which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Older Americans Act of 1965 to authorize Federal assistance to State adult protective services programs, and for other purposes.</official-title></form><legis-body id="H492EEA2792B246D0BE80A878F887A7CB" style="OLC"><section id="H41D695A0F1EC452CBF76844C2B73F88B" section-type="section-one"><enum>1.</enum><header>Short title; findings</header><subsection id="H2338D42ECCB041A080D21832018890A7"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Elder Protection and Abuse Prevention Act</short-title></quote>.</text></subsection><subsection id="HA0D8929CBF8341DD9F5FE2A5E002D00C"><enum>(b)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="HE1FB350DAFD7428B8C8683E3C1BCCF7B"><enum>(1)</enum><text>In 2009, the Department of Justice estimated that 14.1 percent of non-institutionalized older adults in the United States had experienced some form of elder abuse in the past year.</text></paragraph><paragraph id="H460444E8BE0C42C4B3D00C7F652F3B38"><enum>(2)</enum><text>Only 1 in 23.5 cases of elder abuse is ever reported due to a lack of screening, awareness, and prevention efforts.</text></paragraph><paragraph id="H1870D95833964313A3CCEA7216DC9105"><enum>(3)</enum><text>The mortality rate of older adults who are victims of abuse is 3 times higher than older adults that are not victims of abuse.</text></paragraph><paragraph id="H3EB7177138B5456B8BF3AD94123D2F59"><enum>(4)</enum><text>The annual financial loss by victims of elder financial abuse is estimated to be at least $2,900,000,000, and steadily increasing.</text></paragraph></subsection></section><section id="H840B6AB70EEB45B3A7961594CBE23924"><enum>2.</enum><header>Adult protective services; definitions</header><text display-inline="no-display-inline">Section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>) is amended—</text><paragraph id="H663D374A91D0404495C4AAA1D1A13569"><enum>(1)</enum><text>by amending paragraph (1) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H6DEF5CEF9AEC4ABAA6CB60EB0DF60664" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="HD113B7863D6D4CC985EDE16BDF59BBF7"><enum>(1)</enum><header display-inline="yes-display-inline">Abuse</header><text display-inline="yes-display-inline">The term <term>abuse</term> means the knowing infliction of physical or psychological harm or the knowing deprivation of goods or services that are necessary to meet essential needs or to avoid physical or psychological harm.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HF59D87699476422690D53DB72CA80216"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (4) through (54) as paragraphs (5) through (55);</text></paragraph><paragraph id="H3AD33F44EB3144CE95CF37BE8D1DD849"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3), the following:</text><quoted-block display-inline="no-display-inline" id="HFF04243884A84676B667A4455A4AE43C" style="OLC"><paragraph id="H291A2184F8424392B5613105526C81A7"><enum>(4)</enum><header>Adult protective services</header><text display-inline="yes-display-inline">The term <term>adult protective services</term> means such services provided to adults as the Secretary may specify and includes services such as—</text><subparagraph commented="no" display-inline="no-display-inline" id="H27EA0F64CFEA40D6A69B14D27F81C01B"><enum>(A)</enum><text>receiving reports of adult abuse, neglect, or exploitation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE4879D4405904583BD72DEA3F0E2A984"><enum>(B)</enum><text>investigating the reports described in subparagraph (A);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5DD60C574A5C4861AB1E80FB48E24FAC"><enum>(C)</enum><text>case planning, monitoring, evaluation, and other case work and services; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBF874A4FA405471D87455CA191DF90D0"><enum>(D)</enum><text>providing, arranging for, or facilitating the provision of medical, social service, economic, legal, housing, law enforcement, or other protective, emergency, or support services.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="HCB6AE2594082456C932D2887F206C90C"><enum>(4)</enum><text>by amending paragraph (18), as so redesignated, to read as follows:</text><quoted-block display-inline="no-display-inline" id="H9291CB9AF65248E6984D6697CA560580" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="HD18432DF3FDF4B049A33496DE3823316"><enum>(18)</enum><header display-inline="yes-display-inline">Elder justice</header><text display-inline="yes-display-inline">The term <term>elder justice</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="H9E58714F1A224FD3AD410D26BE450A98"><enum>(A)</enum><text>from a societal perspective, efforts to—</text><clause id="H0B5856CD38E646EF87711A4C3B0AB6CD"><enum>(i)</enum><text>prevent, detect, treat, intervene in, and prosecute elder abuse, neglect, and exploitation; and</text></clause><clause id="HBEBC7EEF10F7445DAB707BDA67567339"><enum>(ii)</enum><text>protect older individuals with diminished capacity while maximizing their autonomy; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD73A1EF9EE314B4B95301BE5FA708201"><enum>(B)</enum><text>from an individual perspective, the recognition of an older individual's rights, including the right to be free of abuse, neglect, and exploitation.