payment of cash to recipients of supplemental nutrition assistance benefits for the return of empty bottles and cans used to contain food purchased with benefits provided under the program</header><text display-inline="no-display-inline">Section 3(k)(1) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(k)(1)</external-xref>) is amended—</text><paragraph id="H8C70B5BA478448B98F26FE60AB29E509"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>and hot foods</quote> and inserting <quote>hot foods</quote>; and</text></paragraph><paragraph id="H9A5155745BDB4FE6840ED63630E9D8BE"><enum>(2)</enum><text>by adding at the end the following: <quote>and any deposit fee in excess of amount of the State fee reimbursement (if any) required to purchase any food or food product contained in a returnable bottle or can, regardless of whether such fee is included in the shelf price posted for such food or food product,</quote>.</text></paragraph></section><section id="HD73B87D4DCC747BEA7D0AF4E9DFFB3ED"><enum>102.</enum><header>Retailers</header><subsection commented="no" id="HF4E01B820C2B44738875EC6FC7FB8D55"><enum>(a)</enum><header>Definition of retail food store</header><text>Section 3(p)(1)(A) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(p)(1)(A)</external-xref>) is amended by striking <quote>at least 2</quote> and inserting <quote>at least 3</quote>.</text></subsection><subsection commented="no" id="H24C04EFC05B44E8CBF3A6141113A1D46"><enum>(b)</enum><header>Alternative benefit delivery</header><text>Section 7(f) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2016">7 U.S.C. 2016(f)</external-xref>) is amended—</text><paragraph commented="no" id="HDA568E8B63DF47F7BC3A641F787733F9"><enum>(1)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H21ACDE7F98314A2F91D6747A35B10789" style="OLC"><paragraph commented="no" id="HC946B892DDBC45F594CD57EE6ABD143A"><enum>(2)</enum><header>Imposition of costs</header><subparagraph commented="no" id="HA957608F91FB441DAFE086314596767F"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Secretary shall require participating retailers (including restaurants participating in a State option restaurant program intended to serve the elderly, disabled, and homeless) to pay 100 percent of the costs of acquiring, and arrange for the implementation of, electronic benefit transfer point-of-sale equipment and supplies.</text></subparagraph><subparagraph commented="no" id="HCAF122381D5C4DC394D64E76B7F7E40E"><enum>(B)</enum><header>Exemptions</header><text>The Secretary may exempt from subparagraph (A)—</text><clause commented="no" id="HBFDE41F82D1D481A85E325429D12516A"><enum>(i)</enum><text>farmers’ markets and other direct-to-consumer markets, military commissaries, nonprofit food buying cooperatives, and establishments, organizations, programs, or group living arrangements described in paragraphs (5), (7), and (8) of section 3(k); and</text></clause><clause commented="no" id="H5EDA344962AF40DABCB85EC64B1FD88C"><enum>(ii)</enum><text>establishments described in paragraphs (3), (4), and (9) of section 3(k), other than restaurants participating in a State option restaurant program.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="HDBE18C4747D0401EB75047E2DD2D38BF"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H46E3E6BC4E534232AF6F4E8B0B1B7A24" style="OLC"><paragraph commented="no" id="HED829F29DB7741D18E843739F58E658E"><enum>(4)</enum><header>Termination of manual vouchers</header><subparagraph commented="no" id="HCC0EDD785B3C4E918D6DD1DA35A6C2D3"><enum>(A)</enum><header>In general</header><text>Effective beginning on the effective date of this paragraph, except as provided in subparagraph (B), no State shall issue manual vouchers to a household that receives supplemental nutrition assistance under this Act or allow retailers to accept manual vouchers as payment, unless the Secretary determines that the manual vouchers are necessary, such as in the event of an electronic benefit transfer system failure or a disaster situation.</text></subparagraph><subparagraph commented="no" id="H6B5D0C6541BF458FBC379198762A1047"><enum>(B)</enum><header>Exemptions</header><text>The Secretary may exempt categories of retailers or individual retailers from subparagraph (A) based on criteria established by the Secretary.</text></subparagraph></paragraph><paragraph commented="no" id="H9CD80AAE87B1428CBBD7D5C43DA94BD5"><enum>(5)</enum><header>Unique identification number required</header><text display-inline="yes-display-inline">In an effort to enhance the antifraud protections of the program, the Secretary shall require all parties providing electronic benefit transfer services to provide for and maintain a unique business identification and a unique terminal identification number information through the supplemental nutrition assistance program electronic benefit transfer transaction routing system. In developing the regulations implementing this paragraph, the Secretary shall consider existing commercial practices for other point-of-sale debit transactions. The Secretary shall issue proposed regulations implementing this paragraph not earlier than 2 years after the date of enactment of this paragraph.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="HB724226132A74257A00DA0C5FCE98768"><enum>(c)</enum><header>Electronic benefit transfers</header><text>Section 7(h)(3)(B) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2016">7 U.S.C. 2016(h)(3)(B)</external-xref>) is amended by striking <quote>is operational—</quote> and all that follows through <quote>(ii) in the case of other participating stores,</quote> and inserting <quote>is operational</quote>.</text></subsection><subsection commented="no" id="HBD7A60F5C0784ACEA968346B43DB9CB4"><enum>(d)</enum><header>Approval of retail food stores and wholesale food concerns</header><text display-inline="yes-display-inline">Section 9 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2018">7 U.S.C. 2018</external-xref>) is amended—</text><paragraph id="H34489988BD9544F8AF4E0FB953F02EB2"><enum>(1)</enum><text display-inline="yes-display-inline">in the 2d sentence of subsection (a)(1) by striking <quote>; and (C)</quote> and inserting <quote>; (C) whether the applicant is located in an area with significantly limited access to food; and (D)</quote>; and</text></paragraph><paragraph id="H1316C952D9FB4913A2E46FEF175617D6"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H0DB8899CDFB64C49AD8709B83DF09680" style="OLC"><subsection id="H2634DFDA09AB4B838EA7BFF56F427DE5"><enum>(g)</enum><header>EBT service requirement</header><text display-inline="yes-display-inline">An approved retail food store shall provide adequate EBT service as described in section 7(h)(3)(B).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H0B0F6C02B0AC4BAAB30D5FED503C3E6B"><enum>103.</enum><header>Enhancing services to elderly and disabled supplemental nutrition assistance program participants</header><subsection display-inline="no-display-inline" id="HC7F581E71D35402CBA0B1F94A3F79F47"><enum>(a)</enum><header>Enhancing services to elderly and disabled program participants</header><text>Section 3(p) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(p)</external-xref>) is amended—</text><paragraph id="HB07C52BF1F824DD7B8096B121EF129BF"><enum>(1)</enum><text>in paragraph (3) by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H9F783A87AEB84FAF8FE8970F00213A71"><enum>(2)</enum><text>in paragraph (4) by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H78878E11802A408CA1AB550A62748092"><enum>(3)</enum><text>by inserting after paragraph (4) the following:</text><quoted-block id="H14EC9E3CAC9B4EB6A6A0EFE509F531DA" style="OLC"><paragraph id="H11C4927E8A6B43F98ABF3C0F64B9CFD3"><enum>(5)</enum><text>a governmental or private nonprofit food purchasing and delivery service that—</text><subparagraph id="H16E149626A0F47289E6151A03D35830D"><enum>(A)</enum><text>purchases food for, and delivers such food to, individuals who are—</text><clause id="HBAA187FEFCFD4B4B91CF28800D25D1BA"><enum>(i)</enum><text>unable to shop for food; and</text></clause><clause id="H1AA9C0A6E3F140F88510AEB3CEAC8056"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H28E4277F0B394908B0BA5B4CC4D94A60"><enum>(I)</enum><text>not less than 60 years of age; or</text></subclause><subclause id="H8D80FE6DB96749C198DCF8EDBAC1156C" indent="up1"><enum>(II)</enum><text>physically or mentally handicapped or otherwise disabled;</text></subclause></clause></subparagraph><subparagraph id="HCA6AD798C9E64CE19E0518D3D08CBEBF"><enum>(B)</enum><text>clearly notifies the participating household at the time such household places a food order—</text><clause id="H88DB7141493B46998717C2731F150540"><enum>(i)</enum><text>of any delivery fee associated with the food purchase and delivery provided to such household by such service; and</text></clause><clause id="H7A2EE893A7314971B7D1503102DFC4DC"><enum>(ii)</enum><text>that a delivery fee cannot be paid with benefits provided under supplemental nutrition assistance program; and</text></clause></subparagraph><subparagraph id="H42910EB17565476DAF5978B08693FDB2"><enum>(C)</enum><text>sells food purchased for such household at the price paid by such service for such food and without any additional cost markup.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB2CB496223CD405D81AD06CE7993FED1"><enum>(b)</enum><header>Implementation</header><paragraph id="H5143F43AE99E4F43B9BE31565ABB184E"><enum>(1)</enum><header>Issuance of rules</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall issue regulations that—</text><subparagraph id="HE14C8AD8985540FAB856975F78A7112C"><enum>(A)</enum><text>establish criteria to identify a food purchasing and delivery service referred to in section 3(p)(5) of the Food and Nutrition Act of 2008 as amended by this Act; and</text></subparagraph><subparagraph id="H5AED5B04E2284D6CBBCF834825A028B1"><enum>(B)</enum><text>establish procedures to ensure that such service—</text><clause id="H76853885F59B46FDA50192D0A01DD6CE"><enum>(i)</enum><text>does not charge more for a food item than the price paid by the such service for such food item;</text></clause><clause id="HBD1C5AEAD141467DB83AB438DFB3EF7E"><enum>(ii)</enum><text>offers food delivery service at no or low cost to households under such Act;</text></clause><clause id="H926E1D378D534A38B982D8DBF87E9AFC"><enum>(iii)</enum><text>ensures that benefits provided under the supplemental nutrition assistance program are used only to purchase food, as defined in section 3 of such Act;</text></clause><clause id="H7BDF49EFEE8942218DD1CF51AA7E4B72"><enum>(iv)</enum><text>limits the purchase of food, and the delivery of such food, to households eligible to receive services described in section 3(p)(5) of such Act as so amended;</text></clause><clause id="H69A32DD78D904EC2B8F89EC713187B1A"><enum>(v)</enum><text>has established adequate safeguards against fraudulent activities, including unauthorized use of electronic benefit cards issued under such Act; and</text></clause><clause id="HCDB9490CE1244E6DBFB02E2E3064038A"><enum>(vi)</enum><text>such other requirements as the Secretary deems to be appropriate.</text></clause></subparagraph></paragraph><paragraph id="HFFDDD66E18D049DFA6D686DB06D8DAA5"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Before the issuance of rules under paragraph (1), the Secretary of Agriculture may not approve more than 20 food purchasing and delivery services referred to in section 3(p)(5) of the Food and Nutrition Act of 2008 as amended by this Act, to participate as retail food stores under the supplemental nutrition assistance program.</text></paragraph></subsection></section><section id="H2F77A747E9FD4F8D8F7D350072AC6219"><enum>104.</enum><header>Food distribution program on Indian reservations</header><text display-inline="no-display-inline">Section 4(b)(6)(F) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2013">7 U.S.C. 2013(b)(6)(F)</external-xref>) is amended by striking <quote>2012</quote> and inserting <quote>2016</quote>.</text></section><section id="H3D000146E00E4F7F93282D9777F03146"><enum>105.</enum><header>Updating program eligibility</header><text display-inline="no-display-inline">Section 5 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014</external-xref>) is amended—</text><paragraph id="HB67B110155C2459D9DA6B644C89B1F01"><enum>(1)</enum><text display-inline="yes-display-inline">in the 2d sentence of subsection (a) by striking <quote>households in which each member receives benefits</quote> and inserting <quote>households in which each member receives cash assistance</quote>; and</text></paragraph><paragraph id="H68D9BE6B8143419893F1550E8C8854F8"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (j) by striking <quote>or who receives benefits under a State program</quote> and inserting <quote>or who receives cash assistance under a State program</quote>.</text></paragraph></section><section id="HDA361D6E524040568A0D5257CFB82A96"><enum>106.</enum><header>Exclusion of medical marijuana from excess medical expense deduction</header><text display-inline="no-display-inline">Section 5(e)(5) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(e)(5)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H40C4935526434620BE097843C23BF248" style="OLC"><subparagraph id="H0B0640BA58A04F54AEE07E54E642D9D8"><enum>(C)</enum><header>Exclusion of medical marijuana</header><text display-inline="yes-display-inline">The Secretary shall promulgate rules to ensure that medical marijuana is not treated as a medical expense for purposes of this paragraph.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H6E48E83B39AF48DF8E396D440555FA57"><enum>107.</enum><header>Standard utility allowances based on the receipt of energy assistance payments</header><subsection id="HF02D4AF8847D484D998B5127AEAFC04E"><enum>(a)</enum><header>Standard utility allowances in the supplemental nutrition assistance program</header><text display-inline="yes-display-inline">Section 5(e)(6)(C) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(e)(6)(C)</external-xref>) is amended—</text><paragraph id="H8BE2007FE3034B06BF68B8CB184F80F3"><enum>(1)</enum><text>in clause (i) by inserting <quote>, subject to clause (iv)</quote> after <quote>Secretary</quote>; and</text></paragraph><paragraph id="H6619D11F1C034556853D6F03B982A823"><enum>(2)</enum><text>by striking subclause (I) of clause (iv) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H08C5488F9B694950894424A45E65648C" style="OLC"><subclause id="HA691D7D1BF7C4A63B046C439DD388427"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II), if a State agency elects to use a standard utility allowance that reflects heating and cooling costs, the standard utility allowance shall be made available to households that received a payment, or on behalf of which a payment was made, under the Low-Income Home Energy Assistance Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/8621">42 U.S.C. 8621 et seq.</external-xref>) or other similar energy assistance program, if in the current month or in the immediately preceding 12 months, the household either received such payment, or such payment was made on behalf of the household, that was greater than $20 annually, as determined by the Secretary.</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph></subsection><subsection display-inline="no-display-inline" id="HDE8883F749DF4AEAADF1AF4656A4D483"><enum>(b)</enum><header>Conforming amendment</header><text>Section 2605(f)(2)(A) of the Low-Income Home Energy Assistance Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/8624">42 U.S.C. 8624(f)(2)(A)</external-xref>) is amended by inserting before the semicolon the following: <quote>, except that, for purposes of the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>), such payments or allowances were greater than $20 annually, consistent with section 5(e)(6)(C)(iv)(I) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(e)(6)(C)(iv)(I)</external-xref>), as determined by the Secretary of Agriculture</quote>.</text></subsection><subsection id="HE2149D1F34CC4C6B9CE2ABAE78E79987"><enum>(c)</enum><header>Effective date and implementation</header><paragraph id="H4E1A8ED1955B41A9883F48D896833B59"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), this section and the amendments made by this section shall take effect on October 1, 2013, and shall apply with respect to certification periods that begin after such date.</text></paragraph><paragraph id="HD3849150BF8C49BDA02669096AC20D83"><enum>(2)</enum><header>State option to delay implementation for current recipients</header><text>A State may, at the option of the State, implement a policy that eliminates or reduces the effect of the amendments made by this section on households that received a standard utility allowance as of the date of enactment of this Act, for not more than a 180-day period that begins on the date on which such amendments would otherwise apply to the respective household.</text></paragraph></subsection></section><section id="HC7FF3250C3B24FE28592E22D1F119204"><enum>108.</enum><header>Eligibility disqualifications</header><text display-inline="no-display-inline">Section 6(e)(3)(B) of Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015(e)(3)(B)</external-xref>) is amended by striking <quote>section;</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H8E337B5C812E460190F3A60AD39BAEB1" style="OLC"><subparagraph id="HB50F61AD34DB4F3DBCF4AF8F5ABF268C"><enum></enum><text>section, subject to the condition that the course or program of study—</text><clause id="H570A3446C25542C18B82DFE82D25A704"><enum>(i)</enum><text>is part of a program of career and technical education (as defined in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>)) that may be completed in not more than 4 years at an institution of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)); or</text></clause><clause id="H375377D092694C5F9373247CB94FAAEE"><enum>(ii)</enum><text>is limited to remedial courses, basic adult education, literacy, or English as a second language;</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section display-inline="no-display-inline" id="HF3C2BA222DCF46CA8155089A98A502AB" section-type="subsequent-section"><enum>109.</enum><header>Repeal of State work program waiver authority</header><text display-inline="no-display-inline">Section 6(o) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015(o)</external-xref>) is amended—</text><paragraph id="H5F3FAB600BD54A59B3433F24B129CC93"><enum>(1)</enum><text>in paragraph (2)(D) by striking <quote>(5), or (6)</quote> and inserting <quote>or (5)</quote>;</text></paragraph><paragraph id="HC50F60CDEF454285BF6F99D97316EEA9"><enum>(2)</enum><text>by striking paragraph id="H876B29C8AB094066BB3BB35937F5266D"><enum>(H)</enum><header>Fiscal year 2014 and thereafter</header><text display-inline="yes-display-inline">Subject to subparagraph (G), for fiscal year 2014 and each subsequent fiscal year, a State agency may provide a number of exemptions such that the average monthly number of the exemptions in effect during the fiscal year does not exceed 15 percent of the number of individuals identified as <quote>Nondisabled Adults Age 18–49 in Childless Households</quote> in the table <quote>B.5 Distribution of Participating Households by Household Composition and by State</quote> of the report entitled Characteristics of Supplemental Nutrition Assistance Program Households: Fiscal Year 2011 (Supplemental Nutrition Assistance Program Report No. SNAP–12–CHAR) prepared for and published by the Office of Research and Analysis of the Food and Nutrition Service of the Department of Agriculture in November 2012.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA0BDBFAC59CE4CD5BE5EEB21ADCF53CA"><enum>(4)</enum><text>by redesignating paragraphs (5), (6), and (7) as paragraphs (4), (5), and (6), respectively.</text></paragraph></section><section display-inline="no-display-inline" id="H1C9B1163233B4F87926A79DB2843347B"><enum>110.