Davis of Illinois</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend part E of title IV of the Social Security Act to extend the adoption incentive payments program to incentive payments for foster child exits to reunification, adoption, and guardianship, and for other purposes.</official-title></form><legis-body id="H95B1D3070D5F447186520E05A38F1ABD" style="OLC"><section id="HB8129328025240C78440B403298C9F4E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Investing in Permanency for Youth in Foster Care Act</short-title></quote>.</text></section><section id="HD81BA1B56F4C48259D8E0CF044D9977F"><enum>2.</enum><header>Extend the adoption incentive payment program to incentive payments for foster child exits to reunification, adoption, and guardianship</header><subsection id="HDAD2D5E5F41A4A488F595DFAEB9E48BF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 473A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b</external-xref>) is amended—</text><paragraph id="H892533DD856747209EF124BBFF1C43AB"><enum>(1)</enum><text>in the section heading, by striking <quote><short-title><header-in-text level="section" style="OLC">Adoption</header-in-text></short-title></quote> and inserting <quote><short-title><header-in-text level="section" style="OLC">Permanency</header-in-text></short-title></quote>;</text></paragraph><paragraph id="H1D3A213197E04502AD3EE35078B98AFA"><enum>(2)</enum><text>in subsection (a), by striking <quote><short-title>adoption</short-title></quote> and inserting <quote><short-title>permanency</short-title></quote>;</text></paragraph><paragraph id="H68810BCBA62448D9A79390D9A8C60B65"><enum>(3)</enum><text>in subsection (b)—</text><subparagraph id="HE6A87487A9A24639B8014E32B4BC4E41"><enum>(A)</enum><text>by striking paragraph (2);</text></subparagraph><subparagraph id="H8A944999A28D4D1393429AFBEAA73B7A"><enum>(B)</enum><text>in paragraph (5), by striking <quote><short-title>2008 through 2012</short-title></quote> and inserting <quote><short-title>2013 through 2017</short-title></quote>; and</text></subparagraph><subparagraph id="HEC5AA6B989224D1695CB89C549D6D32F"><enum>(C)</enum><text>by redesignating paragraphs (3) through (5) as paragraphs (2) through (4), respectively;</text></subparagraph></paragraph><paragraph id="H8B072151F6B94710B0DEE8D51D76F03B"><enum>(4)</enum><text>in subsection (c)—</text><subparagraph id="H6D72A3F3D6D94BD0B52446D931DA6512"><enum>(A)</enum><text>by striking paragraphs (1) and (2) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H5693D47E9C2B44649CE8AFEBA9607A31" style="OLC"><paragraph id="HC888BD53E26343E0BED649F9FB9843AC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A State is in compliance with this subsection for a particular fiscal year if the State has provided to the Secretary the data described in paragraph (2) for fiscal year 2010 and each succeeding fiscal year through the fiscal year second preceding the particular fiscal year.</text></paragraph><paragraph id="HBFA18EACDCB54D9A8BAF6F88E31BD1F7"><enum>(2)</enum><header>Determination of numbers of exits based on afcars data</header><text display-inline="yes-display-inline">The Secretary shall determine the numbers of exits to reunification, adoption, and guardianship in a State during a fiscal year, on the basis of data meeting the requirements of the system established pursuant to section 479, as reported by the State and approved by the Secretary by August 1 of the succeeding fiscal year.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H5E9779163F284291A4EEDF890B647A9B"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HFAD2407959114114A7D0E07D32FCDCAC" style="OLC"><paragraph id="H207F8BE73A5A4922A1A957C002B468E9"><enum>(4)</enum><header>Annual reports to the secretary</header><text display-inline="yes-display-inline">Beginning 24 months after the effective date of this paragraph, each State to which a payment is made under this section for a fiscal year shall submit to the Secretary and shall make available to the public annual reports on the amount of the payment that is attributable to exits to reunification, the amount that is attributable to exits to adoption, and the amount that is attributable to exits to guardianship, and a breakdown of how the State used the total payment to improve or expand the provision of post-permanency services in the State.