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HDB71A3C096D44F00892C797CF75EACCE"><enum>(5)</enum><text>in paragraph (19), as so redesignated, by striking <quote>The term <quote>exploitation</quote> means</quote> and inserting <quote>The terms <quote>exploitation</quote> and <quote>financial exploitation</quote> mean</quote>;</text></paragraph><paragraph id="HAE2DBACC16204D3D99048C468F0B96D9"><enum>(6)</enum><text>in paragraph (25), as so redesignated—</text><subparagraph id="HFC515B0F9C9A4FD0AD53A9CFA1B52444"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>and</quote>;</text></subparagraph><subparagraph id="HD382FF918298444D88495BCEC5E3753C"><enum>(B)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H65F1B6150E814CEF8D232A24D41B29E1"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H53C9931AE08640A2A232FEAC3A4100CA" style="OLC"><subparagraph id="H94640019A66243F9A9BF8956A8937612"><enum>(D)</enum><text>abuse, neglect (including self-neglect), financial exploitation, including factors that are the basis of a referral to adult protective services.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3CF561DBAD6549A1BB561C13517D4453"><enum>(7)</enum><text>in paragraph (29)(C), as so redesignated, by inserting <quote>, including opportunities for work and volunteer service in the community</quote> after <quote>available</quote>;</text></paragraph><paragraph id="H6D2F5813B55C47D09A7B5EEC9E026D6A"><enum>(8)</enum><text>in paragraph (30), as so redesignated, by striking <quote>information and referral</quote> and inserting <quote>information and referral assistance</quote>; and</text></paragraph><paragraph id="HDFDE2A2B95104C0EB90D298C77D46BEE"><enum>(9)</enum><text>in paragraph (37), as so redesignated, by inserting <quote>(including elder abuse and neglect screening)</quote> after <quote>educational services</quote>.</text></paragraph></section><section id="HCDB3FC6159D749FC9C6E1837393A2039"><enum>3.</enum><header>Coordination of elder justice activities</header><subsection id="H6560609DA8294BEC96900BB5BC4771AB"><enum>(a)</enum><header>Use of funds</header><text>Section 201 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3011">42 U.S.C. 3011</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HEF93E8404CD346DE9EF5D514F0FDEC7E" style="OLC"><subsection id="H938D324899834284BE86A2BAE69DF519"><enum>(g)</enum><text>The Assistant Secretary is authorized to use funds appropriated to carry out this Act to implement activities authorized under part I of subtitle B of title XX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397k">42 U.S.C. 1397k et seq.</external-xref>), including the establishment of the Advisory Board on Elder Abuse, Neglect, and Exploitation and the continuation of the work of the Elder Justice Coordinating Council.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF4BC970D78164B559E56CF1FECD40E49"><enum>(b)</enum><header>Assurance of appropriate training for staff</header><text>Section 202 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3012">42 U.S.C. 3012</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H644157B31D4E412383678DB9D0E5FD71" style="OLC"><subsection id="H64A5547B6CD445E5A8B231815D7819B2"><enum>(g)</enum><text>The Assistant Secretary shall—</text><paragraph id="HB190B1CA15D143F5AC082BD828962EF3"><enum>(1)</enum><text>ensure, where appropriate, that all programs funded under this Act include appropriate training in prevention and provision of services that address elder justice and exploitation; and</text></paragraph><paragraph id="HA787E810A2B24E9D951E9019DF64DA78"><enum>(2)</enum><text>periodically update the need for and benefit of such training related to prevention of abuse, neglect, and exploitation of older adults.