<section id="H9D51BB8D85484A6E8642127E6849EC5C" section-type="section-one"><enum>1.</enum><header>Transmittal of electronic medical records to separating members of the Armed Forces</header> 
<subsection id="H673E752259374B17BBEF093419A839D6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/1142">Section 1142</external-xref> of title 10, United States Code, is amended—</text> 
<paragraph id="HBF0B326A164640E1804ED8D1AFB5626E"><enum>(1)</enum><text>in subsection (c)—</text> 
<subparagraph id="H72D2952AEF524AB082D5FF968B183B61"><enum>(A)</enum><text>by striking <quote>In the case</quote> and inserting <quote>(1) In the case</quote>;</text></subparagraph> 
<subparagraph id="H5BE57D2F947D45B9A36A3873E416AB00"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraph:</text>

<paragraph id="H6E093F211B6C4174B0BB404B18CC5A12" indent="up1" commented="no"><enum>(2)</enum> 
<subparagraph id="H21C8E9CE540C4A13980EB2C3A9BD50F8" display-inline="yes-display-inline"><enum>(A)</enum><text>The Secretary concerned shall provide to each member of the armed forces who is scheduled to be separated from the armed forces a copy of the medical records of the member (including the results of a Physical Evaluation Board or any other physical examination) in an electronic format.</text></subparagraph> 
<subparagraph id="H5BE53AA20FDB462A942A1EB49E4FED2F" indent="up1"><enum>(B)</enum><text>To the extent practicable, the Secretary concerned shall ensure that medical records provided to a member of the National Guard under subparagraph (A) include medical records that are—</text> 
<clause id="H3E74CA1F1E4B402993533955268C05F6"><enum>(i)</enum><text display-inline="yes-display-inline">in connection with the service of the member in the National Guard, maintained by the Governor of the State, Commonwealth, territory, or possession of the United States, or in the case of the District of Columbia, the Commanding General of the National Guard of the District of Columbia; and</text></clause> 
<clause id="H085BB293FABB49FDADDC23F4FBF7C968"><enum>(ii)</enum><text>provided to the Secretary for purposes of such subparagraph.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H5B8622A9F2204EE69EBBA8A35BB52523"><enum>(C)</enum><text>in the heading by striking <quote><header-in-text level="subsection" style="USC">to Department of Veterans Affairs</header-in-text></quote>; and</text></subparagraph></paragraph> 
<paragraph id="H46B47443A22440D4AE77838676DEB208"><enum>(2)</enum><text>in the heading by striking <quote><header-in-text level="section" style="USC">to Department of Veterans Affairs</header-in-text></quote>.</text></paragraph></subsection> 
<subsection id="H3EC4346A6D9F4161813A8C5E9774FCE6"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of chapter 58 of such title is amended by striking the item relating to section 1142 and inserting the following:</text>

<section id="H769A0B69DECE49B6800D93CEDD742CE2"><enum>2.</enum><header>Mandatory physical examinations of separating members of the Armed Forces</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/1145">Section 1145</external-xref> of title 10, United States Code, is amended—</text> 
<paragraph id="H03017E1A99444E59A5D3BA93CE038A98"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(5)—</text> 
<subparagraph id="H7890ABF7A0F249559D4BDE235037D7F6"><enum>(A)</enum><text>by striking <quote>(A) The Secretary</quote> and inserting <quote>The Secretary</quote>;</text></subparagraph> 
<subparagraph id="HBFD4E95FBE244D3984C0DC3553D4A71C"><enum>(B)</enum><text>by inserting <quote>comprehensive</quote> after <quote>undergo a</quote>; and </text></subparagraph> 
<subparagraph id="HB3059C5C67AF4C3B831824FBF44C9204"><enum>(C)</enum><text>by striking subparagraph (B); and</text></subparagraph></paragraph> 
<paragraph id="HF72C71B574664F2383E2A29580E3A3B5"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="HF8C0E775CCF748C6828463584AA6E897"><enum>(f)</enum><header>Mandatory physical examinations for members not otherwise covered by this section</header> 
<paragraph id="H9B7383F33AE64977AD52C1B4BD6A7D66" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary concerned shall provide a comprehensive physical examination pursuant to subsection (a)(5) to each member of the armed forces who is scheduled to be separated from the armed forces and does not otherwise receive such an examination under such subsection.</text> </paragraph> 
<paragraph id="H6B9602B79A0942EF9B62B150DCF3CFCD" indent="up1"><enum>(2)</enum><text>A member may not be entitled to health care benefits pursuant to subsection (a), (b), or (c) solely by reason of being provided a physical examination under paragraph (1).</text></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
