<section id="H81D1B27CD7684F1FAC8E4100E10F340A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Biennial Budgeting and Appropriations Act of 2013</short-title></quote>.</text></section> 
<section id="H6948465687B84CE6B1F73ED8690D9767"><enum>2.</enum><header>Revision of timetable</header><text display-inline="no-display-inline">Section 300 of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/631">2 U.S.C. 631</external-xref>) is amended to read as follows:</text>

<subsection id="H5E5F0F8967114E8D856C054895585457"><enum>(a)</enum><header>Declaration of Purpose</header><text>Section 2(2) of the Congressional Budget and Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/621">2 U.S.C. 621(2)</external-xref>) is amended by striking <quote>each year</quote> and inserting <quote>biennially</quote>.</text></subsection>

<paragraph id="HCF68ED57C8D7496DA8F54F6492883765"><enum>(1)</enum><header>Budget resolution</header><text>Section 3(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/622">2 U.S.C. 622(4)</external-xref>) is amended by striking <quote>fiscal year</quote> each place it appears and inserting <quote>biennium</quote>.</text></paragraph> 
<paragraph id="H5D0209ABBE5743A9AB7EE2BFE3DCA9A7"><enum>(2)</enum><header>Biennium</header><text>Section 3 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/622">2 U.S.C. 622</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HC3F9F7E6895E4417820DFAC34E64CD93"><enum>(1)</enum><header>Contents of resolution</header><text>Section 301(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/632">2 U.S.C. 632(a)</external-xref>) is amended—</text> 
<subparagraph id="H471E64460F744B239182394B6277D6F6"><enum>(A)</enum><text>in the matter preceding paragraph (1) by—</text>

<subparagraph commented="no" display-inline="yes-display-inline" id="H01335813E1D541AD8EC61DC1EFF91673"><enum>(A)</enum><text>It shall not be in order in the House of Representatives or the Senate to consider any measure that contains a specific authorization of appropriations for any purpose unless the measure includes such a specific authorization of appropriations for that purpose for not less than each fiscal year in one or more bienniums.</text></subparagraph> 
<subparagraph id="H25EE2A2D2FB5427384D0ED8FA6A04378" indent="up2"><enum>(B)</enum><text>For purposes of this paragraph, a specific authorization of appropriations is an authorization for the enactment of an amount of appropriations or amounts not to exceed an amount of appropriations (whether stated as a sum certain, as a limit, or as such sums as may be necessary) for any purpose for a fiscal year.</text></subparagraph></paragraph> 
<paragraph id="HA0BC7447358F4BB0A6E15DF76B0DB077" indent="up1"><enum>(2)</enum><text>Paragraph (1) does not apply with respect to an authorization of appropriations for a single fiscal year for any program, project, or activity if the measure containing that authorization includes a provision expressly stating the following: <quote>Congress finds that no authorization of appropriation will be required for [Insert name of applicable program, project, or activity] for any subsequent fiscal year.</quote>.</text></paragraph>

<subsection id="HB72466CE72B349EEA09BB22A347AD0E3"><enum>(h)</enum><header>Committee Views of Plans and Reports</header><text>Section 301(d) of the Congressional Budget Act (<external-xref legal-doc="usc" parsable-cite="usc/2/632">2 U.S.C. 632(d)</external-xref>) is amended by adding at the end <quote>Each committee of the Senate or the House of Representatives shall review the strategic plans, performance plans, and performance reports, required under <external-xref legal-doc="usc" parsable-cite="usc/5/306">section 306</external-xref> of title 5, United States Code, and sections <external-xref legal-doc="usc" parsable-cite="usc/31/1115">1115</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/31/1116">1116</external-xref> of title 31, United States Code, of all agencies under the jurisdiction of the committee. Each committee may provide its views on such plans or reports to the Committee on the Budget of the applicable House.</quote>.</text></subsection> 
<subsection id="HA8238782C908425895FFCA47142ECEDD"><enum>(i)</enum><header>Effective Date</header> 
<paragraph id="HCF2081129826459F953CB3F69A6D305F"><enum>(1)</enum><header>In general</header><text>The amendments made by this section shall take effect on September 30, 2016.</text></paragraph> 
<paragraph id="H7B245AC104FE46719D40C63E6AE35B80"><enum>(2)</enum><header>Agency actions</header><text>Effective on and after the date of enactment of this Act, each agency shall take such actions as necessary to prepare and submit any plan or report in accordance with the amendments made by it.</text></paragraph></subsection></section>