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H60479EDD9C734DCFB3706714FBF0E098"><enum>(c)</enum><header>Information and assistance services</header><text>Section 202(a)(21) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3012">42 U.S.C. 3012(a)(21)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HF7116D30094048D0BE48C9D7B60D0B05" style="OLC"><paragraph id="HB977274FDC684169AD79784CF06FAD2B" indent="up1"><enum>(21)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H78E80D9269C647329A7E58661DB0A2DC"><enum>(A)</enum><text>establish information and assistance services as priority services for older individuals, and ensure that quality information and assistance services are consistently provided to older individuals;</text></subparagraph><subparagraph id="HE95882931D534BCF98AE3EA2C966D923" indent="up1"><enum>(B)</enum><text>ensure that there is full collaboration between all governmental information and assistance systems that serve older individuals, whether specialized, crisis intervention, disaster assistance, or others; and</text></subparagraph><subparagraph id="H14D0495510614061964BE0C7840171BD" indent="up1"><enum>(C)</enum><text>develop and operate, either directly or through contracts, grants, or cooperative agreements, a National Eldercare Locator Service, providing information and assistance services through a nationwide toll free number to identify community resources for older individuals;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEF684FCFF093448F9AA292DD698762C7"><enum>(d)</enum><header>Integration of titles</header><text>Section 701 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3058">42 U.S.C. 3058</external-xref>) is amended by adding at the end the following: <quote>The Assistant Secretary, to the maximum extent practicable, shall ensure there be full integration of education and public awareness activities under this title with all service programs under title III with special emphasis on the nutrition programs, legal services, information and referral assistance activities, the work of aging and disability resource centers, and the long-term care ombudsman programs, including programs carried out under title VI.</quote>.</text></subsection></section><section id="H602BB758BD924622AD583D7971667612"><enum>4.</enum><header>Coordination of national adult protective services resource center with elder abuse and exploitation prevention</header><text display-inline="no-display-inline">Subsection (e)(2) of section 201 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3011">42 U.S.C. 3011</external-xref>) is amended in the matter preceding subparagraph (A) by inserting <quote>, and in coordination with State Directors of the Adult Protective Services Programs and State Directors of the Office of Long-Term Care Ombudsman Programs</quote> after <quote>and services</quote>.</text></section><section id="HE925826B08C24ADF82BDA26FE71B32DB"><enum>5.</enum><header>National adult protective services resource center</header><subsection id="HFAE517FE982F469DB8C1C7395A7C64D5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 201 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3011">42 U.S.C. 3011</external-xref>), as amended by section 3, is further amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HA9D1511BC072493CA99896E15ECCA0C2" style="OLC"><subsection id="H5A406BFA37784F64AF6D3BA58381C3F2"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H07A6C780ADC740E28AC396331434C40E"><enum>(1)</enum><text display-inline="yes-display-inline">The Assistant Secretary shall, by grant or contract with a national nonprofit entity, establish a National Adult Protective Services Resource Center (referred to in this subsection as the <term>Center</term>). The purposes of the Center are to improve the capacity of State and local adult protective services programs to respond effectively to abuse, neglect, and exploitation of vulnerable adults, including home care consumers and residents of long-term care facilities, and to coordinate with the Long-Term Care Ombudsman Program to protect home care consumers and residents most effectively.</text></paragraph><paragraph id="H15973820DF3F4ED8955C25DCF643E6CB" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The nonprofit entity awarded a grant or contract under this subsection shall have expertise in, and representation by, State and local adult protective services programs.