		<section id="H453587A0A3F140E1B801594C59BA842C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Waterfront of Tomorrow Act of
			 2013</short-title></quote>.</text>
		</section><section id="HF542B515010C4CDF9A10448E0BA9CC17"><enum>2.</enum><header>Studies</header>
			<subsection id="HF2591F1E7CC9471885E5D6ADADABF189"><enum>(a)</enum><header>Measures To
			 improve flood protection and climate resilience for New York City</header>
				<paragraph id="H31BBF6A850E6430789D6FB4688A0026E"><enum>(1)</enum><header>Study</header><text>The
			 Secretary of the Army shall conduct a study of measures to improve flood
			 protection and climate resilience for New York City, using both traditional
			 engineering and green infrastructure technologies.</text>
				</paragraph><paragraph id="H6263CFB007EC4D9DA6A2F5A21521832E"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">In conducting the study, the Secretary
			 shall—</text>
					<subparagraph id="HE17D81B2FE96439FB55B6ED61F7FC45C"><enum>(A)</enum><text>assess traditional
			 engineering solutions, including tide gates and seawalls;</text>
					</subparagraph><subparagraph id="H253E97CF4DD54EBCBE91D90F8CF04EFC"><enum>(B)</enum><text>assess, in
			 consultation with the Administrator of the National Oceanic and Atmospheric
			 Administration, the use of alternative approaches, including oyster reef
			 restoration, tidal wetland restoration and construction, and other natural
			 designs that reduce storm surge impacts and retain storm water while providing
			 additional environmental benefits;</text>
					</subparagraph><subparagraph id="H167C2CDCCA99419C9266788BF8BB9ABA"><enum>(C)</enum><text display-inline="yes-display-inline">identify the cost and time associated with
			 implementing the measures described in subparagraphs (A) and (B), the potential
			 impact of such measures on the surrounding environment, and any adverse impacts
			 of such measures on local housing, commerce, or recreation; and</text>
					</subparagraph><subparagraph id="H413CA7CC7AF346BCAC6C612AF11F915D"><enum>(D)</enum><text display-inline="yes-display-inline">make a recommendation as to which of such
			 measures would provide the greatest protection for New York City coastal
			 communities and critical infrastructure from an event of a magnitude that is
			 equal to or greater than Hurricane Sandy.</text>
					</subparagraph></paragraph><paragraph id="HCDAAB085F1EC4C2FBD6AA2AD5D024892"><enum>(3)</enum><header>Coordination to
			 prevent duplication of efforts</header><text display-inline="yes-display-inline">The Secretary shall carry out the
			 activities under this section in coordination with the study to be conducted by
			 the Secretary under the heading <term>Corps of
			 Engineers—Civil—Investigations</term> in title II of <external-xref legal-doc="public-law" parsable-cite="pl/113/2">Public Law 113–2</external-xref> (127
			 Stat. 5).</text>
				</paragraph><paragraph id="H6F6AB4D0F18F4527975FDC100015F441"><enum>(4)</enum><header>Report</header><text>Not
			 later than 18 months after the date of enactment of this Act, the Secretary
			 shall transmit to Congress a report on the results of the study.</text>
				</paragraph><paragraph id="H4000DC1AB1794813804B6AC6B9E984F0"><enum>(5)</enum><header>Corps of
			 Engineers</header><text>The Secretary shall carry out this subsection acting
			 through the Chief of Engineers.</text>
				</paragraph></subsection><subsection id="H6073BD9E6FCC4009BDA9F7407851C9FE"><enum>(b)</enum><header>Environmental
			 impact of major disasters</header>
				<paragraph id="HC442250426854DC39097E73EF5E30854"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Administrator of the Environmental
			 Protection Agency, in consultation with the Administrator of the Occupational
			 Safety and Health Administration, shall conduct a study of the environmental
			 impact of each major disaster that the Administrator determines will have a
			 significant environmental impact on the waters of the United States.</text>
				</paragraph><paragraph id="HEE3872C39F0A44978281E9D4198941FA"><enum>(2)</enum><header>Determinations</header><text>In
			 making determinations under paragraph (1), the Administrator of the
			 Environmental Protection Agency shall ensure that the Administrator conducts
