<official-title>To amend the Energy Employees Occupational Illness Compensation Program Act of 2000 to strengthen the quality control measures in place for part B lung disease claims and to establish the Advisory Board on Toxic Substances and Worker Health for the contractor employee compensation program under subtitle E of such Act.</official-title>

<section id="H272DFE3EA25B4DAF943B86B9E04DE90A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nuclear Workers Health Advisory Board Act</short-title></quote>.</text></section> 
<section id="H9BBAE3C9127449719C477BCA51DD512D" section-type="subsequent-section"><enum>2.</enum><header>Establishment of the Advisory Board on Toxic Substances and Worker Health</header> 
<subsection id="HF66189E142C7460B8DEC292E8C5A8C0E"><enum>(a)</enum><header>Advisory Board on Toxic Substances and Worker Health</header><text display-inline="yes-display-inline">Subtitle B of the Energy Employees Occupational Illness Compensation Program Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/7384l">42 U.S.C. 7384l et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H2EE921F821054B60B2676D234BEE674C"><enum>3632.</enum><header>Advisory Board on Toxic Substances and Worker Health</header> 
<subsection id="HE5295ECE41254CBD9915908DE6BF2CFB"><enum>(a)</enum><header>Establishment</header> 
<paragraph id="H73351412A894449A8BF5153811F2C553"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this section, the President shall establish and appoint an Advisory Board on Toxic Substances and Worker Health (referred to in this section as the <quote>Board</quote>).</text></paragraph> 
<paragraph id="HA299F0DC9E9C424FACCAAAFC3E45E9CA"><enum>(2)</enum><header>Consultation on appointments</header><text>The President shall make appointments to the Board in consultation with organizations with expertise on worker health issues in order to ensure that the membership of the Board reflects a proper balance of perspectives from the scientific, medical, legal, worker, worker families, and worker advocate communities.</text></paragraph> 
<paragraph id="HB29494E538E5410FB60C7F6450C34CA0"><enum>(3)</enum><header>Chairperson</header><text>The President shall designate a Chair of the Board from among its members.</text></paragraph></subsection> 
<subsection id="H81F779FF98154193957DB3408615A68F"><enum>(b)</enum><header>Duties</header><text>The Board shall—</text> 
<paragraph id="H1A3FD16BB37E4B6EB0DA4410E4C9EBE8"><enum>(1)</enum><text>advise the President concerning the review and approval of the Department of Labor site exposure matrix;</text></paragraph> 
<paragraph id="HA8BBDB31907A4831BCA8593F88D61470"><enum>(2)</enum><text>conduct periodic peer reviews of, and approve, medical guidance for part E claims examiners with respect to the weighing of a claimant’s medical evidence;</text></paragraph> 
<paragraph id="HABD6323B331D4BFB98E03663A7C6B2A9"><enum>(3)</enum><text>obtain periodic expert review of evidentiary requirements for part B claims related to lung disease regardless of approval;</text></paragraph> 
<paragraph id="HCCF112CE605243C68C20A3DA0447CF8A"><enum>(4)</enum><text>provide oversight over industrial hygienists, Department of Labor staff physicians, and Department of Labor’s consulting physicians and their reports to ensure quality, objectivity, and consistency; and</text></paragraph> 
<paragraph id="HCDBB9538C81C4E078D29E85305B6E9A3"><enum>(5)</enum><text>coordinate exchanges of data and findings with the Advisory Board on Radiation and Worker Health to the extent necessary (under section 3624).</text></paragraph></subsection> 
<subsection id="H8E34058A9F024F22BEE083EBFD075790"><enum>(c)</enum><header>Staff and powers</header> 
<paragraph id="H9577CCD3016D4BFA897FB28337889AD2"><enum>(1)</enum><header>In general</header><text>The President shall appoint a staff to facilitate the work of the Board. The staff of the Board shall be headed by a Director who shall be appointed under subchapter VIII of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="H5CF548EDDE8F4D2FBC4DF208814D7E05"><enum>(2)</enum><header>Federal agency personnel</header><text>The President may authorize the detail of employees of Federal agencies to the Board as necessary to enable the Board to carry out its duties under this section. The detail of such personnel may be on a non-reimbursable basis.</text></paragraph> 
