		<official-title>To amend the Lacey Act Amendments of 1981 to prohibit
		  importation, exportation, transportation, sale, receipt, acquisition, and
		  purchase in interstate or foreign commerce, or in a manner substantially
		  affecting interstate or foreign commerce, of any live animal of any prohibited
		  wildlife species.</official-title>

		<section id="HB5355E014BDF4853B71B09DA6E7ED91A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Captive Primate Safety
			 Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H05E8A98DB2E546C69834B39B4EBE182A" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Addition of nonhuman primates to definition
			 of prohibited wildlife species</header><text display-inline="no-display-inline">Section 2(g) of the Lacey Act Amendments of
			 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3371">16 U.S.C. 3371(g)</external-xref>) is amended by inserting before the period at the end
			 <quote>or any nonhuman primate</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HFD1ED04E175D49D9A39F7F26F29D909F" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Captive wildlife amendments</header>
			<subsection commented="no" display-inline="no-display-inline" id="HC8E3C81108374501A989C58159CA059F"><enum>(a)</enum><header display-inline="yes-display-inline">Prohibited acts</header><text display-inline="yes-display-inline">Section 3 of the Lacey Act Amendments of
			 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3372">16 U.S.C. 3372</external-xref>) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H3E02938EB4F54E1C9C65CA2048099221"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H03A28935ABD54DD2AEBB98FDB2394352"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text>
						<clause commented="no" display-inline="no-display-inline" id="H68B0DD2C9B0F4A448C7CB749BD317768"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting
			 <quote>or</quote> after the semicolon;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HA425B36AAD334C2587EFBB3AD422CC86"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (B)(iii), by striking
			 <quote>; or</quote> and inserting a semicolon; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H60C52161E1774E7B93CE0DF54DE94CAD"><enum>(iii)</enum><text display-inline="yes-display-inline">by striking subparagraph (C); and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE7D48BCE23C7406385B7F22B2A8FA183"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (4), by inserting <quote>or
			 subsection (e)</quote> before the period; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5B7906A5BBB34132A96B7450F51F2BE9"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HF3F5E36A7A434B0FBFD06AD352CC12BF"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>(e)</quote> and all that
			 follows through paragraph (1) and inserting the following:</text>

							<subsection commented="no" display-inline="no-display-inline" id="H0083457CB6EA40EDB4D5653F63EF4B5D"><enum>(e)</enum><header display-inline="yes-display-inline">Captive Wildlife Offense</header>
								<paragraph id="H0EC886B7575E4B0996E3D87778305E67"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">It is unlawful for
				any person to import, export, transport, sell, receive, acquire, or purchase in
				interstate or foreign commerce, or in a manner substantially affecting
				interstate or foreign commerce, any live animal of any prohibited wildlife
				species.</text>
								</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H69A2440840BE4B24A48C1DBBA62B1344"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text>
						<clause commented="no" display-inline="no-display-inline" id="HC567B52C067D4C158427696858D6197F"><enum>(i)</enum><text display-inline="yes-display-inline">by striking so much as precedes
			 subparagraph (A) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="H9DD71D201A8743A3AD1074B767E1A88B" style="OLC">
								<paragraph id="HD8C1054185744AE9A04742979DEEF384"><enum>(2)</enum><header>Limitation on
				application</header><text display-inline="yes-display-inline">Paragraph (1)
				does not apply to any person who—</text>
								</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</clause><clause id="HB4A955B2A6844166B1B9A04444E394D3"><enum>(ii)</enum><text>in
			 subparagraph (A), by inserting before the semicolon at the end <quote>and does
			 not allow direct contact between the public and prohibited wildlife
			 species</quote>;</text>
						</clause><clause id="H0E06E766102B45ACA6474AD8884DB6A6"><enum>(iii)</enum><text>in
			 subparagraph (B), by striking <quote>State-licensed wildlife
			 rehabilitator,</quote>;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HFF34691DB62E4BA3A312D6ADC2F6B375"><enum>(iv)</enum><text display-inline="yes-display-inline">in subparagraph (C)—</text>
							<subclause commented="no" display-inline="no-display-inline" id="H17BE926F56A14743872A31E3FC1F5497"><enum>(I)</enum><text display-inline="yes-display-inline">in clauses (ii) and (iii), by striking
			 <quote>animals listed in section 2(g)</quote> each place it appears and
			 inserting <quote>prohibited wildlife species</quote>;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="HBC5290C250CC4F4E922FE631069EFB25"><enum>(II)</enum><text display-inline="yes-display-inline">in clause (iv), by striking
			 <quote>animals</quote> and inserting <quote>prohibited wildlife
			 species</quote>; and</text>
							</subclause><subclause id="HD4FADE1054644BC59281CE9B0F0C4DE6"><enum>(III)</enum><text>by striking
			 <quote>or</quote> after the semicolon at the end;</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H48A2207D107943CCB5182F26C2CB39FC"><enum>(v)</enum><text display-inline="yes-display-inline">in subparagraph (D)—</text>
							<subclause id="H8DB31C9394D447728BE9072C273F1BC6"><enum>(I)</enum><text>by striking
			 <quote>animal</quote> each place it appears and inserting <quote>prohibited
			 wildlife species</quote>; and</text>
							</subclause><subclause id="HEB7D9EE044EB4642B110A43E638CFA69"><enum>(II)</enum><text>by striking the
			 period at the end and inserting <quote>; or</quote>; and</text>
							</subclause></clause><clause id="H718E6B76931F42329887BB6A8F40549F"><enum>(vi)</enum><text>by
			 adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="HE6703CD95E894F18A67EAEEB240B9A58" style="OLC">
								<subparagraph id="HD3C7C606AF3C4F7FBB3C1E4598585533"><enum>(E)</enum><text>is transporting a
				nonhuman primate solely for the purpose of assisting an individual who is
				permanently disabled with a severe mobility impairment, if—</text>
