		<official-title>To implement reforms to the Federal land management
		  agency fire programs in order to address the complexities of 21st century
		  wildfires in a more cost-effective and efficient manner.</official-title>

		<section id="HC970695279A444E29847ABCE57303CF0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Wildland Firefighters Protection
			 Act</short-title></quote>.</text>
		</section><section id="HD851BA4B7CEE4B6E88AED0F632620986"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act—</text>
			<paragraph id="H47981AD605804D92915A20C0C1FBE75F"><enum>(1)</enum><text>the term
			 <term>wildland firefighter</term> means an employee of a Federal land
			 management agency, the duties of whose position are primarily to perform work
			 directly related to the prevention, control, suppression, and management of
			 wildfires, including—</text>
				<subparagraph id="H43C06DAA7D5D42199826D037F8B2B3D1"><enum>(A)</enum><text>an employee of a
			 Federal land management agency who is assigned to support wildland fire
			 suppression activities; and</text>
				</subparagraph><subparagraph id="HBA97F0D5B1C849CC9528D72140FCBA80"><enum>(B)</enum><text>an employee who is
			 transferred to a supervisory or administrative position from a position of
			 wildland firefighter (as defined by the preceding provisions of this
			 paragraph);</text>
				</subparagraph></paragraph><paragraph id="HAF77B8D1B89C40239C50A336D8BC8557"><enum>(2)</enum><text>the term
			 <term>Federal land management agency</term> means—</text>
				<subparagraph id="H490535B2B9A749DDAE36FF69C022E534"><enum>(A)</enum><text>within the
			 Department of the Interior, the Bureau of Land Management, the Bureau of Indian
			 Affairs, the National Park Service, and the Fish and Wildlife Service;
			 and</text>
				</subparagraph><subparagraph id="H1CFC3F0938E24E6D8BABBB6EFE0A9EC8"><enum>(B)</enum><text>within the
			 Department of Agriculture, the Forest Service; and</text>
				</subparagraph></paragraph><paragraph id="H4873C2AC0DA545328F06313A6FD0EE4E"><enum>(3)</enum><text>the term
			 <term>employee</term> has the meaning given such term by section 2105 of title
			 5, United States Code.</text>
			</paragraph></section><section id="H9E09B9E1E0264EC1AD705FC2976463C2"><enum>3.</enum><header>Classification of
			 wildland firefighters</header>
			<subsection id="H035E2802D3EB4B6CA4BD688A1F964510"><enum>(a)</enum><header>Requirements</header>
				<paragraph id="HD8079966E5794F19A0DB5F908B74CBD9"><enum>(1)</enum><header>In
			 general</header><text>Within 30 days after the date of the enactment of this
			 Act, the Office of Personnel Management, in cooperation with the Federal land
			 management agencies, shall commence development of a separate and distinct
			 wildland firefighter occupational series that will more accurately reflect the
			 variety of duties performed by wildland firefighters.</text>
				</paragraph><paragraph id="H7CEE8914B4614C5B8A1B274D22DF8319"><enum>(2)</enum><header>Designation</header><text>The
			 official title assigned to any occupational series established pursuant to
			 paragraph (1) shall include the designation of <quote>Wildland
			 Firefighter</quote>.</text>
				</paragraph><paragraph id="H33CE30CABDB54CA5812AB86BF0C6E108"><enum>(3)</enum><header>Positions
			 described</header><text>Paragraph (1) applies with respect to any class or
			 other category of positions that consists primarily or exclusively of forestry
			 technician positions, range technician positions, or any other positions the
			 duties and responsibilities of which include—</text>
					<subparagraph id="H6978E9CA2C0E4379BF43575D2F086E39"><enum>(A)</enum><text>significant
			 wildfire preparedness and suppression activities; or</text>
					</subparagraph><subparagraph id="HC89DF532791B497E8EC5114783117A91"><enum>(B)</enum><text>activities
			 necessary to meet any other emergency incident to which assigned.</text>
					</subparagraph></paragraph><paragraph id="HF5245AE8640B4505A003152A3B0627ED"><enum>(4)</enum><header>Consultation</header><text>Congress
			 encourages the Office of Personnel Management to consult with recognized
			 employee organizations, employee associations, and any other groups that
			 represent Federal wildland firefighters in carrying out this subsection.</text>
				</paragraph></subsection><subsection id="HB89DBEFD39434D0AA32DB4430991E73D"><enum>(b)</enum><header>Hazardous duty
			 differential not affected</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/5545">Section 5545(d)(1)</external-xref> of title 5, United
			 States Code, is amended by striking all after <quote>except</quote> and
			 inserting an em dash and the following:</text>
				<quoted-block id="HF06F4442573F4D039D07BB70E7985BEB" style="OLC">
					<subparagraph id="H09F8FFE5E6D44438AE037BB18F6C1421"><enum>(A)</enum><text>an employee in an
				occupational series covering positions for which the primary duties are
