display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Communications Commission Consolidated Reporting Act of 2013</short-title></quote>.</text></section><section id="HA469530092C3483DA9A798A01BA7D12F" section-type="subsequent-section"><enum>2.</enum><header>Communications marketplace report</header><text display-inline="no-display-inline">Title I of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block changed="added" committee-id="HIF00" display-inline="no-display-inline" id="H82CD0CA56C70477F80D690F5470B5007" reported-display-style="italic" style="OLC"><section id="H164574AD841A4148BDB9EF8C00E3A77E"><enum>14.</enum><header>Communications marketplace report</header><subsection id="HFA3B867020494D8484578061D0C8CD67"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the last quarter of every even-numbered year, the Commission shall publish on its website and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the state of the communications marketplace.</text></subsection><subsection id="H154FA4E50D2D4846845B54D54E12DD8B"><enum>(b)</enum><header>Contents</header><text>Each report required by subsection (a) shall—</text><paragraph id="H87502CC517B34F2784D83359BF5BBBCC"><enum>(1)</enum><text display-inline="yes-display-inline">assess the state of competition in the communications marketplace, including competition to deliver voice, video, audio, and data services among providers of telecommunications, providers of commercial mobile service (as defined in section 332), multichannel video programming distributors (as defined in section 602), broadcast stations, providers of satellite communications, Internet service providers, and other providers of communications services;</text></paragraph><paragraph id="H42CD52B3D2D743E2AE8F48D70B2DD352"><enum>(2)</enum><text display-inline="yes-display-inline">assess the state of deployment of communications capabilities, including advanced telecommunications capability (as defined in section 706 of the Telecommunications Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/47/1302">47 U.S.C. 1302</external-xref>)), regardless of the technology used for such deployment, including whether advanced telecommunications capability is being deployed to all Americans in a reasonable and timely fashion;</text></paragraph><paragraph id="H0A84B76D57C94DF98E0D817DBDB30758"><enum>(3)</enum><text display-inline="yes-display-inline">assess whether laws, regulations, or regulatory practices (whether those of the Federal Government, States, political subdivisions of States, Indian tribes or tribal organizations (as such terms are defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>)), or foreign governments) pose a barrier to competitive entry into the communications marketplace or to the competitive expansion of existing providers of communications services;</text></paragraph><paragraph id="HEF46ECF853DB413C98931FFEC2CB814E"><enum>(4)</enum><text display-inline="yes-display-inline">describe the agenda of the Commission for the next 2-year period for addressing the challenges and opportunities in the communications marketplace that were identified through the assessments under paragraphs (1) through (3); and</text></paragraph><paragraph id="H802B27FC716C4C24A234A0EA85377A07"><enum>(5)</enum><text display-inline="yes-display-inline">describe the actions that the Commission has taken in pursuit of the agenda described pursuant to paragraph (4) in the previous report submitted under this section.</text></paragraph></subsection><subsection id="HA8F80E252BDC486780BCC6226667112F"><enum>(c)</enum><header>Extension</header><text display-inline="yes-display-inline">If the President designates a Commissioner as Chairman of the Commission during the last quarter of an even-numbered year, the portion of the report required by subsection (b)(4) may be published on the website of the Commission and submitted to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate as an addendum during the first quarter of the following odd-numbered year.</text></subsection><subsection id="HD58A1286624C4A94BD177D0228B7212D"><enum>(d)</enum><header>Special requirements</header><paragraph id="HCE64D6546D974F4AB82EC9D081A93709"><enum>(1)</enum><header>Assessing competition</header><text display-inline="yes-display-inline">In assessing the state of competition under subsection (b)(1), the Commission shall consider all forms of competition, including the effect of intermodal competition, facilities-based competition, and competition from new and emergent communications services, including the provision of content and communications using the Internet.</text></paragraph><paragraph id="HE29EFB9309AF40ACA1E0597EA22A4C02"><enum>(2)</enum><header>Assessing deployment</header><text display-inline="yes-display-inline">In assessing the state of deployment under subsection (b)(2), the Commission shall compile a list of geographical areas that are not served by any provider of advanced telecommunications capability.