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB5706934178841B5BA80A18D8E5D1F57"><enum>(5)</enum><text>by striking subsection (d) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H1784B0F43FA045E8801FC2696AEED2B1" style="OLC"><subsection id="HAC1EE69845484608BA43549A1FE64451"><enum>(d)</enum><header>Permanency incentive payment</header><paragraph id="HBACC89BBA1D14C7B85E634F6642A5496"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the permanency incentive payment payable to a State for a fiscal year under this section shall be equal to the sum of—</text><subparagraph id="H38125B02AB614081B8289021F1A1950E"><enum>(A)</enum><text display-inline="yes-display-inline">$2,000, multiplied by the sum of—</text><clause id="H41DADCEB660D4528A9278B57BBE3E199"><enum>(i)</enum><text>the amount (if any) by which the number of exits to adoption in the State during the fiscal year exceeds the projected number of exits to adoption in the State for the fiscal year;</text></clause><clause id="H9D20D771A864412A809ABF8541F43BC8"><enum>(ii)</enum><text>the amount (if any) by which the number of exits to guardianship in the State during the fiscal year exceeds the projected number of exits to guardianship in the State for the fiscal year; and</text></clause><clause id="H1DC385AA6DB84479827E60ABBECCB2D0"><enum>(iii)</enum><text>the amount (if any) by which the number of exits to reunification in the State during the fiscal year exceeds the projected number of exits to reunification in the State for the fiscal year;</text></clause></subparagraph><subparagraph id="H9295E953F8624A048D91EC235082FBD5"><enum>(B)</enum><text display-inline="yes-display-inline">$8,000, multiplied by the sum of—</text><clause id="H4E0B0BE8F3E54ECC911E542AD07CF84F"><enum>(i)</enum><text>the amount (if any) by which the number of exits to adoption of older children in the State during the fiscal year exceeds the number of exits to adoption of older children in the State for the base fiscal year;</text></clause><clause id="H2D9401AA2D43447AB4EF74A1375C7FEB"><enum>(ii)</enum><text>the amount (if any) by which the number of exits to guardianship of older children in the State during the fiscal year exceeds the number of exits to guardianship of older children in the State for the base fiscal year; and</text></clause><clause id="H9753E011AB4F407C9963E769352A9DB1"><enum>(iii)</enum><text>the amount (if any) by which the number of exits to reunification of older children in the State during the fiscal year exceeds the number of exits to reunification of older children in the State for the base fiscal year;</text></clause></subparagraph><subparagraph id="H7506604584DE4AF3828FDF4F5A098130"><enum>(C)</enum><text display-inline="yes-display-inline">$6,000, multiplied by the sum of—</text><clause id="HD23ACEB0EDD24AA58108343D22500E22"><enum>(i)</enum><text>the amount (if any) by which the number of exits to adoption of pre-adolescent children in the State during the fiscal year exceeds the number of exits to adoption of pre-adolescent children in the State for the base fiscal year;</text></clause><clause id="HB7FC3FCAB94F4A7DA9615910B510A629"><enum>(ii)</enum><text>the amount (if any) by which the number of exits to guardianship of pre-adolescent children in the State during the fiscal year exceeds the number of exits to guardianship of pre-adolescent children in the State for the base fiscal year; and</text></clause><clause id="H008C54A0A76F45DD9309C4D33A722A6E"><enum>(iii)</enum><text>the amount (if any) by which the number of exits to reunification of pre-adolescent children in the State during the fiscal year exceeds the number of exits to reunification of pre-adolescent children in the State for the base fiscal year; and</text></clause></subparagraph><subparagraph id="H3506B2AE47FB4A92935082DF908AAC6F"><enum>(D)</enum><text display-inline="yes-display-inline">$4,000, multiplied by the amount (if any) by which the number of special needs adoptions of young children in the State during the fiscal year exceeds the number of special needs adoptions of young children in the State for the base fiscal year.