</enum><header>Ending supplemental nutrition assistance program benefits for lottery or gambling winners</header><subsection id="HF198A61072CA4C7AAD93D3091FF413A8"><enum>(a)</enum><header>In general</header><text>Section 6 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HBBF5AA27F16B460EBF7892B9F47318DF" style="OLC"><subsection id="HDA5CD2B06F3946238987365BE9E50201"><enum>(r)</enum><header>Ineligibility for benefits due to receipt of substantial lottery or gambling winnings</header><paragraph id="H1CDAF4F4673047618D1C5AAFE4957676"><enum>(1)</enum><header>In general</header><text>Any household in which a member receives substantial lottery or gambling winnings, as determined by the Secretary, shall lose eligibility for benefits immediately upon receipt of the winnings.</text></paragraph><paragraph id="H1016B6FCC8A44A3F90050A96FDBA6D33"><enum>(2)</enum><header>Duration of ineligibility</header><text>A household described in paragraph (1) shall remain ineligible for participation until the household meets the allowable financial resources and income eligibility requirements under subsections (c), (d), (e), (f), (g), (i), (k), (l), (m), and (n) of section 5.</text></paragraph><paragraph id="H0AF7DF531849448289F1A4FD192E8224"><enum>(3)</enum><header>Agreements</header><text>As determined by the Secretary, each State agency, to the maximum extent practicable, shall establish agreements with entities responsible for the regulation or sponsorship of gaming in the State to determine whether individuals participating in the supplemental nutrition assistance program have received substantial lottery or gambling winnings.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2880B10A3F444FA3925D1262D70D96B1"><enum>(b)</enum><header>Conforming amendments</header><text>Section 5(a) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(a)</external-xref>) is amended in the 2d sentence by striking <quote>sections 6(b), 6(d)(2), and 6(g)</quote> and inserting <quote>subsections (b), (d)(2), (g), and (r) of section 6</quote>.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H88E15AE9BA664235BD3B00422585CB98" section-type="subsequent-section"><enum>111.</enum><header>Improving security of food assistance</header><text display-inline="no-display-inline">Section 7(h)(8) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2016">7 U.S.C. 2016(h)(8)</external-xref>) is amended—</text><paragraph id="H2E0F5B3227874343BA929326D9646B3D"><enum>(1)</enum><text>in the heading by striking <quote><header-in-text level="paragraph" style="OLC">card fee</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">of cards</header-in-text></quote>;</text></paragraph><paragraph id="HFFFB04ECD4A04EABB5F9448FBB431A60"><enum>(2)</enum><text>by striking <quote>A State</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H8A8F68FC9AF54C2F8F5D430AAE4A47A8" style="OLC"><subparagraph id="H57EC8C2311784175902F0112BA4A9970"><enum>(A)</enum><header>Fees</header><text>A State</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HD2396FC99035412AAE4F4AA051E0994F"><enum>(3)</enum><text>by adding after subparagraph (A) (as so designated by paragraph (2)) the following:</text><quoted-block display-inline="no-display-inline" id="H5F4EB73A91174AF5B607AFFBEA28262D" style="OLC"><subparagraph id="H84D1CB741C9245F7BC735503229523A6"><enum>(B)</enum><header>Purposeful loss of cards</header><clause id="HC1285FAE2A9C426D949CA99FC2CA28E5"><enum>(i)</enum><header>In general</header><text>Subject to terms and conditions established by the Secretary in accordance with clause (ii), if a household makes excessive requests for replacement of the electronic benefit transfer card of the household, the Secretary may require a State agency to decline to issue a replacement card to the household unless the household, upon request of the State agency, provides an explanation for the loss of the card.</text></clause><clause id="H2ECFDD35809044ED85CED4A105C23BBA"><enum>(ii)</enum><header>Requirements</header><text>The terms and conditions established by the Secretary shall provide that—</text><subclause id="HF37B4AF1E79348538C3EB12B54F791FD"><enum>(I)</enum><text>the household be given the opportunity to provide the requested explanation and meet the requirements under this paragraph promptly;</text></subclause><subclause id="H6AE9B211D4E74BCE82FE2515FD7A9E48"><enum>(II)</enum><text>after an excessive number of lost cards, the head of the household shall be required to review program rights and responsibilities with State agency personnel authorized to make determinations under section 5(a); and</text></subclause><subclause id="HCBD9E02F4A7849769AA03FC45995B676"><enum>(III)</enum><text>any action taken, including actions required under section 6(b)(2), other than the withholding of the electronic benefit transfer card until an explanation described in subclause (I) is provided, shall be consistent with the due process protections under section 6(b) or 11(e)(10), as appropriate.</text></subclause></clause></subparagraph><subparagraph id="H5C755F3EA6094FD6B0E93854695BE1F6"><enum>(C)</enum><header>Protecting vulnerable persons</header><text>In implementing this paragraph, a State agency shall act to protect homeless persons, persons with disabilities, victims of crimes, and other vulnerable persons who lose electronic benefit transfer cards but are not intentionally committing fraud.</text></subparagraph><subparagraph id="H8B33ED4030DE4A9C9832AAB6411D720D"><enum>(D)</enum><header>Effect on eligibility</header><text>While a State may decline to issue an electronic benefits transfer card until a household satisfies the requirements under this paragraph, nothing in this paragraph shall be considered a denial of, or limitation on, the eligibility for benefits under section 5.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HC5D414EEB7984C10990F018942B2323D"><enum>112.</enum><header>Demonstration projects on acceptance of benefits of mobile transactions</header><text display-inline="no-display-inline">Section 7(h) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2016">7 U.S.C. 2016(h)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HA167030D7A3E4A06B3DAEDC24B782AE8"><paragraph id="HBBB7A6C801224E9C8DD54ACD40A5177B"><enum>(14)</enum><header>Demonstration projects on acceptance of benefits of mobile transactions</header><subparagraph id="H47A4D24AC69A490DB06769D94D88C05E"><enum>(A)</enum><header>In general</header><text>The Secretary shall pilot the use of mobile technologies determined by the Secretary to be appropriate to test the feasibility and implications for program integrity, by allowing retail food stores, farmers markets, and other direct producer-to-consumer marketing outlets to accept benefits from recipients of supplemental nutrition assistance through mobile transactions.</text></subparagraph><subparagraph id="H36E0A86B016E496D835508FE393024D5"><enum>(B)</enum><header>Demonstration projects</header><text>To be eligible to participate in a demonstration project under subsection (a), a retail food store, farmers market, or other direct producer-to-consumer marketing outlet shall submit to the Secretary for approval a plan that includes—</text><clause id="H99A637C855DB44BE9D70A5E3C936B392"><enum>(i)</enum><text>a description of the technology;</text></clause><clause id="HC75D5F113B364CDB8E3ACA6186D2F466"><enum>(ii)</enum><text>the manner by which the retail food store, farmers market or other direct producer-to-consumer marketing outlet will provide proof of the transaction to households;</text></clause><clause id="HBBD8466DAD66474CBCF7C0AA53898AC6"><enum>(iii)</enum><text>the provision of data to the Secretary, consistent with requirements established by the Secretary, in a manner that allows the Secretary to evaluate the impact of the demonstration on participant access, ease of use, and program integrity; and</text></clause><clause id="HDF03111B5A1E42BCA989C1B64954CC8B"><enum>(iv)</enum><text>such other criteria as the Secretary may require.</text></clause></subparagraph><subparagraph id="HE12016BFF8884314996CB1E0E6F2171A"><enum>(C)</enum><header>Date of completion</header><text>The demonstration projects under this paragraph shall be completed and final reports submitted to the Secretary by not later than July 1, 2016.</text></subparagraph><subparagraph id="H176665356CEE4E72805A43074269CCD4"><enum>(D)</enum><header>Report to congress</header><text>The Secretary shall submit a report to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate that includes a finding, based on the data provided under subparagraph (C) whether or not implementation in all States is in the best interest of the supplemental nutrition assistance program.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H7667BF11F8414415A062F9465470760C"><enum>113.</enum><header>Use of benefits for purchase of community-supported agriculture share</header><text display-inline="no-display-inline">Section 10 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2019">7 U.S.C. 2019</external-xref>) is amended in the 1st sentence by inserting <quote>agricultural producers who market agricultural products directly to consumers shall be authorized to redeem benefits for the initial cost of the purchase of a community-supported agriculture share,</quote> after <quote>food so purchased,</quote>.</text></section><section commented="no" id="H08DEF5C9470A497CB0D7E1B6DF342A51"><enum>114.</enum><header>Restaurant meals program</header><subsection commented="no" id="HD558344CA16B4216BDD6C1318A7C6AD7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 11(e) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020(e)</external-xref>) is amended—</text><paragraph commented="no" id="H06E0927AE4FB41139AF230B7F9E53B17"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (22) by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" id="H667F3CA43FDA472994C3863F18D0F976"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (23)(C) by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" id="HCCEBE6FB43B14C69BFB84B80DE841832"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H2D8B3136E1624149B753AB4F367B0D42" style="OLC"><paragraph commented="no" id="HBBE121F02690428DB8F9AFFA2BE6E7A5"><enum>(24)</enum><text display-inline="yes-display-inline">if the State elects to carry out a program to contract with private establishments to offer meals at concessional prices, as described in paragraphs (3), (4), and (9) of section 3(k)—</text><subparagraph commented="no" id="H1E3CC172067E488DA5678847498B2FD2"><enum>(A)</enum><text display-inline="yes-display-inline">the plans of the State agency for operating the program, including—</text><clause commented="no" id="HAE4768E822254ED4B3FF7EC6F829187A"><enum>(i)</enum><text>documentation of a need that eligible homeless, elderly, and disabled clients are underserved in a particular geographic area;</text></clause><clause commented="no" id="H217438C60A3D494FA002F20B8E72C0B4"><enum>(ii)</enum><text>the manner by which the State agency will limit participation to only those private establishments that the State determines necessary to meet the need identified in clause (i); and</text></clause><clause commented="no" id="HDAE270E06C2849D2909F1661EE58EBA5"><enum>(iii)</enum><text>any other conditions the Secretary may prescribe, such as the level of security necessary to ensure that only eligible recipients participate in the program; and</text></clause></subparagraph><subparagraph commented="no" id="HBAFEB70AD3C54CABAE8A5A718270019A"><enum>(B)</enum><text>a report by the State agency to the Secretary annually, the schedule of which shall be established by the Secretary, that includes—</text><clause commented="no" id="H55CF1C06C13140A195F77139D28D83C1"><enum>(i)</enum><text>the number of households and individual recipients authorized to participate in the program, including any information on whether the individual recipient is elderly, disabled, or homeless; and</text></clause><clause commented="no" id="H48093E91CF7B4568A159D50FAD801B09"><enum>(ii)</enum><text>an assessment of whether the program is meeting an established need, as documented under subparagraph (A)(i).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H9CAC524CF36948F1A92E370DB839C33A"><enum>(b)</enum><header>Approval of retail food stores and wholesale food concerns</header><text>Section 9 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2018">7 U.S.C. 2018</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HDF7FBC7CD12141C580A8F621FEE3D814" style="OLC"><subsection commented="no" id="H46580EF961AD41DB8A7861FED60BE549"><enum>(h)</enum><header>Private establishments</header><paragraph commented="no" id="H1CA1E0CC66D14CECBFE1D819AB2C199E"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), no private establishment that contracts with a State agency to offer meals at concessional prices as described in paragraphs (3), (4), and (9) of section 3(k) may be authorized to accept and redeem benefits unless the Secretary determines that the participation of the private establishment is required to meet a documented need in accordance with section 11(e)(24).</text></paragraph><paragraph commented="no" id="H5E9D7E9FA8F8413797B18CA4A23A226C"><enum>(2)</enum><header>Existing contracts</header><subparagraph commented="no" id="H8F8227A17AA74FC79E50211A99BA29FB"><enum>(A)</enum><header>In general</header><text>If, on the day before the effective date of this subsection, a State has entered into a contract with a private establishment described in paragraph (1) and the Secretary has not determined that the participation of the private establishment is necessary to meet a documented need in accordance with section 11(e)(24), the Secretary shall allow the operation of the private establishment to continue without that determination of need for a period not to exceed 180 days from the date on which the Secretary establishes determination criteria, by regulation, under section 11(e)(24).</text></subparagraph><subparagraph commented="no" id="H142FCC4C844E40208637A365B3CD79A6"><enum>(B)</enum><header>Justification</header><text>If the Secretary determines to terminate a contract with a private establishment that is in effect on the effective date of this subsection, the Secretary shall provide justification to the State in which the private establishment is located for that termination.</text></subparagraph></paragraph><paragraph commented="no" id="H426CC595C72741D09264F4A2C4379F44"><enum>(3)</enum><header>Report to Congress</header><text>Not later than 90 days after September 30, 2014, and 90 days after the last day of each fiscal year thereafter, the Secretary shall report to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate on the effectiveness of a program under this subsection using any information received from States under section 11(e)(24) as well as any other information the Secretary may have relating to the manner in which benefits are used.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="HE0B21F8C25174DFB88F788FE5AB8079C"><enum>(c)</enum><header>Conforming amendments</header><text>Section 3(k) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(k)</external-xref>) is amended by inserting <quote>subject to section 9(h)</quote> after <quote>concessional prices</quote> each place it appears.</text></subsection></section><section id="HBC26E73512BD4BB68C9D593D788517BE"><enum>115.</enum><header>Mandating State immigration verification</header><text display-inline="no-display-inline">Section 11(p) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020(p)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H62A18E72C4B2446AB56742E087F61DB5" style="OLC"><subsection id="H5CB916DAD6CB4A299A0BCFA8FFF58F03"><enum>(p)</enum><header>State verification option</header><text display-inline="yes-display-inline">In carrying out the supplemental nutrition assistance program, a State agency shall be required to use an income and eligibility, or an immigration status, verification system established under section 1137 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-7">42 U.S.C. 1320b–7</external-xref>), in accordance with standards set by the Secretary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H920F38241D914C8E98D34C277CB9C2F7"><enum>116.</enum><header>Data exchange standardization for improved interoperability</header><subsection id="H5802C647A50A42119D2C27CBE1A7C318"><enum>(a)</enum><header>Data exchange standardization</header><text>Section 11 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H740BECF9D28A4A46963BC65FFC68D03E" style="OLC"><subsection id="H0DCC47FB90064DE4999B76B142540993"><enum>(v)</enum><header>Data exchange standards for improved interoperability</header><paragraph id="H45B3DA90400C4E579242785C711CAABB"><enum>(1)</enum><header>Designation</header><text>The Secretary shall, in consultation with an interagency work group established by the Office of Management and Budget, and considering State government perspectives, designate data exchange standards to govern, under this part—</text><subparagraph id="HA0FBC38CE16D4F4996CF43D5341A9378"><enum>(A)</enum><text>necessary categories of information that State agencies operating such programs are required under applicable law to electronically exchange with another State agency; and</text></subparagraph><subparagraph id="HBDFE67F645C344A09B67A0F06C01EAF4"><enum>(B)</enum><text>Federal reporting and data exchange required under applicable law.</text></subparagraph></paragraph><paragraph id="H48F4F73DFA1241A2B33DF4A6675A9BE5"><enum>(2)</enum><header>Requirements</header><text>The data exchange standards required by paragraph (1) shall, to the extent practicable—</text><subparagraph id="HF7734BB6BC7A4DCBAD87FEC1475C9A71"><enum>(A)</enum><text>incorporate a widely accepted, non-proprietary, searchable, computer-readable format, such as the eXtensible Markup Language;</text></subparagraph><subparagraph id="HAFEE467B6EC64BEF8DCC9E6698659E0D"><enum>(B)</enum><text>contain interoperable standards developed and maintained by intergovernmental partnerships, such as the National Information Exchange Model;</text></subparagraph><subparagraph id="H185650E6865242058EB98DB035E1EA47"><enum>(C)</enum><text>incorporate interoperable standards developed and maintained by Federal entities with authority over contracting and financial assistance;</text></subparagraph><subparagraph id="HD6BDB4786717461197513A0160ACEEDD"><enum>(D)</enum><text>be consistent with and implement applicable accounting principles;</text></subparagraph><subparagraph id="HB979FAF4CFFA4492BE15556A1E1CD128"><enum>(E)</enum><text>be implemented in a manner that is cost-effective and improves program efficiency and effectiveness; and</text></subparagraph><subparagraph id="HAECE59EFB5A549049FFCF958A20804C1"><enum>(F)</enum><text>be capable of being continually upgraded as necessary.</text></subparagraph></paragraph><paragraph id="H58DBFF1DAED84E2F95FB724DEE8F630C"><enum>(3)</enum><header>Rules of construction</header><text>Nothing in this subsection shall be construed to require a change to existing data exchange standards for Federal reporting found to be effective and efficient.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD4B6CB6BE67540898FEAAF421CC6B2D5"><enum>(b)</enum><header>Effective Date</header><text>The Secretary shall issue a proposed rule within 24 months after the date of the enactment of this Act. The rule shall identify federally required data exchanges, include specification and timing of exchanges to be standardized, and address the factors used in determining whether and when to standardize data exchanges. It should also specify state implementation options and describe future milestones.</text></subsection></section><section id="H8F3F7EA9168F4EFF924E0E6A028A968D"><enum>117.</enum><header>Pilot projects to improve Federal-State cooperation in identifying and reducing fraud in the supplemental nutrition assistance program</header><text display-inline="no-display-inline">Section 12 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2021">7 U.S.C. 2021</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HC905382CAD624CDAAC31E16EC1481FD3" style="OLC"><subsection id="H85899282FEA640D896B22A3654C2EBD9"><enum>(i)</enum><header>Pilot projects To improve Federal-State cooperation in identifying and reducing fraud in the supplemental nutrition assistance program</header><paragraph id="H07DFF734420047E6B76A06C6BA975B7B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall carry out, under such terms and conditions as determined by the Secretary, pilot projects to test innovative Federal-State partnerships to identify, investigate, and reduce retailer fraud in the supplemental nutrition assistance program, including allowing States to operate retail Food Store investigation programs. At least 1 such pilot project shall be carried out in an urban area that is among the 10 largest urban areas in the United States (based on population) if the supplemental nutrition assistance program is separately administered in such area and if the administration of such program in such area complies with the other applicable requirements of such program.