		  plan for the Gulf of Mexico red snapper, and for other

		<section id="HC151C54238B84E2E99E26DF578F3177C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Gulf of Mexico Red Snapper
			 Conservation Act of 2013</short-title></quote>.</text>
		</section><section id="H1AD5D21F2FFC441EAC928FAB053022F3"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H07950C662D2F464FA5519B36F8690AB7"><enum>(1)</enum><header>Coastal
			 waters</header><text>The term <term>coastal waters</term> means all waters of
			 the Gulf of Mexico—</text>
				<subparagraph id="HE4F7B37362324991ABDCE65685DC6D8A"><enum>(A)</enum><text>shoreward of the
			 baseline from which the territorial sea of the United States is measured;
			 and</text>
				</subparagraph><subparagraph id="HAE34EB1936744A0F8F529BB012A7BFA6"><enum>(B)</enum><text>seaward from the
			 baseline described in subparagraph (A) to the inner boundary of the exclusive
			 economic zone.</text>
				</subparagraph></paragraph><paragraph id="HC893E83C5C7D49389940B3D2A423C99B"><enum>(2)</enum><header>Commission</header><text>The
			 term <term>Commission</term> means the Gulf States Marine Fisheries
			 Commission.</text>
			</paragraph><paragraph id="H6C498DF2078A4B3AA03C31B2CDD2880F"><enum>(3)</enum><header>Exclusive
			 economic zone</header><text display-inline="yes-display-inline">The term
			 <term>exclusive economic zone</term> has the meaning given to such term in
			 section 3 of the Magnuson-Stevens Fishery Conservation and Management Act (16
			 U.S.C. 1802).</text>
			</paragraph><paragraph id="H888363A0C7C84874A4C5CAB48D2847E9"><enum>(4)</enum><header>Federal fishery
			 management plan</header><text display-inline="yes-display-inline">The term
			 <term>Federal fishery management plan</term> means the Fishery Management Plan
			 for the Reef Fish Resources of the Gulf of Mexico prepared by the Gulf of
			 Mexico Fishery Management Council pursuant to <external-xref legal-doc="usc" parsable-cite="usc/50/622">section 622.1</external-xref> of title 50, Code
			 of Federal Regulations.</text>
			</paragraph><paragraph id="H32B15D9D14044CDEAFFAD7F6C454B11F"><enum>(5)</enum><header>Fishery
			 management measure</header><text>The term <term>fishery management
			 measure</term> means any policy, process, or tool used by a Gulf coastal State
			 to implement the fishery management plan.</text>
			</paragraph><paragraph id="HCB049DEE87CD4C01AAEEE23B93CF1CAC"><enum>(6)</enum><header>Fishery
			 management plan</header><text>The term <term>fishery management plan</term>
			 means a plan created by the Commission for the sustainability of Gulf of Mexico
			 red snapper and the economic and community benefits of each of the Gulf coastal
			 States.</text>
			</paragraph><paragraph id="H21E00B5B1B554E63AE52F2150706CD6D"><enum>(7)</enum><header>Gulf coastal
			 State</header><text>The term <term>Gulf coastal State</term> means any
			 of—</text>
				<subparagraph id="HD4E6E04A733041D1B13CE51B49E3ACF8"><enum>(A)</enum><text>Alabama;</text>
				</subparagraph><subparagraph id="HCB24BB36E93946CF932A2E95199832E0"><enum>(B)</enum><text>Florida;</text>
				</subparagraph><subparagraph id="H40472387A3594B29A5899E362BAA71D1"><enum>(C)</enum><text>Louisiana;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HED628333F091436E9C622934264B6DD2"><enum>(D)</enum><text>Mississippi;
			 or</text>
				</subparagraph><subparagraph id="HC56C8A667DB44483818B7E01A5348592"><enum>(E)</enum><text>Texas.</text>
				</subparagraph></paragraph><paragraph id="H6172680D96BC453786C1CA24375C1138"><enum>(8)</enum><header>Gulf of Mexico
			 red snapper</header><text>The term <term>Gulf of Mexico red snapper</term>
			 means members of stocks or populations of the species Lutjanis campechanus,
			 which ordinarily are found shoreward of coastal waters.</text>
			</paragraph><paragraph id="H76636C4870284714B2C054FCAB11AA64"><enum>(9)</enum><header>Overfishing</header><text display-inline="yes-display-inline">The term <term>overfishing</term> has the