</text></paragraph><paragraph id="H03426A47C0DC4675A11E62AB65A85D56" indent="up1"><enum>(3)</enum><text>The Center shall—</text><subparagraph id="H6854318A63CB4BF7B9DC0289290DF654"><enum>(A)</enum><text>collect and disseminate information regarding, and increase public awareness of, the role of adult protective services programs in investigating the abuse, neglect (including self-neglect), and exploitation of vulnerable adults, including home care consumers and residents of long-term care facilities, and in intervening to protect the consumers and residents from abuse;</text></subparagraph><subparagraph id="H0D96BFF1C3A8417C8648E3B785A78A8B"><enum>(B)</enum><text>develop, distribute, and provide training and technical assistance for adult protective services program investigators and supervisors investigating the abuse, neglect (including self-neglect), and exploitation of vulnerable adults, including home care consumers and residents of long-term care facilities, and intervening to protect the consumers and residents from further abuse;</text></subparagraph><subparagraph id="H9BE5B21D93504CC8BFC3B867CFEF7F8D"><enum>(C)</enum><text>develop, distribute, and provide training to home care and long-term care professionals and others on recognizing, reporting (including regarding mandatory reporting requirements), and responding to the abuse, neglect (including self-neglect), and financial exploitation of vulnerable adults, including home care consumers and residents of long-term care facilities;</text></subparagraph><subparagraph id="H828E77C2E8854902BDFF32B46F97FDA3"><enum>(D)</enum><text>compile and disseminate reports on research and best practices for adult protective services programs and other programs on effective responses to the abuse, neglect (including self-neglect), and exploitation of vulnerable adults, including home care consumers and residents of long-term care facilities;</text></subparagraph><subparagraph id="H3B629F9F82514D2F8F2ACB1A4B4C0B85"><enum>(E)</enum><text>work with the National Ombudsman Resource Center and long-term care ombudsman programs to develop and disseminate training, practice standards, and policies regarding—</text><clause id="H60C5C990A77046A289F92BA91CDDBBE7"><enum>(i)</enum><text>the roles and responsibilities of adult protective services and ombudsman programs;</text></clause><clause id="H0FD13634A80B4B4798FB570E472413FD"><enum>(ii)</enum><text>confidentiality and abuse reporting issues and protocols; and</text></clause><clause id="H9FF5D7FB5C9848EAA39AF42BE507F2E6"><enum>(iii)</enum><text>effective ways to maximize the resources of adult protective services programs for the benefit of home care consumers and residents of long-term care facilities; and</text></clause></subparagraph><subparagraph id="HF23D38F0303F417989557A6DD596F3E2"><enum>(F)</enum><text>establish a data system to collect information on the abuse, neglect (including self-neglect), and exploitation of home care consumers and residents of long-term care facilities and to measure the effectiveness of the activities carried out by the Center.</text></subparagraph></paragraph><paragraph id="H47377BDA2F944E4988BEDEB42A5C307D" indent="up1"><enum>(4)</enum><text>Not later than 18 months after the date of enactment of the <short-title>Elder Protection and Abuse Prevention Act</short-title>, the Director shall—</text><subparagraph id="HECAF3115AE764A0CA2742C643880A138"><enum>(A)</enum><text>collect and analyze, from leading national and State experts, the best practices related to screening for elder abuse;</text></subparagraph><subparagraph id="H744AAE792DDC47C5AD51E9A965422257"><enum>(B)</enum><text>publish a report that describes recommendations regarding such best practices and disseminate such report to all grantees under programs established under this Act and described under this section; and</text></subparagraph><subparagraph id="H19A2A1ADED18463188C9907FAAFAD082"><enum>(C)</enum><text>submit to Congress such report and a description of the dissemination activities under subparagraph (B).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFD822B6659B943F487DF3B6E2C40D30F" indent="up1"><enum>(5)</enum><text>In this subsection, the term <term>home care consumer</term> means a person who receives services in the person's home or community to promote independence and reduce the necessity for residence in a long-term care facility, which may include home care services provided through this Act, the Medicare program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>), the Medicaid program under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>), or another public or private funding source.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC38FD1AAD471431C884D66A70FDFB265"><enum>(b)</enum><header>Authorization of appropriations</header><text>Section 216 of the Older Americans Act is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H68DF1CADCC2A44A1827F6F894E1F139B" style="OLC"><subsection id="HF1BE7AD0EDBA42C088BBC6747D27BC9E"><enum>(d)</enum><header>National Adult Protective Services Resource Center</header><text>There are authorized to be appropriated to carry out section 201(h) (relating to the National Adult Protective Services Resource Center), such sums as may be necessary for fiscal years 2014, 2015, 2016, 2017, and 2018.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H9622E42F6F584613B75EBEDBC4C10AC7"><enum>6.