</text></subparagraph></paragraph><paragraph id="HEC3512100EF344489EDC641EECB80D66"><enum>(2)</enum><header>Pro rata adjustment if insufficient funds available</header><text display-inline="yes-display-inline">For any fiscal year, if the total amount of permanency incentive payments otherwise payable under this section for a fiscal year exceeds the amount appropriated pursuant to subsection (h) for the fiscal year, the amount of the permanency incentive payment payable to each State under this section for the fiscal year shall be—</text><subparagraph id="HA72C9A01B603406FABE570B03CA7C5BA"><enum>(A)</enum><text>the amount of the permanency incentive payment that would otherwise be payable to the State under this section for the fiscal year; multiplied by</text></subparagraph><subparagraph id="H7B92B834B7AA47B099A8CAEB94D2117C"><enum>(B)</enum><text>the percentage represented by the amount so appropriated for the fiscal year, divided by the total amount of permanency incentive payments otherwise payable under this section for the fiscal year.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H5F96B7F90CDD492192AB0C2C990B3BC7"><enum>(6)</enum><text>in subsection (f), by striking <quote><short-title>any service (including post-adoption services) that may be provided under part B or E.</short-title></quote> and inserting <quote><short-title>post-permanency services to help ensure that children remain with the families with whom they have been reunified, adopted, or placed for guardianship, and a State shall not use the amount to supplant other funds being used for the services.</short-title></quote>;</text></paragraph><paragraph id="HB6E536741261420398B3DBDC56A7BEA8"><enum>(7)</enum><text>by striking subsection (g) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H58C1343219AF475BA21B24B9CB12F5E3" style="OLC"><subsection id="HC9A3C374B36B416389CF8551678728D3"><enum>(g)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H4DA22F2195834E7B8B86659636AF3D1D"><enum>(1)</enum><header>Adoption</header><text>The term <term>adoption</term> means the final adoption of a child who, at the time of adoptive placement, was in foster care under the supervision of the State.</text></paragraph><paragraph id="H7955EE716C7C4F40AFAD55CB54A06E56"><enum>(2)</enum><header>Base fiscal year</header><text>The term <term>base fiscal year</term> means fiscal year 2012.</text></paragraph><paragraph id="H50C1AEC6A42F4B238A909E990C01397D"><enum>(3)</enum><header>Exit to reunification</header><text display-inline="yes-display-inline">The term <term>exit to reunification</term> means, with respect to a State and a fiscal year, the permanent reunification of a child who was in foster care under the responsibility of the State for a period of at least 90 consecutive days in the fiscal year, excluding any such placement of children who returned to foster care in the fiscal year.</text></paragraph><paragraph id="HE49308D952304CFBABEEE4FF38E8A9F9"><enum>(4)</enum><header>Foster children</header><text>The term <term>foster children</term> means, with respect to a State and a fiscal year, children in foster care under the responsibility of the State for a period of at least 90 consecutive days in the fiscal year.</text></paragraph><paragraph id="HDC647ED33A6344EBAD044BDC93D7DBD2"><enum>(5)</enum><header>Guardianship</header><text>The term <term>guardianship</term> means the placement with a relative guardian of a child with respect to whom—</text><subparagraph id="H079603AB033646D1825EA0AC0E06059A"><enum>(A)</enum><text>a payment is made under section 474(a)(5); or</text></subparagraph><subparagraph id="HEE3D609B07C54A80AB8960F4F325DF77"><enum>(B)</enum><text>a payment is made using only State or local guardianship assistance funds, and the case plan for the child documents the steps that the agency has taken to determine that it is not appropriate for the child to be returned home or adopted.