<section id="H59454718572441C5900AA216BA312F28" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Brownfields Utilization, Investment, and Local Development Act of 2013</short-title></quote> or the <quote><short-title>BUILD Act</short-title></quote>.</text></section>
<section id="H0B675DFA1D8B4681B947A63096B5324C"><enum>2.</enum><header>Expanded eligibility for nonprofit organizations</header><text display-inline="no-display-inline">Section 104(k)(1) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(1)</external-xref>) is amended—</text>
<paragraph id="H530064F8187C43CFBC502DB8F8504859"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (G), by striking <quote>or</quote> after the semicolon;</text></paragraph>
<paragraph id="HFF30EE5A941D4C69839AEC9C2C3A90EB"><enum>(2)</enum><text>in subparagraph (H), by striking the period at the end and inserting a semicolon; and</text></paragraph>
<paragraph id="H1A45A6D400A64A628D880E599AC575FA"><enum>(3)</enum><text>by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H6C707B25E75C47ADA9438F3DB8F3078D" style="OLC">
<subparagraph id="H252C7B2A08CD42BDA19BC65B84F8F4B1"><enum>(I)</enum><text>an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code;</text></subparagraph>
<subparagraph id="H7ACBF437D6DB4D47985EEFAA432E3BA8"><enum>(J)</enum><text>a limited liability corporation in which all managing members are organizations described in subparagraph (I) or limited liability corporations whose sole members are organizations described in subparagraph (I);</text></subparagraph>
<subparagraph id="HF5A9FFD1C19A47E297CF33398E98DC7F"><enum>(K)</enum><text>a limited partnership in which all general partners are organizations described in subparagraph (I) or limited liability corporations whose sole members are organizations described in subparagraph (I); or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H8BADDFDBA32443BF896069B1ED78F268"><enum>(L)</enum><text>a qualified community development entity (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D(c)(1)</external-xref> of the Internal Revenue Code of 1986).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H100A9F2AF0794864AEFB1E7D48C2E473"><enum>3.</enum><header>Multipurpose brownfields grants</header><text display-inline="no-display-inline">Section 104(k) of the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) is amended—</act-name></text>
<paragraph id="H15907426E8EB46AF91D36FF1F3365A2D"><enum>(1)</enum><text>by redesignating paragraphs (4) through (9) and (10) through (12) as paragraphs (5) through (10) and (13) through (15), respectively;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HDA62170DF38A40C296915A6A69D477F0"><enum>(2)</enum><text>in paragraph (3)(A), by striking <quote>subject to paragraphs (4) and (5)</quote> and inserting <quote>subject to paragraphs (5) and (6)</quote>; and</text></paragraph>
<paragraph id="HCBBF11CC1DC44A87B1E9CA70B23D6543"><enum>(3)</enum><text>by inserting after paragraph (3) the following:</text>

<paragraph id="H09D4D8E65DEC40B786326EEDD743D0A6"><enum>(4)</enum><header>Multipurpose brownfields grants</header>
<subparagraph id="H744CEF00E18241F48C4C413642BEFC28"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (D) and paragraphs (5) and (6), the Administrator shall establish a program to provide multipurpose grants to an eligible entity based on the considerations under paragraph (3)(C), to carry out inventory, characterization, assessment, planning, or remediation activities at 1 or more brownfield sites in a proposed area.</text></subparagraph>
<subparagraph id="H3A0CE391AA21401098F5E0A7BA080057"><enum>(B)</enum><header>Grant amounts</header>
<clause id="HFB073F3256F245D69EED3E815F2AFE2B"><enum>(i)</enum><header>Individual grant amounts</header><text>Each grant awarded under this paragraph shall not exceed $950,000.</text></clause>