</enum><header>Inclusion of adult protective services programs in congressional reports</header><text display-inline="no-display-inline">Section 207(b)(1)(C) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3018">42 U.S.C. 3018(b)(1)(C)</external-xref>) is amended by inserting <quote>and the adult protective services programs of the States</quote> after <quote>of the States</quote>.</text></section><section id="H9C1B0CBF72844847A40CAA0F9A8C901D"><enum>7.</enum><header>Prevention, assessment, and response to elder abuse</header><subsection id="HFE53FA329792462B85AF5DA71C65BA9B"><enum>(a)</enum><header>Preferences</header><text>Section 305(a)(2)(E) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3025">42 U.S.C. 3025(a)(2)(E)</external-xref>) is amended by inserting <quote>older individuals who are or are alleged victims of elder abuse, neglect, or exploitation,</quote> after <quote>proficiency,</quote>.</text></subsection><subsection id="H2BDFF4F192E64BD7A9B65A588F456BE7"><enum>(b)</enum><header>Area plans</header><text display-inline="yes-display-inline">Section 306 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3026">42 U.S.C. 3026</external-xref>) is amended—</text><paragraph id="H6AFEFF87D3184631BCF0E71D2690F5C5"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(6)—</text><subparagraph id="HD8839829B1304BA0BFE569CEF1D1782F"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (G), by inserting <quote>and</quote> at the end; and</text></clause><clause id="H2F22B5953B8B41468EC63DA02E0861F9" indent="up1"><enum>(iv)</enum><text>report any instances of elder abuse in accordance with State law.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB49448EC681B40CE9D82EF8DB3E57D0D"><enum>(2)</enum><text>in subsection (b)(3)—</text><subparagraph id="HADE0333002A34B66B0E4BAFA073014A5"><enum>(A)</enum><text>in subparagraph (J), by striking <quote>and</quote>;</text></subparagraph><subparagraph id="HD8C0094AEE8047DE8BCB2822C9ADC5F9"><enum>(B)</enum><text>by redesignating subparagraph (K) as subparagraph (L); and</text></paragraph><paragraph id="H43DD228162B746E2A049254C9EB0B447"><enum>(3)</enum><text>in paragraph (23), by inserting <quote>, elder abuse, neglect, and financial exploitation</quote> after <quote>mental health</quote>.</text></paragraph></subsection><subsection id="HC3499E8B8D504E8096E011BAF4DE09D3"><enum>(e)</enum><header>Nutrition</header><text>Section 339(2) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3030g-21">42 U.S.C. 3030g–21(2)</external-xref>) is amended—</text><paragraph id="HE094AEF42E784F03BEB532D86439F056"><enum>(1)</enum><text>in subparagraph (J), by striking <quote>, and</quote> and inserting a comma;</text></paragraph><paragraph id="H9CDD40E025DD4752982F40AE68498D51"><enum>(2)</enum><text>in subparagraph (K), by striking the period at the end and inserting <quote>, and</quote>; and</text></paragraph><paragraph id="H3FA4BAC56C074871A1BAF9909B0DFCD6"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5C59FC2D6B2244CE860F932C02648BB0" style="OLC"><subparagraph id="H2C96BEB670DF481298AD3EFDA964EB51"><enum>(L)</enum><text>encourages individuals who distribute nutrition services under subpart 2 to distribute information on diabetes, elder abuse, neglect, financial exploitation, and the annual Medicare wellness exam.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HC53434944E954FDC9999093D477A4834"><enum>8.</enum><header>Abuse prevention education and training</header><subsection id="H3418C32C993B4CFBA667F1FA8422CAF3"><enum>(a)</enum><header>Activities for health, independence, and longevity</header><paragraph id="H57FCA96D81EE4AF09A37301F08C36C66"><enum>(1)</enum><header>Older individuals' protection from violence projects</header><text>Section 413(b) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3032b">42 U.S.C. 3032b(b)</external-xref>) is amended—</text><subparagraph id="H2B3E177D619B4C4592918B0AAB7AB9C1"><enum>(A)</enum><text>in paragraph (3), by striking <quote>or</quote> after the semicolon at the end;</text></subparagraph><subparagraph id="H5CA70332DFC241EA9D71FCC3857D537C"><enum>(B)</enum><text>in paragraph (4), by striking the period at the end and inserting <quote>; and</text></subparagraph><subparagraph id="H55419F201825486FA9C6D51C86457F6F"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HB89BA904DD4E41CDAF366570EB2A0072" style="OLC"><subparagraph id="HBFA79914278F4F48A141CAB96BA4CFD0"><enum>(C)</enum><text>engage volunteers who are older than 50 years of age in providing support and information to older adults (and their families or caretakers) who have experienced or are at risk of elder abuse, including physical, emotional, or financial abuse, neglect, or exploitation and;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HCD8FFF77E8F9477C9DBC4CAF2BA59D33"><enum>(b)</enum><header>Community service senior opportunities</header><text>Section 502(b)(1)(E) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3056">42 U.S.C. 3056(b)(1)(E)</external-xref>) is amended by inserting <quote>, and for the health and safety of, and prevention and detection of elder abuse for, older adults</quote> after <quote>families</quote>.