			 meaning given to such term in section 3 of the Magnuson-Stevens Fishery
			 Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1802">16 U.S.C. 1802</external-xref>).</text>
			</paragraph><paragraph id="HB87FE1F709DB426D836B79DDA7D974E6"><enum>(10)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Commerce.</text>
			</paragraph></section><section id="H4D0C94FCAD9F4FC0AA3935A363A01B5D"><enum>3.</enum><header>Data collection
			 strategy for Gulf of Mexico red snapper</header><text display-inline="no-display-inline">Not later than one year after the date of
			 the enactment of this Act, the Commission, with the support of the Secretary,
			 shall prepare and adopt by vote a strategy for the collection of data on the
			 Gulf of Mexico red snapper fishery that shall include—</text>
			<paragraph id="H94615AB22FE942C08B84B394292E8E71"><enum>(1)</enum><text display-inline="yes-display-inline">measures to enhance interstate
			 collaboration on the collection of data regarding the Gulf of Mexico red
			 snapper fishery; and</text>
			</paragraph><paragraph id="H91B1A0ABBAE048608739DDD11229BA21"><enum>(2)</enum><text display-inline="yes-display-inline">a plan to undertake annual stock
			 assessments of Gulf of Mexico red snapper.</text>
			</paragraph></section><section id="HC9D0E8FF6B6145B58D8F7379FAE13020"><enum>4.</enum><header>Adopting a
			 fishery management plan</header>
			<subsection id="HB166DCDB97C943E7BB4AD67BDB34A8A5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than one
			 year after the date of the enactment of this Act, the Commission shall prepare
			 and adopt by vote a fishery management plan and submit the plan to the
			 Secretary.</text>
			</subsection><subsection id="H84C423218C5F4A0A9DE1DDFC88DA5CEF"><enum>(b)</enum><header>Requirements</header><text>In
			 adopting a fishery management plan under subsection (a), the Commission shall
			 ensure—</text>
				<paragraph id="HF4517E8923F7419E8D697B11806B55C7"><enum>(1)</enum><text display-inline="yes-display-inline">adequate opportunity for public
			 participation prior to a vote under subsection (a), including—</text>
					<subparagraph id="H1BB80A0EC6AB4813BF75CA564A66E4BB"><enum>(A)</enum><text>at least 1 public
			 hearing held in each Gulf coastal State; and</text>
					</subparagraph><subparagraph id="HC7A73DC19F41487BA6A668CCD7B85BC8"><enum>(B)</enum><text>procedures for
			 submitting written comments on the fishery management plan to the Commission
			 and for making such comments and responses of the Commission available to the
			 public; and</text>
					</subparagraph></paragraph><paragraph id="H5653D5A72D304481BCB21D7820350578"><enum>(2)</enum><text>that such plan
			 contains standards and procedures for the long-term sustainability of Gulf of
			 Mexico red snapper based on the available science.</text>
				</paragraph></subsection><subsection id="HB7944D574C59482BB435B1F95B773C89"><enum>(c)</enum><header>Limitations on
			 quotas</header><text display-inline="yes-display-inline">The fishery management
			 plan shall address the quotas of Gulf of Mexico red snapper on the date of the
			 enactment of this Act as follows:</text>
				<paragraph id="H4DD71ACF87834991868230E37E60D622"><enum>(1)</enum><text display-inline="yes-display-inline">Based on stock assessments, the fishery
			 management plan may increase the quota apportioned to commercial fishing in a
			 fair and equitable manner.</text>
				</paragraph><paragraph id="H33B8FDC6A6B941539AF70415CD1ADD89"><enum>(2)</enum><text display-inline="yes-display-inline">Except as provided in paragraph (3), the
			 fishery management plan shall not reduce such quota until the date that is 3
			 years after the date of the enactment of this Act.</text>
				</paragraph><paragraph id="H3D0A9E0149D24907A58F3686C669457C"><enum>(3)</enum><text display-inline="yes-display-inline">If there is a reduction in the stock of