				wildland firefighting, as determined by the Office; and</text>
					</subparagraph><subparagraph id="H7AC53895F69B48DA930F325E75162612"><enum>(B)</enum><text>in such other
				circumstances as the Office may by regulation prescribe;
				and</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HED55833D583E4CFEB72971A7425DCDF6"><enum>(c)</enum><header>Employees
			 currently in 401 series</header><text display-inline="yes-display-inline">Any
			 individual who, as of the date of the enactment of this Act, holds a position
			 of wildland firefighter shall have the option of either remaining in the 401
			 series (as in effect on such date under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/51">chapter 51</external-xref> of title 5, United States
			 Code) or being included in the new wildland firefighter series, as established
			 pursuant to subsection (a).</text>
			</subsection></section><section id="HC1F65A235FF148CE934F8989A6096A07"><enum>4.</enum><header>Pay and
			 benefits</header>
			<subsection id="HEA146A06D31342FD8DC13EEFC4B8AC2E"><enum>(a)</enum><header>Portal-to-Portal
			 Compensation Pilot Program</header>
				<paragraph id="HA9A67E96315640D6A6624F039286BAFA"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In the case of a
			 wildland firefighter, for full-time, part-time, and intermittent tours of duty,
			 hours of work officially ordered or approved in excess of 40 hours per week or
			 8 hours per day shall be considered overtime work, inclusive of all time the
			 firefighter is away from their official duty station assigned to an emergency
			 incident, in support of an emergency incident (including wildfires, hurricanes,
			 and other natural disasters to which employees are assigned) in support of an
			 emergency incident, or pre-positioned for emergency response, and shall be
			 compensable as work time in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/5542">section 5542(a)</external-xref> of title 5, United
			 States Code, as amended by paragraph (2)(A). The provisions of this subsection
			 and the amendments made by this subsection comprise the portal-to-portal
			 compensation pilot program.</text>
				</paragraph><paragraph id="HEA01310AF9E54A46B80A48AE3A304E42"><enum>(2)</enum><header>Requirements</header>
					<subparagraph id="HDB59959033D04C60A4ECE8AEA1560503"><enum>(A)</enum><header>Amendment to
			 title 5</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/5542">Section 5542(a)</external-xref> of title 5, United States Code, is
			 amended by adding at the end (as a flush left sentence) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H0BD379AF5A724CA4B01625B2FA545C0C" style="USC">
							<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">Notwithstanding paragraphs (1) and
				(2), and only for the duration of the portal-to-portal compensation program
				under section 4 of the <short-title>Wildland Firefighters
				Protection Act</short-title>, for a wildland firefighter assigned to an
				emergency incident, assigned in support of an emergency incident, or
				pre-positioned for emergency response, the overtime hourly rate of pay is an
				amount equal to one and one-half times the hourly rate of the basic pay of the
				employee, and that entire amount is premium
				pay.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HC37278E7BF8E47A4B2E1AFA73BBDEE75"><enum>(B)</enum><header>Fair Labor
			 Standards Act of 1938</header><text>For the purpose of applying the provisions
			 of the Fair Labor Standards Act of 1938 (29 U.S.C. 201 and following) with
			 respect to wildland firefighters, no violation referred to in such provisions
			 shall be considered to have occurred if the requirements described in the
			 amendment made by subparagraph (A) are met.</text>
					</subparagraph><subparagraph id="HF3723D160FC647B0AD12F52E1989FF6A"><enum>(C)</enum><header>Duration and
			 scope of pilot program</header><text display-inline="yes-display-inline">The
			 pilot program shall be carried out by the Department of the Interior and the
			 Department of Agriculture—</text>
						<clause id="H95AEAC2753AC42858ED85F10F295A4F3"><enum>(i)</enum><text>for
			 a period not to exceed 3 calendar years beginning as of the start of the 2014
			 wildfire season; and</text>
						</clause><clause id="HE0535A6A5C9149C1BD775CBBA06D8BCC"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to wildland firefighters
			 holding positions within such geographic areas as the Secretary of Agriculture
			 shall, in consultation with the Secretary of the Interior, determine.</text>
						</clause></subparagraph><subparagraph id="H9680DDA78AF74626AE8EDD0BCFAC8282"><enum>(D)</enum><header>Funding</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 there shall be made available from the FLAME Wildfire Suppression Reserve
			 Funds, established by section 502(b) of the FLAME Act of 2009 (43 U.S.C.
