		<official-title>To amend the Surface Mining Control and Reclamation Act
		  of 1977 to transfer certain funds to the Multiemployer Health Benefit Plan and
		  the 1974 United Mine Workers of America Pension Plan.</official-title>

		<section id="HA4249BA0698A4DEBA2F7EC87AFABC4A3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Coal Healthcare and Pensions
			 Protection Act of 2013</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HE97AC77B97464C15BEB3C4CD20BF935A"><enum>2.</enum><header>Inclusion of
			 certain retirees in the Multiemployer Health Benefit Plan</header><text display-inline="no-display-inline">Section 402 of the Surface Mining Control
			 and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232</external-xref>) is amended—</text>
			<paragraph id="H7747F621755E44D2A7FFA759A59237CA"><enum>(1)</enum><text>in subsection
			 (h)(2)(C)—</text>
				<subparagraph id="HA9ADBB8283B1463D94DE8DCABE949980"><enum>(A)</enum><text>by striking
			 <quote>A transfer</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H9B1650A4F6E74761A1577AFBB2FB57C8" style="OLC">
						<clause id="H053ED341BC2F40B68BEA721B61F8C4D7"><enum>(i)</enum><header>Transfer to the
				Plan</header><text display-inline="yes-display-inline">A
				transfer</text>
						</clause><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H9D8D3481294D41B2BC954A8BE5D792ED"><enum>(B)</enum><text>by redesignating
			 clauses (i) and (ii) as subclauses (I) and (II), respectively, and moving such
			 subclauses 2 ems to the right; and</text>
				</subparagraph><subparagraph id="HC11571D4DD5D42DBBD9FC320B8127627"><enum>(C)</enum><text>by striking the
			 matter following such subclause (II) (as so redesignated) and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H5DD340A981A64E8AB40BE7ABB5B97508" style="OLC">
						<clause id="HFCF92457C7224039BCBEA89FD3E2917B"><enum>(ii)</enum><header>Calculation of
				excess</header><text display-inline="yes-display-inline">Such excess shall be
				calculated by taking into account only—</text>
							<subclause id="H2C65382FAE0E49D58FCB39859E0D82C0"><enum>(I)</enum><text>those
				beneficiaries actually enrolled in the Plan as of the date of enactment of the
				<short-title>Coal Healthcare and Pensions Protection Act
				of 2013</short-title>, who are eligible to receive health benefits under the
				Plan on the first day of the calendar year for which the transfer is made;
				and</text>
							</subclause><subclause id="HD8ACD18C8CFC48BBA9A5162A5B725E9A"><enum>(II)</enum><text display-inline="yes-display-inline">those beneficiaries whose health benefits,
				defined as those benefits payable directly by an employer in the bituminous
				coal industry under a coal wage agreement (defined in section 9701(b)(1) of the
				Internal Revenue Code of 1986) as a result of a bankruptcy proceeding commenced
				in 2012, would be denied or reduced.</text>
							</subclause></clause><clause commented="no" id="HE7BDF088CB1D41BAA02711C07AC40EBC"><enum>(iii)</enum><header>Eligibility</header><text>An
				individual referred to in clause (ii)(II) shall be considered eligible to
				receive health benefits under the Plan.</text>
						</clause><clause id="HE0FFA1C82EDF47DD95537D26665FA81A"><enum>(iv)</enum><header>Requirements
				for transfer</header><text display-inline="yes-display-inline">A transfer under
				this subparagraph shall be in an amount equal to the excess calculated under
				clause (i), and reduced by any amount transferred from a voluntary employees'
				beneficiary association established as a result of such bankruptcy proceeding
				to the Plan to pay benefits required under the Plan.</text>
						</clause><clause id="H731D0B967A69408FA07D87D59D7BA920"><enum>(v)</enum><header>VEBA
				transfer</header><text display-inline="yes-display-inline">The administrator of
				such voluntary employees’ beneficiary association shall transfer to the Plan
				any amounts received as a result of such bankruptcy proceeding, reduced by an
				amount for administrative costs of such
				association.</text>
						</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HCCA505525770447B8B1740A2E92EA7A8"><enum>(2)</enum><text>in subsection
			 (i)—</text>
				<subparagraph id="HEBA385C15A50480390BB248327483752"><enum>(A)</enum><text>by redesignating
			 paragraph (4) as paragraph (5); and</text>
				</subparagraph><subparagraph id="HE319B642B54F4B3AACE1D9CC6CE23AAB"><enum>(B)</enum><text>by inserting after
			 paragraph (3) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H97913ADA86B14C3E82B813FFDF3AC307" style="OLC">
						<paragraph id="H5D6E3DA6AF6E42ED8BAD3A06C399D057"><enum>(4)</enum><header>Additional
				amounts</header>
							<subparagraph id="HF4DDCF43DF5F400297EF3A240EA65AF7"><enum>(A)</enum><header>Calculation</header><text display-inline="yes-display-inline">If the dollar limitation specified in
				paragraph (3)(A) exceeds the aggregate amount required to be transferred under
				paragraphs (1) and (2) for a fiscal year, the Secretary of the Treasury shall
				transfer an additional amount, not to exceed the difference between such dollar
				limitation and such aggregate amount, to the trustees of the 1974 UMWA Pension
				Plan to pay benefits required under that plan.</text>
