		<section id="HEEEBA6ED975D4A4BB78CEAF0614C57C2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Commute Less Act of 2013</short-title></quote>.</text>
		</section><section id="H9D51527FCB7C4A5BB451BB5F754F39C1"><enum>2.</enum><header>Metropolitan
			 transportation planning</header>
			<subsection id="H8BD093B2BC3A4E4C8A5157B5120ECF16"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/5303">Section 5303(b)</external-xref> of title 49, United States
			 Code, is amended—</text>
				<paragraph id="H0433267C58634A56B31FBF7395DEE10D"><enum>(1)</enum><text>by redesignating
			 paragraph (7) as paragraph (9);</text>
				</paragraph><paragraph id="HD1353153817D4EF79653248076DB81C1"><enum>(2)</enum><text>by redesignating
			 paragraphs (1) through (6) as paragraphs (2) through (7), respectively;</text>
				</paragraph><paragraph id="H20C9FCFB06FA46D79AD05B02AE7C01A4"><enum>(3)</enum><text>by inserting
			 before paragraph (2) (as so redesignated by paragraph (2) of this subsection)
			 the following:</text>

						<paragraph id="HCB980318C86443AD8410EABAD1371198"><enum>(1)</enum><header>Employer-based
				commuter program</header><text display-inline="yes-display-inline">The term
				<term>employer-based commuter program</term> means a program implemented by an
				employer that provides employees of that employer with alternatives to driving
				to and from work in a vehicle occupied by a single individual, including the
				following:</text>
							<subparagraph id="HD4DB0B25A9214BF19807269F445F6739"><enum>(A)</enum><text>A carpool
				program.</text>
							</subparagraph><subparagraph id="H43832EEB425A47FCA2638869E528C4E8"><enum>(B)</enum><text>A vanpool
				program.</text>
							</subparagraph><subparagraph id="H1C9FA913553246CDBEAA6E6F18E7ACF1"><enum>(C)</enum><text>A transit benefit
				program.</text>
							</subparagraph><subparagraph id="HBEC9D8AB40D84830972B98D8B2947949"><enum>(D)</enum><text>A parking cash-out
				program.</text>
							</subparagraph><subparagraph id="H41E6398FE383445FA66A05D221008C83"><enum>(E)</enum><text>A shuttle
				program.</text>
							</subparagraph><subparagraph id="HC408D373AFDB48908512FA217E44FA47"><enum>(F)</enum><text>A telework
				program.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H65A62B9BA1954F6D9080F1DEEA202097"><enum>(4)</enum><text>by inserting
			 before paragraph (9) (as so redesignated by paragraph (1) of this subsection)
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="HF31D747CFC7A47438A0DA8ED1CC1F853" style="USC">
						<paragraph id="HA93D01B76F4241898B05CDD787DBEE3E"><enum>(8)</enum><header>Transportation
				management organization</header><text display-inline="yes-display-inline">The
				term <term>transportation management organization</term> means a local,
				regional, or statewide association of employers established for the purpose of
				providing employees of those employers with alternatives to driving to and from
				work in a vehicle occupied by a single
				individual.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H4C3EF747AF804A0DA5CE775EFEBC6A34"><enum>(b)</enum><header>Development of
			 transportation plan</header>
				<paragraph id="H8C61A324CEDC4AAB9793CB0C419165EF"><enum>(1)</enum><header>Transportation
			 plan</header><text display-inline="yes-display-inline">Section 5303(i)(2) of
			 title 49, United States Code, is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H633FA2AD7F6A4178B347D2A9B0803103" style="USC">
						<subparagraph id="H8BA0E4E2E3F44719B2CCE95169775056"><enum>(I)</enum><header>Employer
				outreach activities and strategies</header><text display-inline="yes-display-inline">Proposed activities and strategies to
				provide outreach to employers and transportation management organizations to
				facilitate the creation and expansion of employer-based commuter
				programs.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF8DA0CF2D30D4B4F806C905497F3FCED"><enum>(2)</enum><header>Participation by
			 interested parties</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/5303">Section 5303(i)(6)(A)</external-xref> of title 49, United
			 States Code, is amended by inserting after <quote>the disabled,</quote> the
			 following: <quote>representatives of employers and transportation management
			 organizations,</quote>.</text>
				</paragraph></subsection><subsection id="H0842FFC4C84F4775B48BF9F7DE7E7702"><enum>(c)</enum><header>Metropolitan
			 TIP</header><text display-inline="yes-display-inline">Section 5303(j)(2)(A) of
			 title 49, United States Code, is amended by striking the period at the end and
			 inserting <quote>, including projects identified in a relevant commuter trip
			 reduction plan developed under subsection (r).</quote>.</text>
			</subsection><subsection id="H280C0028A67C4D41B2469E655E8C3AA3"><enum>(d)</enum><header>Transportation
			 management areas</header><text display-inline="yes-display-inline">Section
			 5303(k)(3) of title 49, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HCC1E9589DC324E8CB48C07338E4B3ED7" style="USC">
					<subparagraph id="H728702682BBF42AF802555020DBD6A8A"><enum>(C)</enum><header>Employer
				involvement</header><text display-inline="yes-display-inline">A process for