<clause id="H565B98A908AC422C9D1885DA79A525E7"><enum>(ii)</enum><header>Cumulative grant amounts</header><text>The total amount of grants awarded for each fiscal year under this paragraph shall not exceed 15 percent of the funds made available for the fiscal year to carry out this subsection.</text></clause></subparagraph>
<subparagraph id="HCD2225126E044400A42F0DBA0AE93099"><enum>(C)</enum><header>Criteria</header><text>In awarding a grant under this paragraph, the Administrator shall consider the extent to which an eligible entity is able—</text>
<clause id="H256EB30C506B40AAA7CB876017E31B82"><enum>(i)</enum><text>to provide an overall plan for revitalization of the 1 or more brownfield sites in the proposed area in which the multipurpose grant will be used;</text></clause>
<clause id="H28A0D58C4DD646259BF201EC7D901A59"><enum>(ii)</enum><text>to demonstrate a capacity to conduct the range of eligible activities that will be funded by the multipurpose grant; and</text></clause>
<clause id="H15C2483F3A5A4522A3C0EC448BDB0D3C"><enum>(iii)</enum><text>to demonstrate that a multipurpose grant will meet the needs of the 1 or more brownfield sites in the proposed area.</text></clause></subparagraph>
<subparagraph id="HE75D178DBF1A4519BEDD033D23A51EAC"><enum>(D)</enum><header>Condition</header><text>As a condition of receiving a grant under this paragraph, each eligible entity shall expend the full amount of the grant not later than the date that is 3 years after the date on which the grant is awarded to the eligible entity unless the Administrator, in the discretion of the Administrator, provides an extension.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H8C1EF8F81591440D840D3F1A7B911F22"><enum>4.</enum><header>Treatment of certain publicly owned brownfield sites</header><text display-inline="no-display-inline">Section 104(k)(2) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(2)</external-xref>) is amended by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H5F590735692E49CF8805CB68ABADE65E" style="OLC">
<subparagraph id="H39EF672905204ADA850B3D2CBC1A0A0D"><enum>(C)</enum><header>Exemption for certain publicly owned brownfield sites</header><text>Notwithstanding any other provision of law, an eligible entity that is a governmental entity may receive a grant under this paragraph for property acquired by that governmental entity prior to January 11, 2002, even if the governmental entity does not qualify as a bona fide prospective purchaser (as that term is defined in section 101(40)).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HC05E8286732B40009245FB6DE3B05984"><enum>5.</enum><header>Increased funding for remediation grants</header><text display-inline="no-display-inline">Section 104(k)(3)(A)(ii) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)(3)(A)(ii)</external-xref>) is amended by striking <quote>$200,000 for each site to be remediated</quote> and inserting <quote>$500,000 for each site to be remediated, which limit may be waived by the Administrator, but not to exceed a total of $650,000 for each site, based on the anticipated level of contamination, size, or ownership status of the site</quote>.</text></section>
<section id="HDB1AB9B4897D48D5BFD38D3753821F60"><enum>6.</enum><header>Allowing administrative costs for grant recipients</header><text display-inline="no-display-inline">Paragraph (5) of section 104(k) of the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) (as redesignated by section 3(1)) is amended</act-name>—</text>
<paragraph id="HB46A7929DEB040E79A625FE68B85FBC3"><enum>(1)</enum><text>in subparagraph (B)—</text>
<subparagraph id="HDA231816BDA647728355AD60E4540F0B"><enum>(A)</enum><text>in clause (i)—</text>
<clause id="HF3BDEC1EFD33401C8B84D5620AD764DD"><enum>(i)</enum><text>by striking subclause (III); and</text></clause>
<clause id="HF6957E40760946A5AEC44211F5F7E1B5"><enum>(ii)</enum><text>by redesignating subclauses (IV) and (V) as subclauses (III) and (IV), respectively;</text></clause></subparagraph>
<subparagraph id="H20E9B7B98B9D433796945CA3F6F21055"><enum>(B)</enum><text>by striking clause (ii);</text></subparagraph>
