appropriations</header><section id="HDCA68CABBD1A4C4AA21A15C2FAEB885F"><enum>101.</enum><header>Administration of foreign affairs</header><text display-inline="no-display-inline">The following amounts are authorized to be appropriated for the Department of State under <quote>Administration of Foreign Affairs</quote> to carry out the authorities, functions, duties, and responsibilities in the conduct of foreign affairs of the United States, and for other purposes authorized by law:</text><paragraph id="H3018F5F6B7C145C68F96BDB094B82030"><enum>(1)</enum><header>Diplomatic and consular programs</header><text>For <quote>Diplomatic and Consular Programs</quote>, $8,481,854,000 for fiscal year 2014.</text><subparagraph id="H3FB84987E44B43D5B1B331A1F9C3EC44"><enum>(A)</enum><header>Bureau of democracy, human rights, and labor</header><text>Of such amounts, not less than $26,839,000 for fiscal year 2014 is authorized to be appropriated for the Bureau of Democracy, Human Rights and Labor.</text></subparagraph><subparagraph id="H9BF07779F09A4778AED37ED7D6A5A9DD"><enum>(B)</enum><header>Worldwide security protection</header><text>Of such amounts, not less than $2,182,135,000 for fiscal year 2014 is authorized to be appropriated for worldwide security protection.</text></subparagraph></paragraph><paragraph id="H25A167DFB81C4A439A057C6E7C6F943C"><enum>(2)</enum><header>Capital investment fund</header><text>For <quote>Capital Investment Fund</quote>, $76,900,000 for fiscal year 2014.</text></paragraph><paragraph id="HC7867D39E0994183803DEA89C64A8F88"><enum>(3)</enum><header>Educational and cultural exchange programs</header><text display-inline="yes-display-inline">For <quote>Educational and Cultural Exchange Programs</quote>, $535,000,000 for fiscal year 2014, of which funding for educational and cultural programs that occur in countries or regions that are at risk of, in, or are in transition from, conflict or civil strife should be prioritized.</text></paragraph><paragraph id="H0AC6888EB60E46D1A13A65258EEED75F"><enum>(4)</enum><header>Conflict stabilization operations</header><subparagraph id="HD8E01E0203064479A00192DFEA59A20E"><enum>(A)</enum><header>In general</header><text>For <quote>Conflict Stabilization Operations</quote>, $45,207,000 for fiscal year 2014.</text></subparagraph><subparagraph id="HE6DB7279F29B49628034614BE8A1860A"><enum>(B)</enum><header>Transfer</header><text>Subject to subparagraph (C) of this paragraph, of the amount authorized to be appropriated pursuant to paragraph (1), up to $35,000,000 is authorized to be transferred to, and merged with, the amount specified in subparagraph (A) of this paragraph.</text></subparagraph><subparagraph id="H179FD319D8434445938B9C437E96B564"><enum>(C)</enum><header>Notification</header><text>If the Secretary of State exercises the transfer authority described in subparagraph (B), the Secretary shall notwithstanding section 209(a)(1) of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3929">22 U.S.C. 3929(a)(1)</external-xref>) as such section relates to the inspection of the administration of activities and operations of each Foreign Service post.</text></paragraph><paragraph id="H5DC05B042BE94CD996FE24FC2D196126"><enum>(11)</enum><header>International chancery center</header><text>For <quote>International Chancery Center (ICC)</quote>, $5,450,000 for fiscal year 2014.</text></paragraph><paragraph id="H2DCF132B6B2F4E9586A47342D2BA95C9"><enum>(12)</enum><header>Embassy security, construction and maintenance</header><text>For <quote>Embassy Security, Construction and Maintenance</quote>, $2,649,351,000 for fiscal year 2014.</text></paragraph></section><section id="H520E72F6441F4ED0BE9634B65AF4791F"><enum>102.</enum><header>Contributions to international organizations</header><text display-inline="no-display-inline">There are authorized to be appropriated for <quote>Contributions to International Organizations</quote>, $1,400,000,000 for fiscal year 2014, for the Department of State to carry out the authorities, functions, duties, and responsibilities in the conduct of the foreign affairs of the United States with respect to international organizations and to carry out other authorities in law consistent with such purposes. The Secretary shall notify the appropriate congressional committees not less than fifteen days prior to obligating funds authorized under this section to implement or establish any principle commission or organization required by a treaty that has not been ratified by the Senate.</text></section><section id="HAB936A2D5BDA4AD1B30F7E675102138B"><enum>103.</enum><header>Contributions for international peacekeeping activities</header><text display-inline="no-display-inline">There are authorized to be appropriated for <quote>Contributions for International Peacekeeping Activities</quote>, $1,942,000,000 for fiscal year 2014 for the Department of State to carry out the authorities, functions, duties, and responsibilities of the United States with respect to international peacekeeping activities and to carry out other authorities in law consistent with such purposes, except that such amounts may not be used to support any United Nations Unmanned Aerial Systems (drone) activities or missions operating in United States airspace, including United States territories and possessions. Notwithstanding any other provision of law, funds authorized to be appropriated under this section are authorized to remain available until September 30, 2015.</text></section><section id="HF9C591C3BA454530A96D7AE951749EBD"><enum>104.</enum><header>International commissions</header><text display-inline="no-display-inline">The following amounts are authorized to be appropriated under <quote>International Commissions</quote> for the Department of State to carry out the authorities, functions, duties, and responsibilities in the conduct of the foreign affairs of the United States and for other purposes authorized by law:</text><paragraph id="H15B6CB8504DC4D25A0737C02673617D3"><enum>(1)</enum><header>International boundary and water commission, United States and Mexico</header><text>For <quote>International Boundary and Water Commission, United States and Mexico</quote>—</text><subparagraph id="H97F4EF8F1609487C85CB14B027600A7A"><enum>(A)</enum><text>for <quote>Salaries and Expenses</quote>, $44,722,000 for fiscal year 2014; and</text></subparagraph><subparagraph id="HB33EABF3BDC5400CBE1D786770C96230"><enum>(B)</enum><text>for <quote>Construction</quote>, $31,400,000 for fiscal year 2014.</text></subparagraph></paragraph><paragraph id="H93B2672F37934608B1D4FEE348A414E1"><enum>(2)</enum><header>International boundary commission, United States and Canada</header><text>For <quote>International Boundary Commission, United States and Canada</quote>, $2,449,000 for fiscal year 2014.</text></paragraph><paragraph id="HE92D17846EE84316B44E756CACE00D59"><enum>(3)</enum><header>International joint commission</header><text>For <quote>International Joint Commission</quote>, $7,012,000 for fiscal year 2014.</text></paragraph><paragraph id="H9C94C71F4E4A4B879B06F3E70F35ADAA"><enum>(4)</enum><header>International fisheries commissions</header><text>For <quote>International Fisheries Commissions</quote>, $31,445,000 for fiscal year 2014.</text></paragraph><paragraph id="HC75F6A7128C047E59B2655FB17FC406F"><enum>(5)</enum><header>Border environment cooperation commission</header><text>For <quote>Border Environment Cooperation Commission</quote>, $2,386,000 for fiscal year 2014.</text></paragraph></section><section id="H654E3EE8071A48D09804358B50F8C569"><enum>105.</enum><header>National Endowment for Democracy</header><text display-inline="no-display-inline">There are authorized to be appropriated for the <quote>National Endowment for Democracy</quote> for authorized activities $117,764,000 for fiscal year 2014.</text></section><section id="HF0EE9E148EC24CE5868409CF500C28EF"><enum>106.</enum><header>Prohibition on use of funds relating to Federal Acquisition Regulation</header><text display-inline="no-display-inline">No funds under this Act are authorized to be appropriated to enter into a contract with any offeror or any of its principals if the offeror certifies, pursuant to the Federal Acquisition Regulation, that the offeror or any of its principals—</text><paragraph id="HC72B7B1A2B9C434689B169EA7CACA694"><enum>(1)</enum><text>within a three-year period preceding this offer has been convicted of or had a civil judgment rendered against it for commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property; or</text></paragraph><paragraph id="H7981B1A9339F49499F617F88A266D0BE"><enum>(2)</enum><text>are presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (1); or</text></paragraph><paragraph id="HB867B13F417647C29417CB066D08AE51"><enum>(3)</enum><text>within a three-year period preceding this offer, has been notified of any delinquent Federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied.