		  the excise tax and special occupational tax in respect of firearms and to
		  increase the transfer tax on any other weapon, and for other

		<section id="H7228971F39964DE889B234E481BE2C57" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Gun Violence Prevention and Safe
			 Communities Act of 2013</short-title></quote>.</text>
		</section><section id="H4A57ED18D4E240BBBC332EE534D94A90"><enum>2.</enum><header>Increase in
			 excise taxes relating to firearms</header>
			<subsection commented="no" id="H7F730E2831FB46369F8D0264929FCF34"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/4181">Section 4181</external-xref> of the Internal Revenue Code of 1986 is
			 amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HB7A3F78ADF5F4DC8B4E806795844DEE4" style="OLC">
					<section commented="no" id="HD7F43C6C282F4B798DCF7AF57D1AD41C"><enum>4181.</enum><header>Imposition of
				tax</header><text display-inline="no-display-inline">There is hereby imposed
				upon the sale by the manufacturer, producer, or importer of the following
				articles a tax equivalent to the specified percent of the price for which so
				sold:</text>
						<paragraph commented="no" id="HA399AF90FF7B434A9893C008676BAF65"><enum>(1)</enum><text>Articles taxable
				at 20 percent:</text>
							<subparagraph commented="no" id="HF8A23893791545EF85CA3F706BF5CE44"><enum>(A)</enum><text>Pistols.</text>
							</subparagraph><subparagraph commented="no" id="HDE103B9BA444426782D4784C6F107333"><enum>(B)</enum><text>Revolvers.</text>
							</subparagraph><subparagraph commented="no" id="H79A92748C91746E99BD1EB701823D5DA"><enum>(C)</enum><text>Firearms (other
				than pistols and revolvers).</text>
							</subparagraph><subparagraph commented="no" id="H62C9D64D058B4D1DB0FB7EA57574D449"><enum>(D)</enum><text display-inline="yes-display-inline">Any lower frame or receiver for a firearm,
				whether for a semiautomatic pistol, rifle, or shotgun that is designed to
				accommodate interchangeable upper receivers.</text>
							</subparagraph></paragraph><paragraph commented="no" id="HDC68EF4C2F5C4F34960AD4E1992AF2ED"><enum>(2)</enum><text display-inline="yes-display-inline">Articles taxable at 50 percent: Shells and
				cartridges.</text>
						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="H9037D2919B6A43D0B6DB98018D9C3178"><enum>(b)</enum><header>Exemption for
			 United States</header><text>Subsection (b) of section 4182 of the Internal
			 Revenue Code of 1986 is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H184DC44F0FDE43D0AC94FCB3F96190BE" style="OLC">
					<subsection id="H0D6D964C0C234278AFB204EDE1132E95"><enum>(b)</enum><header>Sales to United
				States</header><text display-inline="yes-display-inline">No firearms, pistols,
				revolvers, lower frame or receiver for a firearm, shells, and cartridges
				purchased with funds appropriated for any department, agency, or
				instrumentality of the United States shall be subject to any tax imposed on the
				sale or transfer of such
				articles.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="H438DB3F753994BE0B01989B038BFBB21"><enum>(c)</enum><header>Availability of
			 funds from increased taxes</header>
				<paragraph commented="no" id="H48B9B80C719749DAB7E45A149E83A9C7"><enum>(1)</enum><header>Allocation</header><text display-inline="yes-display-inline">Amounts in the general fund of the Treasury
			 by reason of section 3(a) of the Pittman-Robertson Wildlife Restoration Act (as
			 amended by paragraph (2) of this subsection) are hereby appropriated and shall
			 be available, as follows:</text>
					<subparagraph id="H83AFDC9BC6AA4A429A6901E98FE9B173"><enum>(A)</enum><text display-inline="yes-display-inline">35 percent of such amounts shall be
			 available for community-oriented policing services grants for the hiring and
			 rehiring of additional career law enforcement officers under section 1701(b) of
			 title I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C.