<paragraph id="H3FBDF4CF76A846BA8131E1150F57FD63"><enum>(3)</enum><header>Powers</header><text>The Board shall have same powers that the Advisory Board has under section 3624.</text></paragraph> 
<paragraph id="H5B36F7966DEC4CB682CCAD20A4B77977"><enum>(4)</enum><header>Contractors</header><text>The Secretary shall employ outside contractors and specialists selected by the Board to support the work of the Board.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H993C9CF5BB14402B9CCA07E38594DBB6"><enum>(d)</enum><header>Expenses</header><text>Members of the Board, other than full-time employees of the United States, while attending meetings of the Board or while otherwise serving at the request of the President, and while serving away from their homes or regular place of business, shall be allowed travel and meal expenses, including per diem in lieu of subsistence (as authorized by <external-xref legal-doc="usc" parsable-cite="usc/5/5703">section 5703</external-xref> of title 5, United States Code) for individuals in the Federal Government serving without pay.</text></subsection> 
<subsection id="HDE258128418D41FE8C593C3A9A5BCB89"><enum>(e)</enum><header>Security clearances</header> 
<paragraph id="H5EAD187349D24F208D2CA1FA589FBD4D"><enum>(1)</enum><header>Application</header><text>The Secretary of Energy shall ensure that the members and staff of the Board, and the contractors performing work in support of the Board, are afforded the opportunity to apply for a security clearance for any matter for which such a clearance is appropriate.</text></paragraph> 
<paragraph id="HA1DD7E4FE6664077A7A24416E5A3CDFD"><enum>(2)</enum><header>Determination</header><text>The Secretary of Energy should, not later than 180 days after receiving a completed application for a security clearance under this subsection, make a determination whether or not the individual concerned is eligible for the clearance.</text></paragraph> 
<paragraph id="HA65D36968A1447BAB7E96A807075AC9E"><enum>(3)</enum><header>Report</header><text>For fiscal year 2015, and each fiscal year thereafter, the Secretary of Energy shall include in the budget justification materials submitted to Congress in support of the Department of Energy budget for that fiscal year (as submitted with the budget of the President under <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105(a)</external-xref> of title 31, United States Code) a report specifying the number of applications for security clearances under this subsection, the number of such applications granted, and the number of such applications denied.</text></paragraph></subsection> 
<subsection id="HDF60A4D06045473D9FB38B778544D32F"><enum>(f)</enum><header>Information</header><text>The Secretary of Energy shall, in accordance with law, provide to the Board and the contractors of the Board, access to any information that the Board considers relevant to carry out its responsibilities under this section, including information such as restricted data (as defined in section 11(y) of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2014">42 U.S.C. 2014(y)</external-xref>)) and information covered by the Privacy Act.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H075F4B2EC5704B3AB081D39475F9DFD4"><enum>(b)</enum><header>Department of Labor response to the Office of the Ombudsman annual report</header><text>Section 3686 of the Energy Employees Occupational Illness Compensation Program Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/7385s-15">42 U.S.C. 7385s–15</external-xref>) is amended—</text> 
<paragraph id="H8A94557A5F2C46D496399DAD06ED6026"><enum>(1)</enum><text>in subsection (e)(1), by striking <quote>February 15</quote> and inserting <quote>July 30</quote>; and</text></paragraph> 
<paragraph id="H75BE4753BD4E4446AF1A0F238F0A5015"><enum>(2)</enum><text>by striking subsection (h) and inserting the following:</text>

<subsection id="H3A15A1EC934A418EB5CB3B09C5F86091"><enum>(h)</enum><header>Response to report</header><text>Not later than 180 days after the publication of the annual report under subsection (e), the Department of Labor shall submit an answer in writing on whether the Department agrees or disagrees with the specific issues raised by the Ombudsman, if the Department agrees, on the actions to be taken to correct the problems identified by the Ombudsman, and if the Department does not agree, on the reasons therefore. The Department of Labor shall post such answer on the public Internet website of the Department.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
