		<official-title>To amend the Small Business Act to provide loan
		  guarantees for the acquisition of health information technology by eligible
		  professionals in solo and small group practices, and for other
		  purposes.</official-title>

		<section id="HABCFD27856CC46B5954D45E10E20160C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Working Families’ Access to Health
			 Innovations Act of 2013</short-title></quote>.</text>
		</section><section id="HBAADBE58CADF451F880414ECAADDFD20"><enum>2.</enum><header>Amendment of
			 small business act</header><text display-inline="no-display-inline">The Small
			 Business Act is amended by redesignating section 45 as section 46 and by
			 inserting after section 44 the following:</text>
			<quoted-block display-inline="no-display-inline" id="H8D65FCC5A4CA4506B77C4A481418BBDF" style="OLC">
				<section id="HBEFB37498B224BF7A45B80CE7D7F5E1F"><enum>45.</enum><header>Loan guarantees
				for health information technology</header>
					<subsection id="HA3E01B747F13457EB923E29F75F4CF88"><enum>(a)</enum><header>Definitions</header><text>As
				used in this section:</text>
						<paragraph id="H16E60A2360D64ACAA5DF887D29423F59"><enum>(1)</enum><text>The term
				<term>health information technology</term> means computer hardware, software,
				and related technology (including electronic medical record technology)
				that—</text>
							<subparagraph id="HF6A43233C0344BE0B182F971015ADDB5"><enum>(A)</enum><text>supports the
				compliance with the meaningful EHR use requirements set forth in section
				1848(o)(2)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(o)(2)(A)</external-xref>);</text>
							</subparagraph><subparagraph id="H1171FDFB19464891B7205BF3F1C35883"><enum>(B)</enum><text>is purchased by an
				eligible professional to aid in the provision of health care in a health care
				setting; and</text>
							</subparagraph><subparagraph id="H2F2419874A7F49658DA52EF04133A0DC"><enum>(C)</enum><text>provides
				for—</text>
								<clause id="H1D4CF1F6E1ED419083A37AF208E3C453"><enum>(i)</enum><text>enhancement of
				continuity of care for patients through electronic storage, transmission, and
				exchange of relevant personal health data and information, such that this
				information is accessible at the times and places where clinical decisions will
				be or are likely to be made;</text>
								</clause><clause id="H42760D548B78468EAB819B69EBBB8665"><enum>(ii)</enum><text>enhancement of
				communication between patients and health care providers;</text>
								</clause><clause id="H5F1C1D55B2944E3DB2A9D2BE45269785"><enum>(iii)</enum><text>improvement of
				quality measurement by eligible professionals enabling them to collect, store,
				measure, and report on the processes and outcomes of individual and population
				performance and quality of care;</text>
								</clause><clause id="H9038F898B79A4DD794B6D8BFF47B77C4"><enum>(iv)</enum><text>improvement of
				evidence-based decision support; or</text>
								</clause><clause id="H00F538AAF1D84F0A984429DEFACBF4B3"><enum>(v)</enum><text>enhancement of
				consumer and patient empowerment.</text>
								</clause></subparagraph><continuation-text continuation-text-level="paragraph">Such term
				does not include information technology the sole use of which is financial
				management, maintenance of inventory of basic supplies, or appointment
				scheduling.</continuation-text></paragraph><paragraph id="HBE9F1C2A99AD4E28BFF33EF877868545"><enum>(2)</enum><text>The term
				<term>eligible professional</term> means any of the following:</text>
							<subparagraph id="H26BD90DDE44F4A9595F718D42B19258C"><enum>(A)</enum><text>A physician (as
				defined in section 1861(r) of the Social Security Act (42 U.S.C.
				1395x(r))).</text>
							</subparagraph><subparagraph id="HCC57D14F882D4FD09FE08A5EFB5CFA56"><enum>(B)</enum><text>A practitioner
				described in section 1842(b)(18)(C) of such Act (42 U.S.C.
				1395u(b)(18)(C)).</text>
							</subparagraph><subparagraph id="H6E77EA4FD71B45F7A7380D181C2740B0"><enum>(C)</enum><text>A physical or
				occupational therapist or a qualified speech-language pathologist.</text>
							</subparagraph><subparagraph id="H265E7505EE7F46A88DA7EA86302AF7D3"><enum>(D)</enum><text>A qualified
				audiologist (as defined in section 1861(ll)(4)(B) of such Act (42 U.S.C.
