		<section id="HBEDB0712DA9C48A6ACEB52796BCDEC54" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Taxpayer Conscience Protection Act of
			 2013</short-title></quote>.</text>
		</section><section id="H15707B31CDE64466BA5C6BFFA0A0491D"><enum>2.</enum><header>Required
			 reporting of medicaid payments to abortion providers</header>
			<subsection id="H2D65004B67AC4C6D9BB45B23DAD1FABE"><enum>(a)</enum><header>In
			 general</header><text>Not later than 60 days after the end of fiscal year 2013
			 and each fiscal year thereafter, each State that makes a Medicaid payment from
			 Federal funds during the fiscal year for any items or services furnished by an
			 abortion provider shall—</text>
				<paragraph id="H01ADF58865E948189EFF8EA5CD757249"><enum>(1)</enum><text>submit to the
			 Secretary a report on all such payments; and</text>
				</paragraph><paragraph id="HC6B4769F600D42F481522510B04C53A0"><enum>(2)</enum><text>publish the report
			 on a public Internet website of the State.</text>
				</paragraph></subsection><subsection id="H4BC60FF15B484CFCB367B65E2D357772"><enum>(b)</enum><header>Report
			 described</header><text>The report under subsection (a) shall, with respect to
			 each payment, include the following:</text>
				<paragraph id="HF8916E3CE3B34894B5A90496BCF64CF9"><enum>(1)</enum><text>A
			 specification of the amount of the payment.</text>
				</paragraph><paragraph id="H375895B71998429EBD330AE2BF472F0D"><enum>(2)</enum><text>A
			 specification of the purposes for which the payment was made.</text>
				</paragraph><paragraph id="H92BED15A194A4470B24DABF9D354B9EF"><enum>(3)</enum><text>A
			 comparison of the amount of the payment with the amount of any such payment to
			 the provider involved in any prior fiscal year.</text>
				</paragraph><paragraph id="H246F25F289D64B51B2A4D16022C8DE85"><enum>(4)</enum><text>A
			 specification of the number of abortions performed during the fiscal year by
			 the provider involved.</text>
				</paragraph></subsection><subsection id="H7F448CF3089B4E31AC7078639EAEBE66"><enum>(c)</enum><header>Report to
			 congress</header><text>Not later than 90 days after the end of each fiscal
			 year, the Secretary shall submit to the Committee on Energy and Commerce of the
			 House of Representatives and to the Committee on Finance of the Senate, and
			 publish on a public Internet website of the Department of Health and Human
			 Services, a report that—</text>
				<paragraph id="H7665CB3D9CB9422AA2722936EDDFDA2E"><enum>(1)</enum><text>contains the
			 reports submitted pursuant to subsection (a) for the fiscal year; and</text>
				</paragraph><paragraph id="H43D158B3C3B64676B297A64607A7C606"><enum>(2)</enum><text>includes a summary
			 of the reports.</text>
				</paragraph></subsection><subsection id="HC9D481EEB8DB49639095C3DC339A1AB8"><enum>(d)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H2685CE8E706A467CBD894C1F0805E953"><enum>(1)</enum><header>Abortion
			 provider</header><text>The term <term>abortion provider</term> means an entity
			 that—</text>
					<subparagraph id="HE189C9C53A574A51BD3C8DF5D1F64C40"><enum>(A)</enum><text>performs (or
			 refers an individual for) an abortion; or</text>
					</subparagraph><subparagraph id="H3C3BCBDCF71D4FB9BDDF641E98BEE9A6"><enum>(B)</enum><text>controls, is
			 controlled by, or is under common control with, an entity described in
			 subparagraph (A).</text>
					</subparagraph></paragraph><paragraph id="HAF6AE12D41FC4D85B634C6B096ACB481"><enum>(2)</enum><header>Medicaid payment
			 from Federal funds</header><text>The term <term>Medicaid payment from Federal
			 funds</term> means a payment for which there is Federal financial participation
			 under title XIX of the Social Security Act.</text>
				</paragraph><paragraph id="H46B51B22F0DA4AA58BB1CEE49C6C7A3B"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Health and Human
			 Services.</text>
				</paragraph><paragraph id="H5E4D3B98F1FC4DAF9527928A69CB91A9"><enum>(4)</enum><header>State</header><text>The
			 term <term>State</term> has the meaning given the term for purposes of title
			 XIX of the Social Security Act.</text>
				</paragraph></subsection><subsection id="H7BE13C651682491DAC4F6E6AF29264ED"><enum>(e)</enum><header>Conforming
			 amendments to Social Security Act</header><text>Section 1902(a) of the Social
			 Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)</external-xref>) is amended—</text>
				<paragraph id="H751BDC2CB713423A92251C2879EB8399"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (71);</text>
				</paragraph><paragraph id="HB337C6AACE064A6B807DF378CF995A0B"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (72) and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="HC96049FE799C412D8E6693BA63F510DF"><enum>(3)</enum><text>by inserting after
			 paragraph (72) the following:</text>
					<quoted-block id="H8747B177DF2D48AEA2899726C0E0EAAB" style="OLC">
						<paragraph id="HA960144A39AB4C83BBA34C0BC5370273"><enum>(73)</enum><text>provides for the
				submission of reports in accordance with section 2 of the Taxpayer Conscience
				Protection Act of
				2013.</text>