							</subparagraph><subparagraph id="HCCDE702756914F2A8F50A1F09EFF34C1"><enum>(B)</enum><header>1974 UMWA
				Pension Plan defined</header><text display-inline="yes-display-inline">In this
				paragraph, the term <term>1974 UMWA Pension Plan</term> has the meaning given
				the term in <external-xref legal-doc="usc" parsable-cite="usc/26/9701">section 9701(a)(3)</external-xref> of the Internal Revenue Code of 1986, but
				without regard to the limitation on participation to individuals who retired in
				1976 and
				thereafter.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="H289DDC7D5C9E44388E1D493F39AA9171"><enum>3.</enum><header>Special rule for
			 certain supplemental benefit plans</header>
			<subsection id="H54494E4E903F4204BB7C2F149B8F0122"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 404 of the
			 Internal Revenue Code of 1986 is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H9EC2CF4B49EE441F85F1A8C31ABF4063" style="OLC">
					<subsection id="H4BB2A59E38D64B3C80ACC10C93B679FD"><enum>(p)</enum><header>Special rule for
				certain supplemental benefit plans</header>
						<paragraph id="HAFB5870C95894386BFD945FFA725809B"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">If contributions are
				paid by an employer under a plan that provides supplemental benefits solely to
				participants in a plan described in subsection (c) (or a continuation thereof)
				that provides pension benefits, such contributions shall not be deductible
				under this section nor be made nondeductible by this section, but the
				deductibility thereof shall be governed solely by section 162 (relating to
				trade or business expenses).</text>
						</paragraph><paragraph id="HABFB2E25712F4DBFB1B5F85CEBBEE8D1"><enum>(2)</enum><header>Tax treatment of
				plan</header><text display-inline="yes-display-inline">For purposes of this
				title, the trust holding the assets of a plan to which paragraph (1) applies
				shall be treated as an organization exempt from tax under section
				501(a).</text>
						</paragraph><paragraph id="H7401B34FE8024BC88938A83D313C7E96"><enum>(3)</enum><header>Special rule for
				payments other than to or from a trust</header><text display-inline="yes-display-inline">For purposes of this subsection, payments
				made by an employer to the trustees of a plan described in paragraph (1), and
				benefits paid by the trustees of such plan, shall be treated as contributions
				paid to, and benefits paid from, such plan without regard to whether the
				contributions are paid into, or benefits paid from, the trust holding the
				assets of such
				plan.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4DAFF5ED76C844A096E4A7DD02A76F8D"><enum>(b)</enum><header>Exclusion from
			 wages</header>
				<paragraph id="H2771A62B536B49B69F291C7448CBCD96"><enum>(1)</enum><header>Payroll
			 taxes</header><text display-inline="yes-display-inline">Paragraph (5) of
			 <external-xref legal-doc="usc" parsable-cite="usc/26/3121">section 3121(a)</external-xref> of the Internal Revenue Code of 1986 is amended—</text>
					<subparagraph id="H3CFEFFFA985741D3A7CDC6DFB61ECE57"><enum>(A)</enum><text>by striking
			 <quote>or</quote> at the end of subparagraph (H);</text>
					</subparagraph><subparagraph id="H03F492B874D84AA289B7B0C162D68379"><enum>(B)</enum><text>by adding
			 <quote>or</quote> at the end of subparagraph (I); and</text>
					</subparagraph><subparagraph id="H802BA402ACD64CE6B4B4F9728F916257"><enum>(C)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H25AA678F7FEB4A8D9512E89723413ED9" style="OLC">
							<subparagraph id="HAC560B9F396E4F22A205912F88108B04"><enum>(J)</enum><text display-inline="yes-display-inline">under a plan to which section 404(p)(1)
				applies;</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H0B9AC734C26B4E78A9E531D3474A64F5"><enum>(2)</enum><header>Collection of
			 income tax at source</header><text display-inline="yes-display-inline">Paragraph (12) of section 3401(a) of such
			 Code is amended by adding at the end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HE55210EB003C4020931FB9CB1DC35825" style="OLC">
						<subparagraph id="HC5B5AAFBE32F47C69C7E514BE5561137"><enum>(F)</enum><text display-inline="yes-display-inline">under a plan to which section 404(p)(1)
				applies,
				or</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HCC81C16AAF6E4AA1A4E4CBC3F547281E"><enum>(3)</enum><header>Unemployment
			 taxes</header><text display-inline="yes-display-inline">Section 3306(b) of such
			 Code is amended—</text>
					<subparagraph id="H3FF3B294B40A4D2C8B90499BB59E87FE"><enum>(A)</enum><text>by striking
			 <quote>or</quote> at the end of paragraph (19);</text>
					</subparagraph><subparagraph id="H93E0C64D95D9417AAA03147D152FA7D8"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (20) and inserting <quote>; or</quote>;
			 and</text>
					</subparagraph><subparagraph id="H16F65F94B66841FDB5CB072EC7A53AB1"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H2C5F9D4090A64CA6A0B7F0D6444B9BD7" style="OLC">
							<paragraph id="H3CB9437EAC404343BA261348A6D87EB8"><enum>(21)</enum><text display-inline="yes-display-inline">any payment made to or for the benefit of
				an individual under a plan to which section 404(p)(1)
				applies.</text>