</text></subparagraph></paragraph><paragraph id="HAD264BCF495A4DE38D541C0E2310B03B"><enum>(6)</enum><header>Older children</header><text>The term <term>older children</term> means children who have attained 14 years of age.</text></paragraph><paragraph id="H977EAEBCA3AF47258DE1F86FBD99BEC4"><enum>(7)</enum><header>Adoption placement rate</header><text>The term <term>adoption placement rate</term> means, with respect to a State and a fiscal year—</text><subparagraph id="H96EBBC47E4A9431AB8F733B3DDAC7661"><enum>(A)</enum><text>the total number of exits to adoption in the State during the fiscal year; divided by</text></subparagraph><subparagraph id="H0F339D59D4D440D8B09D9AB7EF13889F"><enum>(B)</enum><text>the number of children in foster care under the responsibility of the State on the last day of the preceding fiscal year.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HBB61C2BBD4B947A184DD9CB7877E1538"><enum>(8)</enum><header>Guardianship placement rate</header><text>The term <term>guardianship placement rate</term> means, with respect to a State and a fiscal year—</text><subparagraph id="H377D2C641C4E401C9B30797EE27D4C61"><enum>(A)</enum><text>the total number of exits to guardianship in the State during the fiscal year; divided by</text></subparagraph><subparagraph id="H04FF5F0E29D84F4A808821C9A48BE38A"><enum>(B)</enum><text>the number of children in foster care under the responsibility of the State on the last day of the preceding fiscal year.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HEE207026BEBC4B0C9354F5743413298C"><enum>(9)</enum><header>Reunification placement rate</header><text>The term <term>reunification placement rate</term> means, with respect to a State and a fiscal year—</text><subparagraph id="H8C043472E1214CCD9C3EACE063AFA587"><enum>(A)</enum><text>the total number of exits to reunification in the State during the fiscal year; divided by</text></subparagraph><subparagraph id="H0AE739CE6ABA42F3813B6A5CE42F505C"><enum>(B)</enum><text>the number of foster children with respect to the State for the fiscal year.</text></subparagraph></paragraph><paragraph id="H904D6723441A498E8B6559508C328E16"><enum>(10)</enum><header>Post-permanency services</header><text display-inline="yes-display-inline">The term <term>post-permanency services</term> means the services needed once children and youth have been reunified, adopted, or placed with guardians to stabilize and support the child and family, including—</text><subparagraph id="H79F477CAB1F24C5B8569B5CCE3B89DA0"><enum>(A)</enum><text>financial support;</text></subparagraph><subparagraph id="H245F2DFB363443509CF03A2715AA09AD"><enum>(B)</enum><text>case management;</text></subparagraph><subparagraph id="H3CFCA917B7CC4E13AD8CBF34B5308A0C"><enum>(C)</enum><text>connections with community services;</text></subparagraph><subparagraph id="H49881388C60E42918629AD5CA1AD1895"><enum>(D)</enum><text>individual, group and family counseling and other mental health services;</text></subparagraph><subparagraph id="HD6C55CA1EFEE480EA37E4917813796BB"><enum>(E)</enum><text>respite care; and</text></subparagraph><subparagraph id="H9692A73AE0C14931BB0F7C0DB59A275D"><enum>(F)</enum><text>training of public and private child welfare staff on delivering post-permanency services.</text></subparagraph></paragraph><paragraph id="HADA1F3125ABB4E50811DEC679531BE82"><enum>(11)</enum><header>Pre-adolescent children</header><text>The term <term>pre-adolescent children</term> means children who have attained 9 years of age but have not attained 14 years of age.