumer held by the Bureau at the time of the request, except that if the consumer to whom the information relates requests that the first 5 digits of the social security number (or similar identification number) of the consumer not be included in the disclosure, and the Bureau has received appropriate proof of the identity of the requester, the Bureau shall so truncate such number in such disclosure.</text></subclause><subclause id="HD577482A1EF444698BCE48654439BD72"><enum>(II)</enum><text>The sources of the information.</text></subclause><subclause id="H0C8BE1A808B6422C99198BD428BC5EDD"><enum>(III)</enum><text>Any person or other Federal department or agency to which the Bureau disclosed information described under subclause (I).</text></subclause></clause><clause id="HF3C3CA227AE641888B47ECBAF019BD71"><enum>(ii)</enum><header>Method of request</header><text>The Bureau shall allow consumers to make a request under clause (i)—</text><subclause id="HEC2459FC72224910ABEB4D3516EA564B"><enum>(I)</enum><text>online, with a link prominently displayed on the Bureau’s website;</text></subclause><subclause id="H9FDAA79A363A4F03BB3C26997150E3F7"><enum>(II)</enum><text>via United States mail; and</text></subclause><subclause id="H832CDE1B10C94F75BAC806B15596FAB9"><enum>(III)</enum><text>via a toll-free telephone number established by the Bureau for such purpose.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2051102DA1B74472B0E065889D723D59"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">Section 1022(c)(9)(C) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5512">12 U.S.C. 5512(c)(9)(C)</external-xref>), as added by subsection (a), shall take effect with respect to consumer requests made after the 1-year period beginning on the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