<subsection id="H4064337219C04162AC0F3C7006482AE1"><enum>(a)</enum><header>In the House of Representatives</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H1659FCBB3820429BBFAD1F5AD4655B9D"><enum>(1)</enum><text>Clause 2(a) of rule XXI of the Rules of the House of Representatives is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="HEF6C34B4932145038D9804F47E01B51D" indent="up1"><enum>(B)</enum><text>Subdivision (A) does not apply with respect to an appropriation for a single fiscal year for any program, project, or activity if the bill or amendment thereto containing that appropriation includes a provision expressly stating the following: <quote>Congress finds that no additional funding beyond one fiscal year will be required and the [Insert name of applicable program, project, or activity] will be completed or terminated after the amount provided has been expended.</quote>.</text></subparagraph>

<paragraph id="H39525F09F38747BDA885411822B7DEFC" indent="up1"><enum>(2)</enum><text>The table of contents set forth in section 1(b) of the Congressional Budget and Impoundment Control Act of 1974 is amended by adding after the item relating to section 316 the following new item:</text>

<section id="H3CA7766A4302402FAE6981BF060B8658"><enum>10.</enum><header>Assistance by Federal agencies to standing committees of the Senate and the House of Representatives</header> 
<subsection id="HC16D9A77F65640D9A4E1743667654B3A"><enum>(a)</enum><header>Information Regarding Agency Appropriations Requests</header><text>To assist each standing committee of the House of Representatives and the Senate in carrying out its responsibilities, the head of each Federal agency which administers the laws or parts of laws under the jurisdiction of such committee shall provide to such committee such studies, information, analyses, reports, and assistance as may be requested by the chairman and ranking minority member of the committee.</text></subsection> 
<subsection id="H9AA8D2E4244540FD9BD1D22904EC73E8"><enum>(b)</enum><header>Information Regarding Agency Program Administration</header><text>To assist each standing committee of the House of Representatives and the Senate in carrying out its responsibilities, the head of any agency shall furnish to such committee documentation, containing information received, compiled, or maintained by the agency as part of the operation or administration of a program, or specifically compiled pursuant to a request in support of a review of a program, as may be requested by the chairman and ranking minority member of such committee.</text></subsection> 
<subsection id="H964E38AA01C447A7BCC28C42B558ED56"><enum>(c)</enum><header>Summaries by Comptroller General</header><text>Within thirty days after the receipt of a request from a chairman and ranking minority member of a standing committee having jurisdiction over a program being reviewed and studied by such committee under this section, the Comptroller General of the United States shall furnish to such committee summaries of any audits or reviews of such program which the Comptroller General has completed during the preceding six years.</text></subsection> 
<subsection id="HBEF1FAA5C3F8433A858A6FBCF358F496"><enum>(d)</enum><header>Congressional Assistance</header><text>Consistent with their duties and functions under law, the Comptroller General of the United States, the Director of the Congressional Budget Office, and the Director of the Congressional Research Service shall continue to furnish (consistent with established protocols) to each standing committee of the House of Representatives or the Senate such information, studies, analyses, and reports as the chairman and ranking minority member may request to assist the committee in conducting reviews and studies of programs under this section.</text></subsection></section> 
<section id="HDD5F07B497BA49608FB36D850B5B9CAD"><enum>11.</enum><header>Report on two-year fiscal period</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Director of the Office of Management and Budget shall—</text> 
<paragraph id="H660B7DF63FFE4F959BC9A39D16883DD9"><enum>(1)</enum><text>determine the impact and feasibility of changing the definition of a fiscal year and the budget process based on that definition to a 2-year fiscal period with a biennial budget process based on the 2-year period; and</text></paragraph> 
<paragraph id="H67A333918F844759BEF0D7ABD454EA43"><enum>(2)</enum><text>report the findings of the study to the Committees on the Budget of the House of Representatives and the Senate and the Committee on Rules of the House of Representatives.</text></paragraph></section> 
<section id="H51AFB1D8D51544A19D07716E7C2EE7AF"><enum>12.</enum><header>Special transition period for the 114th Congress</header> 
<subsection id="HC99130E180AB42878D43B2800A02AF12"><enum>(a)</enum><header>President’s Budget Submission for Fiscal Year 2016</header><text>The budget submission of the President pursuant to <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105(a)</external-xref> of title 31, United States Code, for fiscal year 2016 shall include the following:</text> 
<paragraph id="HEC408B6AAC8F403D8203F3A3AF223C42"><enum>(1)</enum><text>An identification of the budget accounts for which an appropriation should be made for each fiscal year of the fiscal year 2016–2017 biennium.</text></paragraph> 
<paragraph id="H6BFE605B99B04D2493E9B07F2A81D178"><enum>(2)</enum><text>Budget authority that should be provided for each such fiscal year for the budget accounts identified under paragraph (1).</text></paragraph></subsection> 