				addressing congestion management under subparagraph (A) shall be developed in
				coordination with any relevant employer advisory council established under
				subsection (r) and shall include projects identified in the commuter trip
				reduction plan of that
				council.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD1EAE50C580648559BBDBAD7EC752D6E"><enum>(e)</enum><header>Employer
			 advisory councils and information clearinghouse</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/5303">Section 5303</external-xref> of title 49, United States
			 Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H1927BDFDA22E4A53A2C3AA75A19421F8" style="USC">
					<subsection id="HF9CCF8E7AAF34129A909833416AEC61D"><enum>(r)</enum><header>Employer
				advisory councils</header>
						<paragraph id="HAA969EC19EF140FA8C3A4AAC33FC795E"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Each metropolitan
				planning organization serving a transportation management area shall establish
				an employer advisory council that consists of representatives of employers in
				the area served by the metropolitan planning organization.</text>
						</paragraph><paragraph id="HCC6F592998E64F05BAAC62F806C353DF"><enum>(2)</enum><header>Membership</header>
							<subparagraph id="H7DF94BB1C03E4E9C88CA7E6041D31CF7"><enum>(A)</enum><header>In
				general</header><text>An employer advisory council shall consist of not less
				than 7 representatives of employers and representatives of identified
				transportation management organizations in the area served by the relevant
				metropolitan planning organization.</text>
							</subparagraph><subparagraph id="HE047FCCA5A164C58A61BED7A5324263F"><enum>(B)</enum><header>Ensuring a
				diverse cross-section of employers</header><text display-inline="yes-display-inline">In establishing an employer advisory
				council, a metropolitan planning organization, to the extent practicable, shall
				ensure that the membership of the council includes a diverse cross-section of
				employers from the area served by the organization.</text>
							</subparagraph></paragraph><paragraph id="HE3AF4A0ECB01439482BB51CF91A4211C"><enum>(3)</enum><header>Commuter trip
				reduction plan</header><text display-inline="yes-display-inline">An employer
				advisory council established under paragraph (1) shall develop and maintain a
				commuter trip reduction plan that identifies—</text>
							<subparagraph id="H093CAB40D81A4BFF8A7F2A7D5664EFBB"><enum>(A)</enum><text display-inline="yes-display-inline">commuting patterns in the area served by
				the relevant metropolitan planning organization;</text>
							</subparagraph><subparagraph id="H5E0E902642EA408F954E6A797204BF89"><enum>(B)</enum><text>area goals for the
				reduction of vehicle miles traveled during peak commuting hours;</text>
							</subparagraph><subparagraph id="H20916E59898641D3A7BE38E4C5031241"><enum>(C)</enum><text>existing and
				proposed employer-based commuter programs in the area;</text>
							</subparagraph><subparagraph id="H3C6880296F234C79952DDF529225D4CB"><enum>(D)</enum><text>a series of
				projects and activities to facilitate achievement of the goals identified under
				subparagraph (B); and</text>
							</subparagraph><subparagraph id="HE49ED89A95334354AEDE635427EFF2D7"><enum>(E)</enum><text>a financing plan
				for the projects and activities identified under subparagraph (D).</text>
							</subparagraph></paragraph></subsection><subsection id="HB858A4E361574DCD91CB3C769598D4B6"><enum>(s)</enum><header>Information
				clearinghouse</header><text display-inline="yes-display-inline">The Secretary
				is authorized to make a grant to a national nonprofit organization engaged in
				efforts relating to employer-based commuter programs or another entity
				to—</text>
						<paragraph id="H44C36CB79D064FAD9E9582390083C7F7"><enum>(1)</enum><text>establish and
				operate an information clearinghouse relating to employer investment in
				transportation and employer-based commuter programs;</text>
						</paragraph><paragraph id="HF6A11AA78148479D89AB509ABAB8EAFC"><enum>(2)</enum><text>develop an
				education program with respect to employer investment in transportation and
				employer-based commuter programs; and</text>
						</paragraph><paragraph id="HF91037A7E2784DE3A2D973F06810E119"><enum>(3)</enum><text>provide technical
				assistance relating to employer-based commuter programs and disseminate
				techniques and strategies used by successful employer-based commuter
				programs.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H406AA8F8BB45498EA944A488B73AC222"><enum>3.</enum><header>Congestion
			 mitigation during project construction</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/23/106">Section 106</external-xref> of title 23, United States Code,
			 is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H95EC56128A9D4FC48CE9018D2393543E" style="USC">
				<subsection id="H51BBDF10FE8C4D6D84C0406267001A93"><enum>(k)</enum><header>Congestion
				mitigation plans</header>
					<paragraph id="H4432B1AFBABD4302A321458E00540F3D"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">A recipient of Federal financial assistance