			 studies under this subsection with respect to, at a minimum, 10 percent of the
			 major disasters declared in a fiscal year.</text>
				</paragraph><paragraph id="H6AB08BDDA408491A972A71C85457F6A3"><enum>(3)</enum><header>Contents</header><text display-inline="yes-display-inline">The Administrator shall conduct a study
			 under this subsection with respect to a major disaster with the specific goal
			 of determining—</text>
					<subparagraph id="H05CC3E0729594FCD8600C278327D9392"><enum>(A)</enum><text>whether industrial
			 facilities discharged pollutants or other hazards into local waterways or the
			 water supply during the major disaster; and</text>
					</subparagraph><subparagraph id="HFE55C916F8ED4A6DB9E6103922CE31D4"><enum>(B)</enum><text>if so, how to
			 avoid or minimize the risk of such pollution incidents in the future.</text>
					</subparagraph></paragraph><paragraph id="HE7C830C70CA44046855495D33C95EB79"><enum>(4)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 the declaration of a major disaster described in paragraph (1), the
			 Administrator shall transmit to Congress a report on the results of the study
			 conducted under this subsection with respect to the major disaster.</text>
				</paragraph><paragraph id="HE05ACA4F2AB44EAC98B28DB96D370D07"><enum>(5)</enum><header>Major disaster
			 defined</header><text>In this subsection, the term <term>major disaster</term>
			 has the meaning given that term in section 102 of the Robert T. Stafford
			 Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>).</text>
				</paragraph></subsection></section><section id="H97D3B21337464000A234CD70F10D3449"><enum>3.</enum><header>National freight
			 policy</header>
			<subsection id="H04D1B5E2B456448A9CD43B0378F2E9D4"><enum>(a)</enum><header>Goals</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/23/167">Section 167(b)</external-xref> of title 23, United States
			 Code, is amended—</text>
				<paragraph id="HBE6E8A73CD3C4A73A8D4DFF21F8125B6"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (5);</text>
				</paragraph><paragraph id="H70FECB45EA8A4DE1B336FC4F00940770"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (6) and inserting a semicolon;</text>
				</paragraph><paragraph id="H826FBAB40DB44623810DC8059FEACB2F"><enum>(3)</enum><text>by striking the
			 semicolon at the end of paragraph (7) and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="HAD4368D98B7049969966AC9DCFEDDBF6"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H50DE9ED80DE7492D843EF39AE1C28F81" style="OLC">
						<paragraph id="H435E28F92AE24C1C8472B94EE3D7444C"><enum>(8)</enum><text display-inline="yes-display-inline">to ensure that the socioeconomic and
				environmental impacts of moving cargo through a community are fully accounted
				for in establishing the national freight
				network.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC3D9C13C41E74678B4E34ECBFAFB4B35"><enum>(b)</enum><header>Ports and
			 harbors</header><text display-inline="yes-display-inline">Section 167(c) of
			 title 23, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HEC458A800B4F4B82AF332FD0C86F67CD" style="OLC">
					<paragraph id="H17FE8D8DBD7D46CAAE248F3FA8976D5E"><enum>(3)</enum><header>Ports and
				harbors</header><text display-inline="yes-display-inline">The Secretary shall
				ensure that ports and harbors are incorporated into the national freight
				network.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H9D0B1A58315149E7830AD3680D13CF17"><enum>4.</enum><header>Next generation
			 ports</header>
			<subsection id="H4B57E4C4BBA5471189499AB688E6FF24"><enum>(a)</enum><header>Improvements to
			 port infrastructure and intermodal rail and highway networks</header>
				<paragraph id="HAC9649CCB8BC4AE6BDC44F5A46C4B041"><enum>(1)</enum><header>Grants</header><text>The
			 Secretary of the Army is authorized to make grants to States and local
			 governments for projects to improve port infrastructure and intermodal rail and
			 highway networks.</text>
				</paragraph><paragraph id="HC1D909DCEF584A138637A9FE4A040DEE"><enum>(2)</enum><header>Consideration of
			 local preferences and environmental concerns</header><text display-inline="yes-display-inline">In making grants to States and local
			 governments under this subsection, the Secretary shall ensure that local