</text></paragraph><paragraph id="H4EF4E06227B345D48AC96C080DBB6FB3"><enum>(2)</enum><header>Selection criteria</header><text>Pilot projects shall be selected based on criteria the Secretary establishes, which shall include—</text><subparagraph id="HD56DDA6A1DC74A10AFDBBE4B7A9ED03E"><enum>(A)</enum><text>enhancing existing efforts by the Secretary to reduce retailer fraud;</text></subparagraph><subparagraph id="H80BDFC7419514054BBC86AA8A1F4DDAD"><enum>(B)</enum><text>requiring participant States to maintain their overall level of effort at addressing recipient fraud, as determined by the Secretary, prior to participation in the pilot project;</text></subparagraph><subparagraph id="H809E5DF91C404D99BE4217CCF84EE343"><enum>(C)</enum><text>collaborating with other law enforcement authorities as necessary to carry out an effective pilot project;</text></subparagraph><subparagraph id="HB77C17B6BD214EDD8549AE6B033C2B58"><enum>(D)</enum><text>commitment of the participant State agency to follow Federal rules and procedures with respect to retailer investigations; and</text></subparagraph><subparagraph id="H0873C84441D14A679442437AB2A3EC53"><enum>(E)</enum><text>the extent to which a State has committed resources to recipient fraud and the relative success of those efforts.</text></subparagraph></paragraph><paragraph id="HC2A69D8E6D984F4D92023599BCFD4E61"><enum>(3)</enum><header>Evaluation</header><subparagraph id="HAAEFEE9788874C629DE1B1069ACF592D"><enum>(A)</enum><text>The Secretary shall evaluate the projects selected under this subsection to measure the impact of the pilot projects.</text></subparagraph><subparagraph id="H39EE8C512482419C8A6E23C46C19EC90"><enum>(B)</enum><text>Such evaluation shall include—</text><clause id="H3F303907DCE643ABA5F27B690D82AB9D"><enum>(i)</enum><text>each pilot project’s impact on increasing the Secretary’s capacity to address retailer fraud;</text></clause><clause id="H9C2BFBF57A1644F0A4DCA7FDEDBF4477"><enum>(ii)</enum><text>the effectiveness of the pilot projects in identifying, preventing and reducing retailer fraud; and</text></clause><clause id="H2E566CF08ECA45078C844F298116ED97"><enum>(iii)</enum><text>the cost effectiveness of such pilot projects.</text></clause></subparagraph></paragraph><paragraph id="H6DBACEF2E7B44A07BA7A28B0C1CB5434"><enum>(4)</enum><header>Report to congress</header><text>Not later than September 30, 2017, the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition and Forestry of the Senate, a report that includes a description of the results of each pilot project, including an evaluation of the impact of the project on retailer fraud and the costs associated with each pilot project.</text></paragraph><paragraph id="H4EF84DD73867488EA990BFE9740B1E63"><enum>(5)</enum><header>Funding</header><text>Any costs incurred by the State to operate the pilot projects in excess of the amount expended under this Act for retailer fraud in the respective State in the previous fiscal year shall not be eligible for Federal reimbursement under this Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HFA607B6248C8449F8A4CD5564928985A"><enum>118.</enum><header>Prohibiting government-sponsored recruitment activities</header><subsection id="H1112A19504A24E1BA0786D9BAB9935BB"><enum>(a)</enum><header>Administrative cost-Sharing and quality control</header><text display-inline="yes-display-inline">Section 16(a)(4) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2025">7 U.S.C. 2025(a)(4)</external-xref>) is amended by inserting after <quote>recruitment activities</quote> the following: <quote>designed to persuade an individual to apply for program benefits or that promote the program via television, radio, or billboard advertisements</quote>.</text></subsection><subsection id="HB85D6FD84F574F7DBC1ED0CE553F8FAD"><enum>(b)</enum><header>Limitation on use of funds authorized To be appropriated under Act</header><text display-inline="yes-display-inline">Section 18 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2027">7 U.S.C. 2027</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HE308DCB14CBF42F2BEFD89F8FAA47A6F" style="OLC"><subsection id="HED8248DF1DDC4C97838FF7077DC5DC42"><enum>(g)</enum><header>Ban on recruitment and promotion activities</header><paragraph commented="no" display-inline="yes-display-inline" id="HF4BB158C0DEB4720B55DA612C5ED4EED"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided in paragraph (2), no funds authorized to be appropriated under this Act shall be used by the Secretary for—</text><subparagraph id="H8CBEC10E08F746918F8EEC67C1C55B32" indent="up1"><enum>(A)</enum><text>recruitment activities designed to persuade an individual to apply for supplemental nutrition assistance program benefits;</text></subparagraph><subparagraph id="HE6A5718E8C024BA8875BA841F6346779" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">television, radio, or billboard advertisements that are designed to promote supplemental nutrition assistance program benefits and enrollment; or</text></subparagraph><subparagraph id="H7EB635B028F14FC3A3C05F589CE27E54" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">any agreements with foreign governments designed to promote supplemental nutrition assistance program benefits and enrollment.</text></subparagraph></paragraph><paragraph id="H4CA58E82B84A4BA4B87173447654BB6F" indent="up1"><enum>(2)</enum><text>Paragraph (1)(B) shall not apply to programmatic activities undertaken with respect to benefits made available in response to a natural disaster.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H99CA71A0CAC24757BDF8ECAD2D3A5F97"><enum>(c)</enum><header>Ban on recruitment activities by entities that receive funds</header><text display-inline="yes-display-inline">Section 18 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2027">7 U.S.C. 2027</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HBD6B488AD4E64EBAAAF4AF1D5A9B3C83" style="OLC"><subsection id="H9C8965DEA0604ECFB9672E631DF60EB9"><enum>(h)</enum><header>Ban on recruitment by entities that receive funds</header><text display-inline="yes-display-inline">The Secretary shall issue regulations that forbid entities that receive funds under this Act to compensate any person for conducting outreach activities relating to participation in, or for recruiting individuals to apply to receive benefits under, the supplemental nutrition assistance program if the amount of such compensation would be based on the number of individuals who apply to receive such benefits.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" id="HE930128E64B64A51A8F29E64E3D36E77"><enum>119.</enum><header>Repeal of bonus program</header><text display-inline="no-display-inline">Section 16(d) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2025">7 U.S.C. 2025(d)</external-xref>) is repealed.</text></section><section commented="no" id="HAC6349FEB9104CD596B1BCADDD92ACEF"><enum>120.</enum><header>Funding of employment and training programs</header><text display-inline="no-display-inline">Section 16(h)(1)(A) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2025">7 U.S.C. 2025(h)(1)(A)</external-xref>) is amended by striking <quote>$90,000,000</quote> and all that follows through <quote>$79,000,000</quote>, and inserting <quote>$79,000,000 for each fiscal year</quote>.</text></section><section id="HC52E4FD947C6478D83BB802640302B52"><enum>121.</enum><header>Monitoring employment and training programs</header><subsection id="H8C64AF54A5D3421E9AAA1DD2000D9034"><enum>(a)</enum><header>Reporting measures</header><text>Section 16(h)(5) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2025">7 U.S.C. 2025(h)(5)</external-xref>) is amended to read:</text><quoted-block id="H481A8CFF3C1D411483CA036C107BA526" style="OLC"><paragraph id="HF62C42EF81B34D629D90215AEF0A9920"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H939072C628AD43C0954D4753313FF44F"><enum>(A)</enum><header>In general</header><text>The Secretary shall monitor the employment and training programs carried out by State agencies under section 6(d)(4) and assess their effectiveness in—</text><clause id="H5857AEAA5BB7430D960A69F8FAE2EAFD" indent="up1"><enum>(i)</enum><text>preparing members of households participating in the supplemental nutrition assistance program for employment, including the acquisition of basic skills necessary for employment; and</text></clause><clause id="H978F1AAA7ECD4EF590901217EBB0381B" indent="up1"><enum>(ii)</enum><text>increasing the numbers of household members who obtain and retain employment subsequent to their participation in such employment and training programs.</text></clause></subparagraph><subparagraph id="H3BE5599EB7C340168E046236B26F416B" indent="up1"><enum>(B)</enum><header>Reporting measures</header><text>The Secretary, in consultation with the Secretary of Labor, shall develop reporting measures that identify improvements in the skills, training education or work experience of members of households participating in the supplemental nutrition assistance program. Measures shall be based on common measures of performance for federal workforce training programs, so long as they reflect the challenges facing the types of members of households participating in the supplemental nutrition assistance program who participate in a specific employment and training component. The Secretary shall require that each State employment and training plan submitted under section 11(e)(19) identify appropriate reporting measures for each of their proposed components that serve at least 100 people. Such measures may include:</text><clause id="HF1972F409FB5427784D542A6BFD84E8A"><enum>(i)</enum><text>the percentage and number of program participants who received employment and training services and are in unsubsidized employment subsequent to the receipt of those services;</text></clause><clause id="HDBC8C1C5EB6B4BB3989B86A2AF4E9EC2"><enum>(ii)</enum><text>the percentage and number of program participants who obtain a recognized postsecondary credential, including a registered apprenticeship, or a regular secondary school diploma or its recognized equivalent, while participating in or within 1 year after receiving employment and training services;</text></clause><clause id="H25B55BCB56AF43179F266998E8919DE9"><enum>(iii)</enum><text>the percentage and number of program participants who are in an education or training program that is intended to lead to a recognized postsecondary credential, including a registered apprenticeship or on-the-job training program, a regular secondary school diploma or its recognized equivalent, or unsubsidized employment;</text></clause><clause id="HEC5584427C874352B9403CD3B268BBD4"><enum>(iv)</enum><text>subject to the terms and conditions set by the Secretary, measures developed by each State agency to assess the skills acquisition of employment and training program participants that reflect the goals of their specific employment and training program components, which may include, but are not limited to—</text><subclause id="H05E875011A964DE8B45C6987A5F7B9BD"><enum>(I)</enum><text>the percentage and number of program participants who are meeting program requirements in each component of the State’s education and training program; and</text></subclause><subclause id="HA960D7998A444776BCAB28E8D39D513D"><enum>(II)</enum><text>the percentage and number of program participants who are gaining skills likely to lead to employment as measured through testing, quantitative or qualitative assessment or other method; and</text></subclause></clause><clause id="HA9669DEC70D54624AFD2C65AD478E22A"><enum>(v)</enum><text>other indicators as approved by the Secretary.</text></clause></subparagraph><subparagraph id="H8DAFEC2B2614453486E9BE3731713C28" indent="up1"><enum>(C)</enum><header>State report</header><text>Each State agency shall annually prepare and submit to the Secretary a report on the State’s employment and training program that includes the numbers of supplemental nutrition assistance program participants who have gained skills, training, work or experience that will increase their ability to obtain regular employment using measures identified in subparagraph (B).</text></subparagraph><subparagraph id="HD1974ADC10944414B5D92CD04FF8FBE1" indent="up1"><enum>(D)</enum><header>Modifications to the state employment and training plan</header><text>Subject to the terms and conditions established by the Secretary, if the Secretary determines that the state agency’s performance with respect to employment and training outcomes is inadequate, the Secretary may require the State agency to make modifications to their employment and training plan to improve such outcomes.</text></subparagraph><subparagraph id="HB63C721F4C8D41D78628C816328DDF04" indent="up1"><enum>(E)</enum><header>Periodic evaluation</header><clause id="HE1F80BA000404282A6499A97E71DAD56"><enum>(i)</enum><header>In general</header><text>Subject to terms and conditions established by the Secretary, not later than October 1, 2016, and not less frequently than once every 5 years thereafter, the Secretary shall conduct a study to review existing practice and research to identify employment and training program components and practices that—</text><subclause id="H41DF050F17914B14876787C539105F94"><enum>(I)</enum><text>effectively assist members of households participating in the supplemental nutrition assistance program in gaining skills, training, work, or experience that will increase their ability to obtain regular employment, and</text></subclause><subclause id="HFB4855A90633410F8E25D0C3A55EFDA6"><enum>(II)</enum><text>are best integrated with statewide workforce development systems.</text></subclause></clause><clause id="H854C6702E9134A519E947D2A64B039D6"><enum>(ii)</enum><header>Report to congress</header><text>The Secretary shall submit a report that describes the results of the study under clause (i) to the Committee on Agriculture in the House of Representatives, and the Committee on Agriculture, Nutrition and Forestry in the Senate.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA093139B59F54978981D74800FAB281D"><enum>(b)</enum><header>Effective date</header><text>Notwithstanding section 4(c) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2013">7 U.S.C. 2013(a)</external-xref>), the Secretary shall issue interim final regulations implementing the amendment made by subsection (a) no later than 18 months after the date of enactment of this Act. States shall include such reporting measures in their employment and training plans for the 1st fiscal year thereafter that begins no sooner than 6 months after the date that such regulations are published.</text></subsection></section><section display-inline="no-display-inline" id="H845D2AB3B68641848D056C8F1E2D5988"><enum>122.</enum><header>Cooperation with program research and evaluation</header><text display-inline="no-display-inline">Section 17 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2026">7 U.S.C. 2026</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H5359E519AAA041A49FA756C0CD1AE612" style="OLC"><subsection id="H662FAE72B4F043D5A4AE64F40A67858D"><enum>(l)</enum><header>Cooperation with program research and evaluation</header><text>States, State agencies, local agencies, institutions, facilities such as data consortiums, and contractors participating in programs authorized under this Act shall cooperate with officials and contractors acting on behalf of the Secretary in the conduct of evaluations and studies under this Act and shall submit information at such time and in such manner as the Secretary may require.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H7EE40999D2594D6B9476CA7E9CFA4A4E"><enum>123.</enum><header>Pilot projects to reduce dependency and increase work effort in the supplemental nutrition assistance program</header><text display-inline="no-display-inline">Section 17 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2026">7 U.S.C. 2026</external-xref>), as amended by section 121, is amended by adding at the end the following:</text><quoted-block id="H926EC4752C8C4DEEA61D7A43A22D416A" style="OLC"><subsection id="HC96BD4DD19654972B4A345D18C57B5EC"><enum>(m)</enum><header>Pilot projects To reduce dependency and increase work effort in the supplemental nutrition assistance program</header><paragraph id="HF044ADA7E88748248E0B057753C47718"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out, under such terms and conditions as the Secretary considers to be appropriate, pilot projects to identify best practices for employment and training programs under this Act to raise the number of work registrants who obtain unsubsidized employment, increase their earned income, and reduce their reliance on public assistance, including but not limited to the supplemental nutrition assistance program.</text></paragraph><paragraph id="HF9721AE6E0B94827BCA362D314B2DB36"><enum>(2)</enum><header>Selection criteria</header><text>Pilot projects shall be selected based on criteria the Secretary establishes, that shall include—</text><subparagraph id="H0EBFE93DB10C44FBBE85E3820EE06BF5"><enum>(A)</enum><text>enhancing existing employment and training programs in the State;</text></subparagraph><subparagraph id="H59F760AD4FC24E5687D175841AD70D7B"><enum>(B)</enum><text>agreeing to participate in the evaluation described in paragraph (3), including making available data on participants’ employment activities and post-participation employment, earnings, and public benefit receipt;</text></subparagraph><subparagraph id="H7D695494F18A4B1AB553BF8A339A4B42"><enum>(C)</enum><text>collaborating with the State workforce board and other job training programs in the State and local area;</text></subparagraph><subparagraph id="HEB4DB00FBDEF4B8CAAD9223CD6661321"><enum>(D)</enum><text>the extent to which the pilot project’s components can be easily replicated by other States or political subdivisions; and</text></subparagraph><subparagraph id="H786CDFB5E545454E8E03C990AC97562F"><enum>(E)</enum><text>such additional criteria that ensure that the pilot projects—</text><clause id="HEC58EF16BC484080A8F83FB6D4ABCF3A"><enum>(i)</enum><text>target a variety of populations of work registrants, including childless adults, parents, and individuals with low skills or limited work experience;</text></clause><clause id="H61B2A3493E2C4F7E97A84BB272358299"><enum>(ii)</enum><text>are selected from a range of existing employment and training programs including programs that provide—</text><subclause id="HB208FEF25D5143FDBD5B35C1F0957475"><enum>(I)</enum><text>section 20 workfare;</text></subclause><subclause id="H89AF99FD910144E1AE5D62328867801D"><enum>(II)</enum><text>skills development for work registrants with limited employment history;</text></subclause><subclause id="H7A6FDBB759194DE1A832FEC58B9153BD"><enum>(III)</enum><text>post-employment support services necessary for maintaining employment; and</text></subclause><subclause id="H6B95237A43FE4C1C8B5A0530EB059A7C"><enum>(IV)</enum><text>education leading to a recognized postsecondary credential, registered apprenticeship, or secondary school diploma or its equivalent;</text></subclause></clause><clause id="H667019B0B0C24BE7928DD12BEDB63494"><enum>(iii)</enum><text>are located in a range of geographic areas, including rural, urban, and Indian reservations; and</text></clause><clause id="H1894284C356C4F4188CE7A535B95AEB2"><enum>(iv)</enum><text>include participants who are exempt and not exempt under section (6)(d)(2).</text></clause></subparagraph></paragraph><paragraph id="HA64B7AFD3B444BA08850FAF288533F2B"><enum>(3)</enum><header>Evaluation</header><text>The Secretary shall provide for an independent evaluation of projects selected under this subsection to measure the impact of the pilot projects on the ability of each pilot project target population to find and retain employment that leads to increased household income and reduced dependency, compared to what would have occurred in the absence of the pilot project.