R. 3140</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20130919">September 19, 2013</action-date><action-desc><sponsor name-id="C001047">Mrs. Capito</sponsor> (for herself, <cosponsor name-id="L000571">Mrs. Lummis</cosponsor>, <cosponsor name-id="B001282">Mr. Barr</cosponsor>, <cosponsor name-id="R000395">Mr. Rogers of Kentucky</cosponsor>, <cosponsor name-id="J000292">Mr. Johnson of Ohio</cosponsor>, <cosponsor name-id="R000598">Mr. Rothfus</cosponsor>, <cosponsor name-id="B001275">Mr. Bucshon</cosponsor>, <cosponsor name-id="N000184">Mrs. Noem</cosponsor>, <cosponsor name-id="G000568">Mr. Griffith of Virginia</cosponsor>, and <cosponsor name-id="M001180">Mr. McKinley</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Clean Air Act to prohibit any regulation under such Act concerning the emissions of carbon dioxide from a fossil fuel-fired electric generating unit from taking effect until the Administrator of the Environmental Protection Agency makes certain certifications, and for other purposes.</official-title></form><legis-body id="H30EAE7E71AF9436C8FD199D44473C6CA" style="OLC"><section id="H61FBE2E5C3EE4D9F86E7DFD2E5BDF5FE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensure Reliable and Affordable American Energy Act of 2013</short-title></quote>.</text></section><section id="HE949A647F96848DA92F75DB248C31072"><enum>2.</enum><header>No unilateral regulation of emissions of carbon dioxide</header><text display-inline="no-display-inline">The Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) is amended by inserting after section 329 the following:</text><quoted-block id="HEDA2DD00BA6A40EBAE5B9F3ECC5D8DCE" style="OLC"><section id="HB09599C1A9A140A4BF576B145DA45ECF"><enum>330.</enum><header>No unilateral regulation of emissions of carbon dioxide from fossil fuel-fired electric generating units</header><subsection id="H685A37FC982A4E02A781BCDB5DC45CD3"><enum>(a)</enum><header>Prohibition on regulations concerning emissions of carbon dioxide from fossil fuel-Fired electric generating units taking effect</header><paragraph id="H96EF1114BDE1473D8324D7A60DB15CB6"><enum>(1)</enum><header>Prohibition</header><text>A regulation under this Act concerning emissions of carbon dioxide from a fossil fuel-fired electric generating unit to address climate change may not take effect until the Administrator certifies that a sufficient number of countries have put into effect regulations concerning emissions of carbon dioxide which are at least as stringent as the regulation under this Act.</text></paragraph><paragraph id="HC73D7AA15AF940379A0D043BC3E3D16D"><enum>(2)</enum><header>Countries</header><text display-inline="yes-display-inline">For the purposes of paragraph (1), the term <term>sufficient number</term> means a sufficient number of countries so that, in the aggregate, such countries account for not less than 80 percent of the global carbon dioxide emissions, excluding such emissions in the United States, in the calendar year immediately preceding the year in which the regulation under this Act would be enforced.</text></paragraph><paragraph id="HA3544E959F4D42CEBDF9FC564D21EEE0"><enum>(3)</enum><header>Stringency considerations</header><text>For the purposes of paragraph (1), a country’s regulation concerning carbon dioxide emissions may only be considered to be as stringent as the regulation under this Act if such country’s regulation limits carbon dioxide emissions to a numeric standard that is equal to or less than such a standard under the regulation under this Act in a timeframe that is equal to or less than the timeframe under the regulation under this Act.</text></paragraph></subsection><subsection id="H3E78F35614354E609E34CB7C2E4B0FDF"><enum>(b)</enum><header>Rule of Construction</header><text>Nothing in this section shall be construed as providing the Administrator with any authority to promulgate any regulation concerning, take action relating to, or take into consideration the emissions of carbon dioxide.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