				1395x(ll)(4)(B))).</text>
							</subparagraph><subparagraph id="H8FFF5D02A36C4686A5644FF6A9370A68"><enum>(E)</enum><text>A State-licensed
				pharmacist.</text>
							</subparagraph><subparagraph id="H03A5E3FC81C143879BA7D9DDF3CE04CB"><enum>(F)</enum><text>A State-licensed
				supplier of durable medical equipment, prosthetics, orthotics, or
				supplies.</text>
							</subparagraph><subparagraph id="H2EED79E48B0143B48CE2940460AFA4F2"><enum>(G)</enum><text>A State-licensed,
				a State-certified, or a nationally accredited home health care provider.</text>
							</subparagraph></paragraph><paragraph id="HC37F44592E394AE690837B16A364C750"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>qualified eligible
				professional</term> means an eligible professional whose practice—</text>
							<subparagraph id="H4836C6A2B5DA43C7AF6557B7F6C37655"><enum>(A)</enum><text>is a small
				business concern; and</text>
							</subparagraph><subparagraph id="H860E773783BB4AA7B8A4DB45BBEA41A5"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HD28420616B6D4BAF8A2EBADD2BD3FB2E"><enum>(i)</enum><text>is in a medically
				underserved community (as defined in section 799B(6) of the Public Health
				Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/295p">42 U.S.C. 295p(6)</external-xref>));</text>
								</clause><clause id="H2978B0936D8A4DD2B77A2D19FE6DA982" indent="up1"><enum>(ii)</enum><text>serves individuals at least 50
				percent of whom are entitled to benefits or enrolled under title XVIII of the
				Social Security Act; or</text>
								</clause><clause id="HF9FA5296640F40DC9EC42173FE1F844C" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">serves an area that consists predominantly
				of low-income families (as defined in section 3 of the United States Housing
				Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a</external-xref>)).</text>
								</clause></subparagraph></paragraph></subsection><subsection id="H58D52F57118D430F85409B3ADF718211"><enum>(b)</enum><header>Loan guarantees
				for qualified eligible professionals</header>
						<paragraph id="HFF697B8B26B74ED2845418A7B4981B93"><enum>(1)</enum><header>Guarantee
				percentage</header><text display-inline="yes-display-inline">Subject to
				paragraph (2), the Administrator may guarantee up to 90 percent of the amount
				of the loan made to a qualified eligible professional for the acquisition of
				health information technology for use in such eligible professional’s medical
				practice and for the costs associated with the installation of such
				technology.</text>
						</paragraph><paragraph id="HCFFB988716D442D5AEBC75FEA2F27835"><enum>(2)</enum><header>Limitations on
				guarantee amounts</header><text>The maximum amount of loan principal guaranteed
				under this subsection may not exceed—</text>
							<subparagraph id="H241A3D9861A243F08347C3DD3FF68DFB"><enum>(A)</enum><text>$350,000 with
				respect to any single qualified eligible professional; and</text>
							</subparagraph><subparagraph id="H04377F27116B4FA9962438350CB61618"><enum>(B)</enum><text>$2,000,000 with
				respect to a single group of affiliated qualified eligible
				professionals.</text>
							</subparagraph></paragraph></subsection><subsection id="H0F794973F79147DEABFDE3070DB35257"><enum>(c)</enum><header>Fees</header><paragraph commented="no" display-inline="yes-display-inline" id="H3701D56011F14765AC38E105553D4503"><enum>(1)</enum><text>The Administrator may
				impose a guarantee fee on the borrower in an amount not to exceed 2 percent of
				the total guaranteed portion of any loan guaranteed under this section. The
				Administrator may also impose annual servicing fees on lenders not to exceed
				0.5 percent of the outstanding balance of the guarantees on lenders’
				books.</text>
						</paragraph><paragraph id="H1ECCA36D6595444FA213B54E1902E46A" indent="up1"><enum>(2)</enum><text>No service fees, processing fees,
				origination fees, application fees, points, brokerage fees, bonus points, or
				other fees may be charged to a loan applicant or recipient by a lender in the
				case of a loan guaranteed under this section.</text>
						</paragraph></subsection><subsection id="H7D64D022DF10401B9473EF65CA183D57"><enum>(d)</enum><header>Interest
				rates</header><text>The interest rate charged on a loan guaranteed under this
				section shall not be greater than 25 basis points below the rate provided for a
				loan under the program under section 7(a).</text>
					</subsection><subsection id="H2F0722A7EF3B46AD8BD7F315A14D9EF5"><enum>(e)</enum><header>Deferral
				period</header><text>Loans guaranteed under this section shall carry a deferral
				period of not more than 3 years.</text>
					</subsection><subsection id="HA709205E74B641AE8827ED7DF8151B89"><enum>(f)</enum><header>Terms and
				conditions for loan guarantees</header><text>The loans guaranteed under this
				section shall be subject to the terms and conditions that apply to the program
				under section 7(a) or other such terms and conditions as are prescribed by the
				Administrator.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H453E1733B128495196B880C68D4285F0"><enum>3.</enum><header>Small business
			 development center duties</header><text display-inline="no-display-inline">Section 21(c)(3) of the Small Business Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(c)(3)</external-xref>) is amended—</text>
			<paragraph id="H5D827916F7E04A4CB5D94B07A5F463A2"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (S);</text>
			</paragraph><paragraph id="HD4A9C1524BE74DC49B189A7F558AB355"><enum>(2)</enum><text>by striking the
			 period at the end of subparagraph (T) and inserting a semicolon; and</text>
			</paragraph><paragraph id="HAEAB4AD01348436E8C3F4F8E437EEBFE"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H830E7A87D89A47A98114C4E9D930A750" style="OLC">
					<subparagraph id="H6E03D65473F04AE79BA6874B1C785FE6" indent="up1"><enum>(U)</enum><text display-inline="yes-display-inline">facilitating the training of medical
				professionals in health information technology systems; and</text>
					</subparagraph><subparagraph id="HC3119D7DBD6C41C88FC499D26141E865" indent="up1"><enum>(V)</enum><text>establishing and providing a network
				of small health information technology companies available to medical
				professionals in low-income and underserved areas, as defined by the Secretary
				of Health and Human Services, for the purpose of aiding medical professionals
				in such areas to purchase, utilize, and maintain such
				technology.</text>