			 3796dd(b)). States using funds for school resource officers shall include
			 training, protections, and monitoring to ensure that school resource officers
			 are used to improve school safety and climate, and promote positive reform in
			 student suspensions, expulsions, and referrals to the juvenile or criminal
			 justice systems.</text>
					</subparagraph><subparagraph id="H07D583556576463AB52C7EE399B214BC"><enum>(B)</enum><text display-inline="yes-display-inline">35 percent of such amounts shall be
			 available for the Project Safe Neighborhoods, as authorized by sections 101
			 through 104 of the Continuing Appropriations Resolution, 2007 (Public Law
			 110–5) and <external-xref legal-doc="public-law" parsable-cite="pl/109/108">Public Law 109–108</external-xref> (119 Stat. 2290, 2302).</text>
					</subparagraph><subparagraph id="H18D7A6561C9E4C4889936EC5D9BB9E88"><enum>(C)</enum><text display-inline="yes-display-inline">10 percent of such amounts shall be
			 available for the Centers for Disease Control National Center for Injury
			 Prevention and Control for purposes of research on gun violence and its
			 prevention.</text>
					</subparagraph><subparagraph id="HF6DB80C702CE4F78A090E67EA5E3DED6"><enum>(D)</enum><text display-inline="yes-display-inline">5 percent of such amounts shall be
			 available for the National Criminal History Improvement Program authorized
			 under section 302(c) of title I of the Omnibus Crime Control and Safe Streets
			 Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3732">42 U.S.C. 3732(c)</external-xref>).</text>
					</subparagraph><subparagraph id="H894FF90B2C1145ADA49B1D9AF2095380"><enum>(E)</enum><text display-inline="yes-display-inline">5 percent of such amounts shall be
			 available for the NICS Act Record Improvement Program authorized under section
			 301 of the NICS Improvement Amendments Act of 2007.</text>
					</subparagraph><subparagraph id="HEB9A06F8770A477B9700A7D98C21A6F4"><enum>(F)</enum><text display-inline="yes-display-inline">5 percent for the Community-Based Violence
			 Prevention Field-Initiated Research and Evaluation Program of the Department of
			 Justice.</text>
					</subparagraph><subparagraph id="H071BDE52580444878EAF98CE4CE84D21"><enum>(G)</enum><text display-inline="yes-display-inline">5 percent of such amounts shall be
			 available for the Secretary of Education to provide directed grants and
			 technical assistance to schools eligible for or receiving grants under part A
			 of title I of the Elementary and Secondary Education Act of 1965 to develop and
			 implement comprehensive, evidence-based local or regional strategies (such as
			 positive behavior interventions and supports, social and emotional learning,
			 and restorative justice programs) to improve school climate, reduce the use of
			 exclusionary school discipline, and decrease the number of youth entering the
			 juvenile and criminal justice systems.</text>
					</subparagraph></paragraph><paragraph id="HB5F79FF1AD394F0C992BDCA0F7B802FB"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 3(a) of the Pittman-Robertson Wildlife
			 Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669b">16 U.S.C. 669b(a)</external-xref>) is amended by adding at the end the
			 following new sentence: <quote>There shall not be covered into the fund the
			 portion of the tax imposed by such section 4181 that is attributable to any
			 increase in amounts received in the Treasury under such section by reason of
			 the amendments made by section 2 of the <short-title>Gun
			 Violence Prevention and Safe Communities Act of 2013</short-title>, as
			 estimated by the Secretary.</quote>.</text>
				</paragraph></subsection><subsection id="HB7CDE7CD8C3C4DBCBFDB1E7C902F5CD5"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply with respect
			 to sales after December 31, 2013.</text>
			</subsection></section><section id="HBB3569C578FF4B89AFF77EA8F641CF33"><enum>3.</enum><header>Special tax and
			 licensing relating to firearms</header>
			<subsection id="H25185015679E418381B39A6F1940CC26"><enum>(a)</enum><header>Increase in
			 tax</header>
				<paragraph id="H208573C74C69409599E38C2696D9079E"><enum>(1)</enum><header>General
			 rule</header><text>Subsection (a) of section 5801 of the Internal Revenue Code
			 of 1986—</text>
					<subparagraph id="H1DE4850196E445A2B471384003327DFB"><enum>(A)</enum><text>in paragraph (1)
			 by striking <quote>$1,000</quote> and inserting <quote>$2,000</quote>,
			 and</text>
					</subparagraph><subparagraph id="H024E66216464413EAA2BE09388D5E8EC"><enum>(B)</enum><text>in paragraph (2)
			 by striking <quote>$500</quote> and inserting <quote>50 percent of the dollar
			 amount applicable under paragraph (1) for the taxable year</quote>.</text>
					</subparagraph></paragraph><paragraph id="H3FDDB332AEE8432AA11B053A25F6517E"><enum>(2)</enum><header>Small importers
			 and manufacturers</header><text>Paragraph (1) of section 5801(b) of such Code
			 is amended by striking <quote>substituting <quote>$500</quote> for
			 <quote>$1,000</quote></quote> and inserting <quote>substituting <quote>50
			 percent of the dollar amount applicable under such paragraph for the taxable
			 year</quote> for <quote>$2,000</quote></quote>.</text>
				</paragraph><paragraph id="H8DD14B24B10741B7BF9E53F37A2FFE17"><enum>(3)</enum><header>Adjustment for