</text></paragraph></section><section display-inline="no-display-inline" id="H563A0D05C1D947BAA1074DF9989C8AC7" section-type="subsequent-section"><enum>107.</enum><header>Prohibition on use of funds relating to security and training facility</header><text display-inline="no-display-inline">No funds under this Act are authorized to be appropriated for any new Department of State security and training facility, including the proposed Foreign Affairs Security Training Center, for which there is not a completed, independent feasibility study that has been provided to the appropriate congressional committees, verifying that safety and security training for all Department personnel who require such training cannot reasonably be provided at the existing Federal Law Enforcement Training Facility.</text></section></title><title id="H26A7677C25EC4FD2A84728C2F1D6FEA6"><enum>II</enum><header>Department of State authorities and activities</header><subtitle id="H86E97860497141FB901591C1F1A2CC9A"><enum>A</enum><header>Basic Authorities and Activities</header><section id="H8FDB8D987E63495DB053328ED805EE9C"><enum>201.</enum><header>Foreign Service Act of 1980</header><text display-inline="no-display-inline">Section 501 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3981">22 U.S.C. 3981</external-xref>) is amended by inserting <quote>If a position designated under this section is unfilled for more than one single assignment cycle, such position shall be filled, as appropriate, on a temporary basis, in accordance with section 303 or 309.</quote> after <quote>Positions designated under this section are excepted from the competitive service.</quote>.</text></section><section id="HA2385A11C1A245B3AA2D5CB0AA2EAF49"><enum>202.</enum><header>Center for strategic counterterrorism communications of the Department of State</header><subsection id="H98AA6C279F10475981FA83166CABE33A"><enum>(a)</enum><header>Statement of policy</header><text>As articulated in Executive Order 13584, issued on September 9, 2011, it is the policy of the United States to actively counter the actions and ideologies of al-Qa’ida, its affiliates and adherents, other terrorist organizations, and violent extremists overseas that threaten the interests and national security of the United States.</text></subsection><subsection commented="no" id="HD7C011D252BE4E408ED3FDF2F100ED18"><enum>(b)</enum><header>Establishment of center for strategic counterterrorism communications</header><text>There is authorized to be established within the Department of State, under the direction of the Secretary of State, the Center for Strategic Counterterrorism Communications (in this section referred to as the <quote>CSCC</quote>).</text></subsection><subsection id="HD0CDC7F288C34ACF86A0F1376A001AE9"><enum>(c)</enum><header>Mission</header><text>The CSCC may coordinate, orient, and inform Government-wide public communications activities directed at audiences abroad and targeted against violent extremists and terrorist organizations, especially al-Qa’ida and its affiliates and adherents.</text></subsection><subsection id="HCBED8CED1A444039908AC7FE499ACFED"><enum>(d)</enum><header>Coordinator of the center for strategic counterterrorism communications</header><text>The head of the CSCC should be the Coordinator. The Coordinator of the CSCC should—</text><paragraph id="HC2E68F8DD340467F9369DDB26B106F72"><enum>(1)</enum><text>report to the Under Secretary for Public Diplomacy and Public Affairs; and</text></paragraph><paragraph id="HF40CEB9A2F5146CAADF6F16E3725C7C1"><enum>(2)</enum><text>collaborate with the Bureau of Counterterrorism of the Department of State, other Department bureaus, and other United States Government agencies.</text></paragraph></subsection><subsection id="H12F85938F179472BB6FDF3CABBBADBD6"><enum>(e)</enum><header>Duties</header><text>The CSCC may—</text><paragraph id="H0C2168275E734EB68458F0C89012B857"><enum>(1)</enum><text>monitor and evaluate extremist narratives and events abroad that are relevant to the development of a United States strategic counterterrorism narrative designed to counter violent extremism and terrorism that threaten the interests and national security of the United States;</text></paragraph><paragraph id="H8666970745EB4E30B725A78B9E338E57"><enum>(2)</enum><text>develop and promulgate for use throughout the executive branch the United States strategic counterterrorism narrative developed in accordance with paragraph (1), and public communications strategies to counter the messaging of violent extremists and terrorist organizations, especially al-Qa’ida and its affiliates and adherents;</text></paragraph><paragraph id="HD8AF865635A24D26870008B093A65792"><enum>(3)</enum><text>identify current and emerging trends in extremist communications and communications by al-Qa’ida and its affiliates and adherents in order to coordinate and provide guidance to the United States Government regarding how best to proactively promote the United States strategic counterterrorism narrative developed in accordance with paragraph (1) and related policies, and to respond to and rebut extremist messaging and narratives when communicating to audiences outside the United States;</text></paragraph><paragraph id="HD17CE87946194D939394A9757DF59F05"><enum>(4)</enum><text>facilitate the use of a wide range of communications technologies by sharing expertise and best practices among United States Government and non-Government sources;</text></paragraph><paragraph id="H09C7040BCB4A4B6F9C9F33C7663E2D63"><enum>(5)</enum><text>identify and request relevant information from United States Government agencies, including intelligence reporting, data, and analysis;</text></paragraph><paragraph id="HC495DFE9DFBC4AD584981140BED80DDD"><enum>(6)</enum><text>identify shortfalls in United States capabilities in any areas relevant to the CSCC’s mission, and recommend necessary enhancements or changes; and</text></paragraph><paragraph id="H35386DEA31754309BA3C96EB2B7F5381"><enum>(7)</enum><text display-inline="yes-display-inline">establish measurable goals, performance metrics, and monitoring and evaluation plans to focus on learning, accountability, and policymaking.</text></paragraph></subsection><subsection id="H1A993F216ADC4D60A2CD193CB8168F2F"><enum>(f)</enum><header>Steering committee</header><paragraph id="H77BF7D2CC27F4312B1DF2BAC254874F1"><enum>(1)</enum><header>In general</header><text>The Secretary of State may establish a Steering Committee composed of senior representatives of United States Government agencies relevant to the CSCC’s mission to provide advice to the Secretary on the operations and strategic orientation of the CSCC and to ensure adequate support for the CSCC.</text></paragraph><paragraph id="HE99E9184B5134A08AEA1F08FBA7DB32C"><enum>(2)</enum><header>Meetings</header><text>The Steering Committee should meet not less often than once every six months.</text></paragraph><paragraph id="H3BB2786F8D964484BB851BB8D08A7938"><enum>(3)</enum><header>Leadership</header><text>The Steering Committee should be chaired by the Under Secretary of State for Public Diplomacy. The Coordinator for Counterterrorism of the Department of State should serve as Vice Chair. The Coordinator of the CSCC should serve as Executive Secretary.</text></paragraph><paragraph id="H4F0D1F741D084A90AC2C05552C65A954"><enum>(4)</enum><header>Composition</header><subparagraph id="HF8E2BFC22D7E4B15B9519976CC416216"><enum>(A)</enum><header>In general</header><text>The Steering Committee may include one senior representative designated by the head of each of the following agencies:</text><clause id="HBA0196199C6547F1B474A1B2A9328591"><enum>(i)</enum><text>The Department of Defense.</text></clause><clause id="HB5FA8FD8E493410AA5EF04FCD40CA71D"><enum>(ii)</enum><text>The display-inline="no-display-inline">The Secretary of State is authorized to provide for the participation by the United States in the Information Sharing Centre located in Singapore, as established by the Regional Cooperation Agreement on Combating Piracy and Armed Robbery against Ships in Asia (ReCAAP).</text></section></subtitle><subtitle id="H092F177F2B584599A2AFE8D501C3C446"><enum>B</enum><header>Consular Services and Related Matters</header><section id="HBA12257C01904360B2750CE626709105"><enum>211.