<subparagraph id="H7ACF3596AC7B4B01A686D5316B4618F6"><enum>(C)</enum><text>by redesignating clause (iii) as clause (ii); and</text></subparagraph>
<subparagraph id="H0D785DB7F5034ACEB9606753FFF0099A"><enum>(D)</enum><text>in clause (ii) (as redesignated by subparagraph (C)), by striking <quote>Notwithstanding clause (i)(IV)</quote> and inserting <quote>Notwithstanding clause (i)(III)</quote>; and</text></subparagraph></paragraph>
<paragraph id="H7E81CF50DAEF4FAE80E420B80AF9E912"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

<subparagraph id="HB0ADB6FDA58F4A1AA9BB33AD4BC331E3"><enum>(E)</enum><header>Administrative costs</header>
<clause id="HD56210D8EB30430CA2D77891944F8DE0"><enum>(i)</enum><header>In general</header><text>An eligible entity may use up to 8 percent of the amounts made available under a grant or loan under this subsection for administrative costs.</text></clause>
<clause id="H6736D00C6C2F4C2CA2DED6D5C3A4006D"><enum>(ii)</enum><header>Restriction</header><text>For purposes of clause (i), the term <term>administrative costs</term> does not include—</text>
<subclause id="H04A727B7AA8A48BF81F66EE8A8381FBA"><enum>(I)</enum><text>investigation and identification of the extent of contamination;</text></subclause>
<subclause id="H7B151BEEA2B8448A8D161E19D963C256"><enum>(II)</enum><text>design and performance of a response action; or</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H09003B3B4FEE4595B49BEE7DAB5DC8CC"><enum>(III)</enum><text>monitoring of a natural resource.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HB0FD6A2FE1D243168EB30ED8497353C8"><enum>7.</enum><header>Small community technical assistance</header><text display-inline="no-display-inline">Paragraph (7)(A) of section 104(k) of the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) (as redesignated by section 3(1)) is amended—</act-name></text>
<paragraph id="H52F9E81C7A1E4FE8B9E82F381D272E7D"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>The Administrator</quote> and inserting the following:</text>

<clause id="H7CD9095448AE4BFF8CC5C9D2AE218D96"><enum>(i)</enum><header>In general</header><text>The Administrator</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="HA56A83CA327B4023B86BD17CAED89DCA"><enum>(2)</enum><text>by inserting after clause (i) (as added by paragraph (1)) the following:</text>
<quoted-block display-inline="no-display-inline" id="H143519CE22D44679943D20034DF2C8B5" style="OLC">
<clause id="HC6F48CDD513D4C7B87FEFE67310880B6"><enum>(ii)</enum><header>Small community recipients</header><text>In carrying out the program under clause (i), the Administrator shall give priority to small communities, Indian tribes, rural areas, or low-income areas with a population of not more than 15,000 individuals, as determined by the latest available decennial census.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H6B0D18D33A204277AE55C3B357B550EB"><enum>8.</enum><header>Waterfront brownfields grants</header><text display-inline="no-display-inline">Section 104(k) of the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) is amended </act-name>by inserting after paragraph (10) (as redesignated by section 3(1)) the following: <act-name parsable-cite="CERCL"></act-name></text>
<quoted-block display-inline="no-display-inline" id="H40F86208A1CA405DBC10D33E33CEA6CB" style="OLC">
<paragraph id="HFED21265837D4989A9DC2E74392FE30E"><enum>(11)</enum><header>Waterfront brownfield sites</header>
<subparagraph id="H0EBF158FF4EA428F9C293D28294D3A65"><enum>(A)</enum><header>Definition of waterfront brownfield site</header><text>In this paragraph, the term <term>waterfront brownfield site</term> means a brownfield site that is adjacent to a body of water or a federally designated floodplain.</text></subparagraph>
<subparagraph id="HC8D0A84A3015447BB51FD0D2368CA403"><enum>(B)</enum><header>Requirements</header><text>In providing grants under this subsection, the Administrator shall—</text>
