R. 3152</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20130919">September 19, 2013</action-date><action-desc><sponsor name-id="R000585">Mr. Reed</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name>, and in addition to the Committees on <committee-name committee-id="HAS00">Armed Services</committee-name>, <committee-name committee-id="HHA00">House Administration</committee-name>, <committee-name committee-id="HWM00">Ways and Means</committee-name>, <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, and <committee-name committee-id="HVR00">Veterans’ Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit Members of Congress, the President, the Vice President, and the head of any Executive department from receiving pay for any period in which there is a Government shutdown and to provide for payments to seniors, military and veterans during a Government shutdown.</official-title></form><legis-body id="H1EF6CAE4134B482A834CE5B028F0C7FB" style="OLC"><section id="HA5B3849E7850457CA9D9E498BB6A8897" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pay Our Veterans and Seniors First Act</short-title></quote>.</text></section><section id="H79E21F28CFA94FF1BE636884D7D8A05C" section-type="subsequent-section"><enum>2.</enum><header>Prohibition</header><subsection id="H1E647C15D7754F349F8803BEB0EEDEC6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A Member of Congress, the President, the Vice President, and the head of any Executive department shall not receive basic pay for any period in which there is more than a 24-hour lapse in appropriations for any Executive agency as a result of a failure to enact a regular appropriations bill or continuing resolution.</text></subsection><subsection id="H2A4BD866E6EB4DCBAADD7F2C14FE6285"><enum>(b)</enum><header>Retroactive Pay Prohibited</header><text display-inline="yes-display-inline">No pay forfeited in accordance with subsection (a) may be paid retroactively.</text></subsection></section><section display-inline="no-display-inline" id="H071D160E320744CBBC602DD0121C0292" section-type="subsequent-section"><enum>3.</enum><header>Continuation of payments for certain purposes</header><text display-inline="no-display-inline">During any lapse in appropriations during fiscal year 2014 when interim or full-year appropriations for the affected accounts have not been enacted, from amounts in the general fund of the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the appropriate Secretary such amounts as are necessary to provide the following:</text><paragraph id="H98290A332AAA4D16B9B3AB0DFCBB7B25"><enum>(1)</enum><text>Pay and allowances to members of the Armed Forces, including reserve component members, who perform active service.</text></paragraph><paragraph id="HB7A891A1466C4AC0ADE03D6144208855"><enum>(2)</enum><text>Benefits under—</text><subparagraph id="H9DFF5816584246F2842407127B895E0F"><enum>(A)</enum><text>the TRICARE for Life program under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/55">chapter 55</external-xref> of title 10, United States Code;</text></subparagraph><subparagraph id="H99851863435F435E973E24CCB83692AF"><enum>(B)</enum><text>the Medicare program under title XVIII of the Social Security Act; and</text></subparagraph><subparagraph id="H296FDE3FFE9E4A8CADB4044F4DD58E3B"><enum>(C)</enum><text>title II of the Social Security Act.</text></subparagraph></paragraph><paragraph id="H144BD061023C4A02A8229E6FF45FEB1F"><enum>(3)</enum><text>Benefits and programs under title 38, United States Code.</text></paragraph></section><section id="HAC274823E53A47728AD5898E4337DD09"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act—</text><paragraph id="H7167E967F5AA49CB92A4A8C13EEB871F"><enum>(1)</enum><text>the term <term>Executive department</term> has the meaning given such term by <external-xref legal-doc="usc" parsable-cite="usc/5/101">section 101</external-xref> of title 5, United States Code; and</text></paragraph><paragraph id="HDF27F77663684FD19981BC60418C1E8E"><enum>(2)</enum><text>the term <term>Executive agency</term> has the meaning given such term by <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5, United States Code.</text></paragraph></section></legis-body></bill>