</text></paragraph><paragraph id="HE433138C453049CA9C09071E4066F26E"><enum>(3)</enum><header>International comparisons and demographic information</header><text display-inline="yes-display-inline">The Commission may use readily available data to draw appropriate comparisons between the United States communications marketplace and the international communications marketplace and to correlate its assessments with demographic information.</text></paragraph><paragraph id="HBA84D167C4514E258F1EDD5C57C5B52F"><enum>(4)</enum><header>Considering small businesses</header><text display-inline="yes-display-inline">In assessing the state of competition under subsection (b)(1) and regulatory barriers under subsection (b)(3), the Commission shall consider market entry barriers for entrepreneurs and other small businesses in the communications marketplace in accordance with the national policy under section 257(b).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF692E760C07340189D1349FFF1596795"><enum>3.</enum><header>Consolidation of redundant reports; conforming amendments</header><subsection id="H163EB6EAFE0749BEA11BCDA6A3B4F1A4"><enum>(a)</enum><header>ORBIT Act Report</header><text display-inline="yes-display-inline">Section 646 of the Communications Satellite Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/47/765e">47 U.S.C. 765e</external-xref>; 114 Stat. 57) is repealed.</text></subsection><subsection id="HBFBD28E09708459ABB7A274B6054C381"><enum>(b)</enum><header>Satellite Competition Report</header><text display-inline="yes-display-inline">Section 4 of <external-xref legal-doc="public-law" parsable-cite="pl/109/34">Public Law 109–34</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/47/703">47 U.S.C. 703</external-xref>) is repealed.</text></subsection><subsection id="H1914176D6AF74094A860EC9DCB275F4D"><enum>(c)</enum><header>International Broadband Data Report</header><text>Section 103 of the Broadband Data Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/47/1303">47 U.S.C. 1303</external-xref>) is amended—</text><paragraph id="H188D7C7241CA450291AB3A6E2C142EDA"><enum>(1)</enum><text>by striking subsection (b); and</text></paragraph><paragraph id="H55D2EDD74E9D41C2BD560094A6BAA87F"><enum>(2)</enum><text>by redesignating subsections (c) through (e) as subsections (b) through (d), respectively.</text></paragraph></subsection><subsection id="HADFD2E6E01354E63AD096C50979CED98"><enum>(d)</enum><header>Status of Competition in the Market for the Delivery of Video Programming Report</header><text display-inline="yes-display-inline">Section 628 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/548">47 U.S.C. 548</external-xref>) is amended—</text><paragraph id="HA1E45818CD4C4A429EC7F33989157AA3"><enum>(1)</enum><text>by striking subsection (g);</text></paragraph><paragraph id="H9618AADABA1847D4905D67CEE076BC6F"><enum>(2)</enum><text>by redesignating subsection (j) as subsection (g); and</text></paragraph><paragraph id="HA1AC759A3550462992AA342654B1903D"><enum>(3)</enum><text>by transferring subsection (g) (as redesignated) so that it appears after subsection (f).</text></paragraph></subsection><subsection id="H9B560E8DC8EE4065A48D3B50FC0F5C67"><enum>(e)</enum><header>Report on Cable Industry Prices</header><paragraph id="HB009601BA26845A28DEF2C7A00E8B493"><enum>(1)</enum><header>In general</header><text>Section 623 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/543">47 U.S.C. 543</external-xref>) is amended—</text><subparagraph id="H11366C08784A4884BB1BCD5B1681511E"><enum>(A)</enum><text>by striking subsection (k); and</text></subparagraph><subparagraph id="H52B2D0FEB18145FEB6C0A52C2A4CC477"><enum>(B)</enum><text>by redesignating subsections (l) through (n) as subsections (k) through (m), respectively.</text></subparagraph></paragraph><paragraph id="H643905BB069F4F50B7D68B0C2ED5A496"><enum>(2)</enum><header>Conforming amendment</header><text>Section 613(a)(3) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/533">47 U.S.C. 533(a)(3)</external-xref>) is amended by striking <quote>623(l)</quote> and inserting <quote>623(k)</quote>.</text></paragraph></subsection><subsection id="HE8EAC092F87B4892BFD3808D2BD7EA9E"><enum>(f)</enum><header>Triennial Report Identifying and Eliminating Market Entry Barriers for Entrepreneurs and Other Small Businesses</header><text display-inline="yes-display-inline">Section 257 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/257">47 U.S.C. 257</external-xref>) is amended by striking subsection (c).