			 Gulf of Mexico red snapper prior to the date specified in paragraph (2), the
			 fishery management plan shall reduce quotas apportioned to all fishing sectors
			 in a fair and equitable manner that ensures a sustainable harvest of Gulf of
			 Mexico red snapper.</text>
				</paragraph></subsection><subsection id="H3236CC46953046D4864DA8FD27616331"><enum>(d)</enum><header>Gulf coastal
			 State requirements</header><text display-inline="yes-display-inline">The
			 fishery management plan shall describe standards of compliance for Gulf coastal
			 States to use in developing fishery management measures.</text>
			</subsection></section><section id="HA85590FFCB7840588CBC27F9D2FDAA1B"><enum>5.</enum><header>Review and
			 certification by Secretary</header>
			<subsection id="HEBCBC7CF300145DBB866F313C6B044AA"><enum>(a)</enum><header>Plan
			 review</header><text display-inline="yes-display-inline">The Secretary shall
			 review the fishery management plan submitted pursuant to section 4 to determine
			 if the plan—</text>
				<paragraph id="H6A16349A90D44DA483D22CED98D43889"><enum>(1)</enum><text display-inline="yes-display-inline">is compatible, to the extent practicable,
			 with section 301 of the Magnuson-Stevens Fishery Conservation and Management
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1851">16 U.S.C. 1851</external-xref>); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H90B2C9637EC142F8B2271C614029D61F"><enum>(2)</enum><text display-inline="yes-display-inline">will ensure the long-term sustainability of
			 Gulf of Mexico red snapper populations.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFBF761BED9B84DF8B4E9A32D4DBEABD4"><enum>(b)</enum><header>Plan
			 certification</header><text display-inline="yes-display-inline">The Secretary
			 shall determine whether to certify the fishery management plan based on the
			 review conducted under subsection (a).</text>
			</subsection><subsection id="HE6AD7D1D1FBB468FBC1C3DEF6C32625A"><enum>(c)</enum><header>Failure To
			 certify</header><text>If the Secretary does not certify the fishery management
			 plan under subsection (b), the Secretary shall submit a written explanation to
			 the Commission explaining why the plan was not certified. The Commission may
			 submit a new fishery management plan to the Secretary pursuant to section
			 4.</text>
			</subsection><subsection id="H66E1A8D7FFC74CE8A9ACC1234E563952"><enum>(d)</enum><header>Time for
			 Secretary response</header><text display-inline="yes-display-inline">If the
			 Secretary fails to act pursuant to subsection (b) within 120 days of receipt of
			 the fishery management plan, the plan shall be treated as certified by the
			 Secretary.</text>
			</subsection></section><section id="HA3D398058C03411AA238E1799E0F5121"><enum>6.</enum><header>State
			 implementation of the fishery management plan</header>
			<subsection id="H7F3E4318FAC04C6CA0015CE4FD13FC2F"><enum>(a)</enum><header>Management
			 measures deadline</header><text display-inline="yes-display-inline">The
			 Commission shall establish a deadline for each Gulf coastal State to submit
			 fishery management measures to the Commission.</text>
			</subsection><subsection id="H165D9EBC5BF741F6A096BB1B5AAA3BD9"><enum>(b)</enum><header>Review and
			 approval</header><text display-inline="yes-display-inline">Within 60 days of
			 receipt of the fishery management measures, the Commission shall review and
			 approve such measures that ensure each Gulf coastal State is in compliance with
			 the objectives of the fishery management plan.</text>
			</subsection><subsection id="HF565A55341584286B1C73BFC22CF241B"><enum>(c)</enum><header>Revocation of
			 Federal management</header><text display-inline="yes-display-inline">The
			 Commission shall certify to the Secretary that the Commission has approved the
			 fishery management measures submitted under subsection (a) for all Gulf coastal