<subsection id="H4F9F2BE9E2F948A4A6C2D68EF2015DF9"><enum>(b)</enum><header>Review and Recommendations of the Committees on Appropriations</header><text>The Committee on Appropriations of the House of Representatives and the Senate shall review the items included pursuant to subsection (a) in the budget submission of the President for fiscal year 2016 and include its recommendations thereon in its views and estimates made under section 301(d) of the Congressional Budget Act of 1974 within 6 weeks of that budget submission.</text></subsection> 
<subsection id="H001DD79C5EBD400BB6443A383DCA8FC0"><enum>(c)</enum><header>Actions by the Committees on the Budget</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H3B797DD3F334410582ACEE8396B67FB8"><enum>(1)</enum><text>The Committee on the Budget of the House of Representatives and the Senate shall review the items included pursuant to subsection (a) in the budget submission of the President for fiscal year 2016 and the recommendations submitted by the Committee on Appropriations of its House pursuant to subsection (b) included in its views and estimates made under section 301(d) of the Congressional Budget Act of 1974.</text></paragraph> 
<paragraph id="H32709847D98D4C8FA85A6B727F0952C7" indent="up1"><enum>(2)</enum><text>The report of the Committee on the Budget of each House accompanying the concurrent resolution on the budget for fiscal year 2016 and the joint explanatory statement of managers accompanying such resolution shall also include allocations to the Committee on Appropriations of its House of total new budget authority and total outlays (which shall be deemed to be made pursuant to section 302(a) of the Congressional Budget Act of 1974 for purposes of budget enforcement under section 302(f)) for fiscal year 2017 from which the Committee on Appropriations may report regular appropriation bills for fiscal year 2016 that include funding for certain accounts for each of fiscal years 2016 and 2017.</text></paragraph> 
<paragraph id="H9D25BC4962D84256858869E443264B8F" indent="up1"><enum>(3)</enum><text>The report of the Committee on the Budget of each House accompanying the concurrent resolution on the budget for fiscal year 2016 and the joint explanatory statement of managers accompanying such resolution shall also include the assumptions upon which such allocations referred to in paragraph (2) are based.</text></paragraph></subsection> 
<subsection id="HC1699288FE754B38A07F33F2AA2A01C2"><enum>(d)</enum><header>GAO Programmatic Oversight Assistance</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="HF75319A229554E3C8DC35B825C608541"><enum>(1)</enum><text>During the first session of the 114th Congress the committees of the House of Representatives and the Senate are directed to work with the Comptroller General of the United States to develop plans to transition program authorizations to a multi-year schedule.</text></paragraph> 
<paragraph id="H59E1961E09EB40C3B7FFB4845A008F56" indent="up1"><enum>(2)</enum><text>During the 114th Congress, the Comptroller General of the United States will continue to provide assistance to the Congress with respect to programmatic oversight and in particular will assist the committees of Congress in designing and conforming programmatic oversight procedures for the fiscal year 2016–2017 biennium.</text></paragraph></subsection> 
<subsection id="HD9E20E00B8FC4D8D86D5A984A6CCE761"><enum>(e)</enum><header>CBO Authorization Report</header><text>On or before January 15, 2016, the Director of the Congressional Budget Office, after consultation with the appropriate committees of the House of Representatives and Senate, shall submit to the Congress a report listing (A) all programs and activities funded during fiscal year 2016 for which authorizations for appropriations have not been enacted for that fiscal year and (B) all programs and activities funded during fiscal year 2016 for which authorizations for appropriations will expire during that fiscal year, fiscal year 2017, or fiscal year 2018.</text></subsection> 
<subsection id="H41DED4E2DE5E471E9432CFBD6BDC7091"><enum>(f)</enum><header>President’s Budget Submission for Fiscal Year 2017</header><text>The budget submission of the President pursuant to <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105(a)</external-xref> of title 31, United States Code, for fiscal year 2017 shall include an evaluation of, and recommendations regarding, the transitional biennial budget process for the fiscal year 2016–2017 biennium that was carried out pursuant to this section.</text></subsection> 
<subsection id="HAAFA5422ADDA458F876748A5C7E28DC2"><enum>(g)</enum><header>CBO Transitional Report</header><text>On or before March 31, 2016, the Director of the Congressional Budget Office shall submit to Congress an evaluation of, and recommendations regarding, the transitional biennial budget process for the fiscal year 2016–2017 biennium that was carried out pursuant to this section.</text></subsection></section> 
<section id="H3AFE129F486640738B5A02A2C795F0D7"><enum>13.</enum><header>Effective date</header><text display-inline="no-display-inline">Except as provided by sections 8, 11, and 12, this Act and the amendments made by it shall take effect on January 1, 2017, and shall apply to budget resolutions and appropriations for the biennium beginning with fiscal year 2018.</text></section>