</text></paragraph><paragraph id="HCCEFC177A8CE477CB760C7E80C25185F"><enum>(4)</enum><header>Report to congress</header><text>By September 30, 2017, the Secretary shall submit, to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate, a report that includes a description of—</text><subparagraph id="H4F7F69348F3D473F94321847C939B5D2"><enum>(A)</enum><text>the results of each pilot project, including an evaluation of the impact of the project on the employment, income, and public benefit receipt of the targeted population of work registrants;</text></subparagraph><subparagraph id="H5549D8AF4EF4475291F3E775151D9F90"><enum>(B)</enum><text>the Federal, State, and other costs of each pilot project;</text></subparagraph><subparagraph id="H735A71790D074048A733D4ACA3828879"><enum>(C)</enum><text>the planned dissemination of the reports’ findings with State agencies; and</text></subparagraph><subparagraph id="H10221DA49FDC49CB841893723D906A61"><enum>(D)</enum><text>the steps and funding necessary to incorporate components of pilot projects that demonstrate increased employment and earnings into State employment and training programs.</text></subparagraph></paragraph><paragraph id="H9D7AD71747134EE7877A45259DBF8532"><enum>(5)</enum><header>Funding</header><text>From amounts made available under section 18(a)(1), the Secretary shall make $10,000,000 available for each of the fiscal years 2014, 2015, and 2016 to carry out this subsection. Such amounts shall remain available until expended.</text></paragraph><paragraph id="HDE37A1038D1043308F578E5091F2D132"><enum>(6)</enum><header>Use of funds</header><subparagraph id="H8BEDE4E267644DD0B0159101D244930F"><enum>(A)</enum><text>Funds provided under this subsection for pilot projects shall be used only for—</text><clause id="HD89A03B4BC694690A8C308BF7EC60661"><enum>(i)</enum><text>pilot projects that comply with the provisions of this Act;</text></clause><clause id="HA093825EDB954FDDABC67FB5C62AF106"><enum>(ii)</enum><text>the costs and administration of the pilot projects;</text></clause><clause id="HC58AF052970B4F648112539DE30CC462"><enum>(iii)</enum><text>the costs incurred in providing information and data to the independent evaluation under paragraph (3); and</text></clause><clause id="H9F1990134CAF480BA2D430C393C081ED"><enum>(iv)</enum><text>the costs of the evaluation under paragraph (3).</text></clause></subparagraph><subparagraph id="H66051B5A07A248948AAACBFE24450D55"><enum>(B)</enum><text>Funds made available under this subsection may not be used to supplant non-Federal funds used for existing employment and training activities.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HDB1A7CF4872445BE9D2EBFBBDA8FF1D1"><enum>124.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 18(a)(1) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2027">7 U.S.C. 2027(a)(1)</external-xref>) is amended in the 1st sentence by striking <quote>2012</quote> and inserting <quote>2016</quote>.</text></section><section id="H5260836D32984780B47699CF3A515C39"><enum>125.</enum><header>Limitation on use of block grant to Puerto Rico</header><text display-inline="no-display-inline">Section 19(a)(2)(B) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2028">7 U.S.C. 2028(a)(2)(B)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H51E16A3141DA4E4B953CCE5408FC79DA" style="OLC"><clause id="H940DBACC617942DBA848B68D750C59EE"><enum>(iii)</enum><header>Limitation on use of funds</header><text display-inline="yes-display-inline">None of the funds made available to the Commonwealth of Puerto Rico under this subparagraph may be used to provide nutrition assistance in the form of cash benefits.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HAD8AEBA9C7AD46E5B1125AAEF0090F26"><enum>126.</enum><header>Assistance for community food projects</header><subsection display-inline="no-display-inline" id="HF80531B877144AD9B1FA4CDD3896AB03"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 25(a)(1)(B)(i) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2034">7 U.S.C. 2034(a)(1)(B)(i)</external-xref>) is amended—</text><paragraph id="HB3CE2A55CCF24DFCABB3BEA56EC8A8AF"><enum>(1)</enum><text>in subclause (II) by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HF66C869B661345709E18F3B7A292D86D"><enum>(2)</enum><text>in subclause (III) by striking <quote>or</quote> at the end and inserting <quote>and</quote>; and</text></paragraph><paragraph id="H65585A029BCA4FB7984B4E37C85DA3C2"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HDE1077322B194F54B6F513B4E20CBEBB" style="OLC"><subclause id="HA46B2985B5F94BDCAE04F18489243BBA" indent="up1"><enum>(IV)</enum><text display-inline="yes-display-inline">to provide incentives for the consumption of fruits and vegetables among low-income individuals; or</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H08DAEB4E5165418F88181F1BCAD9893E"><enum>(b)</enum><header>Additional funding</header><text display-inline="yes-display-inline">Section 25(b) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2034">7 U.S.C. 2034</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H37DEA268FB1342A0910C1B6D8CCC5D98" style="OLC"><paragraph id="HC0771F52033245A58C59AD1F527A1A97"><enum>(3)</enum><header>Funding</header><subparagraph id="HA62B50DB5808445E97DF166851E1A37D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary to carry out this section not less than $10,000,000 for fiscal year 2014 and each fiscal year thereafter. Of the amount made available under this subparagraph for each such fiscal year, $5,000,000 shall be available to carry out subsection (a)(1)(B)(I)(IV).</text></subparagraph><subparagraph id="H9BB35BFB0B4345368B7C959D7FB2FE24"><enum>(B)</enum><header>Receipt and acceptance</header><text>The Secretary shall be entitled to receive, shall accept, and shall use to carry out this section, the funds transferred under subparagraph (A) without further appropriation.</text></subparagraph><subparagraph id="H96916208071A45F9816FEAB70A8C754B"><enum>(C)</enum><header>Maintenance of funding</header><text>The funding provided under subparagraph (A) shall supplement (and not supplant) other Federal funding made available to the Secretary to carry out this section.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="H75C993EBFFDF40F89A13630C493958ED"><enum>127.</enum><header>Emergency food assistance</header><subsection commented="no" id="H700ECFB282974D14AE4CFE91F289A09D"><enum>(a)</enum><header>Purchase of commodities</header><text>Section 27(a) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2036">7 U.S.C. 2036(a)</external-xref>) is amended—</text><paragraph commented="no" id="HB3DC3D000DD94B1B9CFDA530469B0BC4"><enum>(1)</enum><text>in paragraph (1) by striking <quote>2008 through 2012</quote> and inserting <quote>2013 through 2016</quote>;</text></paragraph><paragraph commented="no" id="H626A857A6175410F8F2C83FF157868DF"><enum>(2)</enum><text>in paragraph (2) by striking subparagraphs (A), (B), and (C), and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H4FBE0F126CDC4B80B2025ED3A585A72F" style="OLC"><subparagraph commented="no" id="HF440A48BFECA41ACAA10B6747EFE3FDE"><enum>(A)</enum><text>for fiscal year 2013, $265,750,000;</text></subparagraph><subparagraph commented="no" id="H1B46174BB7194288BA635F44DDD6B5A5"><enum>(B)</enum><text>for fiscal year 2014, the dollar amount of commodities specified in subparagraph (A) adjusted by the percentage by which the thrifty food plan has been adjusted under section 3(u)(4) between June 30, 2012 and June 30, 2013, and increased by $70,000,000;</text></subparagraph><subparagraph id="HD429AE8D177E44EBAC4205C39CE4BC4C"><enum>(C)</enum><text display-inline="yes-display-inline">for fiscal year 2015, the dollar amount of commodities determined for fiscal year 2014 under subparagraph (B) adjusted by the percentage by which the thrifty food plan has been adjusted under section 3(u)(4) between June 30, 2013 and June 30, 2014;</text></subparagraph><subparagraph id="H81D7EB2971F0428BA938427A1C72ABB4"><enum>(D)</enum><text display-inline="yes-display-inline">for fiscal year 2016, the dollar amount of commodities determined for fiscal year 2015 under subparagraph (C) adjusted by the percentage by which the thrifty food plan has been adjusted under section 3(u)(4) between June 30, 2014 and June 30, 2015, and reduced by $50,000,000; and</text></subparagraph><subparagraph id="H480066FF9D8C41BBA41DF484C6CFA9BD"><enum>(E)</enum><text display-inline="yes-display-inline">for each subsequent fiscal year, the dollar amount of commodities determined for the preceding fiscal year adjusted to reflect the percentage by which the thrifty food plan has been adjusted under section 3(u)(4) for the 12-month period ending on the preceding June 30.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H1FEC0955BBD74E61BB97DF023D290E30"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H688A89E0947E432EAA356DA67D643AC2" style="OLC"><paragraph id="HD3C0F43F9BB1433787496A2E2FEC5C0E"><enum>(3)</enum><header>Funds availability</header><text display-inline="yes-display-inline">For purposes of the funds described in this subsection, the Secretary shall—</text><subparagraph id="HC05CA28104464B45B6D597BA2E96E0BD"><enum>(A)</enum><text>make the funds available for 2 fiscal years; and</text></subparagraph><subparagraph id="HAD8EC73290084816912A45770A90EB0A"><enum>(B)</enum><text>allow States to carry over unexpended balances to the next fiscal year pursuant to such terms and conditions as are determined by the Secretary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="HF9D0816976BA48B88A0FA50BD76EB5D7"><enum>(b)</enum><header>Emergency food program infrastructure grants</header><text display-inline="yes-display-inline">Section 209(d) of the Emergency Food Assistance Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/7/7511a">7 U.S.C. 7511a(d)</external-xref>) is amended by striking <quote>2012</quote> and inserting <quote>2016</quote>.</text></subsection></section><section commented="no" id="HFC2CC076FB1245BBBF2EAEDCCDD29682"><enum>128.</enum><header>Nutrition education</header><text display-inline="no-display-inline">Section 28 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2036a">7 U.S.C. 2036a</external-xref>) is amended—</text><paragraph id="HE053833BA65C4E29906EEFB8CEAF0E42"><enum>(1)</enum><text>in subsection (b) by inserting <quote>and physical activity</quote> after <quote>healthy food choices</quote>; and</text></paragraph><paragraph id="H7CBB97B7A27A4702A43FE34DF865BDFC"><enum>(2)</enum><text>in subsection (d)(1)—</text><subparagraph id="HA859ECBE89024F7DB11B0EE08D88FEE7"><enum>(A)</enum><text>in subparagraph (D) by striking <quote>$401,000,000;</quote> and inserting <quote>$372,000,000; and</quote>;</text></subparagraph><subparagraph id="H5ECFABD465A44700835F99C3BD5E265D"><enum>(B)</enum><text display-inline="yes-display-inline">by striking subparagraph (E); and</text></subparagraph><subparagraph id="H1EDB812CAC66449DB792A179CCC31CFB"><enum>(C)</enum><text>in subparagraph (F) by striking <quote>(F) for fiscal year 2016</quote> and inserting <quote>(E) for fiscal year 2015</quote>.</text></subparagraph></paragraph></section><section commented="no" id="HB5B87A8849FE4CC993AB79CAC7704894"><enum>129.</enum><header>Retailer trafficking</header><text display-inline="no-display-inline">The Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H843B21D70A2D4A0BBD0DDB185A2BBC1A" style="OLC"><section id="H663835F1779D4A388360AB5002FAF800"><enum>29.</enum><header>Retailer trafficking</header><subsection id="H5206E8D23D1E4706B5C13FB78220A698"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to provide the Department of Agriculture with additional resources to prevent trafficking in violation of this Act by strengthening recipient and retailer program integrity. Additional funds are provided to supplement the Department’s payment accuracy, and retailer and recipient integrity activities.</text></subsection><subsection id="H2CDD246A1E11461DA5DE1AB3FBC9062A"><enum>(b)</enum><header>Funding</header><paragraph id="H277889428C0E49F0BA231E598A7FB0EF"><enum>(1)</enum><header>In general</header><text>Out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary to carry out this section not less than $5,000,000 for fiscal year 2014 and each fiscal year thereafter.</text></paragraph><paragraph id="HB15F0065AD0047C9BCA6203298067A42"><enum>(2)</enum><header>Receipt and acceptance</header><text>The Secretary shall be entitled to receive, shall accept, and shall use to carry out this section the funds transferred under paragraph (1) without further appropriation.</text></paragraph><paragraph id="H0443B70F30A044A39157FF7868260F9A"><enum>(3)</enum><header>Maintenance of funding</header><text>The funding provided under paragraph (1) shall supplement (and not supplant) other Federal funding for programs carried out under this Act.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H30FD42D32AE84CCDB497309D574F4459"><enum>130.</enum><header>Technical and conforming amendments</header><subsection id="H4F39CA559C644DC6B5FC9B40F70B8A6B"><enum>(a)</enum><text>Section 3 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012</external-xref>) is amended—</text><paragraph id="H9231ABF6C47E45EF8ABAED0875C929BF"><enum>(1)</enum><text>in subsection (g) by striking <quote>coupon,</quote> the last place it appears and inserting <quote>coupon</quote>;</text></paragraph><paragraph id="H504076256ABD45329E1E1E93C96F0118"><enum>(2)</enum><text>in subsection (k)(7) by striking <quote>or are</quote> and inserting <quote>and</quote>;</text></paragraph><paragraph id="H95AC8BF664B64E5782FAFC4E6590BD16"><enum>(3)</enum><text>by striking subsection (l);</text></paragraph><paragraph id="H450BC62CE9FE472388CC7A2481BA8416"><enum>(4)</enum><text>by redesignating subsections (m) through (t) as subsections (l) through (s), respectively; and</text></paragraph><paragraph id="HED55AA0096BA4774B8C5A9616E93AE75"><enum>(5)</enum><text>by inserting after subsection (s) (as so redesignated) the following:</text><quoted-block display-inline="no-display-inline" id="HD752EDE38D69422184340D7F147C4417" style="OLC"><subsection id="HBA201B7C28584833A62F603C47B6EB8B"><enum>(t)</enum><text><quote>Supplemental nutritional assistance program</quote> means the program operated pursuant to this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H6769451128554314A7A234015BA02060"><enum>(b)</enum><text>Section 4(a) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2013">7 U.S.C. 2013(a)</external-xref>) is amended by striking <quote>benefits</quote> the last place it appears and inserting <quote>Benefits</quote>.</text></subsection><subsection id="HE98CC744F69448ABB2436442D0760A3C"><enum>(c)</enum><text>Section 5 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014</external-xref>) is amended—</text><paragraph id="H748C00605896493FA6CD0987A56CC74F"><enum>(1)</enum><text>in the last sentence of subsection (i)(2)(D) by striking <quote>section 13(b)(2)</quote> and inserting <quote>section 13(b)</quote>; and</text></subparagraph></paragraph><paragraph id="HA8A10CF4FD134505A23FA27FEC58C292"><enum>(3)</enum><text>in the heading of section 1631(n) by striking <quote><header-in-text level="subsection" style="traditional">food stamp</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="traditional">supplemental nutrition assistance</header-in-text></quote>.</text></paragraph></subsection></section><section id="HC759B0C93DE84D25B911105D0D9FD598"><enum>131.</enum><header>Tolerance level for excluding small errors</header><text display-inline="no-display-inline">The Secretary shall set the tolerance level for excluding small errors for the purposes of section 16(c) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2025">7 U.S.C. 2025(c)</external-xref>)—</text><paragraph id="H78B4B22EB8154C24A347690B0905BA25"><enum>(1)</enum><text>for fiscal year 2014 at an amount no greater than $25; and</text></paragraph><paragraph id="H49A7CBBAEC2D4606B4E1D928BFF2C716"><enum>(2)</enum><text display-inline="yes-display-inline">for each fiscal year thereafter, the amount specified in paragraph (1) adjusted by the percentage by which the thrifty food plan is adjusted under section 3(u)(4) of such Act between June 30, 2012, and June 30 of the immediately preceding fiscal year.</text></paragraph></section><section id="H0DFEAC2C2FD44D689DAE6815246040E5" section-type="subsequent-section"><enum>132.</enum><header>Commonwealth of the Northern Mariana Islands pilot program</header><subsection id="HD27696399EE7496A87006DB88F9A908D"><enum>(a)</enum><header>Study</header><paragraph id="H9BFE4D44EF2B4387947C89660EF18F36"><enum>(1)</enum><header>In general</header><text>Prior to establishing the pilot program under subsection (b), the Secretary shall conduct a study to be completed not later than 2 years after the effective date of this section to assess—</text><subparagraph id="H7637289F11C34152B86A346A0A257B65"><enum>(A)</enum><text display-inline="yes-display-inline">the capabilities of the Commonwealth of the Northern Mariana Islands to operate the supplemental nutrition assistance program in the same manner in which the program is operated in the States (as defined in section 3 of the Food and Nutrition Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>)); and</text></subparagraph><subparagraph id="HFDE71B071ACE40EA86737EB15C8D000A"><enum>(B)</enum><text>alternative models of the supplemental nutrition assistance program operation and benefit delivery that best meet the nutrition assistance needs of the Commonwealth of the Northern Mariana Islands.</text></subparagraph></paragraph><paragraph id="HC789C714C1354014A182CA1389E377E0"><enum>(2)</enum><header>Scope</header><text>The study conducted under paragraph (1)(A) will assess the capability of the Commonwealth to fulfill the responsibilities of a State agency, including—</text><subparagraph id="HC7A1CA87BFD243BCBF1DF24AC45A3A87"><enum>(A)</enum><text>extending and limiting participation to eligible households, as prescribed by sections 5 and 6 of the Act;</text></subparagraph><subparagraph id="H1AC296A56B1B4751906D0F449421F9CE"><enum>(B)</enum><text>issuing benefits through EBT cards, as prescribed by section 7 of the Act;</text></subparagraph><subparagraph id="H8DAD1E958EED49278E8A2AB4DB3F8BAA"><enum>(C)</enum><text>maintaining the integrity of the program, including operation of a quality control system, as prescribed by section 16(c) of the Act;</text></subparagraph><subparagraph id="H656862C053194BED8B07C296CF5DC671"><enum>(D)</enum><text>implementing work requirements, including operating an employment and training program, as prescribed by section 6(d) of the Act; and</text></subparagraph><subparagraph id="H078C615913C94E8CAF43D6F3102491C8"><enum>(E)</enum><text>paying a share of administrative costs with non-Federal funds, as prescribed by section 16(a) of the Act.</text></subparagraph></paragraph></subsection><subsection id="H5338C33C42294670A8F478AFBB199E36"><enum>(b)</enum><header>Establishment</header><text>If the Secretary determines that a pilot program is feasible, the Secretary shall establish a pilot program for the Commonwealth of the Northern Mariana Islands to operate the supplemental nutrition assistance program in the same manner in which the program is operated in the States.</text></subsection><subsection id="H9DD09F4AEBAF4729AF4D048E84CDBE99"><enum>(c)</enum><header>Scope</header><text>The Secretary shall utilize the information obtained from the study conducted under subsection (a) to establish the scope of the pilot program established under subsection (b).</text></subsection><subsection id="H247F05378410431C864D0ADC58C025DA"><enum>(d)</enum><header>Report</header><text>Not later than June 30, 2019, the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report on the pilot program carried out under this section, including an analysis of the feasibility of operating in the Commonwealth of the Northern Mariana Islands the supplemental nutrition assistance program as it is operated in the States.