			 States. Upon receipt of the certification, the Secretary shall—</text>
				<paragraph id="H7D16ADC5615549F38BD0403945471C04"><enum>(1)</enum><text>publish a notice
			 in the Federal Register revoking those regulations and portions of the Federal
			 fishery management plan that are in conflict with the fishery management plan
			 submitted under section 4, including the deletion of the Gulf of Mexico red
			 snapper from the Federal fishery management plan; and</text>
				</paragraph><paragraph id="H70BF9E30DD244524A155A313B42C3DF8"><enum>(2)</enum><text>transfer
			 management of Gulf of Mexico red snapper to the Gulf coastal
			 States.<italic></italic></text>
				</paragraph></subsection><subsection id="H6C06221440A147C0BC8A2FA5A4E8BE9B"><enum>(d)</enum><header>Implementation</header><text>Upon
			 the transfer of management described in subsection (c)(2), each Gulf coastal
			 State shall implement the measures approved under subsection (b).</text>
			</subsection></section><section id="H80A809949B0E42DEA93F3A31885B7328"><enum>7.</enum><header>Commission
			 oversight responsibilities</header>
			<subsection id="H4B637FB99F25494F82A981EE95585D44"><enum>(a)</enum><header>Implementation
			 and enforcement of fishery management measures</header><text>In December of the
			 year following the transfer of management described in section 6(c)(2), and at
			 any other time the Commission considers appropriate after that December, the
			 Commission shall determine if—</text>
				<paragraph id="H30146577F4E1429FB40E47107E6DBD9F"><enum>(1)</enum><text>each Gulf coastal
			 State has fully adopted and implemented fishery management measures;</text>
				</paragraph><paragraph id="H4601D43F8150411A84EE842A4F895362"><enum>(2)</enum><text>such measures
			 continue to be in compliance with the fishery management plan; and</text>
				</paragraph><paragraph id="H0C5FDA4206B7415E86712C3F7640824D"><enum>(3)</enum><text display-inline="yes-display-inline">the enforcement of such measures by each
			 Gulf coastal State is satisfactory to maintain the long-term sustainability and
			 abundance of Gulf of Mexico red snapper.</text>
				</paragraph></subsection><subsection id="H1694D8C67C51492D952C0B16D6CCDF23"><enum>(b)</enum><header>Certification of
			 overfishing and rebuilding plans</header><text display-inline="yes-display-inline">If the Gulf of Mexico red snapper in a Gulf
			 coastal State is experiencing overfishing or is subject to a rebuilding plan,
			 that Gulf coastal State shall submit a certification to the Commission showing
			 that such State—</text>
				<paragraph id="H899BCE90C1F14AAB8E6FED037B1232D0"><enum>(1)</enum><text>has implemented
			 the necessary measures to end overfishing or rebuild the fishery; and</text>
				</paragraph><paragraph id="HBF4F86E1E05042709A1491599DE7FB66"><enum>(2)</enum><text display-inline="yes-display-inline">in consultation with the National Oceanic
			 and Atmospheric Administration, has implemented a program to provide for data
			 collection adequate to monitor the harvest of Gulf of Mexico red snapper by
			 such Gulf coastal State.</text>
				</paragraph></subsection></section><section id="HF8EE6A343AB2440995065EA3A3A96675"><enum>8.</enum><header>Opportunity to
			 remedy</header>
			<subsection id="H2648DC6053054899BECF44B1C68121AC"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">If the Commission
			 finds that a Gulf coastal State is noncompliant under section 7, the Commission
			 shall offer assistance to that Gulf coastal State to remedy the finding of
			 noncompliance.</text>
			</subsection><subsection id="H1F6135D5B908433E88318A941DB19E30"><enum>(b)</enum><header>Notification to
			 Secretary for continued noncompliance</header><text display-inline="yes-display-inline">If, after such time as determined by the
			 Commission, the Gulf coastal State receiving assistance described in subsection