			 1748a(b)), an amount—</text>
						<clause id="H32426F43C5034ECF9EEB0232763EB3D5"><enum>(i)</enum><text>sufficient to
			 carry out the portal-to-portal compensation pilot program; but</text>
						</clause><clause id="H959257CC891F493FB395D3194FD219EB"><enum>(ii)</enum><text>only to the
			 extent that—</text>
							<subclause id="H87631AEBEEC94D71A239298AD580F1D0"><enum>(I)</enum><text>in the case of the
			 2014 wildfire season and any subsequent wildfire season during which the pilot
			 program is in effect, such amount exceeds</text>
							</subclause><subclause id="HDBC300970BDF47CEA3A1668B4FBC61EC"><enum>(II)</enum><text>the average
			 corresponding expenses which were paid, with respect to wildland firefighters
			 holding positions within the geographic area or areas covered by the program
			 (as specified under subparagraph (C)(ii)) for the 2012 and 2013 wildfire
			 seasons.</text>
							</subclause></clause></subparagraph><subparagraph id="H4869ED62ADB94791894CB9F9DC8171E0"><enum>(E)</enum><header>Report</header><text>No
			 later than 90 days after the completion of the pilot program, the Secretary of
			 the Interior and the Secretary of Agriculture shall submit to Congress a joint
			 report on the effectiveness of the pilot program. Such report shall address the
			 effect of the program with respect to—</text>
						<clause id="HAB1F6E09CCAF4767BA1C6680CB41B337"><enum>(i)</enum><text>recruitment and
			 retention of wildland firefighters; and</text>
						</clause><clause id="HDBF4C014064D4B4DB887E41D3D980D79"><enum>(ii)</enum><text>any
			 cost savings.</text>
						</clause></subparagraph><subparagraph id="H8B125DBF7B564A39A084D5B2DB23E744"><enum>(F)</enum><header>Exemption</header><text display-inline="yes-display-inline">Employees compensated under the pilot
			 program shall, for the period of such program, be exempt from any limitation on
			 premium pay under <external-xref legal-doc="usc" parsable-cite="usc/5/5547">section 5547</external-xref> of title 5, United States Code.</text>
					</subparagraph></paragraph></subsection><subsection id="H2179774371F24A3F9ACE58D53ACC464E"><enum>(b)</enum><header>Hazardous duty
			 differential To be treated as part of a wildland firefighter’s base pay for
			 retirement purposes</header>
				<paragraph id="H4E992671518A471BAD69A70352561F75"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8331">Section 8331(3)</external-xref> of title 5, United States Code is
			 amended—</text>
					<subparagraph id="H45F44733469B4EF4A6DF5F6C8EA3894E"><enum>(A)</enum><text>in subparagraph
			 (G), by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="HFD10458D35014777A90041ED0ACAA323"><enum>(B)</enum><text>in subparagraph
			 (H), by inserting <quote>and</quote> at the end; and</text>
					</subparagraph><subparagraph id="H28E9A0C46AE44F74A3E239F38FF90958"><enum>(C)</enum><text>by adding after
			 subparagraph (H) the following:</text>
						<quoted-block id="HD31F77746EE74635819DB58AF955E20B" style="OLC">
							<subparagraph id="HB5B253503C4E455BB910BD13A6908181"><enum>(I)</enum><text>with respect to a
				wildland firefighter (as defined by section 2 of the
				<short-title>Wildland Firefighters Protection
				Act</short-title>), any pay differential received under section
				5545(d);</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H6EAEF93857AB4AB0AF62450ED8805C2C"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Such section 8331(3) is further amended, in the matter
			 following subparagraph (I) (as added by paragraph (1)(C)), by striking
			 <quote>subparagraphs (B) through (H) of this paragraph</quote> and inserting
			 <quote>subparagraphs (B) through (I),</quote>.</text>