			 preferences and environmental concerns are incorporated into any port
			 infrastructure and intermodal transportation improvements, so that disruptions
			 and adverse impacts are minimized.</text>
				</paragraph></subsection><subsection id="HF6C33738DF284C47B48D1399DB1DB442"><enum>(b)</enum><header>Green
			 ports</header>
				<paragraph id="H850765810EE94963BAF1FCFDE78F03E2"><enum>(1)</enum><header>Designation</header><text display-inline="yes-display-inline">The Administrator of the Maritime
			 Administration, acting jointly with the Administrator of the Environmental
			 Protection Agency, shall establish a green port designation for ports that meet
			 certain environmental standards.</text>
				</paragraph><paragraph id="H07E55F7254AD43798D7E7E09BF4B314F"><enum>(2)</enum><header>Grants and
			 technical assistance</header><text>The Administrator of the Maritime
			 Administration is authorized to provide grants and technical assistance to a
			 port designated as a green port pursuant to paragraph (1) to implement
			 innovations that minimize the environmental impacts of port operations.</text>
				</paragraph></subsection></section><section id="H65254AE5734A47828962030E8CC4485E"><enum>5.</enum><header>Waterfronts as
			 main streets</header>
			<subsection id="H5154D982E4934898B5176055F3E437FD"><enum>(a)</enum><header>Establishment of
			 grant program</header><text display-inline="yes-display-inline">The Secretary
			 of Commerce, acting through the Administrator of the Economic Development
			 Administration, shall carry out a grant program in accordance with the
			 requirements of this section.</text>
			</subsection><subsection display-inline="no-display-inline" id="H28C441E744934CB1A3E5E1D6409A3752"><enum>(b)</enum><header>Award of
			 grants</header><text display-inline="yes-display-inline">In carrying out the
			 program, the Secretary may make grants to States and local governments for
			 projects to establish environmentally sustainable waterfront areas.</text>
			</subsection><subsection id="H4969523A9F434EA7B5E83D8011B05B41"><enum>(c)</enum><header>Applications</header><text>A
			 State or local government seeking a grant under the program shall submit to the
			 Secretary an application at such time and containing such information as the
			 Secretary may require.</text>
			</subsection><subsection id="H4AB65762BD50445E81383209680FBBCA"><enum>(d)</enum><header>Criteria</header>
				<paragraph id="H769DF3D74597486E8CA92C0EEC9D9B91"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall establish criteria for awarding
			 grants for projects under the program.</text>
				</paragraph><paragraph id="HA0ACA572ECD447758AC8CB710B9D00F3"><enum>(2)</enum><header>Priority</header><text>The
			 criteria shall include an assessment of whether the applicant is able to
			 demonstrate the potential of a project—</text>
					<subparagraph id="HB49C20640E3849618A1873C241A4469C"><enum>(A)</enum><text>to generate
			 economic growth and job creation; or</text>
					</subparagraph><subparagraph id="HF4E78B4CA5ED4B80B275202C71F26D35"><enum>(B)</enum><text>to improve the
			 environmental sustainability of waterfront areas.</text>
					</subparagraph></paragraph></subsection><subsection id="HDD88FD68F4BC436AA0208D322B412F0E"><enum>(e)</enum><header>Maximum grant
			 amount</header><text>The Secretary may not make grants under this section to a
			 State or local government in an amount that exceeds $10,000,000 in the
			 aggregate.</text>
			</subsection><subsection id="H5B15FAF3512E41CA865AAEB497BF1A6E"><enum>(f)</enum><header>Reporting
			 requirement</header><text display-inline="yes-display-inline">As a condition
			 for receiving a grant under the program, a State or local government shall
			 agree to submit to the Secretary an annual report on the achievement of
			 performance measures, including the criteria described in subsection (d)(2), by
			 the State or local government for a period of 3 years after the grant is
			 awarded.</text>
			</subsection><subsection id="HEF32B53392FE49DD8121001D4C5323FC"><enum>(g)</enum><header>Federal
			 share</header><text>The Federal share of the cost of a project carried out with
			 funds from a grant under the program may not exceed 75 percent.</text>