</enum><header>Extension of authority to assess passport surcharge</header><text display-inline="no-display-inline">Paragraph (2) of section 1(b) of the Act of June 4, 1920 (41 Stat. 750; chapter 223; <external-xref legal-doc="usc" parsable-cite="usc/22/214">22 U.S.C. 214(b)</external-xref>), is amended by striking <quote>2010</quote> and inserting <quote>2016</quote>.</text></section><section id="H0E8CC4BE5EC943C3A9B1C08404FAB532"><enum>(1)</enum><text>limit to one year or such period of time as the Secretary of State shall determine appropriate the period of validity of a passport issued to a sex offender; and</text></paragraph><paragraph id="H3BAE9A65FAB04AB98B661FDAB28C901E"><enum>(2)</enum><text>revoke the passport or passport card of an individual who has been convicted by a court of competent jurisdiction in a foreign country of a sex offense.</text></paragraph></subsection><subsection id="HB0EE30DE5435498F98581431253B6FC9"><enum>(b)</enum><header>Limitation for return to United States</header><text>Notwithstanding subsection (a), in no case shall a United States citizen convicted by a court of competent jurisdiction in a foreign country of a sex offense be precluded from entering the United States due to a passport revocation under such subsection.</text></subsection><subsection id="HFEE4852A5E2348EA881A13E1DBE4C1E0"><enum>(c)</enum><header>Reapplication</header><text>An individual whose passport or passport card was revoked pursuant to subsection (a)(2) may reapply for a passport or passport card at any time after such individual has returned to the United States.</text></subsection><subsection id="H08C829E7C68340BE811C698C22452AB9"><enum>(d)</enum><header>Definitions</header><text>For purposes of this section:</text><paragraph id="H4B99DE749A41435B9A8BEBF2CDD79821"><enum>(1)</enum><header>Sex offender</header><text>The term <term>sex offender</term> means an individual who is listed on the National Sex Offender Registry thereafter, the Director of the Office of Management and Budget shall submit to Congress a report on all assessed and voluntary contributions, including in-kind, of the United States Government to the United Nations and its affiliated agencies and related bodies during the previous fiscal year.</text></paragraph><paragraph id="H563C636D2EA946C4A869725D5607DF6B"><enum>(2)</enum><header>Content</header><text>Each report required under subsection (a) shall include the following elements:</text><subparagraph id="H0AA6F8E83F314C5A857C831F7A74777A"><enum>(A)</enum><text>The total amount of all assessed and voluntary contributions, including in-kind, of the United States Government to the United Nations and its affiliated agencies and related bodies during the previous fiscal year.</text></subparagraph><subparagraph id="HEF5592BD18BE4E16962DD51FD62D2F6A"><enum>(B)</enum><text>The approximate percentage of United States Government contributions to each United Nations affiliated agency or related body in such fiscal year when compared with all contributions to each such agency or body from any source in such fiscal year.</text></subparagraph><subparagraph id="HA0C8CD1CFFDC42E08164D58FE2EDB74C"><enum>(C)</enum><text>For each such United States Government contribution—</text><clause id="HB8EB65D0B7F442AFA2A0D870A47FD9ED"><enum>(i)</enum><text>the amount of the contribution;</text></clause><clause id="HEF27D31DA06546CDB8607CCB64B7D5F6"><enum>(ii)</enum><text>a description of the contribution (including whether assessed or voluntary);</text></clause><clause id="HEFA271886A0B477A9C99505523516517"><enum>(iii)</enum><text>the department or agency of the United States Government responsible for the contribution;</text></clause><clause id="H25F4277C726148CDB2D00E5DAC98FD23"><enum>(iv)</enum><text>the purpose of the contribution; and</text></clause><clause id="HBDF2743F186C42108E29BB21A229894B"><enum>(v)</enum><text>the United Nations or its affiliated agency or related body receiving the contribution.</text></clause></subparagraph></paragraph><paragraph id="HB8A3C653FA1F4F98B692A409DC91F6D2"><enum>(3)</enum><header>Scope of initial report</header><text>The first report required under this subsection shall include the information required under this section for the previous three fiscal years.</text></paragraph><paragraph id="H7557B1E7027D45869354C040BB49A5D5"><enum>(4)</enum><header>Public availability of information</header><text>Not later than 14 days after submitting a report under this subsection, the Director of the Office of Management and Budget shall post a public version of such report on a text-based, searchable, and publicly available Internet Web site.</text></paragraph></subsection></section></subtitle></title><title id="H66EF3B557A0B4339A3BE3A5D29EA6E91"><enum>III</enum><header>Organization and personnel authorities</header><section id="HF692E643FEA64F13A3B885A25EF46ACB"><enum>301.</enum><header>Suspension of foreign service members without pay</header><subsection id="H445C9BC797D040918A780477883B7C61"><enum>(a)</enum><header>Suspension</header><text>Section 610 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4010">22 U.S.C. 4010</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block id="H20CA8E94617449E49B92D8BAB1DB5D36" style="OLC"><subsection id="HBF06691CC7E0448DA123C322E6D0192D"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H8EC2F32352FA490382017C0DEC11DC7D"><enum>(1)</enum><text>In order to promote the efficiency of the Service, the Secretary may suspend a member of the Foreign Service without pay when the member’s security clearance is suspended or when there is reasonable cause to believe that the member has committed a crime for which a sentence of imprisonment may be imposed.</text></paragraph><paragraph display-inline="no-display-inline" id="H538FBA42102F46459D30D2D609AC944F" indent="up1"><enum>(2)</enum><text>Any member of the Foreign Service for whom a suspension is proposed in accordance with paragraph (1) shall be entitled to—</text><subparagraph id="HAD96B4144EED497BACD208D8B138DBBA"><enum>(A)</enum><text>written notice stating the specific reasons for the proposed suspension;</text></subparagraph><subparagraph id="HAF0F4C96ECEB4483BCFAE9E33AAB1FC9"><enum>(B)</enum><text display-inline="yes-display-inline">a period of not less than 30 days after receipt of any notice under subparagraph (A) to respond orally and in writing to the proposed suspension, which period may be extended upon a showing of good cause;</text></subparagraph><subparagraph id="HF6BB637C51E74FB88B081197C35F045B"><enum>(C)</enum><text>representation by an attorney or other representative; and</text></subparagraph><subparagraph id="HFA8D734808E84A36BD8A2E4D746C3813"><enum>(D)</enum><text>a final written decision, including the specific reasons for such decision, as soon as practicable.</text></subparagraph></paragraph><paragraph id="HBF7DF3BBED3F4EA7B53850B7D89591A1" indent="up1"><enum>(3)</enum><text>Any member suspended under this section may file a grievance in accordance with the procedures applicable to grievances under chapter 11.</text></paragraph><paragraph id="HA0AF3EE3F5844FC197DF08F7D51B86C8" indent="up1"><enum>(4)</enum><text>In the case of a grievance filed under paragraph (3)—</text><subparagraph id="H322249F1BE3C4577B8F0ADEEA87C1109"><enum>(A)</enum><text>the review by the Foreign Service Grievance Board shall be limited to a determination of whether the provisions of paragraphs (1) and (2) have been fulfilled; and</text></subparagraph><subparagraph id="H546C51E8B8764F8B96BF13CDB367E876"><enum>(B)</enum><text>the Foreign Service Grievance Board may not exercise the authority provided under section 1106(8).</text></subparagraph></paragraph><paragraph id="H2FBDF71796124A58982109EA35614840" indent="up1"><enum>(5)</enum><text>In this subsection:</text><subparagraph id="HD3A893B7537D45E781ED202CBDD4D475"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>reasonable cause to believe a member has committed a crime</term> means the member has been indicted by a grand jury.</text></subparagraph><subparagraph id="H9CF4968C36C248DF8BC13459278B7E34"><enum>(B)</enum><text>The term <term>suspend</term> or <term>suspension</term> means the placing of a member of the Foreign Service in a temporary status without duties and pay.