R. 3078</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action><action-date date="20130910">September 10, 2013</action-date><action-desc><sponsor name-id="S000510">Mr. Smith of Washington</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to disregard amounts transferred from a traditional IRA to a Roth IRA in computing income for purposes of determining the income-related premiums under parts B and D of the Medicare program, and for other purposes.</official-title></form><legis-body id="H66623D4D26EF4007825ACFFCA268E5C4" style="OLC"><section id="H327A90C2D8B942B4870686C4EDA4788D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Roth IRA Flexibility Act of 2013</short-title></quote>.</text></section><section id="H6169372B193342A3B370C8CEFF44814D"><enum>2.</enum><header>Disregarding amounts transferred from a traditional IRA to a Roth IRA in computing income for purposes of determining the income-related premiums under parts B and D of the Medicare program</header><subsection id="H145C71A076E04AD69054E08473DBFBFE"><enum>(a)</enum><header>In general</header><text>Section 1839(i)(4)(A)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395r">42 U.S.C. 1395r(i)(4)(A)(i)</external-xref>) is amended by inserting <quote><short-title>and without regard to any distribution to which paragraph (3) of section 408A(d) of such Code (relating to rollovers from an eligible retirement plan other than a Roth IRA) applies</short-title></quote> before the semicolon.</text></subsection><subsection id="H1F0F57A2021740BCB2C91024304D0E4D"><enum>(b)</enum><header>Disclosure authority</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/6103">Section 6103(l)(20)(A)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="HEA22A4689FD94763A32296FF03877B86"><enum>(1)</enum><text>by redesignating clauses (vii) and (viii) as clauses (viii) and (ix), respectively, and</text></paragraph><paragraph id="H96449CCF251C404CA1A99280F5F61F41"><enum>(2)</enum><text>by inserting after clause (vi) the following new clause:</text><quoted-block display-inline="no-display-inline" id="H0F5391DBD47C4D459884ED285ADE5B28" style="OLC"><clause id="HB60CC523C1344ED594C1D6FECD9D3ED5"><enum>(vii)</enum><text display-inline="yes-display-inline">the amounts included in the taxpayer’s gross income under section 408A(d)(3) to the extent such information is available,</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H36E1C5C3DE664A33B9C2303A6F94AA9D"><enum>(c)</enum><header>Premium rebate based on certain previous distributions</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall provide, in collaboration with the Commissioner of Social Security, to an individual a refund of the premiums paid under parts B and D of title XVIII of the Social Security Act by the individual in an amount that is equal to the difference between such premiums paid by the individual and the premiums that would have been paid by the individual if distributions to which <external-xref legal-doc="usc" parsable-cite="usc/26/408A">section 408A(d)(3)</external-xref> of the Internal Revenue Code of 1986 relate which were made on or after January 1, 2011, had not been taken into account. The Secretary of the Treasury, acting under <external-xref legal-doc="usc" parsable-cite="usc/26/6103">section 6103(l)(20)</external-xref> of the Internal Revenue Code of 1986 and through the Commissioner of Social Security, shall provide such information as may be necessary to carry out the previous sentence and for purposes of subparagraph (B) of such section, activities to carry out this subsection shall be deemed to be related to establishing the appropriate amount of a premium adjustment under section 1839(i) of the Social Security Act.</text></subsection><subsection id="H1076DBC4EB78466292C81DCE8525D078"><enum>(d)</enum><header>Effective dates</header><paragraph id="HFD1DCA4B92DE411F9D08273147F991B9"><enum>(1)</enum><header>In general</header><text>The amendment made by subsection (a) shall apply with respect to premiums for months in years beginning more than 90 days after the date of the enactment of this Act.</text></paragraph><paragraph id="H12A0EA5697714C32945BC33478B9F598"><enum>(2)</enum><header>Disclosure authority</header><text>The amendments made by subsection (b) shall apply to requests for disclosure made after the date of the enactment of this Act (with respect to taxable years beginning before, on, or after such date).</text></paragraph></subsection></section></legis-body></bill>
