<section id="H96F444653CD5439199859C47F692E996" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Common Access Card Act of 2013</short-title></quote>.</text></section> 
<section id="H155F6CC6C25F402C9B3BC24545EDFA27"><enum>2.</enum><header>Secure Medicare card pilot program</header> 
<subsection id="H8D21404B50E140D0AB8A207B010232F9"><enum>(a)</enum><header>Pilot program implementation (Phase <enum-in-header>I</enum-in-header>)</header> 
<paragraph id="H462DDC0E4C5B498E8F7F44E3D9723195"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of the enactment of this Act, the Secretary shall conduct a pilot program under title XVIII of the Social Security Act for the purpose of utilizing smart card technology for Medicare beneficiary and provider identification cards in order to—</text> 
<subparagraph id="H936C612678424CA1ADA3DCFDF8EA20CE"><enum>(A)</enum><text>increase the quality of care furnished to Medicare beneficiaries;</text></subparagraph> 
<subparagraph id="HDF7F7BFC31024CF0AC05379BAA9BC217"><enum>(B)</enum><text>improve the accuracy and efficiency in the billing for Medicare items and services furnished by Medicare providers;</text></subparagraph> 
<subparagraph id="HA974DD9FD75B4972B4732AF6A350EF09"><enum>(C)</enum><text>reduce the potential for identity theft and other unlawful use of Medicare beneficiary and provider identifying information; </text></subparagraph> 
<subparagraph id="H8F579FDE12BB47E4A79A8114F4349FF1"><enum>(D)</enum><text>reduce waste, fraud, and abuse in the Medicare program; and</text></subparagraph>
<subparagraph id="HFC88E78BE71B44A78E8DB924713D01EA"><enum>(E)</enum><text>evaluate the efficiencies of patient matching.</text></subparagraph></paragraph> 
<paragraph id="H3C013EDD83134B75A3449C51312474FB"><enum>(2)</enum><header>Site requirements</header><text>The Secretary shall conduct the pilot program in at least 5 geographic areas in which the Secretary determines there is a high risk for waste, fraud, or abuse.</text></paragraph> 
<paragraph id="H3BEAA97D31544EAE8260F75B7ED968D3"><enum>(3)</enum><header>Design of pilot program</header><text>In designing the pilot program, the Secretary shall provide for the following:</text> 
<subparagraph id="HCDA340EBFB214A6CBA4F19C7904742AD"><enum>(A)</enum><text>Implementation of a system that utilizes a smart card as a Medicare identification card for Medicare beneficiaries and Medicare providers. Such a card shall contain appropriate security features and protect personal privacy.</text></subparagraph> 
<subparagraph id="H32DB0FFB34DF4DC9909F1D8CE2EB6F79"><enum>(B)</enum><text>Issuance of a new smart card to all Medicare beneficiaries participating in the pilot program. Such card shall not have the Social Security number printed on the front but, instead shall have such number stored securely on the smart card chip along with other information the Secretary deems necessary.</text></subparagraph> 
<subparagraph id="H243C5C0563754440BEC9BBD9F274A45C"><enum>(C)</enum><text>Issuance of a new provider card to all Medicare providers participating in the pilot program. Such card shall include a photograph of the provider and shall not have the Medicare provider number printed on the front of the card but, instead shall have such number stored securely on the smart card chip along with other information the Secretary deems necessary.</text></subparagraph> 
<subparagraph id="H700ED9D784794CC9B16381956FCA52F3"><enum>(D)</enum><text>A process for enrollment of all Medicare providers that includes—</text> 
<clause id="H27C44D50E89240BABA26B41D1B70AB4D"><enum>(i)</enum><text>identity and certification verification; and</text></clause> 
<clause id="HB677BCA8AE6A4C99B4D1A8AA5E23B738"><enum>(ii)</enum><text>utilization of biometric data, such as fingerprints, for provider identification and authentication.</text></clause></subparagraph> 
<subparagraph id="H5059E4815ACB4DEFA88DC80EF99A92CE"><enum>(E)</enum><text>A process under which the cards issued under subparagraphs (B) and (C) are used by both Medicare beneficiaries and Medicare providers to verify eligibility, prevent fraud, and authorize transactions.</text></subparagraph> 
<subparagraph id="H97E9243D69DD4C19BDF3BEB2CB0CED30"><enum>(F)</enum><text>Distribution of necessary equipment, including cards, card readers, kiosks, biometric readers, and other materials or documents to Medicare beneficiaries and providers at no cost to them.</text></subparagraph> 