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H85F6717CA6F6486BACAD8EEC628DFC30"><enum>(b)</enum><header>Conforming and clerical amendments</header><paragraph id="HDF85B9A8FEEC440AB45F664C0D8FBC48"><enum>(1)</enum><header>Amendment of section heading</header><text>Section 610 of the Foreign Service Act of 1980, as amended by subsection (a) of this section, is further amended, in the section heading, by inserting <quote>; <header-in-text level="subsection" style="traditional">Suspension</header-in-text></quote> before the period at the end.</text></paragraph><paragraph id="H41045C64760046868605FE5B4BD64355"><enum>(2)</enum><header>Clerical amendment</header><text>The item relating to section 610 in the table of contents in section 2 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3949">22 U.S.C. 3949</external-xref>) is amended—</text><paragraph id="H159F161B1C084865ABAD9A9F52A496E6"><enum>(1)</enum><text>in subsection (a), by striking <quote>subsection (b)</quote> and inserting <quote>subsection (b) or (c)</quote>;</text></paragraph><paragraph id="H366CE5CC2CA04404908032D901AFEAF2"><enum>(2)</enum><text>in and</text></subparagraph><subparagraph id="HAAF2B44A674C4D6084FF394DD7AB4E38"><enum>(D)</enum><text>by adding after paragraph (5) the following new paragraph:</text><quoted-block id="H51E8CA2CF6D8466DAA71AF30E6D0C66A" style="OLC"><paragraph id="HBA25FE0FFFAE4BC5BE415B6806DD2E90" indent="up1"><enum>(6)</enum><text>in exceptional circumstances where the Secretary determines the needs of the Service require the extension of a limited appointment, (A), for a period of time not to exceed 12 months (if such period of time does not permit additional review by boards under section 306), or (B), for the minimum time needed to settle a grievance, claim, or complaint not otherwise provided for in this section.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H6B9A2E215F2543CDA7BABA5910EFB793"><enum>(3)</enum><text>by adding at the end the following new subsection:</text><quoted-block id="H00059423B3A34942A533CC861BE19780" style="OLC"><subsection id="H41520613F82E4F788C7A1079D1DC0C02"><enum>(c)</enum><text>Non-career Foreign Service employees who have served five consecutive years under a limited appointment may be reappointed to a subsequent limited appointment if there is a one year break in service between each such appointment. The Secretary may in cases of special need waive the requirement for a one year break in service.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H0F64049E748F40D9863D67FA74E2B473"><enum>304.</enum><header>Limitation of compensatory time off for travel</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/5550b">Section 5550b</external-xref> of title 5, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block id="H05704C116B0642AAA1A940F51B0327BA" style="OLC"><subsection id="HD2DD0D0900EC466FBBA0996B97842ED5"><enum>(c)</enum><text>The maximum amount of compensatory time off earned under this section may not exceed 104 hours during any leave year (as defined by regulations established by the Office of Personnel Management).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H4CD4F2F936A64AFE918DEE59420FD6B7"><enum>305.</enum><header>Department of State organization</header><text display-inline="no-display-inline">The Secretary of State may, after consultation with the appropriate congressional committees, transfer to such other officials or offices of the Department of State as the Secretary may determine from time to time any authority, duty, or function assigned by statute to the Coordinator for Counterterrorism, the Coordinator for Reconstruction and Stabilization, or the Coordinator for International Energy Affairs.</text></section><section id="H1CBEAB1995384761A9817536216EB492"><enum>306.</enum><header>Overseas comparability pay limitation</header><subsection commented="no" id="H78F8B78A50D648A49ACEBAD15E78FDC2"><enum>(a)</enum><header>In general</header><text>Subject to the limitation described in subsection (b), the authority provided by section 1113 of the Supplemental Appropriations Act, 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/32">Public Law 111–32</external-xref>; 123 Stat. 1904), shall remain in effect through September 30, 2014.</text></subsection><subsection id="H65A794FFA92344E6BCA460D9B8C5D920"><enum>(b)</enum><header>Limitation</header><text>The authority described in subsection (a) may not be used to pay an eligible member of the Foreign Service (as defined in section 1113(b) of the Supplemental Appropriations Act, 2009) a locality-based comparability payment (stated as a percentage) that exceeds two-thirds of the amount of the locality-based comparability payment (stated as a percentage) that would be payable to such member under <external-xref legal-doc="usc" parsable-cite="usc/5/5304">section 5304</external-xref> of title 5, United States Code, if such member’s official duty station were in the District of Columbia.</text></subsection></section></title><title id="HFC6F2F900764440EBBA53F03C5B9EBD1"><enum>IV</enum><header>Embassy Security and Personnel Protection</header><subtitle id="H48768940A32A42DC9358D75498AFDDEC"><enum>A</enum><header>Review and Planning Requirements</header><section id="HFE0F464E92834A0E90CFFB0FB49F2CAA"><enum>411.</enum><header>Designation of high risk, high threat posts and working groups</header><subsection id="H8AC69ABDD218404E82391C408D5A3247"><enum>(a)</enum><header>In general</header><text>Title I of the Omnibus Diplomatic Security and Antiterrorism Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/22/4801">22 U.S.C. 4801 et seq.</external-xref>; relating to diplomatic security) is amended by inserting after section 103 the following new sections:</text><quoted-block id="H032A0B7099084C60995A19573E6AA64B" style="OLC"><section id="H50EAE61E315240C59B4A914620BF63BA"><enum>104.</enum><header>Designation of high risk, high threat posts</header><subsection id="H841F1D48458B478299D806137CF4541C"><enum>(a)</enum><header>Initial designation</header><text>Not later than 30 days after the date of the enactment of this section, the Secretary shall submit to the appropriate congressional committees a report, in classified form, that contains an initial list of diplomatic and consular posts designated as high risk, high threat posts.</text></subsection><subsection id="H4A903DB73DD54BDE83B41406D3467807"><enum>(b)</enum><header>Designations before opening or reopening posts</header><text>Before opening or reopening a diplomatic or consular post, the Secretary shall determine if such post should be designated as a high risk, high threat post.</text></subsection><subsection id="HC9BA754EA3834F42A9F060C46930BC10"><enum>(c)</enum><header>Designating existing posts</header><text>The Secretary shall regularly review existing diplomatic and consular posts to determine if any such post should be designated as a high risk, high threat post if conditions at such post or the surrounding security environment require such a designation.</text></subsection><subsection id="HDD69EA01B5294ABBBD84D434D52FF72E"><enum>(d)</enum><header>Definitions</header><text>In this section and section 105:</text><paragraph id="H62FD316C61384F48A71F4BEDECC061CF"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate.</text></paragraph><paragraph id="HF5959D9F31094DDC9B02E3021D77F609"><enum>(2)</enum><header>High risk, high threat post</header><text>The term <term>high risk, high threat post</term> means a United States diplomatic or consular post, as determined by the Secretary, that, among other factors, is—</text><subparagraph id="HADA57B3BD2BF4A039464A2AC974481C8"><enum>(A)</enum><text>located in a country—</text><clause id="HD67099AF0B7F42FFBADB87C205719920"><enum>(i)</enum><text>with high to critical levels of political violence and terrorism; and</text></clause><clause id="H292F3699C955473198BEA65E01254398"><enum>(ii)</enum><text>the government of which lacks the ability or willingness to provide adequate security; and</text></clause></subparagraph><subparagraph id="HFC7237B2D24144758C84F1F9E0C51870"><enum>(B)</enum><text>with mission physical security platforms that fall below the Department of State’s established standards.</text></subparagraph></paragraph></subsection></section><section id="H344E8BF557434E80882B8C1881CAA550"><enum>105.</enum><header>Working groups for high risk, high threat posts</header><subsection id="HF91548EC08D741568437140DB84CEF40"><enum>(a)</enum><header>Establishment</header><text>Before opening or reopening a high risk, high threat post, the Secretary shall establish a working group that is responsible for the geographic area in which such post is to be opened or reopened.