<clause id="H69B0A6ED2278457BB124E63E8C44A58D"><enum>(i)</enum><text>take into consideration whether the brownfield site to be served by the grant is a waterfront brownfield site; and</text></clause>
<clause commented="no" id="H2401C5A0CF4F4CC3BDB4F79A3E1025DD"><enum>(ii)</enum><text>give consideration to waterfront brownfield sites.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H0A5A66A31C4A4ADF92A0241B0CFDA823"><enum>9.</enum><header>Clean energy brownfields grants</header><text display-inline="no-display-inline">Section 104(k) of the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) (as amended by section 8) is amended </act-name>by inserting after paragraph (11) the following:</text>

<paragraph id="H2740BE53DF8843A88B8FF276771B0FA6"><enum>(12)</enum><header>Clean energy projects at brownfield sites</header>
<subparagraph id="H38B1FFCC37E64BDE9702CA72251FDB7F"><enum>(A)</enum><header>Definition of clean energy project</header><text>In this paragraph, the term <term>clean energy project</term> means—</text>
<clause id="H1D9498482DC4469C9D6F7C6668050DF9"><enum>(i)</enum><text>a facility that generates renewable electricity from wind, solar, or geothermal energy; and</text></clause>
<clause id="HCCDF954A9BF948078D78BA57A76259E7"><enum>(ii)</enum><text>any energy efficiency improvement project at a facility, including combined heat and power and district energy.</text></clause></subparagraph>
<subparagraph id="H871FE201ADB5426381CD024EFA7C5FFC"><enum>(B)</enum><header>Establishment</header><text>The Administrator shall establish a program to provide grants—</text>
<clause id="HBA1DB7D971584D21B60EEB444545AF17"><enum>(i)</enum><text>to eligible entities to carry out inventory, characterization, assessment, planning, feasibility analysis, design, or remediation activities to locate a clean energy project at 1 or more brownfield sites; and</text></clause>
<clause id="H3FC7E7646B7D408CB409C03CF5911550"><enum>(ii)</enum><text>to capitalize a revolving loan fund for the purposes described in clause (i).</text></clause></subparagraph>
<subparagraph id="HEE38148F180E4DA09BC607436094FF32"><enum>(C)</enum><header>Maximum amount</header><text>A grant under this paragraph shall not exceed $500,000.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HBA2E0E74DA314FB0B5487FEE7945A0B6"><enum>10.</enum><header>Targeted funding for States</header><text display-inline="no-display-inline">Paragraph (15) of section 104(k) of the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) (as redesignated by section 3(1)) is amended</act-name> by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H810533B5423B4FF2A9272E0CAC812EAC" style="OLC">
<subparagraph id="HDB907EC9C2C14524A00CF8F15A5824B0"><enum>(C)</enum><header>Targeted funding</header><text>Of the amounts made available under subparagraph (A) for a fiscal year, the Administrator may use not more than $2,000,000 to provide grants to States for purposes authorized under section 128(a), subject to the condition that each State that receives a grant under this subparagraph shall have used at least 50 percent of the amounts made available to that State in the previous fiscal year to carry out assessment and remediation activities under section 128(a).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H5761820542D04A8CA77E547B52A16004"><enum>11.</enum><header>Authorization of appropriations</header>
<subsection id="H42237E51C5D34C65BF39267A707577AC"><enum>(a)</enum><header>Brownfields revitalization funding</header><text>Paragraph (15)(A) of section 104(k) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) (as redesignated by section 3(1)) is amended by striking <quote>2006</quote> and inserting <quote>2016</quote>.</text></subsection>
<subsection id="HFE63D3C4DE994DB6BA55A51F54B77131"><enum>(b)</enum><header>State response programs</header><text>Section 128(a)(3) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9628">42 U.S.C. 9628(a)(3)</external-xref>) is amended by striking <quote>2006</quote> and inserting <quote>2016</quote>.</text></subsection></section>