</text></subsection><subsection id="HA4C5382041764370BE74BCD8EF04C3D3"><enum>(e)</enum><header>Funding</header><paragraph id="HCB40ADBD1CE14B4DBFA7B7F42E8ECC7F"><enum>(1)</enum><header>Study</header><text>Of the funds made available under section 18(a)(1) of the Food and Nutrition Act of 2008, the Secretary may use not more than $1,000,000 in each of fiscal years 2014 and 2015 to conduct the study described in subsection (a).</text></paragraph><paragraph id="HEA0ED3742C094A39A8AA82A567500330"><enum>(2)</enum><header>Pilot program</header><text>Of the funds made available under section 18(a)(1) of the Food and Nutrition Act of 2008, for the purposes of establishing and carrying out the pilot program established under subsection (b) of this section, including the Federal costs for providing technical assistance to the Commonwealth, authorizing and monitoring retail food stores, and assessing pilot operations, the Secretary may use not more than—</text><subparagraph id="H8504647F84354B95B9E561CB3113D235"><enum>(A)</enum><text>$13,500,000 in fiscal year 2016; and</text></subparagraph><subparagraph id="HF3145EB461E44E28ABD8D196D1F78D0D"><enum>(B)</enum><text>$8,500,000 in each of fiscal years 2017 and 2018.</text></subparagraph></paragraph></subsection></section><section id="H379DA01A25C14351A9E01E8AA6C12C03"><enum>133.</enum><header>Annual State report on verification of SNAP participation</header><subsection id="H871C4CE3D40A48A1AEA07FD5117AFA70"><enum>(a)</enum><header>Annual report</header><text display-inline="yes-display-inline">Not later 1 year after the date specified by the Secretary in the 180-day period beginning on the date of the enactment of this Act, and annually thereafter, each State agency that carries out the supplemental nutrition assistance program shall submit to the Secretary a report containing sufficient information for the Secretary to determine whether the State agency has, for the then most recently concluded fiscal year preceding such annual date, verified that households to which such State agency provided such assistance in such fiscal year—</text><paragraph id="H4EB63D23609B414EB6E607AE53DEA9F8"><enum>(1)</enum><text display-inline="yes-display-inline">did not obtain benefits attributable to a deceased individual;</text></paragraph><paragraph id="HA0D31DB42DC746E59108ECADB157B026"><enum>(2)</enum><text>did not include an individual who was simultaneously included in a household receiving such assistance in another State; and</text></paragraph><paragraph id="H19344F3816CC43909B25DC6AFECB2EAF"><enum>(3)</enum><text display-inline="yes-display-inline">did not include, during the time benefits were provided, an individual who was then disqualified from receiving benefits.</text></paragraph></subsection><subsection id="HCB11B51D6B5B4F7794A95E6073B429F8"><enum>(b)</enum><header>Penalty for noncompliance</header><text>For any fiscal year for which a State agency fails to comply with subsection (a), the Secretary shall reduce by 50 percent the amount otherwise payable to such State agency under section 16(a) of the Food and Nutrition Act of 2008 with respect to such fiscal year.</text></subsection></section><section display-inline="no-display-inline" id="H8024331FA75C4A82850819E000F8AB23" section-type="subsequent-section"><enum>134.</enum><header>Termination of existing agreement</header><text display-inline="no-display-inline">Effective on the date of the enactment of this Act, the memorandum of understanding entered into on July 22, 2004, by the Secretary of Agriculture of the United States Department of Agriculture and the Secretary of Foreign Affairs of the Republic of Mexico and known as the <quote>Partnership for Nutrition Assistance Initiative</quote> is null and void.</text></section><section id="HDDE352799E3F49AE92859B220D6F8B89"><enum>135.</enum><header>Service of traditional foods in public facilities</header><subsection id="H87DF3F68504A4E0B88D491C997AAC275"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H07560CB485594A8CA966192966B50FF5"><enum>(1)</enum><header>Food service program</header><text>The term <quote>food service program</quote> includes—</text><subparagraph id="H00C2089699FA4AC6B97950230E9254CB"><enum>(A)</enum><text>food service at a residential child care facility with a license from an appropriate State agency;</text></subparagraph><subparagraph id="HE275708C88E5434884A92DFA99D6F1E2"><enum>(B)</enum><text>a child nutrition program (as defined in section 25(b) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769f">42 U.S.C. 1769f(b)</external-xref>);</text></subparagraph><subparagraph id="HE0859AD077F942C48B6DC4807750315D"><enum>(C)</enum><text>food service at a hospital or clinic or long term care facility; and</text></subparagraph><subparagraph id="H68A5AD15D0A44EEE95731882F5D2741B"><enum>(D)</enum><text>a senior meal program.</text></subparagraph></paragraph><paragraph id="H57C0FC7AAF054FB4ADE27471959B3AC6"><enum>(2)</enum><header>Indian; Indian tribe; Indian tribal organization</header><text>The terms <quote>Indian</quote>; <quote>Indian tribe</quote>; and <quote>Indian Tribal Organization</quote> have the meanings given those terms in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text></paragraph><paragraph id="H6F6ECAB4AAEA493592D7A9A3DB21677A"><enum>(3)</enum><header>Traditional food</header><subparagraph id="HDC46D78F352F41B6B6F9BC2C2F3E88FD"><enum>(A)</enum><header>In general</header><text>The term <quote>traditional food</quote> means food that has traditionally been prepared and consumed by an Indian tribe.</text></subparagraph><subparagraph id="HA4FD0B9698A24942950EEF36626995F4"><enum>(B)</enum><header>Inclusions</header><text>The term <quote>traditional food</quote> includes—</text><clause id="H4CA7ED349AAF43BA812E91EC6467A4E8"><enum>(i)</enum><text>wild game meat;</text></clause><clause id="H6A2B4025F28845658C12E9FA039EFB8F"><enum>(ii)</enum><text>fish;</text></clause><clause id="H595F9F053E9E4A84B79CDA47B9AF26E9"><enum>(iii)</enum><text>seafood;</text></clause><clause id="H0486090A4B4C4DA0BBD94F6EF7173A75"><enum>(iv)</enum><text>marine mammals;</text></clause><clause id="H2D6172D568A64A3E856A4EE1E5C14BB1"><enum>(v)</enum><text>plants; and</text></clause><clause id="H37F36E0882B047D0BCBC410760BF1B7A"><enum>(vi)</enum><text>berries.</text></clause></subparagraph></paragraph></subsection><subsection id="H67B883E200684396A26FE8A2DC81F295"><enum>(b)</enum><header>Program</header><text>Notwithstanding any other provision of law, the Secretary shall allow the donation to and serving of traditional food through a food service program at a public facility, nonprofit facility, including facilities operated by an Indian tribe or tribal organization that primarily serves Indians if the operator of the food service program—</text><paragraph id="H3977A19E5C934A6197D663280C2C688E"><enum>(1)</enum><text>ensures that the food is received whole, gutted, gilled, as quarters, or as a roast, without further processing;</text></paragraph><paragraph id="H36BAE28289144803A6302B5EE6687A19"><enum>(2)</enum><text>makes a reasonable determination that—</text><subparagraph id="HF62A89D3F04443E28311161513EAA7AE"><enum>(A)</enum><text>the animal was not diseased;</text></subparagraph><subparagraph id="H2EE94AE7B16740C19CF9FE5AA5F1EB93"><enum>(B)</enum><text>the food was butchered, dressed, transported, and stored to prevent contamination, undesirable microbial growth, or deterioration; and</text></subparagraph><subparagraph id="HA73B653B0B214211A10C6D27F9FAC86E"><enum>(C)</enum><text>the food will not cause a significant health hazard or potential for human illness;</text></subparagraph></paragraph><paragraph id="H8958FF19BBCC4912B43AF8C6A4DA57FC"><enum>(3)</enum><text>carries out any further preparation or processing of the food at a different time or in a different space from the preparation or processing of other food for the applicable program to prevent cross-contamination;</text></paragraph><paragraph id="H60CA2941EF8249FAA3C68DB480363677"><enum>(4)</enum><text>cleans and sanitizes food-contact surfaces of equipment and utensils after processing the traditional food; and</text></paragraph><paragraph id="HDF0C3F657AAA48B9888E3F9BB062D79D"><enum>(5)</enum><text>labels donated traditional food with the name of the food and stores the traditional food separately from other food for the applicable program, including through storage in a separate freezer or refrigerator or in a separate compartment or shelf in the freezer or refrigerator.</text></paragraph></subsection><subsection id="H5A8D014FBF7343DE8E152802FFF32DCB"><enum>(c)</enum><header>Liability</header><text>Liability for damages from donated traditional food and products to the participating food service program shall not be subject to civil or criminal liability arising from the nature, age, packaging, or condition of donated food.</text></subsection></section><section display-inline="no-display-inline" id="HE89B3C0A59154FCF98C40AD4EEB4B80D" section-type="subsequent-section"><enum>136.</enum><header>Testing applicants for unlawful use of controlled substances</header><text display-inline="no-display-inline">Section 6 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015</external-xref>), as amended by section 109, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H19873571153D45408101D7E13C45E95B" style="OLC"><subsection id="H4E20B75A2851474F9143BEA850ADB74E"><enum>(s)</enum><header>Testing applicants for unlawful use of controlled substances</header><paragraph display-inline="no-display-inline" id="HE6196714CDBD47C7A7A517F08FD1E28B"><enum>(1)</enum><text>Nothing in this Act, or in any other Federal law, shall be considered to prevent a State, at the full cost to such State, from—</text><subparagraph id="H2EB6F4E9E2E94D92B2B91DAFBC0DD8EF"><enum>(A)</enum><text display-inline="yes-display-inline">enacting legislation to provide for testing any individual who is a member of a household applying for supplemental nutrition assistance benefits, for the unlawful use of controlled substances as a condition for receiving such benefits; and</text></subparagraph><subparagraph id="H60EAEDCF26CB4462AD6D90F24DDAB44B"><enum>(B)</enum><text>finding an individual ineligible to participate in the supplemental nutrition assistance program on the basis of the positive result of the testing conducted by the State under such legislation.</text></subparagraph></paragraph><paragraph id="H18DAA3DCCD794647898EC43EDB2C4F45"><enum>(2)</enum><text>For purposes of this subsection, term <quote>controlled substance</quote> has the meaning given such term in section 102 of the Controlled Substances Act ((<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H422CF4D76FC048E7B529A469A9934434"><enum>137.</enum><header>Eligibility disqualifications for certain convicted felons</header><subsection id="H000C21FA536D44AA8B2BBFC349AB291B"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 6 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015</external-xref>), as amended by sections 109 and 135, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HCF02A88C59A14B2AA3B60B7846EF25BD" style="OLC"><subsection id="H7609ABC33C4F4B9DA1355AE8C351327F"><enum>(t)</enum><header>Disqualification for certain convicted felons</header><paragraph id="HA4B81EFBE0664C5880427D3BA4D86478"><enum>(1)</enum><header>In general</header><text>An individual shall not be eligible for benefits under this Act if the individual is convicted of—</text><subparagraph id="H78030388B14F4EA38A38F270FD619D88"><enum>(A)</enum><text>aggravated sexual abuse under <external-xref legal-doc="usc" parsable-cite="usc/18/2241">section 2241</external-xref> of title 18, United States Code;</text></subparagraph><subparagraph id="H03A1B55A079B40B9BC10EE1E229C2115"><enum>(B)</enum><text>murder under <external-xref legal-doc="usc" parsable-cite="usc/18/1111">section 1111</external-xref> of title 18, United States Code;</text></subparagraph><subparagraph id="H9A9BE7C79CF44D1AB5A9E389F3D8EEBE"><enum>(C)</enum><text>an offense under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">chapter 110</external-xref> of title 18, United States Code;</text></subparagraph><subparagraph id="H6214F8EC23D5499387B839922E479402"><enum>(D)</enum><text>a Federal or State offense involving sexual assault, as defined in 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925(a)</external-xref>); or</text></subparagraph><subparagraph id="HA21C7E3C5E6349B4A9C5D59BC816B81B"><enum>(E)</enum><text>an offense under State law determined by the Attorney General to be substantially similar to an offense described in subparagraph (A), (B), or (C).</text></subparagraph></paragraph><paragraph id="H5085ED0DD47E4FAD9F3DFC4D1F99EA43"><enum>(2)</enum><header>Effects on assistance and benefits for others</header><text>The amount of benefits otherwise required to be provided to an eligible household under this Act shall be determined by considering the individual to whom paragraph (1) applies not to be a member of such household, except that the income and resources of the individual shall be considered to be income and resources of the household.</text></paragraph><paragraph id="HB441BB54D37A486FB3F6CE6F2F2DC0DD"><enum>(3)</enum><header>Enforcement</header><text>Each State shall require each individual applying for benefits under this Act, during the application process, to state, in writing, whether the individual, or any member of the household of the individual, has been convicted of a crime described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H48A18D41438D4CF9AF3F95D31995B7B4"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 5(a) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(a)</external-xref>), as amended by section 109, is amended in the 2d sentence by striking <quote>and (r)</quote> and inserting <quote>, (r), and (t)</quote>.</text></subsection><subsection id="H146C4209E5954234AEA4C4DF3A091BEA"><enum>(c)</enum><header>Inapplicability to convictions occurring on or before enactment</header><text display-inline="yes-display-inline">The amendments made by this section shall not apply to a conviction if the conviction is for conduct occurring on or before the date of the enactment of this Act.</text></subsection></section><section display-inline="no-display-inline" id="H41CDE7AF73064995A01A92EB604B7100" section-type="subsequent-section"><enum>138.</enum><header>Expungement of unused supplemental nutrition assistance program benefits</header><text display-inline="no-display-inline">Section 11 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020</external-xref>), as amended by section 115, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H59FC8DCF557A493A908331E51EAD63F0" style="OLC"><subsection id="HF6815E6AACFD4FF78248547C656FD9C9"><enum>(w)</enum><header>Expungement of unused benefits</header><text display-inline="yes-display-inline">The State agency shall expunge from the EBT account of a household benefits that are not used before the expiration of the 60-day period beginning on the date such benefits are posted to such account.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section display-inline="no-display-inline" id="HD699BCCD6B654AB09BFA15CAE9DBBBB3"><enum>139.</enum><header>Pilot projects to promote work and increase State accountability in the supplemental nutrition assistance program</header><subsection id="HC22CFB3EC3964D4ABFC2E17DECD86616"><enum>(a)</enum><header>Pilot projects</header><text display-inline="yes-display-inline">Section 17 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2026">7 U.S.C. 2026</external-xref>), as amended by sections 122 and 123, is amended by adding at the end the following:</text><quoted-block id="HB275F911DFAE493D836B81BEF2B05D8D"><subsection id="HE0DDE72D035F4923A75F7B942B7780D4"><enum>(n)</enum><header>Pilot projects To promote work and increase State accountability in the supplemental nutrition assistance program</header><paragraph id="HF9C8FA8AD1AE4B5DA9BAAF348B75DC92"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall carry out pilot projects to develop and test methods allowing States to run a work program with certain features comparable to the State program funded under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>), with the intent of increasing employment and self-sufficiency through increased State accountability and thereby reducing the need for supplemental nutrition assistance benefits.</text></paragraph><paragraph display-inline="no-display-inline" id="HFCDB0C68B48F456A974FB1AA31CA6ECB"><enum>(2)</enum><header>Agreements</header><subparagraph display-inline="no-display-inline" id="H9FA72C3AC9254234AA183FD6636581B5"><enum>(A)</enum><header>In general</header><text>In carrying out this subsection, the Secretary shall enter into cooperative agreements with States in accordance with pilot projects that meet the criteria required under this subsection.</text></subparagraph><subparagraph id="H76CE64CD84424357A325BDB057E6C833"><enum>(B)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to enter into a cooperative agreement to operate a pilot project under this subsection, a State shall amend its State plan under section 11(d) to include a description of its pilot project and explanations of how such project meets the criteria required under this subsection. The Secretary may not disapprove a pilot project which meets the requirements under this subsection.</text></subparagraph><subparagraph id="H53A559BAC5C44FD29FD0C07ECE1F32CE"><enum>(C)</enum><header>Assurances</header><text>A State shall include in its plan assurances that its pilot project will—</text><clause id="H62672DB7E1094E9F89681AD038424885"><enum>(i)</enum><text>operate for at least three 12-month periods but not more than five 12-month periods;</text></clause><clause id="HF38F0DD0D690434CA2F60ED1B5391070"><enum>(ii)</enum><text>have a robust data collection system for program administration that is designed and shared with project evaluators to ensure proper and timely evaluation; and</text></clause><clause id="H266022D5B95140BFA9EC9230A91496FC"><enum>(iii)</enum><text display-inline="yes-display-inline">intend to offer a work activity described in paragraph (3) to adults assigned and required to participate under paragraph (4)(A) and who are not exempt under paragraph (4)(B).</text></clause></subparagraph><subparagraph id="H3B6922634B8240A6B640C8132697506A"><enum>(D)</enum><header>Number of pilot projects</header><text>Any State may carry out a pilot project that meets the requirements of this subsection.</text></subparagraph><subparagraph id="H9A62948068714605867E4B457B9650C3"><enum>(E)</enum><header>Extent of pilot projects</header><text>Pilot projects shall cover no less than the entire State.</text></subparagraph></paragraph><paragraph id="H1CFEFD83AB3B423B937DFC4D5E26CEEA"><enum>(3)</enum><header>Work activity</header><subparagraph commented="no" display-inline="yes-display-inline" id="H61EEE226573C4FA0BED39474E8226C03"><enum>(A)</enum><text>For purposes of this subsection, the term <quote>work activity</quote> means any of the following:</text><clause id="H9BE1F4AAC67141068DF998B0C8F0BB43" indent="up1"><enum>(i)</enum><text>Employment in the public or private sector that is not subsidized by any public program.</text></clause><clause id="H55B3D3C407F9413B928BF3D8EDCBDCD1" indent="up1"><enum>(ii)</enum><text>Employment in the private sector for which the employer receives a subsidy from public funds to offset some or all of the wages and costs of employing an adult.</text></clause><clause id="HA40729B743304561BC99E6768DF513E8" indent="up1"><enum>(iii)</enum><text>Employment in the public sector for which the employer receives a subsidy from public funds to offset some or all of the wages and costs of employing an adult.</text></clause><clause id="HCC29A641BB4A4FDBA72E4302EDBCED1E" indent="up1"><enum>(iv)</enum><text>A work activity that—</text><subclause id="HFEE3749DD2B84BC59247BF27CACDAF18"><enum>(I)</enum><text>is performed in return for public benefits;</text></subclause><subclause id="H6F0E5575DF464BD786695EE3745CE215"><enum>(II)</enum><text>provides an adult with an opportunity to acquire the general skills, knowledge, and work habits necessary to obtain employment;</text></subclause><subclause id="HB7F8EEB92C9E404696B33BA2CBE709C1"><enum>(III)</enum><text>is designed to improve the employability of those who cannot find unsubsidized employment; and</text></subclause><subclause id="H997F0B542AD740A4BCBD2F48B895B763"><enum>(IV)</enum><text>is supervised by an employer, work site sponsor, or other responsible party on an ongoing basis.