		<official-title>To amend title 28, United States Code, to provide for
		  procedures ensuring accuracy in employment-related exchanges of records and
		  information, and for other purposes.</official-title>

		<section id="HBBE7265CA60D455383A09951FC6DDF1F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Accurate Background Check Act of
			 2013</short-title></quote> or as the <quote><short-title>ABC Act of
			 2013</short-title></quote>.</text>
		</section><section id="H44020FB61A6E46FCB6E88BA6EE19D92F"><enum>2.</enum><header>Procedures
			 relating to employment-related exchanges of records and
			 information</header><text display-inline="no-display-inline">Section 534 of
			 title 28, United States Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H513999112F1A4A6A8BB570DA10FD1669" style="USC">
				<subsection id="H1F23247BD71A42A3A2B812D4F17978DB"><enum>(g)</enum><header>Employment with
				Federal Government or Federal contractor</header>
					<paragraph id="HFC0C0E839D48421E9FBFB8142FBD8047"><enum>(1)</enum><header>Procedures to
				ensure accuracy of records</header><text display-inline="yes-display-inline">The Attorney General shall by rule provide
				for procedures to ensure that any records and information exchanged under this
				section for purposes of employment background checks are as accurate and
				complete as is reasonably possible.</text>
					</paragraph><paragraph id="HEBB5DAE2610A4922A5CAE2FB3EFEE993"><enum>(2)</enum><header>Necessary
				elements of procedures</header><text display-inline="yes-display-inline">The
				procedure under paragraph (1) shall ensure that, if a record or information is
				determined to be inaccurate or incomplete, then not later than 10 days after a
				request for an exchange of the record or information is made and prior to
				releasing the record or information to the requesting entity, the Attorney
				General shall correct or, if appropriate, delete or amend that information,
				and—</text>
						<subparagraph id="H06725417AD104E06849C4B5BD0207D73"><enum>(A)</enum><text>conduct research
				in whatever State and local recordkeeping systems are available in order to
				obtain complete data;</text>
						</subparagraph><subparagraph id="H12FC36993DDB466CB6285E40EAF46CD3"><enum>(B)</enum><text>maintain a
				disposition document database that contains information obtained pursuant to
				subparagraph (A) that cannot otherwise be posted or maintained and searched in
				other databases;</text>
						</subparagraph><subparagraph id="H5F0EEE0E56D64B51B651C4A3F3AC0EE1"><enum>(C)</enum><text>search the
				disposition document database established pursuant to subparagraph (B) and any
				other Federal databases that contain relevant disposition information;
				and</text>
						</subparagraph><subparagraph id="H56DAEFBFF1C44C11A1C7C0B73BDA6CC7"><enum>(D)</enum><text>notify each
				appropriate reporting jurisdiction of any updated information obtained pursuant
				to this paragraph.</text>
						</subparagraph></paragraph><paragraph id="H2E15F6B52D4C4071A6497661CB498B1A"><enum>(3)</enum><header>Completeness of
				record or information</header><text display-inline="yes-display-inline">For
				purposes of this subsection, a record or information is incomplete if that
				record or information indicates that an arrest was made and does not include
				the disposition of that arrest.</text>
					</paragraph><paragraph id="H565B368EBA8D4F7C8D1DE042A048C68B"><enum>(4)</enum><header>Opportunity to
				review records or information</header><text display-inline="yes-display-inline">In connection with an exchange of a record
				or information under this section for purposes of employment background checks,
				the Attorney General shall, prior to the exchange—</text>
						<subparagraph id="HD2D8D4AE92704C3A87DE8E65DFCCCE7D"><enum>(A)</enum><text display-inline="yes-display-inline">obtain a statement of consent signed by the
				subject of such record or information authorizing the exchange of a record or
				information;</text>
						</subparagraph><subparagraph id="HF1BE26A25EA64D95AAF67C6044D51BAD"><enum>(B)</enum><text display-inline="yes-display-inline">provide the applicant an opportunity to
				obtain a copy of the record or information upon request and to challenge the
				accuracy and completeness of that record or information;</text>
						</subparagraph><subparagraph id="H2E8F2B53EF5F43B283F8234DCC56B31F"><enum>(C)</enum><text>promptly notify
				the requesting entity of any such challenge;</text>
						</subparagraph><subparagraph id="H3F51AA7357AB4117A1A7CCB26DC725B8"><enum>(D)</enum><text>not later than 30
				days after the challenge is made, complete an investigation of the
				challenge;</text>
						</subparagraph><subparagraph id="H9C244FCC472C453B93145EE03C9D4214"><enum>(E)</enum><text>provide to the
				applicant the specific findings and results of that investigation; and</text>
						</subparagraph><subparagraph id="HFB031ABE2D9C4AD296242BA2051E3A2D"><enum>(F)</enum><text>enter such
				findings in the disposition document database established pursuant to paragraph
				(2)(B).</text>
						</subparagraph></paragraph><paragraph id="HD493A59ED1A94CE09018144DF4799820"><enum>(5)</enum><header>Report of
				Attorney General</header><text display-inline="yes-display-inline">Not later
				than 2 years after the date of enactment of this Act, the Attorney General
				shall submit a report to Congress that includes—</text>
						<subparagraph id="HE1ED9CD3C3634C5FBDC936D5DFD20743"><enum>(A)</enum><text display-inline="yes-display-inline">the number of requests for information made
				under this section;</text>
						</subparagraph><subparagraph id="H5F5C1CDCCFC64E57B6C00164B31011A5"><enum>(B)</enum><text>appropriate
				statistical information to determine whether the exchange of records or
				information about arrests that did not result in convictions is affecting the
				employment opportunities of applicants to whom those records or information
				pertain;</text>
						</subparagraph><subparagraph id="H231352C204404CBEB055C1D364730C2B"><enum>(C)</enum><text>any prolonged
				failure of a reporting jurisdiction to comply with a request by the Attorney
				General for information about dispositions of arrests;</text>
						</subparagraph><subparagraph id="HD3FD8C39153D4EC794052FB92F8A20F5"><enum>(D)</enum><text>the percentage of
				missing arrest dispositions located within the time limit required by this Act;
				and</text>
						</subparagraph><subparagraph id="H609BAD58ECC04288859CBBBE69F620BD"><enum>(E)</enum><text>the number of
				successful and unsuccessful challenges to the accuracy and completeness of
				records or information.</text>
						</subparagraph></paragraph><paragraph id="H8A906B50010940D6A02B6A44963AA7AC"><enum>(6)</enum><header>Certain other
				parties included as authorized officials for exchanges under this
				subsection</header><text display-inline="yes-display-inline">For purposes of
				exchanges under this subsection, the term <term>employment background
				checks</term> includes background investigations authorized by Executive Order
				10450, background investigations authorized by Homeland Security Presidential
				Directive 12, and any exchanges made pursuant to <external-xref legal-doc="usc" parsable-cite="usc/46/70105">section 70105(d)</external-xref> of title 46,
				United States
				Code.</text>