</text></subsection><subsection id="HC8C0BEE0FEA740C795455CDA1C59C7A8"><enum>(b)</enum><header>Duties</header><text>The duties of the working group established in accordance with subsection (a) shall include—</text><paragraph id="H3955FD19321945488F3F93361B8D4EFD"><enum>(1)</enum><text>evaluating the importance and appropriateness of the objectives of the proposed post to the national security of the United States, and the type and level of security threats such post could encounter;</text></paragraph><paragraph id="HFA7B036ADC154E718DB3B81A15BD1545"><enum>(2)</enum><text>completing working plans to expedite the approval and funding for establishing and operating such post, implementing physical security measures, providing necessary security and management personnel, and the provision of necessary equipment;</text></paragraph><paragraph id="HC39008FA0CFF4C9383AF9DBB10DF704F"><enum>(3)</enum><text>establishing security <quote>tripwires</quote> that would determine specific action, including enhanced security measures or evacuation of such post, based on the improvement or deterioration of the local security environment; and</text></paragraph><paragraph id="HE32D106B936741139DE15DAED3C763BB"><enum>(4)</enum><text>identifying and reporting any costs that may be associated with opening or reopening such post.</text></paragraph></subsection><subsection id="H64C3336E1D0F46C1A5C7AC8695F25759"><enum>(c)</enum><header>Composition</header><text>The working group should be composed of representatives of the—</text><paragraph id="H3CC87C3CABCE4C33AE46282A5E7C9991"><enum>(1)</enum><text>appropriate regional bureau;</text></paragraph><paragraph id="HFD757CA993BA474895E870284E15F141"><enum>(2)</enum><text>Bureau of Diplomatic Security;</text></paragraph><paragraph id="HACF422853A5447728724D6DFA3452585"><enum>(3)</enum><text>Bureau of Overseas Building Operations;</text></paragraph><paragraph id="HF2379B6A13444538A6BA4B76B6015CF6"><enum>(4)</enum><text>Bureau of Intelligence and Research; and</text></paragraph><paragraph id="H112EB7CB9DDD47C4882CE5DE19B4D817"><enum>(5)</enum><text>other bureaus or offices as determined by the Secretary.</text></paragraph></subsection><subsection id="H3A8E0ECAAB0D4B46BF9AC305394CDD12"><enum>(d)</enum><header>Congressional notification</header><text>Not less than 30 days before opening or reopening a high risk, high threat post, the Secretary shall notify the appropriate congressional committees in classified form of—</text><paragraph id="H282BA5E6AE5147C89668F888358C35A1"><enum>(1)</enum><text>the decision to open or reopen such post; and</text></paragraph><paragraph id="H21DB7BFA155D45E8A2A316C61E1BE92B"><enum>(2)</enum><text>the results of the working group under subsection (b).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H607ED88A3AC4438A9A35035DFA2DAB13"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents of the Omnibus Diplomatic Security and Antiterrorism Act of 1986 is amended by inserting after the item relating to section 103 the following new items:</text><quoted-block id="HABDC5665FBBB4D1C8855E5C27BDFFBE0" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 104. Designation of high risk, high threat posts.</toc-entry><toc-entry level="section">Sec. 105. Working groups for high risk, high threat posts.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H17DA95E7E255422D8324FE54B4D6D3F2"><enum>412.</enum><header>Contingency plans for high risk, high threat posts</header><text display-inline="no-display-inline">Section 606(a) of the Secure Embassy Construction and Counterterrorism Act of 1999 (<external-xref legal-doc="usc" parsable-cite="usc/22/4865">22 U.S.C. 4865(a)</external-xref>; relating to diplomatic security) is amended—</text><paragraph id="HCC3C3B1FA67B4F229FC82BBAE847EE92"><enum>(1)</enum><text>in paragraph (1)(A)—</text><subparagraph id="H24EE08D77A47437AA5F6F5518126020E"><enum>(A)</enum><text>by inserting <quote>and from complex attacks (as such term is defined in section 416 of the Omnibus Diplomatic Security and Antiterrorism Act of 1986),</quote> after <quote>attacks from vehicles</quote>; and</text></subparagraph><subparagraph id="HED46F8825FD84C52BADFAFD11C1667D5"><enum>(B)</enum><text>by inserting <quote>or such a complex attack</quote> before the period at the end;</text></subparagraph></paragraph><paragraph id="H93DB8904FB3E4ADABBC38ED8CA9A1F18"><enum>(2)</enum><text>in paragraph (7), by inserting before the period at the end the following: <quote>, including at high risk, high threat posts (as such term is defined in section 104 of the Omnibus Diplomatic Security and Antiterrorism Act of 1986), including options for the deployment of additional military personnel or equipment to bolster security and rapid deployment of armed or surveillance assets in response to an attack</quote>.</text></paragraph></section><section id="H2BE004B47E904A7DB7A55C9F4478EB41"><enum>413.</enum><header>Strategic review of Bureau of Diplomatic Security</header><subsection id="H15C5391FD74C421A8008EA99757CD426"><enum>(a)</enum><header>In general</header><text>The Secretary of State shall complete a strategic review of the Bureau of Diplomatic Security of the Department of State to ensure that the mission and activities of the Bureau are fulfilling the current and projected needs of the Department of State.</text></subsection><subsection id="HB19877D3A39D4A9C8B1FB589608554B7"><enum>(b)</enum><header>Contents of review</header><text>The strategic review described in subsection (a) shall include assessments of—</text><paragraph id="H524A4EB4B03940F498AA230607CAD110"><enum>(1)</enum><text>staffing needs for both domestic and international operations;</text></paragraph><paragraph id="H526F3BB1B6214B8B96478A6CA7972216"><enum>(2)</enum><text>facilities under chief of mission authority adhering to security standards;</text></paragraph><paragraph id="H14D4508CA0C348759235A763B6F527E2"><enum>(3)</enum><text>security personnel with the necessary language skills for assignment to overseas posts;</text></paragraph><paragraph id="H1C4868304E5D465BA04DA448C098991B"><enum>(4)</enum><text>programs being carried out by personnel with the necessary experience and at commensurate grade levels;</text></paragraph><paragraph id="H93AFA1CD2BC841EE84BDF69481CF6A17"><enum>(5)</enum><text>necessary security training provided to personnel under chief of mission authority for expected assignments and objectives;</text></paragraph><paragraph id="HAF583C80A99A4E26AAC5EA57683899B3"><enum>(6)</enum><text>balancing security needs with an ability to carry out the diplomatic mission of the Department of State;</text></paragraph><paragraph id="H9CE787D33E6848B0B0A2A8ADD24FF11D"><enum>(7)</enum><text>the budgetary implications of balancing multiple missions; and</text></paragraph><paragraph id="HCB16A33AAC7F40EA86E591F79EF4179A"><enum>(8)</enum><text>how to resolve any identified deficiencies in the mission or activities of the Bureau.</text></paragraph></subsection></section><section display-inline="no-display-inline" id="H704E0B1947BD452F829FA6D60D5E34E0" section-type="subsequent-section"><enum>414.</enum><header>Revision of provisions relating to personnel recommendations of Accountability Review Board</header><subsection id="H90ADCE63817F4692ACDD8701502DEEB5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 304(c) of the Diplomatic Security Act (<external-xref legal-doc="usc" parsable-cite="usc/22/4834">22 U.S.C. 4834(c)</external-xref>) is amended—</text><paragraph id="HA45EF4BE054D4DDD924E71B53D286FC1"><enum>(1)</enum><text>in the matter preceding paragraph (1)—</text><subparagraph id="H82AE47937A4844BEA6F3A00DB7DA4284"><enum>(A)</enum><text>by striking <quote>Whenever</quote> and inserting <quote>If</quote>; and</text></subparagraph><subparagraph id="H7301497B553A406488FBB7151AEEEFDC"><enum>(B)</enum><text>by striking <quote>has breached the duty of that individual</quote> and inserting <quote>has engaged in misconduct or unsatisfactorily performed the duties of employment of that individual, and such misconduct or unsatisfactory performance has significantly contributed to the serious injury, loss of life, or significant destruction of property, or the serious breach of security that is the subject of the Board’s examination as described in subsection (a)</quote>;</text></subparagraph></paragraph><paragraph id="H95006448DA624C268C285314FA770C37"><enum>(2)</enum><text>in paragraph (2), by striking <quote>finding</quote> each place it appears and inserting <quote>findings</quote>; and</text></paragraph><paragraph id="HBADE9441B1854AE684B15878657277AC"><enum>(3)</enum><text>in the matter following paragraph (3)—</text><subparagraph id="H234ECA47BAF84EC0B0D7750053A57F20"><enum>(A)</enum><text>by striking <quote>has breached a duty of that individual</quote> and inserting <quote>has engaged in misconduct or unsatisfactorily performed the duties of employment of that individual</quote>; and</text></subparagraph><subparagraph id="HCAAADAAFD22B4594A39137A972E0A6A7"><enum>(B)</enum><text>by striking <quote>to the performance of the duties of that individual</quote>.