			 (a) remains noncompliant, the Commission shall vote on whether to notify the
			 Secretary.</text>
			</subsection></section><section id="H8618029FBEBD4EDFAA8B3045394863E6"><enum>9.</enum><header>Closure of the
			 Gulf of Mexico red snapper fishery</header>
			<subsection id="H805135BA189D40DF90CF1B7F09520F89"><enum>(a)</enum><header>Conditions for
			 closure</header><text>Not later than 60 days after the receipt of a notice
			 under section 8(b), the Secretary may declare a closure of the Gulf of Mexico
			 red snapper fishery within the Federal waters adjacent to the waters of the
			 Gulf coastal State that is the subject of such notice.</text>
			</subsection><subsection id="H5B3D2A1CEBD9483588362AB2036CC9A0"><enum>(b)</enum><header>Considerations</header><text>Prior
			 to making a declaration under subsection (a) the Secretary shall consider the
			 comments of such Gulf coastal State and the Commission.</text>
			</subsection><subsection id="HBE95B3AC284E4C748EA02CAD4EAC0EAD"><enum>(c)</enum><header>Actions
			 prohibited during closure</header><text>During a closure of the Gulf of Mexico
			 red snapper fishery under subsection (a), it is unlawful for any person—</text>
				<paragraph id="H7A5C3E09AE344668BB5B432D091CC2AE"><enum>(1)</enum><text display-inline="yes-display-inline">to engage in fishing for Gulf of Mexico red
			 snapper within the Federal waters adjacent to the waters of the Gulf coastal
			 State covered by the closure;</text>
				</paragraph><paragraph id="HCD323FE3406F4FA0ADE727E064B9DF22"><enum>(2)</enum><text display-inline="yes-display-inline">to land, or attempt to land, the Gulf of
			 Mexico red snapper to which the closure applies; or</text>
				</paragraph><paragraph id="H5DDE591F870F497D8499E51937D0EA58"><enum>(3)</enum><text>to fail to return
			 to the water any Gulf of Mexico red snapper to which the closure applies that
			 are caught incidental to commercial harvest or in other recreational
			 fisheries.</text>
				</paragraph></subsection></section><section id="HA6D140DF319E44B4B00CE02E1C2CEFDC"><enum>10.</enum><header>Economic
			 analysis and report</header>
			<subsection id="HF09AE565B94A4724A6C26D8DAC27CA9E"><enum>(a)</enum><header>Economic
			 analysis of Gulf of Mexico red snapper fishery</header><text>The Secretary, in
			 consultation with the Gulf coastal States and the Commission, shall conduct a
			 study and analysis of the economic impacts for the local, regional, and
			 national economy of the Gulf of Mexico red snapper fishery. The study shall
			 include an analysis of—</text>
				<paragraph id="HDC74BAB2EF784F12A8AFA7828883D72F"><enum>(1)</enum><text>the beneficial
			 economic impacts on industries directly related to the Gulf of Mexico red
			 snapper fishery, including boat sales, marina activity, boat construction and
			 repair, fishing gear and tackle sales, and other closely related industries;
			 and</text>
				</paragraph><paragraph id="HF87B8ACEA56D4AE097FB012D04DD594B"><enum>(2)</enum><text display-inline="yes-display-inline">the downstream economic impacts of the Gulf
			 of Mexico red snapper fishery on the economies of the Gulf coastal States,
			 including hotels, restaurants, grocery stores, related tourism, and other
			 peripheral businesses and industries.</text>
				</paragraph></subsection><subsection id="H830D05B3CF164898A06C8518209AF07F"><enum>(b)</enum><header>Biennial
			 reports</header><text>Beginning 2 years after the date of the enactment of this
			 Act, and every 2 years thereafter, the Secretary shall submit a report on the
			 findings of the study conducted under subsection (a) to Congress, the Governor
			 of each of the Gulf coastal States, and the Commission. Each report shall be
			 made available to the public and shall include recommendations for additional
			 actions to be taken to encourage the sustainability of the Gulf of Mexico red
			 snapper fishery.</text>
			</subsection></section></legis-body>