									<clause id="H5E8B260DBBF54774A18E18172BB152CA"><enum>(i)</enum><text>the nonhuman
				primate is a single animal of the genus Cebus;</text>
									</clause><clause id="HCFB437E5B7904DEABA5064456310153A"><enum>(ii)</enum><text display-inline="yes-display-inline">the nonhuman primate was obtained from, and
				trained at, a licensed nonprofit organization that before July 18, 2008, was
				exempt from taxation under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(a)</external-xref> of the Internal Revenue Code of 1986
				and described in sections 501(c)(3) and 170(b)(1)(A)(vi) of such Code on the
				basis that the mission of the organization is to improve the quality of life of
				severely mobility-impaired individuals;</text>
									</clause><clause id="HD1FC56611B654342A97F86A23D1EF64E"><enum>(iii)</enum><text>the person
				transporting the nonhuman primate is a specially trained employee or agent of a
				nonprofit organization described in clause (ii) that is transporting the
				nonhuman primate to or from a designated individual who is permanently disabled
				with a severe mobility impairment;</text>
									</clause><clause id="HB842F503BD2B47F1BEE48AB82F775F73"><enum>(iv)</enum><text>the person
				transporting the nonhuman primate carries documentation from the applicable
				nonprofit organization that includes the name of the designated individual
				referred to in clause (iii);</text>
									</clause><clause id="H5CE565416B82400B8BBE32F0D2B49CDD"><enum>(v)</enum><text>the nonhuman
				primate is transported in a secure enclosure that is appropriate for that
				species;</text>
									</clause><clause id="HF4BEAA58BB7A483E9B0D0F982EA128CF"><enum>(vi)</enum><text>the nonhuman
				primate has no contact with any animal or member of the public, other than the
				designated individual referred to in clause (iii); and</text>
									</clause><clause id="H163F31AC1C2C4D02AD5E9C49CFEE9313"><enum>(vii)</enum><text>the
				transportation of the nonhuman primate is in compliance with—</text>
										<subclause id="H46CA252FAB634E448586ACE9FBCC5A10"><enum>(I)</enum><text>all applicable
				State and local restrictions regarding the transport; and</text>
										</subclause><subclause id="H4553012CC4A2459895A6CBE426EBFC81"><enum>(II)</enum><text>all applicable
				State and local requirements regarding permits or health
				certificates.</text>
										</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H03686E60D069474D86C58771C3888487"><enum>(b)</enum><header display-inline="yes-display-inline">Civil Penalties</header><text display-inline="yes-display-inline">Section 4(a) of the Lacey Act Amendments of
			 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3373">16 U.S.C. 3373(a)</external-xref>) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HCCDAED06FA7D4760BA7EFEB2BC8BE649"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting
			 <quote>(e),</quote> after <quote>subsections (b), (d),</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5C4DA801247C425AA4C04B882EA28831"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>,
			 (e),</quote> after <quote>subsection (d)</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3247E2F1E28C4ED6806734F532CFB496"><enum>(c)</enum><header display-inline="yes-display-inline">Criminal Penalties</header><text display-inline="yes-display-inline">Section 4(d) of the Lacey Act Amendments of
			 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3373">16 U.S.C. 3373(d)</external-xref>) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HF97C26F71CB047C6A90EAF9E884948F2"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraphs (1)(A) and (1)(B) and in the
			 first sentence of paragraph (2), by inserting <quote>(e),</quote> after
			 <quote>subsections (b), (d),</quote> each place it appears; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB60D8599CE9A477385C1E6B9D7B42809"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3), by inserting <quote>,
			 (e),</quote> after <quote>subsection (d)</quote> .</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5E7C8C305B384EECBB76FE3F8245EEE2"><enum>(d)</enum><header>Effective date;
			 regulations</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H001EF90E742F4C5B9C156B79F7A00C26"><enum>(1)</enum><header>Effective
			 date</header><text>Subsections (a) through (c), and the amendments made by
			 those subsections, shall take effect on the earlier of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H72056B676AD7416B806E83D22282E8B1"><enum>(A)</enum><text>the date of
			 promulgation of regulations under paragraph (2); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6C6430AF785A47ABB9CD8E83A0DC4FA8"><enum>(B)</enum><text>the expiration of
			 the period referred to in paragraph (2).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD9E36B3F05DE42439F432C6B3A9C2918"><enum>(2)</enum><header>Regulations</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary of
			 the Interior shall promulgate regulations implementing the amendments made by
			 this section.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H17B50A3BA9EA4B72ACFE47EE5FB53F89" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Applicability provision
			 amendment</header><text display-inline="no-display-inline">Section 3 of the
			 Captive Wildlife Safety Act (117 Stat. 2871; <external-xref legal-doc="public-law" parsable-cite="pl/108/191">Public Law 108–191</external-xref>) is
			 amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H7F3FDF5F6E6E4C6F80D24B3FFF073CE8"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>(a)
			 <header-in-text level="subsection" style="OLC">In
			 general.—</header-in-text>Section 3</quote> and inserting <quote>Section
			 3</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7ADD543DCFBC405A84C7498C5090AF4A"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (b).</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="HA189F137B6BB434FA74B930E1D4B3CAF" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="no-display-inline">Section 7(a) of the Lacey Act Amendments of
			 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3376">16 U.S.C. 3376(a)</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H53CC5FA4A65D49E4A71E4D1616DB73E5" style="OLC">
				<paragraph commented="no" display-inline="no-display-inline" id="HFC9936B4855D4C12935BC2855D57EE41"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary shall, in consultation with
				other relevant Federal and State agencies, promulgate regulations to implement
				section
				3(e).</text>