</text></subparagraph></paragraph></subsection><subsection id="HFAFB334EB4EC43DBAEF187195C996954"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply with respect to any case of an Accountability Review Board that is convened under section 301 of the Diplomatic Security Act (<external-xref legal-doc="usc" parsable-cite="usc/22/4831">22 U.S.C. 4831</external-xref>) on or after the date of the enactment of this Act.</text></subsection></section></subtitle><subtitle id="HB191F08A407E4E92B2BD7FB2E2438EE4"><enum>B</enum><header>Physical Security and Personnel Requirements</header><section id="HD4305B2FA86A46638D5FF1B19250B9C1"><enum>421.</enum><header>Capital security cost sharing program</header><subsection id="H163B0C2A6A50460DBF039EC8C58A4354"><enum>(a)</enum><header>Sense of congress on the capital security cost sharing program</header><text>It is the sense of Congress that the Capital Security Cost Sharing Program should prioritize the construction of new facilities and the maintenance of existing facilities at high risk, high threat posts.</text></subsection><subsection id="HE614C1DC04044390BF21C9C4E2962F76"><enum>(b)</enum><header>Restriction on construction of office space</header><text>Section 604(e)(2) of the Secure Embassy Construction and Counterterrorism Act of 1999 (title VI of division A of H.R. 3427, as enacted into law by section 1000(a)(7) of <external-xref legal-doc="public-law" parsable-cite="pl/106/113">Public Law 106–113</external-xref>; 113 Stat. 1501A–453; <external-xref legal-doc="usc" parsable-cite="usc/22/4865">22 U.S.C. 4865</external-xref> note) is amended by adding at the end the following new sentence: <quote>A project to construct a diplomatic facility of the United States may not include office space or other accommodations for an employee of a Federal department or agency if the Secretary of State determines that such department or agency has not provided to the Department of State the full amount of funding required by paragraph (1), except that such project may include office space or other accommodations for members of the United States Marine Corps.</quote>.</text></subsection></section><section id="H85D2D4C177F44E80B84C254EF91777D4"><enum>422.</enum><header>Local guard contracts abroad under diplomatic security program</header><subsection id="HACEF534AEB5443BDB3B066F624E30B39"><enum>(a)</enum><header>In general</header><text>Section 136 of the Foreign Relations Authorization Act, Fiscal Years 1990 and 1991 (<external-xref legal-doc="usc" parsable-cite="usc/22/4864">22 U.S.C. 4864</external-xref>) is amended—</text><paragraph id="H5C1E5A4189E841758D9B577AF1E06718"><enum>(1)</enum><text>in subsection (c)—</text><subparagraph id="HD5AD846E3E44463E98901E982BD76FEA"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>With respect</quote> and inserting <quote>Except as provided in subsection (d), with respect</quote>; and</text></subparagraph><subparagraph id="HE8DABBFB3F6D48A2A768C85B2B9E1E28"><enum>(B)</enum><text>in paragraph (3), by striking <quote>subsection (d)</quote> and inserting <quote>subsection (e)</quote>;</text></subparagraph></paragraph><paragraph id="H10D044DB02A545CC862F9693179913BB"><enum>(2)</enum><text>by redesignating subsections (d), (e), (f), and (g) as subsections (e), (f), (g), and (h), respectively; and</text></paragraph><paragraph id="H230339E8640C49398E7A086EA99AC3BC"><enum>(3)</enum><text>by inserting after subsection (c) the following new subsection:</text><quoted-block id="HBB99A3551F674B1CA5994D83241FB3CF" style="OLC"><subsection id="H88A018E854A7477BA7102D080BD1ADD5"><enum>(d)</enum><header>Award of local guard and protective service contracts for high risk, high threat posts</header><text display-inline="yes-display-inline">With respect to any local guard contract for a high risk, high threat post (as such term is defined in section 104 of the Omnibus Diplomatic Security and Antiterrorism Act of 1986) that is entered into after the date of the enactment of this subsection, the Secretary of State—</text><paragraph id="HD1D2AFA998AC4F26A8588DF245CF6AAE"><enum>(1)</enum><text>shall comply with paragraphs (1), (2), (4), (5), and (6) of subsection (c) in the award of such contract;</text></paragraph><paragraph id="H4A7DCD31B92941DDAB062E157EDECAAD"><enum>(2)</enum><text>after evaluating proposals for such contract, may award such contract to the firm representing the best value to the Government in accordance with the best value tradeoff process described in subpart 15.1 of the Federal Acquisition Regulation (48 C.F.R. 6 15.101–1); and</text></paragraph><paragraph id="H1EFAC0E8BBD344DC873DE81DDC6B201A"><enum>(3)</enum><text>shall ensure that contractor personnel under such contract providing local guard or protective services are classified—</text><subparagraph id="HB984C877CB6C44AF94FBE60380973E1B"><enum>(A)</enum><text>as employees of the contractor;</text></subparagraph><subparagraph id="H58CA845375794F5E835680070F107F85"><enum>(B)</enum><text>if the contractor is a joint venture, as employees of one of the persons or parties constituting the joint venture; or</text></subparagraph><subparagraph id="HA8C893A4BED14F249B9B212C4693A6C2"><enum>(C)</enum><text>as employees of a subcontractor to the contractor, and not as independent contractors to the contractor or any other entity performing under such contracts.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H87F86DD27EE14908846BE16F6E33866D"><enum>(b)</enum><header>Report</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of State shall submit to the appropriate congressional committees a report that includes—</text><paragraph id="H4B1E1EE0589C451FA42402F94E94D0E7"><enum>(1)</enum><text>an explanation of the implementation of subsection (d) of section 136 of the Foreign Relations Authorization Act, Fiscal Years 1990 and 1991, as amended by subsection (a)(3) of this section; and</text></paragraph><paragraph commented="no" id="H752AAB92C7B743508224372F2ADFFA09"><enum>(2)</enum><text>for each instance in which an award is made pursuant to such subsection (d) of such section 136, a written justification providing the basis for such award and an explanation of the inability to satisfy the needs of the Department of State by technically acceptable, lowest price evaluation award.</text></paragraph></subsection></section><section id="H68029622B5C14CA6AF0F72DFF33E7002"><enum>423.</enum><header>Transfer authority</header><text display-inline="no-display-inline">Section 4 of the Foreign Service Buildings Act, 1926 (<external-xref legal-doc="usc" parsable-cite="usc/22/295">22 U.S.C. 295</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block id="HE0F63BE7ED464624AFDBBE9C69F70FA4" style="OLC"><subsection id="HCF71B725CEFA46D4B6BEDACB9F2E912B"><enum>(j)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HEA39B118C6A441759B8BFCB5A9E9C522"><enum>(1)</enum><text>In addition to exercising any other transfer authority available to the Secretary of State, and subject to paragraphs (2) and (3), the Secretary may transfer to, and merge with, any appropriation for embassy security, construction, and maintenance such amounts appropriated for fiscal year 2014 for any other purpose related to the administration of foreign affairs on or after October 1, 2013, if the Secretary determines such transfer is necessary to provide for the security of sites and buildings in foreign countries under the jurisdiction and control of the Secretary.</text></paragraph><paragraph id="HFEBD0F88AD0B4908AB1F0F6C2CBACBAB" indent="up1"><enum>(2)</enum><text>Any funds transferred pursuant to paragraph (1)—</text><subparagraph id="H0D79F860BEFA4D4B8275BD7EAC061A13"><enum>(A)</enum><text>shall not exceed 20 percent of any appropriation made available for fiscal year 2014 for the Department of State under the heading <quote>Administration of Foreign Affairs</quote>, and no such appropriation shall be increased by more than 10 percent by any such transfer; and</text></subparagraph><subparagraph id="HD366B97698284AD9AF6038BE128FCAA6"><enum>(B)</enum><text>shall be merged with funds in the heading to which transferred, and shall be available subject to the same terms and conditions as the funds with which merged.