</text></subclause></clause><clause id="HE84877D2BE84472F87B60A1EBF82A32C" indent="up1"><enum>(v)</enum><text>Training in the public or private sector that is given to a paid employee while he or she is engaged in productive work and that provides knowledge and skills essential to the full and adequate performance of the job.</text></clause><clause id="H50DD613DE1BF43DB9A09D9845DB99B09" indent="up1"><enum>(vi)</enum><text>Job search, obtaining employment, or preparation to seek or obtain employment, including—</text><subclause id="H9C19B48B1A3D4F2EBEDB1A0EA4B4979F"><enum>(I)</enum><text display-inline="yes-display-inline">life skills training;</text></subclause><subclause id="HBF1A24A10E3A4EA6800FE72A3CDE41CC"><enum>(II)</enum><text display-inline="yes-display-inline">substance abuse treatment or mental health treatment, determined to be necessary and documented by a qualified medical, substance abuse, or mental health professional; or</text></subclause><subclause id="H648A27E9C6824FBFA0B461F4335A61DA"><enum>(III)</enum><text display-inline="yes-display-inline">rehabilitation activities,</text></subclause><continuation-text continuation-text-level="clause">supervised by a public agency or other responsible party on an ongoing basis.</continuation-text></clause><clause id="H36E2724BD2714602B4D56B78D44B9F30" indent="up1"><enum>(vii)</enum><text>Structured programs and embedded activities—</text><subclause id="HDA7D0064C1624788AE2B62BC4EE8C1B7"><enum>(I)</enum><text>in which adults perform work for the direct benefit of the community under the auspices of public or nonprofit organizations;</text></subclause><subclause id="HF2FC80CDE6F9461CA1E1B8B929EC8879"><enum>(II)</enum><text>that are limited to projects that serve useful community purposes in fields such as health, social service, environmental protection, education, urban and rural redevelopment, welfare, recreation, public facilities, public safety, and child care;</text></subclause><subclause id="H94F0B0140CAF4847819AEEF7175D3140"><enum>(III)</enum><text>that are designed to improve the employability of adults not otherwise able to obtain unsubsidized employment; and</text></subclause><subclause id="H437DC3CE4B0244F5A87B898A6E51FE69"><enum>(IV)</enum><text>that are supervised on an ongoing basis; and</text></subclause><subclause id="H739E39BBF2E141B49FF103D90AE7ECEF"><enum>(V)</enum><text>with respect to which a State agency takes into account, to the extent possible, the prior training, experience, and skills of a recipient in making appropriate community service assignments.</text></subclause></clause><clause id="HF498ED2F135D4F0EAA1F44D137348D92" indent="up1"><enum>(viii)</enum><text display-inline="yes-display-inline">Career and technical training programs (not to exceed 12 months with respect to any adult) that are directly related to the preparation of adults for employment in current or emerging occupations and that are supervised on an ongoing basis.</text></clause><clause id="H81B3BEF44DFD4E73BD4620C1544FC0A0" indent="up1"><enum>(ix)</enum><text>Training or education for job skills that are required by an employer to provide an adult with the ability to obtain employment or to advance or adapt to the changing demands of the workplace and that are supervised on an ongoing basis.</text></clause><clause id="HAD3FADA6328D4A48B8ABC1F1CF8CD52B" indent="up1"><enum>(x)</enum><text>Education that is related to a specific occupation, job, or job offer and that is supervised on an ongoing basis.</text></clause><clause id="H7A5EFD2B7BAF4780AC49DA4DB31B9637" indent="up1"><enum>(xi)</enum><text display-inline="yes-display-inline">In the case of an adult who has not completed secondary school or received such a certificate of general equivalence, regular attendance—</text><subclause id="H14AD90B7E22C42FFB439B28A05AFD540"><enum>(I)</enum><text>in accordance with the requirements of the secondary school or course of study, at a secondary school or in a course of study leading to such certificate; and</text></subclause><subclause id="H2DCA64CDAED0492DA17ED0D7D16A8EE1"><enum>(II)</enum><text>supervised on an ongoing basis.</text></subclause></clause><clause id="HEFC61448FFC948A1A93044E5809A5610" indent="up1"><enum>(xii)</enum><text>Providing child care to enable another recipient of public benefits to participate in a community service program that—</text><subclause id="HBA4AB02017B94C69B0840BEC46C280D8"><enum>(I)</enum><text>does not provide compensation for such community service;</text></subclause><subclause id="H81F2418061D446C8A0B452A9CB5161C0"><enum>(II)</enum><text>is a structured program designed to improve the employability of adults who participate in such program; and</text></subclause><subclause id="H258E01C52B6B4CEC8544345BCDF759C5"><enum>(III)</enum><text>is supervised on an ongoing basis.</text></subclause></clause></subparagraph><subparagraph id="H3C44571950DA4D8EAD86EDEE2BCDFACB" indent="up1"><enum>(B)</enum><header>Protections</header><text display-inline="yes-display-inline">Work activities under this subsection shall be subject to all applicable health and safety standards. Except as described in clauses (i), (ii), and (iii) of subparagraph (A), the term <quote>work activity</quote> shall be considered work preparation and not defined as employment for purposes of other law.</text></subparagraph></paragraph><paragraph id="H25B4BBB4B4B24CFFB0451AAF585256C5"><enum>(4)</enum><header>Pilot projects</header><text>Pilot projects carried out under this subsection shall include interventions to which adults are assigned that are designed to reduce unnecessary dependence, promote self-sufficiency, increase work levels, increase earned income, and reduce supplemental nutrition assistance benefit expenditures among households eligible for, applying for, or participating in the supplemental nutrition assistance program.</text><subparagraph id="HC098646D75444B80BCD46162D2A260AD"><enum>(A)</enum><text>Adults assigned to interventions by the State shall—</text><clause id="H961C5C85AE384D54872BFC5FEDE1D0EB"><enum>(i)</enum><text>be subject to mandatory participation in work activities specified in paragraph (3);</text></clause><clause id="H1D0E93EC64CA417599C0EB91595162AB"><enum>(ii)</enum><text>participate in work activities specified in paragraph (3) for a minimum of 20 hours per week per household;</text></clause><clause id="HF2EC50D0B5BF433E8A54D0D9EFB73734"><enum>(iii)</enum><text>be a maximum age of not less than 50 and not more than 60, as defined by the State;</text></clause><clause id="HAB93F1659F414C06865EEB6AF79C6F97"><enum>(iv)</enum><text>be subject to penalties during a period of nonparticipation without good cause ranging from, at State option, a minimum of the removal of the adults from the household benefit amount, up to a maximum of the discontinuance of the entire household benefit amount; and</text></clause><clause id="H083728F81351406499A273CD2715F46C"><enum>(v)</enum><text>not be penalized for nonparticipation if child care is not available for 1 or more children under 6 years of age.</text></clause></subparagraph><subparagraph id="H39DE4455C82446F3AC18461356133246"><enum>(B)</enum><text>The State shall allow certain individuals to be exempt from work requirements—</text><clause id="H48289C34CB164B37AAC7C3182169BA00"><enum>(i)</enum><text display-inline="yes-display-inline">those participating in work programs under a State program funded under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>) for an equal or greater number of hours;</text></clause><clause id="HD76DFDA357C24288A6730483C7FDF6D0"><enum>(ii)</enum><text display-inline="yes-display-inline">those with 1 or more dependent children under 1 year of age;</text></clause><clause id="HC6F11391A6624F6DBC5B973EB4D2800E"><enum>(iii)</enum><text>1 adult family member per household who is needed in the home to care for a disabled family member;</text></clause><clause id="H5948582247764489BAAFB2B3FFFE40CC"><enum>(iv)</enum><text display-inline="yes-display-inline">an adult who is receiving temporary or permanent disability benefits provided by a governmental entity; and</text></clause><clause id="H2EB0E0488F2441C5BAB3BA38C9A383E1"><enum>(v)</enum><text>those with a good cause reason for nonparticipation, such as victims of domestic violence, as defined by the State.</text></clause></subparagraph></paragraph><paragraph id="H20109DF5013E4726939339C722D98192"><enum>(5)</enum><header>Evaluation and reporting</header><subparagraph id="H4EC453FB6FE94145B031FC157A1920CE"><enum>(A)</enum><header>Evaluation</header><clause id="H5583E5755A7D4EF7B9731EF3DBDF7BE1"><enum>(i)</enum><header>Independent evaluation</header><subclause id="HEADCFA6F855B4F95B8FA1DC1F295BA28"><enum>(I)</enum><header>In general</header><text>The Secretary shall provide for each State that enters into a cooperative agreement under paragraph (2) an independent, longitudinal evaluation of its pilot project under this subsection to determine total program savings over the entire course of the pilot project with results reported in consecutive 12-month increments.</text></subclause><subclause id="H610046B30EA94839AABD42907B6BCA97"><enum>(II)</enum><header>Purpose</header><text>The purpose of the evaluation is to measure the impact of interventions provided by the State under the pilot project on the ability of adults in households eligible for, applying for, or participating in the supplemental nutrition assistance program to find and retain employment that leads to increased household income and reduced dependency.</text></subclause><subclause id="HBF58ED83B58340CFA21E7BF1D31DCE63"><enum>(III)</enum><header>Requirement</header><text>The independent evaluation under subclause (I) shall use valid statistical methods which can determine the difference between supplemental nutrition assistance benefit expenditures, if any, as a result of the interventions as compared to a control group that—</text><item id="H9ED73DAE11304906A36630D4D9ADDD70"><enum>(aa)</enum><text>is not subject to the interventions provided by the State under the pilot project under this subsection; and</text></item><item id="HCD3857FB8EB4490E9EF3CAAAC412D2B4"><enum>(bb)</enum><text>maintains services provided under 16(h) in the year prior to the start of the pilot project under this subsection.</text></item></subclause><subclause id="H48D06EDAFD6F4344B18E9E0D83D37664"><enum>(IV)</enum><header>Option</header><text>States shall have the option to evaluate pilot projects by matched counties or matched geographical areas using a constructed control group design to isolate the effects of the intervention of the pilot project.</text></subclause><subclause id="HDCED1F6881CB46A5BB6DED87269796A1"><enum>(V)</enum><header>Definition</header><text>Constructed control group means there is no random assignment, and instead program participants (those subject to interventions) and non-participants (control described in subclause (III)) are equated using matching or statistical procedures on characteristics that may be associated with program outcomes.</text></subclause></clause></subparagraph><subparagraph id="H2ACE628760BF4E0DB1EC8478CE64C17D"><enum>(B)</enum><header>Reporting</header><text>Not later than 90 days after the end of fiscal year 2014 and of each fiscal year thereafter, until the completion of the last evaluation under subparagraph (A), the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate, a report that includes a description of—</text><clause id="HDA3E6144AB9F4E87897A9C1E07694A70"><enum>(i)</enum><text>the status of each pilot project carried out under this subsection;</text></clause><clause id="H55E88D2FBC7B43C1ABFC84DD2FB5DF84"><enum>(ii)</enum><text>the results of the evaluation completed during the previous fiscal year; and</text></clause><clause id="HF0B40F0A85CC4C45ADC28E215B98F8F6"><enum>(iii)</enum><text>to the maximum extent practicable—</text><subclause id="H4AC6AE7C26284C99A830063FEAF1034F"><enum>(I)</enum><text>baseline information relevant to the stated goals and desired outcomes of the pilot project;</text></subclause><subclause id="HE1D71F04B40443A388C75A4117F28C1A"><enum>(II)</enum><text>the impact of the interventions on appropriate employment, income, and public benefit receipt outcomes among households participating in the pilot project;</text></subclause><subclause id="HCAB60EC4CFA6448394E85C09C77892D5"><enum>(III)</enum><text>equivalent information about similar or identical measures for control groups;</text></subclause><subclause id="H2CF3EEF62DE94BBBB7A614D171AD61C2"><enum>(IV)</enum><text>the planned dissemination of the report findings to State agencies; and</text></subclause><subclause id="HD4AF8470DF5544408FC6E67B5DAAD773"><enum>(V)</enum><text display-inline="yes-display-inline">the steps and funding necessary to incorporate into State employment and training programs the components of pilot projects that demonstrate increased employment and earnings.</text></subclause></clause></subparagraph><subparagraph id="H2BADD270B97A4831B064F50D55992B6E"><enum>(C)</enum><header>Public dissemination</header><text display-inline="yes-display-inline">In addition to the reporting requirements under subparagraph (B), evaluation results shall be shared broadly to inform policy makers, service providers, other partners, and the public in order to promote wide use of successful strategies, including by posting evaluation results on the Internet website of the Department of Agriculture.</text></subparagraph></paragraph><paragraph id="H3C6F7442DF4743FFA1235B0D2622861B"><enum>(6)</enum><header>Funding</header><subparagraph commented="no" id="HC21B750664B246CFAE9849E39EEE39D9"><enum>(A)</enum><header>Additional available funds</header><text>From amounts made available under section 18(a)(1), the Secretary shall make available—</text><clause commented="no" id="H855F20733E8D4963BD13171BA7469AA4"><enum>(i)</enum><text>up to $1,000,000 for each of the fiscal years 2014 through 2017 for evaluations described in paragraph (5) to carry out this subsection, with such amounts to remain available until expended; and</text></clause><clause commented="no" id="HB9DDAEC322AB4646B2B54495D67493D2"><enum>(ii)</enum><text>amounts equal to one-half of the accumulated supplemental nutrition assistance benefit dollars saved over each consecutive 12-month period according to the evaluation under paragraph (5) for bonus grants to States under paragraph (7)(B).</text></clause></subparagraph><subparagraph id="H9444DAB53185422C8D019C89D83FC7B4"><enum>(B)</enum><header>Administrative expenses</header><clause id="HF90F06D2E8EE4056B647F95BC3AE700B"><enum>(i)</enum><header>Reimbursement</header><text display-inline="yes-display-inline">Except as provided in clause (ii)—</text><subclause id="H4C623A89AC784B01A2DDF3E924A4A67C"><enum>(I)</enum><text display-inline="yes-display-inline">if, in carrying out a pilot project under this subsection during a fiscal year, a State incurs costs that exceed the amount allocated to the State agency under section 16(h)(1), the Secretary shall pay such State an amount equal to 50 percent of such costs; and</text></subclause><subclause id="H4998CC864C4248E991DCA64D358A5C30"><enum>(II)</enum><text>the Secretary shall also reimburse the State in an amount equal to 50 percent of the total amount of payments made or costs incurred by the State agency in connection with transportation costs and other expenses reasonably necessary and directly related to participation in a pilot project under this subsection, except that the amount of the reimbursement for dependent care expenses shall not exceed an amount equal to the payment made under section 6(d)(4)(I)(i)(II) but not more than the applicable local market rate, and such reimbursement shall not be made out of funds allocated under section 16(h)(1).</text></subclause></clause><clause id="H3169EA32635A46FAAD5591CD16BFF9E8"><enum>(ii)</enum><header>Limitation</header><text display-inline="yes-display-inline">For any fiscal year, the Secretary may not pay under clause (i) to a State an amount the exceeds the amount equal to the product of—</text><subclause id="H400C0D18B3C14A96A0677E4E20BF8535"><enum>(I)</enum><text display-inline="yes-display-inline">the amount of administrative expenses that would be reimbursable for such fiscal year to such State under clause (i) without regard to this clause; and</text></subclause><subclause id="H968CD4299BFB49C180A31249765ECA25"><enum>(II)</enum><text display-inline="yes-display-inline">$277,000,000 (plus the amount carried over, if any, under clause (iii)), divided by the aggregate amount of administrative expenses that would be reimbursable for such fiscal year to all of the States under clause (i) without regard to this clause.</text></subclause></clause><clause id="HCA4207C7015341E894A00A5208C29DAC"><enum>(iii)</enum><header>Carryover</header><text>The amount by which $277,000,000 exceeds the aggregate amount paid under clause (i) for a particular fiscal year shall remain available for payments under such clause for any subsequent fiscal year.</text></clause></subparagraph><subparagraph id="HA2FEDDA1DFBE49F08BEEFCA7390A8696"><enum>(C)</enum><header>Other funds</header><text>Any additional funds required by a State to carry out a pilot project under this subsection may be provided by the State from funds made available to the State for such purpose and in accordance with State and other Federal laws, including the following:</text><clause id="HE6314064614D402B9F96CCA802C1434D"><enum>(i)</enum><text display-inline="yes-display-inline">Section 403 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/603">42 U.S.C. 603</external-xref>).</text></clause><clause id="H5A93AE7D64C54796A7EC040817A4426B"><enum>(ii)</enum><text>The Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/9201">29 U.S.C. 9201 et seq.</external-xref>).</text></clause><clause id="HCA84019560A7448B87803D5164451FFD"><enum>(iii)</enum><text display-inline="yes-display-inline">The Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858">42 U.S.C. 9858 et seq.</external-xref>) and section 418 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/618">42 U.S.C. 618</external-xref>).</text></clause><clause id="HFF9D28BC100F4075B14CDE7E75F427C1"><enum>(iv)</enum><text>The social services block grant under subtitle A of title XX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397">42 U.S.C. 1397 et seq.</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="HF5DA9644CF5A46A7ADF4B471411F897C"><enum>(7)</enum><header>Use of funds</header><subparagraph commented="no" id="HA1A3548B995B445C84DFA9947801C270"><enum>(A)</enum><header>Specific uses</header><text>Funds provided under this subsection for evaluation of pilot projects under paragraph (6)(A)(i) shall be used only for—</text><clause commented="no" id="H499570CDDF4543CA93AF8EADB15E6A7A"><enum>(i)</enum><text>pilot projects that comply with this subsection;</text></clause><clause commented="no" id="HE026411386B8428FA327DD14F32D91E5"><enum>(ii)</enum><text>the costs incurred in gathering and providing information and data used to conduct the independent evaluation under paragraph (5); and</text></clause><clause commented="no" id="HB0ED50003068486A8C291C78AC019307"><enum>(iii)</enum><text>the costs of the evaluation under paragraph (5).</text></clause></subparagraph><subparagraph commented="no" id="H1FC09CA5C670455C9099F50FF166CC0B"><enum>(B)</enum><header>Limitation</header><text>Funds provided for bonus grants to States for pilot projects under subparagraph (6)(A)(ii) shall be used only for—</text><clause commented="no" id="HA25B54590DC445219A87750F918541E4"><enum>(i)</enum><text>pilot projects that comply with this subsection; and</text></clause><clause commented="no" id="H684186BAD4B14DB9B7F9FC86FEC6D2D2"><enum>(ii)</enum><text>any State purpose, not to be restricted to the supplemental nutrition assistance program or its beneficiary population.