<subparagraph id="HC081F434C2CD4F818CEEA2CB1BD5B2AE"><enum>(G)</enum><text>Regular monitoring and review by the Secretary of Medicare providers’ Medicare billings and Medicare beneficiaries’ Medicare records in order to identify and address inaccurate charges and instances of waste, fraud, or abuse.</text></subparagraph> 
<subparagraph id="H108B340C7F2B469B9EEC3B14B77EEF61"><enum>(H)</enum><text>Reporting mechanisms for measuring the cost savings to the Medicare program by reason of the pilot program.</text></subparagraph> 
<subparagraph id="HE15B4C7341D04DD38CE36B461A550765"><enum>(I)</enum><text>Including provisions—</text> 
<clause id="H54A1F8F9FEF74B63B489A4C246230EAE"><enum>(i)</enum><text>to ensure that all devices and systems utilized as part of the pilot program comply with standards for identity credentials and biometric data developed by the American National Standards Institute and the National Institute of Standards and Technology and Federal requirements relating to interoperability and information security, including all requirements under the Health Insurance Portability and Accountability Act of 1996;</text></clause> 
<clause id="HE30ED7F7053140E19A87B68DF3F3DAA3"><enum>(ii)</enum><text>to ensure that a Medicare beneficiary’s and provider’s personal identifying, health, and other information is protected from unauthorized access or disclosure through the use of at least two-factor authentication;</text></clause> 
<clause id="H559E657BCD2845A0AAAD0E1A464CCE63"><enum>(iii)</enum><text>for the development of procedures and guidelines for the use of identification cards, card readers, kiosks, biometric data and readers, and other equipment to verify a Medicare beneficiary’s identity and eligibility for services;</text></clause> 
<clause id="H5D08610B1194485DB39760BB56E92D9E"><enum>(iv)</enum><text>to ensure that each Medicare beneficiary and provider participating in the pilot program is informed of—</text> 
<subclause id="HDFB4636CC13B40E6A111092D2B2AB273"><enum>(I)</enum><text>the purpose of the program;</text></subclause> 
<subclause id="H2D74B1C5FFC54802932109C3C07ED848"><enum>(II)</enum><text>the processes for capturing, enrolling, and verifying their eligibility and, with respect to providers, their biometric data;</text></subclause> 
<subclause id="H7695D9EB962C41E0A93FF5DA5B42F29C"><enum>(III)</enum><text>the manner in which the biometric data for providers will be used; and</text></subclause> 
<subclause id="H3AE4F7A8F518432F9539223F5630C7A1"><enum>(IV)</enum><text>the steps that will be taken to protect personal identifying, health, and other information from unauthorized access and disclosure;</text></subclause></clause> 
<clause id="HD6AB073A7D6A44AC8DCDB020973F0BC0"><enum>(v)</enum><text>for addressing problems related to the loss, theft, or malfunction of or damage to equipment and any identifying documents or materials provided by the Secretary;</text></clause> 
<clause id="H4E595AC6B1C444D7AD6694366C5C500D"><enum>(vi)</enum><text>for development of a hotline, Web site, or other means by which Medicare beneficiaries and providers can contact the Secretary for assistance; and</text></clause> 
<clause id="HFEFF38B7ED0B4204B03A0DFD68101066"><enum>(vii)</enum><text>for addressing problems related to accessing care outside the pilot area and cases where the individual faces issues related to physical or other capacity limitations.</text></clause></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HBBA78DAE738A41D394F34A8B69258480"><enum>(4)</enum><header display-inline="yes-display-inline">Privacy</header><text display-inline="yes-display-inline">Information on the smart card shall only be disclosed if the disclosure of such information is permitted under the Federal regulations (concerning the privacy of individually identifiable health information) promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H2B14D4A47128460288DC519A146C2CA8"><enum>(5)</enum><header display-inline="yes-display-inline">Disclosure exemption</header><text display-inline="yes-display-inline">Information on the smart card shall be exempt from disclosure under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552(b)(3)</external-xref> of title 5, United States Code.</text></paragraph></subsection> 