			 inflation</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5801">Section 5801</external-xref> of the Internal Revenue Code of 1986 is
			 amended by adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HEBADC7762352496C83079B216F08C0A8" style="OLC">
						<subsection id="HAF723A625CDB42F1B7D962C8FF3BC231"><enum>(c)</enum><header>Adjustment for
				inflation</header><text>In the case of any taxable year beginning in a calendar
				year after 2014, the dollar amount in subsection (a)(1) shall be increased by
				an amount equal to—</text>
							<paragraph id="H5926287A0CC84F14A50CB78AB9585C70"><enum>(1)</enum><text>such dollar
				amount, multiplied by</text>
							</paragraph><paragraph id="HBF149553A816476F82E604FABB151ED8"><enum>(2)</enum><text>the cost-of-living
				adjustment determined under section 1(f)(3) for the calendar year in which the
				taxable year begins, determined by substituting <quote>calendar year
				2013</quote> for <quote>calendar year 1992</quote> in subparagraph (B)
				thereof.</text>
							</paragraph><continuation-text continuation-text-level="subsection">If any
				increase under paragraph (1) is not a multiple of $10, such increase shall be
				rounded to the next lowest multiple of
				$10.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC184157BF4914C8BA48AEAB8408F831D"><enum>(b)</enum><header>Increase in
			 transfer tax on firearms</header>
				<paragraph id="H2E7647FB1CB34E45BCFEBA74367F165E"><enum>(1)</enum><header>In
			 general</header><text>Subsection (a) of section 5811 of the Internal Revenue
			 Code of 1986 is amended—</text>
					<subparagraph id="HDE3AC600B5544BDD942DDC14F0EEE4A1"><enum>(A)</enum><text>by striking
			 <quote>$200</quote> and inserting <quote>$500</quote>, and</text>
					</subparagraph><subparagraph id="H02D2331C0DAB401F8366945D7729594B"><enum>(B)</enum><text>by striking
			 <quote>$5</quote> and inserting <quote>$100</quote>.</text>
					</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HC93AD71C9440449CBC1819C181CB375A"><enum>(2)</enum><header>Adjustment for
			 inflation</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5811">Section 5811</external-xref> of the Internal Revenue Code of 1986 is
			 amended by adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HFC7AB40DF96E44EEB98D07912D6A5FC5" style="OLC">
						<subsection id="HED6F8E5D4B8B4157B9FC8E888EE7EA51"><enum>(d)</enum><header>Adjustment for
				inflation</header><text>In the case of any taxable year beginning in a calendar
				year after 2014, each dollar amount in subsection (a) shall be increased by an
				amount equal to—</text>
							<paragraph id="H4653C2B71FCF490782DE48BE0DED4F59"><enum>(1)</enum><text>such dollar
				amount, multiplied by</text>
							</paragraph><paragraph id="HBEAB068C29B64407BA12ED610A87B2A3"><enum>(2)</enum><text>the cost-of-living
				adjustment determined under section 1(f)(3) for the calendar year in which the
				taxable year begins, determined by substituting <quote>calendar year
				2013</quote> for <quote>calendar year 1992</quote> in subparagraph (B)
				thereof.</text>
							</paragraph><continuation-text continuation-text-level="subsection">If any
				increase under paragraph (1) is not a multiple of $5, such increase shall be
				rounded to the next lowest multiple of
				$5.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H5247E4C552AC48A2B5D07821A130472F"><enum>(c)</enum><header>Certain
			 semiautomatic pistols chambered for cartridges treated as
			 firearms</header><text>The first sentence of section 5845(a) of the Internal
			 Revenue Code of 1986 is amended—</text>
				<paragraph id="H420BD299B34C41FEAB2A1FD07848D4D2"><enum>(1)</enum><text>by striking
			 <quote>and</quote> before <quote>(8)</quote>,</text>
				</paragraph><paragraph id="HD4D59970C06449D3A1CB4C2F93FB220E"><enum>(2)</enum><text>by striking
			 <quote>device.</quote> and inserting <quote>device, and</quote>, and</text>
				</paragraph><paragraph id="HB9B56A07FEA341C4ACBE74AEFB16ACDF"><enum>(3)</enum><text>by adding at the
			 end the following: <quote>(9) a semiautomatic pistol chambered for cartridges
			 commonly considered rifle rounds, configured with receivers commonly associated
			 with rifles and capable of accepting detachable magazines.</quote>.</text>
				</paragraph></subsection><subsection id="HD71538197C2C455C8550FC12F5672A51"><enum>(d)</enum><header>Effective
			 dates</header>
				<paragraph id="HA646AACCA2AE4BCC834FBC2C0647EEAA"><enum>(1)</enum><header>In
			 general</header><text>Except as provided by paragraph (2), the amendments made
			 by this section shall take effect on July 1, 2014.</text>
				</paragraph><paragraph id="HAF09998909514E89A183634F1C02531E"><enum>(2)</enum><header>Transfer
			 tax</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (b) shall apply to transfers after December 31, 2013.</text>
				</paragraph><paragraph id="H13C1D3B58CDE4C60B0198C418D1E7997"><enum>(3)</enum><header>All taxpayers
			 treated as commencing in business on July 1, 2014</header><text>Any person
			 engaged on July 1, 2014, in any trade or business which is subject to an
			 occupational tax by reason of the amendment made by subsection (b) shall be
			 treated for purposes of such tax as having first engaged in a trade or business
			 on such date.</text>