</text></paragraph><paragraph id="H7E42BF447CB74CFAAC13AC84DE276781"><enum>(12)</enum><header>Projected number of exits to adoption</header><text>The term <term>projected number of exits to adoption</term> means, with respect to a State and a fiscal year—</text><subparagraph id="H845838FE9BA3469FB540240FD0A4DA70"><enum>(A)</enum><text display-inline="yes-display-inline">the number of children in foster care under the responsibility of the State as of the last day of the preceding fiscal year; multiplied by</text></subparagraph><subparagraph id="H87F543FAACE54C6FBA53C80716AB24CA"><enum>(B)</enum><text display-inline="yes-display-inline">the average of the adoption placement rates for the State for the 3 fiscal years most recently preceding the fiscal year referred to in subparagraph (A).</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H1DA6EBDBAEAC408A8F380B367F6BC896"><enum>(13)</enum><header>Projected number of exits to guardianship</header><text>The term <term>projected number of exits to guardianship</term> means, with respect to a State and a fiscal year—</text><subparagraph id="H8EB612ABAF074FE38DD374B9CEDC4C3A"><enum>(A)</enum><text display-inline="yes-display-inline">the number of children in foster care under the responsibility of the State as of the last day of the preceding fiscal year; multiplied by</text></subparagraph><subparagraph id="H06EFB16EDE534CB7BE8E1D59A242F492"><enum>(B)</enum><text display-inline="yes-display-inline">the average of the guardianship placement rates for the State for the 3 fiscal years most recently preceding the fiscal year referred to in subparagraph (A).</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HE65AD0C08AD544E4A80EF788D8EE05D9"><enum>(14)</enum><header>Projected number of exits to reunification</header><text>The term <term>projected number of exits to reunification</term> means, with respect to a State and a fiscal year—</text><subparagraph id="H7D241118F8934310B26FD5E00A8CC2FC"><enum>(A)</enum><text display-inline="yes-display-inline">the number of foster children with respect to the State for the fiscal year; multiplied by</text></subparagraph><subparagraph id="HA9E3288CEDF54E43BB6CDCE261B174F6"><enum>(B)</enum><text display-inline="yes-display-inline">the average of the reunification placement rates for the State for the 3                fiscal years most recently preceding the fiscal year referred to in subparagraph (A).</text></subparagraph></paragraph><paragraph id="HB3FADF6F47CB4C0C945189F6B094AAC3"><enum>(15)</enum><header>Reunification</header><text display-inline="yes-display-inline">The term <term>reunification</term> means an exit from foster care to a relative with whom the child was living before the placement into foster care or to another relative.</text></paragraph><paragraph id="H515B24DEB9CF44C1B89E7E3AA3493880"><enum>(16)</enum><header>Special needs adoption</header><text>The term <term>special needs adoption</term> means the final adoption of a child—</text><subparagraph id="H316D14C314244A4E83A2B1C75285519E"><enum>(A)</enum><text>who has special needs (as defined by the State); or</text></subparagraph><subparagraph id="H3C1CB0B43FCE45F7901AE1D34ED7A307"><enum>(B)</enum><text>for whom an adoption assistance agreement is in effect under section 473.</text></subparagraph></paragraph><paragraph id="H512A35646B394922BA536C847B40AC33"><enum>(17)</enum><header>Young children</header><text>The term <term>young children</term> means children who have not attained 9 years of age.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H68561FF65ACE4D8481A7162B61A2644C"><enum>(8)</enum><text>in subsection (h)(1)—</text><subparagraph id="HC196CB22B0564D998256A495DBBBF605"><enum>(A)</enum><text>by striking <quote><short-title>and</short-title></quote> at the end of subparagraph (C);</text></subparagraph><subparagraph id="H1DB6A909886F4A47929907E01D0F4859"><enum>(B)</enum><text>by striking the period at the end of subparagraph (D) and inserting <quote><short-title>; and</short-title></quote>; and</text></subparagraph><subparagraph id="HA44A755AF7234D089BA620A84682C12A"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H25E89DE6E3F94E2A8846A6D7321E9EB5" style="OLC"><subparagraph id="H7F9FA9A6343C4D2396E7DE063CFD98E0"><enum>(E)</enum><text display-inline="yes-display-inline">$60,000,000 for each of fiscal years 2014 through 2018.