</text></subsection><subsection id="HB119F35566244631846611FFD7122936"><enum>(c)</enum><header>Allotments for vulnerable elder rights protection activities</header><paragraph id="H6EF8597D4FF6466295336C0D888F8D9C"><enum>(1)</enum><header>State plan requirements</header><text>Section 705(a)(2) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3058d">42 U.S.C. 3058d(a)(2)</external-xref>) is amended by inserting <quote>family caregivers,</quote> after <quote>title VI,</quote>.</text></paragraph><paragraph id="H4C575CF373CE4C03BCBB9792D936CE03"><enum>(2)</enum><header>State long-term care ombudsman program</header><subparagraph id="H9C04E19171014E73967EC6AB820CE9C2"><enum>(A)</enum><header>Support of Office under the National Family Caregiver Support Program</header><text>Section 373(g) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3030s-1">42 U.S.C. 3030s–1(g)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H17512E3A675447A18830364321002ECB" style="OLC"><paragraph id="H11E6570F14CE4C29903FE3A45D8DACC1"><enum>(3)</enum><header>Use of funds for ombudsman program</header><text>Amounts made available to a State to carry out the State program under this subpart may be used to support the Office of the State Long-Term Care Ombudsman, including supporting the development of resident and family councils.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="HC2EF68D30CF9412E915500C1430C26E1"><enum>(B)</enum><header>Ensuring effective programs and residents' rights</header><text>Section 712 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3058g">42 U.S.C. 3058g</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HA0D10BDC85D44DB68F0F16E846ED292E" style="OLC"><subsection id="HC84749D001844F319ABCBA9D4948CEF2"><enum>(k)</enum><header>Ensuring effective programs and residents' rights</header><text>The State agency shall ensure the Office—</text><paragraph id="HE2B5E2DD44AC4EA2937B0B8626544254"><enum>(1)</enum><text>provides facility residents with private and unimpeded access to the Office, including access to all records concerning the resident; and</text></paragraph><paragraph id="H559E7A218F684421849D64848B70DD07"><enum>(2)</enum><text>allows all facility residents to receive services from the Office.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HF6E40C4C701D45FEB5AEEA6E5C472D18"><enum>(3)</enum><header>Prevention of elder abuse, neglect, and exploitation</header><text>Section 721(b) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3058i">42 U.S.C. 3058i(b)</external-xref>) is amended—</text><subparagraph id="H39815EF2CC82481EAF1BEEF67AC65CC2"><enum>(A)</enum><text>by redesignating paragraphs (7), (8), (9), (10), (11), and (12), as paragraphs (8), (10), (11), (12), (13), and (14), respectively;</text></subparagraph><subparagraph id="H02D4A497CC8444BABBFAD7933BE115BA"><enum>(B)</enum><text>by striking paragraph (6) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H868CE43DB5164447B78C0577F14BD871" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="H4172B10D300147B6BC3D3D7679D83C37"><enum>(6)</enum><text display-inline="yes-display-inline">conducting specialized abuse sensitivity training for caregivers described in part E of title III;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE0E5CEAFF91B49199E081CAC4613D756"><enum>(7)</enum><text display-inline="yes-display-inline">conducting training for professionals and paraprofessionals in relevant fields on the identification, prevention, and treatment of elder abuse, neglect, and exploitation, with particular focus on prevention and enhancement of self-determination and autonomy;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H82921A246BF449BE8CB179CDCA0259FB"><enum>(C)</enum><text>by inserting after paragraph (8), as redesignated by subparagraph (B), the following:</text><quoted-block display-inline="no-display-inline" id="H66A61395C8F94471A94CB784EBADA66E" style="OLC"><paragraph id="HAC52857BC0C643488B159E01494658B7"><enum>(9)</enum><text>conducting appropriate training to ensure cultural sensitivity in the provision of elder rights services, including training in cultural issues associated with abuse;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section></legis-body></bill>
