<section id="HDE77480EAABD468581D71187C4B265BE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Children’s Consignment Event Recognition Act of 2013</short-title></quote>.</text></section>
<section id="H5F75C84B21874FBFA52459B595B51E1D"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to ensure that individuals and families may pool their resources, time, efforts, and energies, with or without the assistance of a facilitator, to sell, purchase, and otherwise exchange children’s clothing, toys, bedding, furniture, and related accessories, and maternity clothing and accessories without fear that they will be deemed to be employees under the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>).</text></section>
<section id="H3172C04CE0B74B55894C002F3A49E75B"><enum>3.</enum><header>Amendments to the Fair Labor Standards Act of 1938</header><text display-inline="no-display-inline">Section 3(e) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>) is amended—</text>
<paragraph id="HAC2EDB93B2794606A40C0906C22E4D10"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and (4)</quote> and inserting <quote>, (4), (5), and (6)</quote>; and</text></paragraph>
<paragraph id="HF2118A024617461E89B6DA82AFCE8EF9"><enum>(2)</enum><text>by adding at the end the following:</text>

<paragraph id="H14BE4E7C547D4E0284809E209F8AD85D"><enum>(6)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="H149ACA63031E4DA681A28BBF3BBA869A"><enum>(A)</enum><text>The term <term>employee</term> does not include—</text>
<clause id="H7D9765D46BBE492EAD974E6B99BA3292" indent="up1"><enum>(i)</enum><text>individuals who volunteer their services before, during, or after a children’s consignment event with or without the assistance of a facilitator and—</text>
<subclause id="HADCA280032354F909C16188708796E6A" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">provide not less than 15 items for sale at such children’s consignment event;</text></subclause>
<subclause id="HCB9FBEA78ADD4F5492C5EFD9C60DCCA4" indent="up1"><enum>(II)</enum><text>receive a right to shop from the facilitator at such children’s consignment event before such event is open to the general public; or</text></subclause></clause>
<clause id="HC75945D5569F4A458E12547DBFBCAC7D" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the spouse, children, spouses of children, grandchildren, parents, and parents of spouses of the individuals described in clause (i).</text></clause></subparagraph>
<subparagraph id="H5F9CE3004BAB40FC894BE20A8C5D62DD" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, the term <term>children’s consignment event</term> means a sale or other event in which—</text>
<clause id="H18E3A05527C04A04B41963E51752F66D"><enum>(i)</enum><text>not less than 90 percent of the fair market value, in the aggregate, of the items offered for sale at such event are—</text>
<subclause id="H5A88C1E18D704D3EB87C9AEB1615496E"><enum>(I)</enum><text>children’s or maternity items; and</text></subclause>
<subclause id="HF69B4607BBB844EEA51F45F31451097A"><enum>(II)</enum><text>resale items offered for sale on consignment by consignors; and</text></subclause></clause>
<clause id="H893EE48778E3499EA9B3029C42740C0F"><enum>(ii)</enum><text>such event is held in a single physical location and is open to the public for the sale of goods for 8 or fewer sale days within any 30-day period.</text></clause></subparagraph>
<subparagraph id="H07397A6025364A20A2D4811A74C0B473" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, the term <term>facilitator</term> means a person that organizes or hosts a children’s consignment event, or otherwise actively provides an opportunity for individuals described in subparagraph (A) to volunteer at a children’s consignment event.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