</text></subsection><subsection id="HFE2995D2B41C4DE08ADD42BC8E4E76C1"><enum>(g)</enum><header>Section 706 Report</header><text display-inline="yes-display-inline">Section 706 of the Telecommunications Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/47/1302">47 U.S.C. 1302</external-xref>) is amended—</text><paragraph id="HBDF0AEA31FF24AFCA8A75EE6A9FB4773"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H75D117997099484598BE577B261E2613"><enum>(A)</enum><text>in the last sentence, by striking <quote>If the Commission’s determination is negative, it</quote> and inserting <quote>If the Commission determines in its report under section 14 of the Communications Act of 1934 that advanced telecommunications capability is not being deployed to all Americans in a reasonable and timely fashion, the Commission</quote>; and</text></subparagraph><subparagraph id="H82E7AD7F2D00469DA083BEBF2EFADCDA"><enum>(B)</enum><text>by striking the first and second sentences;</text></subparagraph></paragraph><paragraph id="H0864CD9E88094FCCA18FF2DA4A07F0CB"><enum>(2)</enum><text>by striking subsection (c);</text></paragraph><paragraph id="H7328F7B72E1B4CE5B98EC4FCB3D04015"><enum>(3)</enum><text>in subsection (d), by striking <quote>this subsection</quote> and inserting <quote>this section</quote>; and</text></paragraph><paragraph id="HE9C2B84ACFE942118EC6B86587DEC9B6"><enum>(4)</enum><text>by redesignating subsection (d) as subsection (c).</text></paragraph></subsection><subsection id="H5418E97007EE427E91D03E7004C529D8"><enum>(h)</enum><header>State of Competitive Market Conditions with respect to Commercial Mobile Radio Services</header><text display-inline="yes-display-inline">Section 332(c)(1)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(c)(1)(C)</external-xref>) is amended by striking the first and second sentences.</text></subsection><subsection id="H03F5B9AAA77840F18EE99EB3D0F69DEB"><enum>(i)</enum><header>Previously eliminated annual report</header><paragraph id="H93F3E45425FB479397747E5BE0C8902C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/154">47 U.S.C. 154</external-xref>) is amended—</text><subparagraph id="HB1EDF8C3BE4443A59D189C050A0CF5EE"><enum>(A)</enum><text>by striking subsection (k); and</text></subparagraph><subparagraph id="HF84E9ADAA08E4DFAA8107DD97470DEDB"><enum>(B)</enum><text>by redesignating subsections (l) through (o) as subsections (k) through (n), respectively.</text></subparagraph></paragraph><paragraph id="HEB7D0848B70747A6B3A95483A4F96198"><enum>(2)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">The Communications Act of 1934 is amended—</text><subparagraph id="HE016A74792794C63AF8E9D0997F39CCC"><enum>(A)</enum><text>in section 9(i), by striking <quote>In the Commission’s annual report, the Commission shall prepare an analysis of its progress in developing such systems and</quote> and inserting <quote>The Commission</quote>; and</text></subparagraph><subparagraph id="H8F133BFB84DD456EADB6A0287ED8B8AB"><enum>(B)</enum><text>in section 309(j)(8)(B), by striking the last sentence.</text></subparagraph></paragraph></subsection><subsection id="HE7ECDF90C20E401E9769E393EC244D39"><enum>(j)</enum><header>Additional outdated reports</header><text display-inline="yes-display-inline">The Communications Act of 1934 is further amended—</text><paragraph id="H936068A5D003449FB1E5C35D0B319590"><enum>(1)</enum><text>in section 4—</text><subparagraph display-inline="no-display-inline" id="H290FEADE39304FC5A2568896E56944B5"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b)(2)(B)(ii), by striking <quote>and shall furnish notice of such action</quote> and all that follows through <quote>subject of the waiver</quote>; and</text></subparagraph><subparagraph id="H544C289980CC448B978A3A98AFF423D5"><enum>(B)</enum><text>in subsection (g), by striking paragraph (2);</text></subparagraph></paragraph><paragraph id="HA860903BC36645E9BAC53BA64FA80ADA"><enum>(2)</enum><text>in section 215—</text><subparagraph id="H54F285D62CC74DF4ACEA812921D1CCE4"><enum>(A)</enum><text>by striking subsection (b); and</text></subparagraph><subparagraph id="HD822D2214FB64F84AE4EA066291B4A87"><enum>(B)</enum><text>by id="H77A169B0BA6B43C5B0C7F3E790929BC4"><enum>(C)</enum><text>by striking <quote>Within 180 days after</quote> and all that follows through <quote>to assure such compatibility.</quote>; and</text></subparagraph></paragraph><paragraph id="H6E6173E680384099B9BF7B95CFE1411B"><enum>(11)</enum><text>in section 713, by striking subsection (a).</text></paragraph></subsection></section><section id="H8ED620C4C6814A5C8AAF4AF54071E08D"><enum>4.</enum><header>Effect on authority</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to expand or contract the authority of the Federal Communications Commission.</text></section><section id="H063B22D33DC64596AD010166BE2889D3"><enum>5.</enum><header>Other reports</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to prohibit or otherwise prevent the Federal Communications Commission from producing any additional reports otherwise within the authority of the Commission.</text></section></legis-body><endorsement
