		<section id="H1C86514ADBC2405396854E8296D303AA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Keep Repos to Maturity on Balance
			 Sheet Act of 2013</short-title></quote>.</text>
		</section><section id="H57AFCE8ADB1244588C63B91520456461"><enum>2.</enum><header>Accounting
			 treatment of RTM transactions</header>
			<subsection id="HDD8C4AF037B345A9986A6E0D0633A1F8"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In establishing
			 accounting principles or standards for purposes of the securities laws, the
			 Securities and Exchange Commission shall require that a repurchase-to-maturity
			 transaction be treated as a secured borrowing in which the transferred asset
			 serves as collateral.</text>
			</subsection><subsection id="H6AB19819BC09499C9EF66CB63293E4BE"><enum>(b)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="HA7B690E98FEC48468C29FFCA0A8525FE"><enum>(1)</enum><header>Repurchase-to-maturity
			 transaction</header><text display-inline="yes-display-inline">The term
			 <quote>repurchase-to-maturity transaction</quote> means a transaction in
			 which—</text>
					<subparagraph id="HAA969A7E393045E58AF32656C3E5846F"><enum>(A)</enum><text>a financial asset
			 is transferred in exchange for cash, other financial assets, or letters of
			 credit; and</text>
					</subparagraph><subparagraph id="H99689ECD85C947F7BBCF90C0AE3E3ACF"><enum>(B)</enum><text>concurrently with
			 the transfer, the transferor and the transferee agree that, at the maturity of
			 the transferred asset, the transferee may either, at the option of the
			 transferee—</text>
						<clause id="H0978411BE0504BE886BC68C89363132A"><enum>(i)</enum><text>return the
			 transferred asset (or a substantially similar asset) to the transferor, thereby
			 obligating the transferor to reacquire the transferred asset (or to acquire the
			 substantially similar asset, as the case may be) for an amount equal to the
			 value of the cash, other financial assets, or letters of credit described in
			 subparagraph (A), plus a stipulated interest factor; or</text>
						</clause><clause id="HE50D9465DCF94D489D83D91235518F4B"><enum>(ii)</enum><text>redeem the
			 transferred asset from the issuer of the transferred asset.</text>
						</clause></subparagraph></paragraph><paragraph id="H4358CDF554D340909C2EA70D9CEFCD50"><enum>(2)</enum><header>Securities
			 laws</header><text>The term <quote>securities laws</quote> has the meaning
			 given such term in section 3(a) of the Securities Exchange Act of 1934 (15
			 U.S.C. 78c(a)).</text>
				</paragraph><paragraph id="HB039821441AC4A798CF7686CC4B24813"><enum>(3)</enum><header>Transferred
			 asset</header><text>The term <quote>transferred asset</quote> means a financial
			 asset transferred in exchange for cash, other financial assets, or letters of
			 credit in a repurchase-to-maturity transaction, as described in paragraph
			 (1)(A).</text>
				</paragraph></subsection><subsection id="H0405231EEAD142EAA797FC6C5D027FC9"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The treatment required
			 under subsection (a) shall apply beginning on the date that is 90 days after
			 the date of the enactment of this Act.</text>
