			 subsequently determined by the Speaker, in each case for consideration of such
			 provisions as fall within the jurisdiction of the committee
			 concerned</action-desc>

		<official-title>To require each agency to repeal two existing regulations
		  before issuing a new regulation, and for other purposes.</official-title>
	</form>
	<legis-body id="HA537731460084573A9574E1211A92B16" style="OLC">
		<section id="HE7AD9A0C70714FD2B25D611C7AD70A69" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>One In, Two Out
			 Act</short-title></quote>.</text>
		</section><section id="HD43FF1609E3F43CE9D72E1A78E9C792B"><enum>2.</enum><header>Repeal of
			 regulations required before issuance of a new rule</header>
			<paragraph id="H08CAADA0B33342EE94EC4EB6107F152A"><enum>(1)</enum><header>Requirement for
			 rule</header><text display-inline="yes-display-inline">An agency may not issue
			 a rule unless such agency has repealed two or more rules described in paragraph
			 (4) that, to the extent practicable, are related to the rule.</text>
			</paragraph><paragraph id="HEC36F5C0911E441BB4380EBF0DB498A3"><enum>(2)</enum><header>Requirement for
			 major rule</header>
				<subparagraph id="HEA23E6698FCA4A78B0793B1122009903"><enum>(A)</enum><header>Repeal
			 required</header><text display-inline="yes-display-inline">An agency may not
			 issue a major rule unless—</text>
					<clause id="H4ED3B7EC2F544ED89294FB4718B0DCA0"><enum>(i)</enum><text display-inline="yes-display-inline">such agency has repealed two or more rules
			 described in paragraph (4) that, to the extent practicable, are related to the
			 major rule; and</text>
					</clause><clause id="HFEAD2017432E4B3CAB5462B1970A3454"><enum>(ii)</enum><text>the
			 cost of the new major rule is less than or equal to the cost of the rules
			 repealed.</text>
					</clause></subparagraph><subparagraph commented="no" id="H11E0862D0E794FE9A65DAECAF3490DF8"><enum>(B)</enum><header>Certified
			 cost</header><text display-inline="yes-display-inline">For any rule issued in
			 accordance with subparagraph (A), the Administrator of the Office of
			 Information and Regulatory Affairs of the Office of Management and Budget must
			 have certified that the cost of the new major rule is equal to or less that the
			 cost of the rules repealed.</text>
				</subparagraph></paragraph><paragraph id="HFA1B92DFE16A4BA8A49AFC95E0DE6DA4"><enum>(3)</enum><header>Publication
			 required</header><text>Any rule repealed under paragraph (1) or (2) shall be
			 published in the Federal Register.</text>
			</paragraph><paragraph id="H8192DAA703E4411D86A6A02DDBACDA1D"><enum>(4)</enum><header>Applicability</header><text>This
			 section—</text>
				<subparagraph id="HAD58291BB22B4E87899F5725196A61D3"><enum>(A)</enum><text display-inline="yes-display-inline">applies to any rule or major rule that
			 imposes a cost or responsibility on a nongovernmental person or a State or
			 local government; and</text>
				</subparagraph><subparagraph id="H4CAD4ACF17754AD7BC785DE64D9F2870"><enum>(B)</enum><text>shall not apply to
			 any rule or major rule—</text>
					<clause id="H0D14577AD6F1416ABF85143331BDA3CB"><enum>(i)</enum><text>that
			 relates to the internal policy or practice of an agency or procurement by the
			 agency; or</text>
					</clause><clause id="H1758AFFF33024EFE86533281A329AE98"><enum>(ii)</enum><text display-inline="yes-display-inline">that is being revised to be less burdensome
			 to decrease requirements imposed by the rule or cost of compliance.</text>
					</clause></subparagraph></paragraph><paragraph id="H80360419115E48A2B0D74F6808598A10"><enum>(5)</enum><header>Definitions</header><text>In
			 this section:</text>
				<subparagraph id="H6B958999E5FE49CFBE0C429857E2B13B"><enum>(A)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the
			 meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/5/551">section 551</external-xref> of title 5, United States Code.</text>
				</subparagraph><subparagraph commented="no" id="HF81122762E11478C827555AA2ECD7E13"><enum>(B)</enum><header>Major
			 rule</header><text display-inline="yes-display-inline">The term <term>major
			 rule</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/5/804">section 804</external-xref> of title 5, United
			 States Code.</text>
				</subparagraph><subparagraph commented="no" id="H8DF1A98472CC448F9E011F2BD7207160"><enum>(C)</enum><header>Rule</header><text>The
			 term <term>rule</term> has the meaning given that term in section 551 of title
			 5, United States Code.</text>
				</subparagraph><subparagraph commented="no" id="H0DE8E299E1EA46A19647819C18690EB5"><enum>(D)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of
			 the several States, the District of Columbia, each territory or possession of
			 the United States, and each federally recognized Indian tribe.</text>
