R. 3138</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20130919">September 19, 2013</action-date><action-desc><sponsor name-id="R000598">Mr. Rothfus</sponsor> (for himself, <cosponsor name-id="D000604">Mr. Dent</cosponsor>, <cosponsor name-id="B001269">Mr. Barletta</cosponsor>, and <cosponsor name-id="T000467">Mr. Thompson of Pennsylvania</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide that certain emission limits for hydrogen chloride and sulfur dioxide shall not apply to certain existing electric utility steam generating units that use circulating fluidized bed technology to convert coal refuse into energy.</official-title></form><legis-body id="HDC98C11C4D6743B0B602DB15D08179B6" style="OLC"><section id="H595C1C6C39E64435B6D599F41439528F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Satisfying Energy Needs and Saving the Environment Act of 2013</short-title></quote> or the <quote><short-title>SENSE Act of 2013</short-title></quote>.</text></section><section display-inline="no-display-inline" id="H7A95041F48A24F9C8B29C61D2B6F9DEB"><enum>2.</enum><header>Inapplicability of certain emission limits for electric utility steam generating units that convert coal refuse into energy</header><subsection id="HDF1007EC04FA42F3A68D76D5FBBF484B"><enum>(a)</enum><header>Inapplicability of certain emission limits for certain EGUs</header><text display-inline="yes-display-inline">The emission limits for hydrogen chloride and sulfur dioxide in table 2 to subpart UUUUU of part 63 of title 40, Code of Federal Regulations, entitled <quote><short-title>Emission Limits for Existing EGUs</short-title></quote>, shall not apply to an electric utility steam generating unit in the subcategory <quote><short-title>Coal-fired unit not low rank virgin coal</short-title></quote> if such electric utility steam generating unit—</text><paragraph id="HE2C92B6F74824F33B4B2E0131C09E623"><enum>(1)</enum><text>is in operation as of the date of enactment of this Act;</text></paragraph><paragraph id="HC633D78627FB4DF9ABB83DF0E147D82D"><enum>(2)</enum><text display-inline="yes-display-inline">utilizes circulating fluidized bed technology to convert coal refuse into energy; and</text></paragraph><paragraph id="H39A92C252D9D4E1E8FC2613A403F4C6A"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H97EC33252F6742358F493F015FABEB43"><enum>(A)</enum><text>derives at least 75 percent of its heat input from coal refuse; or</text></subparagraph><subparagraph id="H4CD75F1CF0B6476E96B71DD85623863D" indent="up1"><enum>(B)</enum><text>is a qualifying facility.</text></subparagraph></paragraph></subsection><subsection id="H4361C10C278643258CA8905D740CCED6"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H8D51A878DAE14E918FBBE23D90BA01AD"><enum>(1)</enum><header>Coal refuse</header><text>The term <term>coal refuse</term> means any byproduct of coal mining, physical coal cleaning, or coal preparation operations, that contains coal, matrix material, clay, and other organic and inorganic material.</text></paragraph><paragraph id="HF25A78D964DB4F5BA034B024A4CA3A2F"><enum>(2)</enum><header>Qualifying cogeneration facility</header><text>The term <term>qualifying cogeneration facility</term> has the meaning given such term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text></paragraph><paragraph id="HA3BB1052C6F843A29AB1D622E4088DB4"><enum>(3)</enum><header>Qualifying facility</header><text>The term <term>qualifying facility</term> means—</text><subparagraph id="H5FF171907F66421D8E36E85413518AB6"><enum>(A)</enum><text>a qualifying small power production facility; or</text></subparagraph><subparagraph id="H2A0A8A1792BC46E8853B9C8D4EFAECB2"><enum>(B)</enum><text>a qualifying cogeneration facility.</text></subparagraph></paragraph><paragraph id="HC0738317985947D4A9E6063FA6F3C850"><enum>(4)</enum><header>Qualifying small power production facility</header><text>The term <term>qualifying small power production facility</term> has the meaning given such term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
