R. 3162</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20130920">September 20, 2013</action-date><action-desc><sponsor name-id="G000568">Mr. Griffith of Virginia</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Black Lung Benefits Act to provide equity for certain eligible survivors, and for other purposes.</official-title></form><legis-body id="HE433307EA15F4ACAB31E9AD28E7BB0AB" style="OLC"><section id="H73C463CA117E411DB3648A84E8F361F6" section-type="section-one"><enum>1.</enum><header>Equity for certain eligible survivors</header><subsection id="H1B5EE00FB162404BB9992887BB45634F"><enum>(a)</enum><header>Rebuttable presumption</header><text display-inline="yes-display-inline">Section 411(c)(4) of the Black Lung Benefits Act (<external-xref legal-doc="usc" parsable-cite="usc/30/921">30 U.S.C. 921(c)(4)</external-xref>) is amended by striking the last sentence.</text></subsection><subsection id="HF746FB6A639F4AA08E553DF7126CBEFD"><enum>(b)</enum><header>Continuation of benefits</header><text display-inline="yes-display-inline">Section 422(l) of the Black Lung Benefits Act (<external-xref legal-doc="usc" parsable-cite="usc/30/932">30 U.S.C. 932(l)</external-xref>) is amended by striking <quote>, except with respect to a claim filed under this part on or after the effective date of the Black Lung Benefits Amendments of 1981</quote>.</text></subsection><subsection id="H563E4580A1604C35BEDA9731FDC8C408"><enum>(c)</enum><header>Applicability</header><text>The amendments made by this section shall apply with respect to claims filed under part B or part C of the Black Lung Benefits Act (<external-xref legal-doc="usc" parsable-cite="usc/30/921">30 U.S.C. 921 et seq.</external-xref>, 931 et seq.) after January 1, 2005, that were pending on or after March 23, 2010.</text></subsection></section><section id="HD630A35E3ECA478BB395F1E389F9A4A9"><enum>2.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect on the date of enactment of any Act that repeals section 1556 of the Patient Protection and Affordable Care Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>).</text></section></legis-body></bill>