</text></subparagraph></paragraph><paragraph id="H8FB0150D2069495494387E9018090763" indent="up1"><enum>(3)</enum><text>Not later than 15 days before any transfer of funds pursuant to paragraph (1), the Secretary of State shall notify in writing the Committees on Foreign Relations and Appropriations of the Senate and the Committees on Foreign Affairs and Appropriations of the House of Representatives. Any such notification shall include a description of the particular security need necessitating the transfer at issue.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF08700D08E6D45DF9E409EBA6EAD2264"><enum>424.</enum><header>Security enhancements for soft targets</header><text display-inline="no-display-inline">Section 29 of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2701">22 U.S.C. 2701</external-xref>) is amended, in the third sentence, by inserting <quote>physical security enhancements and</quote> after <quote>may include</quote>.</text></section><section id="HBD09F49573EA48EFA8F0B83CAD68B75C"><enum>425.</enum><header>Reemployment of annuitants</header><text display-inline="no-display-inline">Section 824(g) of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4064">22 U.S.C. 4064(g)</external-xref>) is amended—</text><paragraph id="H472513355677442D94A8C0C8E364E726"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="HCC10AC97F1B147019D84FF447FB094A7"><enum>(A)</enum><text>in subparagraph (B)—</text><clause id="HE02DC67970F348C5B35BC0E9ADBB8C09"><enum>(i)</enum><text>by striking <quote>to facilitate the</quote> and all that follows through <quote>Afghanistan,</quote>; and</text></clause></subparagraph><subparagraph id="HABF4D62DD6C74CD7A464052DA73477D5"><enum>(B)</enum><text>by moving subparagraph (C) two ems to the left; and</text></subparagraph></paragraph><paragraph commented="no" id="H681BAAD2CC334E05A1E0AA43D61FD607"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph commented="no" id="H7C777CB4151F4DC6BB5BC849A782FA03"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>2010</quote> and inserting <quote>2018</quote>; and</text></subparagraph><subparagraph commented="no" id="HB566F41E9F364DE0B57AEB9FE656969E"><enum>(B)</enum><text>in subparagraphs (B) and (C), by striking <quote>2009</quote> and inserting <quote>2018</quote> each place it appears.</text></subparagraph></paragraph></section><section id="HE614788D00134FC8B2B1BA8186D39CB9"><enum>426.</enum><header>Sense of Congress regarding minimum security standards for temporary United States diplomatic and consular posts</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="H37024D95929D4CB0B4ED727D3AA74CA5"><enum>(1)</enum><text display-inline="yes-display-inline">the Overseas Security Policy Board’s security standards for United States diplomatic and consular posts should apply to all such posts regardless of the duration of their occupancy; and</text></paragraph><paragraph id="H851119E2B5B74140AF9D8E3E102EA7A0"><enum>(2)</enum><text display-inline="yes-display-inline">such posts should comply with requirements for attaining a waiver or exception to applicable standards if it is in the national interest of the United States as determined by the Secretary of State.</text></paragraph></section><section id="HA001DC55712E44DC8E3FF460692DB78B"><enum>427.</enum><header>Assignment of personnel at high risk, high threat posts</header><subsection id="H612E830FF356427DB89A9DE19D472A56"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State shall station key personnel for sustained periods of time at high risk, high threat posts (as such term is defined in section 104 of the Omnibus Diplomatic Security and Antiterrorism Act of 1986, as added by section 411 of this Act) in order to—</text><paragraph id="H288CCC4CD6614854A36CED114D3A7F97"><enum>(1)</enum><text>establish institutional knowledge and situational awareness that would allow for a fuller familiarization of the local political and security environment in which such posts are located; and</text></paragraph><paragraph id="HBEE53FC0D554498C8F2D7F8C1A155A67"><enum>(2)</enum><text>ensure that necessary security procedures are implemented.</text></paragraph></subsection><subsection id="H27789F37543D43D29FB5F4485662D394"><enum>(b)</enum><header>Quarterly briefings</header><text>The Secretary of State shall quarterly brief the appropriate congressional committees on the personnel staffing and rotation cycles at high risk, high threat posts.</text></subsection></section><section display-inline="no-display-inline" id="HF0860BBEA5E142EAA305696252FEDED9" section-type="subsequent-section"><enum>428.</enum><header>Bureau of Diplomatic Security mobile biometric enrollment program</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall brief the appropriate congressional committees regarding the mobile biometric enrollment program of the Bureau of Diplomatic Security that includes the following:</text><paragraph id="HDB7E1DB3FA8747AAB2610E5375E3E9C8"><enum>(1)</enum><text>An overview of the mobile biometric enrollment program and the Department of State’s use of biometric technologies to secure access to United States diplomatic and consular posts.</text></paragraph><paragraph id="H1362AA36F5FB43C3B5B30C46550F5851"><enum>(2)</enum><text>An assessment of the effectiveness and uses of such biometric technologies.</text></paragraph><paragraph id="HD09E92B1EDF441ED9CA0622321127A3A"><enum>(3)</enum><text display-inline="yes-display-inline">An assessment of the costs, benefits, and implementation time that would be involved in extending the mobile biometric enrollment program initially to all high risk, high threat posts (as such term is defined in section 104 of the Omnibus Diplomatic Security and Antiterrorism Act of 1986, as added by section 411 of this Act), and then to all remaining diplomatic and consular posts.</text></paragraph></section></subtitle><subtitle id="H0E748ED6892C4990BC817C40DF2076E3"><enum>C</enum><header>Security Training</header><section id="HC070435B33EA42908E9E3CFD5B6D5660"><enum>431.</enum><header>Security training for personnel assigned to high risk, high threat posts</header><subsection id="HDCC9AF35EBB64B23B79AF9B6EFCB22F8"><enum>(a)</enum><header>In general</header><text>Title IV of the Omnibus Diplomatic Security and Antiterrorism Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/22/4851">22 U.S.C. 4851 et seq.</external-xref>; relating to diplomatic security) is amended by adding at the end the following new sections:</text><quoted-block id="HC049E5061C194E14B90F90A396FED6B8" style="OLC"><section id="H4B00B88202A8401086265B9A91CA948B"><enum>416.</enum><header>Security training for personnel assigned to a high risk, high threat post</header><subsection id="HF03E3272BC4448CC9F49E695A3E9F391"><enum>(a)</enum><header>In general</header><text>Individuals assigned permanently to or who are in long-term temporary duty status as designated by the Secretary at a high risk, high threat post shall receive security training described in subsection (b) on a mandatory basis in order to prepare such individuals for living and working at such posts.</text></subsection><subsection id="HA71E70CAE3C44B228785853D220460DE"><enum>(b)</enum><header>Security training described</header><text>Security training referred to in subsection (a)—</text><paragraph id="HFBF4C5D7FAD84CEBBB4AD7E12C5AAD01"><enum>(1)</enum><text>is training to improve basic knowledge and skills; and</text></paragraph><paragraph id="HD778AA2BF9C14034BBA760A6A54E0B59"><enum>(2)</enum><text>may include—</text><subparagraph id="H37064B66888B4A86994419DEA634461A"><enum>(A)</enum><text>an ability to recognize, avoid, and respond to potential terrorist situations, including a complex attack;</text></subparagraph><subparagraph id="H69BE44D352CD4ED4A9D5D54E2AB3E525"><enum>(B)</enum><text>conducting surveillance detection;</text></subparagraph><subparagraph id="H319FA14EB0C64FDDAA272ABB63A2740A"><enum>(C)</enum><text>providing emergency medical care;</text></subparagraph><subparagraph id="H6F9FD87119474744807548AF0BE16A57"><enum>(D)</enum><text>ability to detect the presence of improvised explosive devices;</text></subparagraph><subparagraph id="H7319F7C8DDF84BDCB2CCCE0C8CF752DF"><enum>(E)</enum><text>minimal firearms familiarization; and</text></subparagraph><subparagraph id="HF3BD2535B6034821A3183C1BEF8F2DC7"><enum>(F)</enum><text>defensive driving maneuvers.</text></subparagraph></paragraph></subsection><subsection id="H347650899F7E4FBB9D04266B8558E59E"><enum>(c)</enum><header>Effective date</header><text>The requirements of this section shall take effect upon the date of the enactment of this section.