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H87B50C10A29946669D41ECF45C90861D"><enum>(9)</enum><text>in subsection (i)—</text><subparagraph id="H5CDCBAF868A2458389DBB411E47B275B"><enum>(A)</enum><text>by striking paragraphs (1) through (3) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H15868D42D9414E1EB43233F376DF0467" style="OLC"><paragraph id="H9D544FC58E7240008DCDC9A71510BCEC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may, directly or through grants or contracts, provide technical assistance to assist States and local communities to reach their targets for increased numbers of exits to adoption, guardianship, and reunification.</text></paragraph><paragraph id="H3C949CD9CEED490AA31D8043E219FFC0"><enum>(2)</enum><header>Description of the character of the technical assistance</header><text display-inline="yes-display-inline">The technical assistance provided under paragraph (1) shall support the goal of encouraging more permanent exits of children from foster care, and may include the following:</text><subparagraph id="H65869CF15FBB4860880C2EBFBAA0D769"><enum>(A)</enum><text>Models that encourage child-specific and child-focused efforts to recruit permanent families for children.</text></subparagraph><subparagraph id="H5E6C871DCAEC4BE9BF479013CAF6B492"><enum>(B)</enum><text>Models that encourage the use of intensive family-finding efforts.</text></subparagraph><subparagraph id="H01D61EE0FB1A47C98A7536241F98ED15"><enum>(C)</enum><text>Models to encourage the use of concurrent planning.</text></subparagraph><subparagraph id="H0D28DE471ABB49AAAC971AAC6A53173C"><enum>(D)</enum><text display-inline="yes-display-inline">The development of permanency units and specialized expertise to help move children promptly to permanency goals.</text></subparagraph><subparagraph id="HD9AF8A5AEC8044F7A590A8028FADC308"><enum>(E)</enum><text>The development of assessment tools to facilitate appropriate reunification or other permanency options.</text></subparagraph><subparagraph id="H00D20202A92F49B9B4BEC4C802D400E8"><enum>(F)</enum><text>The development of best practice guidelines for expediting permanency for children and, where, appropriate, termination of parental rights.</text></subparagraph><subparagraph id="HB20844D076E4486E84F775D9541A690C"><enum>(G)</enum><text>Development of programs that place children into pre-adoptive families while termination of parental rights is being pursued.</text></subparagraph><subparagraph id="H28778B3B33A64D2492CE70A9F206FF2A"><enum>(H)</enum><text>Models to encourage the fast tracking of children who have not attained 1 year of age and cannot be reunified, into permanent adoptive or guardianship families.</text></subparagraph><subparagraph id="HA0FBB10D7CF14C0698D0B60DE4C06AD4"><enum>(I)</enum><text>Models that require ongoing consulting with children who have attained 9 years of age about their permanency goal, including asking the children and youth about any adults who may serve as permanent parents through adoptions or guardianship.</text></subparagraph><subparagraph id="H6ECB3F87967C48A2902E119011DCDBD5"><enum>(J)</enum><text display-inline="yes-display-inline">Development of strategies designed to promote the use by a State of the guardianship assistance program under this part.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HF7B59BFBE0054FC8BD61838A498E68B7"><enum>(B)</enum><text>in paragraph (4)—</text><clause id="HEC032F6ED8994A629F44A0C538027436"><enum>(i)</enum><text>by striking <quote><short-title>(4)</short-title></quote> and inserting <quote><short-title>(3)</short-title></quote>; and</text></clause><clause id="HE072EEA3703744DBB770638BF464ABC8"><enum>(ii)</enum><text>by striking <quote><short-title>2004 through 2006</short-title></quote> and inserting <quote><short-title>2014 through 2018</short-title></quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="H47B4938B56534F9CB59E525F3C0C5290"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on October 1, 2013.</text></subsection></section></legis-body></bill>