				</paragraph></subsection><subsection id="H660563EE3472456B973AE912D666B81B"><enum>(c)</enum><header>Hazardous duty
			 differential</header>
				<paragraph id="H9D1BCDA234C040A69EE2886680C74631"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In the administration
			 of <external-xref legal-doc="usc" parsable-cite="usc/5/5545">section 5545(d)</external-xref> of title 5, United States Code, the Office of Personnel
			 Management shall take such measures as may be necessary to ensure that, under
			 the schedule or schedules of pay differentials for duty involving unusual
			 physical hardship or hazard, a pay differential of 25 percent shall be payable
			 to an individual while serving as a member of a wildland firefighting
			 crew.</text>
				</paragraph><paragraph id="H0AA5943ACD5D42D790D54C716B3ACB13"><enum>(2)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this subsection, the term
			 <term>wildland firefighting crew</term> includes ground (hand crew, hotshot,
			 engine, and other fire apparatus personnel) and airborne (smoke jumper or
			 helitack) firefighting personnel on the fire line of any wildfire or prescribed
			 fuel treatment burn or fire, as further defined in regulations of the Office of
			 Personnel Management.</text>
				</paragraph></subsection><subsection id="HBA2E05638E3E4D5F9CFE5E4FC379B0A2"><enum>(d)</enum><header>Buy back of
			 civilian time after 1989</header>
				<paragraph id="H1116CCCE3E2F44DC96C16D7549AEAFED"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Any individual who is
			 subject to the Federal Employees’ Retirement System as a firefighter (within
			 the meaning of <external-xref legal-doc="usc" parsable-cite="usc/5/8401">section 8401</external-xref> of title 5, United States Code) on the date of the
			 enactment of this Act shall be entitled to have any qualifying firefighter
			 service treated as creditable service under section 8411 of such title.</text>
				</paragraph><paragraph id="H273461DB10894E9283C624C9DD3C32CF"><enum>(2)</enum><header>Qualifying
			 firefighter service</header><text>For purposes of this subsection, the term
			 <term>qualifying firefighter service</term> means, in connection with an
			 individual, any service—</text>
					<subparagraph id="H7C35AB192C164FB89DD5263000333895"><enum>(A)</enum><text display-inline="yes-display-inline">which was performed by such individual, as
			 a wildland firefighter, after 1989 and before the date of the enactment of this
			 Act; and</text>
					</subparagraph><subparagraph id="H395BF8AAC6E740D499778EE31AC86618"><enum>(B)</enum><text>for which such
			 individual was not allowed to receive retirement credit by reason of section
			 8347(g) or 8402(c) of such title 5.</text>
					</subparagraph></paragraph><paragraph id="H3A47755F0E1D4F1FAAA58F587DED061B"><enum>(3)</enum><header>Deposit
			 requirement</header><text>Credit for a period of service may not be given under
			 this subsection unless the individual involved makes a deposit, in such manner
			 as the Office of Personnel Management may by regulation require, equal to the
			 employee contributions that would have been required (in the case of a
			 firefighter) for such period under section 8334(c) or 8422(a) of such title 5,
			 with interest.</text>
				</paragraph><paragraph id="HA637057AA74C4FBD8712774381929376"><enum>(4)</enum><header>Certification</header><text>The
			 Office of Personnel Management shall accept the certification of the Secretary
			 of the Interior or the Secretary of Agriculture, as the case may be, concerning
			 whether an individual performed qualifying firefighter service and the length
			 of the period of such service the individual performed.</text>
				</paragraph></subsection></section></legis-body>