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD7F6457F92FB429CAC09143709C5C65D"><enum>(b)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">The Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) is amended—</text><paragraph id="H1CA96C58DEB9418694F5D5A0FC906469"><enum>(1)</enum><text display-inline="yes-display-inline">in section 16, as amended by section 121 of this Act—</text><subparagraph id="HD7E357305E204CC2AC71A7FAB1C933AC"><enum>(A)</enum><text>in subsection (a) by striking <quote>subsection (k)</quote> and inserting <quote>subsections (k) and (h) and section 20</quote>; and</text></subparagraph><subparagraph id="H1144749FBB6E4DB0A505855F4C025D3E"><enum>(B)</enum><text>in subsection (h)—</text><clause id="H6AF017413D864FC7BE410C7BC9D92CA4"><enum>(i)</enum><text>in paragraph (1)—</text><subclause id="H4819FD4AE12C4E01B7493906E8296DAF"><enum>(I)</enum><text>in subparagraph (A) by inserting <quote>under sections 6(d)(4) and 17(n)</quote> after <quote>programs</quote>; and</text></subclause><subclause id="H56D2CFFF08274315A27A613E38B9328D"><enum>(II)</enum><text>by striking subparagraph (E);</text></subclause></clause><clause id="H6A6FE086900F47D2A30E2BE92EC5C3A4"><enum>(ii)</enum><text>by striking paragraphs (2) and (3), and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HCF66208C28CF49A5A0A14AE9CE6DC53C" style="OLC"><paragraph id="H2747D76314044659886375F796A97DB2"><enum>(2)</enum><header>Exclusion of reimbursement for administrative costs</header><text display-inline="yes-display-inline">No funds may be paid under subsection (a) to a State agency for administrative costs incurred to carry out any of such programs in such fiscal year.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="H02C5613F5AAD48FEA60FF133DA5422E3"><enum>(iii)</enum><text>in paragraph (4) by inserting <quote>or 17(n)</quote> after <quote>section 6(d)(4)</quote>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H0C1E7DB62FDC42A09F6E1D807A973400"><enum>(3)</enum><text display-inline="yes-display-inline">in section 22(d)(1)(B)(ii) by striking <quote>, (g), (h)(2), and (h)(3)</quote> and inserting <quote>and (g)</quote>.</text></paragraph></subsection></section><section id="HFC4F8EFF1CAA4FF3BBF8AF6E1CCDBB56"><enum>140.</enum><header>Improved wage verification using the National Directory of New Hires</header><text display-inline="no-display-inline">Effective October 1, 2013, section 11(e) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020(e)</external-xref>) is amended—</text><paragraph id="HFD7774F2F0734752A7E31514415193A8"><enum>(1)</enum><text>in paragraph (3) by inserting <quote>and after compliance with the requirement specified in paragraph (24)</quote> after <quote>section 16(e) of this Act</quote>,</text></paragraph><paragraph id="HB4266E72A269405B85642AFC67B34275"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (22) by striking <quote>and</quote> at the end,</text></paragraph><paragraph id="H4A7662F63FA84CB8A763D235DDD04C46"><enum>(3)</enum><text>in paragraph (23) by striking the period at the end and inserting <quote>; and</quote>, and</text></paragraph><paragraph id="H1C436970D34345C8BA0712A83A2804E0"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H3C328A396D9744A08F40FD3E921892BB" style="traditional"><paragraph id="H99BD8D3D413E45BF91C85A45AE02C834"><enum>(24)</enum><text display-inline="yes-display-inline">that the State agency shall request wage data directly from the National Directory of New Hires established under section 453(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653(i)</external-xref>) relevant to determining eligibility to receive supplemental nutrition assistance program benefits and determining the correct amount of such benefits.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section display-inline="no-display-inline" id="H96EBBD790ECB4176A44DE46E18A1D4DB" section-type="subsequent-section"><enum>141.</enum><header>Feasibility study for Indian tribes</header><text display-inline="no-display-inline">Section 4 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2013">7 U.S.C. 2013</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H7DA20574FA994AD7BBBA08B6DDCAFE9E" style="OLC"><subsection id="H0531FE57C53D462AA7FABC87C3E1C3E5"><enum>(d)</enum><header>Feasibility study for Indian tribes</header><paragraph id="HC89B6A0A93504A92942793E3EAE434C1"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">Subject to the availability of appropriations to carry out this subsection, the Secretary shall conduct a study to determine the feasibility of a tribal demonstration project for tribes to administer all Federal food assistance programs, services, functions, and activities (or portions thereof) of the agency.</text></paragraph><paragraph id="H06C86759610040388885620F108A5144"><enum>(2)</enum><header>Considerations</header><text>In conducting the study, the Secretary shall consider—</text><subparagraph id="H378E2FC08C7E40E4A7075E2AC778CD59"><enum>(A)</enum><text>the probable effects on specific programs and program beneficiaries of such a demonstration project;</text></subparagraph><subparagraph id="HDAEAE4AEA66342B59EF9AAFD1D8834DA"><enum>(B)</enum><text>statutory, regulatory, or other impediments to implementation of such a demonstration project;</text></subparagraph><subparagraph id="H6A10E346B64D43B2A3C9335203A20397"><enum>(C)</enum><text>strategies for implementing such a demonstration project;</text></subparagraph><subparagraph id="H58EE4A05ABD6407FA4F1ABC114BBE8B3"><enum>(D)</enum><text>probable costs or savings associated with such a demonstration project;</text></subparagraph><subparagraph id="H8F00EEB38EB7445394E475BD27422191"><enum>(E)</enum><text>methods to assure quality and accountability in such a demonstration project; and</text></subparagraph><subparagraph id="H580AECB69AFE4F6FBC936C089CFD763E"><enum>(F)</enum><text>such other issues that may be determined by the Secretary or developed through consultation with pursuant to paragraph (4).</text></subparagraph></paragraph><paragraph id="H1A48CE45C8974F609358B83B9A875B6A"><enum>(3)</enum><header>Report</header><text>Not later than 18 months after the effective date of this subsection, the Secretary shall submit a report to the Committee on Agriculture, Nutrition and Forestry of the Senate and the Committee on Agriculture of the House of Representatives. The report shall contain—</text><subparagraph id="H899BF88B55AF451C8F499B08ADFEBEA5"><enum>(A)</enum><text>the results of the study under this subsection;</text></subparagraph><subparagraph id="HC5827D423A2A44EB93A235AC634AD11F"><enum>(B)</enum><text>a list of programs, services, functions, and activities (or portions thereof) within each agency with respect to which it would be feasible to include in a tribal demonstration project;</text></subparagraph><subparagraph id="H8609F875D7DD4363A7C1AEBBE5C5C33F"><enum>(C)</enum><text>a list of programs, services, functions, and activities (or portions thereof) included in the list provided pursuant to subparagraph (B) that could be included in a tribal demonstration project without amending a statute, or waiving regulations that the Secretary may not waiver; and</text></subparagraph><subparagraph id="H2C5454ECE3244860BE2D0C2086CE9FB9"><enum>(D)</enum><text>a list of legislative actions required in order to include those programs, services, function, and activities (or portions thereof) included in the list provided pursuant to subparagraph (B) but not included in the list provided pursuant to subparagraph (C), in a tribal demonstration project.</text></subparagraph></paragraph><paragraph id="H1A230995AA594348832C81CC5C75CD5B"><enum>(4)</enum><header>Consultation with Indian tribes</header><text>The Secretary shall consult with Indian tribes to determine a protocol for consultation under paragraph (1) prior to consultation under such paragraph with the other entities described in such paragraph. The protocol shall require, at a minimum, that—</text><subparagraph id="HBEDFA93F72F0447CAED41D04A8132F0B"><enum>(A)</enum><text>the government-to-government relationship with Indian tribes forms the basis for the consultation process;</text></subparagraph><subparagraph id="HD48E66223D884C66BD9643448D89717C"><enum>(B)</enum><text>the Indian tribes and the Secretary jointly conduct the consultations required by this subsection; and</text></subparagraph><subparagraph id="H49826EF4ED0C44418B6F7C860ADC9534"><enum>(C)</enum><text>the consultation process allows for separate and direct recommendations from the Indian tribes and other entities described in paragraph (1).</text></subparagraph></paragraph><paragraph id="HFFD1D6189A134A4BA941FAD6EC84C6F0"><enum>(5)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this subsection $1,000,000.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="HA53C51665F744E3095DE3F1B68EADD8D"><enum>II</enum><header>Commodity distribution programs</header><section id="HACE9DE64AFC54832AF0D689B6DD71BD9"><enum>201.</enum><header>Commodity distribution program</header><text display-inline="no-display-inline">Section 4(a) of the Agriculture and Consumer Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c">7 U.S.C. 612c</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/93/86">Public Law 93–86</external-xref>) is amended in the 1st sentence by striking <quote>2012</quote> and inserting <quote>2016</quote>.</text></section><section commented="no" id="H5D7CE0DF6C71420F976BD5B57C1F251E"><enum>202.</enum><header>Commodity supplemental food program</header><text display-inline="no-display-inline">Section 5 of the Agriculture and Consumer Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c">7 U.S.C. 612c</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/93/86">Public Law 93–86</external-xref>) is amended—</text><paragraph commented="no" id="HF546C2A68CF2429D98BE80B01D19CE88"><enum>(1)</enum><text>in paragraphs (1) and (2)(B) of subsection (a) by striking <quote>2012</quote> each place it appears and inserting <quote>2016</quote>;</text></paragraph><paragraph commented="no" id="H6552B045480F476AB2454E3D8FF3F7BF"><enum>(2)</enum><text>in the 1st sentence of subsection (d)(2) by striking <quote>2012</quote> and inserting <quote>2016</quote>;</text></paragraph><paragraph commented="no" id="HDFFE396A96B6421C901A38B35DBEE0B2"><enum>(3)</enum><text>by striking subsection (g) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H500EB84F67474531BE920CA0EC025984" style="OLC"><subsection commented="no" id="H49427533F5D6415CBF5E5B0724FB879C"><enum>(g)</enum><header>Eligibility</header><text>Except as provided in subsection (m), the States shall only provide assistance under the commodity supplemental food program to low-income individuals aged 60 and older.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H621EC12642FD4AC9A9C686A3CDDC15A2"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H3CC8F994C58543FEA3765FF5C79254B4" style="OLC"><subsection commented="no" id="HF02E1ECE989843D493B2CF1370464575"><enum>(m)</enum><header>Phase-Out</header><text>Notwithstanding any other provision of law, an individual who receives assistance under the commodity supplemental food program on the day before the effective date of this subsection shall continue to receive that assistance until the date on which the individual no longer qualifies for assistance under the eligibility criteria for the program in effect on the day before the effective date of this subsection.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H3C8F91404A5041848E8D18E6A4B22217"><enum>203.</enum><header>Distribution of surplus commodities to special nutrition projects</header><text display-inline="no-display-inline">Section 1114(a)(2)(A) of the Agriculture and Food Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/7/1431e">7 U.S.C. 1431e(2)(A)</external-xref>) is amended in the 1st sentence by striking <quote>2012</quote> and inserting <quote>2016</quote>.</text></section><section display-inline="no-display-inline" id="H6B941C10C4AF4C9F9FD372B166C08C3E"><enum>204.</enum><header>Processing of commodities</header><subsection id="HDB2A400052D04D9790BEEB66631B37BE"><enum>(a)</enum><text>Section 17 of the Commodity Distribution Reform Act and WIC Amendments of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c">7 U.S.C. 612c</external-xref> note) is amended by—</text><paragraph id="HAF3811521E684CBB9E16EABD34F49B02"><enum>(1)</enum><text>striking the heading and inserting <quote><header-in-text level="section" style="OLC">Commodity donations and processing</header-in-text></quote>; and</text></paragraph><paragraph id="H92B53398F07A4BF091A79AA80B3119FE"><enum>(2)</enum><text>adding at the end the following:</text><quoted-block id="H79CF53061BEA421CBDD6674BDECD30C8" style="OLC"><subsection id="HC7BD00A30A744EE39861CAF846F984CE"><enum>(c)</enum><header>Processing</header><text>For any program included in subsection (b), the Secretary may, notwithstanding any other provision of State or Federal law relating to the procurement of goods and services—</text><paragraph id="HB2FD90B828DA46288366241D811250DF"><enum>(1)</enum><text>retain title to commodities delivered to a processor, on behalf of a State (including a State distributing agency and a recipient agency), until such time as end products containing such commodities, or similar commodities as approved by the Secretary, are delivered to a State distributing agency or to a recipient agency; and</text></paragraph><paragraph id="H7FEA9775B62744C2B678996940387748"><enum>(2)</enum><text>promulgate regulations to ensure accountability for commodities provided to a processor for processing into end products, and to facilitate processing of commodities into end products for use by recipient agencies. Such regulations may provide that—</text><subparagraph id="H0632F733BC6E4E4CA7AEFF8D340EE891"><enum>(A)</enum><text>a processor that receives commodities for processing into end products, or provides a service with respect to such commodities or end products, in accordance with its agreement with a State distributing agency or a recipient agency, provide to the Secretary a bond or other means of financial assurance to protect the value of such commodities; and</text></subparagraph><subparagraph id="H99B6382A0DBB4A15BDAF90A9FB44DF66"><enum>(B)</enum><text>in the event a processor fails to deliver to a State distributing agency or a recipient agency an end product in conformance with the processing agreement entered into under this Act, the Secretary take action with respect to the bond or other means of financial assurance pursuant to regulations promulgated under this paragraph and distribute any proceeds obtained by the Secretary to one or more State distributing agencies and recipient agencies as determined appropriate by the Secretary.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5BE355C90B114EE6A9B205E918B9350B"><enum>(b)</enum><header>Definitions</header><text>Section 18 of the Commodity Distribution Reform Act and WIC Amendments of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c">7 U.S.C. 612c</external-xref> note) is amended by striking paragraphs (1) and (2) and inserting the following:</text><quoted-block id="H29B35886E12C4924971C2F96C40A67F6" style="OLC"><paragraph id="HA3433545657F414F9C21596E2974B41D"><enum>(1)</enum><text>The term <term>commodities</term> means agricultural commodities and their products that are donated by the Secretary for use by recipient agencies.</text></paragraph><paragraph id="H05EB0A8AAECB4479AD3914CFBE403C45"><enum>(2)</enum><text>The term <term>end product</term> means a food product that contains processed commodities.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H66EA6AAC3C27447197BE2378861FD603"><enum>(c)</enum><header>Technical and conforming amendments</header><text>Section 3 of the Commodity Distribution Reform Act and WIC Amendments of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c">7 U.S.C. 612c</external-xref> note; and</text></paragraph><paragraph id="H6A89FD78830C403CA9586ED1A5B91484"><enum>(3)</enum><text>specifying other terms and conditions as the Secretary deems appropriate to encourage expanding the participation of small scale farmers in Federal nutrition programs.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H294B3FC64A624353914AEAA8BB6FF5E0"><enum>302.</enum><header>Nutrition information and awareness pilot program</header><text display-inline="no-display-inline">Section 4403 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/3171">7 U.S.C. 3171</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/171">Public Law 107–171</external-xref>) is repealed.</text></section><section commented="no" id="H5748F0FBE447422BAF99AAD53F88F283" section-type="subsequent-section"><enum>303.</enum><header>Fresh fruit and vegetable program</header><text display-inline="no-display-inline">Section 19 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769a">42 U.S.C. 1769a</external-xref>) is amended—</text><paragraph id="HCBCF3C3EF68841E3A131D415E6C43B90"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">Fresh</header-in-text></quote>;</text></paragraph><paragraph id="H528F55C607174A11A4AE098A220DF003"><enum>(2)</enum><text>in subsection (a), by striking <quote>fresh</quote>;</text></paragraph><paragraph id="H6A83F9DCFF0041668F16A0B667D7B33C"><enum>(3)</enum><text>in subsection (b), by striking <quote>fresh</quote>; and</text></paragraph><paragraph id="H49C7FD5051FB44849F1231F14B4AAF86"><enum>(4)</enum><text>in subsection (e), by striking <quote>fresh</quote>.</text></paragraph></section><section id="HBC926B30173C445CA970E377909C2A4D"><enum>304.</enum><header>Additional authority for purchase of fresh fruits, vegetables, and other specialty food crops</header><text display-inline="no-display-inline">Section 10603 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c-4">7 U.S.C. 612c–4</external-xref>) is amended—</text><paragraph id="H80CACC8EE37049B4956831C782558BC1"><enum>(1)</enum><text>in subsection (b), by striking <quote>2012</quote> and inserting <quote>2016</quote>;</text></paragraph><paragraph id="HE24480953BFF4AA49E4215EEEF1471DB"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsection (c) as subsection (d); and</text></paragraph><paragraph id="H427759EA7B3B424A93B5BD98789DD7FB"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (b) the following:</text><quoted-block display-inline="no-display-inline" id="H2FD8470451C245648C6A650E08322F80" style="OLC"><subsection id="H8962574C79D84EEEA92C756C1E249F0A"><enum>(c)</enum><header>Pilot grant program for purchase of fresh fruits and vegetables</header><paragraph id="HC1F578C2FA0F4F1AAFBFF0FE183F0F43"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Using amounts made available to carry out subsection (b), the Secretary of Agriculture shall conduct a pilot program under which the Secretary will give not more than five participating States the option of receiving a grant in an amount equal to the value of the commodities that the participating State would otherwise receive under this section for each of fiscal years 2014 through 2016.</text></paragraph><paragraph id="HD9E6F30059F6419FA3ED5E9BCC12B35E"><enum>(2)</enum><header>Use of grant funds</header><text>A participating State receiving a grant under this subsection may use the grant funds solely to purchase fresh fruits and vegetables for distribution to schools and service institutions in the State that participate in the food service programs under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) and the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>).</text></paragraph><paragraph id="H0C55D4C381F045D8A5B0B3B154561E45"><enum>(3)</enum><header>Selection of participating States</header><text>The Secretary shall select participating States from applications submitted by the States.</text></paragraph><paragraph id="H6D72D8ABC6C04D05B0438BD609C98489"><enum>(4)</enum><header>Reporting requirements</header><subparagraph id="H0969A7D5124D4F19B129641EFC1BCD4C"><enum>(A)</enum><header>School and service institution requirement</header><text display-inline="yes-display-inline">Schools and service institutions in a participating State shall keep records of purchases of fresh fruits and vegetables made using the grant funds and report such records to the State.</text></subparagraph><subparagraph id="HC176B70665864D80B1255F449DBF8363"><enum>(B)</enum><header>State requirement</header><text>Each participating State shall submit to the Secretary a report on the success of the pilot program in the State, including information on—</text><clause id="HD67076091E83452F988DA454FD07458F"><enum>(i)</enum><text display-inline="yes-display-inline">the amount and value of each type of fresh fruit and vegetable purchased by the State; and</text></clause><clause id="HA8F93208F947470B94D724A102422AFE"><enum>(ii)</enum><text display-inline="yes-display-inline">the benefit provided by such purchases in conducting the school food service in the State, including meeting school meal requirements.