				under this title for a project with an estimated total cost of $75,000,000 or
				more or that will reduce traffic flow (as defined by the Secretary) for more
				than 120 days shall prepare a congestion mitigation plan for such project that
				includes funding for projects to reduce vehicle miles traveled during peak
				commuting hours along the impacted corridor.</text>
					</paragraph><paragraph id="HDA04FCE6D8254FA29E14AC402EC794E8"><enum>(2)</enum><header>Coordination</header><text>A
				recipient shall prepare a congestion mitigation plan under paragraph (1) in
				coordination with any relevant employer advisory council established under
				<external-xref legal-doc="usc" parsable-cite="usc/49/5303">section 5303(r)</external-xref> of title 49.</text>
					</paragraph><paragraph id="HDC97E83E59EA478EBD6FF9097E010A46"><enum>(3)</enum><header>Review by
				Secretary</header><text>A congestion mitigation plan prepared under paragraph
				(1) shall be made available to the Secretary for review upon the request of the
				Secretary.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H9E2F00DC34544B3EAFEA71F975B90CFF"><enum>4.</enum><header>Employer-based
			 commuter programs action plan</header>
			<subsection id="H10325B1CAE1F4EBE8B3B6AC2537BB7DA"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Transportation shall develop and implement a plan to expand and promote
			 employer-based commuter programs (as defined in <external-xref legal-doc="usc" parsable-cite="usc/49/5303">section 5303(b)</external-xref> of title 49,
			 United States Code).</text>
			</subsection><subsection id="HC4CE3E95D24A4F4C872599DC51B71BD4"><enum>(b)</enum><header>Contents</header><text>The
			 plan developed under subsection (a) shall include plans—</text>
				<paragraph id="H67B3E9E859E94D71AF3327E554A01D46"><enum>(1)</enum><text>to amend existing
			 regulations and guidance and, if necessary, develop new regulations and
			 guidance to ensure that employer-based commuter programs are integrated, to the
			 extent possible, into all appropriate Federal transportation programs;</text>
				</paragraph><paragraph id="HDFD926FF2C9246ABB2605BF095D950FF"><enum>(2)</enum><text>to identify best
			 practices with respect to employer-based commuter programs;</text>
				</paragraph><paragraph id="H4A33A2A0C0B04A5689298F7567D081D4"><enum>(3)</enum><text>to research the
			 effectiveness and efficiency of employer-based commuter programs; and</text>
				</paragraph><paragraph id="HF9E9935240D943478FBC79BAD6A3CB10"><enum>(4)</enum><text>to create a
			 national and regional peer exchange program to ensure that developments with
			 respect to employer-based commuter programs are shared and issues are
			 addressed.</text>
				</paragraph></subsection><subsection id="HC2BEAFB0EFD5477B932FE13CDD8D1A27"><enum>(c)</enum><header>Timing</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary
			 shall finalize and begin implementation of the plan developed under subsection
			 (a).</text>
			</subsection><subsection id="HCA4D68D9ADFF4B0F81DCE12CBBD6EC4A"><enum>(d)</enum><header>Report to
			 Congress</header><text display-inline="yes-display-inline">Not later than 2
			 years after the date of enactment of this Act, the Secretary shall submit to
			 the Committee on Transportation and Infrastructure of the House of
			 Representatives and the Committee on Banking, Housing, and Urban Affairs and
			 the Committee on Environment and Public Works of the Senate a report on the
			 implementation and impact of the plan developed under subsection (a).</text>
			</subsection></section><section id="HFB2916A7473D497D9CDFD89FC5810CE5"><enum>5.</enum><header>Disaster
			 preparedness report</header>
			<subsection id="HFA646E69C4664B8DB7F919EE35DA26CF"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 1 year
			 after the date of enactment of this Act, the Secretary of Transportation shall
			 submit to the Committee on Transportation and Infrastructure of the House of
			 Representatives and the Committee on Banking, Housing, and Urban Affairs and
			 the Committee on Environment and Public Works of the Senate a report with
			 recommendations on how to better integrate employer-based commuter programs (as
			 defined in <external-xref legal-doc="usc" parsable-cite="usc/49/5303">section 5303(b)</external-xref> of title 49, United States Code) into emergency
			 planning, preparedness, and response activities.</text>
			</subsection><subsection id="HF67CE7853E844C3CADAD47333F6B5E01"><enum>(b)</enum><header>Coordination</header><text display-inline="yes-display-inline">In preparing the report under subsection
			 (a), the Secretary shall consult with—</text>
				<paragraph id="H109D597B2E3B484E80EB25276A523F83"><enum>(1)</enum><text>the Administrator
			 of the Federal Emergency Management Agency; and</text>
				</paragraph><paragraph id="HC31F8FCB70D04D8E8A77B023F36F6C86"><enum>(2)</enum><text>stakeholders,
			 including national and regional organizations and experts that promote
			 employer-based commuter programs.</text>
				</paragraph></subsection></section></legis-body>