</text></subsection><subsection id="HB822F9369949431A90B24B6D831DDDAA"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section and sections 417 and 418:</text><paragraph commented="no" id="H1DB76C608F904561988A3E1634D216DA"><enum>(1)</enum><header>Complex attack</header><text>The term <term>complex attack</term> has the meaning given such term by the North Atlantic Treaty Organization as follows: <quote>An attack conducted by multiple hostile elements which employ at least two distinct classes of weapon systems (i.e., indirect fire and direct fire, improvised explosive devices, and surface to air fire).</quote>.</text></paragraph><paragraph id="H90210ED652BB4E3F98D7E856B72878A5"><enum>(2)</enum><header>High risk, high threat post</header><text>The term <term>high risk, high threat post</term> has the meaning given such term in section 104.</text></paragraph></subsection></section><section id="HC1FFB189D8144FA2920CD3DA7C5900C5"><enum>417.</enum><header>Security management training for officials assigned to a high risk, high threat post</header><subsection id="HAE035E3E3FB64B138F142FC4E0FC74F3"><enum>(a)</enum><header>In general</header><text>Officials described in subsection (c) who are assigned to a high risk, high threat post shall receive security training described in subsection (b) on a mandatory basis in order to improve the ability of such officials to make security-related management decisions.</text></subsection><subsection id="HBA15D1CDCE28435D92A70A7B2D4E34A0"><enum>(b)</enum><header>Security training described</header><text>Security training referred to in subsection (a) may include—</text><paragraph id="HBA1999FF7C9F4075BE5DEC82161839F8"><enum>(1)</enum><text>development of skills to better evaluate threats;</text></paragraph><paragraph id="H7782A96319644BFFB546C1F1181623DC"><enum>(2)</enum><text>effective use of security resources to mitigate such threats; and</text></paragraph><paragraph id="H50DBB7B749EC49929452D2D67999DF2E"><enum>(3)</enum><text>improved familiarity of available security resources.</text></paragraph></subsection><subsection id="HC5B1844D11CF47889061D3EE65A8025A"><enum>(c)</enum><header>Officials described</header><text>Officials referred to in subsection (a) are—</text><paragraph id="HF7D3230C09F2495CB8BF36FE1CE5CA79"><enum>(1)</enum><text>members of the Senior Foreign Service appointed under section 302(a)(1) or 303 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3942">22 U.S.C. 3942(a)(1)</external-xref> and 3943) or members of the Senior Executive Service (as such term is described in <external-xref legal-doc="usc" parsable-cite="usc/5/3132">section 3132(a)(2)</external-xref> of title 5, United States Code);</text></paragraph><paragraph id="H1185840FCA20445B8CFA69BF9135D773"><enum>(2)</enum><text>Foreign Service officers appointed under section 302(a)(1) of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3942">22 U.S.C. 3942(a)(1)</external-xref>) holding a position in classes FS–1, FS–2, or FS–3;</text></paragraph><paragraph id="HF0A22FC0C4B2481C8889D0F9D1A041A9"><enum>(3)</enum><text>Foreign Service Specialists appointed by the Secretary under section 303 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3943">22 U.S.C. 3943</external-xref>) holding a position in classes FS–1, FS–2, or FS–3; and</text></paragraph><paragraph id="HC009B198F9854AC1A80AFA8F5B39E662"><enum>(4)</enum><text>individuals holding a position in grades GS–13, GS–14, or GS–15.</text></paragraph></subsection><subsection id="H38CD361AA922469487FA9A22E5FAF757"><enum>(d)</enum><header>Effective date</header><text>The requirements of this section shall take effect beginning on the date that is one year after the date of the enactment of this section.</text></subsection></section><section id="H8A309CC1527044BEAD8DD3A2D87295FA"><enum>418.</enum><header>Language requirements for diplomatic security personnel assigned to high risk, high threat post</header><subsection id="H30281EFED8AF4F0AA359E6FD8E10381F"><enum>(a)</enum><header>In general</header><text>Diplomatic security personnel assigned permanently to or who are in long-term temporary duty status as designated by the Secretary at a high risk, high threat post should receive language training described in subsection (b) in order to prepare such personnel for duty requirements at such post.</text></subsection><subsection id="H19EC01044B5645BAA82D99A6B07EDEA2"><enum>(b)</enum><header>Language training described</header><text>Language training referred to in subsection (a) should prepare personnel described in such subsection to—</text><paragraph id="HE6DBF58258BD464BA5F01797D3FAB02C"><enum>(1)</enum><text>speak the language at issue with sufficient structural accuracy and vocabulary to participate effectively in most formal and informal conversations on subjects germane to security; and</text></paragraph><paragraph id="H06214D3DFF9A44F3B9738A5A7A5CBECB"><enum>(2)</enum><text>read within an adequate range of speed and with almost complete comprehension on subjects germane to security.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD0440B7D9FA24CF187069225C18FB554"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents of the Omnibus Diplomatic Security and Antiterrorism Act of 1986 is amended by inserting after the item relating to section 415 the following new items:</text><quoted-block id="HA8EE9347A52E41BD86C4D38FF7E9AD37" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 416. Security training for personnel assigned to a high risk, high threat post.</toc-entry><toc-entry level="section">Sec. 417. Language requirements for diplomatic security personnel assigned to high risk, high threat post.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H9AA39A6D18BB451E95EC0A86E5D71281"><enum>432.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 18 months after the date of the enactment of this Act, the Secretary of State shall submit to the appropriate congressional committees a report on the implementation of this subtitle.</text></section></subtitle><subtitle id="HD1744F156069482DA080367F3E988647"><enum>D</enum><header>Expansion of the Marine Corps Security Guard Detachment Program</header><section id="H24A4DF9C19FB47E8807AF0F110D25815"><enum>441.</enum><header>Marine Corps Security Guard Program</header><subsection id="H851E3E9CC0704E249FE2C591F771CEF4"><enum>(a)</enum><header>In general</header><text>Pursuant to the responsibility of the Secretary of State for diplomatic security under section 103 of the Diplomatic Security Act (<external-xref legal-doc="usc" parsable-cite="usc/22/4802">22 U.S.C. 4802</external-xref>; enacted as part of the Omnibus Diplomatic Security and Antiterrorism Act of 1986 (<external-xref legal-doc="public-law" parsable-cite="pl/99/399">Public Law 99–399</external-xref>)), the Secretary of State, in consultation with the Secretary of Defense, shall conduct an annual review of the Marine Corps Security Guard Program, including—</text><paragraph id="HEFFAB8200DBF437DA6FA8A02940CA0A3"><enum>(1)</enum><text>an evaluation of whether the size and composition of the Marine Corps Security Guard Program is adequate to meet global diplomatic security requirements;</text></paragraph><paragraph id="H58334FD23FF74FA4B8CC8B64881976E7"><enum>(2)</enum><text>an assessment of whether the Marine Corps security guards are appropriately deployed among United States embassies, consulates, and other diplomatic facilities to respond to evolving security developments and potential threats to United States interests abroad; and</text></paragraph><paragraph id="HEBAE73C384BF4D76B3D3E5656A1676FA"><enum>(3)</enum><text>an assessment of the mission objectives of the Marine Corps Security Guard Program and the procedural rules of engagement to protect diplomatic personnel under the Program.</text></paragraph></subsection><subsection id="H018393DE649443C5A2BB0682823E370D"><enum>(b)</enum><header>Reporting requirement</header><text>Not later than 180 days after the date of the enactment of this Act and annually thereafter for three years, the Secretary of State, in consultation with the Secretary of Defense, shall submit to the appropriate congressional committees an unclassified report, with a classified annex as necessary, that addresses the requirements specified in subsection (a).</text></subsection></section></subtitle></title></legis-body><attestation><attestation-group><attestation-date chamber="House" date="20130929" legis-day="20130928">Passed the House of Representatives September 29 (legislative day September 28), 2013.</attestation-date><attestor display="yes">Karen L.