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H0D97D3F257A5437FB33A6B15F72E2BD5" section-type="subsequent-section"><enum>305.</enum><header>Encouraging locally and regionally grown and raised food</header><subsection id="H2FC0D17351054AED96351A545F4A7BD4"><enum>(a)</enum><header>Commodity Purchase Streamlining</header><text display-inline="yes-display-inline">The Secretary may permit each school food authority with a low annual commodity entitlement value, as determined by the Secretary, to elect to substitute locally and regionally grown and raised food for the authority’s allotment, in whole or in part, of commodity assistance for the school meal programs under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) and the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>), if—</text><paragraph id="HA9AA0ACEAAF144809A5503A659FA3FD8"><enum>(1)</enum><text>the election is requested by the school food authority;</text></paragraph><paragraph id="HDD442B3395A7440988943610B1BD6D0C"><enum>(2)</enum><text>the Secretary determines that the election will reduce State and Federal administrative costs; and</text></paragraph><paragraph id="HE3EB3DBA713F43E195D4A1862EF7474D"><enum>(3)</enum><text>the election will provide the school food authority with greater flexibility to purchase locally and regionally grown and raised foods.</text></paragraph></subsection><subsection id="H8E3FFC29B3B04DD9902690A8030D2853"><enum>(b)</enum><header>Farm-to-School demonstration programs</header><paragraph id="H82664C3F6404445C8F297D73AB179C91"><enum>(1)</enum><header>In general</header><text>The Secretary may establish farm-to-school demonstration programs under which school food authorities, agricultural producers producing for local and regional markets, and other farm-to-school stakeholders will collaborate with the Agriculture Marketing Service to, on a cost neutral basis, source food for the school meal programs under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) and the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>) from local farmers and ranchers in lieu of the commodity assistance provided to the school food authorities for the school meal programs.</text></paragraph><paragraph id="H16101FE5F3D1496BA64D0E6AE5B7B090"><enum>(2)</enum><header>Requirements</header><subparagraph id="HB74539ECFA494F1EAC38831B07662243"><enum>(A)</enum><header>In general</header><text>Each demonstration program carried out under this subsection shall—</text><clause id="HC91DB9EAEFFE430C8A182C7EECC56A68"><enum>(i)</enum><text>facilitate and increase the purchase of unprocessed and minimally processed locally and regionally grown and raised agricultural products to be served under the school meal programs;</text></clause><clause id="H16662AD72C0E49FDB196A525829761FA"><enum>(ii)</enum><text>test methods to improve procurement, transportation, and meal preparation processes for the school meal programs;</text></clause><clause id="H3A6729E76890433B9E97EB1F735680F8"><enum>(iii)</enum><text>assess whether administrative costs can be saved through increased school food authority flexibility to source locally and regionally produced foods for the school meal programs; and</text></clause><clause id="H562C14360A9540D1BD6417B84E089C84"><enum>(iv)</enum><text>undertake rigorous evaluation and share information about results of the demonstration program, including cost savings, with the Secretary, other school food authorities, agricultural producers producing for the local and regional market, and the general public.</text></clause></subparagraph><subparagraph id="H5BDAEE600AD840F0829EB757389EAFB9"><enum>(B)</enum><header>Plans</header><text>In order to be selected to carry out a demonstration program under this subsection, a school food authority shall submit to the Secretary a plan at such time and in such manner as the Secretary may require, and containing information with respect to the requirements described in clauses (i) through (iv) of subparagraph (A).</text></subparagraph></paragraph><paragraph id="H30560CBD04E343DFBB98068F6A690890"><enum>(3)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Secretary shall provide technical assistance to demonstration program participants to assist such participants to acquire bids from potential vendors in a timely and cost-effective manner.</text></paragraph><paragraph id="HE5E29CD8F01F46ACB61EE1925E68996A"><enum>(4)</enum><header>Length</header><text>The Secretary shall determine the appropriate length of time for each demonstration program under this subsection.</text></paragraph><paragraph id="H244FC134D1014F139728656B6BE590A8"><enum>(5)</enum><header>Coordination</header><text>The Secretary shall coordinate among relevant agencies of the Department of Agriculture and non-governmental organizations with appropriate expertise to facilitate the provision of training and technical assistance necessary to successfully carry out demonstration programs under this subsection.</text></paragraph><paragraph id="H9E368E7B6CEC413EB55EAC7720B9B12A"><enum>(6)</enum><header>Number</header><text>Subject to the availability of funds to carry out this subsection, the Secretary shall select at least 10 demonstration programs to be carried out under this subsection.</text></paragraph><paragraph id="H466728B83DD2406EB2A280D1863EE704"><enum>(7)</enum><header>Diversity and balance</header><text>In selecting demonstration programs to be carried out under this subsection, the Secretary shall, to the maximum extent practicable, ensure—</text><subparagraph id="HA30A55CF85AE45AAB1D302C5E046E9E8"><enum>(A)</enum><text>geographical diversity;</text></subparagraph><subparagraph id="H025904DDA3324C80AABDF4FFF52D873C"><enum>(B)</enum><text>that at least half of the demonstration programs are completed in collaboration with school food authorities with small annual commodity entitlements, as determined by the Secretary;</text></subparagraph><subparagraph id="HBD142622279B47B68DABD04EA05804E2"><enum>(C)</enum><text>that at least half of the demonstration programs are completed in rural or tribal communities;</text></subparagraph><subparagraph id="HE7F78ECFB5FC40468A51B2BA53730D78"><enum>(D)</enum><text>equitable treatment of school food authorities with a high percentage of students eligible for free or reduced price lunches, as determined by the Secretary; and</text></subparagraph><subparagraph id="H96282E8DAFB84810ABFB31CBACCB45AB"><enum>(E)</enum><text display-inline="yes-display-inline">that at least one of the demonstration programs is completed on a military installation as defined in <external-xref legal-doc="usc" parsable-cite="usc/10/2687">section 2687(e)(1)</external-xref> of title 10, United States Code.</text></subparagraph></paragraph></subsection></section><section id="H5981FA6BFDB94683A2FD239C0968EF8B"><enum>306.</enum><header>Review of public health benefits of white potatoes</header><text display-inline="no-display-inline">The Secretary shall conduct a review of the economic and public health benefits of white potatoes on low-income families who are determined to be at nutritional risk. Not later than 1 year after the date of the enactment of this Act, the Secretary shall report the findings of this review to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate.</text></section><section id="H3659531F19D34C6CACC6AB97836AE2C2"><enum>307.</enum><header>Healthy Food Financing Initiative</header><subsection id="H7853720DA7A2451E8DCEE359C5CD95A0"><enum>(a)</enum><header>In general</header><text>Subtitle D of title II of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6951">7 U.S.C. 6951 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5746C3EBA3E640EFB6089780692C72E7" style="OLC"><section id="HC2FE0F4EE6514CD0BE390056921AFECD"><enum>242.</enum><header>Healthy Food Financing Initiative</header><subsection id="H7984BFD34F834E93A86258E0CCC027C4"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to enhance the authorities of the Secretary to support efforts to provide access to healthy food by establishing an initiative to improve access to healthy foods in underserved areas, to create and preserve quality jobs, and to revitalize low-income communities by providing loans and grants to eligible fresh, healthy food retailers to overcome the higher costs and initial barriers to entry in underserved areas.</text></subsection><subsection id="H2A1F25072D224DC7AAFD4A9F728838C1"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H9AAC82A9F4B7484C88CA47C6D0AE9DDC"><enum>(1)</enum><header>Community development financial institution</header><text>The term <term>community development financial institution</term> has the meaning given the term in section 103 of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4702">12 U.S.C. 4702</external-xref>).</text></paragraph><paragraph id="H7A5ADBEB25124C6FB7436D3A3C988FEE"><enum>(2)</enum><header>Initiative</header><text>The term <term>Initiative</term> means the Healthy Food Financing Initiative established under subsection (c)(1).</text></paragraph><paragraph id="H4A9D5A9268F84D73BA4634B81DE694D3"><enum>(3)</enum><header>National fund manager</header><text>The term <term>national fund manager</term> means a community development financial institution that is—</text><subparagraph id="H15D1FBCDC2AF42B6989D77114543B811"><enum>(A)</enum><text>in existence on the date of enactment of this section; and</text></subparagraph><subparagraph id="H60129CC5525B4517A0999C3287903972"><enum>(B)</enum><text>certified by the Community Development Financial Institution Fund of the Department of Treasury to manage the Initiative for purposes of—</text><clause id="H1A1B527AB26540D88468B3AADA5C5F31"><enum>(i)</enum><text>raising private capital;</text></clause><clause id="H85125EF8BC354CC381F4FC726EB0C5A2"><enum>(ii)</enum><text>providing financial and technical assistance to partnerships; and</text></clause><clause id="H32724AC7A9E2433EAFC81E7F53E01950"><enum>(iii)</enum><text>funding eligible projects to attract fresh, healthy food retailers to underserved areas, in accordance with this section.</text></clause></subparagraph></paragraph><paragraph id="HE08ECA440FD64237973FC3928311EF17"><enum>(4)</enum><header>Partnership</header><text>The term <term>partnership</term> means a regional, State, or local public-private partnership that—</text><subparagraph id="H3D549CBAA5B04838895C9A11ADB2F376"><enum>(A)</enum><text>is organized to improve access to fresh, healthy foods;</text></subparagraph><subparagraph id="HDEDE5C0CA63849ECB9FEBD73732B351E"><enum>(B)</enum><text>provides financial and technical assistance to eligible projects; and</text></subparagraph><subparagraph id="H04A13BE1F5164151AD6F210A0F91FE05"><enum>(C)</enum><text>meets such other criteria as the Secretary may establish.</text></subparagraph></paragraph><paragraph id="HFF0B89E342AA4575A68911AC02AB8D69"><enum>(5)</enum><header>Perishable food</header><text>The term <term>perishable food</term> means a staple food that is fresh, refrigerated, or frozen.</text></paragraph><paragraph id="H67E56F73C6EE4D1EA20E1CC52751534C"><enum>(6)</enum><header>Quality job</header><text>The term <term>quality job</term> means a job that provides wages and other benefits comparable to, or better than, similar positions in existing businesses of similar size in similar local economies.</text></paragraph><paragraph id="HF232D5CCC841413BA26C54EBBA352526"><enum>(7)</enum><header>Staple food</header><subparagraph id="H766EC34F5F7D46C7BD41BDD757746EE4"><enum>(A)</enum><header>In general</header><text>The term <term>staple food</term> means food that is a basic dietary item.</text></subparagraph><subparagraph id="HAF14C7CA6DAB45F681E10740C1717891"><enum>(B)</enum><header>Inclusions</header><text>The term <term>staple food</term> includes—</text><clause id="H3265EA67B9634DE2B099731091CF9435"><enum>(i)</enum><text>bread;</text></clause><clause id="HF135490970AC4BBABC29ADBC1EE1F81D"><enum>(ii)</enum><text>flour;</text></clause><clause id="H9AED0FA2185D444BB6A3FFF8497D3FDF"><enum>(iii)</enum><text>fruits;</text></clause><clause id="HAC39972168AA48ECBD5298EB54994BF8"><enum>(iv)</enum><text>vegetables; and</text></clause><clause id="HDBD0283FB3F84C118CAACB0B2794EAA4"><enum>(v)</enum><text>meat.</text></clause></subparagraph></paragraph></subsection><subsection id="H84B2A6999E064CD5A611BEDDD33D8BE1"><enum>(c)</enum><header>Initiative</header><paragraph id="H533EF5F637CC4786883D57BD2520530F"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish an initiative to achieve the purpose described in subsection (a) in accordance with this subsection.</text></paragraph><paragraph id="HF6588F00E2CC404BAFF01F5ED1CB5BE9"><enum>(2)</enum><header>Implementation</header><subparagraph id="HB789A5ECB173472792654FCF16A6A8C1"><enum>(A)</enum><header>In general</header><clause id="H75D9960CCA0A41D49DFF42D73059C5A1"><enum>(i)</enum><header>In general</header><text>In carrying out the Initiative, the Secretary shall provide funding to entities with eligible projects, as described in subparagraph (B), subject to the priorities described in subparagraph (C).</text></clause><clause id="H7FADD88F532840A2879F7BDEFD1FCF0B"><enum>(ii)</enum><header>Use of funds</header><text>Funds provided to an entity pursuant to clause (i) shall be used—</text><subclause id="H1A207A0B033C41DB88BF898E449FB291"><enum>(I)</enum><text>to create revolving loan pools of capital or other products to provide loans to finance eligible projects or partnerships;</text></subclause><subclause id="HBFD4683F47584BBDAF319C661D984DF4"><enum>(II)</enum><text>to provide grants for eligible projects or partnerships;</text></subclause><subclause id="HE4BB351467F84CD98361C66716827CB4"><enum>(III)</enum><text>to provide technical assistance to funded projects and entities seeking Initiative funding; and</text></subclause><subclause id="H5C76A22F955C4C14936B7E89B562B67D"><enum>(IV)</enum><text>to cover administrative expenses of the national fund manager in an amount not to exceed 10 percent of the Federal funds provided.</text></subclause></clause></subparagraph><subparagraph id="HD2E43B69B895415EAA04C9776BDAFDAA"><enum>(B)</enum><header>Eligible projects</header><text>Subject to the approval of the Secretary, the national fund manager shall establish eligibility criteria for projects under the Initiative, which shall include the existence or planned execution of agreements—</text><clause id="H8DC807C1C81D4402AC8FE2AB091A88CB"><enum>(i)</enum><text>to expand or preserve the availability of staple foods in underserved areas with moderate- and low-income populations by maintaining or increasing the number of retail outlets that offer an assortment of perishable food and staple food items, as determined by the Secretary, in those areas; and</text></clause><clause id="H4632CD7EA22C4F83973908CD2995A8CC"><enum>(ii)</enum><text>to accept benefits under the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="H4DC9AFA963D043A69ED06271F6ECEF80"><enum>(C)</enum><header>Priorities</header><text>In carrying out the Initiative, priority shall be given to projects that—</text><clause id="H5E0D1AC9EAD44582A2393BFB86ED5FBB"><enum>(i)</enum><text>are located in severely distressed low-income communities, as defined by the Community Development Financial Institutions Fund of the Department of Treasury; and</text></clause><clause id="H281450176AA040449C93BC5A2441BD1B"><enum>(ii)</enum><text>include 1 or more of the following characteristics:</text><subclause id="H060BBC0B08F94A1A9ECF41379EB26CA4"><enum>(I)</enum><text>The project will create or retain quality jobs for low-income residents in the community.</text></subclause><subclause id="H83B4C039BE154C5C848C29B3B52D3A9A"><enum>(II)</enum><text>The project supports regional food systems and locally grown foods, to the maximum extent practicable.</text></subclause><subclause id="H528C5FEF55EF40DCA1D6B12032D79295"><enum>(III)</enum><text>In areas served by public transit, the project is accessible by public transit.</text></subclause><subclause id="H5ED5441AEF4549E08B099674C4778916"><enum>(IV)</enum><text>The project involves women- or minority-owned businesses.</text></subclause><subclause id="HADE511436DBB497D8F8DA729DF5D263D"><enum>(V)</enum><text>The project receives funding from other sources, including other Federal agencies.</text></subclause><subclause id="H8E94DFAB0B2844759AAC04625CD9D5C2"><enum>(VI)</enum><text>The project otherwise advances the purpose of this section, as determined by the Secretary.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="HD7B819CC0920438298299F9A35C29555"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section $125,000,000, to remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC6FCBC2C6C604EC7BF3338D8A1341797"><enum>(b)</enum><header>Conforming amendment</header><text>Section 296(b) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/7014">7 U.S.C. 7014(b)</external-xref>) is amended—</text><paragraph id="H9790B8F3C6F64F79A00AF5E060C1BAB7"><enum>(1)</enum><text>in paragraph (6) by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="HC2EF0544877548FF9CE5370A8FBAC4D6"><enum>(2)</enum><text>in paragraph (7) by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H11031AB1B33A45AAA3253F4E701DFD9B"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H67BA7C8ABBD84944AF810403D3262225" style="OLC"><paragraph id="H4DBC1258C0484090833D0BF554467948"><enum>(8)</enum><text>the authority of the Secretary to establish and carry out the Health Food Financing Initiative under section 242.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section display-inline="no-display-inline" id="H446FDE8B2AFD42E7A4BD6C89A72CF794" section-type="subsequent-section"><enum>308.</enum><header>Review of sole-source contracts in Federal nutrition programs</header><text display-inline="no-display-inline">The Secretary shall conduct an evaluation of sole-source contracts in Federal nutrition programs, and the effect such contracts have on program participation, program goals, nonprogram consumers, retailers, and free market dynamics. Not later than 1 year after the date of the enactment of this Act, the Secretary shall report the findings of this review to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate.</text></section><section id="HE3FE071904314F9EAAA2BC34732AC8F6"><enum>309.</enum><header>Purchase of Halal and Kosher food for emergency food assistance program</header><text display-inline="no-display-inline">Section 202 of the <act-name parsable-cite="EFAA83">Emergency Food Assistance Act of 1983 </act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/7502">7 U.S.C. 7502</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HCD66FB9FDF45496A9D2D228715D6FD08" style="OLC"><subsection id="HF0E2E228E7794429BC57BC92154A2B76"><enum>(h)</enum><header>Kosher and Halal food</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this subsection, the Secretary shall finalize and implement a plan—</text><paragraph commented="no" display-inline="no-display-inline" id="H87FC1E6F7B00423BA3F2A764D2FD87F2"><enum>(1)</enum><text display-inline="yes-display-inline">to increase the purchase of Kosher and Halal food from food manufacturers with a Kosher or Halal certification to carry out the program established under this Act if the Kosher and Halal food purchased is cost neutral as compared to food that is not from food manufacturers with a Kosher or Halal certification; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6EC424C3CCBC44E19990D7C49DCB4DE9"><enum>(2)</enum><text display-inline="yes-display-inline">to modify the labeling of the commodities list used to carry out the program in a manner that enables Kosher and Halal food bank operators to identify which commodities to obtain from local food banks.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title></legis-body><attestation><attestation-group><attestation-date chamber="House" date="20130919">Passed the House of Representatives September 19, 2013.</attestation-date><attestor display="yes">Karen L.