<subsection id="H45E92B8A4EAD46FA8CAF8854FC22036F"><enum>(b)</enum><header>Expanded implementation (Phase <enum-in-header>II</enum-in-header>)</header><text>Taking into account the interim report under subsection (d)(2), the Secretary shall, through rulemaking, expand the duration and the scope of the pilot program, to the extent determined appropriate by the Secretary.</text></subsection> 
<subsection id="HB11824851E824B9EB44AD7C91585EF72"><enum>(c)</enum><header>Waiver authority</header><text>The Secretary may waive such provisions of titles XI and XVIII of the Social Security Act as the Secretary determines to be appropriate for the conduct of the pilot program.</text></subsection> 
<subsection id="H793C059CB8AF4F24805B8D97645A9618"><enum>(d)</enum><header>Reports to Congress</header> 
<paragraph id="H1511A38A11874C8E8F1B5802A58D0AD7"><enum>(1)</enum><header>Plan</header><text>Not later than 6 months after the date of the enactment of this Act, the Secretary shall submit to Congress a report that contains a description of the design and development of the pilot program, including the Secretary’s plan for implementation.</text></paragraph> 
<paragraph id="HCD91FA463B4B4A1295640B10A87071AE"><enum>(2)</enum><header>Interim report</header><text>Not later than 1 year after the date that the pilot program is first implemented, the Secretary shall conduct an evaluation of the pilot program and submit an interim report to Congress. Such an evaluation shall include an initial analysis of the deployment of the program, the usability of the card system, and the measures taken to protect beneficiary and provider information.</text></paragraph> 
<paragraph id="HD5711D3215204F12AFC015DA44DC1F63"><enum>(3)</enum><header>Additional report</header><text>Not later than 2 years after the date that the pilot program is first implemented, the Secretary shall submit to Congress a report on the pilot program. Such report shall contain a detailed description of issues related to the expansion of the program under subsection (b) and recommendations for such legislation and administrative actions as the Secretary considers appropriate for implementation of the program on a nationwide basis.</text></paragraph></subsection> 
<subsection id="H3B4A904EE01747D7B242D34C93FBC45C"><enum>(e)</enum><header>Funding</header><text>There are appropriated, from amounts in the Treasury not otherwise appropriated, $29,000,000 for the design, implementation, and evaluation of the pilot program. Amounts appropriated under the preceding sentence shall remain available until expended.</text></subsection> 
<subsection id="H52A462D411934EDD8303C82F5B6B49A7"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H6E4A3DB5C86E47FCA3DE8E2110D6C6ED"><enum>(1)</enum><header>Medicare beneficiary</header><text>The term <term>Medicare beneficiary</term> means an individual entitled to, or enrolled for, benefits under part A of title XVIII of the Social Security Act or enrolled for benefits under part B of such title.</text></paragraph> 
<paragraph id="HAAEC8DA69FAB42069A445A1C1634A1A0"><enum>(2)</enum><header>Medicare program</header><text>The term <term>Medicare program</term> means the health benefits program under title XVIII of the Social Security Act.</text></paragraph> 
<paragraph id="H4E9C9E345F69442BB75F5485D3048896"><enum>(3)</enum><header>Medicare provider</header><text>The term <term>Medicare provider</term> means a provider of services (as defined in subsection (u) of section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>)) and a supplier (as defined in subsection (d) of such section), including a supplier of durable medical equipment and supplies.</text></paragraph> 
<paragraph id="H557B1DA8B0914B9C8BE019A1FE0D7142"><enum>(4)</enum><header>Pilot program</header><text>The term <term>pilot program</term> means the pilot program conducted under this section.</text></paragraph> 
<paragraph id="HD7A017A0BB97425C9E67E7B0B5357FA9"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph> 
<paragraph id="H38DBC599EEA9451A8C7442056722F2E2"><enum>(6)</enum><header>Smart card</header><text>The term <term>smart card</term> means a secure, electronic, machine readable, fraud-resistant, tamper-resistant card that includes an embedded integrated circuit chip with a secure micro-controller.</text></paragraph></subsection> </section>
